			<subsection id="idBF9BF9C0A2074DBEA76519DFC5EBCECF"><enum>(a)</enum><header>Short title</header>
 <text display-inline="yes-display-inline">This Act may be cited as the <quote><short-title>Stronger Way Act</short-title></quote>.</text>
 </subsection><subsection id="id7ECA654F41C847A8AE5E3DF0055D11D6"><enum>(b)</enum><header>Table of contents</header><text>The table of contents of this Act is as follows:</text><toc><toc-entry idref="S1" level="section">Sec. 1. Establishment of fully refundable child tax credit.</toc-entry> </toc> </subsection></section><title id="idC57558FCA6D94DF5ADE4CDF191FBD741" style="OLC"><enum>I</enum><header>Transitional jobs program</header> <section id="id1E59A221026E4647819411C0F5D720E6"><enum>101.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of the transitional jobs program under this title are to—</text>
 <paragraph id="id7BB784FBA4574748BB125A809D8C3E81"><enum>(1)</enum><text display-inline="yes-display-inline">reduce poverty and unemployment;</text> </paragraph><paragraph id="idB4531254B3C34D10AC54B5E169B2147B"><enum>(2)</enum><text display-inline="yes-display-inline">offer unemployed or partially employed individuals, in any local area in a State, the opportunity to work in a transitional job for the purpose of enabling such individuals to gain, through wage-paying jobs, the experience and skills needed to move into regular employment; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB3CC9E1EF6004785B5CB2BA9F376B0A2"><enum>(3)</enum><text>assist employers to create new regular employment.</text> </paragraph></section><section id="idC2F19E4FAC3A41A18524AE9B035653EC"><enum>102.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>
 <paragraph id="id17c947e9b6114669ba8ac37ddce14075"><enum>(1)</enum><header>Employer of record</header><text>The term <term>employer of record</term> means a local government, nonprofit, or for-profit entity selected under section 103(c)(3)(A) to carry out the responsibilities described in section 103(d).</text>
 </paragraph><paragraph id="id6e7032127844447b934f4b7d5504b17f"><enum>(2)</enum><header>Host site employer</header><text>The term <term>host site employer</term> means an employer that—</text> <subparagraph id="id6F70CEBE316742449D7EA501AA413935"><enum>(A)</enum><text>provides an individual who is eligible for a transitional job with the opportunity to work in a specific transitional job for which the individual is qualified, as determined by such employer, at a worksite that is under the direct supervision of such employer; and</text>
 </subparagraph><subparagraph id="id41199B244E0A4DC9B489AFD5D24FAC0D"><enum>(B)</enum><text>agrees to be responsible for—</text>
 <clause id="idc3e5c1874e1a4be481bf6f86cba596cc"><enum>(i)</enum><text>selecting, training, and supervising the transitional jobs worker, including providing a written job description, initial training, ongoing management, and periodic performance reviews;</text>
 </clause><clause id="id68f8146d02cb478f80794fee078b468a"><enum>(ii)</enum><text>certifying to the employer of record, in the manner prescribed by the Secretary, the number of hours that the transitional jobs worker has worked for the host site employer; and</text>
 </clause><clause id="id4b98a3c1d1354e29ae24dcbd9862f41f"><enum>(iii)</enum><text>cooperating with the employer of record in facilitating the movement of the transitional jobs worker into regular employment.</text>
 </clause></subparagraph></paragraph><paragraph id="idab135f22c13b4d91a18ecd6038ff4b8f"><enum>(3)</enum><header>Local area</header><text>The term <term>local area</term> means a city, county, or other general purpose political subdivision of a State.</text> </paragraph><paragraph id="idC98A1B0E717E4C0AB00A7B20FDFC269C"><enum>(4)</enum><header>Regular employment</header><text>The term <term>regular employment</term> means regular, unsubsidized employment, as defined by the Secretary.</text>
 </paragraph><paragraph id="idD3996B789CB94D11A86BEC46D53E52D5"><enum>(5)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Labor.</text> </paragraph><paragraph id="id3831EB384C034725BF593581468BAA4B"><enum>(6)</enum><header>State</header><text>The term <term>State</term> means each of the several States of the United States, the District of Columbia, and the Commonwealth of Puerto Rico.</text>
 </paragraph><paragraph id="idcf36f9ab332147f0af8641e246e20ada"><enum>(7)</enum><header>Transitional job</header><text>The term <term>transitional job</term> means a job offered to an eligible individual through the program authorized under section 103 that—</text>
 <subparagraph id="id3E302514FD1C403D9DBCA96C9B27CE5A"><enum>(A)</enum><text>provides the rate of pay described in section 103(d)(6); and</text> </subparagraph><subparagraph id="id4F0B63D59D754E13A749BB0865DAFECB"><enum>(B)</enum><text>provides the individual with employment of—</text>
