		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Mandatory Bureaucratic Realignment and Consolidation Commission Act of 2016</short-title></quote> or the <quote>Mandatory BRACC Act</quote>.</text>
 </section><section id="ID6db23b4807304d4199055a05b29d0a7e"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act—</text> <paragraph commented="no" display-inline="no-display-inline" id="id362D78259E12435AA1F43BC0B58A7CF7"><enum>(1)</enum><text display-inline="yes-display-inline">the terms <term>account</term>, <term>budgetary resources</term>, <term>direct spending</term>, <term>discretionary appropriations</term>, and <term>sequestration</term> have the meaning given such terms in section 250(c) of the Balanced Budget and Emergency Deficit Control Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/2/900">2 U.S.C. 900(c)</external-xref>);</text>
 </paragraph><paragraph id="idC92416C04BDE4174A296405B3EC56DEB"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>Commission</term> means the Mandatory Bureaucratic Realignment and Consolidation Commission established under section 4(a);</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDEEEBF1272A4457C9499F920A1400240"><enum>(3)</enum><text display-inline="yes-display-inline">the term <term>Commission bill</term> means a bill consisting of the proposed legislative language recommended by the Commission under section 4(b)(3) and introduced under section 5(a);</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id852C8D4BE4FA4E1DA249DCA86903CB09"><enum>(4)</enum><text>the term <term>outlays</term> has the meaning given that term under section 3 of the Congressional Budget Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/2/622">2 U.S.C. 622</external-xref>); and</text>
 </paragraph><paragraph id="idd7d67777422c441989ee3e046b9475dc"><enum>(5)</enum><text>the term <term>total spending</term>—</text> <subparagraph id="id58DA8EA894C040EF8CC4C589A393E114"><enum>(A)</enum><text>means all outlays of the Government;</text>
 </subparagraph><subparagraph id="id59439A4A63A1406585957E89AB66DEFD"><enum>(B)</enum><text>includes outlays from off-budget entities and budget authority and outlays flowing therefrom, as applicable, designated as emergencies; and</text>
 </subparagraph><subparagraph id="id31649E50C865454EA55F997AF5907DCC"><enum>(C)</enum><text>does not include net interest.</text> </subparagraph></paragraph></section><section id="id7ED968958FB1427A81F57002EF244211"><enum>3.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to reduce outlays flowing from direct spending such that—</text>
 <paragraph id="idB753471A9C6142E982ED9E04AA0C4B9C"><enum>(1)</enum><text display-inline="yes-display-inline">total spending for each fiscal year is not more than total revenues for the fiscal year; and</text>
 </paragraph><paragraph id="id6884D044D5B948428995741D5082877A"><enum>(2)</enum><text>outlays flowing from direct spending are not more than 50 percent of total spending.</text>
			</paragraph></section><section id="idD9D6E14C062348CEA737E5E13B3F2FD7"><enum>4.</enum><header>Establishment of Mandatory Bureaucratic Realignment and Consolidation Commission</header>
 <subsection id="ID47f32a60572e4228b0c39eeb382da1ad"><enum>(a)</enum><header>Establishment</header><text>There is established in the legislative branch a commission to be known as the <quote>Mandatory Bureaucratic Realignment and Consolidation Commission</quote>.</text>
			</subsection><subsection id="ID903c2f240fe34b22b71d9a5edfbf2f8a"><enum>(b)</enum><header>Duties</header>
 <paragraph id="id61606B5A39DD4898AE66CA974726636A"><enum>(1)</enum><header>In general</header><text>The Commission—</text> <subparagraph id="idF512EAB57F2649DC970AA68994F41858"><enum>(A)</enum><text>shall review all direct spending by the Federal Government to—</text>
 <clause id="id35F402F64D2B48ADA77B04359CA0BBE0"><enum>(i)</enum><text>identify changes in law (which may include ways to streamline functions and increase efficiency within agencies or programs) that will reduce outlays flowing from the direct spending;</text>
 </clause><clause id="idB8A7365270074363BFEBC1928D97F33E"><enum>(ii)</enum><text>identify the goals of each direct spending program;</text> </clause><clause commented="no" display-inline="no-display-inline" id="idE1E9C3EF7E16441E9EC497FDD705C04D"><enum>(iii)</enum><text display-inline="yes-display-inline">determine whether there are effective methods to measure the outcomes of each direct spending program;</text>
