 </subparagraph><subparagraph id="HEDC0B19EA3E4400390C5E3EA7EAD1657"><enum>(B)</enum><text>by inserting <quote>and programs of study</quote> after <quote>technical education programs</quote>;</text> </subparagraph></paragraph><paragraph id="H5AD0D9CD7C8443DFB805A181EA3537D5"><enum>(2)</enum><text>in paragraph (3), by striking <quote>, including tech prep education</quote>; and</text>

 <paragraph id="HFB7B4A9111804ED6B8F5ABB537F21F27"><enum>(1)</enum><text>by striking paragraphs (16), (23), (24), (25), (26), and (32);</text> </paragraph><paragraph commented="no" id="HBE3F237AFECE4CFAB83F75EE9E0E8472"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (8), (9), (10), (11), (12), (13), (14), (15), (17), (18), (19), (20), (21), (22), (27), (28), (29), (30), (31), (33), and (34) as paragraphs (9), (10), (13), (16), (17), (19), (20), (23), (25), (27), (28), (30), (32), (35), (39), (40), (41), (44), (45), (46), and (47), respectively;</text>
 </paragraph><paragraph id="H71D78029D6474AF4937026BC720253E6"><enum>(3)</enum><text>in paragraph (3)—</text> <subparagraph id="H60B4317C66034E78B0AE58870720FD89"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (B), by striking <quote>5 different occupational fields to individuals</quote> and inserting <quote>three different fields, especially in in-demand industry sectors or occupations, that are available to all students</quote>; and</text>

 </subclause><subclause id="HAFC993653C2C4BB0BEAE55728CB81206"><enum>(II)</enum><text>by striking <quote>and skills</quote> and inserting <quote>and skills,</quote>; and</text> </subclause><subclause id="HD12F00294F954342BCF935BC85182774"><enum>(III)</enum><text>by inserting <quote>, including in in-demand industry sectors or occupations</quote> before the semicolon at the end;</text>
 </subclause></clause><clause id="H9ACF88FA9F124F7798FE016765E9E037"><enum>(ii)</enum><text display-inline="yes-display-inline">in clause (ii), by striking <quote>, an industry-recognized credential, a certificate, or an associate degree</quote> and inserting <quote>or a recognized postsecondary credential, which may include an industry-recognized credential</quote>; and</text> </clause><clause id="H816E0B4137C147B1BE18ECC4610EA0F9"><enum>(iii)</enum><text>in clause (iii), by striking <quote>and</quote> at the end;</text>
 </clause></subparagraph><subparagraph id="HBFCFF3BFE51C4F92A697FC06D6C652EA"><enum>(B)</enum><text>in subparagraph (B)—</text> <clause id="HC8712851777B40769CFC5ED0CA6D76EF"><enum>(i)</enum><text>by inserting <quote>, work-based, or other</quote> after <quote>competency-based</quote>;</text>
 </clause><clause id="HEBA87A32CCE24B8C909C42F417D7BAD6"><enum>(ii)</enum><text>by striking <quote>contributes to the</quote> and inserting <quote>supports the development of</quote>;</text> </clause><clause id="H6F2D0E93C7BC45A884CFF6EC579E82BC"><enum>(iii)</enum><text>by striking the period at the end and inserting a semicolon; and</text>
 </clause><clause id="H3E201BB8B2D44C66B2F50714B3A5143A"><enum>(iv)</enum><text>by striking <quote>general</quote>; and</text> </clause></subparagraph><subparagraph id="H62B991C2FCDA4A509329E545CD400C08"><enum>(C)</enum><text>by adding at the end the following:</text>

 <subparagraph id="H54E259817A7E44858C2ED253C36F9C60"><enum>(C)</enum><text>to the extent practicable, coordinate between secondary and postsecondary education programs, which may include early college programs with articulation agreements, dual or concurrent enrollment program opportunities, or programs of study; and</text>
 </subparagraph><subparagraph id="H9F17BC7751CF4B9D81F94409A5CA67FB"><enum>(D)</enum><text>may include career exploration at the high school level or as early as the middle grades (as such term is defined in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>)).</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="HDB351A69FDB241FCB8362160AF5534B8"><enum>(5)</enum><text>in paragraph (7)—</text> <subparagraph id="HA0594526F736464AA232AD0ED2C36B05"><enum>(A)</enum><text>in subparagraph (A), by striking <quote>(and parents, as appropriate)</quote> and inserting <quote>(and, as appropriate, parents and out-of-school youth)</quote>; and</text>
 </subparagraph><subparagraph id="H56DC247353A44544AF66852BE3DD7912"><enum>(B)</enum><text>in subparagraph (B), by striking <quote>financial aid,</quote> and all that follows through the period at the end and inserting <quote>financial aid, job training, secondary and postsecondary options (including baccalaureate degree programs), dual or concurrent enrollment programs, work-based learning opportunities, and support services.</quote>;</text>
 </subparagraph></paragraph><paragraph id="HA8F9CFAA4B464AC1B78294017A34F5FB"><enum>(6)</enum><text>by inserting after paragraph (7) the following:</text> <quoted-block display-inline="no-display-inline" id="HAEB186CCE700419BBC127C1DE7C4A862" style="OLC"> <paragraph id="H0951F2B6928B46D888AF3B7EF03CE10B"><enum>(8)</enum><header>Career pathways</header><text display-inline="yes-display-inline">The term <term>career pathways</term> has the meaning given the term in section 3 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3102">29 U.S.C. 3102</external-xref>).</text></paragraph><after-quoted-block>; </after-quoted-block></quoted-block>
 </paragraph><paragraph id="H44476A26BE7F47448CBA5403E004E7CE"><enum>(7)</enum><text display-inline="yes-display-inline">by inserting after paragraph (10) (as so redesignated by paragraph (2)) the following:</text> <quoted-block display-inline="no-display-inline" id="HA0C625F2C0F3469BA2E84CE5EE4624D7" style="OLC"> <paragraph id="H8F535C9C346F4575ADBA78E1AD3CB0A3"><enum>(11)</enum><header>CTE concentrator</header><text display-inline="yes-display-inline">The term <term>CTE concentrator</term> means—</text>
 <subparagraph id="H899E21F761E74D2085B6FD04E94D257A"><enum>(A)</enum><text>at the secondary school level, a student served by an eligible recipient who has—</text> <clause id="H48110D7D64D54D7E8A027808EBAA4182"><enum>(i)</enum><text>completed three or more career and technical education courses; or</text>
 </clause><clause id="H265A77D1575B445FBAD0556D4DBD70AC"><enum>(ii)</enum><text>completed at least two courses in a single career and technical education program or program of study; or</text>
 </clause></subparagraph><subparagraph id="HF2335876F9DA41D8888A24B6ADE6670C"><enum>(B)</enum><text>at the postsecondary level, a student enrolled in an eligible recipient who has—</text> <clause id="H1810ACB621034767A1A4AA64A2D1A8F6"><enum>(i)</enum><text>earned at least 12 cumulative credits within a career and technical education program or program of study; or</text>
 </clause><clause id="HF3698D7C78964246AA6A1B10EA0EBB3B"><enum>(ii)</enum><text>completed such a program if the program encompasses fewer than 12 credits or the equivalent in total.</text>
 </clause></subparagraph></paragraph><paragraph id="H8872944B6E8244CEB67C58F8AB8B8C70"><enum>(12)</enum><header>CTE Participant</header><text display-inline="yes-display-inline">The term <term>CTE participant</term> means an individual who completes not less than one course or earns not less than one credit in a career and technical education program or program of study of an eligible recipient.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
 </paragraph><paragraph id="H407327CD38DE4BEF803529C617582B21"><enum>(8)</enum><text display-inline="yes-display-inline">by inserting after paragraph (13) (as so redesignated by paragraph (2)) the following:</text> <quoted-block display-inline="no-display-inline" id="H4603B441663643249614DBD224F50186" style="OLC"> <paragraph id="H6CB05886A059464E858A0C59C1B13193"><enum>(14)</enum><header>Dual or concurrent enrollment</header><text>The term <term>dual or concurrent enrollment</term> has the meaning given the term in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text>
 </paragraph><paragraph id="H31FCF9E316B543FCA7130979172E1CB9"><enum>(15)</enum><header>Early college high school</header><text>The term <term>early college high school</term> has the meaning given the term in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>

 </subparagraph></paragraph><paragraph id="H42A816E2B1444CB3A60EA2ACE9F394F6"><enum>(37)</enum><header>Qualified intermediary</header><text display-inline="yes-display-inline">The term <term>qualified intermediary</term> means a nonprofit entity that demonstrates expertise to build, connect, sustain, and measure partnerships with entities such as employers, schools, community-based organizations, postsecondary institutions, social service organizations, economic development organizations, and workforce systems to broker services, resources, and supports to youth and the organizations and systems that are designed to serve youth, including—</text>

 </subparagraph><subparagraph id="H4B8A489EA5F643CEA0279954F715B826"><enum>(C)</enum><text>delivering professional development;</text> </subparagraph><subparagraph id="H1CFCDC119B0042CABD344DC18DDE76AC"><enum>(D)</enum><text>connecting students to internships and other work-based learning opportunities; and</text>
 </subparagraph><subparagraph id="H56DE4976A24C45B686D1A7883085D8A2"><enum>(E)</enum><text>developing personalized student supports.</text> </subparagraph></paragraph><paragraph id="HB7A3C4E60CDD4B6CB5FF752B8EC57077"><enum>(38)</enum><header>Recognized postsecondary credential</header><text display-inline="yes-display-inline">The term <term>recognized postsecondary credential</term> has the meaning given the term in section 3 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3102">29 U.S.C. 3102</external-xref>).</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>

 </paragraph><paragraph id="H74A1AA449E274AA18754E24A45134CB5"><enum>(2)</enum><text>through grants, contracts, or other cooperative agreements, to mandate, direct, or control a State, local educational agency, eligible agency, eligible recipient, eligible entity, or school’s specific instructional content, academic standards and assessments, curricula, or program of instruction (including any requirement, direction, or mandate to adopt the Common Core State Standards developed under the Common Core State Standards Initiative, any other academic standards common to a significant number of States, or any assessment, instructional content, or curriculum aligned to such standards); and</text>

