		<official-title display="yes">To direct the Administrator of the Federal Emergency Management Agency to issue guidance regarding
			 implementation of certain buy-outs or the acquisition of property for open
			 space as a flood mitigation measure, and for other purposes.<pagebreak></pagebreak></official-title>

 <section id="H67082800AB7F49F3943E3C08B77AE01C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Community Empowerment for Mitigated Properties Act of 2017</short-title></quote>.</text> </section><section id="H9FE6DC76660E4CB88A7993535F66D39B" section-type="subsequent-section"><enum>2.</enum><header>Guidance on hazard mitigation assistance</header> <subsection id="HA6DBBB34D5C841B89A3D16AB2BBF0CF1"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Administrator of the Federal Emergency Management Agency shall issue guidance regarding <deleted-phrase committee-id="HPW00" reported-display-style="strikethrough">a buy-out or</deleted-phrase> the acquisition of property for open space as a mitigation measure under section 404 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170c">42 U.S.C. 5170c</external-xref>) that includes—</text>
 <paragraph id="H04D22CA7A23D4615B15A1545748F5AA9"><enum>(1)</enum><text display-inline="yes-display-inline">a process by which the State hazard mitigation officer appointed for such <deleted-phrase committee-id="HPW00" reported-display-style="strikethrough">a buy-out or</deleted-phrase> <added-phrase committee-id="HPW00" reported-display-style="italic">an</added-phrase> acquisition shall, not later than 60 days after the applicant for assistance enters into an agreement with the Administrator regarding the <deleted-phrase committee-id="HPW00" reported-display-style="strikethrough">buy-out or</deleted-phrase> acquisition, provide written notification to each affected unit of local government for such <deleted-phrase committee-id="HPW00" reported-display-style="strikethrough">buy-out or</deleted-phrase> acquisition that includes—</text>
 <subparagraph id="HE84F190F047E4F1BBD1CF180635BA6FC"><enum>(A)</enum><text>the location of the <deleted-phrase committee-id="HPW00" reported-display-style="strikethrough">buy-out or</deleted-phrase> acquisition;</text> </subparagraph><subparagraph id="H89C70A24276C443DA48D8EBE462F97D5"><enum>(B)</enum><text>the State-local assistance agreement for the hazard mitigation grant program;</text>
 </subparagraph><subparagraph id="H694C7F8E91E841A2A556E1852372FB5A"><enum>(C)</enum><text display-inline="yes-display-inline">a description of the <deleted-phrase committee-id="HPW00" reported-display-style="strikethrough">buy-out or</deleted-phrase> acquisition; and</text> </subparagraph><subparagraph id="H1BD1E15AE034488CAB45FCD1BCDE4C0B"><enum>(D)</enum><text>a copy of the <deleted-phrase committee-id="HPW00" reported-display-style="strikethrough">model</deleted-phrase> deed restriction; and</text>
 </subparagraph></paragraph><paragraph id="H1CB08305D1354A8B8153FA1B19BA7C31"><enum>(2)</enum><text>recommendations for entering into and implementing a memorandum of understanding between units of local government and covered entities that includes provisions to allow an affected unit of local government notified under paragraph (1) to—</text>
 <subparagraph id="HC093FCB36C464F6FB5CD2B8C2D1985EF"><enum>(A)</enum><text display-inline="yes-display-inline">use and maintain the open space created by such a project, <added-phrase committee-id="HPW00" reported-display-style="italic">consistent with section 404 (including related regulations, standards, and guidance) and</added-phrase> consistent with all adjoining property, subject to the notification of the adjoining property, so long as the cost of the maintenance is borne by the local government; and</text>
 </subparagraph><subparagraph commented="no" id="HC6BB5F4C8D5B4D399E38C3B8F6D70A94"><enum>(B)</enum><text display-inline="yes-display-inline">maintain the open space pursuant to standards exceeding any local government standards defined in the agreement with the Administrator described under paragraph (1).</text>
 </subparagraph></paragraph></subsection><subsection id="H8FF26AA5C0124F799B5ED5F97805E213"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph id="H2874407EF4874C5BB6F50A93DCFA3C5D"><enum>(1)</enum><header>Affected unit of local government</header><text display-inline="yes-display-inline">The term <quote>affected unit of local government</quote> means any entity covered by the definition of local government in section 102 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5122">42 U.S.C. 5122</external-xref>), that has jurisdiction over the <deleted-phrase committee-id="HPW00" reported-display-style="strikethrough">location of a buy-out or</deleted-phrase> <added-phrase committee-id="HPW00" reported-display-style="italic">property subject to the</added-phrase> acquisition described in subsection (a).</text>
 </paragraph><paragraph id="H338B519F6BA44E729A620E5E0593C3CF"><enum>(2)</enum><header>Covered entity</header><text>The term <quote>covered entity</quote> means—</text> <subparagraph id="H543EB502C5FE4D19A63267CF41FA3408"><enum>(A)</enum><text display-inline="yes-display-inline">the grantee or subgrantee receiving assistance for an open space project described in subsection (a);</text>
 </subparagraph><subparagraph id="H5A027CB20FCE4674BB13D20E69C6DEBE"><enum>(B)</enum><text>the State in which such project is located; <added-phrase committee-id="HPW00" reported-display-style="italic">and</added-phrase></text> </subparagraph><subparagraph changed="deleted" committee-id="HPW00" id="HC208FA59DCCE47B6BD560A8C46874D65" reported-display-style="strikethrough"><enum>(C)</enum><text display-inline="yes-display-inline">the applicable State hazard mitigation officer; and</text>
 </subparagraph><subparagraph changed="deleted" committee-id="HPW00" id="H3E884BA96D074C568CEA26CA1ADA9B72" reported-display-style="strikethrough"><enum>(D)</enum><text>the applicable regional administrator.</text> </subparagraph><subparagraph changed="added" committee-id="HPW00" id="H8A04B7FF7FC74143BB70A657BC3653EC" reported-display-style="italic"><enum>(C)</enum><text display-inline="yes-display-inline">the applicable Regional Administrator of the Federal Emergency Management Agency.</text>
					</subparagraph></paragraph></subsection></section></legis-body><official-title-amendment>Amend the title so as to read: <quote>A bill to direct the Administrator of the Federal Emergency Management Agency to issue guidance
			 regarding the acquisition of property for open space as a flood mitigation
			 measure, and for other purposes.</quote>.</official-title-amendment>