 </clause><clause id="idD23EFF245830447EAB8DD96BEF57FCF7"><enum>(iv)</enum><text>evaluate the usefulness of each direct spending program;</text> </clause><clause id="idEE1565100AF54C5DB742B94C5924A69A"><enum>(v)</enum><text>evaluate whether each direct spending program could be consolidated with another direct spending program, or a program subject to the availability of discretionary appropriations, with similar goals and make recommendations for consolidating the spending programs that are identified;</text>
 </clause><clause id="idC109EA1A3C494CA08DA323C731CA48DD"><enum>(vi)</enum><text>evaluate the potential benefits of eliminating any direct spending program that does not have proven beneficial outcomes or usefulness and make rec­om­men­da­tions regarding eliminating direct spending programs that are identified;</text>
 </clause><clause id="id4075CE7713404715AA9C4E2666BE3A62"><enum>(vii)</enum><text>identify opportunities and make recommendations regarding ways for the Federal Government to reduce the cost or increase the efficiency of direct spending programs by contracting with private entities, or delegating authority to States, to perform activities relating to the program;</text>
 </clause><clause commented="no" id="idDD349365C8A2452B8A0E3A2D97CA3725"><enum>(viii)</enum><text>identify direct spending programs and entitlement authorities that should be modified to be carried out subject to the availability of discretionary appropriations; and</text>
 </clause><clause id="idFAA7367957E64E3F870AAFBA487083AC"><enum>(ix)</enum><text>identify other ways to achieve the requirements described in paragraph (3)(B), as determined by the Commission; and</text>
 </clause></subparagraph><subparagraph id="idACE95B30932340869984D3C9F76C5D7A"><enum>(B)</enum><text>may review the offsetting receipts and discretionary appropriations of the Federal Government, as determined appropriate by the Commission.</text>
					</subparagraph></paragraph><paragraph id="idAAFFD19D954F4DA09C1042453782FAC7"><enum>(2)</enum><header>Consultation and working groups</header>
 <subparagraph id="idB7C62803741B4C88BA0CF4BE3E5D1499"><enum>(A)</enum><header>In general</header><text>In carrying out the review under paragraph (1)(A), the Commission shall—</text> <clause id="id39040DE289B64859A71F6932F8CBC7B0"><enum>(i)</enum><text>consult with experts in company restructuring, reorganizing, and cost cutting; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="idB9466ED806F341F38182D9E09B8D0A84"><enum>(ii)</enum><text>establish working groups for direct spending programs, as determined appropriate by the Commission, to provide recommendations to the Commission.</text>
 </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB263D060FDFE4BFF9EAB904417BBE74C"><enum>(B)</enum><header>Members of working groups</header><text>The individuals serving on a working group established under subparagraph (A)(ii) shall be employees or contractors of the Commission with expertise in a program reviewed by the working group.</text>
					</subparagraph></paragraph><paragraph id="id8849B3D59AA74154BE7E466A926B9E53"><enum>(3)</enum><header>Reporting and proposed legislation</header>
 <subparagraph id="idDEC6A6C14EC6483CB13F285A03D596D1"><enum>(A)</enum><header>In general</header><text>The Commission—</text> <clause id="idC5200CE630D34A35851D17FE801446E8"><enum>(i)</enum><text>shall identify changes in law that will result in the reduction of outlays that will achieve the requirements described in subparagraph (B);</text>
 </clause><clause id="idD361251864B74CF79A4AA4E4D755DB20"><enum>(ii)</enum><text>not later than 6 months after the date on which all members of the Commission are appointed, and upon an affirmative vote of a majority of the members of the Commission, shall submit to Congress and make publicly available a report containing—</text>
 <subclause id="ID40d2a6359f2c49328949ec01c17b948e"><enum>(I)</enum><text>a detailed statement of the findings, conclusions, and rec­om­men­da­tions of the Commission;</text>
 </subclause><subclause id="ID7c52032d35af4c6da6275c5b8e52c1fc"><enum>(II)</enum><text>the assumptions, scenarios, and alternatives considered in reaching such findings, conclusions, and recommendations; and</text>
 </subclause><subclause commented="no" display-inline="no-display-inline" id="id7B6ADE93285D40A5AE229AEBB8AAE56B"><enum>(III)</enum><text>proposed legislative language to carry out the changes in law identified under clause (i); and</text>
 </subclause></clause><clause id="id874bc2e46aee482d9c1245e05f7b06b0"><enum>(iii)</enum><text>may include in the proposed legislative language submitted under clause (ii)(III) changes in law that reduce outlays such that the requirements under subparagraph (B) are exceeded.</text>
