			 constructing or renovating, or planning construction or renovation of,
			 qualified psychiatric and substance abuse treatment facilities, and for
			 other purposes.</official-title></form>
	<legis-body id="H78AF8333825B48EABEAF889EAAAF3754" style="OLC">
 <section id="H660C00DBB34244C8BB91E17E8C22D463" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Mental Health and Substance Abuse Treatment Accessibility Act of 2017</short-title></quote>.</text> </section><section id="HC6266460447E450C890073DD553E7001"><enum>2.</enum><header>Loans and loan guarantees</header><text display-inline="no-display-inline">Part P of title III of the Public Health Service Act is amended by inserting after section 399V–6 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/280g-17">42 U.S.C. 280g–17</external-xref>) the following:</text>
			<quoted-block display-inline="no-display-inline" id="H402AD20D54F14F038243C1915663191A" style="OLC">
				<section id="H48F8218C29DE4280A39052B98973CEA3"><enum>399V–7.</enum><header>Loans and loan guarantees for constructing or renovating, or planning construction or renovation
			 of, certain qualified psychiatric and substance abuse treatment facilities</header>
 <subsection id="H4FC7ADD4A5D94394A2F27660A94AB88B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may—</text> <paragraph id="H453FFCD3905F4A8F96B98F050A03B072"><enum>(1)</enum><text>make loans and loan guarantees for the purpose of constructing or renovating, including planning the construction or renovation of, a qualified psychiatric treatment facility or a qualified substance abuse treatment facility to public, private for-profit, or private not-for-profit—</text>
 <subparagraph id="H9EFCBFFC6D2F4538864AE25976B098AB"><enum>(A)</enum><text>psychiatric treatment facilities;</text> </subparagraph><subparagraph id="HC2E7EA19DBB74E088ABA2B50338F1BF7"><enum>(B)</enum><text>substance abuse treatment facilities;</text>
 </subparagraph><subparagraph id="H0485A65FCC7B40C3A9419E130FE0E360"><enum>(C)</enum><text>psychiatric hospitals; and</text> </subparagraph><subparagraph id="HBED1EB8FFED440A5BC9ACEBC065E217F"><enum>(D)</enum><text>alliances of such facilities or hospitals; and</text>
 </subparagraph></paragraph><paragraph id="HCC4880F64C73429BBC9E1248C6F914C8"><enum>(2)</enum><text>subject to subsection (d), make loans and loan guarantees for refinancing loans that were made for such purpose to an entity listed in paragraph (1).</text>
 </paragraph></subsection><subsection id="HEC8932C07BD44BDCA9A2E7F5FD7AC19D"><enum>(b)</enum><header>Preference</header><text display-inline="yes-display-inline">In making loans and loan guarantees under this section, the Secretary shall give preference to psychiatric treatment facilities and substance abuse treatment facilities that propose to construct or renovate a qualified psychiatric treatment facility or qualified substance abuse treatment facility in a county that has insufficient inpatient psychiatric or substance abuse treatment capacity.</text>
 </subsection><subsection id="H2486965F42DD42708335FFFAD0063C5A"><enum>(c)</enum><header>Terms and conditions</header><text>Loans and loan guarantees under this section shall be made on such terms and conditions as the Secretary may prescribe, subject to the provisions of this section including the following:</text>
 <paragraph id="H871913F5D85B408488A5817C92FF0335"><enum>(1)</enum><text>The Secretary may allow credit to a prospective borrower only where—</text> <subparagraph id="H2311F19167074D12ADC375EBF2AECAF7"><enum>(A)</enum><text display-inline="yes-display-inline">it is necessary to increase the number of psychiatric or substance use disorder treatment beds to enhance the public’s access to acute inpatient mental health and substance abuse services; and</text>
 </subparagraph><subparagraph id="HB1E73CD5B7BE4693BE612F7E08870408"><enum>(B)</enum><text>a credit subsidy is the most efficient way to achieve such increase (on a borrower-by-borrower basis).</text>
