 <section changed="deleted" commented="no" committee-id="SSCM00" display-inline="no-display-inline" id="S1" reported-display-style="strikethrough" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Communications Commission Process Reform Act of 2015</short-title></quote>.</text>
		</section><section changed="deleted" commented="no" committee-id="SSCM00" display-inline="no-display-inline" id="id4f95a27023434d8ea4e8bbc54532c6f0" reported-display-style="strikethrough" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">FCC process reform</header>
 <subsection commented="no" display-inline="no-display-inline" id="ide9a2c9741a9e4b89b8fc6f663eaa709d"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Title I of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/151">47 U.S.C. 151 et seq.</external-xref>) is amended by adding at the end the following:</text>

					<section commented="no" display-inline="no-display-inline" id="id4acb54f0c6514f568e84067821340ccf" section-type="subsequent-section"><enum>13.</enum><header display-inline="yes-display-inline">Transparency and efficiency</header>
 <subsection commented="no" display-inline="no-display-inline" id="id3deb94412281405ea0b145872f51e65a"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph commented="no" display-inline="no-display-inline" id="id6150a0bb56fd466da12632e5a79111bf"><enum>(1)</enum><header display-inline="yes-display-inline">Amendment</header><text display-inline="yes-display-inline">The term <term>amendment</term> includes, when used with respect to an existing rule, the deletion of the rule.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA64BE1DCBFDF4F878FACF79E7EEC8353"><enum>(2)</enum><header display-inline="yes-display-inline">Application for review</header><text display-inline="yes-display-inline">The term <term>application for review</term> means an application for review filed under section 1.115 of title 47, Code of Federal Regulations, or any successor thereto.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6b56e362a99c4cc8b029b219026fecda"><enum>(3)</enum><header display-inline="yes-display-inline">Bipartisan majority</header><text display-inline="yes-display-inline">The term <term>bipartisan majority</term> means, when used with respect to a group of Commissioners, that the group—</text> <subparagraph commented="no" display-inline="no-display-inline" id="idca6cbb11fefc46ef8924ecd0b26dfe45"><enum>(A)</enum><text display-inline="yes-display-inline">is a group of 3 or more Commissioners; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd56bb6484c29433a86948cc31b9c205f"><enum>(B)</enum><text display-inline="yes-display-inline">includes—</text> <clause commented="no" display-inline="no-display-inline" id="id6827887a425f4028920602ae45797fb3"><enum>(i)</enum><text display-inline="yes-display-inline">for each political party of which any Commissioner is a member, not less than 1 Commissioner who is a member of the political party; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id94542b8b12ec4b53ab1883e4caa730d0"><enum>(ii)</enum><text display-inline="yes-display-inline">if any Commissioner has no political party affiliation, not less than 1 unaffiliated Commissioner.</text> </clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id95ad5f60be4949f58a813ee1120eca9b"><enum>(4)</enum><header display-inline="yes-display-inline">Performance measure</header><text display-inline="yes-display-inline">The term <term>performance measure</term> means an objective and quantifiable outcome measure or output measure (as those defined in section 1115 of title 31, United States Code).</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc2a1cb35515f48e1be4ca9d09d14dd6a"><enum>(5)</enum><header display-inline="yes-display-inline">Economically significant impact</header><text display-inline="yes-display-inline">The term <term>economically significant impact</term> means an effect on the economy of $100,000,000 or more annually or a material adverse effect on the economy, a sector of the economy, productivity, competition, jobs, the environment, public health or safety, or State, local, or tribal governments or communities.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id57BB5AD41B69437B97F680BD58336F1A"><enum>(6)</enum><header display-inline="yes-display-inline">Petition for declaratory ruling</header><text display-inline="yes-display-inline">The term <term>petition for declaratory ruling</term> means a petition for declaratory ruling filed under section 1.2 of title 47, Code of Federal Regulations, or any successor thereto.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id42A884CCFD19406F9010D11FB929CF99"><enum>(7)</enum><header display-inline="yes-display-inline">Petition for reconsideration</header><text display-inline="yes-display-inline">The term <term>petition for reconsideration</term> means a petition for reconsideration filed under section 1.106 or 1.429 of title 47, Code of Federal Regulations, or any successor thereto.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id76C789CCF94A419F90222BB1B8C6E387"><enum>(8)</enum><header display-inline="yes-display-inline">Petition for rulemaking</header><text display-inline="yes-display-inline">The term <term>petition for rulemaking</term> means a petition for rulemaking filed under section 1.401 of title 47, Code of Federal Regulations, or any successor thereto.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idde0ffa6f4d71447e8abd8f409708fcb0"><enum>(9)</enum><header display-inline="yes-display-inline">Program activity</header><text display-inline="yes-display-inline">The term <term>program activity</term>—</text> <subparagraph commented="no" display-inline="no-display-inline" id="ida1145f3e25b941bdae786eb36024bfc8"><enum>(A)</enum><text display-inline="yes-display-inline">has the meaning given the term in section 1115 of title 31, United States Code; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id29e31f9ae18f4c53a25b1aad81d03662"><enum>(B)</enum><text display-inline="yes-display-inline">includes any annual collection or distribution or related series of collections or distributions by the Commission of an amount not less than $100,000,000.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7c370060e2a842c1afe990ade2732074"><enum>(10)</enum><header display-inline="yes-display-inline">Other definitions</header><text display-inline="yes-display-inline">The terms <term>adjudication</term>, <term>agency action</term>, <term>ex parte communication</term>, <term>rule</term>, and <term>rulemaking</term> have the meanings given the terms in section 551 of title 5, United States Code.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id75516fbc54a54f199208d8074f4773c2"><enum>(b)</enum><header display-inline="yes-display-inline">Initial rulemaking and inquiry</header>
 <paragraph commented="no" display-inline="no-display-inline" id="id20dc586e32894fe49f75b428414ffef5"><enum>(1)</enum><header display-inline="yes-display-inline">Rulemaking</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of the <short-title>Federal Communications Commission Process Reform Act of 2015</short-title>, the Commission shall complete a rulemaking proceeding and adopt procedural changes to the rules of the Commission to maximize opportunities for public participation and efficient decision making.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd2524bbdbb4b4cda9746d43c9e17af4f"><enum>(2)</enum><header display-inline="yes-display-inline">Requirements for rulemaking</header><text display-inline="yes-display-inline">The rules adopted under paragraph (1) shall—</text> <subparagraph commented="no" display-inline="no-display-inline" id="idfaab8a4b29dd446789d8b60a5782465f"><enum>(A)</enum><text display-inline="yes-display-inline">set minimum comment periods for comment and reply comment, subject to a determination by the Commission that good cause exists for departing from the minimum comment periods, for—</text>
 <clause commented="no" display-inline="no-display-inline" id="idc6b6b3b6ab5647419a9dcc0cd81b7e20"><enum>(i)</enum><text display-inline="yes-display-inline">significant regulatory actions, as defined in Executive Order 12866 (<external-xref legal-doc="usc" parsable-cite="usc/5/601">5 U.S.C. 601</external-xref> note; relating to regulatory planning and review);</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="ida91902489e3446949e0527bd373a455d"><enum>(ii)</enum><text display-inline="yes-display-inline">all other rulemaking proceedings; and</text> </clause><clause commented="no" display-inline="no-display-inline" id="id4357c624a6df45d9a43dec376f0e4aaf"><enum>(iii)</enum><text display-inline="yes-display-inline">petitions for forbearance filed under section 10(c) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/160">47 U.S.C. 160(c)</external-xref>);</text>
