			 (RESPONSE) Subcommittee under the Federal Emergency Management Agency's
			 National Advisory Council to provide recommendations on emergency
			 responder training and resources relating to hazardous materials incidents
 involving railroads, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC"><section commented="no" display-inline="no-display-inline" id="id954F5A6EAC4F4CCC835683979733D74F" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>RESPONSE Act of 2016</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id27F63358E7494EA9868C6FEE903B2D81" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Railroad Emergency Services Preparedness, Operational Needs, and Safety Evaluation Subcommittee</header><text display-inline="no-display-inline">Section 508 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/318">6 U.S.C. 318</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id58D6B5504FE647BB80B3B4151C1A5407"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsection (d) as subsection (e); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD322B1407F7D4A0C8765BFC4A7496C01"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after subsection (c) the following:</text><quoted-block display-inline="no-display-inline" id="id49F612720F8145DD88B1ABBC0A22E08A" style="OLC"><subsection commented="no" display-inline="no-display-inline" id="id43B33973D42B4F9D93E771DB44D8EF73"><enum>(d)</enum><header display-inline="yes-display-inline">RESPONSE Subcommittee</header><paragraph commented="no" display-inline="no-display-inline" id="id8cb36d79d06f4cd6aea5161cf6244ef3"><enum>(1)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">Not later than 30 days after the date of the enactment of the <short-title>RESPONSE Act of 2016</short-title>, the Administrator shall establish, as a subcommittee of the National Advisory Council, the Railroad Emergency Services Preparedness, Operational Needs, and Safety Evaluation Subcommittee (referred to in this subsection as the <term>RESPONSE Subcommittee</term>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id80e5974e243d4d8fac7d6ed5201cbff8"><enum>(2)</enum><header display-inline="yes-display-inline">Membership</header><text display-inline="yes-display-inline">Notwithstanding subsection (c), the RESPONSE Subcommittee shall be composed of the following:</text><subparagraph commented="no" display-inline="no-display-inline" id="id0072b8cabb3047209b6b579310cc275b"><enum>(A)</enum><text display-inline="yes-display-inline">The Deputy Administrator, Protection and National Preparedness of the Federal Emergency Management Agency, or designee.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id71c27356a312422e9fcdc58104ba1de8"><enum>(B)</enum><text display-inline="yes-display-inline">The Associate Administrator for Hazardous Materials Safety of the Pipeline and Hazardous Materials Safety Administration, or designee.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbb42aee7cd5342be9a461bec29158014"><enum>(C)</enum><text display-inline="yes-display-inline">The Director of the Office of Emergency Communications of the Department of Homeland Security, or designee.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1BAE1B3A45F14B40958B178659034351"><enum>(D)</enum><text display-inline="yes-display-inline">The Director for the Office of Railroad, Pipeline and Hazardous Materials Investigations of the National Transportation Safety Board, or designee, only in an advisory capacity.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id236af6de08854905a18652492fa491d3"><enum>(E)</enum><text display-inline="yes-display-inline">The Chief Safety Officer and Associate Administrator for Railroad Safety of the Federal Railroad Administration, or designee.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id785175b070c94a01b43c255c19b0f742"><enum>(F)</enum><text display-inline="yes-display-inline">The Assistant Administrator for Security Policy and Industry Engagement of the Transportation Security Administration, or designee.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id89622adee9054473b2315ab429f11c3c"><enum>(G)</enum><text display-inline="yes-display-inline">The Assistant Commandant for Response Policy of the Coast Guard, or designee.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf79e0c32b98c4b269fa49f0c64ebb908"><enum>(H)</enum><text display-inline="yes-display-inline">The Assistant Administrator for the Office of Solid Waste and Emergency Response of the Environmental Protection Agency, or designee.