			 to provide increased transparency for customers, and for other purposes.<pagebreak></pagebreak></official-title></form>
	<legis-body id="HBDD70B2FB9004A5BA3A52DF7EB01D66D" style="OLC">
 <section id="HCEEDCCD30D8F4C33822BA6382A116D47" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Western Area Power Administration Transparency Act</short-title></quote>.</text> </section><section id="H1CE7BB8C18BC46B3A73212DFDFABC7BB"><enum>2.</enum><header>Western area power administration pilot project</header> <subsection id="H75C14EAB0D30443CB1948EF746E3B8F3"><enum>(a)</enum><header>In general</header><text>Not later than 120 days after the date of enactment of this Act, the Administrator of the Western Area Power Administration (referred to in this section as the <quote>Administrator</quote>) shall establish a pilot project, as part of the continuous process improvement program and to provide increased transparency for customers, to publish on a publicly available website of the Western Area Power Administration, a database of the following information, beginning with fiscal year 2008, relating to the Western Area Power Administration:</text>
 <paragraph id="H8CBA52150C464ECFB6A8DBB2419FB226"><enum>(1)</enum><text>By power system and in a consistent format, rates charged to customers for power and transmission service.</text>
 </paragraph><paragraph id="H56BE93DA471D4BDDB6DE03488B447D7D"><enum>(2)</enum><text>By power system, the amount of capacity or energy sold.</text> </paragraph><paragraph id="H5DD32B0F6738482CACDF350E44B7E042"><enum>(3)</enum><text>By region, a detailed accounting, at the functional level and the budget activity level, of all expenditures, capital costs, and staffing costs, including—</text>
 <subparagraph id="HF1DC95DD5D87409CBCCA54D6401B3DC7"><enum>(A)</enum><text>indirect costs, including overhead costs;</text> </subparagraph><subparagraph id="HEFBA279F37944FEC9418401A8C9711C3"><enum>(B)</enum><text>direct charges and direct allocations;</text>
 </subparagraph><subparagraph id="H256C6E110CBD4943BC7D064123F992BF"><enum>(C)</enum><text>the number of contract staff;</text> </subparagraph><subparagraph id="H644B10027D234CB2A25AF534E44AB0F0"><enum>(D)</enum><text>costs related to independent consultants;</text>
 </subparagraph><subparagraph id="HC0A72DBFE2E14E6F98E35DA2E157364E"><enum>(E)</enum><text>the number of full-time equivalents; and</text> </subparagraph><subparagraph id="HBE4C3A7CDE1E417C9D1A4743D0BD6C8A"><enum>(F)</enum><text>charges to the region from the headquarters office of the Western Area Power Administration for all annual and capital costs.</text>
 </subparagraph></paragraph><paragraph id="H931815B231AE4A7883F1EBDFFAA08DE7"><enum>(4)</enum><text>For the headquarters office of the Western Area Power Administration, a detailed accounting at the functional level and the budget activity level, of all expenditures and capital costs, including—</text>
 <subparagraph id="HE3D9A9870E1B4F18BBD86C4E1B729951"><enum>(A)</enum><text>indirect costs, including overhead costs;</text> </subparagraph><subparagraph id="H88F8B5EC9A87425DBCC735DD64EE0509"><enum>(B)</enum><text>direct charges and direct allocations;</text>
 </subparagraph><subparagraph id="HB83EFD25A1AB42DBBFDF1778C8F49E8C"><enum>(C)</enum><text>the number of contract staff;</text> </subparagraph><subparagraph id="HCC09B8238DB94702B17597FAE8EB068D"><enum>(D)</enum><text>costs related to independent consultants;</text>
 </subparagraph><subparagraph id="HCF9DE674827A4BE5AF9DF85C05D0FB63"><enum>(E)</enum><text>the number of full-time equivalents;</text> </subparagraph><subparagraph id="H1B7C30648C5444B3B44E1D7501DAE1DD"><enum>(F)</enum><text>a summary of any expenditures described in this paragraph, with the total amount paid by each region and power system; and</text>
 </subparagraph><subparagraph id="HCD65ECDA9EC441579B42A06D4F8E84AE"><enum>(G)</enum><text>expenses incurred on behalf of other Federal agencies or programs or third parties for the administration of programs not related to the marketing, transmission, or wheeling of Federal hydropower resources, including—</text>
