		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Rural Disaster Recovery Act of 2016</short-title></quote>.</text>
		</section><section id="idC3096FC3AF054420B8E605AEB8F57D13"><enum>2.</enum><header>State individual assistance programs</header>
 <text display-inline="no-display-inline">Title III of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5141">42 U.S.C. 5141 et seq.</external-xref>) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="ida6369427f1ac43519df081de68a4c7e7" style="OLC">
				<section id="id533b8ea0b90e4a5894a4ed373aa36cc1"><enum>327.</enum><header>State individual assistance programs</header>
 <subsection id="id9ea227187f4244b2a3b2b9340f7af14f"><enum>(a)</enum><header>Incentive for individual assistance programs</header><text>A State may receive an increased Federal share for financial assistance under subsection (c) if the State develops and implements an individual assistance program that authorizes the State government to provide financial assistance, and if necessary, direct services, to individuals and households in the State who, as a direct result of a major disaster or an event that does not trigger a major disaster declaration, have necessary expenses and serious needs in cases in which the individuals and households are unable to meet such expenses through other means.</text>
					</subsection><subsection id="id838dfff9ba3e466189936643039fda42"><enum>(b)</enum><header>Eligibility criteria</header>
 <paragraph id="idfa88b6ed6fc44502a46c4cfca57728a2"><enum>(1)</enum><header>In general</header><text>The Administrator of the Federal Emergency Management Agency shall publish minimum eligibility criteria for a State individual assistance program established under subsection (a) that receives an increased Federal share for financial assistance under subsection (c).</text>
 </paragraph><paragraph id="ide22f0ae5e9104ecca6ad2c9d11b7eb03"><enum>(2)</enum><header>Considerations</header><text>In formulating the minimum eligibility criteria required under paragraph (1), the Administrator of the Federal Emergency Management Agency shall consider—</text>
 <subparagraph id="id561de7e2efac474cb891d63bb757eea2"><enum>(A)</enum><text>the total taxable resources of the individual State or other measure of fiscal capacity, as appropriate;</text>
 </subparagraph><subparagraph id="id3d440dd584024565b0b642bb9d7198fc"><enum>(B)</enum><text>the variation of total taxable resources, or other measures of fiscal capacity, among the individual State; and</text>
 </subparagraph><subparagraph id="id5ff4b30568d34ef2a28dd015af94f813"><enum>(C)</enum><text>the historical frequency of declarations made pursuant to sections 401 and 501.</text> </subparagraph></paragraph><paragraph id="id43dff759fa53436487ad281d9327d360"><enum>(3)</enum><header>Publication deadline</header><text>The Administrator of the Federal Emergency Management Agency shall publish—</text>
 <subparagraph id="iddeefa770217a4a29a8f19ef5b422a358"><enum>(A)</enum><text>interim minimum eligibility criteria required under paragraph (1) not later than 180 days after the date of enactment of this section; and</text>
 </subparagraph><subparagraph id="id5072a5cab0264e62803dc925475bbb76"><enum>(B)</enum><text>final minimum eligibility criteria required under paragraph (1) not later than 1 year after the date of enactment of this section.</text>
 </subparagraph></paragraph></subsection><subsection id="id8ac0719829b1423b80c345572e26218c"><enum>(c)</enum><header>Increased federal share for financial assistance to individuals and households</header><text>If, at the time of the declaration of a major disaster, a State has in effect an individual assistance program that meets the criteria published under subsection (b), the President may increase to 100 percent, with respect to the major disaster, the maximum percentage described in section 408(g)(2)(A).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="id1E1374CCA5A346B6B4084E4A736807FC"><enum>3.</enum><header>Community shelter assistance program</header>