 </subparagraph></paragraph><paragraph id="H353DF92E160647B9B8382E4090214287"><enum>(2)</enum><text>The final maturity of loans made or guaranteed under this section shall not exceed a period of 20 years, or the period of 50 percent of the useful life of any physical asset to be financed by the loan, whichever is less as determined by the Secretary.</text>
 </paragraph><paragraph id="H6B2E7AF4727D477A97D25A20D20C892A"><enum>(3)</enum><text>The Secretary may not make a loan guarantee under this section, with respect to any borrower, in excess of 80 percent of any potential loss on the loan.</text>
 </paragraph><paragraph id="H8D32F41EF6AC45479040DC9764391D73"><enum>(4)</enum><text>The Secretary may not make any loan or loan guarantee under this section if the loan will be subordinated—</text>
 <subparagraph id="H5B126733E25242EB9B432E8483DE6329"><enum>(A)</enum><text>to another debt contracted by the borrower; or</text> </subparagraph><subparagraph id="H227118FA88664CF799EF65D4F080BCB0"><enum>(B)</enum><text>to any other claims against the borrower in the case of default.</text>
 </subparagraph></paragraph><paragraph id="H22D65302E5C549BEBDB52DA9028C7E1B"><enum>(5)</enum><text display-inline="yes-display-inline">The Secretary may not make any loan guarantee under this section unless the Secretary determines that—</text>
 <subparagraph id="H7A465CBE65B8473EA363D99F4F323F2C"><enum>(A)</enum><text>the lender is responsible; and</text> </subparagraph><subparagraph id="H265EB2F1838F49889F00DD5B697AEB5B"><enum>(B)</enum><text>adequate provision is made for servicing the loan on reasonable terms and protecting the financial interest of the United States.</text>
 </subparagraph></paragraph><paragraph id="HE5EC722CBA2D47A2AE998B7009D1BC5A"><enum>(6)</enum><text display-inline="yes-display-inline">The Secretary may not make any loan guarantee under this section if the income from the loan will be excluded from gross income for purposes of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986.</text>
 </paragraph><paragraph id="H640AC66137FA486F93AA4A4A45D032CB"><enum>(7)</enum><text display-inline="yes-display-inline">The Secretary may not make any loan or loan guarantee under this section unless—</text> <subparagraph id="HDC7F9CD38B234FF88248FF18B1DA9244"><enum>(A)</enum><text>the loan and interest supplements on any loan guarantee will be at an interest rate that is set by reference to a benchmark interest rate on marketable Treasury securities with a similar maturity to the loan being made or guaranteed; and</text>
 </subparagraph><subparagraph id="H5CBA9F9A97604017B84C1BCDE6F52D77"><enum>(B)</enum><text>the minimum interest rate on the loan—</text> <clause id="H657CE49F2F35461D83BA2D96B9520FFA"><enum>(i)</enum><text>will be no less than the estimated cost to the Government of making the loan plus 1 percent, with the goal of keeping the interest rate below the interest rate of a comparable and competitive private sector benchmark financial instrument; and</text>
 </clause><clause id="H191D8464A92D4E2D962C062603E4BC31"><enum>(ii)</enum><text>will be adjusted, as determined by the Secretary, every quarter to take account of changes in the interest rate of the benchmark financial instrument.</text>
 </clause></subparagraph></paragraph><paragraph id="H3E160FCBD3864189A81D033B866D97F2"><enum>(8)</enum><text display-inline="yes-display-inline">The Secretary may not make any loan or loan guarantee under this section unless—</text> <subparagraph id="H1983EB30AFB34F808631F52444CB534D"><enum>(A)</enum><text display-inline="yes-display-inline">fees or premiums on the loan or loan guarantee and corresponding insurance coverage will be set at levels that minimize the cost to the Government (as defined in section 502(5) of the Federal Credit Reform Act of 1990) of insuring such loan or loan guarantee, while supporting achievement of increasing the inpatient psychiatric and substance abuse bed count, as applicable, to enhance the public’s access to acute inpatient mental health and substance abuse services;</text>
 </subparagraph><subparagraph id="HBC1BC2B76C444BC28FF9CF21A2434ACE"><enum>(B)</enum><text>the minimum guarantee fee or insurance premium imposed by the Government will be no less than the level sufficient to cover all of the estimated costs to the Government of the expected default claims, plus one percent; and</text>
