			 alien members of the United States Armed Forces, and for other purposes.</official-title></form>
	<legis-body id="H7F67B8575B434773BF8AA49C92571BEA" style="OLC">
 <section id="H4EB6E6B879F04DC4BCE4793EE979BECC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Restoring Respect for Immigrant Service in Uniform Act</short-title></quote>.</text></section><section id="id28A127A34EA846DFA9C60E1396EE3822" section-type="subsequent-section"><enum>2.</enum><header>Readmission of deported veterans</header> <subsection id="id3800FBD7FC784EEFA5498F1FC4E9495D"><enum>(a)</enum><header>In general</header><text>It is the sense of Congress that the Secretary of Homeland Security should exercise the Secretary's discretion, including under subsections (a)(9)(A)(iii), (a)(9)(B)(v), (d)(3)(A), and (d)(5)(A) of section 212 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182</external-xref>) in order to admit to the United States an alien who is inadmissible under such section 212, was previously subject to an order of removal or has been removed, is outside of the United States, and is seeking admission to the United States, if the alien—</text><paragraph id="id9C1CFE38DE0E4FCCBF08242E858DA347"><enum>(1)</enum><text>has been a member of the United States Armed Forces for a period of not less 180 days, and has not received a discharge other than an honorable discharge;</text></paragraph><paragraph id="id7A2803409FCA475C905CA7DC44C0F0F5"><enum>(2)</enum><text>has not been convicted of—</text><subparagraph id="idEFC613093CEC4C75B8A46E8DF8BA7069"><enum>(A)</enum><text>a felony;</text></subparagraph><subparagraph id="idC3051CEC21E84E91810B8A8206A6A404"><enum>(B)</enum><text>a significant misdemeanor; or</text></subparagraph><subparagraph id="id09707E5FEADA48F88577371058C37F0D"><enum>(C)</enum><text>3 or more misdemeanors that are not significant misdemeanors, each of which occurred on a different date, and arose out of separate conduct; and</text></subparagraph></paragraph><paragraph id="id70D19C7C32C84FD8ABB9392AF49E1D32"><enum>(3)</enum><text>is not otherwise a threat to national security or public safety.</text></paragraph></subsection><subsection id="id9BCCA350642F4C02A1B7D4F21E216C3B"><enum>(b)</enum><header>Significant misdemeanor defined</header><text display-inline="yes-display-inline">In this section, the term <term>significant misdemeanor</term> means a misdemeanor—</text><paragraph id="idF86D034834F64BC0BAF7D19CA77B7B8B"><enum>(1)</enum><text>which is a crime of domestic violence (as such term is defined in section 237(a)(2)(E)(i) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1227">8 U.S.C. 1227(a)(2)(E)(i)</external-xref>));</text></paragraph><paragraph id="idB094A53A485E400DA2DFC47EEC7D363C"><enum>(2)</enum><text>which is a sexual assault (as such term is defined in section 40002(a) of the Violent Crime Control and Law Enforcement Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/42/13925">42 U.S.C. 13925(a)</external-xref>));</text></paragraph><paragraph id="id93924EE068BC4402B144B0CA10D3A22C"><enum>(3)</enum><text>which involved the unlawful possession of a firearm (as such term is defined in section 921 of title 18, United States Code); or</text></paragraph><paragraph id="id039F5273BCF34AB08CE09092F38080ED"><enum>(4)</enum><text>for which the alien was sentenced to a term of imprisonment of longer than 90 days.</text></paragraph></subsection></section><section id="id47A47DB0B85A4CE7BE41197C5CFC0F1D"><enum>3.</enum><header>Limiting grounds of deportability for servicemembers and veterans</header><text display-inline="no-display-inline">Section 237 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1227">8 U.S.C. 1227</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="id665DA175A5E94406A874D2B13DFDC1F6" style="OLC"><subsection id="idC506B83E2E7244339EBC44D62D068527"><enum>(e)</enum><header>Alien members of the United States Armed Forces</header><text>The provisions of this section shall not apply to an alien who has been a member of the United States Armed Forces for a period of not less than 180 days, and who has not received a discharge other than an honorable discharge, except in the case of an alien who—</text><paragraph id="idF3F13A6814814583864E2E3113E333B6"><enum>(1)</enum><text>has been convicted of—</text><subparagraph id="id026A18B7446440A59B71B8A69CBB76D2"><enum>(A)</enum><text>a felony;</text></subparagraph><subparagraph id="id45CB117BE05B4E16907C80B81C4F178F"><enum>(B)</enum><text>a significant misdemeanor (as such term is defined in section 2 of the Restoring Respect for Immigrant Service in Uniform Act); or</text></subparagraph><subparagraph id="id6BC8A93A46714010B19539A2CBCFE7D7"><enum>(C)</enum><text>3 or more misdemeanors that are not significant misdemeanors, each of which occurred on a different date, and arose out of separate conduct; and</text></subparagraph></paragraph><paragraph id="id96DF036B6BDB40D494017A3BEEB14BCA"><enum>(2)</enum><text>is otherwise a threat to national security or public safety.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