 <subsection id="idADF6DF3628E14D5D8A4DC3A8D22D3F4E"><enum>(a)</enum><header>In general</header><text>Title III of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11331">42 U.S.C. 11331 et seq.</external-xref>) is amended—</text> <paragraph id="id4B9B3C1C88AB4CF382EF3CB841CC2EB0"><enum>(1)</enum><text>by striking section 322 and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="id189BB202CD624F3593A1D664D5CD73F7" style="OLC">
						<section id="id53202F6375E64C7D9B8593929904B377"><enum>322.</enum><header>Authorization of appropriations</header>
 <subsection id="id12F3029CB2CE44B9B6D2F3BC872C83B7"><enum>(a)</enum><header>Emergency food and shelter grants</header><text>There is authorized to be appropriated to carry out subtitle B $180,000,000 for fiscal year 2017.</text> </subsection><subsection id="id637F9C9E6CFF4357ACB653354E647C40"><enum>(b)</enum><header>Disaster supplemental food and shelter grants</header><text>There is authorized to be appropriated to carry out subtitle D $180,000,000 for fiscal year 2017.</text></subsection></section><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="id767EE5486A6D459890AF08EC9E07FC9B"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="id7B50C27225A142DB9D487D80E7D1BF3B" style="OLC"> <subtitle id="id3FB0526E7C9146C99932FD16EA15F85E" style="OLC"><enum>D</enum><header>Disaster sup­ple­men­tal food and shelter grants</header> <section id="id0616EB7604A4414B9933D362FA5B9B79"><enum>331.</enum><header>Grants by the Administrator</header><text display-inline="no-display-inline">Not later than 30 days after the date on which amounts become available to carry out this subtitle, the Administrator of the Federal Emergency Management Agency (referred to in this subtitle as the <term>Administrator</term>) shall award a grant for the full amount that Congress makes available for the program under this subtitle to the National Board for the purpose of providing disaster supplemental food and shelter grants to needy individuals through private nonprofit organizations and local governments in accordance with section 333.</text>
							</section><section id="id1C67FCD902CD40DEA107B1BCAF27BD77"><enum>332.</enum><header>Retention of interest earned</header>
 <subsection id="idD0F09811B3C54F719D796DF425A73636"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Interest accrued on the balance of any grant to the National Board under this subtitle shall be available to the National Board for reallocation.</text>
 </subsection><subsection id="id192DB91C12C94BD59F3F31984C7EDB3B"><enum>(b)</enum><header>Determination of costs</header><text display-inline="yes-display-inline">Total administrative costs shall be determined based on the total amount of funds available, including interest and any private contributions that are made to the National Board.</text>
								</subsection></section><section id="idCC3719A48A5E4B2BA97FC4F3DD0CE00B"><enum>333.</enum><header>Purposes of grants</header>
 <subsection id="id38A7BE997E1646FE92ECB390710CED6C"><enum>(a)</enum><header>Eligible activities</header><text>Grants to the National Board under this subtitle may be used—</text> <paragraph id="id8717df16d2284074ab374968f56add7f"><enum>(1)</enum><text>to supplement and expand ongoing efforts to provide shelter, food, and supportive services for any area for which the President declares a major disaster under section 401 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>);</text>
 </paragraph><paragraph id="id722B66B45D6049B1B0C4FBB5918CD2F1"><enum>(2)</enum><text>to strengthen efforts to create more effective and innovative local disaster response programs by providing funding for those programs; and</text>
 </paragraph><paragraph id="id207716DFAE98429D97A358A69F126FA8"><enum>(3)</enum><text>to conduct minimum rehabilitation of existing mass shelter facilities, but only to the extent necessary to make facilities safe, sanitary, and bring facilities into compliance with local building codes.</text>
									</paragraph></subsection><subsection id="id060124C77A06460E881420B4D2CEF477"><enum>(b)</enum><header>Limitations on activities</header>
 <paragraph id="id27713600F1264D6B9B208D5475EDFAE6"><enum>(1)</enum><header>Eligible programs</header><text>The National Board may only provide funding provided under this subtitle for programs that are—</text> <subparagraph id="id0E48F21EB4C645CD97A051D5568A56CF"><enum>(A)</enum><text>carried out by private nonprofit organizations and local governments;</text>
