		<official-title>To amend title XVIII of the Social Security Act to provide for a permanent Independence at Home
			 medical practice program under the Medicare program.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Independence at Home Act of 2016</short-title></quote>.</text>
		</section><section id="id83D16B8B0BA1433A88F57E5E703BBA07"><enum>2.</enum><header>Independence at home medical practice program</header>
 <subsection id="idC07F3422C2EB4F388FD50801F9721999"><enum>(a)</enum><header>Program</header><text>Title XVIII of the Social Security Act is amended by inserting after section 1866E the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="idF3F0423CFB4B4CEBBA7E3B1F386E08D7" style="traditional"><section id="id57749a03edb24d218ab13daae1ed838f"><enum>1866F.</enum><header>Independence at home medical practice program</header><subsection commented="no" display-inline="yes-display-inline" id="idBC9E0A60F5F545559F9F1C11AF074359"><enum>(a)</enum><header>Establishment</header>
 <paragraph id="idc8a49368a00548efaf88454de2381767"><enum>(1)</enum><header>In general</header><text>Not later than 18 months after the date of the enactment of this section, the Secretary shall establish and implement an independence at home medical practice program (in this section referred to as the <quote>Program</quote>) that utilizes primary care teams that—</text>
 <subparagraph id="idBB4C9CFE554846C8ABDB7963DC8D65F8"><enum>(A)</enum><text>are directed by physicians, nurse practitioners, or physician assistants; and</text>
 </subparagraph><subparagraph id="id281962A9FAB84E0E8F99158C93D6BF9E"><enum>(B)</enum><text>emphasize home-based care that is designed to reduce expenditures and improve health outcomes in the provision of items and services under this title to applicable beneficiaries.</text>
 </subparagraph></paragraph><paragraph id="idd4a8db699fe6460e92b39c9ff66258a4"><enum>(2)</enum><header>Goals</header><text>Under the Program, an independence at home medical practice shall be accountable for providing comprehensive, coordinated, continuous, and accessible care to applicable beneficiaries at home and coordinating health care across all treatment settings, resulting in—</text>
 <subparagraph id="idbc6f784269154270b1ba4c08ab9cde58"><enum>(A)</enum><text>reducing preventable hospitalizations;</text> </subparagraph><subparagraph id="id83f2ad8204ad40809e8ba5979db9df18"><enum>(B)</enum><text>preventing hospital readmissions;</text>
 </subparagraph><subparagraph id="ide9218e58e04a4012a43a504fb434b0b5"><enum>(C)</enum><text>reducing emergency room visits;</text> </subparagraph><subparagraph id="ida87fb26dc60c4816a3c5fff8706f4391"><enum>(D)</enum><text>improving health outcomes commensurate with each applicable beneficiary’s stage of chronic illness;</text>
 </subparagraph><subparagraph id="id8b03ad87d97f456e83ecb8ae8ffc148d"><enum>(E)</enum><text>improving the efficiency of care, such as by reducing duplicative diagnostic and laboratory tests;</text> </subparagraph><subparagraph id="ide5e74c967b0a4d419f66a7db13718212"><enum>(F)</enum><text>reducing the cost of items and services covered under this title; and</text>
 </subparagraph><subparagraph id="id0ab88a77573c46a8a08ce21ac9581efe"><enum>(G)</enum><text>achieving applicable beneficiary and family caregiver satisfaction.</text> </subparagraph></paragraph></subsection><subsection id="iddcb017a017f743139159e9e6f646840d"><enum>(b)</enum><header>Independence at home medical practice</header> <paragraph id="id77aaff598e5c477f962d61457c405a67"><enum>(1)</enum><header>Independence at home medical practice defined</header><text>In this section:</text>
 <subparagraph id="idc2c0a7e1d98c45d1a88c8356d96ac19f"><enum>(A)</enum><header>In general</header><text>The term <term>independence at home medical practice</term> means a legal entity that meets each of the following requirements:</text> <clause id="id959f80ed349540da8551a5847c6fd1af"><enum>(i)</enum><text>The entity is comprised of an individual physician, nurse practitioner, or physician assistant or group of such practitioners that furnishes care as part of a team that may include physicians, nurses, physician assistants, pharmacists, licensed mental health practitioners, and other health and social services staff, as appropriate.</text>
