			 provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Controlled Substances Act to reduce the gap between Federal and State marijuana
			 policy, and for other purposes.</official-title></form>
	<legis-body id="HA6A9768693D44D1EA43CD4E506CA7AA8" style="OLC">
 <section id="HF2E0FB94652A443681489C03E79CB7E0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Responsibly Addressing the Marijuana Policy Gap Act of 2017</short-title></quote>.</text> </section><section id="H219A1781857C423E99BEACE5E5ACD33A"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="HAE0A81446D46413CBCBFA5A35AEB6F9A"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>depository institution</term> means—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H7B80A31790D64CF3BABC1BA2B676E5A5"><enum>(A)</enum><text display-inline="yes-display-inline">a depository institution as defined in section 3(c) of the Federal Deposit Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1813">12 U.S.C. 1813(c)</external-xref>);</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H391E3853106541C38A3CBA71AC1B796E"><enum>(B)</enum><text display-inline="yes-display-inline">a Federal credit union as defined in section 101 of the Federal Credit Union Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1752">12 U.S.C. 1752</external-xref>); or</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H50EFA3381FC74375B64005B65CEAE4EB"><enum>(C)</enum><text display-inline="yes-display-inline">a State credit union as defined in section 101 of the Federal Credit Union Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1752">12 U.S.C. 1752</external-xref>);</text> </subparagraph></paragraph><paragraph id="H7BF2E5D7E4F743BFAFE224A13837702A"><enum>(2)</enum><text>the term <term>Indian country</term> has the meaning given the term in section 1151 of title 18, United States Code;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB4628C8CF87146A2B98AA1E1148A5127"><enum>(3)</enum><text display-inline="yes-display-inline">the term <term>Indian tribe</term> has the meaning given the term in section 4 of the <act-name parsable-cite="ISDA">Indian Self-Determination and Education Assistance Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>);</text> </paragraph><paragraph id="H017D23D5D9E847BFB5D3C6B4B7ECD4F2"><enum>(4)</enum><text display-inline="yes-display-inline">the term <term>marijuana</term> has the meaning given the term in section 102 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref>), as amended by subsection (d)(2);</text>
 </paragraph><paragraph id="H5EF3FB776D2347E798908149A090ABB6"><enum>(5)</enum><text>the term <term>marijuana derivative</term> means any marijuana product that is not a naturally grown and unadulterated marijuana flower product;</text>
 </paragraph><paragraph id="H5F85676846C5430C840867AB70197F8C"><enum>(6)</enum><text>the term <term>marijuana product</term> means any article that contains marijuana or any marijuana derivative;</text> </paragraph><paragraph id="HE8CAD81E869B470091BBB18668A0BCDD"><enum>(7)</enum><text>the term <term>marijuana-related business</term> means a manufacturer, producer, or any person that—</text>
 <subparagraph id="HE2BD8099B95A466F9FC531783890C060"><enum>(A)</enum><text>participates in any business or organized activity that involves handling marijuana or marijuana products, including selling, transporting, displaying, dispensing, or distributing marijuana or marijuana products; and</text>
 </subparagraph><subparagraph id="HAEBDB3D1395540F094DD5F0CFCD7B371"><enum>(B)</enum><text>engages in such activity pursuant to a law established by a State, a unit of local government, or an Indian tribe that has jurisdiction over the Indian country in which the activity occurs; and</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H543A04733A814298968449D16A054B1E"><enum>(8)</enum><text display-inline="yes-display-inline">the term <term>State</term> means each of the several States, the District of Columbia, Puerto Rico, and any territory or possession of the United States.</text>
			</paragraph></section><title id="HC94723E1EF8F4531AD9BB0F768AAD648" style="OLC"><enum>I</enum><header>Federalism in marijuana policy</header>
 <section commented="no" display-inline="no-display-inline" id="H45F2A96B347C4B609A9878F4EA89F088" section-type="subsequent-section"><enum>101.</enum><header display-inline="yes-display-inline">Elimination of criminal penalties for certain persons complying with State law</header><text display-inline="no-display-inline">Section 708 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/903">21 U.S.C. 903</external-xref>) is amended—</text> <paragraph commented="no" display-inline="no-display-inline" id="HCCA39EA1C8C9445FBDC9CECDDD6EE9A5"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>No provision</quote> and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="H50D6B07BAA1348CAB9EEDCEFE036D308" style="OLC">
 <subsection commented="no" display-inline="no-display-inline" id="HBDE1637E6FC347BF8A8935E9C8C323F8"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in subsection (b), no provision</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE98F3E81EC4C4B6AB62DE231291FDA96"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H2F91B67CC6574814AB1B696C7909F450" style="OLC">
 <subsection id="H3CFB5901DA264912B947D43E5BD73034"><enum>(b)</enum><header>Compliance with State law</header><text>Notwithstanding any other provision of law, the provisions of this title relating to marihuana shall not apply to any person acting in compliance with State law or the law of the Indian tribe that has jurisdiction over the Indian country, as defined in section 1151 of title 18, United States Code, where the conduct occurs relating to—</text>
 <paragraph id="H39A35EB42E2849749BDED5A6ED3F103B"><enum>(1)</enum><text>the production, possession, distribution, dispensation, administration, laboratory testing, or delivery of marihuana; or</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7449ED4F04134B4194B093DC412C5571"><enum>(2)</enum><text>the provision of ancillary services related to the activities described in paragraph (1), such as legal representation, payment processing, advertising, security services, scientific and safety testing, or property leasing.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section></title><title id="H148B6E6E3310453386C076B77999AA8F" style="OLC"><enum>II</enum><header>Removing business and banking barriers</header>
			<section id="H0CA16A9BB1C543E6AE7153080805A723" section-type="subsequent-section"><enum>201.</enum><header>Allowance of deductions and credits relating to expenditures in connection with marijuana sales
			 conducted in compliance with State law</header>
 <subsection id="H7F1977E1DC8D41E39063587FBF67BB9C"><enum>(a)</enum><header>Short title</header><text>This section may be cited as the <quote><short-title>Small Business Tax Equity Act of 2017</short-title></quote>.</text> </subsection><subsection id="HC0B301BF78BC4457B423BCB666F5BA1C"><enum>(b)</enum><header>Allowance</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/280E">Section 280E</external-xref> of the Internal Revenue Code of 1986 is amended by inserting before the period at the end the following: <quote>, unless such trade or business consists of marijuana sales conducted in compliance with State law or the law of the Indian tribe, as defined in section 4 of the <act-name parsable-cite="ISDA">Indian Self-Determination and Education Assistance Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>), that has jurisdiction over the Indian country, as defined in section 1151 of title 18, where the trade or business is conducted</quote>.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="H1029FD857AA84093AA5F2AE47B89DE17"><enum>(c)</enum><header>Effective date</header><text>The amendment made by this section shall apply with respect to taxable years ending after the date of the enactment of this Act.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="H35CC6B61CB9D43C5AD55EF3220F63DD1" section-type="subsequent-section"><enum>202.</enum><header display-inline="yes-display-inline">Marijuana print advertising</header>
 <subsection commented="no" display-inline="no-display-inline" id="HFFF0E2C6A89A44EF929F917CEB4C2CDF"><enum>(a)</enum><header display-inline="yes-display-inline">Short title</header><text>This section may be cited as the <quote><short-title>Marijuana Advertising In Legal States Act</short-title></quote> or the <quote><short-title>MAILS Act</short-title></quote>.</text> </subsection><subsection commented="no" display-inline="no-display-inline" id="H584C1BA0140644E7934F3A74E468140D"><enum>(b)</enum><header display-inline="yes-display-inline">Marijuana print advertising</header><text display-inline="yes-display-inline">Section 403(c)(1) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/843">21 U.S.C. 843(c)(1)</external-xref>) is amended by adding at the end the following: <quote>This paragraph does not apply to an advertisement to the extent that the advertisement relates to an activity, involving marihuana, that is in compliance with the law of the State or the law of the law of the Indian tribe, as defined in section 4 of the <act-name parsable-cite="ISDA">Indian Self-Determination and Education Assistance Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>), that has jurisdiction over the Indian country, as defined in section 1151 of title 18, United States Code, in which that activity takes place.</quote>.</text>
				</subsection></section><section id="H3D8F10E1C0C648368EB3162BB50AC067"><enum>203.</enum><header>Safe harbor for marijuana broadcast advertising</header>
 <subsection id="H6014C71B0BAE4B40ACE659D05572D9C0"><enum>(a)</enum><header>Communications Act of 1934</header><text>Section 309 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/309">47 U.S.C. 309</external-xref>) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H811B984257084C0D8DE0F68C75BC7512" style="OLC">
						<subsection id="HBFEC259CBAC1419883DB62A5047D401B"><enum>(m)</enum><header>Safe harbor for marijuana broadcast advertising</header>