 </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id795e695c3260453ea9e43117401c78d6"><enum>(B)</enum><text display-inline="yes-display-inline">establish policies concerning the submission of extensive new comments, data, or reports towards the end of a comment period;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2ad5ff53101e404da153401aa87d9e07"><enum>(C)</enum><text display-inline="yes-display-inline">establish policies regarding treatment of comments, ex parte communications, and data or reports (including statistical reports and reports to Congress) submitted after a comment period to ensure that the public has adequate notice of and opportunity to respond to the submissions before the Commission relies on the submissions in any order, decision, report, or action;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7f7551e918424df18cf4487ebf3655b9"><enum>(D)</enum><text display-inline="yes-display-inline">establish procedures for publishing the status of open rulemaking proceedings and proposed orders, decisions, reports, or actions on circulation for review by the Commissioners, including which Commissioners have not cast a vote on an order, decision, report, or action that has been on circulation for more than 60 days;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbf94f7cbf09643778f3dd3bcc1671b22"><enum>(E)</enum><text display-inline="yes-display-inline">establish guidelines (relative to the date of filing) for issuing a public notice of—</text> <clause commented="no" display-inline="no-display-inline" id="id55b714ce19af4fd1baf69da7acfd73c6"><enum>(i)</enum><text display-inline="yes-display-inline">a petition for declaratory ruling;</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id37b9df1a1fed4d31941f9db9dbf39129"><enum>(ii)</enum><text display-inline="yes-display-inline">a petition for rulemaking;</text> </clause><clause commented="no" display-inline="no-display-inline" id="ide630826e388342b38547c84570727290"><enum>(iii)</enum><text display-inline="yes-display-inline">a petition for reconsideration; or</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id05D4C00E7D804681B8237B62433408FE"><enum>(iv)</enum><text display-inline="yes-display-inline">an application for review;</text> </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9294767cbb6d432980a169e3f0c94392"><enum>(F)</enum><text display-inline="yes-display-inline">require each notice of proposed rulemaking to include the specific language of the proposed rule or the proposed amendment of an existing rule;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id459e9c454754480eb5dadd5ea31349a1"><enum>(G)</enum><text display-inline="yes-display-inline">require each petition filed with the Commission to be—</text> <clause commented="no" display-inline="no-display-inline" id="idC21835D337254342AA48F8EC75003296"><enum>(i)</enum><text display-inline="yes-display-inline">put out for public notice, subject to the minimum comment and reply comment periods established under subparagraph (A); or</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="idD8B0285B82E746F197A3A20A17CE385D"><enum>(ii)</enum><text display-inline="yes-display-inline">disposed of pursuant to an order of dismissal;</text> </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida25fcc36b91840d58b38a290abd31e0f"><enum>(H)</enum><text display-inline="yes-display-inline">require each new notice of proposed rulemaking or order adopting a rule or amending an existing rule that creates (or proposes to create) a program activity to contain performance measures for evaluating the effectiveness of the program activity;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide3e838acd0b54bdf923d1f958ced3eac"><enum>(I)</enum><text display-inline="yes-display-inline">require each notice of proposed rulemaking or order adopting a rule or amending an existing rule that substantially changes (or proposes to substantially change) a program activity to contain—</text>
 <clause commented="no" display-inline="no-display-inline" id="id3256aa7cdaf64399858f156438baad3b"><enum>(i)</enum><text display-inline="yes-display-inline">performance measures for evaluating the effectiveness of the program activity as changed (or proposed to be changed); or</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id29d9c0b522034fdebf8271f459fa404e"><enum>(ii)</enum><text display-inline="yes-display-inline">a finding that existing performance measures will effectively evaluate the program activity as changed (or proposed to be changed);</text>
 </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5e2a7fb1dde346cb9a3dd14ffb983dcc"><enum>(J)</enum><text display-inline="yes-display-inline">require each notice of proposed rulemaking to include—</text> <clause commented="no" display-inline="no-display-inline" id="idc7f3e03e83de4fb2808fc3019676be04"><enum>(i)</enum><text display-inline="yes-display-inline">an identification of a notice of inquiry, a prior notice of proposed rulemaking, or a notice on a petition for rulemaking, issued by the Commission during the 3-year period preceding the date on which the notice of proposed rulemaking concerned is issued and of which such notice is a logical outgrowth;</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id3178e66b63664bfba43969f87a91b76d"><enum>(ii)</enum><text display-inline="yes-display-inline">an order of a court reviewing action by the Commission or otherwise directing the Commission to act that the court issued during the 3-year period preceding the date on which the notice of proposed rulemaking concerned is issued and in response to which such notice is being issued; or</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id8437b6cc3d734c3db50a94442412d548"><enum>(iii)</enum><text display-inline="yes-display-inline">a finding (together with a brief statement of reasons therefor)—</text> <subclause commented="no" display-inline="no-display-inline" id="idabf853cc6d0545dc8ac2b81feaed235e"><enum>(I)</enum><text display-inline="yes-display-inline">that the proposed rule or the proposed amendment of an existing rule will not impose additional burdens on industry or consumers; and</text>
 </subclause><subclause commented="no" display-inline="no-display-inline" id="idb9f9c9c6f3604232a8f9fae283f77379"><enum>(II)</enum><text display-inline="yes-display-inline">for good cause, that a notice of inquiry is impracticable, unnecessary, or contrary to the public interest;</text>
 </subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1bcc7a5d3c914302afa0de77c3e6a23c"><enum>(K)</enum><text display-inline="yes-display-inline">require each notice of proposed rulemaking or order adopting a rule or amending an existing rule that may have an economically significant impact, to contain—</text>
 <clause commented="no" display-inline="no-display-inline" id="idc02a94992dfe4c86be1a7cba871d9610"><enum>(i)</enum><text display-inline="yes-display-inline">an identification and analysis of the specific market failure, actual consumer harm, burden of existing regulation, or failure of public institutions that warrants the adoption or amendment; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="idb40f88050377422ab21dc6f09d7afa18"><enum>(ii)</enum><text display-inline="yes-display-inline">a reasoned determination that the benefits of the adoption or amendment justify the costs (recognizing that some benefits and costs are difficult to quantify), taking into account alternative forms of regulation and the need to tailor regulation to impose the least burden on society, consistent with obtaining regulatory objectives;</text>
 </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id016e8ee3636e46ffb617381c82528e84"><enum>(L)</enum><text display-inline="yes-display-inline">establish procedures under which a Commissioner, with respect to an order, decision, report, or action of a bureau or office of the Commission, may require the entire Commission to vote on whether to—</text>
 <clause commented="no" display-inline="no-display-inline" id="id7B72128DFAA8406EACAB03982537CF1A"><enum>(i)</enum><text display-inline="yes-display-inline">affirm, modify, or set aside the order, decision, report, or action; or</text> </clause><clause commented="no" display-inline="no-display-inline" id="idDC885AC8C1B94D5CB0DA308BBCDECBCE"><enum>(ii)</enum><text display-inline="yes-display-inline">order a rehearing upon the order, decision, report, or action in accordance with section 405; and</text>
 </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida9a5d5afc14041ebb85ed0b48eabd7fb"><enum>(M)</enum><text display-inline="yes-display-inline">establish procedures for publishing the language of a rule or amendment of an existing rule for a period of not fewer than 21 days before the date on which a vote on the rule or amendment to an existing rule begins.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide380b3b667524d638a461e6dbbc6dda5"><enum>(3)</enum><header display-inline="yes-display-inline">Inquiry</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of the Federal Communications Commission Process Reform Act of 2015, the Commission shall complete an inquiry to seek public comment on whether and how the Commission should—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="idd198f2c5f73a4f89866dd88baf9ba460"><enum>(A)</enum><text display-inline="yes-display-inline">establish procedures for informing all Commissioners of a reasonable number of options available to the Commission for resolving a petition, complaint, application, rulemaking, or other proceeding;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idffa8a1b182214fc58375f03b6084f6db"><enum>(B)</enum><text display-inline="yes-display-inline">establish procedures for ensuring that all Commissioners have adequate time, prior to being required to decide a petition, complaint, application, rulemaking, or other proceeding (including at a meeting held under section 5(d)), to review the proposed Commission decision document, including the specific language of any proposed rule or any proposed amendment of an existing rule;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id41bae7c929244eddb2fbbfd8b3bcfec7"><enum>(C)</enum><text display-inline="yes-display-inline">establish deadlines (relative to the date of filing) for disposition of applications for a license under section 1.913 of title 47, Code of Federal Regulations;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc107939911bc42d58e555a957f2346e9"><enum>(D)</enum><text display-inline="yes-display-inline">assign resources needed to meet the deadlines described in subparagraph (C), including whether the ability of the Commission to meet those deadlines would be enhanced by assessing a fee from applicants for a license described in subparagraph (C); and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3bd17cc2efde41969f4cf91fdf250aa3"><enum>(E)</enum><text display-inline="yes-display-inline">publish each order, decision, report, or action not later than 30 days after the date of the adoption of the order, decision, report, or action.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbc7fc02a90c24b878fda0902aa4806b8"><enum>(4)</enum><header display-inline="yes-display-inline">Data for performance measures</header><text display-inline="yes-display-inline">The Commission shall develop a performance measure or proposed performance measure required under this subsection to rely, where possible, on data already collected by the Commission.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idf2217493971e49928c7a7d4bc930bac7"><enum>(c)</enum><header display-inline="yes-display-inline">Periodic review</header><text display-inline="yes-display-inline">On the date that is 5 years after the completion of the rulemaking proceeding under subsection (b)(1), and every 5 years thereafter, the Commission shall initiate a new rulemaking proceeding to continue to consider any procedural changes to the rules of the Commission that may be in the public interest to maximize opportunities for public participation and efficient decisionmaking.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="idedcc2f4028434c7790cdd67438799731"><enum>(d)</enum><header display-inline="yes-display-inline">Nonpublic collaborative discussions</header>