 </clause></subparagraph><subparagraph id="id3EA2E0DBCEDA42FD84882CBE84006D3F"><enum>(B)</enum><header>Requirements</header><text>The requirements under this subparagraph are that, according to the most recent budget estimates by the Congressional Budget Office as of the date on which the recommendations of the Commission are issued, outlays flowing from direct spending are reduced such that—</text>
 <clause id="id83236C33E6FE43C48A1B4A5AB0237E72"><enum>(i)</enum><text>total spending is gradually reduced during the period of fiscal years 2018 through 2027;</text> </clause><clause id="id06BA0F6A7D3D43F086E1AD992F02D7CD"><enum>(ii)</enum><text>not later than the start of fiscal year 2027, and for each fiscal year thereafter, total spending is not more than total revenues; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="idA742E61A96204A398FB566D6F784DD44"><enum>(iii)</enum><text>not later than the start of fiscal year 2027, and for each fiscal year thereafter, outlays flowing from direct spending are not more than 50 percent of total spending.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="ID552d971fca3c45849492c5590b728243"><enum>(c)</enum><header>Membership</header>
				<paragraph id="IDfbf45af20d55451aa49c4ea30f4a0de4"><enum>(1)</enum><header>In
 general</header><text>The Commission shall be composed of 12 members, appointed as follows:</text> <subparagraph id="ID410cd0b8cbf14b9f8f33c15332129f59"><enum>(A)</enum><text>The President shall appoint 2 members.</text>
 </subparagraph><subparagraph id="ID09e42a6bf1684bc9a306032245a26c69"><enum>(B)</enum><text>The majority leader of the Senate shall appoint 2 members.</text>
 </subparagraph><subparagraph id="ID92c567c9ab284f34b803cb856f03d5f5"><enum>(C)</enum><text>The minority leader of the Senate shall appoint 2 members.</text>
 </subparagraph><subparagraph id="IDcd325d08d94e4837bb64bdd38c744683"><enum>(D)</enum><text>The Speaker of the House of Representatives shall appoint 2 members.</text>
 </subparagraph><subparagraph id="ID3705e8255b1d4aa8853332387b31c6b5"><enum>(E)</enum><text>The minority leader of the House of Representatives shall appoint 2 members.</text>
 </subparagraph><subparagraph id="id238344BBC4FF452E95E12EE0D25A46D0"><enum>(F)</enum><text>The majority leader of the Senate or the minority leader of the Senate shall appoint 2 members, as necessary for there to be an equal number of appointments of members of the Commission made by members of each of the 2 major political parties.</text>
 </subparagraph></paragraph><paragraph id="id7A05AAB9841C4AFCA17B046307013FC5"><enum>(2)</enum><header>Disqualifications</header><text>An individual may not be appointed as a member of the Commission if the individual—</text> <subparagraph id="idB2A6187B980349D693D7E3BADE18677A"><enum>(A)</enum><text>was an officer or employee of any establishment in the Federal Government at any time during the 5-year period ending on the date of the appointment; or</text>
 </subparagraph><subparagraph id="id8826A417045044E3817E66D191D994A9"><enum>(B)</enum><text>was registered as a lobbyist under the Lobbying Disclosure Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1601">2 U.S.C. 1601 et seq.</external-xref>) at any time during the 5-year period ending on the date of the appointment.</text>
 </subparagraph></paragraph><paragraph id="ID25ff5aeb733b4a948f3b4394f5b430ff"><enum>(3)</enum><header>Chairperson</header><text>The members of the Commission shall select a Chairperson from among the members of the Commission.</text> </paragraph><paragraph id="ID6eb457ef526b463ea0a16854c235c831"><enum>(4)</enum><header>Date</header><text>Not later than 1 month after the date of enactment of this Act, all members of the Commission shall be appointed.</text>
				</paragraph><paragraph id="IDf71fa00cbfb34aa2ab14a61e14823346"><enum>(5)</enum><header>Period of
 designation</header><text>Members shall be appointed for the life of the Commission. Any vacancy in the Commission shall not affect its powers, but shall be filled not later than 14 days after the date on which the vacancy occurs in the same manner as the original appointment.</text>
				</paragraph><paragraph id="ID162852e977434532aae30bd59ea0b69c"><enum>(6)</enum><header>Compensation</header>
 <subparagraph id="id992D1F70D6CF4A5A98F82F2212093DE2"><enum>(A)</enum><header>In general</header><text>Each member of the Commission shall be compensated at a rate equal to the daily equivalent of the annual rate of basic pay prescribed for a position at level III of the Executive Schedule under section 5314 of title 5, United States Code, for each day (including travel time) during which such member is engaged in the performance of the duties of the Commission.</text>