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id75C9E30D45EE48EE98F3B82EE7771140"><enum>(I)</enum><text display-inline="yes-display-inline">The Chief Safety Officer and Assistant Administrator of the Federal Motor Carrier Safety Administration, or designee.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id91C3341107474BC1B83786CA54DD9214"><enum>(J)</enum><text display-inline="yes-display-inline">Such other qualified individuals as the co-chairpersons shall jointly appoint as soon as practicable after the date of the enactment of the <short-title>RESPONSE Act of 2016</short-title> from among the following:</text><clause commented="no" display-inline="no-display-inline" id="id59380c62fc694ae59cb0d954e765559d"><enum>(i)</enum><text display-inline="yes-display-inline">Members of the National Advisory Council that have the requisite technical knowledge and expertise to address rail emergency response issues, including members from the following disciplines:</text><subclause commented="no" display-inline="no-display-inline" id="id4b3740ab70c041a7876afaad63a0b73f"><enum>(I)</enum><text display-inline="yes-display-inline">Emergency management and emergency response providers, including fire service, law enforcement, hazardous materials response, and emergency medical services.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id52d97bb9bf5449da97ee787d54474523"><enum>(II)</enum><text display-inline="yes-display-inline">State, local, and tribal government officials, including Adjutants General.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id5ad15302fb1f4960860440b0b2dea608"><enum>(ii)</enum><text display-inline="yes-display-inline">Individuals who have the requisite technical knowledge and expertise to serve on the RESPONSE Subcommittee, including at least 1 representative from each of the following:</text><subclause commented="no" display-inline="no-display-inline" id="id290e3215626f49a8ad9b7817e8b39d01"><enum>(I)</enum><text display-inline="yes-display-inline">The rail industry.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idf5c4773e4be74421a893793a82e6707e"><enum>(II)</enum><text display-inline="yes-display-inline">The oil industry.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id84f55afcc7c94b7bb1137ac72f3ffec1"><enum>(III)</enum><text display-inline="yes-display-inline">The communications industry.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id48127515050746e3a34a0634657893ba"><enum>(IV)</enum><text display-inline="yes-display-inline">Emergency response providers, including individuals nominated by national organizations representing local governments and personnel.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idFF3620DD818F4B5DAD469F5F9416FE9A"><enum>(V)</enum><text display-inline="yes-display-inline">Emergency response training providers.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idE9716B8339134C078D0F1B869985A58B"><enum>(VI)</enum><text display-inline="yes-display-inline">Representatives from national Indian organizations.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id21459274FBB74B0E8000D30D4195E107"><enum>(VII)</enum><text display-inline="yes-display-inline">Technical experts.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id02ED3A41044447B3828CE60A3303A8A6"><enum>(VIII)</enum><text display-inline="yes-display-inline">Vendors, developers, and manufacturers of systems, facilities, equipment, and capabilities for emergency first responder services.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id76080e3b6fac48e08285a0c8c50a1afa"><enum>(iii)</enum><text display-inline="yes-display-inline">Representatives of such other stakeholders and interested and affected parties as the co-chairpersons consider appropriate.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id33c3ea8fbdc145efafb380449a78f801"><enum>(3)</enum><header display-inline="yes-display-inline">Co-chairpersons</header><text display-inline="yes-display-inline">The members described in subparagraphs (A) and (B) of paragraph (2) shall serve as the co-chairpersons of the RESPONSE Subcommittee.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb34d4de715764337850ed6ee42ca95cb"><enum>(4)</enum><header display-inline="yes-display-inline">Meetings</header><subparagraph commented="no" display-inline="no-display-inline" id="idcb1e7fceb2c9432aaca4fe80339194ab"><enum>(A)</enum><header display-inline="yes-display-inline">Initial meeting</header><text display-inline="yes-display-inline">The initial meeting of the RESPONSE Subcommittee shall take place not later than 90 days after the date of the enactment of the <short-title>RESPONSE Act of 2016</short-title>.