 <paragraph commented="no" display-inline="no-display-inline" id="ide2d3eeb221e24553b997eced84ee6d1d"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Notwithstanding section 552b of title 5, United States Code, a bipartisan majority of Commissioners may hold a meeting that is closed to the public to discuss official business if—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="idf064ffe2d12d433fa550f574045dd5c3"><enum>(A)</enum><text display-inline="yes-display-inline">a vote or any other agency action is not taken at the meeting;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8d526c158a334ca38732dac99ceb220b"><enum>(B)</enum><text display-inline="yes-display-inline">each person present at the meeting is a Commissioner, an employee of the Commission, a member of a joint board or conference established under section 410, or a person on the staff of such a joint board or conference or of a member of such a joint board or conference; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0387144d795c4b5397bb75041aac2578"><enum>(C)</enum><text display-inline="yes-display-inline">an attorney from the Office of General Counsel of the Commission is present at the meeting.</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7074fe9ac50e4d53813fb65c55dc03de"><enum>(2)</enum><header display-inline="yes-display-inline">Disclosure of nonpublic collaborative discussions</header><text display-inline="yes-display-inline">Not later than 2 business days after the conclusion of a meeting held under paragraph (1), the Commission shall publish a disclosure of the meeting, including—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id98bfacb3adbb4129bd979c2df55b2049"><enum>(A)</enum><text display-inline="yes-display-inline">a list of the persons who attended the meeting; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7d8daadf3cc649ec8aa12f8b8980d962"><enum>(B)</enum><text display-inline="yes-display-inline">a summary of the matters discussed at the meeting, except for any matters that the Commission determines may be withheld under section 552b(c) of title 5, United States Code.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id282f0bcba88b4210a0675100d9c7c759"><enum>(3)</enum><header display-inline="yes-display-inline">Preservation of open meetings requirements for agency action</header><text display-inline="yes-display-inline">Nothing in this subsection shall limit the applicability of section 552b of title 5, United States Code, with respect to a meeting of Commissioners other than that described in paragraph (1).</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id76066b82428a4deea69ac540601786ed"><enum>(e)</enum><header display-inline="yes-display-inline">Access to certain information on commission’s website</header><text display-inline="yes-display-inline">The Commission shall provide direct access from the homepage of the website of the Commission to—</text> <paragraph commented="no" display-inline="no-display-inline" id="id7b2aacc85d944fd881db696fab29bb62"><enum>(1)</enum><text display-inline="yes-display-inline">detailed information regarding—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="idd9823d39a6284cb5812693c2ee4a8e34"><enum>(A)</enum><text display-inline="yes-display-inline">the budget of the Commission for the current fiscal year;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="iddf46a9dfece246c19ee6025d3df80616"><enum>(B)</enum><text display-inline="yes-display-inline">the appropriations for the Commission for the current fiscal year; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id418125e530b24dcba3e67e5194efc032"><enum>(C)</enum><text display-inline="yes-display-inline">the total number of full-time equivalent employees of the Commission; and</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7572b349bd0e492cbb150c15569c1e62"><enum>(2)</enum><text display-inline="yes-display-inline">the performance plan most recently made available by the Commission under section 1115(b) of title 31, United States Code.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id2d38aee2fc784bf0aed822fac178d46e"><enum>(f)</enum><header display-inline="yes-display-inline">Federal register publication</header>
 <paragraph commented="no" display-inline="no-display-inline" id="id5f786c05ed2d4f00a57b421fe6063f7b"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In the case of any document adopted by the Commission that the Commission is required, under any provision of law, to publish in the Federal Register, the Commission shall, not later than the date described in paragraph (2), complete all Commission actions necessary for the document to be so published.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id132a8d65d92044e89acbb969fd004b24"><enum>(2)</enum><header display-inline="yes-display-inline">Date described</header><text display-inline="yes-display-inline">The date described in this paragraph is the earlier of—</text> <subparagraph commented="no" display-inline="no-display-inline" id="idf48620f7d5df4171b90122f88895268f"><enum>(A)</enum><text display-inline="yes-display-inline">the date that is 60 days after the date of the release of the document described in paragraph (1); or</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0c4bbf388ed84a589dc2bafc11a26899"><enum>(B)</enum><text display-inline="yes-display-inline">the date by which the actions described in paragraph (1) must be completed to comply with any deadline under any other provision of law.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide7b5dcd142d24cad9c07c20a12eacd22"><enum>(3)</enum><header display-inline="yes-display-inline">No effect on deadlines for publication in other form</header>
 <subparagraph commented="no" display-inline="no-display-inline" id="idca987c7cab70480cb30ab8adaac2e728"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In the case of a deadline that does not specify that the form of publication is publication in the Federal Register, the Commission may comply with the deadline by publishing the document in another form.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd837b10140df48a7ba737578a1a56ee8"><enum>(B)</enum><header display-inline="yes-display-inline">Applicability of federal register publication requirements</header><text display-inline="yes-display-inline">Publication of a document in another form as described in subparagraph (A) shall not relieve the Commission of any Federal Register publication requirement applicable to the document, including the requirement under paragraph (1).</text>
								</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id7bf1438f7d18414885bf821a75bbc0b6"><enum>(g)</enum><header display-inline="yes-display-inline">Form of publication</header>
 <paragraph commented="no" display-inline="no-display-inline" id="id141d79c42203443bba8c88f0e3edbaf6"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In complying with a requirement under this section to publish a document, the Commission shall publish the document on the website of the Commission, in addition to publishing the document in any other form that the Commission is required to use or is permitted to and chooses to use.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9f54d0b3812e42a9ae1c5adedf343068"><enum>(2)</enum><header display-inline="yes-display-inline">Exception</header><text display-inline="yes-display-inline">The Commission shall by rule establish procedures for redacting documents required to be published under this section so that the published versions of the documents do not contain—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="idc97f8787c0bf4f7f9f3a7ef3908fa984"><enum>(A)</enum><text display-inline="yes-display-inline">information the publication of which would be detrimental to national security, homeland security, law enforcement, or public safety; or</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf9d5a4d6ae8245efa8ca42319c4d25a0"><enum>(B)</enum><text display-inline="yes-display-inline">information that is proprietary or confidential.