 </subparagraph><subparagraph id="idF739A550772E43229E788784458960C0"><enum>(B)</enum><header>Travel expenses</header><text>Members may be allowed travel expenses, including per diem in lieu of subsistence, in accordance with sections 5702 and 5703 of title 5, United States Code, while away from their homes or regular places of business in performance of services for the Commission.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id558848F7411440F485E9250593056C1C"><enum>(d)</enum><header display-inline="yes-display-inline">Powers of the Commission</header>
 <paragraph id="ID59F4B18DC65D436687C5ABF4ADFAECCB"><enum>(1)</enum><header>Hearings</header><text>The Commission may, for the purpose of carrying out this Act—</text>
 <subparagraph id="ID8AC984FF79BA493690ACCBE8F038342F"><enum>(A)</enum><text>hold such hearings, sit and act at such times and places, take such testimony, receive such evidence, and administer such oaths as the Commission considers advisable to carry out its duties; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idCE251DE311024916AEF47ABFA6D6812E"><enum>(B)</enum><text>require, by subpoena or otherwise, the attendance and testimony of such witnesses and the production of such books, records, correspondence, memoranda, papers, documents, tapes, and materials as the Commission considers advisable to carry out its duties.</text>
 </subparagraph></paragraph><paragraph id="idc01d4359f99248048673279b25d19bab"><enum>(2)</enum><header>Information from Federal agencies</header><text>The Commission may request directly, or require, by subpoena or otherwise, from any Federal agency such information as the Commission considers necessary to carry out its duties. Upon a request of the Chairperson of the Commission, the head of a Federal agency shall furnish such information to the Commission.</text>
				</paragraph><paragraph id="ID983A03FC1B76405F963E2BCA478BD3BD"><enum>(3)</enum><header>Issuance and
		enforcement of subpoenas</header>
 <subparagraph id="IDE043443601D24505B9471995E5B38680"><enum>(A)</enum><header>Issuance</header><text>Subpoenas issued under paragraph (1) or (2) shall bear the signature of the Chairperson of the Commission and shall be served by any person or class of persons designated by the Chairperson for that purpose.</text>
 </subparagraph><subparagraph id="IDD71775781A8F442DAE38E38B384E07BE"><enum>(B)</enum><header>Enforcement</header><text>In the case of contumacy or failure to obey a subpoena issued under paragraph (1) or (2), the United States district court for the judicial district in which the subpoenaed person resides, is served, or may be found may issue an order requiring such person to appear at any designated place to testify or to produce documentary or other evidence. Any failure to obey the order of the court may be punished by the court as a contempt of that court.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4F762FA73B1E48A193A3A1EAE960AB58"><enum>(4)</enum><header>Witness
 allowances and fees</header><text>Section 1821 of title 28, United States Code, shall apply to witnesses requested or subpoenaed to appear at any hearing of the Commission. The per diem and mileage allowances for witnesses shall be paid from funds available to pay the expenses of the Commission.</text>
 </paragraph><paragraph id="id586836B4A4134F0FAD924869B29E8657"><enum>(5)</enum><header>Information from the Congressional Budget Office</header><text>The Commission may secure directly from the Congressional Budget Office such information, including estimates and analysis, as the Commission considers advisable to carry out its duties. Upon request of the Chairperson of the Commission, the Director of the Congressional Budget Office shall furnish such information, including estimates and analysis, to the Commission.</text>
				</paragraph></subsection><subsection id="ID54c8845a00f5482b887cb19035e2f683"><enum>(e)</enum><header>Staff of the Commission</header>
				<paragraph id="ID8066199b07424e66b140410023bfcebd"><enum>(1)</enum><header>Appointment and
 compensation of staff</header><text>The Chairperson may appoint and fix the compensation of a staff director and such other employees as may be necessary to enable the Commission to carry out its functions, without regard to the provisions of title 5, United States Code, governing appointments in the competitive service, but at rates not to exceed the annual rate of basic pay prescribed for a position at level V of the Executive Schedule under section 5316 of title 5 of the United States Code.</text>
