 <section id="H20ADD89A17E542C68B011CA61B814B2A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>HYdropower Permit Extension Act</short-title></quote> or the <quote>HYPE Act</quote>.</text> </section><section id="HEF48E6D271BF4EFDA1959256A605864E"><enum>2.</enum><header>Extensions of periods</header> <subsection id="H38B95890524D4039A5C2767B4E06E06B"><enum>(a)</enum><header>Preliminary permits</header><text>Section 5 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/798">16 U.S.C. 798</external-xref>) is amended—</text>
 <paragraph id="H88905C55E5D64498A8D59A5A47922F6B"><enum>(1)</enum><text>in subsection (a), by striking <quote>three</quote> and inserting <quote>four</quote>; and</text> </paragraph><paragraph id="H2578062E5E324D9FB6402A96FD51FCDE"><enum>(2)</enum><text>in subsection (b)—</text>
 <subparagraph id="HE757943A9C2E4DB18F897C82DB7C3EAD"><enum>(A)</enum><text>by striking <quote>Commission may extend the period of a preliminary permit once for not more than 2 additional years beyond the 3 years</quote> and inserting the following:</text>
						<quoted-block display-inline="yes-display-inline" id="H2193EBDE49914594A2B2EF78F9839A1E" style="OLC">
 <text>Commission may—</text><paragraph id="H0252CDE822E84DFB95F0D2CC40171BCE"><enum>(1)</enum><text>extend the period of a preliminary permit once for not more than 4 additional years beyond the 4 years</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
 </subparagraph><subparagraph id="H652EE3746EE94E0BB4BB44FF6931CD08"><enum>(B)</enum><text>by striking the period at the end and inserting <quote>; and</quote>; and</text> </subparagraph><subparagraph id="HF695DFB0BF6548CFAE5A1EEE3B1F17ED"><enum>(C)</enum><text>by adding at the end the following:</text>

 <paragraph id="H521ED5F7BF6C42919B4D12792D3C4E6D"><enum>(2)</enum><text>if the period of a preliminary permit is extended under paragraph (1), extend the period of such preliminary permit once for not more than 4 additional years beyond the extension period granted under paragraph (1), if the Commission determines that there are extraordinary circumstances that warrant such additional extension.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subparagraph></paragraph></subsection><subsection id="H31AA1089A2F143DA8E079C6B13C1F090"><enum>(b)</enum><header>Time limit for construction of project works</header><text>Section 13 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/806">16 U.S.C. 806</external-xref>) is amended in the second sentence by striking <quote>once but not longer than two additional years</quote> and inserting <quote>for not more than 8 additional years,</quote>.</text> </subsection></section></legis-body><attestation><attestation-group><attestation-date chamber="House" date="20170612">Passed the House of Representatives June 12, 2017.</attestation-date><attestor display="yes">Karen L.