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id02346a5fcb0249b2a09cb372771c85d9"><enum>(B)</enum><header display-inline="yes-display-inline">Other meetings</header><text display-inline="yes-display-inline">After the initial meeting, the RESPONSE Subcommittee shall meet at least twice annually, with at least 1 meeting conducted in person during the first year, at the call of the co-chairpersons.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id91106f77bb2f450d9cdd10d958451598"><enum>(5)</enum><header display-inline="yes-display-inline">Consultation with nonmembers</header><text display-inline="yes-display-inline">The RESPONSE Subcommittee and the program offices for emergency first responder training and resources shall consult with other relevant agencies and groups, including entities engaged in federally funded research and academic institutions engaged in relevant work and research, which are not represented on the RESPONSE Subcommittee to consider new and developing technologies and methods that may be beneficial to preparedness and response to rail hazardous materials incidents.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idba69ef42d36c4884aefd35e2e61ae72c"><enum>(6)</enum><header display-inline="yes-display-inline">Recommendations</header><text display-inline="yes-display-inline">The RESPONSE Subcommittee shall develop recommendations, as appropriate, for improving emergency first responder training and resource allocation for hazardous materials incidents involving railroads after evaluating the following topics:</text><subparagraph commented="no" display-inline="no-display-inline" id="id277ffe2cf1c44582b462038228255791"><enum>(A)</enum><text display-inline="yes-display-inline">The quality and application of training for local emergency first responders related to rail hazardous materials incidents, with a particular focus on local emergency first responders and small communities near railroads, including the following:</text><clause commented="no" display-inline="no-display-inline" id="id30cbde027cbe4e4d8e77c1e5108353c6"><enum>(i)</enum><text display-inline="yes-display-inline">Ease of access to relevant training for local emergency first responders, including an analysis of—</text><subclause commented="no" display-inline="no-display-inline" id="idBB632B2C2FB5434DAC5F6C3D5562470F"><enum>(I)</enum><text display-inline="yes-display-inline">the number of individuals being trained;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idD75148429AC449458E00139A5BFC6FDD"><enum>(II)</enum><text display-inline="yes-display-inline">the number of individuals who are applying;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idFAEE43C8617F49C1B7312B67D2B8C891"><enum>(III)</enum><text display-inline="yes-display-inline">whether current demand is being met;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id4C9E8C5D50D64E07879A3DC558937379"><enum>(IV)</enum><text display-inline="yes-display-inline">current challenges; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id8BFAE04FC4234BBA84ADD836F76DD928"><enum>(V)</enum><text display-inline="yes-display-inline">projected needs.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id5c59f17b0eb64c8698a47c6b1f56caed"><enum>(ii)</enum><text display-inline="yes-display-inline">Modernization of training course content related to rail hazardous materials incidents, with a particular focus on fluctuations in oil shipments by rail.</text></clause><clause commented="no" display-inline="no-display-inline" id="ide10af52a5f3a45b4b7bf20e51d12fca1"><enum>(iii)</enum><text display-inline="yes-display-inline">Avoiding overlap of training content across agencies and the private sector to provide complementary opportunities for rail hazardous materials incidents courses and materials, including the following:</text><subclause commented="no" display-inline="no-display-inline" id="idd16f01e26f9e4e649a36f21cc7fe5d20"><enum>(I)</enum><text display-inline="yes-display-inline">Promoting integrated course content through public-private partnerships.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idd5dc226c435b41509baa9f281514ffb6"><enum>(II)</enum><text display-inline="yes-display-inline">Regular and ongoing evaluation of course opportunities, adaptation to emerging trends, agency and private sector outreach, effectiveness and ease of access for local emergency first responders.