 <clause id="id881aee35ef254023bad403cf025a0b4c"><enum>(i)</enum><text>not less than 16 hours per week; and</text> </clause><clause commented="no" display-inline="no-display-inline" id="idbb28f9bd27664d758c6a6990cf83feae"><enum>(ii)</enum><text>not more than 40 hours per week, when combined with any hours per week of work that the individual is employed through any other employer (if applicable).</text>
						</clause></subparagraph></paragraph></section><section id="idac8f6d46ee6d45dca56faeb46e1f61ca"><enum>103.</enum><header>Transitional jobs</header>
 <subsection id="id9a37c066d1544ef88502c2cb5fea7781"><enum>(a)</enum><header>Program authorized</header><text>From amounts made available under section 104, the Secretary shall establish a program, through grant agreements described in subsection (c) with State and local government agencies, that provides eligible unemployed or partially employed individuals with opportunities to work in a transitional job for the purpose of enabling such individuals to gain, through wage-paying jobs, the experience and skills needed to move into regular employment.</text>
 </subsection><subsection id="id6e99c88d38b24a79b0468162cc04bd5e"><enum>(b)</enum><header>Eligibility</header><text>To be eligible for a transitional job, an individual shall—</text> <paragraph id="id02b83eeaeeb145f5836957de3b35d7e5"><enum>(1)</enum><text>be a resident of the United States, and a resident of the State in which the individual applies for a transitional job;</text>
 </paragraph><paragraph id="id9114d9af72ed4b0997af29ab32a7ed46"><enum>(2)</enum><text>be not less than 18 years of age;</text> </paragraph><paragraph id="id3ecfad1c5dca47df866700bd16ae40d4"><enum>(3)</enum><text>not be incarcerated in any Federal or State penal institution, unless the individual is participating in a work-release program authorized by the United States or a State and the United States or the State authorizes employment under this circumstance in a transitional job; and</text>
 </paragraph><paragraph id="id108e71609c9643b4b230c761adbf5dd0"><enum>(4)</enum><text>be unemployed, or employed for less than 30 hours per week, for not less than 4 consecutive weeks preceding the individual's application for a transitional job.</text>
					</paragraph></subsection><subsection id="id07E36B0FF13046FC8A2D42447539A6AA"><enum>(c)</enum><header>Transitional jobs program administration</header>
 <paragraph id="idA859D7DFF73E4C95ABC827EA42D86534"><enum>(1)</enum><header>In general</header><text>The Secretary shall enter into agreements with State and local government agencies under which—</text> <subparagraph id="idC6C030CB0CE742978CDB0F4DC602C2E4"><enum>(A)</enum><text>the State and local government agencies carry out all activities described in paragraph (3); and</text>
 </subparagraph><subparagraph id="id8DF50D033E084F13A9784EC88254E92A"><enum>(B)</enum><text>the Secretary provides grants to the State and local government agencies to carry out such activities.</text>
 </subparagraph></paragraph><paragraph id="id08A5191A60BD498AA3378A2622EF2B20"><enum>(2)</enum><header>Selection criteria</header><text>The Secretary shall select State and local government agencies for the agreements described in paragraph (1) based on—</text>
 <subparagraph id="id0A6C9007E6F947CBA7E76495F6C1CB11"><enum>(A)</enum><text>the agencies' level of experience and commitment to transitional jobs programs; and</text>
 </subparagraph><subparagraph id="id713728F9976A46BD822508913C0899C4"><enum>(B)</enum><text>such other criteria as the Secretary determines appropriate, which may include criteria relating to the implementation by such agencies of transitional jobs program models under this title.</text>
 </subparagraph></paragraph><paragraph id="id815E03F75B184D54950BE81AE73F4929"><enum>(3)</enum><header>Activities</header><text>The activities described in this paragraph are the following:</text> <subparagraph id="id8555c867b95b48d697d3fc0cb34057d8"><enum>(A)</enum><text>Select, on a competitive basis, and enter into a contract with one or more local government, nonprofit, or for-profit entities to—</text>
 <clause id="id743E69A8BB384A03A129FAB0A2912AE5"><enum>(i)</enum><text>administer the transitional jobs program in the State or local area to be served; and</text>
 </clause><clause id="id5A8C2D85E2814B0CA54033C66776889B"><enum>(ii)</enum><text>function as the employer of record described in subsection (d).</text>
 </clause></subparagraph><subparagraph id="id916a6660f0764ec286f0742cc950ccec"><enum>(B)</enum><text>Pay each entity selected to serve as an employer of record, based upon the terms of the contract and full documentation of performance, for the entity's performance of its contractually defined services in administering the transitional jobs program, including reimbursement of the entity for appropriate wages and taxes the entity has paid, as required under paragraphs (6) and (7) of subsection (d), to or on behalf of eligible individuals who worked in transitional jobs in the entity's capacity as an employer of record. A State or local governmental agency may require a host employer to pay a portion of the appropriate wages and taxes for the individual.</text>