 </clause><clause id="id326fa456ebb14c6792782704a042193c"><enum>(ii)</enum><text>The entity is organized, at least in part, for the purpose of furnishing physicians’ services.</text> </clause><clause id="idba27b3cc9f9e48adbc260bd671595426"><enum>(iii)</enum><text>The entity—</text>
 <subclause id="id3C99964C98DD48D9B18E11E912C45DE4"><enum>(I)</enum><text>has experience in furnishing home-based primary care services to applicable beneficiaries, as determined appropriate by the Secretary;</text>
 </subclause><subclause id="id9981B52D192F4ED6A7BDEFC1D9672C9D"><enum>(II)</enum><text>makes in-home visits; and</text> </subclause><subclause id="id9956D9350AED4D1B8B95E32A233A774B"><enum>(III)</enum><text>is available 24 hours per day, seven days per week, to carry out plans of care that are tailored to an applicable beneficiary’s chronic conditions and designed to achieve the goals described in subparagraphs (A) through (G) of subsection (a)(2).</text>
 </subclause></clause><clause id="idb05aae0226454946ba292ad6ed98dcee"><enum>(iv)</enum><text>The entity enters into an agreement with the Secretary.</text> </clause><clause commented="no" display-inline="no-display-inline" id="idbdbb440b41be4097bc72dba0fe7ceb50"><enum>(v)</enum><text display-inline="yes-display-inline">The entity furnishes services to at least 200 applicable beneficiaries during each year covered under the agreement unless the Secretary determines that a lower minimum number of applicable beneficiaries is necessary for the goals of the Program to be achieved.</text>
 </clause><clause id="id0C2EA996EE0C4FFEB7862D835413F983"><enum>(vi)</enum><text>The entity uses certified electronic health record technology and may use remote monitoring and mobile diagnostic technology, as determined appropriate by the Secretary.</text>
 </clause><clause id="id908b1445b7594afab8560d222a46934d"><enum>(vii)</enum><text>The entity meets such other criteria as the Secretary determines to be appropriate to participate in the Program.</text>
 </clause></subparagraph><subparagraph commented="no" id="id5237bbfb967d458bac002b9c4f961b7f"><enum>(B)</enum><header>Physician</header><text>The term <term>physician</term> means a physician described in section 1861(r)(1) who has the medical training or experience to fulfill the physician’s role described in subparagraph (A)(i).</text>
 </subparagraph></paragraph><paragraph id="id9d443a6ece4b47769e2b99c9cdc0bd71"><enum>(2)</enum><header>Inclusion of affiliated providers and practitioners</header><text>Nothing in this subsection shall prevent an independence at home medical practice from including providers of services, practitioners described in section 1842(b)(18)(C), or other practitioners, including pharmacists, in an arrangement with the practice to share in any savings under the Program.</text>
							</paragraph></subsection><subsection id="idf6d95752392f4015b03a4d107eeda441"><enum>(c)</enum><header>Quality measures and performance standards</header>
							<paragraph id="id702374EF330542179F17C2BAEA7E7082"><enum>(1)</enum><header>Quality measures</header>
 <subparagraph id="id1FA4B878866048EF8FC1198916C07747"><enum>(A)</enum><header>In general</header><text>The Secretary shall determine appropriate quality measures to assess the quality of care furnished by independence at home medical practices. To the extent possible, such measures shall include outcome measures and experience of care measures.</text>
 </subparagraph><subparagraph id="id92B5EAEA88864A0E8E9DB176BF8B932C"><enum>(B)</enum><header>Reporting requirements</header><text>Under the Program, an independence at home medical practice shall submit data in a form and manner and at a frequency specified by the Secretary.</text>
 </subparagraph></paragraph><paragraph id="idB59C800C8DB1468B9B36029958C74255"><enum>(2)</enum><header>Quality performance standards</header><text>The Secretary shall establish quality performance standards that independence at home medical practices must meet in order to be eligible to receive incentive payments under subsection (d)(2).</text>