</text> </subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id0f2f905306564a328936d7a14357e854"><enum>(h)</enum><header display-inline="yes-display-inline">Transparency relating to performance in meeting FOIA requirements</header><text display-inline="yes-display-inline">The Commission shall take additional steps to inform the public about the performance and efficiency of the Commission in meeting the disclosure and other requirements under section 552 of title 5, United States Code (commonly referred to as the <quote>Freedom of Information Act</quote>), including by—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="id91843466df614d7bb7a8635914c56298"><enum>(1)</enum><text display-inline="yes-display-inline">publishing on the website of the Commission the logs used by the Commission for tracking, responding to, and managing requests submitted under such section, including the Commission’s fee estimates, fee categories, and fee request determinations;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2e6eeffde3114bbe9c59b589b7936ee2"><enum>(2)</enum><text display-inline="yes-display-inline">releasing to the public all decisions made by the Commission (including decisions made by the Bureaus and Offices of the Commission) granting or denying requests filed under such section, including any such decisions pertaining to the estimate and application of fees assessed under such section;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1b8448491d534885872d41685cece458"><enum>(3)</enum><text display-inline="yes-display-inline">publishing on the website of the Commission electronic copies of documents released under such section; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0db8b8abf83a4dab9ca890946e554edf"><enum>(4)</enum><text display-inline="yes-display-inline">presenting, in the annual budget estimates of the Commission submitted to Congress and the annual performance and financial reports of the Commission, information about the handling by the Commission of requests under such section, including—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id2e7d48451fec43409aa2fd7a4e3cb6bf"><enum>(A)</enum><text display-inline="yes-display-inline">the number of requests under such section the Commission received during the most recent fiscal year;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf581d580be7b4e55a3e21bdb162dbfa8"><enum>(B)</enum><text display-inline="yes-display-inline">the number of requests described in subparagraph (A) granted and denied;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide7ad167018634a9bbb7290737e073341"><enum>(C)</enum><text display-inline="yes-display-inline">a comparison of the processing of requests described in subparagraph (A) by the Commission during a period of not less than the 3 preceding fiscal years; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2d68c46870a04a20b8a6e21749ee5ac7"><enum>(D)</enum><text display-inline="yes-display-inline">a comparison of the results of the Commission in processing requests described in subparagraph (A) with the most recent average for the United States Government as published on www.foia.gov.</text>
 </subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idc090d542901040a390ae25201e6a57aa"><enum>(i)</enum><header display-inline="yes-display-inline">Prompt release of statistical reports and reports to congress</header><text display-inline="yes-display-inline">Not later than January 15 of each year, the Commission shall identify, catalog, and publish an anticipated release schedule for all statistical reports and reports to Congress that are regularly or intermittently released by the Commission and will be released during the year.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="id995e6656b83d4c19b9f1da73f5a6419f"><enum>(j)</enum><header display-inline="yes-display-inline">Annual score card reports</header>
 <paragraph commented="no" display-inline="no-display-inline" id="id96fc6fe437cb446c8d85851458d75a40"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">For the 1-year period beginning on January 1 of each year, the Commission shall prepare a report on the performance of the Commission in conducting proceedings and meeting the guidelines established under subsection (b)(2)(E).</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd796cb241c654036aea4ed137ec010bc"><enum>(2)</enum><header display-inline="yes-display-inline">Contents</header><text display-inline="yes-display-inline">Each report required under paragraph (1) shall contain detailed statistics on the performance of the Commission as described in paragraph (1), including, with respect to each bureau or office of the Commission—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="idc0f45f7011474c1bb8fa44077563840d"><enum>(A)</enum><text display-inline="yes-display-inline">with respect to each type of filing specified in subsection (b)(2)(E)—</text> <clause commented="no" display-inline="no-display-inline" id="id753aed1e027f4b868f94fec3d3d35fd4"><enum>(i)</enum><text display-inline="yes-display-inline">the number of filings that were pending on the last day of the period covered by the report;</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id91ed9832e4df40b8933d52284e1431b0"><enum>(ii)</enum><text display-inline="yes-display-inline">the number of filings described in clause (i) for which each applicable deadline or guideline established under such subsection was not met and the average length of time those filings have been pending; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id07582b14e18b4ef595301351c02d861e"><enum>(iii)</enum><text display-inline="yes-display-inline">for filings that were resolved during the period covered by the report, the average time between initiation and resolution and the percentage for which each applicable deadline or guideline established under such subsection was met;</text>
 </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7457e72ab3de43a4b7fee3aac81a6e30"><enum>(B)</enum><text display-inline="yes-display-inline">with respect to proceedings before an administrative law judge—</text> <clause commented="no" display-inline="no-display-inline" id="id6047c47bb8bf4f5f8c38d2054c8b6f31"><enum>(i)</enum><text display-inline="yes-display-inline">the number of proceedings completed during the period covered by the report; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id6d74abb5c7fd4692b275e81983fb6af2"><enum>(ii)</enum><text display-inline="yes-display-inline">the number of proceedings pending on the last day of the period covered by the report; and</text> </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id980105ad7c2745cea0e071a119fd8090"><enum>(C)</enum><text display-inline="yes-display-inline">the number of independent studies or analyses published by the Commission during the period covered by the report.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id02f649359060484d947b446746cb3864"><enum>(3)</enum><header display-inline="yes-display-inline">Publication and submission</header><text display-inline="yes-display-inline">The Commission shall publish and submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce Science, and Transportation of the Senate each report required under paragraph (1) not later than the date that is 30 days after the last day of the period covered by the report.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="idb251ac9eb3d5485696f3ea9d25cdc6e5"><enum>(b)</enum><header display-inline="yes-display-inline">Effective dates and implementing rules</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id0a68ca2fca28455989bd169ddd6f755a"><enum>(1)</enum><header display-inline="yes-display-inline">Effective dates</header>
 <subparagraph commented="no" display-inline="no-display-inline" id="id1e747c3ef63f42428954a57c235ec556"><enum>(A)</enum><header display-inline="yes-display-inline">Nonpublic collaborative discussions</header><text display-inline="yes-display-inline">Subsection (d) of section 13 of the Communications Act of 1934, as added by subsection (a), shall apply beginning on the first date on which all of the procedural changes to the rules of the Federal Communications Commission required under subsection (b)(1) of such section have taken effect.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id76f6dd0d74e847b0b5fb7d7c9d4f5559"><enum>(B)</enum><header display-inline="yes-display-inline">Schedules and reports</header><text display-inline="yes-display-inline">Subsections (j) and (k) of section 13 of the Communications Act of 1934, as added by subsection (a), shall apply with respect to 2015 and any year thereafter.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idec20385a917f4396bd29b3540f1f2008"><enum>(2)</enum><header display-inline="yes-display-inline">Rules</header><text display-inline="yes-display-inline">Except as otherwise provided in section 13 of the Communications Act of 1934, as added by subsection (a), the Federal Communications Commission shall promulgate any rules necessary to carry out such section not later than 1 year after the date of enactment of this Act.</text>
 </paragraph></subsection></section><section changed="deleted" commented="no" committee-id="SSCM00" display-inline="no-display-inline" id="ide20c8445b81949159a0c3698722e2928" reported-display-style="strikethrough" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Categorization of TCPA inquiries and complaints in quarterly report</header><text display-inline="no-display-inline">In compiling its quarterly report with respect to informal consumer inquiries and complaints, the Federal Communications Commission may not categorize an inquiry or complaint with respect to section 227 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227</external-xref>) as being a wireline inquiry or complaint or a wireless inquiry or complaint unless the party whose conduct is the subject of the inquiry or complaint is a wireline carrier or a wireless carrier, respectively.</text>
 </section><section changed="deleted" commented="no" committee-id="SSCM00" display-inline="no-display-inline" id="ida30b2a09933348359de0da31b6c5d84d" reported-display-style="strikethrough" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Effect on other laws</header><text display-inline="no-display-inline">Nothing in this Act or the amendments made by this Act shall relieve the Federal Communications Commission from any obligations under title 5, United States Code, except where otherwise expressly provided.</text>
 </section><section changed="deleted" commented="no" committee-id="SSCM00" display-inline="no-display-inline" id="idede9b3162d1c4d7e80c7f7b3287a7ae5" reported-display-style="strikethrough" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Provision of emergency weather information; communications of first responders</header><text display-inline="no-display-inline">Nothing in this Act or the amendments made by this Act shall be construed to impede the Federal Communications Commission from acting in times of emergency to ensure the availability of efficient and effective communications systems—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="id65C658743C484F83AE4F81336A184BD2"><enum>(1)</enum><text display-inline="yes-display-inline">to alert the public to imminent dangerous weather conditions; or</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id48F9D28ABA3F4561AC5D4CCC8C3806F3"><enum>(2)</enum><text display-inline="yes-display-inline">for State and local first responders.</text></paragraph></section></legis-body>

