 <section id="idC14ADE76164144A69B777A3596076184" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Paperwork Reduction for Farmers Act</short-title></quote>.</text> </section><section id="id792CEC37B96C4457A6675D4B3232546F" section-type="subsequent-section"><enum>2.</enum><header>H–2A workers</header> <subsection id="idE6DCE963E26C4471B65E3BAEC8626FE8"><enum>(a)</enum><header>Joint application; period of authorized admission</header><text>Section 214(c)(1) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(c)(1)</external-xref>) is amended—</text>
 <paragraph id="id1D65921F9AD14A36B00A9CA6089AC780"><enum>(1)</enum><text>by inserting <quote>(A)</quote> after <quote>(1)</quote>;</text> </paragraph><paragraph id="id917259E7D4A142B08632066E479DD718"><enum>(2)</enum><text>by striking <quote>Attorney General</quote> each place such term appears and inserting <quote>Director of U.S. Citizenship and Immigration Services</quote>;</text>
 </paragraph><paragraph id="id2DF17F43D449472E96A38FC7873D4DC9"><enum>(3)</enum><text>by striking <quote>For purposes</quote> and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="idCF23C4370C9640B0BFF2C60772BEEDA5" style="OLC"> <subparagraph id="id25E98918C56F4A948E3091235AF226A2" indent="up2"><enum>(B)</enum><text>For purposes</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="idD914A0459C3542B3B62AD416785B89B5"><enum>(4)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="id8CA365A3C1FF442595A2FD466D6EB271" style="OLC"> <subparagraph id="idD410B37AF25E43F29DD5C8D91929097D" indent="up2"><enum>(C)</enum><text>Multiple employers may submit a joint petition under subparagraph (A) to import aliens as nonimmigrants described in section 101(a)(15)(H)(ii)(a). Upon the approval of such petition, each joint employer shall be subject to the provisions under section 218 with respect to each alien listed in such petition.</text>
 </subparagraph><subparagraph id="idB56AF50BEB054B54AF81E335AF74608A" indent="up2"><enum>(D)</enum><text>The period of authorized admission for a nonimmigrant described in section 101(a)(15)(H)(ii)(a) may not exceed the shorter of—</text>
 <clause id="idC2392242F69F43F995F1D4C574F3A675"><enum>(i)</enum><text>the period for which a petitioner under this paragraph has contracted to employ such nonimmigrant; or</text>
 </clause><clause id="idE8E1FAACB1D0484CA19CD47DB57CA980"><enum>(ii)</enum><text>three years.</text> </clause></subparagraph><subparagraph id="idCBBB9FB922C4401E8FA607A32B0BAB52" indent="up2"><enum>(E)</enum><text>If a petition to import aliens as nonimmigrants described in section 101(a)(15)(H)(ii)(a) is denied or if the issuance of visas requested through such petition is delayed due to a problem with the petition, the Director shall promptly notify the petitioner of the reasons for such denial or delay and provide the petitioner with reasonable time to remedy the problem.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="id35E18E6F75FD4279BE0D93284A87DA7A"><enum>(b)</enum><header>Labor certification; staggered employment dates</header><text display-inline="yes-display-inline">Section 218(h) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1188">8 U.S.C. 1188(h)</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id0DDBF6205FC447B9ACC354C4C09D76FC" style="OLC">
 <paragraph id="idC5F764F80D50433C85AAB6EB1CF61B19" indent="up1"><enum>(3)</enum><text>An employer that is seeking to rehire aliens as H–2A workers who previously worked for the employer as H–2A workers at any time during the most recent 12-month period may submit a simplified petition, to be developed by the Director of U.S. Citizenship and Immigration Services, in consultation with the Secretary of Labor, which shall include a certification that the employer maintains compliance with all applicable requirements with respect to the employment of such aliens. Such petitions shall be approved upon completion of applicable security screenings.</text>
 </paragraph><paragraph id="idCFAE62745997449795E4837980DA00D1" indent="up1"><enum>(4)</enum><text>An employer that is seeking to hire aliens as H–2A workers during different time periods in a given fiscal year may submit a single petition to U.S. Citizenship and Immigration Services that details the time period during which each such alien is expected to be employed.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection></section><section id="id305F46547C9D41CCA0458D2E08B42D2F" section-type="subsequent-section"><enum>3.</enum><header>Option for electronic requests for evidence</header><text display-inline="no-display-inline">Section 218(h) of the Immigration and Nationality Act, as amended by section 2, is further amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="idE70CC5B80A3648399325FB44FDE55FAD" style="OLC">
 <paragraph id="id26E8813C4FD04AE9AE37FC5496253031" indent="up1"><enum>(5)</enum><text>If U.S. Citizenship and Immigration Services issues a Request for Evidence to an employer—</text> <subparagraph id="id960C4F523C334508BDB3AAFAAC3F8F6F"><enum>(A)</enum><text>the employer may request that U.S. Citizenship and Immigration Services deliver such Request for Evidence in an online format; and</text>
 </subparagraph><subparagraph id="id2A864DAC06034BDF98777879A10526DE"><enum>(B)</enum><text>if the employer makes such a request—</text> <clause id="id683DAAF89CA146F5A1FD13CC30794885"><enum>(i)</enum><text>the Request for Evidence shall be provided in an online format; and</text>
 </clause><clause id="idF8764B4FC5694F8A9184C352699C08F9"><enum>(ii)</enum><text>not later than three business days after the employer submits the requested evidence online, U.S. Citizenship and Immigration Services shall provide to the employer—</text>
 <subclause id="idA05DFF540BD4475EA027B4C2FED7991D"><enum>(I)</enum><text>an online response that indicates the submitted evidence is sufficient; or</text> </subclause><subclause id="idEF6BA2437C1248B3A7F95E11F3FB480B"><enum>(II)</enum><text>an online response that explains the reasons such evidence is not sufficient and an opportunity for the employer to address any such deficiency.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