 <clause commented="no" id="H585F4D2836B24D309EFE20186D9507B8"><enum>(i)</enum><text>The percentage of CTE concentrators who graduate high school, as measured by—</text> <subclause commented="no" id="H126AFB7870A0407D943E5195C434C365"><enum>(I)</enum><text>the four-year adjusted cohort graduation rate (defined in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>)); and</text>
 </subclause><subclause commented="no" id="HD3F540CD73714DA3926048DD58FDEBAE"><enum>(II)</enum><text display-inline="yes-display-inline">at the State’s discretion, the extended-year adjusted cohort graduation rate defined in such section 8101 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text>
 </subclause></clause><clause commented="no" id="H3AA0D2E9EBF74C379320E3B9729A7A76"><enum>(ii)</enum><text display-inline="yes-display-inline">CTE concentrator attainment of challenging State academic standards adopted by the State under section 1111(b)(1) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311(b)(1)</external-xref>), and measured by the academic assessments described in section 1111(b)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311(b)(2)</external-xref>).</text>
 </clause><clause commented="no" id="H1C8F2161A0A74FE4BBA58C4150CB3692"><enum>(iii)</enum><text>The percentage of CTE concentrators who, in the second quarter following the program year after exiting from secondary education, are in postsecondary education or advanced training, military service, or unsubsidized employment.</text>
 </clause><clause commented="no" id="H5264F4AEE5324FA8A7AD8BA5699EF507"><enum>(iv)</enum><text>Not less than one indicator of career and technical education program quality that—</text> <subclause commented="no" id="HDA406491D01645D68BF074CB274CCB93"><enum>(I)</enum><text>shall include, not less than one of the following—</text>
 <item commented="no" id="H5B886B5E35EE4B74B70ABEA708C77879"><enum>(aa)</enum><text display-inline="yes-display-inline">the percentage of CTE concentrators, as defined in section 3(11)(A)(ii), graduating from high school having attained recognized postsecondary credentials;</text>
 </item><item commented="no" id="HD7976299B9144BCD86F461497C7B975E"><enum>(bb)</enum><text display-inline="yes-display-inline">the percentage of CTE concentrators, as defined in section 3(11)(A)(ii), graduating from high school having attained postsecondary credits in the relevant career and technical educational program or program of study earned through dual and concurrent enrollment or another credit transfer agreement; or</text>
 </item><item commented="no" id="HF8495EE3712F41B8B741C520A2E20A99"><enum>(cc)</enum><text display-inline="yes-display-inline">the percentage of CTE concentrators, as defined in section 3(11)(A)(ii), graduating from high school having participated in work-based learning; and</text>
 </item></subclause><subclause commented="no" id="H3200F78446184895A443ACCFBF0600ED"><enum>(II)</enum><text>may include any other measure of student success in career and technical education that is statewide, valid, and reliable.</text>
 </subclause></clause><clause commented="no" id="HD218616ED2F14967837ECAA5E089E82C"><enum>(v)</enum><text>The percentage of CTE concentrators, as defined in section 3(11)(A)(ii), in career and technical education programs and programs of study that lead to nontraditional fields.</text>
 </clause></subparagraph><subparagraph commented="no" id="H547C7AB5068B48D699149762389184A2"><enum>(B)</enum><header>Core indicators of performance for CTE concentrators at the postsecondary level</header><text>Each eligible agency shall identify in the State plan core indicators of performance for CTE concentrators at the postsecondary level that are valid and reliable, and that include, at a minimum, measures of each of the following:</text>
 <clause commented="no" id="HE1D53C011FB64E78B850FF16F36DC273"><enum>(i)</enum><text>The percentage of CTE concentrators, who, during the second quarter after program completion, are in education or training activities, advanced training, or unsubsidized employment.</text>
 </clause><clause commented="no" id="H903D144D567447D382A5DD1E2C9FBEA6"><enum>(ii)</enum><text>The median earnings of CTE concentrators in unsubsidized employment two quarters after program completion.</text>
 </clause><clause commented="no" id="HC865AFBD38964BD788F45775614C429D"><enum>(iii)</enum><text>The percentage of CTE concentrators who receive a recognized postsecondary credential during participation in or within 1 year of program completion.</text>
 </clause><clause commented="no" id="HD96BAF732C384B7FA6F3F8105839E66B"><enum>(iv)</enum><text>The percentage of CTE concentrators in career and technical education programs and programs of study that lead to nontraditional fields.</text>
 </clause></subparagraph><subparagraph id="H919F246E7C7B4A1BAD748CB5ABFB6802"><enum>(C)</enum><header>Alignment of performance indicators</header><text display-inline="yes-display-inline">In developing core indicators of performance under subparagraphs (A) and (B), an eligible agency shall, to the greatest extent possible, align the indicators so that substantially similar information gathered for other State and Federal programs, or for any other purpose, may be used to meet the requirements of this section.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
 </subparagraph><subparagraph id="HC7F22D3004C044F2B8D9F971D4FF2654"><enum>(D)</enum><text>in paragraph (3)—</text> <clause id="H60B49722426E4D398B7E3412D768003F"><enum>(i)</enum><text>by amending subparagraph (A) to read as follows:</text>
								<quoted-block display-inline="no-display-inline" id="H042DD2D9E6184552AF65329CC723B777" style="OLC">
									<subparagraph id="H4F3C133FE3504AA2A5DDCCFE3EC5503B"><enum>(A)</enum><header>State adjusted levels of performance for core indicators of performance</header>
 <clause id="H299D39158D5E49178A7D92F1A187934C"><enum>(i)</enum><header>In general</header><text>Each eligible agency, with input from eligible recipients, shall establish and identify in the State plan submitted under section 122, for the first 2 program years covered by the State plan, State levels of performance for each of the core indicators of performance described in subparagraphs (A) and (B) of paragraph (2) for career and technical education activities authorized under this title. The levels of performance established under this subparagraph shall, at a minimum—</text>
 <subclause id="HEBC69B4FB0254EB4B1094C1891063C37"><enum>(I)</enum><text>be expressed in a percentage or numerical form, so as to be objective, quantifiable, and measurable; and</text>
 </subclause><subclause id="H423EFFBA3E32464F968BF4D9CA04464B"><enum>(II)</enum><text>be sufficiently ambitious to allow for meaningful evaluation of program quality.</text> </subclause></clause><clause id="HBE38D67AC3664810983F5E46EE910A68"><enum>(ii)</enum><header>State adjusted levels of performance for subsequent years</header><text>Prior to the third program year covered by the State plan, each eligible agency shall revise the State levels of performance for each of the core indicators of performance for the subsequent program years covered by the State plan, taking into account the extent to which such levels of performance promote meaningful program improvement on such indicators. The State adjusted levels of performance identified under this clause shall be considered to be the State adjusted levels of performance for the State for such years and shall be incorporated into the State plan.</text>
 </clause><clause commented="no" id="HD55EE10F0AEB45AF8EEAF318D7EA17A2"><enum>(iii)</enum><header>Reporting</header><text>The eligible agency shall, for each year described in clauses (i) and (iii), publicly report and widely disseminate the State levels of performance described in this subparagraph.</text>
 </clause><clause id="HD2CFB3A1759E42CEB3E866AED434096F"><enum>(iv)</enum><header>Revisions</header><text>If unanticipated circumstances arise in a State, the eligible agency may revise the State adjusted levels of performance required under this subparagraph, and submit such revised levels of performance with evidence supporting the revision and demonstrating public consultation, in a manner consistent with the procedure described in subsections (d) and (f) of section 122.</text></clause></subparagraph><after-quoted-block>; </after-quoted-block></quoted-block>
 </clause><clause id="H2D57D7AC372E4EC5ADF66CC930E62363"><enum>(ii)</enum><text>by striking subparagraph (B) and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="HEE2039E4E38D433CBB847092BAA06CCF" style="OLC"> <subparagraph id="HAF22E129455E405EA80FFA2F6BB03A1A"><enum>(B)</enum><header>Actual levels of performance</header><text>At the end of each program year, the eligible agency shall determine actual levels of performance on each of the core indicators of performance and publicly report and widely disseminate the actual levels of performance described in this subparagraph.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </clause><clause id="HC4602C6E340043EA939694FA211DF569"><enum>(iii)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H49FC323EBD7043E19471136353FEB65A" style="OLC"> <subparagraph commented="no" id="HAC3ED8BD798A48EC9551499E03239081"><enum>(C)</enum><header> Establishment of levels of performance</header><text display-inline="yes-display-inline">An eligible agency shall establish State levels of performance under subparagraph (A) in a manner consistent with the procedure adopted by the eligible agency under section 122(d)(9).</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block>

 <subparagraph id="H37C272771B5049B2A82108D5442B8B09"><enum>(B)</enum><header>Contents</header><text>The evaluation required under subparagraph (A) shall include descriptions and evaluations of—</text> <clause id="HC492EE9B532A4D9F865CFEBA1854CFD7"><enum>(i)</enum><text>the extent and success of the integration of challenging State academic standards adopted under 1111(b)(1) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311(b)(1)</external-xref>) and career and technical education for students participating in career and technical education programs, including a review of the effect of such integration on the academic and technical proficiency achievement of such students (including the number of such students that receive a regular high school diploma, as such term is defined under section 8101 of the Elementary and Secondary Education Act of 1965 or a State-defined alternative diploma described in section 8101(25)(A)(ii)(I)(bb) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801(25)(A)(ii)(I)(bb)</external-xref>));</text>
 </clause><clause id="H14A1C2091E7645ABAA3A266FB936BE66"><enum>(ii)</enum><text>the extent to which career and technical education programs and programs of study prepare students, including special populations, for subsequent employment in high-skill, high-wage occupations (including those in which mathematics and science, which may include computer science, skills are critical), or for participation in postsecondary education;</text>
 </clause><clause id="H68EAFD59124540548ADE3F8EE568CC5C"><enum>(iii)</enum><text>employer involvement in, benefit from, and satisfaction with, career and technical education programs and programs of study and career and technical education students’ preparation for employment;</text>
 </clause><clause id="H2DB1075647474AB3AC13419CAFC7D341"><enum>(iv)</enum><text>efforts to expand access to career and technical education programs of study for all students;</text> </clause><clause id="H5A501613E62E45A5B406546CF79542C2"><enum>(v)</enum><text>innovative approaches to work-based learning programs that increase participation and alignment with employment in high-growth industries, including in rural and low-income areas;</text>
 </clause><clause commented="no" id="HD472660EE875493080CB969AFCE71429"><enum>(vi)</enum><text>the impact of the amendments to this Act made under the <short-title>Strengthening Career and Technical Education for the 21st Century Act</short-title>, including comparisons, where appropriate, of—</text> <subclause commented="no" id="HC0C84D303F9747ED9D00FD804E8F0EEF"><enum>(I)</enum><text>the use of the comprehensive needs assessment under section 134(b);</text>
 </subclause><subclause commented="no" id="H73FC6F48EA7345368E5AD3923922DE9F"><enum>(II)</enum><text>the implementation of programs of study; and</text> </subclause><subclause commented="no" id="H611F90D2411B495A9809C97F1727C454"><enum>(III)</enum><text>coordination of planning and program delivery with other relevant laws, including the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3101">29 U.S.C. 3101</external-xref> et seq.) and the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6301">20 U.S.C. 6301</external-xref> et seq.);</text>
 </subclause></clause><clause id="HCA6A8E31960A42E2AA1AF8303C12E0A4"><enum>(vii)</enum><text display-inline="yes-display-inline">changes in career and technical education program accountability as described in section 113 and any effects of such changes on program delivery and program quality; and</text>

