		<official-title>To amend the Fair Credit Reporting Act and the Fair Debt Collection Practices Act to delay the
			 inclusion in consumer credit reports and to establish requirements for
			 debt collectors with respect to medical debt information of veterans due
			 to inappropriate or delayed billing payments or reimbursements from the
			 Department of Veterans Affairs, and
			 for other purposes.</official-title>

 <section id="id2369F19F0EA4485F9114FB7C1AA4ADDD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Veterans Credit Act of 2016</short-title></quote>.</text> </section><section id="iddf5dad0a02ae4ed2930817144641e41c"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">The purposes of this Act are—</text>
 <paragraph id="idEC4FBFEB3CFF4BB791FA0CFB555508ED"><enum>(1)</enum><text display-inline="yes-display-inline">to rectify reporting of medical debt included in a consumer report of a veteran due to inappropriate or delayed payment for hospital care or medical services provided in a non-Department of Veterans Affairs facility under the laws administered by the Secretary of Veterans Affairs; and</text>
 </paragraph><paragraph id="idDAD3A49CF4D44BAAB2FFBC1B820D842D"><enum>(2)</enum><text display-inline="yes-display-inline">to clarify the process of debt collection for such medical debt.</text>
			</paragraph></section><section id="idd2c98f64801e42b6ba17672b84f1571a"><enum>3.</enum><header>Amendments to fair credit reporting act</header>
 <subsection id="id42f75595b27c4d12bb0c66a67a003ce9"><enum>(a)</enum><header>Veteran’s medical debt defined</header><text>Section 603 of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681a">15 U.S.C. 1681a</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id6B04D8D067E54C288E778F9485AE6C4C" style="OLC">
 <subsection id="idab24a78223134bcfbc1e92d0e6b366e0"><enum>(z)</enum><header>Veteran</header><text>The term <term>veteran</term> has the meaning given the term in section 101 of title 38, United States Code.</text> </subsection><subsection id="idB933B9BA2AB643A8A54D38CE7BCA81EC"><enum>(aa)</enum><header>Veteran's medical debt</header><text>The term <term>veteran’s medical debt</term> means a debt of a veteran arising from hospital care or medical services, as those terms are defined in section 1701 of title 38, United States Code, provided in a non-Department of Veterans Affairs facility under the laws administered by the Secretary of Veterans Affairs, including under section 1703, 1712, 1712A, 1725, or 1728 of title 38, United States Code.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="id0e0b8efe09c84dd5bcacfc5df1397d61"><enum>(b)</enum><header>Exclusion for veteran’s medical debt</header><text>Section 605(a) of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681c">15 U.S.C. 1681c</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idEACB630C86E54473BB89FFF90FA1A302" style="OLC">
 <paragraph id="id0683e10fc3ee4841ad6a379a3108ad3c"><enum>(7)</enum><text>Any information related to a veteran’s medical debt if the date on which the debt was placed for collection, charged to profit or loss, or subjected to any similar action antedates the report by less than 1 year.</text>
 </paragraph><paragraph id="id4797d249181347c4af21587bffb20bc2"><enum>(8)</enum><text>Any information related to a fully paid or settled veteran’s medical debt that had been characterized as delinquent, charged off, or in collection.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="idbf4d2f05a71a4e6f93b37c56c699a039"><enum>(c)</enum><header>Removal of veteran’s medical debt from consumer report</header><text>Section 611 of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681i">15 U.S.C. 1681i</external-xref>) is amended—</text> <paragraph id="idf1c9649013d0474aa27f220a9cdf8fdf"><enum>(1)</enum><text>in subsection (a)(1)(A), by inserting <quote>and except as provided in subsection (g)</quote> after <quote>subsection (f)</quote>; and</text>
 </paragraph><paragraph id="id66109e5ab17049ba928e687677cbc402"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="idCC81053E3F734DCC89E9F0764F0A5B37" style="OLC"> <subsection id="idec75bd27ca2a4f52bdd72c967652fb8a"><enum>(g)</enum><header>Dispute process for veteran’s medical debt</header> <paragraph id="idD63C5340E36E470B8699113381563AC7"><enum>(1)</enum><header>In general</header><text>With respect to a veteran's medical debt of a consumer, the consumer may submit a notice along with proof of liability of the Department of Veterans Affairs for payment of that debt to a consumer reporting agency or a reseller to dispute the inclusion of that debt on a consumer report of the consumer.</text>
 </paragraph><paragraph id="id90AE3E59AA754F81833D1CA94C971EB3"><enum>(2)</enum><header>Deletion of information from file</header><text>Not later than 30 days after the date on which a notice is received under paragraph (1), the consumer reporting agency shall delete information relating to the veteran’s medical debt from the file of the consumer and notify the furnisher and the consumer of that deletion.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="id8a82231b713b4cf6ab3b7997d589b564"><enum>4.</enum><header>Communications regarding veteran's medical debt</header>
 <subsection id="id3265F171471743FAA7162BDF71397378"><enum>(a)</enum><header>In general</header><text>Section 809 of the Fair Debt Collection Practices Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1692g">15 U.S.C. 1692g</external-xref>) is amended—</text> <paragraph id="id0a6dd5035b5a471986e3da50937a1053"><enum>(1)</enum><text>in subsection (a), in the matter preceding paragraph (1), by inserting <quote>, except for a veteran’s medical debt as described in subsection (f),</quote> after <quote>any debt</quote>; and</text>