 </subparagraph><subparagraph id="id6122F49AD03440EFAD8BEB65CFA80FC7"><enum>(B)</enum><text>consistent with the purposes of this title; and</text> </subparagraph><subparagraph id="id19289590E3144A1D81E8CDE3BC3A95B8"><enum>(C)</enum><text>administered within an area for which—</text>
 <clause id="idB02B3FC7BA8347D4B715E7D46036A6F7"><enum>(i)</enum><text>the President declared a major disaster under section 401 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>) during the 12-month period immediately preceding the grant; and</text>
 </clause><clause id="idCCE6EA44BDEF47E0BAD15A218CF34682"><enum>(ii)</enum><text>assistance has not been provided with respect to the major disaster under section 408 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5174">42 U.S.C. 5174</external-xref>).</text>
 </clause></subparagraph></paragraph><paragraph id="idB16523899E6D463EB786020E78E80DB9"><enum>(2)</enum><header>National Board</header><text>The National Board may not carry out programs directly.</text> </paragraph></subsection></section><section id="id6A05DF109C144ADDB8C874F103809860"><enum>334.</enum><header>Limitation on certain costs</header><text display-inline="no-display-inline">Not more than 10 percent of the total amount made available for the program under this subtitle for each fiscal year may be expended for the costs of administration.</text>
 </section><section id="idDFBED7E61A4A4049A2DD6D2EAE68D35E"><enum>335.</enum><header>Disbursement of funds</header><text display-inline="no-display-inline">Any amount made available by appropriation Acts under this subtitle unobligated by the National Board before the expiration of the 12-month period beginning on the date on which the amount becomes available shall be transferred to the general fund of the Treasury.</text>
							</section></subtitle><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="idEED1ACE1D82941638E564D2E61683E4F"><enum>(b)</enum><header>Technical and conforming amendment</header><text>The table of contents in section 101(b) of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11301">42 U.S.C. 11301</external-xref> note) is amended by inserting after the item relating to section 322 the following:</text>
				<quoted-block display-inline="no-display-inline" id="id4A82BF93B12448F9AAFD155A962C0BFC" style="OLC"><toc><toc-entry bold="off" level="subtitle">Subtitle D—Disaster and Supplemental Food Shelter Grants</toc-entry><toc-entry bold="off" level="section">Sec. 331. Grants by the Administrator.</toc-entry><toc-entry bold="off" level="section">Sec. 332. Retention of interest earned.</toc-entry><toc-entry bold="off" level="section">Sec. 333. Purposes of grants.</toc-entry><toc-entry bold="off" level="section">Sec. 334. Limitation on certain costs.</toc-entry><toc-entry bold="off" level="section">Sec. 335. Disbursement of funds.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="id238A45AF4932497596F7B8EB1F495A17"><enum>4.</enum><header>Emergency conservation program</header>
 <subsection id="id24073FF639D443ACA1C61283DF6CDAFC"><enum>(a)</enum><header>Maximum payments per person or legal entity</header><text>The Secretary of Agriculture, acting through the Administrator of the Farm Service Agency, shall amend the regulations promulgated pursuant to section 405 of the Agricultural Credit Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2205">16 U.S.C. 2205</external-xref>) relating to the emergency conservation program to provide that the maximum amount of payments made under section 401 or 402 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/16/2201">16 U.S.C. 2201</external-xref>, 2202) per person or legal entity per natural disaster is $500,000.</text>
 </subsection><subsection id="id8B7A181CC9504B9DB49B3D94BB0B1A7A"><enum>(b)</enum><header>Rulemaking</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary of Agriculture, acting through the Administrator of the Farm Service Agency, shall initiate a rulemaking to amend the regulations promulgated pursuant to section 405 of the Agricultural Credit Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2205">16 U.S.C. 2205</external-xref>) relating to the emergency conservation program to account for the challenges posed by the increase in frequency and intensity of wildland fire.</text>