 <paragraph id="H117AD71F7D6744A685CD12BB31CC0533"><enum>(1)</enum><header>Definitions</header><text>In this subsection—</text> <subparagraph id="H438E464E2A634987BF5D51BCAC2F8AEC"><enum>(A)</enum><text>the term <term>covered activity</term> means the production, possession, sale, distribution, dispensation, administration, processing, or laboratory testing of marijuana;</text>
 </subparagraph><subparagraph id="H5527EF8A6468413D835962B73139A19F"><enum>(B)</enum><text>the term <term>Indian country</term> has the meaning given the term in section 1151 of title 18, United States Code;</text> </subparagraph><subparagraph id="H95E1E0BB586C4ADCBDAEF55D4ECB8F7A"><enum>(C)</enum><text>the term <term>Indian tribe</term> has the meaning given the term in section 4 of the <act-name parsable-cite="ISDA">Indian Self-Determination and Education Assistance Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>);</text>
 </subparagraph><subparagraph id="H40DBB85D4DC543E7A6282A90D16B249E"><enum>(D)</enum><text>the term <term>marijuana</term> has the meaning given the term in section 102 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref>); and</text>
 </subparagraph><subparagraph id="HD961D448ABB94F3596271E374A0DD521"><enum>(E)</enum><text>the term <term>media of mass communications</term> has the meaning given the term in subsection (i)(3)(C).</text> </subparagraph></paragraph><paragraph id="H5CF35A0CB5884B50BCC1AFF7B4631C02"><enum>(2)</enum><header>Safe harbor</header><text>In determining whether to grant an application for a license or permit (including for the renewal of a license or permit) under this section, the Commission shall not consider the broadcast by any medium of mass communications of any advertising or other information pertaining to any aspect of a covered activity to be contrary to the public interest, convenience, and necessity, if the covered activity, and the advertising thereof, does not violate the law of—</text>
 <subparagraph id="HE87E59C81D8B49838FA87CBC074078B9"><enum>(A)</enum><text>the State, or the Indian tribe that has jurisdiction over the Indian country, in which the transmission point of the subject medium of mass communications is located; or</text>
 </subparagraph><subparagraph id="H7D299D9A914241919503531034AC1E6B"><enum>(B)</enum><text>with respect to a radio or television station, the State, or the Indian tribe that has jurisdiction over the Indian country, in which the station's community of license is or is proposed to be located.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="HC6465F1FE64844AC82FCFAB063907CA4"><enum>(b)</enum><header>Controlled Substances Act</header><text>Section 708 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/903">21 U.S.C. 903</external-xref>), as amended by section 101, is amended—</text>
 <paragraph id="HA9D3121E2DD14F7CA28F1D768921003A"><enum>(1)</enum><text>in subsection (a), by striking <quote>subsection (b)</quote> and inserting <quote>subsections (b) and (c)</quote>;</text> </paragraph><paragraph id="H0C6E9841BAF14F2FA716C7AC5B90AA0E"><enum>(2)</enum><text>in subsection (b), by striking <quote>Notwithstanding</quote> and inserting <quote>Subject to subsection (c) and notwithstanding</quote>; and</text>
 </paragraph><paragraph id="HDEFDAFB1C77140A2AE22CB872500071C"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H805A2F489D6A4D70BAFDE7AEE3FD5A44" style="OLC"> <subsection id="H7DB402842DED479BABCCD14E0AA1E9A4"><enum>(c)</enum><header>Compliance with State or tribal law relating to marijuana broadcast advertising</header> <paragraph id="H9C79400B7C164776A88AF4B89B034FAB"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2) and notwithstanding any other provision of law, the provisions of this title relating to marijuana shall not apply to the broadcast by any medium of mass communications of any advertising or other information pertaining to any aspect of a covered activity if the covered activity, and the advertising thereof, does not violate the law of—</text>
 <subparagraph id="H1EE02CF1CFAA42C28EBA79D2F6F51786"><enum>(A)</enum><text>the State, or the Indian tribe that has jurisdiction over the Indian country, in which the transmission point of the subject medium of mass communications is located; or</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE3197B8D1CB64E41BC1DD806368C7995"><enum>(B)</enum><text>with respect to a radio or television station, the State, or the Indian tribe that has jurisdiction over the Indian country, in which the station’s community of license is located.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB1FE580D22204972A94BA627CBA7B6FE"><enum>(2)</enum><header>Broadcasts calculated to induce travel from non-legal jurisdictions</header><text>Paragraph (1) shall not apply to the broadcast by any medium of mass communications of any advertising or other information pertaining to any aspect of a covered activity that is calculated to induce residents of a non-legal jurisdiction to travel to another State or other area of Indian country to purchase marijuana.</text>
 </paragraph></subsection><subsection id="H07AE5E06F3344A5FBC1B7A6162F798A2"><enum>(d)</enum><header>Definitions</header><text>For purposes of this section—</text> <paragraph id="H58D73B81510F49B197D9A222A19129C8"><enum>(1)</enum><text>the term <term>covered activity</term> means the production, possession, sale, distribution, dispensation, administration, processing, or laboratory testing of marijuana;</text>
 </paragraph><paragraph id="HBB2ED2C18A5C4E5082DA5E5B19A992D6"><enum>(2)</enum><text>the term <term>Indian country</term> has the meaning given the term in section 1151 of title 18, United States Code;</text> </paragraph><paragraph commented="no" id="H7C5CCC1035A54E23B3858AC12542D536"><enum>(3)</enum><text>the term <term>Indian tribe</term> has the meaning given the term in section 4 of the <act-name parsable-cite="ISDA">Indian Self-Determination and Education Assistance Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>);</text>
 </paragraph><paragraph id="H078A54C76F054297961B4C74B68FEE7F"><enum>(4)</enum><text>the term <term>media of mass communications</term> has the meaning given the term in section 309(i)(3)(C) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/309">47 U.S.C. 309(i)(3)(C)</external-xref>); and</text>
 </paragraph><paragraph id="HC44E40529C7A4BE8966C79CF3495A8E1"><enum>(5)</enum><text>the term <term>non-legal jurisdiction</term> means—</text> <subparagraph id="HA95F8A22BE7D416FA1DE5649B7C16216"><enum>(A)</enum><text>a State in which the purchase of marijuana is prohibited under State law; or</text>
 </subparagraph><subparagraph id="H1ADA859A09154A35BF16F122857F5E5E"><enum>(B)</enum><text>Indian country in which the purchase of marijuana is prohibited under the law of the Indian tribe that has jurisdiction over the Indian country.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H1E5DF7FDA6E04B7C85BB1BA5887FE530" section-type="subsequent-section"><enum>204.</enum><header display-inline="yes-display-inline">Access to banking</header>
 <subsection commented="no" display-inline="no-display-inline" id="H12907E1C96524A87B5E5F182A87BA6C6"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section—</text> <paragraph commented="no" display-inline="no-display-inline" id="H5BFA7A8DFEF0420BB1C4910CED415F47"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>Federal banking regulator</term> means each of the Board of Governors of the Federal Reserve System, the Bureau of Consumer Financial Protection, the Federal Deposit Insurance Corporation, the Office of the Comptroller of the Currency, the National Credit Union Administration, or any Federal agency or department that regulates banking or financial services, as determined by the Secretary of the Treasury;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC76C36B0CDAA4008A688FD19181F01DE"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>financial service</term> means a financial product or service as defined in section 1002 of the Dodd-Frank Wall Street Reform and Consumer Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/12/5481">12 U.S.C. 5481</external-xref>);</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0EF06710085648CEAA7B420E5FE434FB"><enum>(3)</enum><text display-inline="yes-display-inline">the term <term>manufacturer</term> means a person who manufactures, compounds, converts, processes, prepares, or packages marijuana or marijuana products;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0AF9B8BE8EB44CD7A68ACC4F1E5B0214"><enum>(4)</enum><text display-inline="yes-display-inline">the term <term>producer</term> means a person who plants, cultivates, harvests, or in any way facilitates the natural growth of marijuana.