 </subparagraph><subparagraph id="HA9D2C096A1AC4233A04C4569E2A7EED1"><enum>(C)</enum><text>loan guarantee fees imposed by the Government will be reviewed every six months to ensure that the fees imposed on new loan guarantees are at a level sufficient to satisfy subparagraph (B) based on the most recent estimates of such costs.</text>
 </subparagraph></paragraph><paragraph id="HFA256743979349BB8ABE0E63917C7E66"><enum>(9)</enum><text>The provisions of any loan guarantee under this section shall state that the guarantee is conclusive evidence that—</text>
 <subparagraph id="H67F700FB6FEF46E4B51D2ED69997AC50"><enum>(A)</enum><text>the guarantee has been properly obtained;</text> </subparagraph><subparagraph id="H3DC1318DB8154879A9923D7C64273C19"><enum>(B)</enum><text>the underlying loan qualified for the guarantee; and</text>
 </subparagraph><subparagraph id="HF2E9FD04A7194157B0B6D5D053A10E90"><enum>(C)</enum><text>except in the case of fraud or material misrepresentation by the holder of the loan, the guarantee will be presumed to be valid, legal, and enforceable.</text>
 </subparagraph></paragraph><paragraph id="H3702F514EAC0469E846A5500D6487C9C"><enum>(10)</enum><text display-inline="yes-display-inline">The Secretary may not make any loan or loan guarantee under this section unless—</text> <subparagraph id="H51ECC9B3E3194E6797F073C46974E3D0"><enum>(A)</enum><text>the borrower finances at least 25 percent of the funded project from other sources; and</text>
 </subparagraph><subparagraph id="H410FD740D48546E7BBAA9E10450448DA"><enum>(B)</enum><text display-inline="yes-display-inline">the borrower uses funds that were not derived from Federal loans or loan guarantees to pay the fees or premiums on the loan or loan guarantee under this section.</text>
 </subparagraph></paragraph><paragraph commented="no" id="HEACD05CBAF7749A1B3505BCA9DF76C94"><enum>(11)</enum><text>The Secretary—</text> <subparagraph id="H1DE040B59B4C48F79CBE3A2C406C960F"><enum>(A)</enum><text>shall prescribe explicit standards for use in periodically assessing the credit risk of new and existing direct loans and guaranteed loans; and</text>
 </subparagraph><subparagraph id="HD8BFB2B7601C4B39A7F959D7D53D0DA9"><enum>(B)</enum><text>shall not make a loan or loan guarantee under this section unless the Secretary finds that there is a reasonable assurance of repayment.</text>
 </subparagraph></paragraph></subsection><subsection id="H6A36070ED2664FF593B55F6A71E2D4EC"><enum>(d)</enum><header>Limitation on refinancing</header><text display-inline="yes-display-inline">The authority vested by subsection (a)(2)—</text> <paragraph id="HC2821C57E4D548B19ECA320DBF8596A6"><enum>(1)</enum><text display-inline="yes-display-inline">authorizes making loans and loan guarantees only for refinancing loans that were entered into on or before the date that is 24 months before the date of enactment of the <short-title>Mental Health and Substance Abuse Treatment Accessibility Act of 2017</short-title>; and</text>
 </paragraph><paragraph id="H31B19D9F49AC4ACF8BE4840CCF63EAAD"><enum>(2)</enum><text>terminates on the date that is 24 months after such date of enactment.</text> </paragraph></subsection><subsection commented="no" id="H417C627878E54BF1A9CD29D0EDA4702F"><enum>(e)</enum><header>Payment of losses</header> <paragraph commented="no" id="H3D1FB66D9CB34AEDA78C3571A8980A3F"><enum>(1)</enum><header>Default on guaranteed loans</header><text>If, as a result of a default by a borrower under a loan guaranteed under this section, after the holder thereof has made such further collection efforts and instituted such enforcement proceedings as the Secretary may require, the Secretary determines that the holder has suffered a loss—</text>
 <subparagraph id="HC799371A4A404F52851ABBCDE2FBC74C"><enum>(A)</enum><text>the Secretary shall pay to such holder 75 percent of such loss, as specified in the guarantee contract;</text>