 </paragraph><paragraph id="id83d577e9264b486fb15cddd3757f1879"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="id4737D4B58DEA4801BE3F5330CC8DC15D" style="OLC"> <subsection id="idb8e8fb33714c4022bf9dda13bb29eba0"><enum>(f)</enum><header>Veteran’s medical debt</header> <paragraph id="id1F178FB91A2244239E4D4AD8EC8A46EB"><enum>(1)</enum><header>Definitions</header><text>In this subsection—</text>
 <subparagraph id="id50384D000D2442638D82A77DD602CA2E"><enum>(A)</enum><text>the term <term>consumer reporting agency</term> has the meaning given the term in section 603 of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681a">15 U.S.C. 1681a</external-xref>);</text> </subparagraph><subparagraph id="id41AA0FFDF084444FB45195379204DC1C"><enum>(B)</enum><text>the term <term>veteran</term> has the meaning given the term in section 101 of title 38, United States Code; and</text>
								</subparagraph><subparagraph id="idBF18D7127EC84D2E8F4E223396FBBC42"><enum>(C)</enum>
 <text>the term <term>veteran’s medical debt</term> means a debt of a veteran arising from hospital care or medical services, as those terms are defined in section 1701 of title 38, United States Code, provided in a non-Department of Veterans Affairs facility under the laws administered by the Secretary of Veterans Affairs, including under section 1703, 1712, 1712A, 1725, or 1728 of title 38, United States Code.</text>
 </subparagraph></paragraph><paragraph id="id9F9976F20FAD497EA158ECB74C453995"><enum>(2)</enum><header>Communications regarding veteran’s medical debt</header><text>Not later than 5 days after the initial communication with a veteran in connection with the collection of a veteran’s medical debt, a debt collector shall, unless the following information is contained in the initial communication or the veteran has paid the debt, send the veteran a written notice containing—</text>
 <subparagraph id="idd809e88f6dc646a3b6a28cf08f440e50"><enum>(A)</enum><text>the amount of the debt;</text> </subparagraph><subparagraph id="id5891b798f1e04fe49f641f0222c1115e"><enum>(B)</enum><text>the name of the creditor to whom the debt is owed;</text>
 </subparagraph><subparagraph id="idab8fc9e8c807497abde8f81f20aad94a"><enum>(C)</enum><text>a statement that unless the veteran, within 1 year after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;</text>
 </subparagraph><subparagraph id="idccea5166c21d4f25a8da9ed7c4193cff"><enum>(D)</enum><text>a statement that if the veteran notifies the debt collector in writing within the 1-year period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the veteran and a copy of such verification or judgment will be mailed to the veteran by the debt collector;</text>
 </subparagraph><subparagraph id="idcce507b72ba345788beee992f6a1060b"><enum>(E)</enum><text>a statement that, upon the veteran’s written request within the 1-year period, the debt collector will provide the veteran with the name and address of the original creditor, if different from the current creditor;</text>
 </subparagraph><subparagraph id="id85cb7eba50fc4186a36258e560b83ed4"><enum>(F)</enum><text>a statement that the debt collector will not report the debt to a consumer reporting agency until 1 year after the date on which the debt collector sends the statement; and</text>
 </subparagraph><subparagraph id="idbcd58d34aaf045369b71b4ca5e9b7009"><enum>(G)</enum><text>a statement that the consumer may communicate with—</text> <clause id="ide028bf983f4c4c418fe6bcd2e710458b"><enum>(i)</enum><text>an insurance company to determine coverage for the debt;</text>
 </clause><clause id="id66c353b04d4847829f7d8703b5259a9c"><enum>(ii)</enum><text>the Department of Veterans Affairs to determine coverage for the debt or repayment options; or</text> </clause><clause id="id52e7db5190214bb18dab9bd5bcc0547b"><enum>(iii)</enum><text>the provider of the hospital care or medical services from which the debt arises.</text>
 </clause></subparagraph></paragraph><paragraph id="idD696E5C3B0684C4DAED7AD3AB71FBE8A"><enum>(3)</enum><header>Collection of veteran’s medical debt</header><text>If the veteran notifies the debt collector in writing within the 1-year period described in paragraph (2)(D) that the veteran’s medical debt, or any portion thereof, is disputed, or that the veteran requests the name and address of the original creditor, the debt collector shall cease collection of the veteran's medical debt, or any disputed portion thereof, until the debt collector obtains verification of the veteran’s medical debt or a copy of a judgment, or the name and address of the original creditor, and a copy of such verification or judgment, or name and address of the original creditor, is mailed to the veteran by the debt collector. Collection activities and communications that do not otherwise violate this title may continue during the 1-year period referred to in paragraph (2)(D) unless the veteran has notified the debt collector in writing that the veteran’s medical debt, or any portion of the debt, is disputed or that the veteran requests the name and address of the original creditor. Any collection activities and communication during the 1-year period may not overshadow or be inconsistent with the disclosure of the veteran’s right to dispute the veteran’s medical debt or request the name and address of the original creditor.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection></section><section id="id072b73d076814fc7b712f52690f5c30a"><enum>5.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendments made by this Act shall take effect on the date that is 90 days after the date of enactment of this Act.</text>