 </paragraph><paragraph id="id2ba7a68b827b493596c24a006a80249e"><enum>(2)</enum><header>Agency assistance</header><text>Upon the request of the Chairperson, the head of any agency may detail an employee of the agency to the Commission without reimbursement, and such detail shall be without interruption or loss of civil service status or privilege.</text>
				</paragraph></subsection><subsection id="IDffc4e330c20347ba9e3fa4376f84de3b"><enum>(f)</enum><header>Consultant, temporary, and intermittent
 services</header><text>The Chairperson of the Commission is authorized to procure the services of experts and consultants and temporary and intermittent services in accordance with section 3109 of title 5, United States Code, but at rates not to exceed the daily rate paid a person occupying a position at level V of the Executive Schedule under section 5316 of title 5, United States Code, for each day during which such consultant or expert is engaged in the performance of the duties of the Commission.</text>
 </subsection><subsection id="IDba0337c762084aeeb20073cecd4a1706"><enum>(g)</enum><header>Termination</header><text>The Commission shall terminate on the day after the earlier of—</text> <paragraph id="id7487E99D299D4F00B82E88A5B17F4B2C"><enum>(1)</enum><text>the date on which the Commission bill is enacted into law; or</text>
 </paragraph><paragraph id="id3469DAD27C1F4E8D8547A7B1E855E28C"><enum>(2)</enum><text>the date on which the period during which Congress may consider the Commission bill (including the consideration of any veto message) expires under section 5.</text>
 </paragraph></subsection><subsection id="id3DDD3F98574D46D8B98536D5D181296F"><enum>(h)</enum><header>FACA</header><text>The Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the Commission.</text> </subsection></section><section commented="no" id="H2FAA2E28DA344673A702DEE95CD4E8DC"><enum>5.</enum><header>Expedited procedures</header> <subsection commented="no" id="H4EA964A86C264F0A8646EAB6DA87D5C"><enum>(a)</enum><header>Introduction</header><text>The proposed legislative language recommended by the Commission under section 4(b)(3)—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="id1E765B06277248FFAE2BD66D53C34B3B"><enum>(1)</enum><text display-inline="yes-display-inline">shall be introduced in the Senate (by request), with any technical changes necessary to carry out the intent of the proposed legislative language, by the majority leader of the Senate or by a Member of the Senate designated by the majority leader of the Senate not later than 10 legislative days after the date on which the proposed legislation is submitted to Congress; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1858BA1DDBC04FAABBBA4E18CFEFD580"><enum>(2)</enum><text display-inline="yes-display-inline">shall be introduced in the House of Representatives (by request), with any technical changes necessary to carry out the intent of the proposed legislative language, by the Speaker of the House of Representatives or by a Member of the House of Representatives designated by the Speaker of the House of Representatives not later than 10 legislative days after the date on which the proposed legislation is submitted to Congress.</text>
				</paragraph></subsection><subsection commented="no" id="id9FC6D72BC63840768238C54510D55BBE"><enum>(b)</enum><header>Expedited consideration in House of Representatives</header>
 <paragraph id="HF53FB4F231024E7E002B30966B495C21"><enum>(1)</enum><header>Placement on calendar</header><text>Upon introduction in the House of Representatives, the Commission bill shall be placed immediately on the appropriate calendar.</text>
				</paragraph><paragraph id="H4E5438468A414C028CB1030034E86357"><enum>(2)</enum><header>Proceeding to consideration</header>
 <subparagraph id="idA51D1589FB8344C8AD47E5ECA7C94A92"><enum>(A)</enum><header>In general</header><text>It shall be in order, not later than 60 legislative days after the date the Commission bill is introduced in the House of Representatives, to move to proceed to consider the Commission bill in the House of Representatives.</text>
 </subparagraph><subparagraph id="id48A4D3B4DCB64F969E1FCB9416F641F5"><enum>(B)</enum><header>Procedure</header><text>For a motion to proceed to consider the Commission bill—</text> <clause id="id36CE2C40729341F5A6FCA25BD4FF17C7"><enum>(i)</enum><text>all points of order against the motion are waived;</text>
 </clause><clause id="idE3FCA49735F247979F0E0ECA4217549F"><enum>(ii)</enum><text>such a motion shall not be in order after the House of Representatives has disposed of a motion to proceed on the Commission bill;</text>