 </subparagraph><subparagraph id="id3cb42239fd9648b3bc17bdd932088d20"><enum>(C)</enum><text>Cooperate with the Comptroller General of the United States, the Congressional Budget Office, and other Federal and State agencies in the performance of audits and the conduct of fiscal and programmatic oversight.</text>
 </subparagraph><subparagraph id="idF7F9C1C27F9346438B4549E6DC780A98"><enum>(D)</enum><text>Annually submit to the Secretary, and to the governor or other chief executive officer of the State in which the program is located, and the State legislature, a report on the State or local government agency's role and accomplishments in the operation of the transitional jobs program, in a format specified by the Secretary.</text>
 </subparagraph><subparagraph id="idEB3BB24CD2CD4D64AE8BB2FE7D40F84B"><enum>(E)</enum><text>Conduct, or enter into arrangements with independent academic or research organizations to conduct, periodic evaluations of the effectiveness of the program within the State or local area served in—</text>
 <clause id="id291C505D4D5E47B4B8F631B0A9161BC1"><enum>(i)</enum><text>reducing poverty and unemployment;</text> </clause><clause id="id63DA0D1327394FA8BD28BFAF4D573BA8"><enum>(ii)</enum><text>enabling unemployed and underemployed individuals to gain the experience and skills needed to move into regular employment; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id5463AC48AFE7460488D4938524AEF4BD"><enum>(iii)</enum><text>assisting employers in creating new regular employment.</text>
 </clause></subparagraph><subparagraph id="idd6f7d1b1f1a94d9e899fb67c01dd89d5"><enum>(F)</enum><text>Promulgate any rules necessary for the agency's operation of the transitional jobs program.</text> </subparagraph></paragraph><paragraph id="idDED0A2D459DB433DB3A83F7ECDA0B774"><enum>(4)</enum><header>Scope of program</header> <subparagraph id="idEAB9A036F2684DEDA9C799823FF8E9F8"><enum>(A)</enum><header>In general</header><text>The Secretary shall, to the greatest extent practicable and subject to the availability of appropriations, ensure that the agreements described in paragraph (1) make the transitional jobs program available to eligible individuals in all local areas of all States.</text>
 </subparagraph><subparagraph id="id3D66CD8C4709425EB21E92F8406F8297"><enum>(B)</enum><header>Individuals with significant barriers to employment</header><text>Notwithstanding subparagraph (A), a State or local government agency entering into an agreement under paragraph (1) may, in carrying out the activities described in paragraph (3), choose to target the assistance to eligible individuals under subsection (b) who have significant barriers to employment.</text>
 </subparagraph><subparagraph id="id3341A62724DA4F7C8EB07619EEF805DC"><enum>(C)</enum><header>Use of existing systems</header><text>A State or local government agency entering into an agreement under paragraph (1) may carry out the activities described in paragraph (3) through, or in alignment with, other subsidized employment and job training activities or systems available within the State or local area.</text>
 </subparagraph></paragraph></subsection><subsection id="id909daa6d47684becb8c6118b8a387e90"><enum>(d)</enum><header>Responsibilities of an employer of record</header><text>Each local government, nonprofit, or for-profit entity selected to serve as an employer of record under subsection (c)(3)(A) shall do each of the following:</text>
 <paragraph id="id803c61b2adad42a8bb49a5ce8c1209ef"><enum>(1)</enum><text>Determine the eligibility of individuals applying for the transitional jobs program under this title.</text>
 </paragraph><paragraph id="ida65851f46b2944dab40a0d05e78710d9"><enum>(2)</enum><text>Conduct orientation activities for individuals that the employer of record has determined are eligible for the transitional jobs program.</text>
 </paragraph><paragraph id="ida0cd3b48b6d041f3bcd369e4bb7b4a25"><enum>(3)</enum><text>Assess the education, prior work experience, and other relevant factors of each eligible individual who requests a transitional job, for the purpose of assisting the individual to be successful in applying for and performing well in a specific transitional job.</text>
 </paragraph><paragraph id="id19C6A8AE123C477E83BA2389211C578D"><enum>(4)</enum><text>Connect each eligible individual requesting a transitional job to the one-stop delivery system established under section 121(e) of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3151">29 U.S.C. 3151(e)</external-xref>), and to other resources that provide assistance to job seekers.</text>
 </paragraph><paragraph id="id3521b4a4f3d343ee96305b9b86fd67a2"><enum>(5)</enum><text>Offer each eligible individual who desires to work in a transitional job and meets the eligibility requirements under paragraphs (1) through (4) of subsection (b) the opportunity to work for a host site employer. The host site employer may be—</text>
 <subparagraph id="idF75F589441164FF88860612912699C25"><enum>(A)</enum><text>the employer of record; or</text>