			</subsection></section><section id="id977A9854FB014498A4D7DBEEEC969E3E"><enum>5.</enum><header>Emergency watershed protection program wildfire pilot</header>
 <subsection id="id1d63dafd2d8841ed96907e73cbd5fd32"><enum>(a)</enum><header>Findings</header><text>Congress finds that additional consideration of how the Federal Government supports and expedites the recovery of rural areas affected by wildfires is necessary because wildfires—</text>
 <paragraph id="ide21a157c765a49e48c691ef379325913"><enum>(1)</enum><text>pose unique mitigation, management, response, and recovery challenges due to the unpredictable size, location, and duration of wildfires; and</text>
 </paragraph><paragraph id="ideac8b2c961ec488ba6221d125644dbfa"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id155F6A104867477884C4EE0FA5CD5584"><enum>(A)</enum><text>disproportionately impact rural areas; and</text> </subparagraph><subparagraph id="id4E6A6DC2C40E49B6850A0EFFA0B6FD72" indent="up1"><enum>(B)</enum><text>inflict long-term damage on the agricultural systems rural areas economically rely on.</text>
 </subparagraph></paragraph></subsection><subsection id="idCE534DA528F94CD5A84A7E91A4C7A835"><enum>(b)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="id4BB59293D5B847DC81E7757DDE97102A"><enum>(1)</enum><header>Eligible jurisdiction</header><text>The term <term>eligible jurisdiction</term> means a jurisdiction within an area for which the President declared a major disaster in accordance with section 401 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>) for wildfire.</text>
 </paragraph><paragraph id="id568C8CDBB5C04C05BC932CE7601772F8"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture, acting through the Chief of the Natural Resources Conservation Service.</text>
 </paragraph></subsection><subsection id="id271e885561c54222a5304eec3222def3"><enum>(c)</enum><header>Pilot program</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary shall establish a pilot program for the administration of the emergency watershed protection program established under section 403 of the Agricultural Credit Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2203">16 U.S.C. 2203</external-xref>) in eligible jurisdictions to extend deadlines for the submission of applications and the provision of amounts under the program in accordance with subsection (d).</text>
			</subsection><subsection id="idC915E689EAFC4F4B8CDD877D766CF403"><enum>(d)</enum><header>Extension of deadlines</header>
 <paragraph id="iddde1d4934a734c2cbb3bf5c68273bd18"><enum>(1)</enum><header>Applications</header><text>During the period described in subsection (f), a sponsor may apply for amounts under the emergency watershed protection program for a project within an eligible jurisdiction by submitting a request to the State conservationist for the State in which the eligible jurisdiction is located not later than—</text>
 <subparagraph id="id91B0D52842904A8091152EB64EF0A93F"><enum>(A)</enum><text>180 days after the date on which the President declared the major disaster for wildfire;</text>
 </subparagraph><subparagraph id="id5D1F0793077E407D813403EE8AF2F67C"><enum>(B)</enum><text>60 days after the date on which access to site of the project becomes available, as determined by the Secretary; or</text>
 </subparagraph><subparagraph id="id6697ec1e75754f52bdd390fec48b1b36"><enum>(C)</enum><text>60 days after the date of 100-percent containment of a wildfire for which a major disaster declaration is issued.</text>
					</subparagraph></paragraph><paragraph id="id3c627523bb874287ac613b22636e6019"><enum>(2)</enum><header>Awards</header>
 <subparagraph id="id8C71EFE522EF453BAB3345D04E156A63"><enum>(A)</enum><header>In general</header><text>During the period described in subsection (f), except as provided in subparagraph (B), not later than 360 days after the date on which the Secretary commits amounts to the applicable State conservationist for the provision of amounts under the emergency watershed protection program for a project within an eligible jurisdiction—</text>