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H93786130B3D64E41942468A30C0934D0"><enum>(b)</enum><header display-inline="yes-display-inline">Safe harbor for depository institutions</header><text display-inline="yes-display-inline">A Federal banking regulator may not—</text> <paragraph commented="no" display-inline="no-display-inline" id="H2BFA117A9917435CAA6042823F520EA1"><enum>(1)</enum><text display-inline="yes-display-inline">terminate or limit the deposit insurance of a depository institution under the Federal Deposit Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1811">12 U.S.C. 1811</external-xref> et seq.) or the Federal Credit Union Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1751">12 U.S.C. 1751</external-xref> et seq.) solely because the depository institution provides or has provided financial services to a marijuana-related business;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB4A6B563BB9644BD97ED9A5E454E6262"><enum>(2)</enum><text display-inline="yes-display-inline">prohibit, penalize, or otherwise discourage a depository institution from providing financial services to a marijuana-related business;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H18690ECF5335466F813DC059E20E9D67"><enum>(3)</enum><text display-inline="yes-display-inline">recommend, incentivize, or encourage a depository institution not to offer financial services to a person, or to downgrade or cancel the financial services offered to a person solely because—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="H37028DAFD7A84471A2E523E31D5E1D25"><enum>(A)</enum><text display-inline="yes-display-inline">the person is a manufacturer or producer of marijuana;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H4E6C522A4C9A4ADB9C3728834C9D547E"><enum>(B)</enum><text display-inline="yes-display-inline">the person is the owner, operator, or an employee of a marijuana-related business;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H1ADBAD29C05D4AC48E03A231FB3C2B03"><enum>(C)</enum><text display-inline="yes-display-inline">the person later becomes an owner, operator, or employee of a marijuana-related business; or</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA2ABB05DFCB543968EE2987F3D6168B8"><enum>(D)</enum><text display-inline="yes-display-inline">the depository institution was not aware that the person is the owner, operator, or an employee of a marijuana-related business; or</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H459B7D6035F840EC86A757B349A8CEF6"><enum>(4)</enum><text display-inline="yes-display-inline">take any adverse or corrective supervisory action on a loan to an owner, operator, or employee of—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H08AF8A6603D7419897AD2D6F205214B9"><enum>(A)</enum><text display-inline="yes-display-inline">a marijuana-related business solely because the owner, operator, or employee is an owner, operator, or employee of a marijuana-related business; or</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H0426FD46D2AC47E68B07567596F5183A"><enum>(B)</enum><text display-inline="yes-display-inline">real estate or equipment that is leased to a marijuana-related business solely because the owner or operator of the real estate or equipment leased the real estate or equipment to a marijuana-related business.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H5A875C517B3B4000A3388023572DC4B9"><enum>(c)</enum><header display-inline="yes-display-inline">Prohibition on denying master accounts to depository institutions because of marijuana-Related
 funds</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the Board of Governors of the Federal Reserve System may not deny a master account to a depository institution solely on the basis that the depository institution accepts deposits of funds from marijuana-related businesses.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="H8AB2E09BA751418A9917E03DF88603DE"><enum>(d)</enum><header display-inline="yes-display-inline">Protections under Federal law</header>
 <paragraph commented="no" display-inline="no-display-inline" id="H1018DEBD58BD46FBB5014CF860D9B444"><enum>(1)</enum><header display-inline="yes-display-inline">Investigation and prosecution</header><text display-inline="yes-display-inline">A depository institution that provides financial services to a marijuana-related business, or the officers, directors, and employees of that business, shall be immune from Federal criminal prosecution or investigation for providing those services.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0D8160FE60644B39AE292414AEFF6E05"><enum>(2)</enum><header display-inline="yes-display-inline">Federal criminal law</header><text display-inline="yes-display-inline">A depository institution that provides financial services to a marijuana-related business, or the officers, directors, and employees of that business, shall not be subject to a criminal penalty under any Federal law solely for providing those services or for further investing any income derived from such services.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD918CDFC88DF4DF8AF9B6C4A9069E41A"><enum>(3)</enum><header display-inline="yes-display-inline">Forfeiture</header><text display-inline="yes-display-inline">A depository institution that has a legal interest in the collateral for a loan made to an owner, operator, or employee of a marijuana-related business, or to an owner or operator of real estate or equipment that is leased to a marijuana-related business, shall not be subject to criminal, civil, or administrative forfeiture of that legal interest pursuant to any Federal law for providing such loan.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HC74AFCF99C4C4EEAB87EA1381AB0B603"><enum>(e)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section requires a depository institution to provide financial services to a marijuana-related business.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="H39DD56ECD9884DA7BE116208D70440A6"><enum>205.</enum><header>Requirements for filing suspicious activity reports</header>
 <subsection commented="no" display-inline="no-display-inline" id="HC79467C104244F4AB20A9A19415927B1"><enum>(a)</enum><header>Definition</header><text display-inline="yes-display-inline">In this section, the term <term>deposit account records</term>—</text> <paragraph commented="no" display-inline="no-display-inline" id="HD374B291D17B4D17A945CB2F0B7B9EF6"><enum>(1)</enum><text display-inline="yes-display-inline">means account ledgers, signature cards, certificates of deposit, passbooks, corporate resolutions authorizing accounts in the possession of the depository institution, and other books and records of the depository institution, including records maintained by computer, which relate to the depository institution's deposit taking function; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1FB7A041603147779DA7760F51E9C585"><enum>(2)</enum><text display-inline="yes-display-inline">does not include account statements, deposit slips, items deposited, or cancelled checks.</text> </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H8C52AA937D3E401B95D2F8270F3575C5"><enum>(b)</enum><header>Suspicious activity reports</header> <paragraph commented="no" display-inline="no-display-inline" id="H19678A43B8B342438475FCD8FECC9484"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A depository institution or any director, officer, employee, or agent of a depository institution shall not be required to report a suspicious transaction as prescribed by the guidance issued by the Financial Crimes Enforcement Network titled <quote>BSA Expectations Regarding Marijuana-Related Businesses</quote> (FIN–2014–G001; published on February 14, 2014) or section 21.11(c)(4)(1) of title 12, Code of Federal Regulations, if—</text>
 <subparagraph id="HC09590CF8CC444078426F9DD5A84F847"><enum>(A)</enum><text>the depository institution reasonably believes, based on customer due diligence, that the marijuana-related businesses to which it is providing financial services does not implicate one of the priorities outlined in the document entitled <quote>Memorandum for All United States Attorneys: Guidance Regarding Marijuana Enforcement</quote> issued by James M. Cole on August 29, 2013, nor violate the laws of the State in which marijuana-related business operates; and</text>
 </subparagraph><subparagraph id="H5ED9A2EA77194E0CB4359AA6DA9F8BCA"><enum>(B)</enum><text>the deposit account records of the depository institution—</text> <clause id="H227260859E52470481968773A44EBE93"><enum>(i)</enum><text>include—</text>
 <subclause id="HAFD83CC1D3844AB3A5B0FD7E2C55749B"><enum>(I)</enum><text>identifying information of the account holder and related parties; and</text> </subclause><subclause id="HED859F07DC964F648C9C283BB7364803"><enum>(II)</enum><text>addresses of the account holder and related parties; and</text>
 </subclause></clause><clause id="H98674B9DBC854A1F8BE0E5882416B2F5"><enum>(ii)</enum><text>state that—</text> <subclause id="H5C488967A85748E99C6D43CF43D0D853"><enum>(I)</enum><text>the account holder is engaged in a marijuana-related business; and</text>
 </subclause><subclause id="H712D82B026D5491F9E59DA262DB414C3"><enum>(II)</enum><text>no additional suspicious activity has been identified.</text> </subclause></clause></subparagraph></paragraph><paragraph id="H813C9193576E43B5B20FEEAD76CC0CE8"><enum>(2)</enum><header>Safe harbor</header><text>A depository institution or any director, officer, employee, or agent of a depository institution that reports a suspicious transaction relating to a marijuana-related business shall be considered to have met the requirements of the guidance described in paragraph (1).</text>
 </paragraph></subsection></section><section id="H8FF0DCA59AAD4DCE991F2E7A80A2F064"><enum>206.</enum><header>Bankruptcy protection</header><text display-inline="no-display-inline">Notwithstanding any other provision of law, a marijuana-related business shall be entitled to—</text> <paragraph id="HE59FCEDB5BE1440995A524AEEC58B709"><enum>(1)</enum><text>relief under chapter 7, 11, or 13 of title 11, United States Code; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0853A8066C614597A69390648DCE6448"><enum>(2)</enum><text>convert a case in accordance with section 706, 1112, or 1307 of title 11, United States Code, as applicable.</text>
				</paragraph></section><section id="H84B6FF0D646B4EEBB8E309EC66F7FF86"><enum>207.</enum><header>Tribal marijuana sovereignty</header>
 <subsection id="H9E3E19EACB494FB8B2563A8F72BF0C8B"><enum>(a)</enum><header>In general</header><text>The fact that an Indian tribe, a member of an Indian tribe, or a tribal entity is complying with the law of Indian tribe that has jurisdiction over the Indian country, as defined in section 1151 of title 18, United States Code, where the conduct occurs to produce, purchase, or possess marijuana on lands held in fee by that Indian tribe, lands held in trust by the United States for the benefit of that Indian tribe, or lands conveyed to an Alaska Native Corporation pursuant to the Alaska Native Claims Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1601">43 U.S.C. 1601</external-xref> et seq.), shall not be considered when—</text>
 <paragraph id="H114159A6EE4E443CA7267F6D74944D02"><enum>(1)</enum><text>allocating or distributing Federal funds or other Federal benefits to the Indian tribe, a member of an Indian tribe, or the tribal entity;</text>