 </subparagraph><subparagraph id="id01CAA3A30AE84674B1AD721070569D4E"><enum>(B)</enum><text>another organization that has entered into an agreement with the employer of record, and as part of such agreement, agrees to function as, and meet the responsibilities of, a host site employer, for a period not to exceed 30 weeks, subject to the requirements of subsection (e).</text>
 </subparagraph></paragraph><paragraph id="id2147387656654d7b960ed62f9c0c1777"><enum>(6)</enum><text>Pay each individual described in paragraph (5), for each hour of work performed for the host site employer, an amount at a rate of pay that is equal to, or greater than, the greater of—</text>
 <subparagraph id="id12825012956A4CBDA14B33F56BF8F14A"><enum>(A)</enum><text>the minimum wage rate applicable in the State in which the applicable position is located;</text> </subparagraph><subparagraph id="id1F85F034D643435B8C7572CD4DEF284F"><enum>(B)</enum><text>the wage rate applicable under section 6 of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/206">29 U.S.C. 206</external-xref>); or</text>
 </subparagraph><subparagraph id="id83874F7093F04D7D8288BBD78D4668F6"><enum>(C)</enum><text>if the State or local governmental agency determines appropriate, the prevailing wage rate, as determined by the State or local governmental agency, for the type of work performed by the individual.</text>
 </subparagraph></paragraph><paragraph id="idc16c284fa1f344508afbe8b1a8075c59"><enum>(7)</enum><text>With respect to the employment of each individual described in paragraph (5)—</text> <subparagraph id="idad1da70034c84ef5ab8c8bf99e25ef6f"><enum>(A)</enum><text>pay any applicable Federal taxes for employers, including the employer taxes imposed under sections 3111, 3221, and 3301 of the Internal Revenue Code of 1986;</text>
 </subparagraph><subparagraph id="id9E2BCBD6FFFD410B818CC478CFAAF490"><enum>(B)</enum><text>pay any other State or local government taxes that employers in the relevant State or local area are required to pay;</text>
 </subparagraph><subparagraph id="id0e7de6b71f624ccb97812e7530701e94"><enum>(C)</enum><text>withhold from the individual’s earnings the taxes imposed under sections 3101 and 3201 of the Internal Revenue Code of 1986, and any other Federal, State or local tax required to be withheld for employees;</text>
 </subparagraph><subparagraph commented="no" id="id3eda3d7e4dee44e6acf131501c041b80"><enum>(D)</enum><text>complete and submit to the appropriate government agencies, all required Federal, State, or local tax-related and employment-related forms that an employer would typically submit, including by ensuring that each individual provides the information necessary for the completion of such forms;</text>
 </subparagraph><subparagraph id="idee959e273dc340d4bae547778d1908cf"><enum>(E)</enum><text>provide the individual with a Form W–2 Wage and Tax Statement for the calendar year;</text> </subparagraph><subparagraph id="id8c0a4f2bb01144d5ab13d1dc9b4bddac"><enum>(F)</enum><text>provide for workers' compensation coverage for the individual under the applicable Federal and State workers’ compensation laws;</text>
 </subparagraph><subparagraph id="idc8735e6bf492425d8e69a6a1bf26bb8b"><enum>(G)</enum><text>perform, either directly or through an agreement described in paragraph (5)(B) with a host site employer, all other functions that an employer would typically perform;</text>
 </subparagraph><subparagraph id="id986683ECB1604513BC0C1B73C4AC1A0F"><enum>(H)</enum><text>comply with the requirements for providing health insurance coverage under the Patient Protection and Affordable Care Act (<external-xref legal-doc="public-law" parsable-cite="pl/111/148">Public Law 111–148</external-xref>), including the amendments made by such Act; and</text>
 </subparagraph><subparagraph id="idE78BA8B6BE9B44C08F44BF7980E0C505"><enum>(I)</enum><text>provide any benefits that are otherwise required of employers in the relevant State or local area.</text> </subparagraph></paragraph><paragraph id="ida866a96fbb914436b5dc8d59e279f37b"><enum>(8)</enum><text>Ensure that no transitional job would result in a violation of any of the worker protections provided in subsection (f).</text>
					</paragraph></subsection><subsection id="id540f908e61404dedb5fc776d60bcde6a"><enum>(e)</enum><header>Duration of transitional job</header>
 <paragraph id="id764EA9771C5746F1911EA05EBFF4BFCE"><enum>(1)</enum><header>In general</header><text>An individual may work in a transitional job for a period not to exceed 30 weeks, as long as—</text>
 <subparagraph id="id66402A672717480C9B6BEA757866458A"><enum>(A)</enum><text>the individual continues to meet the eligibility requirements for a transitional job under paragraphs (1) through (3) of subsection (b);</text>
 </subparagraph><subparagraph id="id34242af465e54d06b2db9f033cb46df7"><enum>(B)</enum><text>the individual, during the period of employment in the transitional job, pursues efforts to replace hours of work in the transitional job with regular employment;</text>
