		<section id="id3B7E4EBAD1AA4983B2ACC07679919510" section-type="section-one"><enum>1.</enum><header>Patterson Lake land conveyances</header>
 <subsection id="id255944a05ac8445693187f30e3044560"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="idedf70ccacd464e3abbd21ae06d7df654"><enum>(1)</enum><header>Department</header><text>The term <term>Department</term> means Dickinson Parks &amp; Recreation in Dickinson, North Dakota (or a successor in interest to that entity).</text>
 </paragraph><paragraph id="ide50569c4a08d441eb0a2ff19e161d9ca"><enum>(2)</enum><header>Dickinson Reservoir</header><text>The term <term><quote>Dickinson Reservoir</quote></term> means the Dickinson Reservoir constructed as part of the Dickinson Unit, Heart Division, Pick-Sloan Missouri Basin Program, as authorized by section 9 of the Act of December 22, 1944 (commonly known as the <quote>Flood Control Act of 1944</quote>) (58 Stat. 891, chapter 665).</text>
 </paragraph><paragraph id="id024e52db86304555a576cb7f685b5225"><enum>(3)</enum><header>Permittee</header><text>The term <term>permittee</term> means the holder of a permit for a property.</text> </paragraph><paragraph id="id53a8de531e7847378af8f42b5e2fa918"><enum>(4)</enum><header>Property</header><text>The term <term>property</term> means any one of the cabin sites located on Federal property around the Dickinson Reservoir for which a permit is in effect on the date of enactment of this Act.</text>
 </paragraph><paragraph id="idfca629efcd694ee699fc8fe5818f9294"><enum>(5)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior, acting through the Commissioner of Reclamation.</text> </paragraph></subsection><subsection id="id5d7f75d9ab3b4122b57f7de7628a4228"><enum>(b)</enum><header>Purchase of property by permittee; transfers to Department</header> <paragraph id="idefa8babea5e8420cad8efb8c463b8584"><enum>(1)</enum><header>Option</header><text>The Secretary shall provide to the permittee of a property the first option to purchase that property for fair market value in accordance with paragraph (2).</text>
				</paragraph><paragraph id="id98597ced24c14859a65f39ce60d6685a"><enum>(2)</enum><header>Purchase</header>
 <subparagraph id="id3ab72dc8d939448a9ec3a567b02db31a"><enum>(A)</enum><header>In general</header><text>On an election by a permittee to exercise the option to purchase a property pursuant to paragraph (1), the Secretary shall convey to the permittee, for fair market value—</text>
 <clause id="idcf0f35c26be84c0185ef5af0660667a0"><enum>(i)</enum><text>all right, title, and interest of the United States in and to the property, subject to valid existing rights; and</text>
 </clause><clause id="id536ce489c59e40a0a2bdc987686a0249"><enum>(ii)</enum><text>easements for—</text> <subclause id="id3a36c7956df74936b871bea00b699135"><enum>(I)</enum><text>vehicular access to the property;</text>
 </subclause><subclause id="id4a109740d8194a3b998da6a60d5bbef5"><enum>(II)</enum><text>access to, and use of, a dock for the property; and</text> </subclause><subclause id="idf9132470c68149a4b0bdaf9b6fb46f32"><enum>(III)</enum><text>access to, and use of, all boathouses, ramps, retaining walls, and other improvements for which access is provided in the permit for use of the property as of the date of enactment of this Act.</text>
 </subclause></clause></subparagraph><subparagraph id="id62cd296d81ec4dc49e6de83613256745"><enum>(B)</enum><header>Period for conveyance</header><text>The Secretary shall convey to a permittee a property pursuant to subparagraph (A) during the period—</text>
 <clause id="id92fe36a387fb4189a4a4088f63b02729"><enum>(i)</enum><text>beginning on the date that is 1 year after the date of enactment of this Act; and</text> </clause><clause id="id47e6e0f05e974a54b7262b7156c0c527"><enum>(ii)</enum><text>ending on the date that is 2 years after that date of enactment.</text>
 </clause></subparagraph><subparagraph id="idceaeff261f834a79ac44883b893ec68e"><enum>(C)</enum><header>Disputes regarding fair market value</header><text>Any dispute regarding the fair market value of a property shall be resolved in accordance with section 2201.4 of title 43, Code of Federal Regulations (or successor regulations).</text>
					</subparagraph></paragraph><paragraph id="idd06e6e995e50423bade010ccee0ee50f"><enum>(3)</enum><header>Transfers to Department</header>
 <subparagraph id="idcbd6bdb41bdc4c848f017cd127ac775d"><enum>(A)</enum><header>Failure to purchase</header><text>If a permittee fails to exercise the option to purchase a property under paragraph (2) by the date that is 2 years after the date of enactment of this Act, the Secretary shall transfer the property to the Department, without cost.</text>