 </paragraph><paragraph id="H57AEDFE289CC4DEA9B9B3CADB3BF25B8"><enum>(2)</enum><text>determining the eligibility of the Indian tribe or the tribal entity for any contract, grant, or other agreement with the United States, or the renewal or modification thereof, where the legal production, purchase, or possession of marijuana by the Indian tribe or a member of an Indian tribe would otherwise disqualify the Indian tribe from eligibility;</text>
 </paragraph><paragraph id="HC9CD4A07CF504BCBA746520D99775072"><enum>(3)</enum><text>evaluating the ongoing compliance of the Indian tribe or the tribal entity with any contract, grant, or other agreement with the United States where the legal production, purchase, or possession of marijuana by the Indian tribe or a member of an Indian tribe would otherwise result in the Indian tribe or tribal entity being out of compliance; and</text>
 </paragraph><paragraph id="HCCE142D043634D6D9EC1AA0795CF91FE"><enum>(4)</enum><text>determining if the Indian tribe or a member of an Indian tribe is eligible for Federal benefits for which the Indian tribe or a member of an Indian tribe would otherwise be eligible.</text>
 </paragraph></subsection><subsection id="H8F34D941BE3940A5B6FDC5A1F6695BEB"><enum>(b)</enum><header>Clarification</header><text>This subsection shall not prohibit consideration of income from the legal production, purchase, or possession of marijuana to the same extent that the other legal income would be considered when allocating or distributing Federal funds or determining eligibility for Federal benefits.</text>
 </subsection><subsection id="H69722DCA34D04349BAD71BC195B9A1AC"><enum>(c)</enum><header>Definitions</header><text>For purposes of this subsection:</text> <paragraph id="HF70AA4882CDF456EB1BD9CB6E7C80E68"><enum>(1)</enum><header>Tribal entity</header><text>The term <term>tribal entity</term> means—</text>
 <subparagraph id="H356481A904CE414689B0B162AC5FD962"><enum>(A)</enum><text display-inline="yes-display-inline">tribal organizations as defined in section 4(l) of the Indian Self-Determination and Education Assistance Act of 1975 (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304(l)</external-xref>);</text>
 </subparagraph><subparagraph id="H78FCC31C439F497985B2B56BA01671E7"><enum>(B)</enum><text display-inline="yes-display-inline">tribally designated housing entities as defined in section 4(22) of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4103">25 U.S.C. 4103(22)</external-xref>); or</text>
 </subparagraph><subparagraph id="HF8A9B79D071243C6BB6C645611C51B7A"><enum>(C)</enum><text display-inline="yes-display-inline">Indian-owned businesses and tribal enterprises as defined in paragraphs (5) and (8) of section 3 of the Native American Business Development, Trade Promotion, and Tourism Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/25/4302">25 U.S.C. 4302</external-xref>).</text>
 </subparagraph></paragraph><paragraph id="HE07D9A431A0442A1A9B703AD5B44D152"><enum>(2)</enum><header>Legally authorized</header><text>The term <term>legally authorized</term> means permitted under the laws of—</text> <subparagraph id="H2988EF7BDE7D402189FCC432F1D6B485"><enum>(A)</enum><text>the United States;</text>
 </subparagraph><subparagraph id="H940069DFD1FF4802873D89F1044369A4"><enum>(B)</enum><text>the State where the lands held in fee by an Indian tribe or held in trust by the United States for the benefit on behalf of that Indian tribe are located; or</text>
 </subparagraph><subparagraph id="H7BED1E73FEA9460F89C4402DC362D8D4"><enum>(C)</enum><text>an Indian tribe.</text> </subparagraph></paragraph></subsection></section></title><title id="HBFEC8D3A693A423B9D05951FC879DFF3" style="OLC"><enum>III</enum><header>Individual protections</header> <section id="HCDB1EDD7CA0E452E8D4E798FDDAF7E68"><enum>301.</enum><header>Expungement of criminal records for certain marijuana-related offenses</header> <subsection id="H156AC640A70D49E3AF0D8C7D4015BD2D"><enum>(a)</enum><header>Short title</header><text>This section may be cited as the <quote><short-title>Clean Slate for Marijuana Offenses Act of 2017</short-title></quote>.</text>
 </subsection><subsection id="HE76D51596D4C4CE2BE78A9419E455A37"><enum>(b)</enum><header>Expungement</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/229">Chapter 229</external-xref> of title 18, United States Code, is amended by inserting after subchapter C the following:</text>

							<section id="H665A60FD43E54C73BF988A7A8C4227D3"><enum>3631.</enum><header>Expungement of certain criminal records in limited circumstances</header>
 <subsection id="H2EE148A2857148BFB8E1BC1261AA952E"><enum>(a)</enum><header>In general</header><text>Any individual convicted of a qualifying marijuana-related offense who fulfills the requirements of section 3632 may, upon petition for expungement made in accordance with this subchapter, obtain an order granting expungement under this subchapter.</text>
 </subsection><subsection id="HBA88698ABDCE45EB822EC852DB08B40B"><enum>(b)</enum><header>Definition of qualifying marijuana-Related offense</header><text>In this subchapter, the term <quote>qualifying marijuana-related offense</quote> means an offense against the United States in which the conduct constituting the offense—</text> <paragraph id="HF5FE2BD2C86A4C8F84D9CE641853CFC0"><enum>(1)</enum><text>was legal under the State law or the law of the Indian tribe at the time of the offense; or</text>
 </paragraph><paragraph id="H15A4CEB9DB84486B9DE9FFF4858D2DC3"><enum>(2)</enum><text>was the possession of marijuana in a quantity is not greater than 1 ounce.</text> </paragraph></subsection><subsection id="HD8AA84E8FA484651BE6C628010F78155"><enum>(c)</enum><header>Definitions</header><text>In this subchapter—</text>
 <paragraph id="HD260AC29C5BD40E7BB270C2AC823EE5F"><enum>(1)</enum><text>the term <term>Indian country</term> has the meaning given the term in section 1151;</text> </paragraph><paragraph id="HE4A247A704564AE8B12E2B15272BFE4C"><enum>(2)</enum><text>the term <term>Indian tribe</term> has the meaning given the term in section 4 of the <act-name parsable-cite="ISDA">Indian Self-Determination and Education Assistance Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>); and</text>
 </paragraph><paragraph id="HF1CD3C9FF3E8409F90B0230FFB67E822"><enum>(3)</enum><text>the term <term>State</term> includes the District of Columbia, Puerto Rico, and any other territory or possession of the United States.</text>
 </paragraph></subsection></section><section id="H0C405AFE761F43A5BE757E7029E171D1"><enum>3632.</enum><header>Requirements for expungement</header><text display-inline="no-display-inline">No individual shall be eligible for an order of expungement under this subchapter unless, before filing a petition under this subchapter, such individual fulfills all requirements of the sentence for the conviction for which expungement is sought, including completion of any term of imprisonment or period of probation, meeting all conditions of a supervised release, and paying all fines.</text>
							</section><section id="HF3E82050489F4A339D9956FAE7677860"><enum>3633.</enum><header>Procedure for expungement</header>
 <subsection id="HA706634A8B054E199E19836D4521A803"><enum>(a)</enum><header>Petition</header><text>An individual may file a petition for expungement of a conviction in the court in which the conviction was obtained. A copy of the petition shall be served by the court upon the United States Attorney for the judicial district of that court.</text>
 </subsection><subsection id="H51F4C7413799458F980F6717B006C97C"><enum>(b)</enum><header>Opportunity for Government To contest petition</header><text>Not later than 60 days after the date a copy of a petition is served on the Government under subsection (a), the Government may, if the Government determines the facts do not support the petition, inform the court and the petitioner that the Government opposes granting expungement. If the Government does so inform the court and the petitioner, the court shall allow the Government and the petitioner an opportunity to present evidence and argument relating to the petition.</text>
 </subsection><subsection id="H8330340553BC43628DA98F18063FCE7E"><enum>(c)</enum><header>Court-Ordered expungement</header><text>If, after the passage of the 60-day period described in subsection (a) or earlier, if the Government informs the court it will not oppose granting expungement or if proceedings related to that opposition have been completed, the court determines the preponderance of the evidence before the court supports the granting of expungement under this subchapter, the court shall issue an order granting that expungement. If the court determines the petition is not supported by the preponderance of the evidence before the court, the court shall deny the petition.</text>
								</subsection></section><section id="H0B330550DE604E20880FDDB28D7BC209"><enum>3634.</enum><header>Effect of expungement</header>
 <subsection id="HD4484351B8104E9AA0B7B4B777B90552"><enum>(a)</enum><header>In general</header><text>An order granting expungement under this subchapter restores the individual concerned, in the contemplation of the law, to the status that individual occupied before the arrest or the institution of criminal proceedings for the offense for which ex­punge­ment is granted.</text>
 </subsection><subsection id="H4EA0F179C84247259F0A4C69FA55E655"><enum>(b)</enum><header>No disqualification; statements</header><text>After an order under this subchapter granting expungement of an individual’s criminal records, that individual is not required to divulge information pertaining to the expunged conviction. The fact that such individual has been convicted of the criminal offense concerned shall not operate as a disqualification of that individual to pursue or engage in any lawful activity, occupation, or profession. Such individual is not guilty of any perjury, false answering, or making a false statement by reason of that individual’s failure to recite or acknowledge such arrest or institution of criminal proceedings, or results thereof, in response to an inquiry made of that individual for any purpose.</text>
