			 or live transmission, of a minor engaged in sexually explicit conduct, and
			 for other purposes.<pagebreak></pagebreak></official-title>

 <section id="HD77C07D444C64607BA09F13684EBBF46" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Against Child Exploitation Act of 2017</short-title></quote>.</text> </section><section id="HCEF749ACC0EB41FE807FB5351EBA0FB3" section-type="subsequent-section"><enum>2.</enum><header>Sexual exploitation of children</header><text display-inline="no-display-inline">Section 2251 of title 18, United States Code, is amended—</text>
 <paragraph id="H0FB5B98E64C349C087B55A8009626D66"><enum>(1)</enum><text>by amending subsections (a) and (b) to read as follows:</text> <quoted-block changed="added" committee-id="HJU00" display-inline="no-display-inline" id="HD7C38177201C409CA79D46A23512D082" reported-display-style="italic" style="USC"> <subsection id="HF22EA2D6EB7140E792D0EEFBB475A36E"><enum>(a)</enum><text display-inline="yes-display-inline">Any person who, in a circumstance described in subsection (f), knowingly—</text>
 <paragraph id="H574C7B475E5E4C2D9B31B4020C544BC3"><enum>(1)</enum><text>employs, uses, persuades, induces, entices, or coerces a minor to engage in any sexually explicit conduct for the purpose of producing any visual depiction of such conduct, or transmitting a live visual depiction of such conduct;</text>
 </paragraph><paragraph id="H5C0ABC3AA2D24A9D8B76060C26BDA8B9"><enum>(2)</enum><text>produces or causes to be produced a visual depiction of a minor engaged in any sexually explicit conduct where the production of such visual depiction involves the use of a minor engaging in sexually explicit conduct and such visual depiction is of such conduct;</text>
 </paragraph><paragraph id="HA8BC06E9F74C456BADCBEB2BD7F1F6CE"><enum>(3)</enum><text>transmits or causes to be transmitted a live visual depiction of a minor engaged in any sexually explicit conduct;</text>
 </paragraph><paragraph id="H8090AC9EDBD8421FAF86C1C8612ECF06"><enum>(4)</enum><text>has a minor assist any other person to engage in any sexually explicit conduct during the commission of an offense set forth in paragraphs (1) through (3) of this subsection; or</text>
 </paragraph><paragraph id="H443D0413A60F48BC974E5A5A5C4D6728"><enum>(5)</enum><text>transports any minor in or affecting interstate or foreign commerce with the intent that such minor be used in the production or live transmission of a visual depiction of a minor engaged in any sexually explicit conduct,</text>
 </paragraph><continuation-text continuation-text-level="subsection">shall be punished as provided under subsection (e).</continuation-text></subsection><subsection id="H97F77CF9F5AE4616ACBF7940B706A0EA"><enum>(b)</enum><text>Any parent, legal guardian, or person having custody or control of a minor who, in a circumstance described in subsection (f), knowingly permits such minor to engage in, or to assist any other person to engage in, sexually explicit conduct knowing that a visual depiction of such conduct will be produced or transmitted shall be punished as provided under subsection (e).</text></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
 </paragraph><paragraph id="H71D39ED5FF7042A4B9BC5F2DD6C120A3"><enum>(2)</enum><text>in subsection (c)—</text> <subparagraph id="HBF6ECC1EB2EC4BBD94D33AB0713B5E3E"><enum>(A)</enum><text>in paragraph (1)—</text>
 <clause id="H0342700397834E828C7C3C3504F504B4"><enum>(i)</enum><text>by striking <quote>employs, uses, persuades, induces, entices, or coerces any minor to engage in, or who has a minor assist any other person to engage in, any sexually explicit conduct</quote> and inserting <quote>engages in any conduct described in paragraphs (1) through (5) of subsection (a)</quote>; and</text>
 </clause><clause id="HC8CCE851FD2B48EB8E9311DFE2C05A9E"><enum>(ii)</enum><text>by striking <quote>, for the purpose of producing any visual depiction of such conduct,</quote>;</text> </clause></subparagraph><subparagraph id="H7279278FF03647008BC8264644094AAA"><enum>(B)</enum><text>in paragraph (2)(A), by inserting after <quote>transported</quote> the following: <quote>or transmitted</quote>; and</text>