 </subparagraph><subparagraph id="id74694d578009438fb28f561285757f3a"><enum>(B)</enum><header>Certain other land</header><text>Effective beginning on the date that is 2 years after the date of enactment of this Act, the Secretary shall transfer to the Department, without cost, land managed by the Department as of the date of enactment, on which no cabin is located.</text>
 </subparagraph></paragraph></subsection><subsection id="ide39a79ed0bd645a7af8ee907bdd1a6bb"><enum>(c)</enum><header>Oil, gas, mineral, and other outstanding rights</header><text>Each conveyance to a permittee, and each transfer to the Department, pursuant to subsection (b) shall be made subject to—</text>
 <paragraph id="id89e3258301944257b68a186d8194eb68"><enum>(1)</enum><text>oil, gas, and other mineral rights reserved of record, as of the date of enactment of this Act, by, or in favor of, a third party; and</text>
 </paragraph><paragraph id="id10a700c5f6374486bec06e6dfbd80113"><enum>(2)</enum><text>any permit, license, lease, right-of-use, or right-of-way of record in, on, over, or across the applicable property or land that is outstanding to a third party as of the date of enactment of this Act.</text>
				</paragraph></subsection><subsection id="id27173816a9d24cbaad564afed4eec5a6"><enum>(d)</enum><header>Liability; taking</header>
 <paragraph id="id8e96d5597dd74478b0fe9d4d27db6c59"><enum>(1)</enum><header>Liability</header><text>The United States shall not be liable for flood damage to the personal property of a permittee or for damages arising out of any act, omission, or occurrence relating to a lot to which a permit applies, other than for damages caused by an act or omission of the United States or an employee, agent, or contractor of the United States before the date of enactment of this Act.</text>
 </paragraph><paragraph id="idab2cc04773774bb1806971b496b0f821"><enum>(2)</enum><header>Taking</header><text>Any temporary flooding or flood damage to the personal property of a permittee shall not be considered to be a taking by the United States.</text>
				</paragraph></subsection><subsection id="id8724c35865ca449bba3502390cdae581"><enum>(e)</enum><header>Requirements relating to conveyances and transfers</header>
 <paragraph id="id31350fe4b5ad47998702361de27aea92"><enum>(1)</enum><header>Interim requirements</header><text>During the period beginning on the date of enactment of this Act and ending on the date of conveyance or transfer of a property or land, the provisions of the document entitled <quote>Management Agreement between the Bureau of Reclamation, et al., for the Development, Management, Operation, and Maintenance of Lands and Recreation Facilities at Dickinson Reservoir</quote> that are applicable to the property or land shall remain in force and effect.</text>
 </paragraph><paragraph id="idde5ace85899644508b5ee56abaa846c4"><enum>(2)</enum><header>Legal descriptions</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary, in consultation with the Department, shall provide to the Department a legal description of all properties and land that may be conveyed or transferred pursuant to this section.</text>
 </paragraph><paragraph id="id5d3d06d533f14810be527aed80f9058e"><enum>(3)</enum><header>Restriction on conveyance</header><text>Effective beginning on the date of enactment of this Act—</text> <subparagraph id="idB216F982506641439AC3F77504F13E28"><enum>(A)</enum><text>a permittee may not build any new permanent structure below an elevation of 2,430 feet; and</text>
 </subparagraph><subparagraph id="idC1722B735BDA459EB4A2836706D8DEE0"><enum>(B)</enum><text>if a permittee builds a structure described in subparagraph (A), the property of the permittee shall revert to the Department.</text>
 </subparagraph></paragraph></subsection><subsection id="id21b9df940e6a4e919be7b495760020b8"><enum>(f)</enum><header>Proceeds from sales of Federal land</header><text>Any revenues from a sale of Federal land pursuant to this section shall be made available to the Secretary, without further appropriation, for—</text>
 <paragraph id="id97721de229914627bb051b208bcd6a43"><enum>(1)</enum><text>the costs to the Secretary of carrying out this section; and</text> </paragraph><paragraph id="id3021f57694bc4a6a9624577efdc5b0bb"><enum>(2)</enum><text>deferred maintenance activities relating to the operation of the dam in the Dickinson Reservoir.</text></paragraph></subsection></section></legis-body>