 </subclause></clause></subparagraph><subparagraph id="HA025BFC34DE74EA8B69BE525FDD40448"><enum>(C)</enum><text>by striking paragraphs (3), (4), and (5) and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="H09819EB43E7043D69C6B3FDF03D221CE" style="OLC"> <paragraph id="HBAFB0E14F87E4A4DA5CE792754C5086B"><enum>(3)</enum><header>Innovation</header> <subparagraph commented="no" id="H86A3F93B8C9344DCA7AA8C4806A6C6E5"><enum>(A)</enum><header>Grant program</header><text display-inline="yes-display-inline">To identify and support innovative strategies and activities to improve career and technical education and align workforce skills with labor market needs as part of the plan developed under subsection (c) and the requirements of this subsection, the Secretary may award grants to eligible entities to—</text>
 <clause commented="no" id="H4539B5F393DA44B7AB000B3DDA7BEC95"><enum>(i)</enum><text>create, develop, implement, or take to scale evidence-based, field initiated innovations, including through a pay for success initiative to improve student outcomes in career and technical education; and</text>
 </clause><clause commented="no" id="H63948DE075544370993D8F2255736036"><enum>(ii)</enum><text>rigorously evaluate such innovations.</text> </clause></subparagraph><subparagraph commented="no" id="HEE1ED6472A344104989A7A3B34C4F880"><enum>(B)</enum><header>Matching funds</header> <clause commented="no" id="H68F4D7A790B846C78FBDF396E4D00495"><enum>(i)</enum><header>Matching funds required</header><text>Except as provided under clause (ii), to receive a grant under this paragraph, an eligible entity shall, through cash or in-kind contributions, provide matching funds from public or private sources in an amount equal to at least 50 percent of the funds provided under such grant.</text>
 </clause><clause commented="no" id="H2CCFF3BB25C94058BC0C8370FC3C0071"><enum>(ii)</enum><header>Exception</header><text>The Secretary may waive the matching fund requirement under clause (i) if the eligible entity demonstrates exceptional circumstances.</text>
 </clause></subparagraph><subparagraph id="HB2B908C1E1D9483EBBF40EB39FA00E05"><enum>(C)</enum><header>Application</header><text>To receive a grant under this paragraph, an eligible entity shall submit to the Secretary at such a time as the Secretary may require, an application that—</text>
 <clause id="HA9CC9D74031840D1BA0F4F3ABED819C9"><enum>(i)</enum><text>identifies and designates the agency, institution, or school responsible for the administration and supervision of the program assisted under this paragraph;</text>
 </clause><clause id="H4B9945761F3548969B09966F71454099"><enum>(ii)</enum><text>identifies the source and amount of the matching funds required under subparagraph (B)(i);</text> </clause><clause id="HBEDB937EDD60489E9F471447635ACC7E"><enum>(iii)</enum><text>describes how the eligible entity will use the grant funds, including how such funds will directly benefit students, including special populations, served by the eligible entity;</text>
 </clause><clause id="HF6FE3B1799224F64A64AC755F83E916B"><enum>(iv)</enum><text>describes how the program assisted under this paragraph will be coordinated with the activities carried out under section 124 or 135;</text>
 </clause><clause id="H1F720D8A1AD4488BA153DB50A4CACBE9"><enum>(v)</enum><text>describes how the program assisted under this paragraph aligns with the single plan described in subsection (c); and</text>
 </clause><clause id="H1F8820CE8E6547D28E87E897FFBDAEC5"><enum>(vi)</enum><text>describes how the program assisted under this paragraph will be evaluated and how that evaluation may inform the report described in subsection (d)(2)(C).</text>
 </clause></subparagraph><subparagraph id="H7955B0DD34A7457FA631D83635039285"><enum>(D)</enum><header>Priority</header><text display-inline="yes-display-inline">In awarding grants under this paragraph, the Secretary shall give priority to applications from eligible entities that will predominantly serve students from low-income families.</text>
									</subparagraph><subparagraph id="H47683D4036334D0592D07CC05EB4BFEF"><enum>(E)</enum><header>Geographic diversity</header>
 <clause id="HCC52A1FE5AFE407C9FA0A7540D6978E5"><enum>(i)</enum><header>In general</header><text>In awarding grants under this paragraph, the Secretary shall award no less than 25 percent of the total available funds for any fiscal year to eligible entities proposing to fund career and technical education activities that serve—</text>
 <subclause id="HCF2F8AA7871C49F7A93BF41BA7E7BD5B"><enum>(I)</enum><text>a local educational agency with an urban-centric district locale code of 32, 33, 41, 42, or 43, as determined by the Secretary;</text>
 </subclause><subclause id="H546FEE86B1B04A1EBADF042D5C2F425D"><enum>(II)</enum><text>an institution of higher education primarily serving the one or more areas served by such a local educational agency;</text>
 </subclause><subclause id="H3E174D97EB44420F8C555E22755FC764"><enum>(III)</enum><text>a consortium of such local educational agencies or such institutions of higher education;</text> </subclause><subclause id="H6C354BD17B6C46E79AA1C8181D30CF72"><enum>(IV)</enum><text>a partnership between—</text>
 <item id="H86B76D210E754D5D9990EF3AE21AE184"><enum>(aa)</enum><text>an educational service agency or a nonprofit organization; and</text> </item><item id="H43DE990C14C546448580ED90F0156414"><enum>(bb)</enum><text>such a local educational agency or such an institution of higher education; or</text>
 </item></subclause><subclause id="HA828B15F677A4678A2C236F475A04CCD"><enum>(V)</enum><text>a partnership between—</text> <item id="H7F1B2F2BF37A41829EAA460C5620B708"><enum>(aa)</enum><text>a grant recipient described in subclause (I) or (II); and</text>
 </item><item id="HC2C73D8D17AC4C4F841B954BE3738211"><enum>(bb)</enum><text>a State educational agency.</text> </item></subclause></clause><clause id="H7AB09ACE81944576B3B1B583086597A8"><enum>(ii)</enum><header>Exception</header><text display-inline="yes-display-inline">Notwithstanding clause (i), the Secretary shall reduce the amount of funds made available under such clause if the Secretary does not receive a sufficient number of applications of sufficient quality.</text>
 </clause></subparagraph><subparagraph id="HFC377EB1532042A4828F9B2ACA62826A"><enum>(F)</enum><header>Uses of funds</header><text>An eligible entity that is awarded a grant under this paragraph shall use the grant funds, in a manner consistent with subparagraph (A)(i), to—</text>
 <clause id="H29A234E12A1845DCAB9463FC57E0FE1F"><enum>(i)</enum><text>improve career and technical education outcomes of students served by eligible entities under this title;</text>
 </clause><clause id="HA0BF40E502864A19A402C03B81D33B4F"><enum>(ii)</enum><text>improve career and technical education teacher effectiveness;</text> </clause><clause id="H8E2079FA565C4987B4D5549A0FB8DCDC"><enum>(iii)</enum><text>improve the transition of students from secondary education to postsecondary education or employment;</text>
 </clause><clause id="H4303B65D79C247909C72992E6C21FB8F"><enum>(iv)</enum><text>improve the incorporation of comprehensive work-based learning into career and technical education;</text> </clause><clause id="HD8936A488B7A4E8A948048B923ED3847"><enum>(v)</enum><text>increase the effective use of technology within career and technical education programs;</text>
 </clause><clause id="HF5D57045AA024BEDB1C255C637909D17"><enum>(vi)</enum><text>support new models for integrating academic content and career and technical education content in such programs;</text>
 </clause><clause id="HC56D50C7EE3A45FABA3FA900A46E802E"><enum>(vii)</enum><text>support the development and enhancement of innovative delivery models for career and technical education;</text>
 </clause><clause id="H275E3DD4322646DCA592DE8832C5AC4A"><enum>(viii)</enum><text>work with industry to design and implement courses or programs of study aligned to labor market needs in new or emerging fields;</text>
 </clause><clause id="H4CE5E6968EC94DBBBB832A0948CBCA77"><enum>(ix)</enum><text>integrate science, technology, engineering, and mathematics fields, including computer science education, with career and technical education;</text>
 </clause><clause id="HC73758A242614B0DBF3818AEDA712F67"><enum>(x)</enum><text>support innovative approaches to career and technical education by redesigning the high school experience for students, which may include evidence-based transitional support strategies for students who have not met postsecondary education eligibility requirements;</text>
 </clause><clause id="H9060726133D6491B9B4220103B9C61F1"><enum>(xi)</enum><text>improve CTE concentrator employment outcomes in nontraditional fields; or</text> </clause><clause id="H7F1DB7952A2F4E51A7A1D149B6DC5E66"><enum>(xii)</enum><text>support the use of career and technical education programs and programs of study in a coordinated strategy to address identified employer needs and workforce shortages, such as shortages in the early childhood, elementary school, and secondary school education workforce.</text>
 </clause></subparagraph><subparagraph id="HDAAA4A41DD984CFDBAA19A9DF2AEE187"><enum>(G)</enum><header>Evaluation</header><text>Each eligible entity receiving a grant under this paragraph shall provide for an independent evaluation of the activities carried out using such grant and submit to the Secretary an annual report that includes—</text>
 <clause id="HF2CC9EBA0A394792A7CF2AA9A53DCBFD"><enum>(i)</enum><text>a description of how funds received under this paragraph were used;</text> </clause><clause commented="no" id="HE37B22D5FE704E59A2F246E0D4BC35EF"><enum>(ii)</enum><text>the performance of the eligible entity with respect to, at a minimum, the performance indicators described under section 113, as applicable, and disaggregated by—</text>
 <subclause commented="no" id="H23F7E5443CC649E19E3B1D0A22227136"><enum>(I)</enum><text>subgroups of students described in section 1111(c)(2)(B) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311(c)(2)(B)</external-xref>);</text>
 </subclause><subclause commented="no" id="H657F3D8B580343DAA336AADA9D1930C3"><enum>(II)</enum><text display-inline="yes-display-inline">special populations; and</text> </subclause><subclause commented="no" id="H04489F4FF4AF405BB52F5C679CFCBF08"><enum>(III)</enum><text>as appropriate, each career and technical education program and program of study; and</text>
 </subclause></clause><clause id="H3CFF443649BA4AE59A460ED0576FBE89"><enum>(iii)</enum><text>a quantitative analysis of the effectiveness of the project carried out under this paragraph.</text></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block> </subparagraph></paragraph><paragraph commented="no" id="HAAAC491F172D4EE78C66EE2D6CBF4F60"><enum>(5)</enum><text>by striking subsection (e) and inserting the following:</text>