 </subparagraph><subparagraph id="H9BFE14968FBF4A7D9A923DC981F8230F"><enum>(B)</enum><text>upon making any such payment, the Secretary shall be subrogated to all the rights of the recipient of the payment; and</text>
 </subparagraph><subparagraph id="H4F75A2C9E7344D0DBB95970B6ED8E1D4"><enum>(C)</enum><text>the Secretary shall be entitled to recover from the borrower the amount of any payments made pursuant to the guarantee contract.</text>
 </subparagraph></paragraph><paragraph commented="no" id="HA0DD3754E89D4C29BF5840E65DE66D16"><enum>(2)</enum><header>Required enforce of Federal rights</header><text>The Attorney General of the United States shall take such action as may be appropriate to enforce any right accruing to the United States as a result of the issuance of any guarantee under this section.</text>
 </paragraph><paragraph commented="no" id="HC275B7DBB0524CC294772B6489220AB7"><enum>(3)</enum><header>Forbearance</header><text>Nothing in this section precludes any forbearance for the benefit of the borrower of a loan that is made or guaranteed under this section which is agreed upon by the parties to the loan and approved by the Secretary, provided that budget authority for any resulting cost to the Government (as defined in section 502(5) of the Federal Credit Reform Act of 1990) is available.</text>
 </paragraph></subsection><subsection id="H49C53068066A4E7299DDC68E175F5DAA"><enum>(f)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H36835D1B720D4624A99827C1F7C4247F"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>qualified psychiatric treatment facility</term>—</text>
 <subparagraph id="H0E42ADAC5FFC4EA7B777F3D450954ECA"><enum>(A)</enum><text display-inline="yes-display-inline">means a psychiatric hospital (or other qualified treatment facility, as determined appropriate by the Secretary) that is able to serve patients ages 21 and older that—</text>
 <clause id="H5C52342A9F984D19957F66FA98D4E18C"><enum>(i)</enum><text>will provide acute, short-term inpatient psychiatric treatment services for such patients;</text> </clause><clause id="H6540D527DD7A461A8DFF005AA8A141A4"><enum>(ii)</enum><text>will provide outpatient services; and</text>
 </clause><clause id="HA11277E155474127819A4F912C628208"><enum>(iii)</enum><text>may include a military services program to meet the needs of active and retired military servicemembers; and</text>
 </clause></subparagraph><subparagraph id="HF46AE652A8D94B3CBF65E473826FC579"><enum>(B)</enum><text>excludes a facility that—</text> <clause id="H991268E652154BD0B186DB1131F2039E"><enum>(i)</enum><text display-inline="yes-display-inline">provides long-term inpatient care;</text>
 </clause><clause id="HBAC7C50F6B2941579EBFE17D57E8BFE6"><enum>(ii)</enum><text>is a health center (as defined in section 330); and</text> </clause><clause id="HD078C2713B79432C97C8E7A9EDB0C02D"><enum>(iii)</enum><text>is part of or affiliated with a prison (as defined in section 2246 of title 18, United States Code).</text>
 </clause></subparagraph></paragraph><paragraph id="H2C3513D7C84F4F45B4749F4D5FDBA978"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>qualified substance abuse treatment facility</term>—</text> <subparagraph id="H4111CB0B2F2B40158B0493E8A02B5FB6"><enum>(A)</enum><text display-inline="yes-display-inline">means a psychiatric hospital (or other qualified treatment facility, as determined appropriate by the Secretary) that is able to serve patients ages 21 and older that—</text>
 <clause id="H824C05F2611449B7ABBED570EF2343CD"><enum>(i)</enum><text>will provide acute, short-term inpatient substance abuse treatment services for such patients;</text> </clause><clause id="H4DCD67DA484247AAAF5B1DDFDEA4B848"><enum>(ii)</enum><text>will provide outpatient services; and</text>
 </clause><clause id="H627F18FA34F34573BE291CE67B3C6E78"><enum>(iii)</enum><text>may include a military services program to meet the needs of active and retired military servicemembers; and</text>
 </clause></subparagraph><subparagraph id="H7307C0D6986A427495011602B025641D"><enum>(B)</enum><text>excludes any facility described in paragraph (1)(B).</text> </subparagraph></paragraph><paragraph id="H012EEE0F653B44E69CF546F652C93B30"><enum>(3)</enum><text>The term <term>psychiatric hospital</term> means—</text>