 <clause id="H0014B59E14CC445BA3FB6788DAED6CF3"><enum>(i)</enum><text>indirect costs, including overhead costs;</text> </clause><clause id="H1249932A6D80471CAD249A3FB4BBCA6B"><enum>(ii)</enum><text>direct charges and allocations;</text>
 </clause><clause id="HA3456483B0D14A28AA4E6221B5BB2504"><enum>(iii)</enum><text>the number of contract staff; and</text> </clause><clause id="H212D0560A2054C47A3644A8BB4C78269"><enum>(iv)</enum><text>the number of full-time equivalents.</text>
 </clause></subparagraph></paragraph><paragraph id="H6D8D0C4CC24142FC9261D228FF812C58"><enum>(5)</enum><text>Capital expenditures, including—</text> <subparagraph id="H2235AB1888C74AD3A85D400F525596B5"><enum>(A)</enum><text>capital investments delineated by the year in which each investment is placed into service; and</text>
 </subparagraph><subparagraph id="HE92840E9C9514A7FA13BE339AFAB46EC"><enum>(B)</enum><text>the sources of capital for each investment.</text> </subparagraph></paragraph></subsection><subsection id="HDB0B2CB6C17B418B8A6DFBF69F08A9B5"><enum>(b)</enum><header>Annual summary</header> <paragraph id="HC939833D594F4C1DA251A12CC933338E"><enum>(1)</enum><header>In general</header><text>Not later than 120 days after the end of each fiscal year in which the pilot project is being carried out under this section, the Administrator shall make available on a publicly available website—</text>
 <subparagraph id="HA407B17D29FD40E28734FF489FEC9178"><enum>(A)</enum><text>updates to documents made available on the date of the initial publication of the information on the website under subsection (a);</text>
 </subparagraph><subparagraph id="H0FE870813DF149D88077BED9796A04FA"><enum>(B)</enum><text>an identification of the magnitude of annual changes in the information published on the website under subsection (a);</text>
 </subparagraph><subparagraph id="H2FD6743A2AC84975BCEFFB3CF8F77CF1"><enum>(C)</enum><text>a description of the reasons for the changes identified under subparagraph (B);</text> </subparagraph><subparagraph id="HF4113F5BAF8E46458BB9AF8708043E53"><enum>(D)</enum><text>subject to paragraph (2), the total amount of the unobligated balances retained by the Western Area Power Administration at the end of the prior fiscal year within each marketing area and headquarters by—</text>
 <clause id="H0B20373F129347E78CC9892960960FAC"><enum>(i)</enum><text>purpose or function;</text> </clause><clause id="H060DC212A5874398BE0D49A6012F568E"><enum>(ii)</enum><text>source of funding;</text>
 </clause><clause id="H6E3F002B62924EA180E7E525573E8862"><enum>(iii)</enum><text>anticipated program allotment; and</text> </clause><clause id="HF2AB3D557BD840E2AF7A862A5041C325"><enum>(iv)</enum><text>underlying authority for each source of funding; and</text>
 </clause></subparagraph><subparagraph id="H7A39FA9F1DF445879653D6F8870D3461"><enum>(E)</enum><text>the anticipated level of unobligated balances that the Western Area Power Administration expects to retain at the end of the fiscal year in which the annual summary is published, as delineated by each of the categories described in clauses (i) through (iv) of subparagraph (D).</text>
 </subparagraph></paragraph><paragraph id="HB2B98C407F754FDC9ED99E26BA4ABDA2"><enum>(2)</enum><header>Limitation</header><text>Amounts in the Upper Colorado River Basin Fund established by section 5(a) of the Act of April 11, 1956 (commonly known as the <quote>Colorado River Storage Project Act</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/43/620d">43 U.S.C. 620d(a)</external-xref>), shall not considered to be an unobligated balance retained by the Western Area Power Administration for purposes of paragraph (1)(D).</text>
 </paragraph></subsection><subsection id="H969AB912FD264713B91749745ED81E8E"><enum>(c)</enum><header>Termination</header><text>The pilot project under this section shall terminate on the date that is 7 years after the date of enactment of this Act.</text>
