			 and for other purposes.</official-title></form>
	<legis-body>
 <section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Safeguard Tribal Objects of Patrimony Act of 2016</short-title></quote>.</text> </section><section id="idFF246C56331B4678AA338BB946070000"><enum>2.</enum><header>Enhanced protections for Native American cultural objects</header> <subsection id="id6DF1DE8D65AC4C0A9B42A21D8E8113D7"><enum>(a)</enum><header>Enhanced penalties</header><text>Section 1170 of title 18, United States Code, is amended by striking <quote>5 years</quote> each place it appears and inserting <quote>10 years</quote>.</text>
			</subsection><subsection id="id008E4BFEE7284D25B5A87E1445229E96"><enum>(b)</enum><header>Prohibition of exporting Native American cultural objects</header>
 <text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/53">Chapter 53</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="id4461756D1ECB460999B45A2239EC8D65" style="USC"> <section id="id31E03751CBCF4D1480F5DF469F29EEF2"><enum>1171.</enum><header>Illegal exportation of Native American cultural objects</header> <subsection id="id9997E6FA6AF04E8F890C2411AB072F55"><enum>(a)</enum><header>Definition of Native American cultural object</header><text>In this section, the term <term>Native American cultural object</term> means any Native American (as defined in section 2 of the Native American Graves Protection and Repatriation Act (<external-xref legal-doc="usc" parsable-cite="usc/25/3001">25 U.S.C. 3001</external-xref>))—</text>
 <paragraph id="id05D59AE0DAD54118A5632E5A648558C3"><enum>(1)</enum><text>cultural items, as defined in that section;</text> </paragraph><paragraph id="id2D7C6F37BEE24C879C4F702F1B1082F8"><enum>(2)</enum><text>archaeological resource, as defined in section 3 of the Archaeological Resources Protection Act of 1979 (<external-xref legal-doc="usc" parsable-cite="usc/16/470bb">16 U.S.C. 470bb</external-xref>); or</text>
 </paragraph><paragraph id="id5B0893B8164548FC96F083314DE905BD"><enum>(3)</enum><text>object of antiquity protected under section 1866(b).</text> </paragraph></subsection><subsection id="id8DFF8C3A73B5475495FC8779DF42C9C8"><enum>(b)</enum><header>Prohibition</header><text>It shall be unlawful for any person to knowingly export or otherwise transport from the United States any Native American cultural object obtained in violation of—</text>
 <paragraph id="id76AEA53F15F845E3802E0B9B3AA50504"><enum>(1)</enum><text>the Native American Graves Protection and Repatriation Act (<external-xref legal-doc="usc" parsable-cite="usc/25/3001">25 U.S.C. 3001 et seq.</external-xref>);</text>
 </paragraph><paragraph id="id40A288578A4E49F9A743EAA07A84E9F4"><enum>(2)</enum><text>section 1170;</text> </paragraph><paragraph id="idA925A5DE0D5C494F8339CB106156F972"><enum>(3)</enum><text>the Archaeological Resources Protection Act of 1979 (<external-xref legal-doc="usc" parsable-cite="usc/16/470aa">16 U.S.C. 470aa et seq.</external-xref>); or</text>
 </paragraph><paragraph id="id6B11E25B04044A03B8A8D4A6D49A4EE0"><enum>(4)</enum><text>section 1866(b).</text> </paragraph></subsection><subsection id="idBC1B26580A9C48508247D55EFCD15938"><enum>(c)</enum><header>Penalty</header><text>Any person who violates subsection (b) shall—</text>
 <paragraph id="id52AF0D01B34B43F1AC7C046BAD445CD1"><enum>(1)</enum><text>in the case of a first violation under this section, be fined under this title, imprisoned for not more than 1 year, or both; and</text>
 </paragraph><paragraph id="id106CDB048C964A7B8F21884C7AD92845"><enum>(2)</enum><text>in the case of a second or subsequent violation under this section, be fined under this title, imprisoned for not more than 10 years, or both.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="id4D39385563864043ACE1181A2C618EFF"><enum>(c)</enum><header>Private repatriation of Native American cultural objects</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/53">Chapter 53</external-xref> of title 18, United States Code (as amended by subsection (b)), is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id2A49C1702CEE4CC498DF2CC8E24244C9" style="USC">
					<section id="id69C701E6C11840628A81E3E953338161"><enum>1172.</enum><header>Private repatriation of Native American cultural objects</header>
 <subsection id="id33EE602B2D2D4778B3FA962C2F7527EB"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subsection (b), if a person voluntarily repatriates to the appropriate Indian tribe or Native Hawaiian organization by not later than 2 years after the date of enactment of this section, all of the Native American cultural objects (as defined in section 1171(a)) in the possession of the person, that person shall be immune from criminal prosecution under this title, the Archaeological Resources Protection Act of 1979 (<external-xref legal-doc="usc" parsable-cite="usc/16/470aa">16 U.S.C. 470aa et seq.</external-xref>), or any other related law with respect to the returned Native American cultural objects.</text>
 </subsection><subsection id="id32A3831A19A544DEA93D8E5AC0DE5E73"><enum>(b)</enum><header>Exception</header><text display-inline="yes-display-inline">Subsection (a) shall not apply if the person repatriates the Native American cultural objects on a date that is after the date on which an active investigation or prosecution of the person relating to the Native American cultural objects is initiated.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="id4072D3C277C24735A9CF3D59C8834FAE"><enum>(d)</enum><header>Technical and conforming amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/53">chapter 53</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text>