 </subsection><subsection id="H03861F6996474DDCBDF8E13D7A875D44"><enum>(c)</enum><header>Records To be destroyed</header><text>Except as provided in section 3635, upon order of expungement, all official law enforcement and court records, including all references to such person’s arrest for the offense, the institution of criminal proceedings against the individual, and the results thereof, except publicly available court opinions or briefs on appeal, shall be permanently destroyed.</text>
								</subsection></section><section id="HF98099B3B2D64D8297EC77C69BD14A3E"><enum>3635.</enum><header>Disclosure of expunged records</header>
 <subsection id="H0119F7305B764DD4978204DFB50E34EA"><enum>(a)</enum><header>Index To assist authorized disclosure</header><text>The Department of Justice shall maintain a nonpublic manual or computerized record of expungement under this subchapter containing only the name of, and alphanumeric identifiers selected by the Department of Justice that relate to, the persons who obtained expungement under this subchapter, and the order of expungement.</text>
 </subsection><subsection id="H294DF2849BCF4DD8954EE3FEC0EA124F"><enum>(b)</enum><header>Authorized disclosure to individual</header><text>Information in the index shall be made available only to the individual to whose expungement it pertains or to such individual’s designated agent.</text>
 </subsection><subsection id="H903996229A2C4AFD9BA704C34D0E8548"><enum>(c)</enum><header>Punishment for improper disclosure</header><text>Whoever knowingly discloses information relating to an expunged conviction other than as authorized in this subchapter shall be fined under this title or imprisoned not more than one year, or both.</text></subsection></section></subchapter><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H4B5D94700B7444369BBF9CCA257D74C4"><enum>(c)</enum><header>Clerical amendment</header><text>The table of subchapters at the beginning of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/229">chapter 229</external-xref> of title 18, United States Code, is amended by adding at the end the following item:</text>

				</subsection></section><section id="H099FDC70D9E64203A847218378ECB482"><enum>302.</enum><header>Limit on drug testing for applicants for Federal employment</header>
 <subsection id="H4CB890C3E9C646FB8F30E9385265CA41"><enum>(a)</enum><header>Definition</header><text>In this section, the term <term>covered position</term> means a position in the civil service (as defined in section 2101 of title 5, United States Code).</text> </subsection><subsection id="HADC90F3F9AC846E89FA6DF5225C444AD"><enum>(b)</enum><header>Prohibition</header><text>An agency, establishment, or other appointing authority in the executive, legislative, or judicial branch of the Federal Government may not—</text>
 <paragraph id="H8036BAC23C09407087F03FEEF5E3D048"><enum>(1)</enum><text>require an applicant for a covered position to submit to a test that screens for the use of marijuana; or</text>
 </paragraph><paragraph id="H5A111198E9AA45CF98920A47122BD736"><enum>(2)</enum><text>in determining whether to appoint the applicant to the covered position—</text> <subparagraph id="H00ED6780DED64B279FAFE947A4F1FA22"><enum>(A)</enum><text>use the results of a test indicating that an applicant for a covered position used marijuana, in whole or in part; or</text>
 </subparagraph><subparagraph id="HA0839D035F914783A75D1281A2BBFCB5"><enum>(B)</enum><text>use any evidence that the applicant used marijuana before the date on which the application is submitted if such use was authorized under the law of the State or the law of the Indian tribe that has jurisdiction over the Indian country where the use occurred.</text>
						</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H8666482931D642BB917F54B1CC41DFEF"><enum>303.</enum><header>Fair access to education</header>
 <subsection commented="no" display-inline="no-display-inline" id="HD008380AD99746A8839EF9857A70DA50"><enum>(a)</enum><header>Short title</header><text>This section may be cited as the <quote><short-title>Fair Access to Education Act of 2017</short-title></quote>.</text> </subsection><subsection id="H9759477DA3764724919ADB75938D4456"><enum>(b)</enum><header> Exclusion of misdemeanor marijuana possession offenses from drug-Related offenses resulting in suspension of eligibility for financial assistance for higher education</header><text display-inline="yes-display-inline">Section 484(r)(1) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1091">20 U.S.C. 1091(r)(1)</external-xref>) is amended by inserting after <quote>controlled substance</quote> the following: <quote>, but not including any misdemeanor offense for possession of marihuana (as such term is defined in section 102 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref>)),</quote>.</text>
				</subsection><subsection id="H8FB9135DE1094DB4AEB8719991688629"><enum>(c)</enum><header>Applicability; resumption of eligibility</header>
 <paragraph id="H7B9AD38D64E3455CA19B116F9E0FBF50"><enum>(1)</enum><header>Applicability</header><text>The amendment made by subsection (a) shall apply to convictions for offenses described in the matter inserted by such amendment occurring before, on, and after the date of enactment of this Act.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H177943FE5C924D218F7BA16CD85ED9A2"><enum>(2)</enum><header>Resumption of eligibility</header><text display-inline="yes-display-inline">Any student whose eligibility for grants, loans, and work assistance under title IV of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070">20 U.S.C. 1070</external-xref> et seq.) was suspended under section 484(r)(1) of such Act by reason of a conviction, before the date of enactment of this Act, for an offense described in the matter inserted by the amendment made by subsection (a) shall, unless otherwise ineligible for such assistance, resume eligibility upon such date of enactment.</text>
 </paragraph></subsection></section><section id="HCF6695FCD8544B4B9B18A6248E1F2F1C"><enum>304.</enum><header>Civil forfeiture exemption for marijuana facilities authorized by State law</header><text display-inline="no-display-inline">Section 511(a)(7) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/881">21 U.S.C. 881(a)(7)</external-xref>) is amended—</text> <paragraph id="H8951DF429D534B2A8607C139C12B1843"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>(7) All</quote> and inserting <quote>(7)(A) Except as provided in subparagraph (B), all</quote>; and</text>
 </paragraph><paragraph id="H450696070FD84A188A39F92B442DC829"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H185B9DACD6FB4835A3CA66222D074924" style="OLC"> <subparagraph commented="no" display-inline="no-display-inline" id="HC606D243767D46019D25CB6C3CFED028" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">No real property, including any right, title, and interest in the whole of any lot or tract of land and any appurtenances or improvements, shall be subject to forfeiture under subparagraph (A) due to marijuana-related conduct that is authorized by State law or the law of the Indian tribe, as defined in section 4 of the <act-name parsable-cite="ISDA">Indian Self-Determination and Education Assistance Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>), that has jurisdiction over the Indian country, as defined in section 1151 of title 18, United States Code, in which the conduct occurs.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section id="HCE86FBEA2C87422E8406766A28717642"><enum>305.</enum><header>Prohibition on inadmissibility or deportation of aliens who comply with State law</header>
 <subsection id="H26212F0A40D24F1C99B3E8B9A1CA4C32"><enum>(a)</enum><header>Prohibition on inadmissibility</header><text>Section 212(a)(2)(A)(i)(II) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(2)(A)(i)(II)</external-xref>) is amended by inserting <quote>other than an act involving marijuana that is permitted under the laws of a State or the law of an Indian tribe, as defined in section 4 of the <act-name parsable-cite="ISDA">Indian Self-Determination and Education Assistance Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>), that has jurisdiction over the Indian country, as defined in section 1151 of title 18, United States Code, in which the act occurs</quote> after <quote>802)),</quote>.</text>
 </subsection><subsection id="H81324869F96D4578B166584DAF34431E"><enum>(b)</enum><header>Prohibition on deportation</header><text>Section 237(a)(2)(B)(i) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1227">8 U.S.C. 1227(a)(2)(B)(i)</external-xref>) is amended by striking <quote>marijuana,</quote> and inserting <quote>marijuana or an offense involving marijuana that is permitted under the laws of a State or the law of an Indian tribe, as defined in section 4 of the <act-name parsable-cite="ISDA">Indian Self-Determination and Education Assistance Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>), that has jurisdiction over the Indian country, as defined in section 1151 of title 18, United States Code, in which the offense occurs</quote>.</text>
				</subsection></section><section id="H15065C61F2334263B6778C2B8C8E71B9"><enum>306.</enum><header>Drug-related criminal activity in federally assisted housing</header>
 <subsection id="HB06CD6795CB84091857D98D62DAF14E0"><enum>(a)</enum><header>In general</header><text>Section 3(b) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437a">42 U.S.C. 1437a(b)</external-xref>) is amended—</text> <paragraph id="H92061382249C4EC49A3E77F8FC311C71"><enum>(1)</enum><text>by striking paragraph (9) and inserting the following:</text>