 </paragraph><paragraph id="H344738EBD96742EC8F52257E560566B7"><enum>(2)</enum><header>Single plan</header><text display-inline="yes-display-inline">If the eligible agency elects not to submit a combined plan as described in paragraph (1), such eligible agency shall submit a single State plan.</text>
								</paragraph></subsection><subsection id="H44CBBB822EE84C5CB9EB3757675D9892"><enum>(c)</enum><header>Plan development</header>
 <paragraph id="H9EA3CB370ADE4113A86986A52CF0B55C"><enum>(1)</enum><header>In general</header><text>The eligible agency shall—</text> <subparagraph id="HFB40D8D3F26B4FE580462685D7F10FFD"><enum>(A)</enum><text>develop the State plan in consultation with—</text>
 <clause id="H9073E8413547435489B45CA8C1C823A9"><enum>(i)</enum><text>representatives of secondary and postsecondary career and technical education programs, including eligible recipients and representatives of 2-year Minority-Serving Institutions and Historically Black Colleges and Universities in States where such institutions are in existence, and charter school representatives in States where such schools are in existence, which shall include teachers, school leaders, specialized instructional support personnel (including guidance counselors), and paraprofessionals;</text>
 </clause><clause id="H6AC3FF19981C4773BE2D6965FBACCD05"><enum>(ii)</enum><text>interested community representatives, including parents and students;</text> </clause><clause id="H347B271E55AF4493A0E87007DB6D007E"><enum>(iii)</enum><text>the State workforce development board described in section 101 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3111">29 U.S.C. 3111</external-xref>);</text>
 </clause><clause id="H62FB23EBF6D549CEA3366C2A1A152192"><enum>(iv)</enum><text>representatives of special populations;</text> </clause><clause id="HCEED68E359064EB89C323B089F8B0558"><enum>(v)</enum><text>representatives of business and industry (including representatives of small business), which shall include representatives of industry and sector partnerships in the State, as appropriate, and representatives of labor organizations in the State;</text>
 </clause><clause id="H5E5F7EA8C8D34CD1830B3A59FD16D723"><enum>(vi)</enum><text>representatives of agencies serving out-of-school youth, homeless children and youth, and at-risk youth; and</text>
 </clause><clause id="H3ACF98FF04EF4660A1582EC70C2B5100"><enum>(vii)</enum><text>representatives of Indian tribes located in the State; and</text> </clause></subparagraph><subparagraph commented="no" id="H68A5B337AF434E2CA3C15FBE9BABF6E4"><enum>(B)</enum><text>consult the Governor of the State, and the heads of other State agencies with authority for career and technical education programs that are not the eligible agency, with respect to the development of the State plan.</text>
 </subparagraph></paragraph><paragraph id="H6775C1BA5BC94DCDB8014A149A0779E1"><enum>(2)</enum><header>Activities and procedures</header><text>The eligible agency shall develop effective activities and procedures, including access to information needed to use such procedures, to allow the individuals and entities described in paragraph (1) to participate in State and local decisions that relate to development of the State plan.</text>
 </paragraph></subsection><subsection id="HB953EF4E26B84A48855031ECDE3F0560"><enum>(d)</enum><header>Plan contents</header><text>The State plan shall include—</text> <paragraph id="H7254453453B1456F92AA432C9DE99215"><enum>(1)</enum><text>a summary of State-supported workforce development activities (including education and training) in the State, including the degree to which the State’s career and technical education programs and programs of study are aligned with such activities;</text>
 </paragraph><paragraph id="H00AE334A5D3C4BDE923A75C63F7CD3FB"><enum>(2)</enum><text>the State’s strategic vision and set of goals for preparing an educated and skilled workforce (including special populations) and for meeting the skilled workforce needs of employers, including in-demand industry sectors and occupations as identified by the State, and how the State’s career and technical education programs will help to meet these goals;</text>
 </paragraph><paragraph id="H9894FD2581FE4BC4A40436ABF923E6C4"><enum>(3)</enum><text>a summary of the strategic planning elements of the unified State plan required under section 102(b)(1) of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3112">29 U.S.C. 3112(b)(1)</external-xref>), including the elements related to system alignment under section 102(b)(2)(B) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3112">29 U.S.C. 3112(b)(2)(B)</external-xref>);</text>
 </paragraph><paragraph id="H12165B51B00A42849536A81CF60CC3A0"><enum>(4)</enum><text>a description of the career and technical education programs or programs of study that will be supported, developed, or improved, including descriptions of—</text>
 <subparagraph id="H57BD23535FA44A0B8E7D0CF12BB1E986"><enum>(A)</enum><text>the programs of study to be developed at the State level and made available for adoption by eligible recipients;</text>
 </subparagraph><subparagraph id="H387D7044622440FEB6B3BEA133428066"><enum>(B)</enum><text>the process and criteria to be used for approving locally developed programs of study or career pathways, including how such programs address State workforce development and education needs; and</text>
 </subparagraph><subparagraph id="HF86D627896DF424B9022C625845D2FAA"><enum>(C)</enum><text>how the eligible agency will—</text> <clause id="H4DC283AC011742CBAD167B0443AD183B"><enum>(i)</enum><text>make information on approved programs of study and career pathways, including career exploration, work-based learning opportunities, guidance and advisement resources, available to students and parents;</text>
 </clause><clause id="H706C73C83B8E467DA33A9E60B7EF460D"><enum>(ii)</enum><text>ensure nonduplication of eligible recipients’ development of programs of study and career pathways;</text> </clause><clause id="H366B0A2C8EC94ED5B77067853486C007"><enum>(iii)</enum><text>determine alignment of eligible recipients’ programs of study to the State, regional or local economy, including in-demand fields and occupations identified by the State workforce development board as appropriate;</text>
 </clause><clause id="HB3621939A0AE4278B41E4BA6039B6AD0"><enum>(iv)</enum><text>provide equal access to activities assisted under this Act for special populations;</text> </clause><clause id="H8D0435096D634390B1E38582E79C91DC"><enum>(v)</enum><text display-inline="yes-display-inline">coordinate with the State workforce board to support the local development of career pathways and articulate processes by which career pathways will be developed by local workforce development boards;</text>
 </clause><clause id="HEF3EC4ED82A34016A23C42E3C8A67343"><enum>(vi)</enum><text>use State, regional, or local labor market data to align career and technical education with State labor market needs;</text>
 </clause><clause id="H0045E78038174BE293BCBE223BA38DEF"><enum>(vii)</enum><text>support effective and meaningful collaboration between secondary schools, postsecondary institutions, and employers; and</text>
 </clause><clause id="HCFFE1F6E64CF49AD9255CBD42E36F08C"><enum>(viii)</enum><text>improve outcomes for CTE concentrators, including those who are members of special populations;</text> </clause></subparagraph></paragraph><paragraph id="HF998B5457BAA4D2FAA8E385B277C0EB8"><enum>(5)</enum><text>a description of the criteria and process for how the eligible agency will approve eligible recipients for funds under this Act, including how—</text>
 <subparagraph id="HFD7160349265485D9730644BA5F4987B"><enum>(A)</enum><text>each eligible recipient will promote academic achievement;</text> </subparagraph><subparagraph id="H8A1411EE114343A8B3C849DDEEC356A8"><enum>(B)</enum><text>each eligible recipient will promote skill attainment, including skill attainment that leads to a recognized postsecondary credential; and</text>
 </subparagraph><subparagraph id="H45BD9CE33D6647CA940831751A3AC167"><enum>(C)</enum><text>each eligible recipient will ensure the local needs assessment under section 134 takes into consideration local economic and education needs, including where appropriate, in-demand industry sectors and occupations;</text>
 </subparagraph></paragraph><paragraph id="HBA0DA3F4B73A4EA68FCBAF44A83E6442"><enum>(6)</enum><text>a description of how the eligible agency will support the recruitment and preparation of teachers, including special education teachers, faculty, administrators, specialized instructional support personnel, and paraprofessionals to provide career and technical education instruction, leadership, and support;</text>
 </paragraph><paragraph id="H73E55AFA1AFF4C058AB54FB041806BAB"><enum>(7)</enum><text>a description of how the eligible agency will use State leadership funding to meet the requirements of section 124(b);</text>
 </paragraph><paragraph id="H5676A9C23861414E9E60566757173A77"><enum>(8)</enum><text>a description of how funds received by the eligible agency through the allotment made under section 111 will be distributed—</text>
 <subparagraph id="HD22C21180BDA42C9819C8A650C7E449E"><enum>(A)</enum><text>among career and technical education at the secondary level, or career and technical education at the postsecondary and adult level, or both, including how such distribution will most effectively provide students with the skills needed to succeed in the workplace; and</text>
 </subparagraph><subparagraph id="H055C90EA9F74454693D10931FB491728"><enum>(B)</enum><text>among any consortia that may be formed among secondary schools and eligible institutions, and how funds will be distributed among the members of the consortia, including the rationale for such distribution and how it will most effectively provide students with the skills needed to succeed in the workplace;</text>
 </subparagraph></paragraph><paragraph id="HF7C5FA1BC7554008BF016E73DEE299DE"><enum>(9)</enum><text>a description of the procedure the eligible agency will adopt for determining State adjusted levels of performance described in section 113, which at a minimum shall include—</text>
 <subparagraph id="H4E8C2FC547E94991829C75AE71FC1ADF"><enum>(A)</enum><text>consultation with stakeholders identified in paragraph (1);</text> </subparagraph><subparagraph id="H5CFE9B6F69604F979383F06B08374269"><enum>(B)</enum><text>opportunities for the public to comment in person and in writing on the State adjusted levels of performance included in the State plan; and</text>
 </subparagraph><subparagraph id="HA673056607434240BFA8D3F8F9CC0F1E"><enum>(C)</enum><text>submission of public comment on State adjusted levels of performance as part of the State plan; and</text> </subparagraph></paragraph><paragraph id="H80480244BB4144C2AA88DB6191F7F3F7"><enum>(10)</enum><text>assurances that—</text>
 <subparagraph id="HF56DAC1B2B40463A90C958418DF15DF8"><enum>(A)</enum><text>the eligible agency will comply with the requirements of this Act and the provisions of the State plan, including the provision of a financial audit of funds received under this Act, which may be included as part of an audit of other Federal or State programs;</text>
 </subparagraph><subparagraph id="HB2F4FEA40ED74F69AA67B717EE6DF75D"><enum>(B)</enum><text>none of the funds expended under this Act will be used to acquire equipment (including computer software) in any instance in which such acquisition results in a direct financial benefit to any organization representing the interests of the acquiring entity or the employees of the acquiring entity, or any affiliate of such an organization;</text>
 </subparagraph><subparagraph id="H64A85B3EEF9D4319B7DA97872C0B4422"><enum>(C)</enum><text>the eligible agency will use the funds to promote preparation for high-skill, high-wage, or in-demand occupations and nontraditional fields, as identified by the State;</text>
 </subparagraph><subparagraph id="H0B12C33746CE4C278AC3D00876E2178A"><enum>(D)</enum><text>the eligible agency will use the funds provided under this Act to implement career and technical education programs and programs of study for individuals in State correctional institutions, including juvenile justice facilities; and</text>
 </subparagraph><subparagraph id="H2DABC8DBAC14417BBEB10728F58E66BF"><enum>(E)</enum><text>the eligible agency will provide local educational agencies, area career and technical education schools, and eligible institutions in the State with technical assistance, including technical assistance on how to close gaps in student participation and performance in career and technical education programs.</text>
									</subparagraph></paragraph></subsection><subsection id="H9983203571BF4E37A35710DB0EC8E60B"><enum>(e)</enum><header>Consultation</header>
 <paragraph id="HE652A4AB6ECD42EAA3158B134178771A"><enum>(1)</enum><header>In general</header><text>The eligible agency shall develop the portion of each State plan relating to the amount and uses of any funds proposed to be reserved for adult career and technical education, postsecondary career and technical education, and secondary career and technical education after consultation with the—</text>
 <subparagraph id="H125236047004429F9F9A67D1378F088D"><enum>(A)</enum><text>State agency responsible for supervision of community colleges, technical institutes, or other 2-year postsecondary institutions primarily engaged in providing postsecondary career and technical education;</text>
 </subparagraph><subparagraph id="HA6EC824E041B4E7C87D4E401FB450EAA"><enum>(B)</enum><text>the State agency responsible for secondary education; and</text> </subparagraph><subparagraph id="HAE68B5FE4DC6446DA457587FB12F0DED"><enum>(C)</enum><text>the State agency responsible for adult education.</text>
 </subparagraph></paragraph><paragraph id="HEF5D16773BCE4E6AB1435FE28FFE8F42"><enum>(2)</enum><header>Objections of State agencies</header><text>If a State agency other than the eligible agency finds that a portion of the final State plan is objectionable, that objection shall be filed together with the State plan. The eligible agency shall respond to any objections of such State agency in the State plan submitted to the Secretary.</text>
								</paragraph></subsection><subsection id="H730B8111EC034F1EB5F86A6ECA4C2E24"><enum>(f)</enum><header>Plan approval</header>
 <paragraph id="H8AD30226EEC242799317706FDB590212"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall approve a State plan not later than 120 days after its submission to the Secretary unless the Secretary—</text>
 <subparagraph id="HF43E867D72E6412EB615A7C62EC4A57D"><enum>(A)</enum><text>determines that the State plan does not meet the requirements of this Act, including the requirements described in section 113; and</text>
 </subparagraph><subparagraph id="HA2A7D00109764552A5A7E4C6ADF0E126"><enum>(B)</enum><text>meets the requirements of paragraph (2) with respect to such plan.</text> </subparagraph></paragraph><paragraph id="HD93A3D3FA5924E0187AB22F72E3EBBD4"><enum>(2)</enum><header>Disapproval</header><text>The Secretary shall—</text>
 <subparagraph id="HEFFE79DD4CD1426799A917811476B9D9"><enum>(A)</enum><text>have the authority to disapprove a State plan only if the Secretary—</text> <clause id="H9DEB36B717CB47A2963416C287FEAB51"><enum>(i)</enum><text>determines how the State plan fails to meet the requirements of this Act; and</text>
 </clause><clause id="H0FEA37B3E68E4BD0B318BBFF362C0C62"><enum>(ii)</enum><text>provides to the eligible agency, in writing, notice of such determination and the supporting information and rationale to substantiate such determination; and</text>