 <subsection commented="no" display-inline="no-display-inline" id="idb14340c8-59d4-4e8d-94bb-783bd5e524b7"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph commented="no" display-inline="no-display-inline" id="idf751f21e-9a35-4c40-8c79-541cf5f7e2b4"><enum>(1)</enum><header display-inline="yes-display-inline">Amendment</header><text display-inline="yes-display-inline">The term <term>amendment</term> includes, when used with respect to an existing rule, the deletion of the rule.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb92d5ba3-ed19-4fd1-b7fc-0f466c5d403d"><enum>(2)</enum><header display-inline="yes-display-inline">Application for review</header><text display-inline="yes-display-inline">The term <term>application for review</term> means an application for review filed under section 1.115 of title 47, Code of Federal Regulations, or any successor thereto.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id215503ed-206f-4826-b877-4b012e3ce4cd"><enum>(3)</enum><header display-inline="yes-display-inline">Bipartisan majority</header><text display-inline="yes-display-inline">The term <term>bipartisan majority</term> means, when used with respect to a group of Commissioners, that the group—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id479f73db-2877-4ea2-a1c5-96c6d904701a"><enum>(A)</enum><text display-inline="yes-display-inline">is a group of 3 or more Commissioners; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8cbc70c3-e5ef-462e-9d6e-22d810f35631"><enum>(B)</enum><text display-inline="yes-display-inline">includes—</text> <clause commented="no" display-inline="no-display-inline" id="idfd8bfd18-795b-4b3f-8983-5cb5f14eaf15"><enum>(i)</enum><text display-inline="yes-display-inline">for each political party of which any Commissioner is a member, not less than 1 Commissioner who is a member of the political party; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id73c9232f-970e-43ee-b88c-ca5d77e2c560"><enum>(ii)</enum><text display-inline="yes-display-inline">if any Commissioner has no political party affiliation, not less than 1 unaffiliated Commissioner.</text> </clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id37f458bf-5565-4c0e-9ab9-325a0af245b9"><enum>(4)</enum><header display-inline="yes-display-inline">Performance measure</header><text display-inline="yes-display-inline">The term <term>performance measure</term> means an objective and quantifiable outcome measure or output measure (as those defined in section 1115 of title 31, United States Code).</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id39b76356-e3fe-405f-95d6-1f5e61bf04a6"><enum>(5)</enum><header display-inline="yes-display-inline">Economically significant impact</header><text display-inline="yes-display-inline">The term <term>economically significant impact</term> means an effect on the economy of $100,000,000 or more annually or a material adverse effect on the economy, a sector of the economy, productivity, competition, jobs, the environment, public health or safety, or State, local, or tribal governments or communities.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc92a8152-5b1c-4138-9045-74bb5868634e"><enum>(6)</enum><header display-inline="yes-display-inline">Petition for declaratory ruling</header><text display-inline="yes-display-inline">The term <term>petition for declaratory ruling</term> means a petition for declaratory ruling filed under section 1.2 of title 47, Code of Federal Regulations, or any successor thereto.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id772f298c-b7dd-409a-bb40-c66eee08279b"><enum>(7)</enum><header display-inline="yes-display-inline">Petition for reconsideration</header><text display-inline="yes-display-inline">The term <term>petition for reconsideration</term> means a petition for reconsideration filed under section 1.106 or 1.429 of title 47, Code of Federal Regulations, or any successor thereto.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id79c98052-3b24-483c-9251-f93b6e0bbf54"><enum>(8)</enum><header display-inline="yes-display-inline">Petition for rulemaking</header><text display-inline="yes-display-inline">The term <term>petition for rulemaking</term> means a petition for rulemaking filed under section 1.401 of title 47, Code of Federal Regulations, or any successor thereto.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide0d59570-4c93-449b-a286-56a0f4fd9f19"><enum>(9)</enum><header display-inline="yes-display-inline">Program activity</header><text display-inline="yes-display-inline">The term <term>program activity</term>—</text> <subparagraph commented="no" display-inline="no-display-inline" id="idfccbe128-be44-4afb-9a41-1d10acc79d3a"><enum>(A)</enum><text display-inline="yes-display-inline">has the meaning given the term in section 1115 of title 31, United States Code; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id26fc2701-214d-4e4f-a16d-b72a5e4d736a"><enum>(B)</enum><text display-inline="yes-display-inline">includes any annual collection or distribution or related series of collections or distributions by the Commission of an amount not less than $100,000,000.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb289057d-fbf9-4d0e-8430-a175bf968d7a"><enum>(10)</enum><header display-inline="yes-display-inline">Other definitions</header><text display-inline="yes-display-inline">The terms <term>adjudication</term>, <term>agency action</term>, <term>ex parte communication</term>, <term>rule</term>, and <term>rulemaking</term> have the meanings given the terms in section 551 of title 5, United States Code.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id25eed102-42d7-4cb5-90cd-b91b43ddb5cc"><enum>(b)</enum><header display-inline="yes-display-inline">Initial rulemaking and inquiry</header>
 <paragraph commented="no" display-inline="no-display-inline" id="id0965cf54-dae4-43b1-8763-2f8505910b4a"><enum>(1)</enum><header display-inline="yes-display-inline">Rulemaking</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of the <short-title>Federal Communications Commission Process Reform Act of 2015</short-title>, the Commission shall complete a rulemaking proceeding and adopt procedural changes to the rules of the Commission to maximize opportunities for public participation and efficient decision making.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2b759e15-1d42-4fe0-b568-8b537d9a9053"><enum>(2)</enum><header display-inline="yes-display-inline">Requirements for rulemaking</header><text display-inline="yes-display-inline">The rules adopted under paragraph (1) shall—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id86a65a08-5c73-43fc-9134-b392005dd591"><enum>(A)</enum><text display-inline="yes-display-inline">set minimum comment periods for comment and reply comment, subject to a determination by the Commission that good cause exists for departing from the minimum comment periods, for—</text>
 <clause commented="no" display-inline="no-display-inline" id="idd2bdbbbe-2581-4985-bda4-7607df1e1363"><enum>(i)</enum><text display-inline="yes-display-inline">significant regulatory actions, as defined in Executive Order 12866 (<external-xref legal-doc="usc" parsable-cite="usc/5/601">5 U.S.C. 601</external-xref> note; relating to regulatory planning and review);</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id20e1bfc8-1003-4114-9973-6140a71e977c"><enum>(ii)</enum><text display-inline="yes-display-inline">all other rulemaking proceedings; and</text> </clause><clause commented="no" display-inline="no-display-inline" id="id6efb6a75-b232-4051-86e0-e61e5a34a8fe"><enum>(iii)</enum><text display-inline="yes-display-inline">petitions for forbearance filed under section 10(c) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/160">47 U.S.C. 160(c)</external-xref>);</text>
 </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idffb7de50-cd14-4e9d-b2d6-b6806a2cd2d0"><enum>(B)</enum><text display-inline="yes-display-inline">establish policies concerning the submission of extensive new comments, data, or reports towards the end of a comment period;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id17d82320-5a60-4864-a698-ff818fdc1757"><enum>(C)</enum><text display-inline="yes-display-inline">establish policies regarding treatment of comments, ex parte communications, and data or reports (including statistical reports and reports to Congress) submitted after a comment period to ensure that the public has adequate notice of and opportunity to respond to the submissions before the Commission relies on the submissions in any order, decision, report, or action;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9ea9c950-2d1d-4bcc-a370-eb17898b3662"><enum>(D)</enum><text display-inline="yes-display-inline">establish procedures for publishing the status of open rulemaking proceedings and proposed orders, decisions, reports, or actions on circulation for review by the Commissioners, including which Commissioners have not cast a vote on an order, decision, report, or action that has been on circulation for more than 60 days;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida717274c-002b-42d2-ba2b-94dded22ca5b"><enum>(E)</enum><text display-inline="yes-display-inline">establish guidelines (relative to the date of filing) for issuing a public notice of—</text> <clause commented="no" display-inline="no-display-inline" id="id531909bb-c6dd-4699-95ab-7a25f07d2d41"><enum>(i)</enum><text display-inline="yes-display-inline">a petition for declaratory ruling;</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id3f8f661f-8f9d-4bf5-adde-4f2bdd834573"><enum>(ii)</enum><text display-inline="yes-display-inline">a petition for rulemaking;</text> </clause><clause commented="no" display-inline="no-display-inline" id="id93cb8ad7-7aee-4fce-8469-e6d5247f8686"><enum>(iii)</enum><text display-inline="yes-display-inline">a petition for reconsideration; or</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="idf039f396-ec3f-42ba-8fdf-a831bbf3a371"><enum>(iv)</enum><text