			</subsection></section><section id="id17975C11E1BB41C8913DD444DD59C721"><enum>3.</enum><header>Government Accountability Office report</header>
 <subsection id="idDA33C55394894748BE900E4E49F6640E"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="id58F9F875927142678ED52F1085405B98"><enum>(1)</enum><header>Indian tribe</header><text>The term <term>Indian tribe</term> has the meaning given the term in section 2 of the Native American Graves Protection and Repatriation Act (<external-xref legal-doc="usc" parsable-cite="usc/25/3001">25 U.S.C. 3001</external-xref>).</text>
 </paragraph><paragraph id="idC816AAC7FBB447099A13A3F9A4B785E6"><enum>(2)</enum><header>Native American cultural object</header><text>The term <term>Native American cultural object</term> has the meaning given the term in section 1171(a) of title 18, United States Code.</text> </paragraph><paragraph id="idE489A5521B49408FBA6F2BEB68F229D8"><enum>(3)</enum><header>Native Hawaiian organization</header><text>The term <term>Native Hawaiian organization</term> has the meaning given the term in section 2 of the Native American Graves Protection and Repatriation Act (<external-xref legal-doc="usc" parsable-cite="usc/25/3001">25 U.S.C. 3001</external-xref>).</text>
 </paragraph></subsection><subsection id="id3E4A40BB18834ECE998DF7973F466DD0"><enum>(b)</enum><header>Submission</header><text>Not later than 2 years after the date of enactment of this Act, the Comptroller General of the United States, after collecting information from the Attorney General, the Secretary of the Interior, and the Secretary of State, and meeting, as appropriate, with Indian tribes and Native Hawaiian organizations, shall submit the report described in subsection (c) to—</text>
 <paragraph id="idD9E09C75DD234735AC11F55308C01E77"><enum>(1)</enum><text>the Committee on Indian Affairs of the Senate; and</text> </paragraph><paragraph id="id8C2059A15053406A8CDD4FAE73ADB73C"><enum>(2)</enum><text>the Committee on Natural Resources of the House of Representatives.</text>
 </paragraph></subsection><subsection id="idB09F7B35BEBD400E8F36B8E376DAB605"><enum>(c)</enum><header>Report described</header><text>The report submitted under subsection (b) shall include a description of—</text> <paragraph id="idfa9a31800f8744ecb6e60686e85680f5"><enum>(1)</enum><text>an estimate of the number of Native American cultural objects illegally trafficked in the United States and foreign markets;</text>
 </paragraph><paragraph id="id34A9711A45784BDD8E66AFDE1E25B7E9"><enum>(2)</enum><text>the extent to which the Attorney General has prosecuted, under section 1170 of title 18, United States Code, the Archaeological Resources Protection Act of 1979 (<external-xref legal-doc="usc" parsable-cite="usc/16/470aa">16 U.S.C. 470aa et seq.</external-xref>), section 1866(b) of title 18, United States Code, or any other related law, cases of trafficking in—</text>
 <subparagraph id="id04A2D8B83A08418695F004326BDC941F"><enum>(A)</enum><text>the human remains of a Native American (as defined in section 2 of the Native American Graves Protection and Repatriation Act (<external-xref legal-doc="usc" parsable-cite="usc/25/3001">25 U.S.C. 3001</external-xref>)); or</text>
 </subparagraph><subparagraph id="id783971DA8CFA4C72BF3064BE59BC96A5"><enum>(B)</enum><text>other Native American cultural objects; and</text> </subparagraph></paragraph><paragraph id="idA10DA8F4DA3E4A0FAAB6CDEBDF0856ED"><enum>(3)</enum><text>recommendations for actions the Attorney General, the Secretary of State, and the Secretary of the Interior can take—</text>
 <subparagraph id="id7EFE6367BE174D4585C316941B3AE219"><enum>(A)</enum><text>to eliminate illegal commerce in Native American cultural objects in the United States and foreign markets; and</text>
 </subparagraph><subparagraph commented="no" id="idE3B0D25C081746328AA2789AF34AD0AF"><enum>(B)</enum><text>to secure the repatriation to Indian tribes and Native Hawaiian organizations of Native American cultural objects that have been illegally removed or trafficked in violation of—</text>
 <clause commented="no" id="id654C2504D9C84477A0031E68C95D6C0E"><enum>(i)</enum><text>section 1170(b) of title 18, United States Code;</text> </clause><clause commented="no" id="idD85449D3D138442B872CF84E1B72C076"><enum>(ii)</enum><text>the Archaeological Resources Protection Act of 1979 (<external-xref legal-doc="usc" parsable-cite="usc/16/470aa">16 U.S.C. 470aa et seq.</external-xref>); or</text>
 </clause><clause commented="no" id="id0E0711BD25244A079DBE3B8EAABEDBDC"><enum>(iii)</enum><text>section 1866(b) of title 18, United States Code.</text> </clause></subparagraph></paragraph></subsection><subsection commented="no" id="id3B367C4F3A0F4BCF9B82BDB3A57F84CA"><enum>(d)</enum><header>Tribal working group</header><text>The Secretary of the Interior shall facilitate the convention of a tribal working group composed of representatives of Indian tribes and Native Hawaiian organizations, the Department of Justice, the Department of the Interior, the Department of Homeland Security, and the Department of State—</text>
 <paragraph commented="no" id="id5EE24C18DECB46FCABA58DAEA9252037"><enum>(1)</enum><text>to provide an opportunity for Indian tribes and Native Hawaiian organizations to contribute information to the Attorney General, the Secretary of the Interior, and the Secretary of State during the preparation of the report described in subsection (c); and</text>
 </paragraph><paragraph commented="no" id="idF9784EEB6D8D4653B133DCBB78552AD8"><enum>(2)</enum><text>to advise the Attorney General, the Secretary of the Interior, and the Secretary of State on methods for implementing recommendations included in the report described in subsection (c).</text></paragraph></subsection></section></legis-body></bill>