 </subparagraph><subparagraph id="HE5135CC54D034D4EA5E354FAE8E7302A"><enum>(B)</enum><text>does not include the manufacture, sale, distribution, use, or possession with intent to manufacture, sell, distribute, or use, of marijuana if such activity is conducted in compliance with State law or the law of the Indian tribe that has jurisdiction over the Indian country where the activity occurs.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>

			<section id="H7639D460B389459282AA1297CA8C5BA4" section-type="subsequent-section"><enum>401.</enum><header>Medical Marijuana Research Act</header>
 <subsection id="H167E0FAFC0774BEBBDC86583D42EF4D1"><enum>(a)</enum><header>Short title</header><text display-inline="yes-display-inline">This section may be cited as the <quote><short-title>Medical Marijuana Research Act of 2017</short-title></quote>.</text> </subsection><subsection commented="no" display-inline="no-display-inline" id="HA3D6941EFF3244ECA487E394BB208919"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section—</text>
 <paragraph id="HB0968C3ECA6340139DE4DD89C6A39248"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>qualified medical marijuana researcher</term> means a researcher who is registered to conduct research with marijuana under section 303(f)(3) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/823">21 U.S.C. 823(f)(3)</external-xref>), as amended by subsection (d); and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1400B10A0C604837899664223750AFC2"><enum>(2)</enum><text>the term <term>Secretary</term> means the Secretary of Health and Human Services.</text> </paragraph></subsection><subsection id="HC7A0ACC777F446D8A657B26D194CE7D9"><enum>(c)</enum><header>Production and supply</header> <paragraph id="H0E12D05D1A0D4E42B7F09E24A403FA53"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary—</text>
 <subparagraph id="H7A96A4B986A943A2BA1563E094CD033B"><enum>(A)</enum><text display-inline="yes-display-inline">until the date on which the Secretary determines that manufacturers and distributors (other than the Federal Government) can ensure a sufficient supply of marijuana for qualified medical marijuana researchers, shall—</text>
 <clause id="H4D53391C5F424FD08F4B8978A15AD9D2"><enum>(i)</enum><text>continue to produce marijuana through the National Institute on Drug Abuse Drug Supply Program; and</text> </clause><clause id="H80CD4235FAA2417BB55EBE665C761BE7"><enum>(ii)</enum><text display-inline="yes-display-inline">offer for sale immature marijuana plants and the seeds of marijuana—</text>
 <subclause id="HBE25A96246DB415FB3C90DF22A5DF0B8"><enum>(I)</enum><text display-inline="yes-display-inline">to all qualified medical marijuana researchers who submit a request for such plants or seeds to engage in research pursuant to section 303(f)(3) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/823">21 U.S.C. 823(f)(3)</external-xref>), as amended by subsection (d); and</text>
 </subclause><subclause id="HF50098AA31C545BC80D80D97C41F4305"><enum>(II)</enum><text>in quantities sufficient to produce an adequate supply of marijuana for such research; and</text> </subclause></clause></subparagraph><subparagraph id="H1B8CECA7C2424D359AA4397C6FEAC1F7"><enum>(B)</enum><text>beyond the date specified in subparagraph (A), may, at the Secretary’s discretion, continue to so produce and supply marijuana.</text>
 </subparagraph></paragraph><paragraph commented="no" id="HD6109933159C48C9843B5F12E6E0A872"><enum>(2)</enum><header>Requirement to verify registration</header><text display-inline="yes-display-inline">Before supplying marijuana to any person through the National Institute on Drug Abuse Drug Supply Program, the Secretary shall—</text>
 <subparagraph commented="no" id="HA86973B2596E4703968DEE8988A10542"><enum>(A)</enum><text display-inline="yes-display-inline">require the person to submit documentation demonstrating that the person is a qualified medical marijuana researcher seeking to conduct research pursuant to the section 303(f)(3) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/823">21 U.S.C. 823(f)(3)</external-xref>), as amended by subsection (d); and</text>
 </subparagraph><subparagraph commented="no" id="HB3D77E80FF574F41992C54658A62D257"><enum>(B)</enum><text>not later than 30 days after receipt of such documentation, review such documentation and verify that the marijuana will be used for such research.</text>
 </subparagraph></paragraph><paragraph id="H2C19667AE4B04B48A4A085F81C58DBB8"><enum>(3)</enum><header>Guidelines on production</header><text>The Commissioner of Food and Drugs, in consultation with the Director of the National Institute on Drug Abuse, shall—</text>
 <subparagraph id="H49C9C39A9DFD420E8D219A78481FAE39"><enum>(A)</enum><text display-inline="yes-display-inline">not later than 180 days after the date of enactment of this Act, issue guidelines on the production of marijuana by qualified medical marijuana researchers pursuant to paragraph (1)(A)(ii); and</text>
 </subparagraph><subparagraph id="HDD16ADB095504B91BDF78C30F5D13877"><enum>(B)</enum><text>encourage researchers and manufacturers that are authorized to produce or manufacture marijuana pursuant to section 303 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/823">21 U.S.C. 823</external-xref>), as amended by this section, to comply with such guidelines to the extent applicable.</text>
 </subparagraph></paragraph><paragraph id="H9CD461F823EC4C158E9AF169ECFFEAFD"><enum>(4)</enum><header>Definition</header><text display-inline="yes-display-inline">In this subsection, the term <term>immature marijuana plant</term> means a marijuana plant with no observable flowers or buds.</text> </paragraph></subsection><subsection id="HDBD3BE375C06448AB725E6272F68C234"><enum>(d)</enum><header>Facilitating marijuana research</header> <paragraph id="HDC9DCC624D1D4655AA36D59AE6228B7F"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 303(f) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/823">21 U.S.C. 823(f)</external-xref>) is amended—</text>
 <subparagraph id="HB8867338E94940629B24CECD91F4F7D7"><enum>(A)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (1) through (5) as subparagraphs (A) through (E), respectively;</text> </subparagraph><subparagraph id="H9B1D62B7F39B479DAE416F252728372B"><enum>(B)</enum><text>by striking <quote>(f) The Attorney General</quote> and inserting <quote>(f)(1) The Attorney General</quote>;</text>
 </subparagraph><subparagraph id="H115CADB52E604A8EB5C410F1C68F4B75"><enum>(C)</enum><text>by striking <quote>Registration applications</quote> and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="H644B1EA89E624EC0B72EDAD7373DB23B" style="OLC"> <paragraph id="H4EE67E2246D24391BEC6BF5671428A5A" indent="up1"><enum>(2)</enum><text>Registration applications</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
 </subparagraph><subparagraph id="HA9189BCD37B04681857443FF98505291"><enum>(D)</enum><text>in paragraph (2), as so designated, by striking <quote>schedule I</quote> each place that term appears and inserting <quote>schedule I, except marijuana,</quote>;</text> </subparagraph><subparagraph id="HDE2633C6E30A4009BA9AE8E4C18EEC63"><enum>(E)</enum><text>by striking <quote>Article 7</quote> and inserting the following:</text>

 <paragraph id="HCF224C6FFCCC430F9111AD934E47C7FB" indent="up1"><enum>(4)</enum><text>Article 7</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block> </subparagraph><subparagraph id="H073799004E474EDAA77B9DD431ACF02F"><enum>(F)</enum><text>by inserting before paragraph (4), as so designated, the following:</text>
							<quoted-block display-inline="no-display-inline" id="HCBAC33A7DF54497BAB6300B4995FDBA7" style="OLC">
								<paragraph id="H323DED037EE64E6AB088AD209DED30E7" indent="up1"><enum>(3)</enum>
 <subparagraph commented="no" display-inline="yes-display-inline" id="H0AF824167D1C49AD90793D0453778339"><enum>(A)</enum><text>The Attorney General shall register a practitioner to conduct research with marijuana if—</text> <clause id="H2B504853B35142CD9F22C4E34644F749" indent="up1"><enum>(i)</enum><text>the applicant is authorized to dispense, or conduct research with respect to, controlled substances in schedules II, III, IV, and V under the laws of the State in which the applicant practices;</text>
 </clause><clause id="HBB5E6C08517D450F80E4AFAC4EC7125F" indent="up1"><enum>(ii)</enum><text>the applicant’s research protocol—</text> <subclause id="HDE6518B522FD480E842DD6CB5D4D3F01"><enum>(I)</enum><text>has been reviewed and allowed by—</text>
 <item id="HEA9B9A0654B643F6BCF179A10DA22F25"><enum>(aa)</enum><text>the Secretary under section 505(i) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/355">21 U.S.C. 355(i)</external-xref>); or</text>
 </item><item id="HD4BAB3AF83A94108AC97F50320E015D3"><enum>(bb)</enum><text>the National Institutes of Health or another Federal agency that funds scientific research; or</text> </item></subclause><subclause id="H02E12234EEA045098314FC84110DCC48"><enum>(II)</enum><text>in the case of nonhuman research that is not federally funded, has been voluntarily submitted by the applicant to, and approved by, the National Institutes of Health; and</text>
 </subclause></clause><clause id="H2A7A8EBC69364C8686744EEA29EA75FD" indent="up1"><enum>(iii)</enum><text>the applicant has demonstrated that there are effective procedures in place to adequately safeguard against diversion of the marijuana from legitimate medical or scientific use, in accordance with subparagraph (E).</text>
 </clause></subparagraph><subparagraph id="H2BDCD9CE0B114359B17E18B39979A8E4" indent="up1"><enum>(B)</enum><text>The Attorney General shall grant an application for registration under this paragraph unless the Attorney General determines that the issuance of the registration would be inconsistent with the public interest. In determining the public interest, the following factors shall be considered:</text>
 <clause id="H89EA1A37A59D4FA49FD1C7906B0F7A89"><enum>(i)</enum><text>The applicant's experience in dispensing, or conducting research with respect to, controlled substances.</text>
 </clause><clause id="H57E5C876FD8A4098AE13CF66E22E76E6"><enum>(ii)</enum><text>The applicant's conviction record under Federal or State laws relating to the manufacture, distribution, or dispensing of controlled substances.</text>