 </clause><clause id="id980B709B8F13404ABFDF9F15C3A1D334"><enum>(iii)</enum><text>the previous question shall be considered as ordered on the motion to its adoption without intervening motion;</text>
 </clause><clause id="id29892EEB7352475A9D82F349026AC524"><enum>(iv)</enum><text>the motion shall not be debatable; and</text>
 </clause><clause id="id00CA3E6DF7F74DB1BFB4822C0BB99E76"><enum>(v)</enum><text>a motion to reconsider the vote by which the motion is disposed of shall not be in order.</text>
 </clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HEE3C1B021C33479984DB7313346947A3"><enum>(3)</enum><header>Consideration</header><text>If the House of Representatives proceeds to consideration of the Commission bill—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id4AABBDF4D2F54722A7BB4533B7A74390"><enum>(A)</enum><text>the Commission bill shall be considered as read;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idEC97461267DA41448690AF69B835E859"><enum>(B)</enum><text>all points of order against the Commission bill and against its consideration are waived;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id467184F3B4984625A00FCA77D6BFF69B"><enum>(C)</enum><text>the previous question shall be considered as ordered on the Commission bill to its passage without intervening motion except 10 hours of debate equally divided and controlled by the proponent and an opponent;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idFFFC340608B6409C8A167E6F447E1F96"><enum>(D)</enum><text>an amendment to the Commission bill shall not be in order; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1E86F71F061148B2996E32452E5194D4"><enum>(E)</enum><text>a motion to reconsider the vote on passage of the Commission bill shall not be in order.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE913CFFF272D492194DDF4C2F7113A5F"><enum>(4)</enum><header>Vote on passage</header><text>In the House of Representatives, the Commission bill shall be agreed to upon a vote of a majority of the Members present and voting, a quorum being present.</text>
				</paragraph></subsection><subsection commented="no" id="H9F27DD03951B45A4B88E046CEF612300"><enum>(c)</enum><header>Expedited consideration in Senate</header>
 <paragraph commented="no" id="HEECA9155531044C7923699B0D7F0D1A9"><enum>(1)</enum><header>Placement on calendar</header><text>Upon introduction in the Senate, the Commission bill shall be placed immediately on the calendar.</text> </paragraph><paragraph commented="no" id="H9FB01AFC00724EE9B4021BF58D68EEE"><enum>(2)</enum><header>Proceeding to consideration</header> <subparagraph commented="no" id="H911399D6B22B433191A4C54F8CC57D11"><enum>(A)</enum><header>In general</header><text>Notwithstanding rule XXII of the Standing Rules of the Senate, it is in order, not later than 60 legislative days after the date the Commission bill is introduced in the Senate (even though a previous motion to the same effect has been disagreed to) to move to proceed to the consideration of the Commission bill.</text>
 </subparagraph><subparagraph commented="no" id="id9E578A6C89BA4F48BA7CB61A51899A17"><enum>(B)</enum><header>Procedure</header><text>For a motion to proceed to the consideration of the Commission bill—</text> <clause commented="no" id="idB991BE12419A4769BB047992DCCA994B"><enum>(i)</enum><text>all points of order against the motion are waived;</text>
 </clause><clause commented="no" id="id7EE32329A566432CAE6DFF004519920C"><enum>(ii)</enum><text>the motion is not debatable;</text> </clause><clause commented="no" id="id128F2A3334824E43B6D987E023FDB48D"><enum>(iii)</enum><text>the motion is not subject to a motion to postpone;</text>
 </clause><clause commented="no" id="idC93CCAFFF49A41F0B4C1AEE92FFAC266"><enum>(iv)</enum><text>a motion to reconsider the vote by which the motion is agreed to or disagreed to shall not be in order; and</text>
 </clause><clause commented="no" id="idD66E5AAE05E94869B4923126BB7E7A75"><enum>(v)</enum><text>if the motion is agreed to, the Commission bill shall remain the unfinished business until disposed of.</text>
						</clause></subparagraph></paragraph><paragraph commented="no" id="id78A1373CA3324D77B7193E80A72A85A8"><enum>(3)</enum><header>Floor consideration</header>
 <subparagraph commented="no" id="idF9AC7D607C46499D89FC34DA5F74205F"><enum>(A)</enum><header>In general</header><text>If the Senate proceeds to consideration of the Commission bill—</text> <clause commented="no" id="id760EB467A21A40C286DE10DFEFEBA5D0"><enum>(i)</enum><text>all points of order against the Commission bill (and against consideration of the Commission bill) are waived;</text>
