			 provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish a grant program providing for the acquisition, operation, and maintenance of body-worn
			 cameras for law enforcement officers, and for other purposes.</official-title></form>
	<legis-body id="HFC2B4777F7F64B5D85585FF1ED619A6C" style="OLC">
 <section id="H8F4B2F1415EF40898BE5DB65AB806079" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Camera Accountability Maintenance and Transparency in Policing Act of 2017</short-title></quote> or the <quote>CAM TIP Act of 2017</quote>.</text> </section><section id="HB1AB2584251142929287AFE943760F76"><enum>2.</enum><header>Body-worn camera grants</header><text display-inline="no-display-inline">Title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3711">42 U.S.C. 3711 et seq.</external-xref>) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="H468BA5BD6DA14FCFB94B9FD04E397290" style="OLC">
				<part id="H3F87A8AF09E0406E8024AC176083307F"><enum>MM</enum><header>Body-Worn Camera Grants</header>
 <section id="H64EAB9E1A8A54498AF541F37372BCD34"><enum>3031.</enum><header>In general</header><text display-inline="no-display-inline">From amounts made available to the Bureau of Justice Assistance, the Director of the Bureau of Justice Assistance may make grants to States, units of local government, and Indian tribes for the acquisition, operation, and maintenance of body-worn cameras for law enforcement officers. In making such grants, the Director shall assess the program proposed by the applicant for the elements described in section 3033.</text>
 </section><section id="H45D42715605C4D1AADB011F629F546B0"><enum>3032.</enum><header>Uses of funds</header><text display-inline="no-display-inline">Grants awarded under this part shall be—</text> <paragraph id="H4B906619363E4AA79B247AD1F84B7510"><enum>(1)</enum><text>distributed directly to the State, unit of local government, or Indian tribe; and</text>
 </paragraph><paragraph id="H06CF0F72889B433291B67D88AD16E65D"><enum>(2)</enum><text>used for the program described under section 3033.</text> </paragraph></section><section id="H8D23156B5FC84C28904878FD48D99FCB"><enum>3033.</enum><header>Program described</header><text display-inline="no-display-inline">The program described in this section is any program implemented by a grantee requiring the use of body-worn cameras by law enforcement officers in that jurisdiction, which—</text>
 <paragraph id="H14341BAA7F5F413DA4A79F6559F6FAF5"><enum>(1)</enum><text display-inline="yes-display-inline">establishes policies and procedures for when law enforcement officers should wear, activate, and deactivate body-worn cameras;</text>
 </paragraph><paragraph id="H28BD8F81CEA747DE878C6CA479A93794"><enum>(2)</enum><text>ensures the protection of the civil liberties of members of general public relating to the use of body-worn cameras by law enforcement officers;</text>
 </paragraph><paragraph id="HDD016AA1ABBB46079F8378BC623097E9"><enum>(3)</enum><text>establishes policies limiting the use of recordings of body-worn cameras to monitor the conduct of law enforcement officers outside of their interactions, in an official capacity, with members of the general public;</text>
 </paragraph><paragraph id="HE4D9D0E47EC74D26BEDAF5D7935D3782"><enum>(4)</enum><text display-inline="yes-display-inline">establishes or proposes to develop standards relating to the effective placement, on a law enforcement officer’s body, of a body-worn camera;</text>
 </paragraph><paragraph id="H6AC462FF488C4C9CA955BEC637DEA6E9"><enum>(5)</enum><text>describes the best practices for receiving an accurate narrative from the recordings of body-worn cameras;</text>
 </paragraph><paragraph id="H5F6783B1C2994F2893A0F741D060FA3A"><enum>(6)</enum><text>establishes policies for the collection and storage of the recordings of body-worn cameras;</text> </paragraph><paragraph id="HA06CE585B134486B9462BF12C52EBE1D"><enum>(7)</enum><text>establishes policies relating to the availability of recordings of body-worn cameras—</text>
 <subparagraph id="HB0AD48F0472E4AE39E620FD439EA0FC5"><enum>(A)</enum><text>to the general public;</text> </subparagraph><subparagraph id="HDA1771C7F0664BF7A0B88F5A87A2C818"><enum>(B)</enum><text>to victims of crimes; and</text>
 </subparagraph><subparagraph id="H0991147185694AA280D540F2721A164C"><enum>(C)</enum><text display-inline="yes-display-inline">for internal use by the law enforcement agency; and</text> </subparagraph></paragraph><paragraph id="H885DCAD1F7454AFBBBFC0490E19D6440"><enum>(8)</enum><text>has in place guidelines and training courses for law enforcement officers relating to the proper management and use of body-worn cameras.</text>
						</paragraph></section><section id="HD36B12713B6C46E49DF983488D41D3D6"><enum>3034.</enum><header>Matching Requirements<editorial></editorial></header>