 </paragraph></section><section id="H35FDB987C50A4E4A8B85D36453E320D6"><enum>122.</enum><header>Improvement plans</header><text display-inline="no-display-inline">Section 123 (<external-xref legal-doc="usc" parsable-cite="usc/20/2343">20 U.S.C. 2343</external-xref>) is amended—</text> <paragraph id="HBB4756CC91F2442E94DEB1C58B747747"><enum>(1)</enum><text>in subsection (a)—</text>

 </clause><clause id="H8F809588C6A5430F9A4EE49BB4744E35"><enum>(ii)</enum><text>shall continue to implement such improvement plan until the eligible agency meets at least 90 percent of the State adjusted level of performance for the same core indicators of performance for which the plan is revised.</text></clause></subparagraph><after-quoted-block>; </after-quoted-block></quoted-block>
 </clause><clause id="HC5139088BB7A49EC8BB599A4ED400D25"><enum>(ii)</enum><text>by redesignating subparagraph (B) as subparagraph (C);</text> </clause><clause id="H64AEBB2033ED4C06809B1064696A3A54"><enum>(iii)</enum><text>by inserting after subparagraph (A), the following:</text>

 </clause><clause id="HD819AEF1A1C348C180842A7B67E33051"><enum>(ii)</enum><text>shall continue to implement such improvement plan until such recipient meets at least 90 percent of an agreed upon local adjusted level of performance for the same core indicators of performance for which the plan is revised.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block>

 </paragraph></section><section id="H62FB7FD5545A4700839123E9D3F4E0E9"><enum>123.</enum><header>State leadership activities</header><text display-inline="no-display-inline">Section 124 (<external-xref legal-doc="usc" parsable-cite="usc/20/2344">20 U.S.C. 2344</external-xref>) is amended—</text> <paragraph id="H8CC685FE8B794D96AD37750FB63CFCD6"><enum>(1)</enum><text>in subsection (a), by striking <quote>shall conduct State leadership activities.</quote> and inserting</text>
						<quoted-block display-inline="yes-display-inline" id="HA241852964D745FB8943CB2D6BBF959B" style="OLC">
 <text>shall—</text><paragraph id="H340619DD8EAA45C3A6479F44388CCCA7"><enum>(1)</enum><text>conduct State leadership activities directly; and</text> </paragraph><paragraph id="H82B698A3456040EFBAB0DE0BBC7D07BA"><enum>(2)</enum><text>report on the effectiveness of such use of funds in achieving the goals described in section 122(d)(2) and the State adjusted levels of performance described in section 113(b)(3)(A).</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
 </paragraph><paragraph id="HF9B7767A4A4F46EE9CA46602835EE2EF"><enum>(2)</enum><text>in subsection (b)—</text> <subparagraph id="H8A3C0F39A0A44D8398A49429528F4147"><enum>(A)</enum><text>by striking paragraphs (1) through (4) and inserting the following:</text>
							<quoted-block display-inline="no-display-inline" id="H62CB3E951E49494C9191E94C2AFBA98C" style="OLC">
 <paragraph id="H94F0954748664B108AB73468688B962B"><enum>(1)</enum><text>developing statewide programs of study, which may include standards, curriculum, and course development, and career exploration, guidance, and advisement activities and resources;</text>
 </paragraph><paragraph id="H68D03104129148D7BB4EF909E923BBE7"><enum>(2)</enum><text>approving locally developed programs of study that meet the requirements established in section 122(d)(4)(B);</text>
 </paragraph><paragraph id="H9EAE7E08261D45EEB42CF59A4F225632"><enum>(3)</enum><text>establishing statewide articulation agreements aligned to approved programs of study;</text> </paragraph><paragraph id="H92E9426319E24768BC1F8169343D99A6"><enum>(4)</enum><text>establishing statewide partnerships among local educational agencies, institutions of higher education, and employers, including small businesses, to develop and implement programs of study aligned to State and local economic and education needs, including as appropriate, in-demand industry sectors and occupations;</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </subparagraph><subparagraph id="H748AFCCC03A74F21B154D0BAF61ADA71"><enum>(B)</enum><text>by striking paragraphs (6) through (9) and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="HDE7B634A9BEC43A9B4395E9B743A4B27" style="OLC"> <paragraph id="H2B70F66863504081A0ABB1952412EA9F"><enum>(6)</enum><text>support services for individuals in State institutions, such as State correctional institutions, including juvenile justice facilities, and educational institutions that serve individuals with disabilities;</text>
 </paragraph><paragraph id="H2D04CAFB848E413BA501F53E4A656029"><enum>(7)</enum><text display-inline="yes-display-inline">for faculty and teachers providing career and technical education instruction, support services, and specialized instructional support services, high-quality comprehensive professional development that is, to the extent practicable, grounded in evidence-based research (to the extent a State determines that such evidence is reasonably available) that identifies the most effective educator professional development process and is coordinated and aligned with other professional development activities carried out by the State (including under title II of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6601">20 U.S.C. 6601</external-xref> et seq.) and title II of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1021">20 U.S.C. 1021</external-xref> et seq.)), including programming that—</text>
 <subparagraph id="H77B4C0C66D8941D3986B10405D2290EA"><enum>(A)</enum><text display-inline="yes-display-inline">promotes the integration of the challenging State academic standards adopted by the State under section 1111(b)(1) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311(b)(1)</external-xref>) and relevant technical knowledge and skills;</text>
 </subparagraph><subparagraph id="H53D8F36A30CD4F86AFFC0246665D981B"><enum>(B)</enum><text>prepares career and technical education teachers, specialized instructional support personnel, and paraprofessionals to provide appropriate accommodations for students who are members of special populations, including through the use of principles of universal design for learning; and</text>
 </subparagraph><subparagraph id="H6E3B041BA0F8480E861B42EB3F9F627C"><enum>(C)</enum><text>increases understanding of industry standards, as appropriate, for faculty providing career and technical education instruction; and</text>
 </subparagraph></paragraph><paragraph id="H3B8296C7C8A34FB2932E054EBF6DAEC4"><enum>(8)</enum><text>technical assistance for eligible recipients.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block> </subparagraph></paragraph><paragraph id="HB796A5CCDA8846C49CF6F35586BD46D1"><enum>(3)</enum><text>in subsection (c), by striking paragraphs (1) through (17) and inserting the following:</text>
						<quoted-block display-inline="no-display-inline" id="HA5483AF05CAA420CB81CAEB766279106" style="OLC">
 <paragraph id="H551CA02A12B04C568B0AC2D57E580FB8"><enum>(1)</enum><text>awarding incentive grants to eligible recipients—</text> <subparagraph id="HE3796EE1BA094DC8B1011D98B9D94771"><enum>(A)</enum><text>for exemplary performance in carrying out programs under this Act, which awards shall be based on—</text>
 <clause id="H257C39F32AA14402B94DB3AAE684D54E"><enum>(i)</enum><text>eligible recipients exceeding the local adjusted level of performance established under section 113(b)(4)(A) in a manner that reflects sustained or significant improvement;</text>
 </clause><clause id="H50CC9AFD3D2748F49B2FAED7700CE201"><enum>(ii)</enum><text>eligible recipients effectively developing connections between secondary education and postsecondary education and training;</text>
 </clause><clause id="HFC78D6062D49474A94252FE0B3BDF914"><enum>(iii)</enum><text>the integration of academic and technical standards;</text> </clause><clause id="H5EB26B46E3DA41EF86274919C6164310"><enum>(iv)</enum><text>eligible recipients’ progress in closing achievement gaps among subpopulations who participate in programs of study; or</text>
 </clause><clause id="H297AADEAFB3E45C5B53E283A91266778"><enum>(v)</enum><text>other factors relating to the performance of eligible recipients under this Act as the eligible agency determines are appropriate; or</text>
 </clause></subparagraph><subparagraph id="HF3F37C6F3EE4490DA6ECB0A9833B93C3"><enum>(B)</enum><text>if an eligible recipient elects to use funds as permitted under section 135(c);</text> </subparagraph></paragraph><paragraph id="H9540B3209EA44A2BA0569CDA09EBFFDB"><enum>(2)</enum><text>providing support for the adoption and integration of recognized postsecondary credentials or for consultation and coordination with other State agencies for the identification, consolidation, or elimination of licenses or certifications which pose an unnecessary barrier to entry for aspiring workers and provide limited consumer protection;</text>
 </paragraph><paragraph id="HA334828282BD4A1E9513DA8B7FB7CF08"><enum>(3)</enum><text>the creation, implementation, and support of pay-for-success initiatives leading to recognized postsecondary credentials;</text>
 </paragraph><paragraph id="HB573299EE5B44021B2E816A88CB74363"><enum>(4)</enum><text>support for career and technical education programs for adults and out-of-school youth concurrent with their completion of their secondary school education in a school or other educational setting;</text>
 </paragraph><paragraph id="HA7817EE865D94DCEAB256C261DDA91E1"><enum>(5)</enum><text>the creation, evaluation, and support of competency-based curricula;</text> </paragraph><paragraph id="HC4E4F519D71947798C8C7C58A330E74D"><enum>(6)</enum><text display-inline="yes-display-inline">support for the development, implementation, and expansion of programs of study or career pathways in areas declared to be in a state of emergency under section 501 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5191">42 U.S.C. 5191</external-xref>);</text>
 </paragraph><paragraph id="H4C6C5F92F25D49B9A63CA13D2ECC016E"><enum>(7)</enum><text>providing support for dual or concurrent enrollment programs, such as early college high schools;</text> </paragraph><paragraph id="H6039CEB9905C4EABACA16F0866FDAE89"><enum>(8)</enum><text>improvement of career guidance and academic counseling programs that assist students in making informed academic and career and technical education decisions, including academic and financial aid counseling;</text>
 </paragraph><paragraph id="H7795FF6EB50F498EB32DE0757FFF8CDA"><enum>(9)</enum><text>support for the integration of employability skills into career and technical education programs and programs of study;</text>
 </paragraph><paragraph id="H47673B14A5FA43F7AFA1BCCE7374C1E3"><enum>(10)</enum><text>support for programs and activities that increase access, student engagement, and success in science, technology, engineering, and mathematics fields (including computer science), particularly for students who are members of groups underrepresented in such subject fields, such as female students, minority students, and students who are members of special populations;</text>
 </paragraph><paragraph id="H47F6386A11084C698D3225D70981561F"><enum>(11)</enum><text>support for career and technical student organizations, especially with respect to efforts to increase the participation of students who are members of special populations;</text>
 </paragraph><paragraph id="H65C08EC1FC8F401B9E07EEA43E40FA2E"><enum>(12)</enum><text>support for establishing and expanding work-based learning opportunities;</text> </paragraph><paragraph id="H8696CA07D93B449395A55DD218F92F45"><enum>(13)</enum><text>support for preparing, retaining, and training of career and technical education teachers, faculty, specialized instructional support personnel, and paraprofessionals, such as preservice, professional development, and leadership development programs;</text>
 </paragraph><paragraph id="H2322D0AB26C64A2693F48D976F088003"><enum>(14)</enum><text>integrating and aligning programs of study and career pathways;</text> </paragraph><paragraph id="H020871A0D1F34644B928676F237B17AA"><enum>(15)</enum><text display-inline="yes-display-inline">supporting the use of career and technical education programs and programs of study aligned with State, regional, or local in-demand industry sectors or occupations identified by State or local workforce development boards;</text>
 </paragraph><paragraph id="HCA9BB676F1D342668FA14DDA95361607"><enum>(16)</enum><text>making all forms of instructional content widely available, which may include use of open educational resources;</text>
 </paragraph><paragraph id="HE30840C416BE4E7F9B4A98FDA3DBD315"><enum>(17)</enum><text display-inline="yes-display-inline">support for the integration of arts and design skills, when appropriate, into career and technical education programs and programs of study; and</text>
 </paragraph><paragraph id="HEA4D2F8E5D984FE6B3B15C3B6F95070E"><enum>(18)</enum><text display-inline="yes-display-inline">support for accelerated learning programs (described in section 4104(b)(3)(A)(i)(IV) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7114">20 U.S.C. 7114(b)(3)(A)(i)(IV)</external-xref>)) when any such program is part of a program of study.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