 <clause id="id8E123225C181488FA8B4D8B4946B8CB6"><enum>(i)</enum><text>the State conservationist shall provide the amounts to the sponsor of the project; and</text> </clause><clause id="id81A7A8103EC7486A9A82EF8028E31414"><enum>(ii)</enum><text>the project shall be completed.</text>
 </clause></subparagraph><subparagraph id="id60F5A441639B475794541723E9ADB0DF"><enum>(B)</enum><header>Emergency situations</header><text>During the period described in subsection (f), in an emergency situation (as determined by the Secretary), not later than 10 days after the date on which the Secretary commits amounts to the applicable State conservationist for the provision of amounts under the emergency watershed protection program for a project within an eligible jurisdiction, the project shall be completed.</text>
					</subparagraph></paragraph></subsection><subsection id="ide66efdf33aa54e778c3cb5f503f5f55c"><enum>(e)</enum><header>Reports to Congress</header>
 <paragraph id="id7156845DE304420A8F9904D5EA2EA891"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date on which the pilot program is established under subsection (c), and once the following year, the Secretary shall prepare a report describing—</text>
 <subparagraph id="id37df1a2751b8495eaab3f32dfd12a679"><enum>(A)</enum><text>the number of applications submitted for a project under the pilot program during the 60-day period beginning on the date on which the pilot program is established;</text>
 </subparagraph><subparagraph id="id6c7923935a7243af85da7ff104613575"><enum>(B)</enum><text>the number of applications described in subparagraph (A) that were approved;</text> </subparagraph><subparagraph id="id1c06ec79dfb54e88a8fb5d58f49ace72"><enum>(C)</enum><text>the average time of construction of projects for which applications described in subparagraph (B) were submitted; and</text>
 </subparagraph><subparagraph id="id0374CDAC2F624E8BA8AF0B57EE1DB8C4"><enum>(D)</enum><text>such other information as the Secretary considers appropriate.</text> </subparagraph></paragraph><paragraph id="id9C34B1947CE64BEAA0D4DDC6E26FDCC4"><enum>(2)</enum><header>Submission</header><text>The Secretary shall submit each report under paragraph (1) to each of the following:</text>
 <subparagraph id="id2E36B11652794451AD0FA80BF5B71A02"><enum>(A)</enum><text>In the Senate:</text> <clause id="idFE9518D108C24A3AA0AC0A0B77B9BCA0"><enum>(i)</enum><text>The Committee on Agriculture, Nutrition, and Forestry.</text>
 </clause><clause id="idE5DB24867FD74971A09F565784B09C4E"><enum>(ii)</enum><text>The Committee on Homeland Security and Governmental Affairs.</text> </clause><clause id="idF9ECD13A06E44C7F939DD3A58AEA21B7"><enum>(iii)</enum><text>The Committee on Appropriations.</text>
 </clause></subparagraph><subparagraph id="id452CAB5684A545029BD7427A89A9E423"><enum>(B)</enum><text>In the House of Representatives:</text> <clause id="idC05D9AE9DE31405F9A3A6BBE4A4E83C1"><enum>(i)</enum><text>The Committee on Agriculture.</text>
 </clause><clause id="id6BED18AB5EEF4223B8A46B9DDF821BA5"><enum>(ii)</enum><text>The Committee on Homeland Security.</text> </clause><clause id="idB88ABE3C74A34485B61B387F2EC9CCD8"><enum>(iii)</enum><text>The Committee on Appropriations.</text>
 </clause></subparagraph></paragraph></subsection><subsection id="id7bef210828e84a89b8dce2d7fbc0e427"><enum>(f)</enum><header>Duration</header><text>The pilot program established under subsection (c) shall be carried out during the 2-year period beginning on the date on which the pilot program is established.</text>
 </subsection></section><section id="id5824c38b50b547bfb93f85692eb6d3cf"><enum>6.</enum><header>Expanded eligibility for hazard mitigation assistance</header><text display-inline="no-display-inline">Section 404 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170c">42 U.S.C. 5170c</external-xref>) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="idACAAF1676BF34CD09B563E8D138685D3" style="OLC">
 <subsection id="id8c61cf3d19bf42b588eabd263e217f7d"><enum>(f)</enum><header>Expanded eligibility</header><text>Notwithstanding any other provision of this section or section 420, the President may provide hazard mitigation assistance in accordance with this section in any area in which assistance is provided under section 420.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body>
