 <section changed="deleted" committee-id="SSCM00" id="H74AD17E8CF5D4585A70C247578E57413" reported-display-style="strikethrough" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This section may be cited as the <quote><short-title>Securing Access to Networks in Disasters Act of 2016</short-title></quote>.</text> </section><section changed="deleted" committee-id="SSCM00" id="id36B8C4E46F4C4D7E95288ED104459D8A" reported-display-style="strikethrough"><enum>2.</enum><header>Findings; Sense of Congress</header> <subsection id="idE759882357584E60ADF216F6A695CC70"><enum>(a)</enum><header>Findings</header><text>Congress finds the following:</text>
 <paragraph id="id573219e537184ebabaddc563fdf83c7a"><enum>(1)</enum><text>Severe weather and emergencies can have devastating effects on communities large and small, including rural areas and urban centers.</text>
 </paragraph><paragraph id="ideed7bcec8e1248e28a4c975f9f58d0ac"><enum>(2)</enum><text>10,649 deaths were attributed to weather related causes during 2006 to 2010.</text> </paragraph><paragraph id="id0ca4549e05f548a494540e99a2c96d65"><enum>(3)</enum><text>According to the third national climate assessment, completed in 2014, microclimate weather models predict increased temperatures, and less frequent but more intense storm events.</text>
 </paragraph><paragraph id="id6f1cc86b515f4681a821b471c58c634a"><enum>(4)</enum><text>In 2015, there were 9,407,571 acres burned in wildfires and the United States Fire Administration spent $1,700,000,000 on wildfire suppression and $2,600,000,000 on all wildfire related budget costs in 2015. Wildfire potential is expected to remain static or increase over the coming fire seasons.</text>
 </paragraph><paragraph id="idb1afe449eb0948a7b81e42acda011d8e"><enum>(5)</enum><text>During times of emergencies such as a natural disaster, severe storm, or act of terrorism, communications networks serve as a vital tool for individuals, 9–1–1 centers, and first responders.</text>
 </paragraph><paragraph id="idacf91e26bb074356a20a1a55d6855167"><enum>(6)</enum><text>During times of emergency, it is critical that consumers be able to access cell phone networks, including to contact 9–1–1, even in the event that damage or outage has occurred on their own home network.</text>
 </paragraph><paragraph id="id0b79fdf52a8c40699fa52b6f1e45a683"><enum>(7)</enum><text>Consumer wireless devices are becoming increasingly important to the safety and security of the public during emergencies, whether to contact 9–1–1, receive emergency alerts, communicate with loved ones, or receive vital information like shelter locations using mobile applications and social media platforms.</text>
 </paragraph><paragraph id="id321bdbaa4e40439e8f8daa7c7c590acf"><enum>(8)</enum><text>In April 2016, major cell phone carriers announced a Wireless Network Resiliency Cooperative Framework (referred to in this subsection as the <term>Framework</term>) that outlines reasonable arrangements between the networks for cell phone roaming during disasters, fosters mutual aid during emergencies, and aids in consumer readiness during times of emergency.</text>
 </paragraph><paragraph id="id8d1e2ea754d34916a204733ba70eeb07"><enum>(9)</enum><text>Voluntary agreements similar to the Framework can provide benefits to consumers by offering increased flexibility for carriers to adjust their efforts as technology and the emergency response ecosystem evolves.</text>
 </paragraph><paragraph id="id9499dabe7ecd428fb47d41d07be62411"><enum>(10)</enum><text>Although the initial Framework reflects agreement among the 5 largest carriers in the Nation, the agreement could potentially be expanded to include, or serve as a model for, other carriers especially those in underserved or rural areas.</text>
 </paragraph><paragraph id="idbe4c4c59fbd94598a8eff56ceaad6542"><enum>(11)</enum><text>Close coordination among service providers and the public safety community is essential in advance of, during, and following emergencies.</text>
 </paragraph></subsection><subsection id="id4027D6D9931943429D368C694CEA80DC"><enum>(b)</enum><header>Sense of Congress</header><text>It is the sense of Congress that the voluntary policies outlined in the Wireless Network Resiliency Cooperative Framework should be adhered to, to the best of the carriers' ability, to aid consumers, 9–1–1 professionals, first responders, and local governments, in accessing communication services during times of emergency.</text>
			</subsection></section><section changed="deleted" committee-id="SSCM00" id="idA606DA7028F64E00B692FC2A5E094785" reported-display-style="strikethrough"><enum>3.</enum><header>Securing access to networks in disasters</header>
 <subsection id="id92767A44832C48C8AF88E0757697358D"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section, and for purposes of the rules required under this section—</text> <paragraph id="id791AED31E0A64E3996D02E53C8F68479"><enum>(1)</enum><text>the term <term>mobile service</term> means—</text>