 </subparagraph><subparagraph id="idAED14C97125D427EAC797DC982623056"><enum>(C)</enum><text>the individual has not—</text> <clause id="id956321C650144EDB8E1FEFFA381C1CEC"><enum>(i)</enum><text>obtained regular employment that consistently equals or exceeds 30 hours of work per week; or</text>
 </clause><clause id="idAA68D348D53B4A76BF62098F37F4D0B8"><enum>(ii)</enum><text>turned down any appropriate offer for such regular employment, as determined by the Secretary; and</text> </clause></subparagraph><subparagraph id="idDE77973E24034756A9348D3D6ADD7269"><enum>(D)</enum><text>if the individual receives and accepts an appropriate offer for such regular employment, the individual does not postpone the starting date for such employment beyond the earliest date practicable, as determined by the Secretary, even if such date occurs before the individual has reached the maximum transitional job time period of 30 weeks.</text>
 </subparagraph></paragraph><paragraph id="idbe7f3657f6854dc88f6c2e741c664c1f"><enum>(2)</enum><header>Additional transitional job</header><text>A State or local government agency administering a transitional jobs program under this section shall, subject to the availability of funds, allow an individual who has completed the maximum number of weeks in a transitional job an opportunity to work in a different transitional job, under the same terms and conditions established under this section, if the individual—</text>
 <subparagraph id="id355133e3b2db4d508760ea3cdc04402b"><enum>(A)</enum><text>is unable, after the end of 30 weeks of employment in a transitional job, to find regular employment that consistently equals or exceeds 30 hours per week;</text>
 </subparagraph><subparagraph id="id6fc26ce3181742d5891f0a590f508fea"><enum>(B)</enum><text>engages in an intensive job search, as defined by the Secretary, for not less than 4 consecutive weeks following the completion of a transitional job, and remains unable to find regular employment; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9da541ea41ce41b6a9436a56864f0336"><enum>(C)</enum><text>meets the eligibility requirements under paragraphs (1) through (4) of subsection (b).</text> </subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idAEB626142B444F83B3233D5891D52694"><enum>(f)</enum><header>Worker protections</header> <paragraph id="ID8554BD02F6604F7E89C2AC73FB8BE4E1"><enum>(1)</enum><header>Prohibition against violation of contracts</header><text>A transitional job shall not violate an existing contract for services or a collective bargaining agreement, and a transitional job that would violate a collective bargaining agreement shall not be undertaken without the written concurrence of the labor organization and employer concerned.</text>
 </paragraph><paragraph id="IDDDDC937290774746A9424AEFAB71E7D2"><enum>(2)</enum><header>Other prohibitions</header><text>An individual described in subsection (d)(5) shall not be assigned to a transitional job—</text> <subparagraph id="ID5F2F4EE3FBB94207BB63FC2371EFDE09"><enum>(A)</enum><text>when any other individual is on layoff from the same or any substantially equivalent job;</text>
 </subparagraph><subparagraph id="IDAE7BB31846CF43F0BDD7A37DA4636F27"><enum>(B)</enum><text>if the employer has terminated the employment of any regular employee or otherwise caused an involuntary reduction in its workforce with the intention of filling the vacancy so created with the individual working in the transitional job; or</text>
 </subparagraph><subparagraph id="IDFFDFF2C8E32248E4B3EEF31B0DC828AE"><enum>(C)</enum><text>if the employer has caused an involuntary reduction to less than full time in hours of any employee in the same or a substantially equivalent job.</text>
 </subparagraph></paragraph></subsection><subsection id="id1f69e4e6ad8c417984b5a0d7b62fc723"><enum>(g)</enum><header>Evaluations</header><text>The Secretary may reserve not more than a total of 10 percent of the amounts made available under section 104 for—</text>
 <paragraph id="idC7C3D31AB3574F2CB00B34B54A076793"><enum>(1)</enum><text>evaluations of transitional jobs program models implemented with grants awarded under this title; and</text>
 </paragraph><paragraph id="id5529CE1865E44E4C9AFC1E4995D25345"><enum>(2)</enum><text>other evaluations of grants and activities carried out under this title.</text> </paragraph></subsection></section><section id="ide5d50c0081a24852b4e6e2b575a58e2e"><enum>104.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated to carry out this title such sums as may be necessary.</text>
			</section></title><title id="idAA031C8D816D44E4BCBCE9899626513E" style="OLC"><enum>II</enum><header>Poverty reduction tax credits</header>
			<section commented="no" id="idB1FD6CCA2B5D4454985D64F4DFF3C80F"><enum>201.</enum><header>Reform of earned income credit</header>