 </clause><clause id="H58DAF718387B46AAA2F988CD2ECA3CA7"><enum>(iii)</enum><text>Compliance with applicable State, Federal, or local laws relating to controlled substances.</text> </clause><clause id="H40570A61E45E48F1B51510B7F287257D"><enum>(iv)</enum><text>Such other conduct by the applicant that may threaten the public health and safety.</text>
 </clause></subparagraph><subparagraph id="HB24147D92DE649F1A9C7429AA75C710C" indent="up1"><enum>(C)</enum><text>Not later than 90 days after the date of enactment of the <short-title>Medical Marijuana Research Act of 2017</short-title>, for purposes of subparagraph (A)(ii)(II), the National Institutes of Health shall establish a process that—</text>
 <clause id="HDDF4F5DCC68C4CC6B8B68C6B2C899EC9"><enum>(i)</enum><text>allows a researcher to voluntarily submit the research protocol of the researcher for review and approval; and</text>
 </clause><clause id="H8951F557E46341B196AA385B040029DF"><enum>(ii)</enum><text>provides a researcher described in clause (i) with a decision not less than 30 days after the date on which the research protocol is submitted.</text>
										</clause></subparagraph><subparagraph id="HA45900CFF6D7448AA21B60B00ABB013F" indent="up1"><enum>(D)</enum>
 <clause commented="no" display-inline="yes-display-inline" id="H74C37FA3BDF04789A19AE1B4AE2A238F"><enum>(i)</enum><text>Not later than 60 days after the date on which the Attorney General receives a complete application for registration under this paragraph, the Attorney General shall approve or deny the application.</text>
 </clause><clause id="HAD73D1AB8F0D49EAB4D7BEEF16F15B91" indent="up1"><enum>(ii)</enum><text>For purposes of clause (i), an application shall be deemed complete when the applicant has submitted documentation showing that the requirements under subparagraph (A) are satisfied.</text>
										</clause></subparagraph><subparagraph id="HD44AF0F62035458D8E2BB9E93AA624A9" indent="up1"><enum>(E)</enum>
 <clause commented="no" display-inline="yes-display-inline" id="HBA8533A1F4D246BAAB57F7E9251174E8"><enum>(i)</enum><text>A researcher registered under this paragraph shall store marijuana to be used in research in a securely locked, substantially constructed cabinet.</text>
 </clause><clause id="H8937149373CD4B37AAC39AE6AB895897" indent="up1"><enum>(ii)</enum><text>Except as provided in clause (i), any security measures required by the Attorney General for practitioners conducting research with marijuana pursuant to a registration under this paragraph shall be consistent with the security measures for practitioners conducting research on other controlled substances in schedule II that have a similar risk of diversion and abuse.</text>
										</clause></subparagraph><subparagraph id="H1F35A86E3BE34AF899F68AD1C1632A34" indent="up1"><enum>(F)</enum>
 <clause commented="no" display-inline="yes-display-inline" id="H0D80540C74A74A4499783C29C3C42A8A"><enum>(i)</enum><text>If the Attorney General grants an application for registration under this paragraph, the applicant may amend or supplement the research protocol without reapplying if the applicant does not—</text>
 <subclause id="H7C347BA878B442FEAB2098874FC72DFA" indent="up1"><enum>(I)</enum><text>change the type of drug, the source of the drug, or the conditions under which the drug is stored, tracked, or administered; or</text>
 </subclause><subclause id="H0CAB8395DAA64193B785CE38EEDFA626" indent="up1"><enum>(II)</enum><text>otherwise increase the risk of diversion.</text> </subclause></clause><clause id="H9BD6479152EC4EB38492B4F65A64582D" indent="up1"><enum>(ii)</enum><text>If an applicant amends or supplements the research protocol or initiates research on a new research protocol under clause (i), the applicant shall, in order to renew the registration under this paragraph, provide notice to the Attorney General of the amended or supplemented research protocol or any new research protocol in the applicant's renewal materials.</text>
										</clause><clause id="HD4FE7B7ED788427991A95B2518C3EFCA" indent="up1"><enum>(iii)</enum>
 <subclause commented="no" display-inline="yes-display-inline" id="H4F0347566D8D4DF38E2021094A90AE8A"><enum>(I)</enum><text>If an applicant amends or supplements a research protocol and the amendment or supplement involves a change to the type of drug, the source of the drug, or conditions under which the drug is stored, tracked, or administered or otherwise increases the risk of diversion, the applicant shall provide notice to the Attorney General not later than 30 days before proceeding on such amended or supplemental research or new research protocol, as the case may be.</text>
 </subclause><subclause id="HECE1994DA4AE48F2A6A0479436600EEC" indent="up1"><enum>(II)</enum><text>If the Attorney General does not object during the 30-day period following a notification under subclause (I), the applicant may proceed with the amended or supplemental research or new research protocol.</text>
 </subclause></clause><clause id="H410A6D077FC9449E9B6AE279EE54968D" indent="up1"><enum>(iv)</enum><text>The Attorney General may object to an amended or supplemental protocol or a new research protocol under clause (i) or (iii) only if additional security measures are needed to safeguard against diversion or abuse.</text>
 </clause></subparagraph><subparagraph id="H1407B850698D4FF9BB4DF6C5A7320040" indent="up1"><enum>(G)</enum><text display-inline="yes-display-inline">If marijuana or a compound of marijuana is listed on a schedule other than schedule I, the provisions of paragraphs (1), (2), and (4) that apply to research with a controlled substance in the applicable schedule shall apply to research with marijuana or that compound, as applicable, in lieu of the provisions of subparagraphs (A) through (F) of this paragraph.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="H29123778718D422FB164D17ADF74E0BC"><enum>(2)</enum><header>Conforming amendment</header><text>Section 102(16) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802(16)</external-xref>) is amended by inserting <quote>or <term>marijuana</term></quote> after <quote>The term <term>marihuana</term></quote>.</text> </paragraph></subsection><subsection id="H730C57A873C745D88E7DC4AD0DE2A92E"><enum>(e)</enum><header>Manufacture and distribution of marijuana for use in legitimate, medical research</header><text display-inline="yes-display-inline">Section 303 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/823">21 U.S.C. 823</external-xref>), as amended by subsection (d), is further amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HD1018E86150F494A8EC57D9BB203A3C3" style="OLC">
						<subsection id="HD90BDAFDCEFB458CADE1D2051E3EEBC9"><enum>(k)</enum><header>Registration of persons To manufacture and distribute marijuana for use in legitimate, medical
			 research</header>
 <paragraph id="H023D30270A1B4E4B8D981AB3C11B00EB"><enum>(1)</enum><header>Registration of manufacturers</header><text display-inline="yes-display-inline">Beginning not later than the day that is 1 year after the date of enactment of the <short-title>Medical Marijuana Research Act of 2017</short-title>, the Attorney General shall register an applicant to manufacture marijuana to the extent the marijuana will be used exclusively by qualified medical marijuana researchers for research pursuant to subsection (f)(3), unless the Attorney General determines that the issuance of such registration is inconsistent with the public interest. In determining the public interest, the Attorney General shall—</text>
 <subparagraph id="H68FAC818812B4126950419B3B16F8AAF"><enum>(A)</enum><text>take into consideration—</text> <clause id="H0ADE9808A62C4974B014618D6C152CC0"><enum>(i)</enum><text>maintenance of effective controls against diversion of marijuana and any controlled substance compounded therefrom into other than legitimate medical, scientific, or research channels;</text>
 </clause><clause id="H36729509E87742D68EC6B372C2665B3B"><enum>(ii)</enum><text>compliance with applicable State and local law; and</text> </clause><clause commented="no" id="H030BCB647C844B17BBB62C7672764573"><enum>(iii)</enum><text>prior conviction record of the applicant under Federal or State laws relating to the manufacture, distribution, or dispensing of such substances; and</text>
 </clause></subparagraph><subparagraph id="HBD04B917546E4B799F5EF21496E49D62"><enum>(B)</enum><text>not take into consideration any factors other than the factors listed in subparagraph (A).</text> </subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H8A14C7A102ED41658BCB14F54F59E76C"><enum>(2)</enum><header>Registration of distributors</header><text display-inline="yes-display-inline">Beginning not later than the day that is 1 year after the date of enactment of the <short-title>Medical Marijuana Research Act of 2017</short-title>, the Attorney General shall register an applicant to distribute marijuana that is intended to be used exclusively by qualified medical marijuana researchers for research pursuant to subsection (f)(3), unless the Attorney General determines that the issuance of such registration is inconsistent with the public interest. In determining the public interest, the Attorney General shall—</text>
 <subparagraph id="H466CA9E5542A481FA77EDA91F08F38EC"><enum>(A)</enum><text>take into consideration—</text> <clause id="H3A4A7D271F2044EEA478AF5DE2D27ACB"><enum>(i)</enum><text>maintenance of effective controls against diversion of marijuana and any controlled substance compounded therefrom into other than legitimate medical, scientific, or research channels;</text>
 </clause><clause id="H7881567F2B504C75A46C4788905DB338"><enum>(ii)</enum><text>compliance with applicable State and local law;</text> </clause><clause commented="no" id="HCEAA93420D0548F89BA6033A44E0D60C"><enum>(iii)</enum><text>prior conviction record of the applicant under Federal or State laws relating to the manufacture, distribution, or dispensing of such substances; and</text>
