			 Protection Agency to take action to eliminate human exposure to asbestos,
			 and for other purposes. </official-title></form>
	<legis-body display-enacting-clause="yes-display-enacting-clause">
 <section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Alan Reinstein Ban Asbestos Now Act of 2016</short-title></quote>.</text>
		</section><section id="id49b7a6e9a98a4f7e95969a9a91004a9a"><enum>2.</enum><header>Asbestos ban</header>
 <subsection id="id566432C9A0AE47B3826AF70927F53A64"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2601">15 U.S.C. 2601 et seq.</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id39FFFE33CEF741418A871C4A97B6C05D" style="OLC">
					<title id="idDDCBA1940788475E91CB90B373C82845" style="OLC"><enum>VII</enum><header>Asbestos</header>
 <section id="id91112aaeb363473c95e404d8fae3f0e2"><enum>701.</enum><header>Definition of asbestos</header><text display-inline="no-display-inline">In this title, the term <term>asbestos</term> means all forms of asbestos.</text> </section><section id="id53C783CA323648CFB09CFB2A474B7080"><enum>702.</enum><header>Elimination of asbestos exposure</header> <subsection id="id9aaac991ab544ba38791dde53f713d19"><enum>(a)</enum><header>Importation, use, and exposure assessment</header><text>Notwithstanding any other provision of this Act, not later than 90 days after the date of enactment of the <short-title>Alan Reinstein Ban Asbestos Now Act of 2016</short-title>, the Administrator shall carry out and publish an identification and assessment of the current and reasonably anticipated importation, distribution in commerce, and uses of, and exposures to, asbestos.</text>
							</subsection><subsection id="id7184115014d9409d82aaeec0c37319ec"><enum>(b)</enum><header>Exposure elimination</header>
 <paragraph id="idE804CDDE938E405C86AE39F367B0CC85"><enum>(1)</enum><header>In general</header><text>As soon as practicable, but not later than 18 months after the date of enactment of the <short-title>Alan Reinstein Ban Asbestos Now Act of 2016</short-title>, the Administrator shall impose, by rule, prohibitions, restrictions, and other conditions, including prohibitions on the manufacture, processing, use, distribution in commerce, and disposal of asbestos and mixtures and articles containing asbestos, that the Administrator determines to be necessary to eliminate human or environmental exposure to asbestos.</text>
 </paragraph><paragraph id="id7AC7C32CB6FE4E619330BDA9DC1BF14E"><enum>(2)</enum><header>Selection of conditions</header><text>In imposing prohibitions and other conditions under paragraph (1), the Administrator shall select requirements that permanently eliminate the possibility of exposure to asbestos.</text>
								</paragraph></subsection><subsection id="id44c8f12f20894818bb50c4eb7aa0fe06"><enum>(c)</enum><header>Timing of exposure reductions</header>
 <paragraph id="id6546BDDC3DFD4F4FA240B3F583A9FE3E"><enum>(1)</enum><header>In general</header><text>Except as provided in an exemption granted by the President under subsection (d), beginning on the date that is 1 year after the date on which the Administrator issues the rule described in subsection (b)(1), no person shall manufacture, process, use, distribute in commerce, or dispose of any form of asbestos or any mixture or article containing any form of asbestos for any use or under any condition other than a use or condition described in that rule.</text>
 </paragraph><paragraph id="idBA768DD954AC493E9C8B90405856E518"><enum>(2)</enum><header>Effective date</header><text>In any rule issued under this title, the Administrator shall specify the date on which any prohibition, restriction, or other condition shall take effect, and that date shall be as soon as practicable, but not later than 1 year, after the date of promulgation of the rule.</text>
								</paragraph></subsection><subsection id="idA3A1FB8F8E4E4B93A5FE3FDDD8222AD9"><enum>(d)</enum><header>Exemption for national security reasons</header>
 <paragraph id="id301F982048D743548D1FA3112E58520C"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of this title, the President may grant an exemption from the requirements of this section for any use of asbestos if the President determines that—</text>
 <subparagraph id="id40EB023C8EC4477E94B4F4C9A99F34BA"><enum>(A)</enum><text>the use of asbestos is necessary to protect the national security interests of the United States;</text> </subparagraph><subparagraph id="iddcc0fc7ca23447f38615fef1b69fabf3"><enum>(B)</enum><text>no reasonable alternative to the asbestos use exists for the intended purpose; and</text>
 </subparagraph><subparagraph id="id815829ddc4524bf4a079a02fceeb1da7"><enum>(C)</enum><text>the use of asbestos will not result in an unreasonable risk to health or the environment (without consideration of costs or other nonrisk factors), including an unreasonable risk to a potentially exposed or susceptible subpopulation identified as relevant by the Administrator under the conditions of use.</text>
 </subparagraph></paragraph><paragraph id="idDE2D76B4C6544202A3B21966B4DB0512"><enum>(2)</enum><header>Terms and conditions</header><text>An exemption under paragraph (1) shall be subject to such terms and conditions as the President may prescribe.</text>
								</paragraph><paragraph id="id7E115B3DF778468EBFA66126FFA8DF3C"><enum>(3)</enum><header>Duration</header>
 <subparagraph id="id6089375DB98D4C3C8BF669FBD7768891"><enum>(A)</enum><header>In general</header><text>The duration of an exemption under paragraph (1) shall not exceed a period of 3 years.</text> </subparagraph><subparagraph id="id83FFAE50C78F493E9CBBD713EE0165DC"><enum>(B)</enum><header>Additional exemption</header><text>The President may grant an additional exemption under paragraph (1), for a period of not to exceed 3 years, by making a new determination under that paragraph.</text>
									</subparagraph></paragraph></subsection></section></title><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="idC72078E5E9AB4E1982DDEE5CA3BF466E"><enum>(b)</enum><header>Conforming amendment</header><text>The table of contents for the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2601">15 U.S.C. 2601 et seq.</external-xref>) is amended by adding at the end the following:</text>