 </clause><clause commented="no" id="H9815FFE925934F478D702700FAECC0C8"><enum>(ii)</enum><text>consideration of the Commission bill, and all debatable motions and appeals in connection therewith, shall be limited to not more than 30 hours, which shall be divided equally between the majority and minority leaders or their designees;</text>
 </clause><clause commented="no" id="id466C03DC76CA4FABBFD1EFEFFD264781"><enum>(iii)</enum><text>a motion further to limit debate is in order and not debatable;</text>
 </clause><clause commented="no" id="id4406CBFBEB554998A796A265F5DC9556"><enum>(iv)</enum><text>an amendment to, a motion to postpone, or a motion to commit the Commission bill is not in order; and</text>
 </clause><clause commented="no" id="id8268CFA185354E01BC0467A99F83DF31"><enum>(v)</enum><text>a motion to proceed to the consideration of other business is not in order.</text>
 </clause></subparagraph><subparagraph commented="no" id="H630AD997C7264858AC86697C392E86FA"><enum>(B)</enum><header>Vote on passage</header><text>In the Senate—</text> <clause commented="no" id="id64D182E2EACE41E5B52CACADE2F548AA"><enum>(i)</enum><text>the vote on passage shall occur immediately following the conclusion of the consideration of the Commission bill, and a single quorum call at the conclusion of the debate if requested in accordance with the rules of the Senate; and</text>
 </clause><clause commented="no" id="id53B3B7589FDD46FD91C8040D93FA21F8"><enum>(ii)</enum><text>the Commission bill shall be agreed to upon a vote of a majority of the Members present and voting, a quorum being present.</text>
 </clause></subparagraph><subparagraph commented="no" id="H37829F0A722E485D9E8EFD9EFD4DDD50"><enum>(C)</enum><header>Rulings of the chair on procedure</header><text>Appeals from the decisions of the Chair relating to the application of this subsection or the rules of the Senate, as the case may be, to the procedure relating to the Commission bill shall be decided without debate.</text>
					</subparagraph></paragraph></subsection><subsection id="HC0A3744CB72A44B70057096190629488"><enum>(d)</enum><header>Rules relating to Senate and House of Representatives</header>
 <paragraph commented="no" id="H201CE343E7A44EB49F64DD99A8A78E6F"><enum>(1)</enum><header>Coordination with action by other house</header><text>If, before the passage by one House of the Commission bill of that House, that House receives from the other House the Commission bill—</text>
 <subparagraph commented="no" id="HEC93F99B82A64AFABCAEFD5F23189E7B"><enum>(A)</enum><text>the Commission bill of the other House shall not be referred to a committee; and</text> </subparagraph><subparagraph commented="no" id="H00364B2CBF00433B869582464FAEBF45"><enum>(B)</enum><text>with respect to the Commission bill of the House receiving the resolution—</text>
 <clause commented="no" id="H1A0B824E00914859A0CDDD57EBFE72FB"><enum>(i)</enum><text>the procedure in that House shall be the same as if no Commission bill had been received from the other House; and</text>
 </clause><clause commented="no" id="HC3F4AFF3748D49758D5712EF36F56DF3"><enum>(ii)</enum><text>the vote on passage shall be on the Commission bill of the other House.</text> </clause></subparagraph></paragraph><paragraph commented="no" id="HA9224C0DE15D49D8A34F57E94F30007D"><enum>(2)</enum><header>Treatment of Commission bill of other House</header><text>If one House fails to introduce or consider the Commission bill under this section, the Commission bill of the other House shall be entitled to expedited floor procedures under this section.</text>
 </paragraph><paragraph commented="no" id="HF79766811BA548568DE7A31071551D9E"><enum>(3)</enum><header>Treatment of companion measures</header><text>If, following passage of the Commission bill in the Senate, the Senate receives the companion measure from the House of Representatives, the companion measure shall not be debatable.</text>
 </paragraph><paragraph id="HA27F23C8E60542D5A1A99824F4750000"><enum>(4)</enum><header>Vetoes</header><text>If the President vetoes the Commission bill, consideration of a veto message in the Senate under this section shall be not more than 10 hours equally divided between the majority and minority leaders or their designees.</text>
