Environmental Compliance and Restoration Program

(a)

Definitions

For the purposes of this section— (1)environment, facility, person, release, removal, remedial, and response have the same meaning they have in section 101 of the Comprehensive Environmental Response, Compensation, and Liability Act (42 U.S.C. 9601); (2)hazardous substance has the same meaning it has in section 101 of the Comprehensive Environmental Response, Compensation, and Liability Act (42 U.S.C. 9601), except that it also includes the meaning given oil in section 311 of the Federal Water Pollution Control Act (33 U.S.C. 1321); and (3)pollutant has the same meaning it has in section 502 of the Federal Water Pollution Control Act (33 U.S.C. 1362). (b)

Program

(1)The Secretary shall carry out a program of environmental compliance and restoration at current and former Coast Guard facilities. (2)Program goals include: (A)Identifying, investigating, and cleaning up contamination from hazardous substances and pollutants. (B)Correcting other environmental damage that poses an imminent and substantial danger to the public health or welfare or to the environment. (C)Demolishing and removing unsafe buildings and structures, including buildings and structures at former Coast Guard facilities. (D)Preventing contamination from hazardous substances and pollutants at current Coast Guard facilities. (3) (A)The Secretary shall respond to releases of hazardous substances and pollutants— (i)at each Coast Guard facility the United States owns, leases, or otherwise possesses; (ii)at each Coast Guard facility the United States owned, leased, or otherwise possessed when the actions leading to contamination from hazardous substances or pollutants occurred; and (iii)on each vessel the Coast Guard owns or operates. (B)Subparagraph (A) of this paragraph does not apply to a removal or remedial action when a potentially responsible person responds under section 122 of the Comprehensive Environmental Response, Compensation, and Liability Act (42 U.S.C. 9622). (C)The Secretary shall pay a fee or charge imposed by a State authority for permit services for disposing of hazardous substances or pollutants from Coast Guard facilities to the same extent that nongovernmental entities are required to pay for permit services. This subparagraph does not apply to a payment that is the responsibility of a lessee, contractor, or other private person. (4)The Secretary may agree with another Federal agency for that agency to assist in carrying out the Secretary's responsibilities under this section. The Secretary may enter into contracts, cooperative agreements, and grant agreements with State and local governments to assist in carrying out the Secretary's responsibilities under this section. Services that may be obtained under this paragraph include identifying, investigating, and cleaning up off-site contamination that may have resulted from the release of a hazardous substance or pollutant at a Coast Guard facility. (5)Section 119 of the Comprehensive Environmental Response, Compensation, and Liability Act (42 U.S.C. 9619) applies to response action contractors that carry out response actions under this section. The Coast Guard shall indemnify response action contractors to the extent that adequate insurance is not generally available at a fair price at the time the contractor enters into the contract to cover the contractor's reasonable, potential, long-term liability. (c)

Environmental Compliance and Restoration Account

(1)There is established for the Coast Guard an account known as the Coast Guard Environmental Compliance and Restoration Account. All sums appropriated to carry out the Coast Guard's environmental compliance and restoration functions under this section or another law shall be credited or transferred to the account and remain available until expended. (2)Funds may be obligated or expended from the account to carry out the Coast Guard's environmental compliance and restoration functions under this section or another law. (3)In proposing the budget for any fiscal year under section 1105 of title 31, the President shall set forth separately the amount requested for the Coast Guard's environmental compliance and restoration activities under this section or another law. (4)Amounts recovered under section 107 of the Comprehensive Environmental Response, Compensation, and Liability Act (42 U.S.C. 9607) for the Secretary's response actions at current and former Coast Guard facilities shall be credited to the account. (d)

Annual list of projects to Congress

The Commandant of the Coast Guard shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a prioritized list of projects eligible for environmental compliance and restoration funding for each fiscal year concurrent with the President's budget submission for that fiscal year.

The number of cadets appointed annually to the Academy shall be as determined by the Secretary but the number appointed in any one year shall not exceed six hundred.

1922.

Appointments

Appointments to cadetships shall be made under regulations prescribed by the Secretary, who shall determine age limits, methods of selection of applicants, term of service as a cadet before graduation, and all other matters affecting such appointments. In the administration of this section, the Secretary shall take such action as may be necessary and appropriate to insure that female individuals shall be eligible for appointment and admission to the Coast Guard Academy, and that the relevant standards required for appointment, admission, training, graduation, and commissioning of female individuals shall be the same as those required for male individuals, except for those minimum essential adjustments in such standards required because of physiological differences between male and female individuals.

Conduct

The Secretary may summarily dismiss from the Coast Guard any cadet who, during his cadetship, is found unsatisfactory in either studies or conduct, or may be deemed not adapted for a career in the Coast Guard. Cadets shall be subject to rules governing discipline prescribed by the Commandant.

1925.

Agreement

(a)Each cadet shall sign an agreement with respect to the cadet's length of service in the Coast Guard. The agreement shall provide that the cadet agrees to the following: (1)That the cadet will complete the course of instruction at the Coast Guard Academy. (2)That upon graduation from the Coast Guard Academy the cadet— (A)will accept an appointment, if tendered, as a commissioned officer of the Coast Guard; and (B)will serve on active duty for at least five years immediately after such appointment. (3)That if an appointment described in paragraph (2) is not tendered or if the cadet is permitted to resign as a regular officer before the completion of the commissioned service obligation of the cadet, the cadet— (A)will accept an appointment as a commissioned officer in the Coast Guard Reserve; and (B)will remain in that reserve component until completion of the commissioned service obligation of the cadet. (b) (1)The Secretary may transfer to the Coast Guard Reserve, and may order to active duty for such period of time as the Secretary prescribes (but not to exceed four years), a cadet who breaches an agreement under subsection (a). The period of time for which a cadet is ordered to active duty under this paragraph may be determined without regard to section 651(a) of title 10. (2)A cadet who is transferred to the Coast Guard Reserve under paragraph (1) shall be transferred in an appropriate enlisted grade or rating, as determined by the Secretary. (3)For the purposes of paragraph (1), a cadet shall be considered to have breached an agreement under subsection (a) if the cadet is separated from the Coast Guard Academy under circumstances which the Secretary determines constitute a breach by the cadet of the cadet's agreement to complete the course of instruction at the Coast Guard Academy and accept an appointment as a commissioned officer upon graduation from the Coast Guard Academy. (c)The Secretary shall prescribe regulations to carry out this section. Those regulations shall include— (1)standards for determining what constitutes, for the purpose of subsection (b), a breach of an agreement under subsection (a); (2)procedures for determining whether such a breach has occurred; and (3)standards for determining the period of time for which a person may be ordered to serve on active duty under subsection (b). (d)In this section, commissioned service obligation, with respect to an officer who is a graduate of the Academy, means the period beginning on the date of the officer's appointment as a commissioned officer and ending on the sixth anniversary of such appointment or, at the discretion of the Secretary, any later date up to the eighth anniversary of such appointment. (e) (1)This section does not apply to a cadet who is not a citizen or national of the United States. (2)In the case of a cadet who is a minor and who has parents or a guardian, the cadet may sign the agreement required by subsection (a) only with the consent of the parent or guardian. (f)A cadet or former cadet who does not fulfill the terms of the obligation to serve as specified under section (a), or the alternative obligation imposed under subsection (b), shall be subject to the repayment provisions of section 303a(e) of title 37.
