			 the Department of Justice that use such funds for pretrial services
			 programs to submit to the Attorney General a report relating to such
			 programs, and for other purposes.</official-title></form>
	<legis-body display-enacting-clause="yes-display-enacting-clause" id="HD1E4694F048C41F3BD40B39732B68FA5" style="OLC">
 <section id="HFA07AAF48B764D819A974883E1BA4A2E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Citizens’ Right to Know Act of 2016</short-title></quote>.</text> </section><section id="HFF88475889DA4A9DA9D789BA2F4DBB58"><enum>2.</enum><header>Reporting requirement for Department of Justice grant recipients using funds for pretrial services programs</header> <subsection id="H2BA77735677E46F7B5678F096B672B8F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">For each fiscal year in which a State or unit of local government receives funds under any grant program operated by the Department of Justice, including the Edward Byrne Memorial Justice Assistance grant program under subpart I of part E of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3750">42 U.S.C. 3750 et seq.</external-xref>), and in which the State or unit of local government uses funds received under such program for a pretrial services program, the State or unit of local government shall submit to the Attorney General a report which contains the following:</text>
 <paragraph id="H03F5EE6BBD644B798CC4927FD8DBD59C"><enum>(1)</enum><text>The name of each defendant participating in a pretrial release program administered by the pretrial services program, and whether, as applicable, the defendant appeared for trial and any post-release required court appearance.</text>
 </paragraph><paragraph id="HFE8159BF74E14929BB7260174EE05B9C"><enum>(2)</enum><text>Information relating to the previous arrest record of each defendant participating in the pretrial services program.</text>
 </paragraph><paragraph id="id23A94BFA51474993B9E1DFD29FCAD5B3"><enum>(3)</enum><text>Information relating to any previous failure by each defendant participating in a pretrial release program administered by the pretrial services program to appear for trial or any post-release required court appearance.</text>
 </paragraph><paragraph id="id416F0FBC50564E07A97AD9EE0281C516"><enum>(4)</enum><text>The amount of Federal funds the pretrial services program received during the previous fiscal year.</text> </paragraph></subsection><subsection id="H88FCA85D42AC4C80BC3552A0FBE34637"><enum>(b)</enum><header>Publication requirement</header><text>Subject to any applicable confidentiality requirements, the Attorney General shall, on an annual basis, make publicly available the information received under subsection (a).</text>
 </subsection><subsection id="H74FEE249FC7C4EA8AA35B0457186F313"><enum>(c)</enum><header>Reduction in funding</header><text>If a State or unit of local government fails to comply with the requirement under subsection (a) for a fiscal year, the Attorney General shall reduce the amount that the State or unit of local government would otherwise receive under each grant program described in subsection (a) in the following fiscal year—</text>
 <paragraph id="H77D2825FCF564D898FB9BC4DAE1C845D"><enum>(1)</enum><text>by 10 percent, if the failure to comply with the requirement was the first such failure; or</text> </paragraph><paragraph id="HD5DDEB4537434AADB9B7132052424E12"><enum>(2)</enum><text>by 20 percent, if the failure to comply with the requirement was the second or subsequent such failure.</text>
 </paragraph></subsection><subsection id="H02D2E72907084675A3B022F2A18FD20D"><enum>(d)</enum><header>Reallocation</header><text>Amounts not allocated to a State or unit of local government under subsection (c) shall be reallocated under each such grant program to States and units of local government that comply with the requirement under subsection (a).</text></subsection></section></legis-body></bill>