display-inline="yes-display-inline">an application for review;</text> </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3b5936c4-3a19-4427-b9f4-abfe7e3f8436"><enum>(F)</enum><text display-inline="yes-display-inline">require each notice of proposed rulemaking to include the specific language of the proposed rule or the proposed amendment of an existing rule;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1e968cce-b1a3-443b-9535-96672f3176fc"><enum>(G)</enum><text display-inline="yes-display-inline">require each petition filed with the Commission to be—</text> <clause commented="no" display-inline="no-display-inline" id="id49bef7cd-bbeb-47ef-b60f-7a0854e34f76"><enum>(i)</enum><text display-inline="yes-display-inline">put out for public notice, subject to the minimum comment and reply comment periods established under subparagraph (A); or</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="idec9054db-94b9-450a-8db9-e9a81382dcf0"><enum>(ii)</enum><text display-inline="yes-display-inline">disposed of pursuant to an order of dismissal;</text> </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3481373f-9fee-44f0-812b-9453dd363727"><enum>(H)</enum><text display-inline="yes-display-inline">require each new notice of proposed rulemaking or order adopting a rule or amending an existing rule that creates (or proposes to create) a program activity to contain performance measures for evaluating the effectiveness of the program activity;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id737070e7-43fa-41ea-98ec-583d6092526c"><enum>(I)</enum><text display-inline="yes-display-inline">require each notice of proposed rulemaking or order adopting a rule or amending an existing rule that substantially changes (or proposes to substantially change) a program activity to contain—</text>
 <clause commented="no" display-inline="no-display-inline" id="id0195ad8e-685f-4d80-9898-adff0d8b947c"><enum>(i)</enum><text display-inline="yes-display-inline">performance measures for evaluating the effectiveness of the program activity as changed (or proposed to be changed); or</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id81c5b354-933e-4f1a-8bdc-7022becfa653"><enum>(ii)</enum><text display-inline="yes-display-inline">a finding that existing performance measures will effectively evaluate the program activity as changed (or proposed to be changed);</text>
 </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5a07e758-5298-4b43-97a3-942c242be6a6"><enum>(J)</enum><text display-inline="yes-display-inline">require each notice of proposed rulemaking to include—</text> <clause commented="no" display-inline="no-display-inline" id="ide10f89ce-f629-4353-bd32-6713048bbb5e"><enum>(i)</enum><text display-inline="yes-display-inline">an identification of a notice of inquiry, a prior notice of proposed rulemaking, or a notice on a petition for rulemaking, issued by the Commission during the 3-year period preceding the date on which the notice of proposed rulemaking concerned is issued and of which such notice is a logical outgrowth;</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id10ea7931-a80c-40c1-86e5-5eeb1f05f3e2"><enum>(ii)</enum><text display-inline="yes-display-inline">an order of a court reviewing action by the Commission or otherwise directing the Commission to act that the court issued during the 3-year period preceding the date on which the notice of proposed rulemaking concerned is issued and in response to which such notice is being issued; or</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id9eb3d1b3-3d26-432f-b278-e56cac4b4dae"><enum>(iii)</enum><text display-inline="yes-display-inline">a finding (together with a brief statement of reasons therefor)—</text> <subclause commented="no" display-inline="no-display-inline" id="idb35ded7d-e554-4724-b97a-6bbf5c027de1"><enum>(I)</enum><text display-inline="yes-display-inline">that the proposed rule or the proposed amendment of an existing rule will not impose additional burdens on industry or consumers; and</text>
 </subclause><subclause commented="no" display-inline="no-display-inline" id="idf4f68932-d34a-4489-82c7-d32475573f9f"><enum>(II)</enum><text display-inline="yes-display-inline">for good cause, that a notice of inquiry is impracticable, unnecessary, or contrary to the public interest;</text>
 </subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idad30408b-c430-471e-9ed8-948b2cd2e046"><enum>(K)</enum><text display-inline="yes-display-inline">require each notice of proposed rulemaking or order adopting a rule or amending an existing rule that may have an economically significant impact, to contain—</text>
 <clause commented="no" display-inline="no-display-inline" id="idf6391a30-1210-433c-8682-7c8fc0b44e20"><enum>(i)</enum><text display-inline="yes-display-inline">an identification and analysis of the specific market failure, actual consumer harm, burden of existing regulation, or failure of public institutions that warrants the adoption or amendment; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id32b35eb0-1b9c-49d7-9183-0021cbee3836"><enum>(ii)</enum><text display-inline="yes-display-inline">a reasoned determination that the benefits of the adoption or amendment justify the costs (recognizing that some benefits and costs are difficult to quantify), taking into account alternative forms of regulation and the need to tailor regulation to impose the least burden on society, consistent with obtaining regulatory objectives;</text>
 </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2cf9c4d0-59d6-4010-b387-2ff1c9871fca"><enum>(L)</enum><text display-inline="yes-display-inline">establish procedures under which a Commissioner, with respect to an order, decision, report, or action of a bureau or office of the Commission, may require the entire Commission to vote on whether to—</text>
 <clause commented="no" display-inline="no-display-inline" id="id00ac172e-ba5a-4921-9aa3-c310ca6e9996"><enum>(i)</enum><text display-inline="yes-display-inline">affirm, modify, or set aside the order, decision, report, or action; or</text> </clause><clause commented="no" display-inline="no-display-inline" id="id66dae62c-d0ae-4f75-ada1-9ddabd3fdc81"><enum>(ii)</enum><text display-inline="yes-display-inline">order a rehearing upon the order, decision, report, or action in accordance with section 405;</text>
 </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbce4b8e7-9173-4c04-a8bb-304780a453fe"><enum>(M)</enum><text display-inline="yes-display-inline">establish procedures for publishing the language of a rule or amendment of an existing rule for a period of not fewer than 21 days before the date on which a vote on the rule or amendment to an existing rule begins; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4D18209CEBA74CDE863D9352D4A8F707"><enum>(N)</enum><text>establish procedures to, when publishing an item adopted by the Commission, identify any changes made to the item after its adoption.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc40b8680-7bb8-42be-9102-91c650f83a0c"><enum>(3)</enum><header display-inline="yes-display-inline">Inquiry</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of the Federal Communications Commission Process Reform Act of 2015, the Commission shall complete an inquiry to seek public comment on whether and how the Commission should—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="idbd9edd46-151f-4764-a523-efaeb37e82e2"><enum>(A)</enum><text display-inline="yes-display-inline">establish procedures for informing all Commissioners of a reasonable number of options available to the Commission for resolving a petition, complaint, application, rulemaking, or other proceeding;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbeade3c2-df2a-47f2-a06e-ba5dc649edd8"><enum>(B)</enum><text display-inline="yes-display-inline">establish procedures for ensuring that all Commissioners have adequate time, prior to being required to decide a petition, complaint, application, rulemaking, or other proceeding (including at a meeting held under section 5(d)), to review the proposed Commission decision document, including the specific language of any proposed rule or any proposed amendment of an existing rule;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idcc1263ab-2a2c-48c4-87e1-c5fece98b4d8"><enum>(C)</enum><text display-inline="yes-display-inline">establish deadlines (relative to the date of filing) for disposition of applications for a license under section 1.913 of title 47, Code of Federal Regulations;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf61e076d-f6f2-43c5-87f7-9b3813832fc6"><enum>(D)</enum><text display-inline="yes-display-inline">assign resources needed to meet the deadlines described in subparagraph (C), including whether the ability of the Commission to meet those deadlines would be enhanced by assessing a fee from applicants for a license described in subparagraph (C); and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id59f40008-dd67-47af-9344-f7076d1a932b"><enum>(E)</enum><text display-inline="yes-display-inline">publish each order, decision, report, or action not later than 30 days after the date of the adoption of the order, decision, report, or action.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2cb664a8-ca90-4685-847c-bd566357466f"><enum>(4)</enum><header display-inline="yes-display-inline">Data for performance measures</header><text display-inline="yes-display-inline">The Commission shall develop a performance measure or proposed performance measure required under this subsection to rely, where possible, on data already collected by the Commission.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idd569d10c-30cd-4f3a-a77a-89b05f9643cf"><enum>(c)</enum><header display-inline="yes-display-inline">Periodic review</header><text display-inline="yes-display-inline">On the date that is 5 years after the completion of the rulemaking proceeding under subsection (b)(1), and every 5 years thereafter, the Commission shall initiate a new rulemaking proceeding to continue to consider any procedural changes to the rules of the Commission that may be in the public interest to maximize opportunities for public participation and efficient decisionmaking.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="idf6e30a3e-b22d-46cc-97b4-f7533501fdd3"><enum>(d)</enum><header display-inline="yes-display-inline">Nonpublic collaborative discussions</header>
