		<section id="H54EF3EBB82C24602BA79FD8A48141A00" section-type="section-one"><enum>1.</enum><header>Prohibition on smoking in facilities of the Veterans Health Administration</header>
 <subsection id="HA4A3D9E547374C6796FFEC7B5EDEE6B9"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">Section 1715 of title 38, United States Code, is amended to read as follows:</text> <quoted-block display-inline="no-display-inline" id="H5FB17E4EBC614A05A03F77F1CFD1A66A" style="USC"> <section id="H47FF65E5C8444EE8BC90460D2FC6A93D"><enum>1715.</enum><header>Prohibition on smoking in facilities of the Veterans Health Administration</header> <subsection id="HCDE2525E2676407AAB2DF4AC5CADE79E"><enum>(a)</enum><header>Prohibition</header> <paragraph commented="no" display-inline="yes-display-inline" id="H5EE1BAC7D41F4CF0B4600396A84518DC"><enum>(1)</enum><text>No person may smoke indoors in any facility of the Veterans Health Administration.</text>
 </paragraph><paragraph id="HFFF114B1CECC4C7D9F044BF235259C4E" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">No person may smoke outdoors in any facility of the Veterans Health Administration on or after October 1, 2022.</text>
 </paragraph></subsection><subsection id="HB2618C2D46614771891CD910DE990B81"><enum>(b)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H77C830075C224A18984B2BD7FAE34B1A"><enum>(1)</enum><text display-inline="yes-display-inline">The term <quote>smoke</quote> includes the smoking of cigarettes (including e-cigarettes or electronic cigarettes), cigars, pipes, and any other combustion of tobacco.</text>
 </paragraph><paragraph id="HCE2B7D4E8BC545EDBF925A5F4B6BDF47"><enum>(2)</enum><text display-inline="yes-display-inline">The term <quote>facility of the Veterans Health Administration</quote> means any land or building (including any medical center, nursing home, domiciliary facility, outpatient clinic, or center that provides readjustment counseling) that is—</text>
 <subparagraph id="H56B9E65BF623435680019B10FE54D37F"><enum>(A)</enum><text>under the jurisdiction of the Department of Veterans Affairs;</text> </subparagraph><subparagraph id="H37F75A90A859422F99F8DA366E9733AC"><enum>(B)</enum><text>under the control of the Veterans Health Administration; and</text>
 </subparagraph><subparagraph id="H33B6BB7C214341C4AF4EF8BEDC0719EA"><enum>(C)</enum><text>not under the control of the General Services Administration.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection><subsection id="HE7F242CCDB7B4F4F816ADF4B9DC9D155"><enum>(b)</enum><header>Conforming amendments</header> <paragraph id="H08274A0B1221485AACB8245F22EF11F4"><enum>(1)</enum><text display-inline="yes-display-inline">The table of sections at the beginning of chapter 17 of such title is amended by striking the item relating to section 1715 and inserting the following:</text>

							<toc-entry level="section">1715. Prohibition on smoking in facilities of the Veterans Health Administration.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph><paragraph id="HC9D1868C35834A3186CE3814AF712A39"><enum>(2)</enum><text display-inline="yes-display-inline">Section 526 of the Veterans Health Care Act of 1992 (<external-xref legal-doc="public-law" parsable-cite="pl/102/585">Public Law 102–585</external-xref>) is repealed.</text> </paragraph></subsection><subsection id="H4DB2B61DD4EC4CE592698EEE37E9A419"><enum>(c)</enum><header>Effective date</header><text display-inline="yes-display-inline">This section shall take effect 90 days after the date of the enactment of this Act.</text>