 <subsection id="H190C15009E54441E9449E505B97FC179"><enum>(a)</enum><header>Federal share</header><text display-inline="yes-display-inline">The portion of the costs of a program provided by a grant under this part may not exceed 50 percent. Any funds appropriated by Congress for the activities of any agency of an Indian tribal government or the Bureau of Indian Affairs performing law enforcement functions on any Indian lands may be used to provide the non-Federal share of a matching requirement funded under this subsection.</text>
 </subsection><subsection id="H9FEDC2AC232A44CFA332C98FF013AB47"><enum>(b)</enum><header>Non-Federal share</header><text>The non-Federal share of payments made under this part may be made in cash or in-kind fairly evaluated, including planned equipment or services.</text>
 </subsection></section><section id="H046E63A3FEF7497DABD62E01777D39DD"><enum>3035.</enum><header>Funding</header><text display-inline="no-display-inline">Grants under this part may be made using the funds that are available under section 506(a)(1).</text></section></part><after-quoted-block>.</after-quoted-block></quoted-block> </section><section display-inline="no-display-inline" id="H598B444BB8D447EE9992E107CBB87EF2"><enum>3.</enum><header>Study on the cost of the purchase and use of body-worn cameras by law enforcement agencies</header> <subsection id="H8A1DC21A85FC4220B14CFAF108B29523"><enum>(a)</enum><header>Study</header><text display-inline="yes-display-inline">The Attorney General shall conduct a study on the cost to State and local law enforcement agencies of purchasing and using body-worn cameras or other similar cameras, including gun-mounted cameras.</text>
 </subsection><subsection id="HE70FD82CBF5F447293A7E8FCFBBFB64E"><enum>(b)</enum><header>Report</header><text>Not later than 180 days after the date of the enactment of this Act, the Attorney General shall submit to Congress a report that contains the results of the study conducted under subsection (a).</text>
 </subsection></section><section id="H13EBD841A22D4DD6B9A71F5DAB2BC763"><enum>4.</enum><header>Establishment of task force on community policing and body camera accountability</header><text display-inline="no-display-inline">There shall be established in the Department of Justice a task force to do the following:</text> <paragraph id="HB7A12E3120564A489E6980EC90D86495"><enum>(1)</enum><text display-inline="yes-display-inline">The task force shall be created to provide recommendations on community policing, including best practices for creating accountability and transparency.</text>
 </paragraph><paragraph id="HC83437CF10204C5D8725E591A04EAC0B"><enum>(2)</enum><text>Not later than one year after the date of the enactment of this Act, the task force shall provide a report to the Congress, which shall include the recommendations under paragraph (1).</text>
 </paragraph><paragraph id="HC18C5DB1FE7D4B45B991BDC1EEA27F0C"><enum>(3)</enum><text display-inline="yes-display-inline">Membership shall include representatives of civil rights organizations, Federal, State, and local law enforcement personnel, and community policing experts.</text>
 </paragraph><paragraph id="H034C6BCC29AE434CA9DE40DA7CF48F08"><enum>(4)</enum><text>The task force shall develop proper body-worn camera training protocol.</text> </paragraph><paragraph id="H8159F18B07C849E7B08D6F718F785129"><enum>(5)</enum><text>The task force shall study the impact that citizen review boards could have on investigating cases of alleged police misconduct.</text>
 </paragraph><paragraph id="H077DFF8C3A774D52ABC1926F21FC74A9"><enum>(6)</enum><text>Not later than 1 year after implementation of the body camera requirement policy under section 3033 of title I of the Omnibus Crime Control Act of 1968, the task force shall conduct a survey to determine best practices and effectiveness of the policy with findings to be reported back to the Congress.</text>
 </paragraph></section><section id="H567BB7B7156C4B77BB5F2430C605CB4C"><enum>5.</enum><header>GAO report on pentagon’s 1033 program</header><text display-inline="no-display-inline">Not later than 90 days after the date of enactment of this Act, the Comptroller General of the United States shall submit to the Congress a report on the Department of Defense Excess Personal Property Program established pursuant to section 1033 of the National Defense Authorization Act for Fiscal Year 1997 (<external-xref legal-doc="public-law" parsable-cite="pl/104/201">Public Law 104–201</external-xref>), that includes information on—</text>
 <paragraph id="H664A2D8DC4CB4E8B97F22D643E3D208E"><enum>(1)</enum><text>which jurisdictions equipment is sent to;</text> </paragraph><paragraph id="H09F5D39C2C7744BCB9E713C7E07F9892"><enum>(2)</enum><text>the value of equipment sent to each jurisdiction;</text>
 </paragraph><paragraph id="H25A1A646415B48F5834B4EB043705F42"><enum>(3)</enum><text>the level of training provided to officers; and</text> </paragraph><paragraph id="H03501DD322D147CA9ECBB0B78EB48562"><enum>(4)</enum><text>how the equipment is used in the jurisdiction.</text>