 <paragraph commented="no" display-inline="no-display-inline" id="id6578fc10-b3aa-4f52-af96-198d8ad646e6"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Notwithstanding section 552b of title 5, United States Code, a bipartisan majority of Commissioners may hold a meeting that is closed to the public to discuss official business if—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="idf4a6a34b-b2ad-4612-aac7-304b96405fa9"><enum>(A)</enum><text display-inline="yes-display-inline">a vote or any other agency action is not taken at the meeting;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id283ea8a2-bd98-4eea-9495-cbdc4ec28c43"><enum>(B)</enum><text display-inline="yes-display-inline">each person present at the meeting is a Commissioner, an employee of the Commission, a member of a joint board or conference established under section 410, or a person on the staff of such a joint board or conference or of a member of such a joint board or conference; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc0f0c314-7bf2-4749-be07-50846f05f4e2"><enum>(C)</enum><text display-inline="yes-display-inline">an attorney from the Office of General Counsel of the Commission is present at the meeting.</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idaab70b9c-9c5a-4abc-9045-2925322f32fb"><enum>(2)</enum><header display-inline="yes-display-inline">Disclosure of nonpublic collaborative discussions</header><text display-inline="yes-display-inline">Not later than 2 business days after the conclusion of a meeting held under paragraph (1), the Commission shall publish a disclosure of the meeting, including—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id2cc10114-ce66-4304-92f9-788fc7738ad4"><enum>(A)</enum><text display-inline="yes-display-inline">a list of the persons who attended the meeting; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfb6c24cf-056a-44ad-9d3e-273024155671"><enum>(B)</enum><text display-inline="yes-display-inline">a summary of the matters discussed at the meeting, except for any matters that the Commission determines may be withheld under section 552b(c) of title 5, United States Code.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1cc53b5b-69ba-46cc-a91b-4e9b372d1330"><enum>(3)</enum><header display-inline="yes-display-inline">Preservation of open meetings requirements for agency action</header><text display-inline="yes-display-inline">Nothing in this subsection shall limit the applicability of section 552b of title 5, United States Code, with respect to a meeting of Commissioners other than that described in paragraph (1).</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id9a551863-b3d5-44a5-8940-1cf894731e15"><enum>(e)</enum><header display-inline="yes-display-inline">Access to certain information on commission’s website</header><text display-inline="yes-display-inline">The Commission shall provide direct access from the homepage of the website of the Commission to—</text> <paragraph commented="no" display-inline="no-display-inline" id="id88856da8-401e-42c7-9ce0-483a985689f8"><enum>(1)</enum><text display-inline="yes-display-inline">detailed information regarding—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id8d072d8d-1a6b-40e0-aded-91b86f81925b"><enum>(A)</enum><text display-inline="yes-display-inline">the budget of the Commission for the current fiscal year;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id27fb9f93-f843-4d78-8af1-c925b4cca1c4"><enum>(B)</enum><text display-inline="yes-display-inline">the appropriations for the Commission for the current fiscal year; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id504ad14c-b553-4fe5-887a-d32dbf1751cb"><enum>(C)</enum><text display-inline="yes-display-inline">the total number of full-time equivalent employees of the Commission; and</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3bef65d9-ef31-45cb-a452-ffb82c69afd7"><enum>(2)</enum><text display-inline="yes-display-inline">the performance plan most recently made available by the Commission under section 1115(b) of title 31, United States Code.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id74ce5c2c-2dd0-44e0-b686-248a36e030e1"><enum>(f)</enum><header display-inline="yes-display-inline">Federal register publication</header>
 <paragraph commented="no" display-inline="no-display-inline" id="id19d821b1-6049-4216-b4b8-deb2587cc2c4"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In the case of any document adopted by the Commission that the Commission is required, under any provision of law, to publish in the Federal Register, the Commission shall, not later than the date described in paragraph (2), complete all Commission actions necessary for the document to be so published.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id957cf203-b966-4ba0-997b-ca4227213c23"><enum>(2)</enum><header display-inline="yes-display-inline">Date described</header><text display-inline="yes-display-inline">The date described in this paragraph is the earlier of—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id8b012ebb-43dc-4466-bcb2-9b136ee3ec81"><enum>(A)</enum><text display-inline="yes-display-inline">the date that is 60 days after the date of the release of the document described in paragraph (1); or</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id83d52166-f381-496f-a612-e81d4f871551"><enum>(B)</enum><text display-inline="yes-display-inline">the date by which the actions described in paragraph (1) must be completed to comply with any deadline under any other provision of law.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ideae32eb2-ac0d-4060-887b-6b420ff9a406"><enum>(3)</enum><header display-inline="yes-display-inline">No effect on deadlines for publication in other form</header>
 <subparagraph commented="no" display-inline="no-display-inline" id="id07dd0ef5-ba9a-4bdf-b4dd-5187f68d6a87"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In the case of a deadline that does not specify that the form of publication is publication in the Federal Register, the Commission may comply with the deadline by publishing the document in another form.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf6669504-b14f-4daa-9651-f7c91e779e9b"><enum>(B)</enum><header display-inline="yes-display-inline">Applicability of federal register publication requirements</header><text display-inline="yes-display-inline">Publication of a document in another form as described in subparagraph (A) shall not relieve the Commission of any Federal Register publication requirement applicable to the document, including the requirement under paragraph (1).</text>
								</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idcb35409c-819e-452f-a94a-0e2a109492d0"><enum>(g)</enum><header display-inline="yes-display-inline">Form of publication</header>
 <paragraph commented="no" display-inline="no-display-inline" id="idc447d656-ee85-4f13-b895-9cbbf77f7828"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In complying with a requirement under this section to publish a document, the Commission shall publish the document on the website of the Commission, in addition to publishing the document in any other form that the Commission is required to use or is permitted to and chooses to use.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb30fee76-a8ad-4dda-a864-fa371f3fceb7"><enum>(2)</enum><header display-inline="yes-display-inline">Exception</header><text display-inline="yes-display-inline">The Commission shall by rule establish procedures for redacting documents required to be published under this section so that the published versions of the documents do not contain—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id8daac6cc-4f03-42cb-a23d-59e5716a40af"><enum>(A)</enum><text display-inline="yes-display-inline">information the publication of which would be detrimental to national security, homeland security, law enforcement, or public safety; or</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4a5e276d-9b15-4ac3-9462-bfe873ab2375"><enum>(B)</enum><text display-inline="yes-display-inline">information that is proprietary or confidential.</text> </subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id074534f9-b5f4-4ce7-b88f-9e1e0eedd5f9"><enum>(h)</enum><header display-inline="yes-display-inline">Transparency relating to performance in meeting FOIA requirements</header><text display-inline="yes-display-inline">The Commission shall take additional steps to inform the public about the performance and efficiency of the Commission in meeting the disclosure and other requirements under section 552 of title 5, United States Code (commonly referred to as the <quote>Freedom of Information Act</quote>), including by—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="ide52572bf-1797-4eee-99ed-9f5c254d9a9c"><enum>(1)</enum><text display-inline="yes-display-inline">publishing on the website of the Commission the logs used by the Commission for tracking, responding to, and managing requests submitted under such section, including the Commission’s fee estimates, fee categories, and fee request determinations;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb98df84b-04e8-45fc-8fb2-7c0b1c063a77"><enum>(2)</enum><text display-inline="yes-display-inline">releasing to the public all decisions made by the Commission (including decisions made by the Bureaus and Offices of the Commission) granting or denying requests filed under such section, including any such decisions pertaining to the estimate and application of fees assessed under such section;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4794e8bb-ac39-4870-ac2c-a3664c50baee"><enum>(3)</enum><text display-inline="yes-display-inline">publishing on the website of the Commission electronic copies of