							</paragraph></subsection><subsection id="id9a9ea90e942146b6b5fa8699496779dd"><enum>(d)</enum><header>Incentive payment methodology</header>
 <paragraph id="id30a9ad952c6e40bab42605ae24787d4e"><enum>(1)</enum><header>Establishment of target spending level</header><text>The Secretary shall establish an estimated annual spending target based on the amount the Secretary estimates would have been spent in the absence of the Program, for items and services covered under parts A and B furnished to applicable beneficiaries or comparable beneficiaries, as determined by the Secretary, for each independence at home medical practice under this section. Such spending targets shall be determined on a per capita basis. Such spending targets shall include a risk corridor that takes into account normal variation in expenditures for items and services covered under parts A and B furnished to such beneficiaries with the size of the corridor being related to the number of applicable beneficiaries furnished services by each independence at home medical practice. The spending targets may also be adjusted for other factors as the Secretary determines appropriate.</text>
 </paragraph><paragraph id="idabdabae35d664a4f8feda4737a560530"><enum>(2)</enum><header>Incentive payments</header><text>Subject to meeting the quality performance standards under subsection (c)(2), an independence at home medical practice is eligible to receive an incentive payment under the Program if actual expenditures for a year for the applicable beneficiaries who are attributed to the practice are less than the estimated spending target established under paragraph (1) for such year. An incentive payment for such year shall be equal to a portion (as determined by the Secretary but in no case greater than 80 percent) of the amount by which actual expenditures (including incentive payments under this paragraph) for applicable beneficiaries under parts A and B for such year are estimated to be less than 5 percent less than the estimated spending target for such year, as determined under paragraph (1).</text>
							</paragraph></subsection><subsection id="id6e59bc94dcd94c50996afa9e3e5ef89a"><enum>(e)</enum><header>Applicable beneficiary</header>
 <paragraph id="id5ba68fd6d50941dd8ac364c402575923"><enum>(1)</enum><header>In general</header><text>In this section, the term <term>applicable beneficiary</term> means an individual who the independence at home medical practice to which the individual is attributed has determined—</text>
 <subparagraph id="id56d765615dd04dd0a19e3f05225d3569"><enum>(A)</enum><text>is entitled to benefits under part A and enrolled for benefits under part B;</text> </subparagraph><subparagraph id="idf03636b8103941f885c03698d80b6137"><enum>(B)</enum><text>is not—</text>
 <clause id="id824CD29C309243F08AF2E16A40E50E31"><enum>(i)</enum><text>enrolled in a Medicare Advantage plan under part C or a PACE program under section 1894;</text> </clause><clause id="idC616057B4B03426593ED929DD5FACB51"><enum>(ii)</enum><text>attributed under—</text>
 <subclause id="id627525E6D8F3449BAF12368EAC715034"><enum>(I)</enum><text>another shared savings program, under this title, such as under section 1899; or</text>
 </subclause><subclause id="id667A922461004AAD843AFC161C186EF6"><enum>(II)</enum><text>a model tested or expanded under section 1115A that involves shared savings under this title, or any other demonstration that involves such shared savings; or</text>
 </subclause></clause><clause id="idE126634B5532475FBF4B1B97C24BB206"><enum>(iii)</enum><text>determined to have end stage renal disease as provided in section 226A or receiving dialysis at home;</text>
 </clause></subparagraph><subparagraph id="id0b7a403ba30e434fb489416ec4f85476"><enum>(C)</enum><text>has two or more chronic illnesses, as determined by the Secretary, such as congestive heart failure, diabetes, chronic obstructive pulmonary disease, ischemic heart disease, stroke, Alzheimer’s Disease and neurodegenerative diseases, other dementias designated by the Secretary, and other diseases and conditions which result in high costs under this title;</text>
