<official-title display="yes">To amend the Gramm-Leach-Bliley Act to update the exception for certain annual notices provided by financial institutions.</official-title>

<section id="H03EA2B74944C449F9CC806CEA1DE5EC5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Privacy Notification Technical Clarification Act</short-title></quote>.</text></section> <section id="H633D0DD16C6D4451BC7F09200F7B2C73"><enum>2.</enum><header>Exception to annual notice requirement</header><text display-inline="no-display-inline">Section 503 of the Gramm-Leach-Bliley Act (<external-xref legal-doc="usc" parsable-cite="usc/15/6803">15 U.S.C. 6803</external-xref>) is amended by adding at the end the following:</text>

<subsection id="HAE75FAB132F74B73BA8CB01642A3E367"><enum>(g)</enum><header>Additional exception to annual notice requirement</header>
<paragraph id="HB08E41EF3DCF4E29B80876465A33670F"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A vehicle financial company that has not changed its policies and practices with regard to disclosing nonpublic personal information from the policies and practices that were disclosed in the most recent disclosure sent to consumers in accordance with this section shall not be required to provide an annual disclosure under this section if—</text> <subparagraph id="H9714DC7A2B264C528581F140A8FD9728"><enum>(A)</enum><text display-inline="yes-display-inline">the vehicle financial company makes its current policy available to consumers on its website and via mail upon written request sent to a designated address identified for the purpose of requesting the policy or upon telephone request made using a toll free consumer service telephone number; </text></subparagraph>
<subparagraph id="H302B9C36ACA847CA9110EFC731CC00FA"><enum>(B)</enum><text display-inline="yes-display-inline">the vehicle financial company conspicuously notifies consumers of the availability of the current policy, including—</text> <clause id="HCAB85E4128904C9D988C7C8EC923BB16"><enum>(i)</enum><text display-inline="yes-display-inline">with respect to consumers who are entitled to a periodic billing statement, a message on the front page of each periodic billing statement; and</text></clause>
<clause id="H4C68B11F2121430A8FF92ED258403E10"><enum>(ii)</enum><text display-inline="yes-display-inline">with respect to consumers who are not entitled to a periodic billing statement, through other reasonable means such as through a link on the landing page of the company’s website or with other written communication, including electronic communication, sent to the consumer; and</text></clause></subparagraph> <subparagraph id="HC84CEB6DFB1348F4896D645F16E4CCC4"><enum>(C)</enum><text display-inline="yes-display-inline">the vehicle financial company—</text>
<clause id="HA6BEEBE39783493DB57BD1E069B18743"><enum>(i)</enum><text>provides consumers with the ability to opt out, subject to any exemption or exception provided under subsection (b)(2) or (e) of section 502 or under regulations prescribed under section 504(b), of having the consumer’s nonpublic personal information disclosed to a nonaffiliated third party; and</text></clause> <clause id="HC7F84FB4C7354A74B9840D3539AEA1B5"><enum>(ii)</enum><text display-inline="yes-display-inline">includes a description about where to locate the procedures for a consumer to select such opt out in each periodic billing statement sent to the consumer.</text></clause></subparagraph></paragraph>
<paragraph id="HFFA5C42CCBA74A8BAA983D3C00F96AA1"><enum>(2)</enum><header>Treatment of multiple policies</header><text display-inline="yes-display-inline">If a vehicle financial company maintains more than one set of policies described under paragraph (1) that vary depending on the consumer’s account status or State of residence, the vehicle financial company may comply with the website posting requirement in paragraph (1)(A) by posting all of such policies to the public section of the vehicle financial company’s website, with instructions for choosing the applicable policy.</text></paragraph> <paragraph id="H49307790422A4EA18DD2DCA824992328"><enum>(3)</enum><header>Vehicle financial company defined</header><text>For purposes of this subsection, the term <quote>vehicle financial company</quote> means—</text>
<subparagraph id="H05CF851B2A3C4727A1D2AE6C9E51D08E"><enum>(A)</enum><text>a financial institution that—</text> <clause id="HCB99B6A5C961461E9974A359913C2D3B"><enum>(i)</enum><text>is regularly engaged in the business of extending credit for the purchase of vehicles;</text></clause>
<clause id="HC95377632F3D4565976048A251944ECD"><enum>(ii)</enum><text>is affiliated with a vehicle manufacturer; and</text></clause> <clause id="H9543EEB2D4D640A68148BDEBFDBD6B7B"><enum>(iii)</enum><text>only shares nonpublic personal information of consumers with nonaffiliated third parties that are vehicle dealers; or</text></clause></subparagraph>
<subparagraph id="H623EAA4B17384460B8461D46DA929A34"><enum>(B)</enum><text display-inline="yes-display-inline">a financial institution that—</text> <clause id="H1D8108285BE44E5FBE2CFCE8AF1FF492"><enum>(i)</enum><text>regularly engages in the business of extending credit for the purchase or lease of vehicles from vehicle dealers; or</text></clause>
<clause id="H930375EA333E46B4B9514536E365AAB0"><enum>(ii)</enum><text>purchases vehicle installment sales contracts or leases from vehicle dealers.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> </legis-body> <attestation><attestation-group><attestation-date date="20171214" chamber="House">Passed the House of Representatives December 14, 2017.</attestation-date><attestor display="no">Karen L.