 </subparagraph><subparagraph id="HE8285702C94149F781B62F0A4EBD1DF2"><enum>(C)</enum><text>in paragraph (2)(B), by inserting after <quote>transports</quote> the following; <quote>or transmits</quote>;</text> </subparagraph></paragraph><paragraph id="H3AA6B0CA9C734FD2AEF78D8994901D87"><enum>(3)</enum><text>by adding at the end the following:</text>
				<quoted-block changed="added" committee-id="HJU00" display-inline="no-display-inline" id="HB9E560D2DB93446F97C75CC6D551B698" reported-display-style="italic" style="USC">
 <subsection id="HF8ADB32FEF114ECA8097161C52538C75"><enum>(f)</enum><text display-inline="yes-display-inline">The circumstances referred to in subsections (a) and (b) are—</text> <paragraph id="H76D45B879BBE46DAA3FB767E60163233"><enum>(1)</enum><text>that the person knows or has reason to know that such visual depiction will be—</text>
 <subparagraph id="HD490EB01095945D4A797E85E81B082C6"><enum>(A)</enum><text>transported or transmitted using any means or facility of interstate or foreign commerce;</text> </subparagraph><subparagraph id="HC08BD96344FF47ACAE0A550A55B1D142"><enum>(B)</enum><text>transported or transmitted in or affecting interstate or foreign commerce; or</text>
 </subparagraph><subparagraph id="HE262AF1EDC97406099B413A906D30992"><enum>(C)</enum><text>mailed;</text> </subparagraph></paragraph><paragraph id="HB46FB7B99DDE4A72BB35355C17DF3175"><enum>(2)</enum><text>the visual depiction was produced or transmitted using materials that have been mailed, or shipped or transported in or affecting interstate or foreign commerce by any means, including by computer;</text>
 </paragraph><paragraph id="H1489568EACBE4136899E07EF5E10876B"><enum>(3)</enum><text>such visual depiction has actually been—</text> <subparagraph id="H94ADD9790CF048798519C3769BFA56CD"><enum>(A)</enum><text display-inline="yes-display-inline">transported or transmitted using any means or facility of interstate or foreign commerce;</text>
 </subparagraph><subparagraph id="H7F2BBD8FCAC24B46AD2B9D3EFFAB7CB3"><enum>(B)</enum><text display-inline="yes-display-inline">transported or transmitted in or affecting interstate or foreign commerce; or</text> </subparagraph><subparagraph id="H108C5034C7F246E7B5EA9366B172F4E4"><enum>(C)</enum><text>mailed; or</text>
 </subparagraph></paragraph><paragraph id="HD2E23E26484D42D3A9CFC6AB11AEB339"><enum>(4)</enum><text>any part of the offense occurred in a territory or possession of the United States or within the special maritime and territorial jurisdiction of the United States.</text>
 </paragraph></subsection><subsection id="H860AC5192625400191B3B95CFB6FCB77"><enum>(g)</enum><text display-inline="yes-display-inline">Notwithstanding any other provision of this section, no criminal charge under subsection (a)(3) may be brought against an electronic communication service provider or remote computing service provider unless such provider has intentionally transmitted or caused to be transmitted a visual depiction with actual knowledge that such depiction is of a minor engaged in sexually explicit conduct, nor may any such criminal charge be brought if barred by the provisions of section 2258B.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></section><section display-inline="no-display-inline" id="H3BBEB774BC8A4BF7B78473F4E6C9DF18" section-type="subsequent-section"><enum>3.</enum><header>Limited liability for certain persons when responding to search warrants or other legal process</header><text display-inline="no-display-inline">Section 2258B of title 18, United States Code, is amended—</text> <paragraph id="H4636C1BC371049AB88BE927DE3CA919C"><enum>(1)</enum><text>in subsection (a), by inserting <quote>from the response to a search warrant or other legal process or</quote> before <quote>from the performance</quote>; and</text>
 </paragraph><paragraph id="H456763A6D6D14E88BC3C6D7B74CD4FF7"><enum>(2)</enum><text>in subsection (b)(2)(C), by inserting <quote>the response to a search warrant or other legal process or to</quote> before <quote>the performance of any responsibility</quote>.</text> </paragraph></section></legis-body> <endorsement display="yes"> <action-date>May 22, 2017</action-date> <action-desc>Reported with an amendment, committed to the Committee of the Whole House on the State of the Union, and ordered to be printed</action-desc></endorsement> </bill>