 <subparagraph id="HA3C786409C74423B82210801F3E57206"><enum>(A)</enum><text>how the results of the comprehensive needs assessment described in subsection (c) informed the selection of the specific career and technical education programs and activities selected to be funded; and</text>
 </subparagraph><subparagraph id="H0F02B2AD1A5E4DC48D5BB740C9D27BC7"><enum>(B)</enum><text display-inline="yes-display-inline">a description of any new programs of study the eligible recipient will develop and submit to the State for approval;</text>
 </subparagraph></paragraph><paragraph id="H91D1D3A3A8C94C6BB285F71EC2CB7F1B"><enum>(3)</enum><text>a description of how the eligible recipient will provide—</text> <subparagraph id="H2FBCEFDD892D4B628A4B40A5F957B372"><enum>(A)</enum><text>career exploration and career development coursework, activities, or services;</text>
 </subparagraph><subparagraph id="HB20C0B9DF711492ABDA370D07F43DC52"><enum>(B)</enum><text>career information; and</text> </subparagraph><subparagraph id="HFF0EC4C0B6334099A53088DFBFA922F0"><enum>(C)</enum><text>an organized system of career guidance and academic counseling to students before enrolling and while participating in a career and technical education program; and</text>
 </subparagraph></paragraph><paragraph id="H4151804E8FF5458E8381642EFE791E2B"><enum>(4)</enum><text>a description of how the eligible recipient will—</text> <subparagraph id="H33F4AE8BD13E44E5B845C40233772D43"><enum>(A)</enum><text display-inline="yes-display-inline">provide activities to prepare special populations for high-skill, high-wage, or in-demand occupations that will lead to self-sufficiency; and</text>
 </subparagraph><subparagraph id="H97715B41B8AA44D28805E39B937A32B5"><enum>(B)</enum><text>prepare CTE participants for nontraditional fields.</text> </subparagraph></paragraph></subsection><subsection id="H11B421E6462645E2BF96C5751E5EABFE"><enum>(c)</enum><header>Comprehensive needs assessment</header> <paragraph id="H0804C0A430B84D19B6732616D6C0B1BD"><enum>(1)</enum><header>In general</header><text>To be eligible to receive financial assistance under this part, an eligible recipient shall—</text>
 <subparagraph id="H6D5C881AA4E943D2A5AD3F746F367BD4"><enum>(A)</enum><text>conduct a comprehensive local needs assessment related to career and technical education; and</text> </subparagraph><subparagraph id="H0D430777AFE949898EA378E61219F62E"><enum>(B)</enum><text>not less than once every 2 years, update such comprehensive local needs assessment.</text>
 </subparagraph></paragraph><paragraph id="H3D46B4C5C6AF4464BE80F3F8BB2BD3A7"><enum>(2)</enum><header>Requirements</header><text>The comprehensive local needs assessment described under paragraph (1) shall include—</text> <subparagraph id="H5D566D794C504C34ABA50CD3FA254173"><enum>(A)</enum><text>an evaluation of the performance of the students served by the eligible recipient with respect to State and local adjusted levels of performance established pursuant to section 113, including an evaluation of performance for special populations;</text>
 </subparagraph><subparagraph id="H9EF53E9173A340A4BD3ABCD8D3C0050C"><enum>(B)</enum><text>a description of how career and technical education programs offered by the eligible recipient are—</text> <clause id="H51DAE7154F0D40C897ED38020F22846D"><enum>(i)</enum><text>sufficient in size, scope, and quality to meet the needs of all students served by the eligible recipient; and</text>
										</clause><clause id="H2A8BF7CD054F4A5C8FF483B6DFB56B76"><enum>(ii)</enum>
 <subclause commented="no" display-inline="yes-display-inline" id="H5FDB6FDE9573424DA50CF0E0A6E32982"><enum>(I)</enum><text>aligned to State, regional, or local in-demand industry sectors or occupations identified by the State or local workforce development board, including career pathways, where appropriate; or</text>
 </subclause><subclause id="H726A8BF38036458FB5670D5CA8EC9866" indent="up1"><enum>(II)</enum><text>designed to meet local education or economic needs not identified by State or local workforce development boards;</text>
 </subclause></clause></subparagraph><subparagraph id="H503714C1BBA147ACA461683D3609E6F3"><enum>(C)</enum><text>an evaluation of progress toward the implementation of career and technical education programs and programs of study;</text>
 </subparagraph><subparagraph commented="no" id="HAD1BD16B8EAF41D0854F106189CEB6E1"><enum>(D)</enum><text display-inline="yes-display-inline">an evaluation of strategies needed to overcome barriers that result in lowering rates of access to, or lowering success in, career and technical education programs for special populations, which may include strategies to establish or utilize existing flexible learning and manufacturing facilities, such as makerspaces;</text>
 </subparagraph><subparagraph id="H44D7A5A21A784EC6B4D816CB6F3F80A6"><enum>(E)</enum><text>a description of how the eligible recipient will improve recruitment, retention, and training of career and technical education teachers, faculty, specialized instructional support personnel, paraprofessionals, and career, academic, and guidance counselors, including individuals in groups underrepresented in such professions; and</text>
 </subparagraph><subparagraph id="H2E2CFCE9F3084D5CB7D0B70A0ACE2DC3"><enum>(F)</enum><text display-inline="yes-display-inline">a description of how the eligible recipient will support the transition to teaching from business and industry.</text>
 </subparagraph></paragraph></subsection><subsection id="H4619328AE47843B39833D29610806692"><enum>(d)</enum><header>Consultation</header><text>In conducting the comprehensive needs assessment under subsection (c), an eligible recipient shall involve a diverse body of stakeholders, including, at a minimum—</text>
 <paragraph id="HA75ED74314FA4E21B0B0F65249657513"><enum>(1)</enum><text>representatives of career and technical education programs in a local educational agency or educational service agency, including teachers and administrators;</text>
 </paragraph><paragraph id="H10CA867B081F40BCB83EF6A67C0985B3"><enum>(2)</enum><text>representatives of career and technical education programs at postsecondary educational institutions, including faculty and administrators;</text>
 </paragraph><paragraph id="H07B47E8193D14BEB8F65D7F862031091"><enum>(3)</enum><text>representatives of State or local workforce development boards and a range of local or regional businesses or industries;</text>
 </paragraph><paragraph id="H0B12EDB8A86343D0947EC221AE0396F5"><enum>(4)</enum><text>parents and students;</text> </paragraph><paragraph id="H6640E7DCBE514E38A4D50829F6F4A69F"><enum>(5)</enum><text>representatives of special populations; and</text>
 </paragraph><paragraph id="H15865C60B1D349BA9EF2BA2B704202BF"><enum>(6)</enum><text>representatives of local agencies serving out-of-school youth, homeless children and youth, and at-risk youth (as defined in section 1432 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6472">20 U.S.C. 6472</external-xref>)).</text>
 </paragraph></subsection><subsection id="H04B22A3E3FEB414CBD0AE86510178872"><enum>(e)</enum><header>Continued consultation</header><text display-inline="yes-display-inline">An eligible recipient receiving financial assistance under this part shall consult with the entities described in subsection (d) on an ongoing basis to—</text>
 <paragraph id="H9EC6C408B44844978422E362E87C77BC"><enum>(1)</enum><text>provide input on annual updates to the comprehensive needs assessment required under subsection (c);</text>
 </paragraph><paragraph id="H5F5B5B96C05F448AB8F1EAEE6173E015"><enum>(2)</enum><text>ensure programs of study are—</text> <subparagraph id="H04F66D0053E54F27AA7C7D44CED884FF"><enum>(A)</enum><text>responsive to community employment needs;</text>
 </subparagraph><subparagraph id="HC7278532F98E42C6BB1AEA634B075233"><enum>(B)</enum><text>aligned with employment priorities in the State, regional, or local economy identified by employers and the entities described in subsection (d), which may include in-demand industry sectors or occupations identified by the local workforce development board;</text>
 </subparagraph><subparagraph id="H200AB065553F4B558CD1A4D6BFEDCB5E"><enum>(C)</enum><text>informed by labor market information, including information provided under section 15(e)(2)(C) of the Wagner-Peyser Act (<external-xref legal-doc="usc" parsable-cite="usc/29/491-2">29 U.S.C. 491–2(e)(2)(C)</external-xref>);</text>
 </subparagraph><subparagraph id="H4CEA059D99974681971FD93D2FDE947E"><enum>(D)</enum><text>designed to meet current, intermediate, or long-term labor market projections; and</text> </subparagraph><subparagraph id="H3AA43CFCA87B47A28605F511CFE10719"><enum>(E)</enum><text display-inline="yes-display-inline">allow employer input, including input from industry or sector partnerships in the local area, where applicable, into the development and implementation of programs of study to ensure programs align with skills required by local employment opportunities, including activities such as the identification of relevant standards, curriculum, industry-recognized credentials, and current technology and equipment;</text>
 </subparagraph></paragraph><paragraph id="HC473B9F996C84E5390DF9F30A77A5963"><enum>(3)</enum><text>identify and encourage opportunities for work-based learning; and</text> </paragraph><paragraph id="H4C2FD59DCD08456C96FA2C5896791B7E"><enum>(4)</enum><text>ensure funding under this part is used in a coordinated manner with other local resources.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></section><section id="H6C6472AF11EB45CCA1CC3268B852AA53"><enum>132.</enum><header>Local uses of funds</header><text display-inline="no-display-inline">Section 135 (<external-xref legal-doc="usc" parsable-cite="usc/20/2355">20 U.S.C. 2355</external-xref>) is amended to read as follows:</text> <quoted-block display-inline="no-display-inline" id="H3AB038FC5B204E25999A7C0638DB700C" style="OLC"> <section id="H990F6F12CA284069985323C98D7362E2"><enum>135.</enum><header>Local uses of funds</header> <subsection id="H57C22EDA85CD45029F102150D5CF5324"><enum>(a)</enum><header>General authority</header><text>Each eligible recipient that receives funds under this part shall use such funds to develop, coordinate, implement, or improve career and technical education programs to meet the needs identified in the comprehensive needs assessment described in section 134(c).</text>
 </subsection><subsection id="HB05C6100A5FE4CC982547A248D28F55D"><enum>(b)</enum><header>Requirements for uses of funds</header><text>Funds made available to eligible recipients under this part shall be used to support career and technical education programs that are of sufficient size, scope, and quality to be effective and—</text>
 <paragraph id="H02C1EA86C2DB4140AD489F17D6ED8DFA"><enum>(1)</enum><text>provide career exploration and career development activities through an organized, systematic framework designed to aid students, before enrolling and while participating in a career and technical education program, in making informed plans and decisions about future education and career opportunities and programs of study, which may include—</text>
 <subparagraph id="H5D0278521F7E4F74BDDF5E6828907871"><enum>(A)</enum><text>introductory courses or activities focused on career exploration and career awareness;</text> </subparagraph><subparagraph id="H77A771245DFD4FC09F62F81C1543DB78"><enum>(B)</enum><text>readily available career and labor market information, including information on—</text>