 <subparagraph id="H4AA352512CB147F4A3099CB45384E5D3"><enum>(A)</enum><text>an institution that—</text> <clause id="H53BC144E95DF4415A3219814C67A769C"><enum>(i)</enum><text display-inline="yes-display-inline">is primarily engaged in providing, by or under the supervision of one or more physicians, psychiatric services for the diagnosis and treatment of mentally ill persons or those suffering from substance abuse disorders;</text>
 </clause><clause id="HD7C446FF19AA4A50881CB6B985769F85"><enum>(ii)</enum><text>satisfies the requirements of paragraphs (3) through (9) of subsection (e) of section 1861 of the Social Security Act;</text>
 </clause><clause id="HACC6AA10FC8E49E6AD2C9445D27E7744"><enum>(iii)</enum><text>maintains clinical records on all patients and maintains such records as the Secretary finds to be necessary to determine the degree and intensity of the treatment provided to individuals entitled to hospital insurance benefits under part A of title XVIII of the Social Security Act; and</text>
 </clause><clause id="HC023384B151B47C18C3B6C7929CE497A"><enum>(iv)</enum><text>meets such staffing requirements as the Secretary finds necessary for the institution to carry out an active program of treatment for individuals who are furnished services in the institution; or</text>
 </clause></subparagraph><subparagraph id="HCC30A0983DE5444B8B1D25128015A033"><enum>(B)</enum><text display-inline="yes-display-inline">a distinct part of an institution that satisfies clauses (i) and (ii) of subparagraph (A) if such distinct part satisfies clauses (iii) and (iv) of subparagraph (A).</text>
 </subparagraph></paragraph></subsection><subsection commented="no" id="H1F2CF72E891E4F7CAB44649B1B594EFF"><enum>(g)</enum><header>Funding limitations</header><text display-inline="yes-display-inline">The Secretary may provide loans and loan guarantees under this section—</text> <paragraph id="HFBA0FB4003EB429CA21C125152B293C4"><enum>(1)</enum><text>only to the extent or in the amounts provided in advance in appropriation Acts; and</text>
 </paragraph><paragraph id="H614182FE2B3F4E2D956CFEF63ADCC8B6"><enum>(2)</enum><text display-inline="yes-display-inline">totaling not more than $200,000,000 in each of fiscal years 2018 through 2022.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </section><section id="H0D111D04FCD14E40B568B11B27C72851"><enum>3.</enum><header>Mental Health and Substance Use Treatment Trust Fund</header> <subsection id="H92FF3B7301B84A718445623DB37E2332"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established in the Treasury of the United States a trust fund to be known as the Mental Health and Substance Use Treatment Trust Fund (in this section referred to as the <quote>Trust Fund</quote>).</text>
 </subsection><subsection id="H1EFAF1D3AEED4FFEBF5739C8CE284126"><enum>(b)</enum><header>Deposits</header><text>There are hereby authorized to be appropriated to the Trust Fund, to remain available until expended, amounts equivalent to any revenues from the program of loans and loan guarantees under section 399V–7 of the Public Health Service Act, as added by section 2, that exceed the costs of carrying out such program.</text>
 </subsection><subsection id="H5750466E15D34391AB9846455310EA90"><enum>(c)</enum><header>Use of fund</header><text display-inline="yes-display-inline">Amounts in the Trust Fund shall be available, as provided by appropriation Acts, for block grants for community mental health services under subpart I of part B of title XIX of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300x">42 U.S.C. 300x</external-xref> et seq.).</text>
 </subsection></section><section id="H2307626FF32649E39755ECAE2230F00B"><enum>4.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that reversing the Federal policy of denying Federal financial participation under the Medicaid program for care and services for patients in an institution for mental diseases is critically important to improving access to mental health care services and treatment.</text>