 <subparagraph id="id288133860A4F4F2D886B26B3F1379DC8"><enum>(A)</enum><text>commercial mobile service (as defined in section 332 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/332">47 U.S.C. 332</external-xref>)); or</text>
 </subparagraph><subparagraph id="id728E717F19264F228765C06121177F16"><enum>(B)</enum><text>commercial mobile data service (as defined in section 6001 of the Middle Class Tax Relief and Job Creation Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/47/1401">47 U.S.C. 1401</external-xref>));</text>
 </subparagraph></paragraph><paragraph id="id5A436A308E5042ACB37E4C52F22124CC"><enum>(2)</enum><text>the term <term>mobile service infrastructure</term> means a site or similar facility used to transmit or receive mobile service signals;</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF848C7E23FDB413DBFFAC9F5A9DCB0CE"><enum>(3)</enum><text display-inline="yes-display-inline">the term <term>times of emergency</term> means—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id3791FBEBC67B4D4EB9DBD9409C894544"><enum>(A)</enum><text display-inline="yes-display-inline">an emergency as defined in section 102 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5122">42 U.S.C. 5122</external-xref>); or</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8B1F2548AE9644A199FBD3151922E863"><enum>(B)</enum><text display-inline="yes-display-inline">an emergency as declared by the Governor of a State or territory of the United States; and</text> </subparagraph></paragraph><paragraph id="idD73B047A6F304175AA56A8B1E14E44AF"><enum>(4)</enum><text>the term <term>WiFi access point</term> means wireless Internet access using the standard designated as 802.11 or any variant thereof.</text>
				</paragraph></subsection><subsection id="H11CBF691CD714F598AB3E44128A7B81E"><enum>(b)</enum><header>Proceedings related to cellular network resiliency</header>
				<paragraph id="HB01E2A8C415048649A1026CF41E3FC93"><enum>(1)</enum><header>Directory</header>
 <subparagraph id="HEF0E6AA0E95B47779D02E328FCB55AED"><enum>(A)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Commission shall create a master point of contact directory to provide for effective communication between public safety answering points and telecommunications service providers.</text>
 </subparagraph><subparagraph id="HA347F1B5C26F4243BB6F17516C242962"><enum>(B)</enum><header>Confidentiality</header><text>The directory established under this paragraph shall be available to telecommunications service providers and public safety answering points on a confidential basis.</text>
 </subparagraph><subparagraph id="HE2F6A3BD523B4B51816495C99F6DF735"><enum>(C)</enum><header>Exemption from Paperwork Reduction Act requirements</header><text display-inline="yes-display-inline">In establishing the directory under this paragraph, the Commission shall be exempted from <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, United States Code (commonly known as the <quote>Paperwork Reduction Act</quote>).</text>
 </subparagraph></paragraph><paragraph id="idc7692afeda6e4570a4a619628fb5a405"><enum>(2)</enum><header>Study on network resiliency</header><text display-inline="yes-display-inline">Not later than 36 months after the date of enactment of this Act, the Commission shall submit to Congress, and make publically available on the Commission’s website, a study on the public safety benefits and technical feasibility and cost of—</text>
 <subparagraph id="id5D0C9A856F3A4EAB96BA8D62FC8853FD"><enum>(A)</enum><text display-inline="yes-display-inline">making telecommunications service provider-owned WiFi access points, and other communications technologies operating on unlicensed spectrum, available to the general public for access to 9–1–1 services, without requiring any login credentials, during times of emergency when mobile service is unavailable;</text>
 </subparagraph><subparagraph id="idA823680443E1412FA14C52A728504467"><enum>(B)</enum><text display-inline="yes-display-inline">the provision by non-telecommunications service provider-owned WiFi access points of public access to 9–1–1 services during times of emergency when mobile service is unavailable; and</text>
 </subparagraph><subparagraph id="id9B03454586214EAFAF2CE1728D384960"><enum>(C)</enum><text display-inline="yes-display-inline">other alternative means of providing the public with access to 9–1–1 services during times of emergency when mobile service is unavailable.</text>
					</subparagraph></paragraph></subsection><subsection id="HFF126BECCCC543F5A5C3400085D86958"><enum>(c)</enum><header>GAO study and report</header>
 <paragraph id="H0F55C9B2D9A24373A0791FB2315B3B7D"><enum>(1)</enum><header>Study</header><text>The Comptroller General of the United States shall conduct a study on—</text> <subparagraph id="H1714BD9FAB424A65BCCEDF97364DA539"><enum>(A)</enum><text>how Federal agencies can better ensure critical telecommunications networks remain operational during times of emergency;</text>