 <clause id="HD80DF454DDC34E57A41948B1CC5C2D51"><enum>(i)</enum><text>occupational supply and demand;</text> </clause><clause id="HA1673F77027C42A7AEF4C3772E8CF0BC"><enum>(ii)</enum><text>educational requirements;</text>
 </clause><clause id="HCCE8C873EA80455DA518D8619B32B903"><enum>(iii)</enum><text>other information on careers aligned to State or local economic priorities; and</text> </clause><clause id="HA711FF3E7748498F8CE9A0063B47D7B6"><enum>(iv)</enum><text>employment sectors;</text>
 </clause></subparagraph><subparagraph id="H19E968B320B641C9B504007952EF5CD7"><enum>(C)</enum><text>programs and activities related to the development of student graduation and career plans;</text> </subparagraph><subparagraph id="HBA9FBDB82D1244569262D0E020D010FB"><enum>(D)</enum><text>career guidance and academic counselors that provide information on postsecondary education and career options; or</text>
 </subparagraph><subparagraph id="HBED620656AC7427AB7EE8727B156B64C"><enum>(E)</enum><text>any other activity that advances knowledge of career opportunities and assists students in making informed decisions about future education and employment goals;</text>
 </subparagraph></paragraph><paragraph id="HB4E36823BF2047AFAEF2CD5D9995AFC4"><enum>(2)</enum><text>provide professional development for teachers, principals, school leaders, administrators, faculty, and career and guidance counselors with respect to content and pedagogy that—</text>
 <subparagraph id="HFDC038EFEA6A43059D6F7336D5A04D94"><enum>(A)</enum><text>supports individualized academic and career and technical education instructional approaches, including the integration of academic and career and technical education standards and curriculum;</text>
 </subparagraph><subparagraph id="H54CBAC2E91A14E64B033814E10AC1908"><enum>(B)</enum><text>ensures labor market information is used to inform the programs, guidance, and advisement offered to students;</text>
 </subparagraph><subparagraph id="H3E2F78EC528C4D9DB656B9FDB3417425"><enum>(C)</enum><text>provides educators with opportunities to advance knowledge, skills, and understanding of all aspects of an industry, including the latest workplace equipment, technologies, standards, and credentials;</text>
 </subparagraph><subparagraph id="H4BDDC7FEEE654B3FAE65D871D7C14931"><enum>(D)</enum><text>supports administrators in managing career and technical education programs in the schools, institutions, or local educational agencies of such administrators;</text>
 </subparagraph><subparagraph id="HE86C350EBD7049A78CA5E8F15F3CF465"><enum>(E)</enum><text>supports the implementation of strategies to improve student achievement and close gaps in student participation and performance in career and technical education programs; and</text>
 </subparagraph><subparagraph id="HBFC12934B56C4EFFB32E790A387888E7"><enum>(F)</enum><text>provides educators with opportunities to advance knowledge, skills, and understanding in pedagogical practices, including, to the extent the eligible recipient determines that such evidence is reasonably available, evidence-based pedagogical practices;</text>
 </subparagraph></paragraph><paragraph id="H8F42356D49004C8685FF182BC5E0B281"><enum>(3)</enum><text>provide career and technical education students, including special populations, with the skills necessary to pursue high-skill, high-wage occupations;</text>
 </paragraph><paragraph id="H549448675E07456AAFCA69CA7037397C"><enum>(4)</enum><text>support integration of academic skills into career and technical education programs and programs of study to support CTE participants at the secondary school level in meeting the challenging State academic standards adopted under section 1111(b)(1) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311(b)(1)</external-xref>) by the State in which the eligible recipient is located;</text>
 </paragraph><paragraph id="H8F2FC4A13FC94CA991748FBCD851CF5C"><enum>(5)</enum><text>plan and carry out elements that support the implementation of career and technical education programs and programs of study and student achievement of the local adjusted levels of performance established under section 113, which may include—</text>
 <subparagraph id="HE5CEDFF084A0442EB9B42DDFB0FBD1FC"><enum>(A)</enum><text>curriculum aligned with the requirements for a program of study;</text> </subparagraph><subparagraph id="H5FA6A066C0D64E33865DECDE498B724F"><enum>(B)</enum><text>sustainable relationships among education, business and industry, and other community stakeholders, including industry or sector partnerships in the local area, where applicable, that are designed to facilitate the process of continuously updating and aligning programs of study with skills in demand in the State, regional, or local economy;</text>
 </subparagraph><subparagraph id="H1DB768D528A24F33A45E443B5190EB0A"><enum>(C)</enum><text>dual or concurrent enrollment programs, including early college high schools, and the development or implementation of articulation agreements;</text>
 </subparagraph><subparagraph id="H987211EEAC8C4B309173848351ACE116"><enum>(D)</enum><text>appropriate equipment, technology, and instructional materials (including support for library resources) aligned with business and industry needs, including machinery, testing equipment, tools, implements, hardware and software, and other new and emerging instructional materials;</text>
 </subparagraph><subparagraph id="H3334F6AC37AD45D69721E52B69D5EE77"><enum>(E)</enum><text>a continuum of work-based learning opportunities;</text> </subparagraph><subparagraph id="HE416EB6C3606482C8ECD0B74A24C1066"><enum>(F)</enum><text>industry-recognized certification exams or other assessments leading toward industry-recognized postsecondary credentials;</text>
 </subparagraph><subparagraph id="H9BDB9181F7C647798C758DD096292758"><enum>(G)</enum><text>efforts to recruit and retain career and technical education program administrators and educators;</text> </subparagraph><subparagraph id="H831EB65AD7B245EDA3861533CFD99ABD"><enum>(H)</enum><text display-inline="yes-display-inline">where applicable, coordination with other education and workforce development programs and initiatives, including career pathways and sector partnerships developed under the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3101">29 U.S.C. 3101</external-xref> et seq.) and other Federal laws and initiatives that provide students with transition-related services, including the Individuals with Disabilities Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1400">20 U.S.C. 1400</external-xref> et seq.);</text>
 </subparagraph><subparagraph id="HE6574CDEABCA41ABBD9A96BE6C8B6D06"><enum>(I)</enum><text>expanding opportunities for students to participate in distance career and technical education and blended-learning programs;</text>
 </subparagraph><subparagraph id="H08D8FB9F925B4FEFB8D4AA82DB001EE3"><enum>(J)</enum><text>expanding opportunities for students to participate in competency-based education programs;</text> </subparagraph><subparagraph id="H8981858C37854B4EB720D92FEC1A75E2"><enum>(K)</enum><text>improving career guidance and academic counseling programs that assist students in making informed academic and career and technical education decisions, including academic and financial aid counseling;</text>
 </subparagraph><subparagraph commented="no" id="H9CD3EF606AF84D8695372E1A7797C665"><enum>(L)</enum><text>supporting the integration of employability skills into career and technical education programs and programs of study;</text>
 </subparagraph><subparagraph id="HE8BDA270AC1940FDBA1D93B4B95E75B3"><enum>(M)</enum><text>supporting programs and activities that increase access, student engagement, and success in science, technology, engineering, and mathematics fields (including computer science) for students who are members of groups underrepresented in such subject fields;</text>
 </subparagraph><subparagraph id="H331CEDDE220F4DADB036B6A9B10578B8"><enum>(N)</enum><text display-inline="yes-display-inline">providing career and technical education, in a school or other educational setting, for adults or a school-aged individual who has dropped out of a secondary school to complete secondary school education or upgrade technical skills;</text>
 </subparagraph><subparagraph id="H5CB0D9E6F7284E5C82574C61C2D848CD"><enum>(O)</enum><text display-inline="yes-display-inline">career and technical student organizations, including student preparation for and participation in technical skills competitions aligned with career and technical education program standards and curriculum;</text>
 </subparagraph><subparagraph id="H3DCE510262C64EFDB18BC2C9FFD9A576"><enum>(P)</enum><text>making all forms of instructional content widely available, which may include use of open educational resources;</text>
 </subparagraph><subparagraph id="H05F668688EED4648B4BBA8B24E28EFF6"><enum>(Q)</enum><text display-inline="yes-display-inline">supporting the integration of arts and design skills, when appropriate, into career and technical education programs and programs of study;</text>
 </subparagraph><subparagraph id="HD2F9EE577CA948CEA0FBB56BAF268EC1"><enum>(R)</enum><text display-inline="yes-display-inline">where appropriate, expanding opportunities for CTE concentrators to participate in accelerated learning programs (described in section 4104(b)(3)(A)(i)(IV) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7114">20 U.S.C. 7114(b)(3)(A)(i)(IV)</external-xref>)) as part of a program of study; and</text>
 </subparagraph><subparagraph id="H486DE6B4E0844E9F8093825750683AB9"><enum>(S)</enum><text>other activities to improve career and technical education programs; and</text> </subparagraph></paragraph><paragraph id="HEA0FAE3F188D4E7C8445D973FBBE5A49"><enum>(6)</enum><text>develop and implement evaluations of the activities carried out with funds under this part, including evaluations necessary to complete the comprehensive needs assessment required under section 134(c) and the local report required under section 113(b)(4)(C).</text>
 </paragraph></subsection><subsection commented="no" id="H1E6C2E0BFCF24E7B96AE12AE88465823"><enum>(c)</enum><header>Pooling funds</header><text>An eligible recipient may pool a portion of funds received under this Act with a portion of funds received under this Act available to not less than one other eligible recipient to support implementation of programs of study through the activities described in subsection (b)(2).</text>
 </subsection><subsection id="HB5FA92C91173465C8ABC2BCCEAF22DF0"><enum>(d)</enum><header>Administrative costs</header><text>Each eligible recipient receiving funds under this part shall not use more than 5 percent of such funds for costs associated with the administration of activities under this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</section></part></title><title id="H342C1F4C455F4ABB89C1B1823AA986AD"><enum>II</enum><header>General provisions</header>
 <section id="HF0F9C4BC74AB40BE9475B3D6CC77529E"><enum>201.</enum><header>Federal and State administrative provisions</header><text display-inline="no-display-inline">The Act (<external-xref legal-doc="usc" parsable-cite="usc/20/2301">20 U.S.C. 2301</external-xref> et seq.) is amended—</text> <paragraph id="HD1A576F990464E27895D7EDB0D24B7E2"><enum>(1)</enum><text>in section 311(b)—</text>