 <subsection commented="no" id="id1794EE283906451D986E10269161B169"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/32">Section 32</external-xref> of the Internal Revenue Code of 1986 is amended—</text> <paragraph commented="no" id="id74DB5187953F4A01A084140980DFC3E5"><enum>(1)</enum><text>by amending subsection (b) to read as follows:</text>

 <clause id="idB5D117B0795B46D2BD9EC541CA50ABD3"><enum>(i)</enum><header>In general</header><text>Except as provided in clause (ii), in the case of a joint return filed by an eligible individual and such individual's spouse, the phaseout amount determined under subparagraph (A) shall be increased by $5,550.</text>
 </clause><clause id="idCC3F59C4A2C54F42864E8825F717253C"><enum>(ii)</enum><header>Taxpayers with no qualifying children</header><text>In the case of a joint return filed by an eligible individual and such individual’s spouse who do not have a qualifying child for the taxable year, the phaseout amount in the third column of the first row of the table in subparagraph (A) shall be increased by $8,000.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>,</after-quoted-block></quoted-block>
 </paragraph><paragraph commented="no" id="idF61773499BD04CD7A978C8D96E33327B"><enum>(2)</enum><text>in subclause (II) of subsection (c)(1)(A)(ii), by striking <quote>attained age 25 but not attained age 65</quote> and inserting <quote>attained age 21 but not attained age 67</quote>, and</text> </paragraph><paragraph commented="no" id="idAAD1CB849648451181C1FAF215FCA5C1"><enum>(3)</enum><text>by amending subsection (j) to read as follows:</text>

 <paragraph commented="no" id="id1B6416C3033B4D88878E51DC1E14DA9C"><enum>(1)</enum><header>In general</header><text>In the case of any taxable year beginning after 2017, each of the dollar amounts in subparagraph (A) of subsection (b)(2) (after being increased under subparagraph (B) thereof) shall be increased by an amount equal to—</text>
 <subparagraph commented="no" id="id8FF422CC94524D43B14FEC9AC485DC62"><enum>(A)</enum><text>such dollar amount, multiplied by</text> </subparagraph><subparagraph commented="no" id="id1C1526CF3C464B2987C08C91FECE6476"><enum>(B)</enum><text>the cost-of-living adjustment determined under section 1(f)(3) for the calendar year in which the taxable year begins, determined by substituting <quote>calendar year 2016</quote> for <quote>calendar year 1992</quote> in subparagraph (B) thereof.</text>
 </subparagraph></paragraph><paragraph commented="no" id="id65B00D510D954524A171CD6CA607DEE5"><enum>(2)</enum><header>Rounding</header><text>If any dollar amount increased under paragraph (1) is not a multiple of $50, such dollar amount shall be rounded to the nearest multiple of $50.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection commented="no" id="idBA5147A2B9CF49E6BF4F94F4257268AA"><enum>(b)</enum><header>Effective date</header><text>The amendments made by this section shall apply to taxable years beginning after December 31, 2016.</text> </subsection></section><section commented="no" id="id135C2F44CFD74A67B8591406D81A56A4"><enum>202.</enum><header>Establishment of fully refundable child tax credit</header> <subsection commented="no" id="idB90EBF5E187C45DDBAEFEDA594A5BF8E"><enum>(a)</enum><header>Elimination of existing child tax credit</header><text>Subpart A of part IV of subchapter A of chapter 1 of subtitle A of the Internal Revenue Code of 1986 is amended by striking section 24.</text>
 </subsection><subsection commented="no" id="idB4B04F866D8640E281D74FABB6771A28"><enum>(b)</enum><header>Establishment of fully refundable child tax credit</header><text>Subpart C of part IV of subchapter A of chapter 1 of subtitle A of such Code is amended by inserting after section 36B the following new section:</text>
					<quoted-block display-inline="no-display-inline" id="id098B37A9BB95407D96FA1CBF6AE22C6F" style="OLC">
						<section commented="no" id="id1EB41F2A301A46E482C1A7D94B8932FF"><enum>36C.</enum><header>Child tax credit</header>
 <subsection commented="no" id="id5E6D8E0814484E4E8CAED7E70E6B48B7"><enum>(a)</enum><header>Allowance of credit</header><text>In the case of a taxpayer with a qualifying child, there shall be allowed as a credit against the tax imposed by this subtitle for the taxable year an amount equal to 15 percent of the taxpayer's earned income (within the meaning of section 32) which is taken into account in computing taxable income for the taxable year.</text>
							</subsection><subsection commented="no" id="id98EA7B81528E4F5EA0ED37A909BF68C3"><enum>(b)</enum><header>Limitation</header>
 <paragraph commented="no" id="idFED737B79E6E437E817D9BA35814BCBB"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), the amount of the credit allowable to a taxpayer by subsection (a) for the taxable year shall not exceed an amount equal to the product of $1,000 and the number of qualifying children of the taxpayer.</text>
								</paragraph><paragraph commented="no" id="idDC851B56A627446AA358F2C90C6A46DA"><enum>(2)</enum><header>Reduction based on modified adjusted gross income</header>