 </subparagraph><subparagraph id="id5be9ea8f343241ec9ec326134cf7ec01"><enum>(D)</enum><text>subject to paragraph (2), during the 12-month period immediately preceding the individual's attribution to an independence at home medical practice—</text>
 <clause id="idCDA5550DCAFE4AA5B4010D715930BE11"><enum>(i)</enum><text>had a nonelective hospital admission; and</text> </clause><clause id="id28549D24018F4CCA91C35CDC399CF086"><enum>(ii)</enum><text>received—</text>
 <subclause id="id7B2AE23D9C204A988CDC274523E40C98"><enum>(I)</enum><text>skilled nursing care or rehabilitation services in a skilled nursing facility paid under section 1888(e);</text>
 </subclause><subclause id="idB48E149E16D145CD9B382C52AC14A501"><enum>(II)</enum><text>rehabilitation services in an inpatient rehabilitation facility; or</text>
 </subclause><subclause id="idD114C6DE6E1A4F179C769DD8AC0CEDBC"><enum>(III)</enum><text>part-time or intermittent nursing care (as described in section 1861(m)(1)) through a home health agency or physical or occupational therapy or speech-language pathology services (as described in section 1861(m)(2)) through a home health agency;</text>
 </subclause></clause></subparagraph><subparagraph id="id14FAB721681E4A26B08E7C333B2B8D72"><enum>(E)</enum><text>has two or more functional dependencies requiring the assistance of another person (such as bathing, dressing, toileting, walking, or feeding); and</text>
 </subparagraph><subparagraph id="id56926655ab1d4ab18783394f84abc2a1"><enum>(F)</enum><text>meets such other criteria as the Secretary determines appropriate.</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6171F77C320E4F83BAA797B7C7437FF8"><enum>(2)</enum><header>Waiver of certain requirements when beneficiary changes plans</header><text>The requirements under paragraph (1)(D) shall not apply when an individual is attributed to an independence at home medical practice under this section subsequent to the first time an individual is attributed to such a practice under this section.</text>
 </paragraph><paragraph id="id25c229f6fa3543f98cdae1762bc768ce"><enum>(3)</enum><header>Patient election to participate</header><text>The Secretary shall adopt an appropriate method to determine that applicable beneficiaries have agreed to enroll in an independence at home medical practice. Enrollment in an independence at home medical practice shall be voluntary.</text>
 </paragraph><paragraph id="id1286e8642a6040f98a2fbdbd10bde4e7"><enum>(4)</enum><header>Beneficiary access to services</header><text>Nothing in this section shall be construed as—</text> <subparagraph id="id87063D34895546C0AC8623F6727A7A14"><enum>(A)</enum><text>encouraging physicians, nurse practitioners, physician assistants, or other team members to limit applicable beneficiary access to services covered under this title; or</text>
 </subparagraph><subparagraph id="idD98AFEB7684C494DB43287CAC3916F3C"><enum>(B)</enum><text>requiring applicable beneficiaries to relinquish access to any benefit under this title as a condition of receiving services from an independence at home medical practice.</text>
								</subparagraph></paragraph></subsection><subsection id="ideb38c860e44444f2806e57102a838164"><enum>(f)</enum><header>Agreements</header>
 <paragraph id="id5305BED3AB24437F8BCF5D2FAAEDD0D3"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), an agreement with an independence at home medical practice under the Program shall be for a period determined appropriate by the Secretary but in no case more than 3 years.</text>
 </paragraph><paragraph id="id715DEF11E1344427A61C3238AF300709"><enum>(2)</enum><header>Renewals</header><text>Subject to subsection (j), the Secretary may renew an agreement with an independence at home medical practice under the Program.</text>
 </paragraph></subsection><subsection id="id4916a24a8aee412eb9955c2cb7fd7b05"><enum>(g)</enum><header>Permitting practices To furnish supplemental benefits at own expense</header><text>Under the Program, independence at home medical practices may furnish applicable beneficiaries with items and services for which payment is not made under parts A and B, as determined by the Secretary. No payment for such items and services shall be made under this title.</text>