 <subparagraph id="HC49EB315F8C249DEAED758EFCE560D68"><enum>(A)</enum><text>in paragraph (1)—</text> <clause id="H269FDA8ED5F547929DFC557BC9A536EC"><enum>(i)</enum><text>by amending subparagraph (A) to read as follows:</text>
							<quoted-block display-inline="no-display-inline" id="H8FF5CEE7AB6A4DBAAFFA570097D5B94D" style="OLC">
 <subparagraph id="H6BAE40231E44448A9E41DF2E3141C5BA"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subparagraph (B), (C), or (D), in order for a State to receive its full allotment of funds under this Act for any fiscal year, the Secretary must find that the State’s fiscal effort per student, or the aggregate expenditures of such State, with respect to career and technical education for the preceding fiscal year was not less than the fiscal effort per student, or the aggregate expenditures of such State, for the second preceding fiscal year.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
 </clause><clause id="H0210410D2B824747BE5557F5F9AE4D6B"><enum>(ii)</enum><text>in subparagraph (B), by striking <quote>shall exclude capital expenditures, special 1-time project costs, and the cost of pilot programs.</quote> and inserting <quote>shall, at the request of the State, exclude competitive or incentive-based programs established by the State, capital expenditures, special one-time project costs, and the cost of pilot programs.</quote>; and</text>
 </clause><clause id="HCA2738C243284E1CBCB29AAD661A29AC"><enum>(iii)</enum><text>by adding after subparagraph (C), the following new subparagraph:</text> <quoted-block display-inline="no-display-inline" id="H475FE4CE088D4F2C8D1D5458D4D1112B" style="OLC"> <subparagraph id="H367176DE5430475DBD04033C96A4D176"><enum>(D)</enum><header>Establishing the State baseline</header> <clause id="H285FB0BA9DF64D41A436BB8F3388771F"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">For purposes of subparagraph (A), the State may—</text>
 <subclause id="H037B0884A7CB47F4A02E5DD32F1FCD5A"><enum>(I)</enum><text display-inline="yes-display-inline">continue to use the State’s fiscal effort per student, or aggregate expenditures of such State, with respect to career and technical education, as was in effect on the day before the date of enactment of the Strengthening Career and Technical Education for the 21st Century Act; or</text>
 </subclause><subclause id="HEEAE7BE50E48434EA56DEC8E8DC07700"><enum>(II)</enum><text display-inline="yes-display-inline">establish a new level of fiscal effort per student, or aggregate expenditures of such State, with respect to career and technical education, which is not less than 90 percent of the State’s fiscal effort per student, or the aggregate expenditures of such State, with respect to career and technical education for the preceding fiscal year.</text>
 </subclause></clause><clause id="HEDD9D257699345D793E3068FFF77DF87"><enum>(ii)</enum><header>Amount</header><text display-inline="yes-display-inline">The amount of the new level described in clause (i)(II) shall be the State’s fiscal effort per student, or aggregate expenditures of such State, with respect to career and technical education, for the first full fiscal year following the enactment of the <short-title>Strengthening Career and Technical Education for the 21st Century Act</short-title>.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </clause></subparagraph><subparagraph id="H2B836C9688E14B14A37BDFFBE4492CF3"><enum>(B)</enum><text>by striking paragraph (2) and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="H5B340ECE31E246348E4B6622FAE28DE7" style="OLC"> <paragraph id="H3D739BBDFEB846748ECF85870DCC2672"><enum>(2)</enum><header>Failure to meet</header><text display-inline="yes-display-inline">The Secretary shall reduce the amount of a State’s allotment of funds under this Act for any fiscal year in the exact proportion by which the State fails to meet the requirement of paragraph (1) by falling below the State’s fiscal effort per student or the State’s aggregate expenditures (using the measure most favorable to the State), if the State failed to meet such requirement (as determined using the measure most favorable to the State) for 1 or more of the 5 immediately preceding fiscal years.</text>
 </paragraph><paragraph id="H8C83D0CB014248BAB6432C69014C107E"><enum>(3)</enum><header>Waiver</header><text display-inline="yes-display-inline">The Secretary may waive paragraph (2) due to exceptional or uncontrollable circumstances affecting the ability of the State to meet the requirement of paragraph (1).</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="H1036100B39E541DEA090C404FF9279D1"><enum>(2)</enum><text>in section 317(b)(1)—</text> <subparagraph id="H134997809F8F4FDD880DB04FFEF170AA"><enum>(A)</enum><text>by striking <quote>may, upon written request, use funds made available under this Act to</quote> and inserting <quote>may use funds made available under this Act to</quote>; and</text>
 </subparagraph><subparagraph id="H06591C4278AF4932905A073AC2048808"><enum>(B)</enum><text>by striking <quote>who reside in the geographical area served by</quote> and inserting <quote>located in or near the geographical area served by</quote>;</text> </subparagraph></paragraph><paragraph id="H259EE609A5914B05A7CA22FA0D766542"><enum>(3)</enum><text>by striking title II and redesignating title III as title II;</text>
 </paragraph><paragraph id="HE2ADBC0BE80B498F93C4EA0F78B1CC56"><enum>(4)</enum><text>by redesignating sections 311 through 318 as sections 211 through 218, respectively;</text> </paragraph><paragraph id="HE6B11CF8123A4D1EB24265FFD710596F"><enum>(5)</enum><text>by redesignating sections 321 through 324 as sections 221 through 224, respectively; and</text>
 </paragraph><paragraph id="HAED95BBF7FEB458EA205A3C44A252B33"><enum>(6)</enum><text>by inserting after section 218 (as so redesignated) the following:</text> <quoted-block display-inline="no-display-inline" id="H98F788A8320F4C2896F7AACBC745512F" style="OLC"> <section id="H48E855AE607C44118A4A31C7A6AAC982"><enum>219.</enum><header>Study on programs of study aligned to high-skill, high-wage occupations</header> <subsection id="H6EAABEAA4E3A494A8439AADECA495557"><enum>(a)</enum><header>Scope of study</header><text display-inline="yes-display-inline">The Comptroller General of the United States shall conduct a study to evaluate—</text>
 <paragraph id="H596C28E9ECF042F492120768C555451A"><enum>(1)</enum><text>the strategies, components, policies, and practices used by eligible agencies or eligible recipients receiving funding under this Act to successfully assist—</text>
 <subparagraph id="H89D311EEA45C494D818BF95B97993DD0"><enum>(A)</enum><text>all students in pursuing and completing programs of study aligned to high-skill, high-wage occupations; and</text>
 </subparagraph><subparagraph id="H493A81AA00A94E8C96B8912070C2E412"><enum>(B)</enum><text display-inline="yes-display-inline">any specific subgroup of students identified in section 1111(h)(1)(C)(ii) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311(h)(1)(C)(ii)</external-xref>) in pursuing and completing programs of study aligned to high-skill, high-wage occupations in fields in which such subgroup is underrepresented; and</text>
 </subparagraph></paragraph><paragraph id="H8BBA982BC4E04F209A0D40429B484523"><enum>(2)</enum><text>any challenges associated with replication of such strategies, components, policies, and practices.</text> </paragraph></subsection><subsection id="HFF2E63FE00AF43E5AA8B038E5D831650"><enum>(b)</enum><header>Consultation</header><text display-inline="yes-display-inline">In carrying out the study conducted under subsection (a), the Comptroller General of the United States shall consult with a geographically diverse (including urban, suburban, and rural) representation of—</text>
 <paragraph id="HDD18D1440BB4493D97BD2D3454099D02"><enum>(1)</enum><text>students and parents;</text> </paragraph><paragraph id="HC64CDF7B208A4102B36F92CA83D9F19D"><enum>(2)</enum><text>eligible agencies and eligible recipients;</text>
 </paragraph><paragraph id="H0D390D1F72AA48DD8F5494594547CB03"><enum>(3)</enum><text>teachers, faculty, specialized instructional support personnel, and paraprofessionals, including those with expertise in preparing CTE students for nontraditional fields;</text>
 </paragraph><paragraph id="HC32B6CBD62024A249CECCA53945BB1A9"><enum>(4)</enum><text>special populations; and</text> </paragraph><paragraph id="H1DEA55337AD04E60B73CBE7347587586"><enum>(5)</enum><text>representatives of business and industry.</text>
 </paragraph></subsection><subsection id="H65AC8E1F2D904DBCAC10B7829D461786"><enum>(c)</enum><header>Submission</header><text display-inline="yes-display-inline">Upon completion, the Comptroller General of the United States shall submit the study conducted under subsection (a) to the Committee on Education and the Workforce of the House of Representatives and the Committee on Health, Education, Labor, and Pensions of the Senate.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section></title><title id="H7F49B7D8ED5A4DFBB3353CA6BA150B5F"><enum>III</enum><header>Amendments to the Wagner-Peyser Act</header>
 <section id="HC63856150DE8437AAB03BADF6C10F31C" section-type="subsequent-section"><enum>301.</enum><header>State responsibilities</header><text display-inline="no-display-inline">Section 15(e)(2) of the Wagner-Peyser Act (<external-xref legal-doc="usc" parsable-cite="usc/29/49l-2">29 U.S.C. 49l–2(e)(2)</external-xref>) is amended—</text> <paragraph id="H27D51A94F0E44EF79DB0DB30FD621E29"><enum>(1)</enum><text>by striking subparagraph (B) and inserting the following:</text>
					<quoted-block id="H6C209C19354142BAABC1A87CAB5137BB" style="OLC">
 <subparagraph id="HD742F7678DBC49A68627BB265A871FF5"><enum>(B)</enum><text>consult with eligible agencies (defined in section 3 of the Carl D. Perkins Career and Technical Education Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/20/2302">20 U.S.C. 2302</external-xref>)), State educational agencies, and local educational agencies concerning the provision of workforce and labor market information in order to—</text>
 <clause id="H038BACAA68B846B5BDCE0ACE51C82094"><enum>(i)</enum><text>meet the needs of secondary school and postsecondary school students who seek such information; and</text> </clause><clause id="HA9994139BE284305B72934A884A823D5"><enum>(ii)</enum><text display-inline="yes-display-inline">annually inform the development and implementation of programs of study defined in section 3 of the Carl D. Perkins Career and Technical Education Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/20/2302">20 U.S.C. 2302</external-xref>), and career pathways;</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
 </paragraph><paragraph id="H0207D427007E4ED5AAED6081C85D81B5"><enum>(2)</enum><text>in subparagraph (G), by striking <quote>and</quote> at the end;</text> </paragraph><paragraph id="H53519F6C8601428B816787FACA10A77B"><enum>(3)</enum><text>in subparagraph (H), by striking the period at the end and inserting <quote>; and</quote>; and</text>
 </paragraph><paragraph id="H9E92E4F419224084B41995A25381505D"><enum>(4)</enum><text>by inserting after subparagraph (H) the following new subparagraph:</text> <quoted-block id="H252BF8759F2445DEA6F68C59E638B3C2" style="OLC"> <subparagraph id="H5FEF849F030F4AB49923A2F295E9AC05"><enum>(I)</enum><text display-inline="yes-display-inline">provide, on an annual and timely basis to each eligible agency (defined in section 3 of the Carl D.