 <subparagraph commented="no" id="id59CBA6CA2170415099C342CC84C6C7A4"><enum>(A)</enum><header>In general</header><text>The amount which would (but for this paragraph) be allowable as a credit under this subsection shall be reduced (but not below zero) by $50 for each $1,000 (or fraction thereof) by which the taxpayer's modified adjusted gross income exceeds—</text>
 <clause commented="no" id="id04992EE4701F48D486CC37B7D04B1125"><enum>(i)</enum><text>$110,000 in the case of a joint return,</text> </clause><clause commented="no" id="id27F22B58DD40426392135B98DF9A3A5A"><enum>(ii)</enum><text>$75,000 in the case of an individual who is not married, and</text>
 </clause><clause commented="no" id="id96BAAAC8D03B4D2C9CD658A537C56852"><enum>(iii)</enum><text>$55,000 in the case of a married individual filing a separate return.</text> </clause></subparagraph><subparagraph commented="no" id="idCD633B431EBB4E3AB81C1D961C376426"><enum>(B)</enum><header>Marital status</header><text>For purposes of this paragraph, marital status shall be determined under section 7703.</text>
									</subparagraph></paragraph></subsection><subsection commented="no" id="id38BCCC774C7845CAB2ADD2F59073B690"><enum>(c)</enum><header>Qualifying child</header>
 <paragraph commented="no" id="id1659430A539C49C28A5C1829059F21FC"><enum>(1)</enum><header>In general</header><text>In this section, the term <term>qualifying child</term> means a qualifying child of the taxpayer (as defined in section 152(c)) who has not attained age 17.</text>
 </paragraph><paragraph commented="no" id="id54889E947121478080F07FD7467687D9"><enum>(2)</enum><header>Exception for certain non-citizens</header><text>The term <quote>qualifying child</quote> shall not include any individual who would not be a dependent if subparagraph (A) of section 152(b)(3) were applied without regard to all that follows <quote>resident of the United States</quote>.</text>
 </paragraph></subsection><subsection commented="no" id="id3AB6664991334CC7AFC9F707D99E2722"><enum>(d)</enum><header>Modified adjusted gross income</header><text>In this section, the term <term>modified adjusted gross income</term> means adjusted gross income increased by any amount excluded from gross income under section 911, 931, or 933.</text>
							</subsection><subsection commented="no" id="idDE7E1AEBFD53494389DB73D9AC5C8FF7"><enum>(e)</enum><header>Inflation adjustment</header>
 <paragraph commented="no" id="idAF8A2782FB7640C88E69B9CC8DA67D2B"><enum>(1)</enum><header>In general</header><text>In the case of any taxable year beginning after 2017, the $1,000 amount in subsection (b)(1) shall be increased by an amount equal to—</text>
 <subparagraph commented="no" id="id4E146E973F8B442586DE6215B6F78809"><enum>(A)</enum><text>such dollar amount, multiplied by</text> </subparagraph><subparagraph commented="no" id="id8C50AE4F364A4146A6087ED6E31150EE"><enum>(B)</enum><text>the cost-of-living adjustment determined under section 1(f)(3) for the calendar year in which the taxable year begins determined by substituting <quote>calendar year 2016</quote> for <quote>calendar year 1992</quote> in subparagraph (B) thereof.</text>
 </subparagraph></paragraph><paragraph commented="no" id="id39A79C72DCB54D50966CDAAE0AAA8C33"><enum>(2)</enum><header>Rounding</header><text>If any increase determined under paragraph (1) is not a multiple of $50, such increase shall be rounded to the nearest multiple of $50.</text>
								</paragraph></subsection><subsection commented="no" id="id046F0FDA032544A0B6CE61E5E824811F"><enum>(f)</enum><header>Identification requirement</header>
 <paragraph commented="no" id="idA64FE2C5B80A4F27874F7FAADEE8944C"><enum>(1)</enum><header>Qualifying child identification requirement</header><text>No credit shall be allowed under this section to a taxpayer with respect to any qualifying child unless the taxpayer includes the name and taxpayer identification number of such qualifying child on the return of tax for the taxable year and such taxpayer identification number was issued on or before the due date for filing such return.</text>
 </paragraph><paragraph commented="no" id="id0DC42FE4A2B748AB8BD44F2E0C1C203F"><enum>(2)</enum><header>Taxpayer identification requirement</header><text>No credit shall be allowed under this section if the identifying number of the taxpayer was issued after the due date for filing the return for the taxable year.</text>
 </paragraph></subsection><subsection commented="no" id="id45C45BB47B7B4F5C8D6E774788F76870"><enum>(g)</enum><header>Taxable year must be full taxable year</header><text>Except in the case of a taxable year closed by reason of the death of the taxpayer, no credit shall be allowable under this section in the case of a taxable year covering a period of less than 12 months.</text>
							</subsection><subsection commented="no" id="id55BC0C1554A14626AC3052FF09CAB1EF"><enum>(h)</enum><header>Restrictions on taxpayers who improperly claimed credit in prior year</header>
								<paragraph commented="no" id="id023ED1CFBAE045B0A035A71D891A810F"><enum>(1)</enum><header>Taxpayers making prior fraudulent or reckless claims</header>