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id64d9f5bed879442983f3c97ea5ea6b75"><enum>(iv)</enum><text display-inline="yes-display-inline">Online training platforms, train-the-trainer and mobile training options.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6bb41feb9d3c4217acbac8d22520b648"><enum>(B)</enum><text display-inline="yes-display-inline">The effectiveness of funding levels related to training local emergency first responders for rail hazardous materials incidents, with a particular focus on local emergency first responders and small communities near railroads, including the following:</text><clause commented="no" display-inline="no-display-inline" id="id440147c4d9f6409c96f868ede957fce8"><enum>(i)</enum><text display-inline="yes-display-inline">Minimizing overlap in resource allocation among agencies.</text></clause><clause commented="no" display-inline="no-display-inline" id="id4fca5a530f5a499783d0fda05f3918f0"><enum>(ii)</enum><text display-inline="yes-display-inline">Minimizing overlap in resource allocation among agencies and private sector.</text></clause><clause commented="no" display-inline="no-display-inline" id="id80e5acc68c774131ae342e6827c96af8"><enum>(iii)</enum><text display-inline="yes-display-inline">Maximizing public-private partnerships where funding gaps exists for specific training or cost-saving measures can be implemented to increase training opportunities.</text></clause><clause commented="no" display-inline="no-display-inline" id="idd954416540b64060bf5e8534ac9c97de"><enum>(iv)</enum><text display-inline="yes-display-inline">Adaptation of priority settings for agency funding allocations in response to emerging trends.</text></clause><clause commented="no" display-inline="no-display-inline" id="id6260428dd19344b8ab1904bccc52e852"><enum>(v)</enum><text display-inline="yes-display-inline">Historic levels of funding across Federal agencies for rail hazardous materials incident response and training, including funding provided by the private sector to public entities or in conjunction with Federal programs.</text></clause><clause commented="no" display-inline="no-display-inline" id="id1C166FB578004DCC80330A2128C8EAF8"><enum>(vi)</enum><text display-inline="yes-display-inline">Current funding resources across agencies.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id75e24009c37648f6832d0abc5966bfc1"><enum>(C)</enum><text display-inline="yes-display-inline">The strategy for integrating commodity flow studies, mapping, rail and hazardous materials databases and other relevant data for local emergency first responders and increasing the rate of access to the individual responder in existing or emerging communications technology.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5eac108b1ddc4a8dab644f3a1bce4a66"><enum>(7)</enum><header display-inline="yes-display-inline">Report</header><subparagraph commented="no" display-inline="no-display-inline" id="idD8CAE04CDAB54336A19062953DF15404"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of the <short-title>RESPONSE Act of 2016</short-title>, the RESPONSE Subcommittee shall submit a report to the National Advisory Council that—</text><clause commented="no" display-inline="no-display-inline" id="id5045690DA291478CBBA2D38A3300BEA6"><enum>(i)</enum><text display-inline="yes-display-inline">includes the recommendations developed under paragraph (6);</text></clause><clause commented="no" display-inline="no-display-inline" id="idAE0BFA43FAF44FFF9AF3393537F38A15"><enum>(ii)</enum><text display-inline="yes-display-inline">specifies the timeframes for implementing any such recommendations that do not require congressional action; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id059f1ba479954c6eacb6c3a3aff3f2d1"><enum>(iii)</enum><text display-inline="yes-display-inline">identifies any such recommendations that do require congressional action.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id064BDE81EBAE4EF99D774D8710A3950D"><enum>(B)</enum><header display-inline="yes-display-inline">Review</header><text display-inline="yes-display-inline">Not later than 30 days after receiving the report under subparagraph (A), the National Advisory Council shall begin a review of the report. The National Advisory Council may ask for additional clarification, changes, or other information from the RESPONSE Subcommittee to assist in the approval of the recommendations.