 </paragraph></subsection><subsection commented="no" id="H3379EB1614E1450BBAE87831EF791DBA"><enum>(e)</enum><header>Rules of House of Representatives and Senate</header><text>This section is enacted by Congress—</text> <paragraph commented="no" id="H388A960DA12B414AB4F48541F3BFC635"><enum>(1)</enum><text>as an exercise of the rulemaking power of the Senate and House of Representatives, respectively, and as such is deemed a part of the rules of each House, respectively, but applicable only with respect to the procedure to be followed in that House in the case of the Commission bill, and supersede other rules only to the extent that it is inconsistent with such rules; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HBCB049D6BDBE4489BDE0031DFF5CFE6"><enum>(2)</enum><text>with full recognition of the constitutional right of either House to change the rules (so far as relating to the procedure of that House) at any time, in the same manner, and to the same extent as in the case of any other rule of that House.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idFE339CB069B44FE48E26BD25D86D5A3B"><enum>6.</enum><header>Growth limitations in spending if savings are not enacted</header>
 <subsection commented="no" display-inline="no-display-inline" id="id40A72FFF7F214054BDC30C73F68F7DE7"><enum>(a)</enum><header>Determination</header><text display-inline="yes-display-inline">Not later than November 1, 2017, and November 1 of every fiscal year thereafter, the Office of Management and Budget shall determine whether total spending for the previous fiscal year was more than total revenues for the previous fiscal year.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="id6C3C81F01C014AEAB30F4AED8254C556"><enum>(b)</enum><header>Failure To enact savings</header><text>Except as provided in subsection (d), if the Commission bill to achieve the requirements described in section 4(b)(3)(B) is not enacted, notwithstanding section 251A of the Balanced Budget and Emergency Deficit Control Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/2/901a">2 U.S.C. 901a</external-xref>), effective on the first October 1 occurring after consideration of the Commission bill in the Senate and the House of Representatives, and October 1 of every fiscal year thereafter, the President shall limit the annual growth in outlays by ordering a sequestration, effective upon issuance, that ensures projected total spending for the fiscal year is not more than 3 percent greater than total spending for the previous fiscal year by reducing each nonexempt account by the uniform percentage necessary, unless—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="id07B43FD520D3443098E1B3FB5F00F34B"><enum>(1)</enum><text>the Office of Management and Budget determines that, as a result of reductions in budgetary resources under this subsection, total spending for the previous fiscal year was not more than total revenues for the previous fiscal year; or</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4A7F151919684D5BAD1A9FC52E364E5F"><enum>(2)</enum><text>changes in law have been enacted that will achieve the requirements described in section 4(b)(3)(B).</text>
				</paragraph></subsection><subsection id="idDF0E9448BD07473E80885197DF70935D"><enum>(c)</enum><header>Implementation</header>
 <paragraph id="id8CF267529F88423FABA5A210F111561A"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), each sequestration under subsection (b) shall be implemented in accordance with the Balanced Budget and Emergency Deficit Control Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/2/900">2 U.S.C. 900 et seq.</external-xref>).</text>
 </paragraph><paragraph id="id51071E583C1741A6A5E9AF81B5D94354"><enum>(2)</enum><header>No exemptions, other than payments on interest, or maximum reductions</header><text display-inline="yes-display-inline">Subsections (a), (b), and (d) through (k) of section 255 of the Balanced Budget and Emergency Deficit Control Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/2/905">2 U.S.C. 905</external-xref>) and subsections (d)(2) and (e) of section 256 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/2/906">2 U.S.C. 906</external-xref>) shall not apply to the sequestration under subsection (b).</text>
				</paragraph></subsection><subsection id="id99A486D70CD149C09908940C15C52CED"><enum>(d)</enum><header>Waiver</header>
 <paragraph id="idDA6079B6BA7A4CDB91A2F4CB36D6A651"><enum>(1)</enum><header>In general</header><text>A sequestration required to be ordered under subsection (b) for a fiscal year shall not be implemented if a bill or joint resolution is enacted, upon an affirmative vote of two-thirds of the Members of each House of Congress, waiving subsection (b) for such fiscal year.</text>
 </paragraph><paragraph id="idA686D67AC99D4B0185FE28CD7865DE15"><enum>(2)</enum><header>Single fiscal year</header><text>A bill or joint resolution described in paragraph (1) may only waive subsection (b) for a single fiscal year.</text></paragraph></subsection></section></legis-body>