 <subparagraph commented="no" id="id2EFFE93334BF461CAB2CBE4895DD28D7"><enum>(A)</enum><header>In general</header><text>No credit shall be allowed under this section for any taxable year in the disallowance period.</text> </subparagraph><subparagraph commented="no" id="idFDE0B68991944F20A5D5A075836BA679"><enum>(B)</enum><header>Disallowance period</header><text>For purposes of subparagraph (A), the disallowance period is—</text>
 <clause commented="no" id="id6D1F27F8FDDB489DA5FED9705526A7C2"><enum>(i)</enum><text>the period of 10 taxable years after the most recent taxable year for which there was a final determination that the taxpayer's claim of credit under this section was due to fraud, and</text>
 </clause><clause commented="no" id="idB2C119D19E454CF381E4AA35B88F64CF"><enum>(ii)</enum><text>the period of 2 taxable years after the most recent taxable year for which there was a final determination that the taxpayer's claim of credit under this section was due to reckless or intentional disregard of rules and regulations (but not due to fraud).</text>
 </clause></subparagraph></paragraph><paragraph commented="no" id="id4950A845E3084BCC9EFF99196A992D17"><enum>(2)</enum><header>Taxpayers making improper prior claims</header><text>In the case of a taxpayer who is denied credit under this section for any taxable year as a result of the deficiency procedures under subchapter B of chapter 63, no credit shall be allowed under this section for any subsequent taxable year unless the taxpayer provides such information as the Secretary may require to demonstrate eligibility for such credit.</text>
								</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection commented="no" id="id0F924AC215E84E07A34C9EB2C37F9511"><enum>(c)</enum><header>Conforming amendments</header>
 <paragraph commented="no" id="id9CA9CB94A9C54A7791A3D6436E75DBB5"><enum>(1)</enum><text>The table of sections for subpart A of part IV of subchapter A of chapter 1 of subtitle A of the Internal Revenue Code of 1986 is amended by striking the item relating to section 24.</text>
 </paragraph><paragraph commented="no" id="id98255B8A4069445B86BAD9484A18DBDE"><enum>(2)</enum><text>The table of sections for subpart C of part IV of subchapter A of chapter 1 of subtitle A of such Code is amended by inserting after the item relating to section 36B the following:</text><toc><toc-entry bold="off" level="section"><quote>Sec. 36C. Child tax credit.</quote>.</toc-entry></toc>
 </paragraph><paragraph commented="no" id="id4AA953395B974EF4A24EE70E46C02E66"><enum>(3)</enum><text>Subparagraph (B) of section 45R(f)(3) of such Code is amended to read as follows:</text> <quoted-block display-inline="no-display-inline" id="id24FE20817C1949E4B88C2C65F67CCD75" style="OLC"> <subparagraph commented="no" id="id8D08D0F763C6449A8C78A59BB930A4E3"><enum>(B)</enum><header>Special rule</header><text>Any amounts paid pursuant to an agreement under section 3121(l) (relating to agreements entered into by American employers with respect to foreign affiliates) which are equivalent to the taxes referred to in subparagraph (A) shall be treated as taxes referred to in such subparagraph.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph><paragraph commented="no" id="id4D2DA3BEE5C54419A74D1D4CAF3F8F73"><enum>(4)</enum><text>Section 152(f)(6)(B)(ii) of such Code is amended by striking <quote>section 24</quote> and inserting <quote>section 36C</quote>.</text> </paragraph><paragraph commented="no" id="id41ABDC7DEE0E4A1582B3FAFCED3CB747"><enum>(5)</enum><text>Paragraph (26) of section 501(c) of such Code is amended in the flush matter at the end by striking <quote>section 24(c)</quote> and inserting <quote>section 36C(c)</quote>.</text>
 </paragraph><paragraph commented="no" id="id5342446403D7491C8B31C354FA08D5A4"><enum>(6)</enum><text>Section 6211(b)(4)(A) of such Code is amended by inserting <quote>36C,</quote> after <quote>36B,</quote>.</text> </paragraph><paragraph commented="no" id="idBDC70F9AFBFD44938CEA4952DA37705B"><enum>(7)</enum><text>Section 6213(g)(2) of such Code is amended—</text>
 <subparagraph commented="no" id="id3E722CC663C7483ABAD365056BA04D47"><enum>(A)</enum><text>in subparagraph (I), by striking <quote>section 24(e)</quote> and inserting <quote>section 36C(d)</quote>, and</text> </subparagraph><subparagraph commented="no" id="id0C7A33E314B3470793D570A43255432E"><enum>(B)</enum><text>in subparagraph (L), by striking <quote>24, 32</quote> and inserting <quote>32, 36C</quote>.</text>
 </subparagraph></paragraph><paragraph commented="no" id="id61704EA28D9D49E68BDF7A51F594DCD8"><enum>(8)</enum><text>Subchapter B of chapter 65 of subtitle F of such Code is amended by striking section 6429.</text> </paragraph><paragraph commented="no" id="idB68C12A792D44F7C8A06C187A9DA6D77"><enum>(9)</enum><text>Paragraph (2) of section 1324(b) of title 31, United States Code, is amended by inserting <quote>36C,</quote> after <quote>36B,</quote>.</text>