documents released under such section; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id01a46ab8-cfcb-410c-9670-a5d2e0ac1954"><enum>(4)</enum><text display-inline="yes-display-inline">presenting, in the annual budget estimates of the Commission submitted to Congress and the annual performance and financial reports of the Commission, information about the handling by the Commission of requests under such section, including—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="idbc66b26c-d32e-4fa2-8d75-dc19ea7ae8bf"><enum>(A)</enum><text display-inline="yes-display-inline">the number of requests under such section the Commission received during the most recent fiscal year;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida1050e52-3424-44e4-aee1-7395cf6e4d92"><enum>(B)</enum><text display-inline="yes-display-inline">the number of requests described in subparagraph (A) granted and denied;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2c1722fc-59ab-4377-b45e-85facb6dd1a7"><enum>(C)</enum><text display-inline="yes-display-inline">a comparison of the processing of requests described in subparagraph (A) by the Commission during a period of not less than the 3 preceding fiscal years; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc1bd8f85-15b6-4ce5-9d7f-bb8c0f13675c"><enum>(D)</enum><text display-inline="yes-display-inline">a comparison of the results of the Commission in processing requests described in subparagraph (A) with the most recent average for the United States Government as published on www.foia.gov.</text>
 </subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idd8720cf0-5195-4626-b582-0df004b784f6"><enum>(i)</enum><header display-inline="yes-display-inline">Prompt release of statistical reports and reports to congress</header><text display-inline="yes-display-inline">Not later than January 15 of each year, the Commission shall identify, catalog, and publish an anticipated release schedule for all statistical reports and reports to Congress that are regularly or intermittently released by the Commission and will be released during the year.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="id30915892-cb9e-4e4c-ad8a-4aafaa124ab4"><enum>(j)</enum><header display-inline="yes-display-inline">Annual score card reports</header>
 <paragraph commented="no" display-inline="no-display-inline" id="id25cab69e-53de-4a76-9b71-77d42f5c6edc"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">For the 1-year period beginning on January 1 of each year, the Commission shall prepare a report on the performance of the Commission in conducting proceedings and meeting the guidelines established under subsection (b)(2)(E).</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb4c48bc6-80e3-4f14-8ddf-fbaca996fe63"><enum>(2)</enum><header display-inline="yes-display-inline">Contents</header><text display-inline="yes-display-inline">Each report required under paragraph (1) shall contain detailed statistics on the performance of the Commission as described in paragraph (1), including, with respect to each bureau or office of the Commission—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="idaa4e61c5-f8d9-4e7d-8707-989ec400e882"><enum>(A)</enum><text display-inline="yes-display-inline">with respect to each type of filing specified in subsection (b)(2)(E)—</text> <clause commented="no" display-inline="no-display-inline" id="id7b6b718a-bc8d-4502-9a22-e396d55b586a"><enum>(i)</enum><text display-inline="yes-display-inline">the number of filings that were pending on the last day of the period covered by the report;</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id2c126eba-de7b-40f3-8f83-f75add76b261"><enum>(ii)</enum><text display-inline="yes-display-inline">the number of filings described in clause (i) for which each applicable deadline or guideline established under such subsection was not met and the average length of time those filings have been pending; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id41241b31-2aa4-4b3b-9811-bbfc635c9df8"><enum>(iii)</enum><text display-inline="yes-display-inline">for filings that were resolved during the period covered by the report, the average time between initiation and resolution and the percentage for which each applicable deadline or guideline established under such subsection was met;</text>
 </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id40abeffb-08d6-483a-ba22-04b73d04810d"><enum>(B)</enum><text display-inline="yes-display-inline">with respect to proceedings before an administrative law judge—</text> <clause commented="no" display-inline="no-display-inline" id="idb1295ca8-fffd-4d19-a9bf-d38c2b739d69"><enum>(i)</enum><text display-inline="yes-display-inline">the number of proceedings completed during the period covered by the report; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="idf52bf905-eb9d-4226-8de7-47629b787261"><enum>(ii)</enum><text display-inline="yes-display-inline">the number of proceedings pending on the last day of the period covered by the report; and</text> </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3f88aaa0-e6ae-4586-aa61-bb76e3ccc37c"><enum>(C)</enum><text display-inline="yes-display-inline">the number of independent studies or analyses published by the Commission during the period covered by the report.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0c39365e-251a-4c06-af6c-387af73972e2"><enum>(3)</enum><header display-inline="yes-display-inline">Publication and submission</header><text display-inline="yes-display-inline">The Commission shall publish and submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce Science, and Transportation of the Senate each report required under paragraph (1) not later than the date that is 30 days after the last day of the period covered by the report.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id88248724-7b6a-4d28-95d0-62958b5a1807"><enum>(b)</enum><header display-inline="yes-display-inline">Effective dates and implementing rules</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id270cc9f2-6801-4723-bd78-c4c1c82f6bc2"><enum>(1)</enum><header display-inline="yes-display-inline">Effective dates</header>
 <subparagraph commented="no" display-inline="no-display-inline" id="idcb071665-8c4e-403b-847d-34b57461d3a6"><enum>(A)</enum><header display-inline="yes-display-inline">Nonpublic collaborative discussions</header><text display-inline="yes-display-inline">Subsection (d) of section 13 of the Communications Act of 1934, as added by subsection (a), shall apply beginning on the first date on which all of the procedural changes to the rules of the Federal Communications Commission required under subsection (b)(1) of such section have taken effect.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1ff1323c-4003-4598-8ddd-df213224794d"><enum>(B)</enum><header display-inline="yes-display-inline">Schedules and reports</header><text display-inline="yes-display-inline">Subsection (j) of section 13 of the Communications Act of 1934, as added by subsection (a), shall apply with respect to 2015 and any year thereafter.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf915ae50-1809-4579-98e7-8890a46a8f24"><enum>(2)</enum><header display-inline="yes-display-inline">Rules</header><text display-inline="yes-display-inline">Except as otherwise provided in section 13 of the Communications Act of 1934, as added by subsection (a), the Federal Communications Commission shall promulgate any rules necessary to carry out such section not later than 1 year after the date of enactment of this Act.</text>
 </paragraph></subsection></section><section changed="added" commented="no" committee-id="SSCM00" display-inline="no-display-inline" id="id284a55f9-e820-4315-b853-da2ab016a51c" reported-display-style="italic" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Categorization of TCPA inquiries and complaints in quarterly report</header><text display-inline="no-display-inline">In compiling its quarterly report with respect to informal consumer inquiries and complaints, the Federal Communications Commission may not categorize an inquiry or complaint with respect to section 227 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227</external-xref>) as being a wireline inquiry or complaint or a wireless inquiry or complaint unless the party whose conduct is the subject of the inquiry or complaint is a wireline carrier or a wireless carrier, respectively.</text>
 </section><section changed="added" commented="no" committee-id="SSCM00" display-inline="no-display-inline" id="id4ef5ad50-2e52-446d-a7fc-6d470bff88c2" reported-display-style="italic" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Effect on other laws</header><text display-inline="no-display-inline">Nothing in this Act or the amendments made by this Act shall relieve the Federal Communications Commission from any obligations under title 5, United States Code, except where otherwise expressly provided.</text>
 </section><section changed="added" commented="no" committee-id="SSCM00" display-inline="no-display-inline" id="id3149817d-3a49-4eb9-a4f8-31825f78627f" reported-display-style="italic" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Provision of emergency weather information; communications of first responders</header><text display-inline="no-display-inline">Nothing in this Act or the amendments made by this Act shall be construed to impede the Federal Communications Commission from acting in times of emergency to ensure the availability of efficient and effective communications systems—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="idbc5a397e-d2b3-4b9a-9e5c-74889c38d1bb"><enum>(1)</enum><text display-inline="yes-display-inline">to alert the public to imminent dangerous weather conditions; or</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id43623b1c-df3c-425a-8b7e-0c10fb366f6c"><enum>(2)</enum><text display-inline="yes-display-inline">for State and local first responders.</text></paragraph></section></legis-body><endorsement><action-date>December 6, 2016</action-date><action-desc>Reported with an amendment</action-desc></endorsement></bill>