						</subsection><subsection id="id0b1634275c1c4091a62bd509c6dcc9d2"><enum>(h)</enum><header>Waiver authority</header>
 <paragraph id="id050EA15024684061968F58BF127D619C"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), the Secretary may waive such provisions of this title and title XI as the Secretary determines necessary in order to implement the Program.</text>
 </paragraph><paragraph id="id56CD224BB70A4242A591C454C2ACA0CA"><enum>(2)</enum><header>Limitation</header><text>The Secretary may only waive the collection of coinsurance that is payable by individuals under section 1833(a)(1) if the Chief Actuary of the Centers for Medicare &amp; Medicaid Services certifies that such a waiver would reduce (or would not result in any increase in) net program spending under this title.</text>
 </paragraph></subsection><subsection id="idd80805fd7eb342038c8d899eb0e32e89"><enum>(i)</enum><header>Administration</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">Chapter 35</external-xref> of title 44, United States Code, shall not apply to this section.</text> </subsection><subsection id="id4f871eb2235b4a90ab4fb4a1dabaa095"><enum>(j)</enum><header>Termination</header> <paragraph id="id2c5083eb32794dff8c44181613f153fe"><enum>(1)</enum><header>Mandatory termination</header><text>The Secretary shall terminate an agreement with an independence at home medical practice if—</text>
 <subparagraph id="id81b80861db104518b3895226c20f89b4"><enum>(A)</enum><text>the Secretary estimates or determines that such practice will not receive an incentive payment under subsection (d)(2) for the third of 3 consecutive years under the Program; or</text>
 </subparagraph><subparagraph id="idf9f2300243994987bea4dbaac16891ad"><enum>(B)</enum><text>such practice fails to meet at least a minimum number of quality performance standards established under subsection (c)(2) during any year of the agreement period.</text>
 </subparagraph></paragraph><paragraph id="id1b7e9be56039477e9d185c17ffefbfca"><enum>(2)</enum><header>Permissive termination</header><text>The Secretary may terminate an agreement with an independence at home medical practice for such other reasons determined appropriate by the Secretary.</text>
							</paragraph></subsection><subsection id="id20DD338DA82A444ABC3DD23898279958"><enum>(k)</enum><header>Transition</header>
 <paragraph id="id5E2F26A73A32464B959A294A7DDB8DAF"><enum>(1)</enum><header>Transition from demonstration</header><text>The Secretary shall provide for an appropriate transition from the demonstration program under section 1866E to the Program under this section. Such transition shall include a process that ensures that independence at home medical practices and applicable beneficiaries participating in such demonstration are automatically included in the Program under this section at the time of the implementation of the Program.</text>
 </paragraph><paragraph commented="no" id="id3EC0FF184538432D8C5340F9D800E088"><enum>(2)</enum><header>Special rule for individuals participating in similar programs</header><text>In the case of an individual who has regularly received home-based primary care services, as determined by the Secretary, during the 12-month period immediately preceding the individual's attribution to an independence at home medical practice for the first time, the Secretary may, as determined appropriate, apply clause (i) of subsection (e)(1)(D) (relating to a prior nonelective hospital admission) by increasing the 12-month period described in such subsection as it relates to such clause to a period of up to 24 months.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id55A6CBD3460B4C30B9DEFA3EB65A43A0"><enum>(l)</enum><header display-inline="yes-display-inline">Limitation on
 review</header><text display-inline="yes-display-inline">There shall be no administrative or judicial review under section 1869, section 1878, or otherwise of—</text>
 <paragraph id="id9787a97c604c4d38aa70a3d6141d0287"><enum>(1)</enum><text>the attribution of applicable beneficiaries to an independence at home medical practice;</text>