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2BB5C066C7BC4374AABE9C7F917AEC6E"><enum>(C)</enum><header display-inline="yes-display-inline">Recommendation</header><text display-inline="yes-display-inline">Once the National Advisory Council approves the recommendations of the RESPONSE Subcommittee, the National Advisory Council shall submit the report to—</text><clause commented="no" display-inline="no-display-inline" id="id55EC52D3B2754A51A365460081BB8004"><enum>(i)</enum><text display-inline="yes-display-inline">the co-chairpersons of the RESPONSE Subcommittee;</text></clause><clause commented="no" display-inline="no-display-inline" id="idC218E13AC5654F3898650F86363EB9F6"><enum>(ii)</enum><text display-inline="yes-display-inline">the head of each other agency represented on the RESPONSE Subcommittee;</text></clause><clause commented="no" display-inline="no-display-inline" id="id27165B3CA076441A8405EDDFEE25BF61"><enum>(iii)</enum><text display-inline="yes-display-inline">the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name>;</text></clause><clause commented="no" display-inline="no-display-inline" id="id10F39667BBC3423D9FF1B775B0145FBA"><enum>(iv)</enum><text display-inline="yes-display-inline">the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation of the Senate</committee-name>;</text></clause><clause commented="no" display-inline="no-display-inline" id="idA7CF1C714E704E6C937D4270D805DD59"><enum>(v)</enum><text display-inline="yes-display-inline">the <committee-name committee-id="">Committee on Homeland Security of the House of Representatives</committee-name>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id283A35BA3B2A4E9DBBB77D10D211BFB3"><enum>(vi)</enum><text display-inline="yes-display-inline">the <committee-name committee-id="">Committee on Transportation and Infrastructure of the House of Representatives</committee-name>.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idaa5ba834c853406f94e92b0115bcf377"><enum>(8)</enum><header display-inline="yes-display-inline">Interim activity</header><subparagraph commented="no" display-inline="no-display-inline" id="id80E8C8FBD49B4B80B1B720C98F43CECB"><enum>(A)</enum><header display-inline="yes-display-inline">Updates and oversight</header><text display-inline="yes-display-inline">After the submission of the report by the National Advisory Council under paragraph (7), the Administrator shall—</text><clause commented="no" display-inline="no-display-inline" id="id688BAFE3E6DA46E6BCA428119A064643"><enum>(i)</enum><text display-inline="yes-display-inline">provide annual updates to the congressional committees referred to in paragraph (7)(C) regarding the status of the implementation of the recommendations developed under paragraph (6); and</text></clause><clause commented="no" display-inline="no-display-inline" id="id1F924DE8BBEF45399096BC803DA6B0E1"><enum>(ii)</enum><text display-inline="yes-display-inline">coordinate the implementation of the recommendations described in paragraph (6)(G)(i), as appropriate.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF4D9BBACB464419F9862069E9E3E7B49"><enum>(B)</enum><header display-inline="yes-display-inline">Additional reports</header><text display-inline="yes-display-inline">After submitting the report required under paragraph (7), the RESPONSE Subcommittee shall submit additional reports and recommendations in the same manner and to the same entities identified in paragraph (7) if needed or requested from Congress.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF34EB8B7F0454D1280B4CDAA8852EB4B"><enum>(9)</enum><header display-inline="yes-display-inline">Termination</header><subparagraph commented="no" display-inline="no-display-inline" id="idAB638EBD7137478BB90988E9BA77ED37"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in subparagraph (B), the RESPONSE Subcommittee shall terminate not later than 4 years after the date of the enactment of the <short-title>RESPONSE Act of 2016</short-title>.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4CB4EFBFFDEE42E4999D199C3B360AA2"><enum>(B)</enum><header display-inline="yes-display-inline">Extension</header><text display-inline="yes-display-inline">The Administrator may extend the duration of the RESPONSE Subcommittee for 1 additional year if the Administrator determines that an additional report and recommendations are needed from the RESPONSE Subcommittee after the termination date set forth in subparagraph (A).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body><attestation><attestation-group><attestation-date chamber="Senate" date="20160509">Passed the Senate May 9, 2016.</attestation-date><attestor display="no"></attestor><role>Secretary</role></attestation-group></attestation><endorsement display="yes"></endorsement></bill>