 </clause><clause commented="no" id="H850EBFC967F14C88814EB0932E3FA5EA"><enum>(iv)</enum><text>past experience in the distribution of controlled substances, and the existence in the establishment of effective controls against diversion; and</text>
 </clause></subparagraph><subparagraph id="H406E4EC6A22E446F931AABB57479EF31"><enum>(B)</enum><text>not take into consideration any factors other than the factors listed in subparagraph (A).</text> </subparagraph></paragraph><paragraph id="H2112E417CDB14904A2DD5A6654F4613D"><enum>(3)</enum><header>No limit on number of manufacturers and distributors</header><text>Notwithstanding any other provision of law, the Attorney General shall not impose or implement any limit on the number of persons eligible to be registered to manufacture or distribute marijuana pursuant to paragraph (1) or (2).</text>
 </paragraph><paragraph commented="no" id="H6322714CA0B4489A8A248BF39101AEAE"><enum>(4)</enum><header>Requirement to verify use for legitimate, medical research</header><text display-inline="yes-display-inline">As a condition on registration under this section to manufacture or distribute marijuana, the Attorney General shall require the registrant—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="H9E72EE4A0D48432A8F0ED171BCBA7190"><enum>(A)</enum><text display-inline="yes-display-inline">to require any person to whom the marijuana will be supplied to submit documentation demonstrating that the marijuana will be used exclusively by qualified medical marijuana researchers for research pursuant to subsection (f)(3); and</text>
 </subparagraph><subparagraph commented="no" id="HF9BD48CFA87B4E8EA25F1E51F7A857C7"><enum>(B)</enum><text>not later than 30 days after receipt of such documentation, and before supplying the marijuana to such person, to review such documentation and verify that the marijuana will be so used.</text>
 </subparagraph></paragraph><paragraph id="H2AF22F5928304583B2EBBCCF6D0F9439"><enum>(5)</enum><header>Timing</header><text>Not later than 30 days after receipt of a request for registration under this subsection to manufacture or distribute marijuana, the Attorney General shall—</text>
 <subparagraph id="H99D2F94C359A4FEEAA5974B55648581F"><enum>(A)</enum><text>grant or deny the request; and</text> </subparagraph><subparagraph id="H0CE68DA78FBA4525862CAC7983FEFC0F"><enum>(B)</enum><text>in the case of a denial, provide a written explanation of the basis for the denial.</text>
 </subparagraph></paragraph><paragraph id="H6921DB2FD86C4FC5B6CF46ED07C87521"><enum>(6)</enum><header>Definition</header><text display-inline="yes-display-inline">For purposes of this subsection, the term <term>qualified medical marijuana researcher</term> means a researcher who is registered to conduct research with marijuana under subsection (f)(3).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subsection><subsection display-inline="no-display-inline" id="HCA11E57F04694A51A199E4C153E60855"><enum>(f)</enum><header>Termination of interdisciplinary review process for non-NIH-Funded researchers</header><text display-inline="yes-display-inline">The Secretary may not—</text>
 <paragraph id="H7CF6CC1020674AF1B87D358F8F582EC6"><enum>(1)</enum><text display-inline="yes-display-inline">reinstate the Public Health Service interdisciplinary review process described in the guidance entitled <quote>Guidance on Procedures for the Provision of Marijuana for Medical Research</quote> (issued on May 21, 1999); or</text>
 </paragraph><paragraph id="H47B02CA85DBC4E53AA6BB22C0640CEBB"><enum>(2)</enum><text display-inline="yes-display-inline">create an additional review of scientific protocols that is only conducted for research on marijuana other than the review of research protocols performed at the request of a researcher conducting nonhuman research that is not federally funded, in accordance with section 303(f)(3)(A)(ii)(II) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/823">21 U.S.C. 823(f)(3)(A)(ii)(II)</external-xref>), as amended by subsection (d).</text>
 </paragraph></subsection><subsection id="H8CEB50C6B16141028E8CBF939A81A456"><enum>(g)</enum><header>Consideration of results of research</header><text display-inline="yes-display-inline">Immediately upon the approval by the Food and Drug Administration of an application for a marijuana-based drug under section 505 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/355">21 U.S.C. 355</external-xref>), and (irrespective of whether any such approval is granted) not later than the date that is 5 years after the date of enactment of this Act, the Secretary shall—</text>
 <paragraph id="H453ABCF8A3724055953706363F48E2EC"><enum>(1)</enum><text>conduct a review of existing medical and other research with respect to marijuana;</text> </paragraph><paragraph commented="no" id="H5EFF99A1A8174AF38CE44CE5FECCE1D8"><enum>(2)</enum><text display-inline="yes-display-inline">submit a report to the Congress on the results of such review; and</text>
 </paragraph><paragraph id="H4F1E183A95534A6E84F6E9D9CD0FE4C3"><enum>(3)</enum><text>include in such report whether, taking into consideration the factors listed in section 201(c) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/811">21 U.S.C. 811(c)</external-xref>), as well as any potential for medical benefits, any gaps in research, and any impacts of Federal restrictions and policy on research, marijuana should be transferred to a schedule other than schedule I (if marijuana has not been so transferred already).</text>
 </paragraph></subsection><subsection id="HFB626252505042A89F8F02C2DE2EC14F"><enum>(h)</enum><header>No production quotas for marijuana grown for legitimate, medical research</header><text display-inline="yes-display-inline">Section 306 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/826">21 U.S.C. 826</external-xref>) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HA8A568438D714038A3282B5D7BB0C051" style="OLC">
 <subsection id="HBEABD05A4F9C4A5FBC7A881F7360F586"><enum>(i)</enum><text display-inline="yes-display-inline">The Attorney General may only establish a quota for production of marijuana that is manufactured and distributed in accordance with the <short-title>Medical Marijuana Research Act of 2017</short-title> that meets the changing medical, scientific, and industrial needs for marijuana.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H94D02E8972474727BAD2F294F9362A7E"><enum>(i)</enum><header>Article 28 of the Single Convention on Narcotic Drugs</header><text display-inline="yes-display-inline">Article 28 of the Single Convention on Narcotic Drugs shall not be construed to prohibit, or impose additional restrictions upon, research involving marijuana, or the manufacture, distribution, or dispensing of marijuana, that is conducted in accordance with the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/801">21 U.S.C. 801</external-xref> et seq.), this section, and the amendments made by this section.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="H7E3BF28A57004E348F3AAD375F795CC3"><enum>(j)</enum><header>No interference by Department of Justice</header><text display-inline="yes-display-inline">The Attorney General, and any officer or employee of the Department of Justice, shall not interfere with the production, distribution, and sale of marijuana in accordance with this section and the amendments made by this section.</text>
				</subsection></section><section id="H376A0444223245C1988C9EA4141EDD97"><enum>402.</enum><header>Provision by health care providers of the Department of Veterans Affairs of recommendations and
			 opinions regarding veteran participation in State marijuana programs</header>
 <subsection id="HCCFFC4C4F4A645C9A679A14BD446CC13"><enum>(a)</enum><header>Short title</header><text display-inline="yes-display-inline">This section may be cited as the <quote><short-title>Veterans Equal Access Act of 2017</short-title></quote>.</text> </subsection><subsection id="HF096A5C4891049C38898EF255D7DB562"><enum>(b)</enum><header>Authorization</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the Secretary of Veterans Affairs shall authorize physicians and other health care providers employed by the Department of Veterans Affairs—</text>
 <paragraph id="H0CD8B3394DAB4EAFBB6F46A852CA6AFE"><enum>(1)</enum><text>to provide recommendations and opinions to veterans who are residents of States with State marijuana programs regarding the participation of veterans in such State marijuana programs; and</text>
 </paragraph><paragraph id="H4B8E7E1D523A438AA51A1650E3C98940"><enum>(2)</enum><text>to complete forms reflecting such recommendations and opinions.</text> </paragraph></subsection></section><section id="H684B23A9FD1E4222B0D6A0375658E458"><enum>403.</enum><header>Provision by medical professionals of the Indian Health Service of recommendations and opinions regarding participation in State marijuana programs</header> <paragraph id="H93A840198A954B838C363C2E22B6AE92"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of law, IHS medical professionals are authorized to make medical recommendations to their patients with regard to marijuana and to complete forms reflecting such recommendations.</text>
 </paragraph><paragraph id="HA503E14849D545B391C71D6CE961F35B"><enum>(2)</enum><header>Definitions</header><text>In this subsection:</text> <subparagraph id="HDEAE7DFC85B84145A853B26DD685FFFC"><enum>(A)</enum><header>IHS medical professional</header><text>The term <term>IHS medical professional</term> means a physician or other health professional furnishing services through an Indian health program (as defined in section 108(a)(2) of the Indian Health Care Improvement Act (<external-xref legal-doc="usc" parsable-cite="usc/25/1616a">25 U.S.C. 1616a(a)(2)</external-xref>)).</text>
 </subparagraph><subparagraph id="H74BBB9BE26E24ABDAE49527D2C1803CC"><enum>(B)</enum><header>Recommendations</header><text>The term <term>recommendations</term> does not include dispensing (as defined in section 102 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref>)).</text>