 </paragraph><paragraph id="id32d9d210a7ba4dd4a64bdb5a86a5b28f"><enum>(2)</enum><text>the determination of the estimated annual spending target for an independence at home medical practice under subsection (d)(1);</text>
 </paragraph><paragraph id="id898b79bd0e7047d7a84a70a860d70722"><enum>(3)</enum><text>the assessment of the quality of care furnished by an independence at home medical practice and the establishment of quality performance standards under subsection (c);</text>
 </paragraph><paragraph id="id4f2a5834a099488a9ee6cccf9c1fe64c"><enum>(4)</enum><text>the determination of whether an independence at home medical practice is eligible for incentive payments under subsection (d)(2), and the amount of such incentive payments; and</text>
 </paragraph><paragraph id="id64008efc78ec45cd988bc2092520f890"><enum>(5)</enum><text>the termination of an independence at home medical practice under subsection (j).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection><subsection commented="no" id="H54727C230C4343CEA1AB03E4A3C0DEE7"><enum>(b)</enum><header>GAO study and report</header> <paragraph commented="no" id="H47794A2650EF4B63908F3AC26C7B7078"><enum>(1)</enum><header>Study</header><text display-inline="yes-display-inline">The Comptroller General of the United States shall conduct a study on the independence at home medical practice program under section 1866F of the Social Security Act, as added by subsection (a). Such study shall include an analysis of—</text>
 <subparagraph commented="no" id="id621226FBC3F34B119FE59FE1DB4497F5"><enum>(A)</enum><text display-inline="yes-display-inline">whether independence at home medical practices are meeting the requirements under such program;</text> </subparagraph><subparagraph commented="no" id="id048B5105A6924BBDB1E81F9CB46049F4"><enum>(B)</enum><text>whether such program is reducing expenditures under this title;</text>
 </subparagraph><subparagraph commented="no" id="id2B443B6519D349EE9B9693D3BF14DBFF"><enum>(C)</enum><text>the care that beneficiaries are receiving under such program; and</text> </subparagraph><subparagraph commented="no" id="idF767FC2E7A024D35B41325086F820D3B"><enum>(D)</enum><text>other areas determined appropriate by the Comptroller General.</text>
 </subparagraph></paragraph><paragraph commented="no" id="HCC13650E34B24F759B9C09B6CF253BC7"><enum>(2)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 3 years after the date of the implementation of such independence at home medical practice program, the Comptroller General of the United States shall submit to Congress a report on the study conducted under paragraph (1), together with such recommendations as the Comptroller General determines to be appropriate.</text>
				</paragraph></subsection><subsection commented="no" id="id738B9B254CE1449580253063824FD10C"><enum>(c)</enum><header>Revisions to existing demonstration program</header>
 <paragraph commented="no" id="idA51E187D330E45848924DF605EF958D4"><enum>(1)</enum><header>Extension through the implementation of the new program</header><text>Section 1866E(e)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395cc-5">42 U.S.C. 1395cc–5(e)(1)</external-xref>) is amended by inserting <quote>plus the period beginning at the end of such 5-year period and ending on the date of the implementation of the program under section 1866F</quote> after <quote>5-year period</quote>.</text>
 </paragraph><paragraph commented="no" id="id2723CFD885404651A22F07AC3A87A51D"><enum>(2)</enum><header>Permitting existing practices to see more beneficiaries</header><text>Section 1866E(e)(5) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395cc-5">42 U.S.C. 1395cc–5(e)(1)</external-xref>) is amended by adding at the end the following new sentence: <quote>Beginning on the date of the enactment of this sentence, the limitation on the number of beneficiaries that may participate in the demonstration program pursuant to the preceding sentence shall not apply with respect to independence at home medical practices participating in the demonstration program as of such date of enactment.</quote>.</text>