 </subparagraph><subparagraph id="H3F179E3B4A2544EAAE295064D41B7AAA"><enum>(B)</enum><text>the feasibility and advisability of adding points of contact for local utilities to the directory described in subsection (b)(1); and</text>
 </subparagraph><subparagraph id="HB92462C5F03E49FBBEF171180CC38811"><enum>(C)</enum><text>any legislative matters Congress should consider to help promote network resiliency.</text> </subparagraph></paragraph><paragraph id="H8AB488E1CA124C6ABDEEABA60A65B04E"><enum>(2)</enum><header>Report</header><text>Not later than 18 months after the date of enactment of this Act, the Comptroller General shall transmit a report to Congress containing the findings and recommendations of the study required under paragraph (1).</text>
				</paragraph></subsection><subsection id="H021E6AF137534C558D6B6917020687F8"><enum>(d)</enum><header>Expanding list of essential service providers during federally declared emergencies To include all
 communications providers; providing access to essential service providers</header><text display-inline="yes-display-inline">Section 427 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5189e">42 U.S.C. 5189e</external-xref>) is amended—</text>
 <paragraph id="id6949BC373F8C45DF88BA686BA3BCC5B0"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(1)(A), by striking <quote>telecommunications service</quote> and inserting <quote>communications service, including wireline and mobile telephone service, Internet access service, radio and television broadcasting, cable service, and direct broadcast satellite service</quote>; and</text>
 </paragraph><paragraph id="idE32C56EA6079469AB65FDBE97E3C2ABF"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block changed="deleted" committee-id="SSCM00" display-inline="no-display-inline" id="idFB8AEC5F715E4935A352125A3C75AC4E" reported-display-style="strikethrough" style="OLC"> <subsection id="idA571F53756494F2D8C5D200747CBE56D"><enum>(d)</enum><header>Mutual aid agreements</header><text>The President, acting through the Administrator of the Federal Emergency Management Agency, shall encourage the adoption of mutual aid agreements that recognize the credentials of essential service providers issued by all parties to the mutual aid agreement.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="id1495FA2421EA4A6EAB779DA8E0B370E4"><enum>(e)</enum><header>Communications networks are designated essential assistance during federally declared emergencies</header><text>Section 403(a)(3) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170b">42 U.S.C. 5170b(a)(3)</external-xref>) is amended—</text>
 <paragraph id="idA3884B737D6442B3BBE562B63FFED4B6"><enum>(1)</enum><text>in subparagraph (I), by striking <quote>and</quote> at the end;</text> </paragraph><paragraph id="id0E03E8AA6C8F4923BDE8E0DC5C7A815C"><enum>(2)</enum><text>in the first subparagraph (J)(ii), by striking the period at the end and inserting <quote>; and</quote>; and</text>
 </paragraph><paragraph id="id29BF8A78337340808671C13FBA18AFF5"><enum>(3)</enum><text>by striking the second subparagraph (J) (as added by section 4 of the Pets Evacuation and Transportation Standards Act of 2006 (<external-xref legal-doc="public-law" parsable-cite="pl/109/308">Public Law 109–308</external-xref>; 120 Stat. 1725) and inserting the following:</text>
					<quoted-block changed="deleted" committee-id="SSCM00" display-inline="no-display-inline" id="id38EA7D8BA4694B4D89D368132ED316C4" reported-display-style="strikethrough" style="OLC">
 <subparagraph id="id83D71E8F73AD4E6B80B23F1C17FA1759"><enum>(K)</enum><text>establishing temporary or restoring communications service, including wireline and mobile telephone service, Internet access service, radio and television broadcasting, cable service, and direct broadcast satellite service.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body>

 <subsection id="id075bd0df-322e-468b-9153-9f1e8ce4022c"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section—</text> <paragraph id="id14947a12-66bb-426b-81a8-fd2e553dccf9"><enum>(1)</enum><text>the term <term>Commission</term> means the Federal Communications Commission;</text>
 </paragraph><paragraph id="id96A10517A756464482E7E45245A7E8D8"><enum>(2)</enum><text>the term <term>mobile service</term> means—</text> <subparagraph id="id31bfad64-3327-4395-ba4d-3439195abc4b"><enum>(A)</enum><text>commercial mobile service (as defined in section 332 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/332">47 U.S.C. 332</external-xref>)); or</text>
 </subparagraph><subparagraph id="idcc7896af-ce01-41e8-a715-8971e3527548"><enum>(B)</enum><text>commercial mobile data service (as defined in section 6001 of the Middle Class Tax Relief and Job Creation Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/47/1401">47 U.S.C. 1401</external-xref>));</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb86dd621-457e-425f-938c-11d702d0fba4"><enum>(3)</enum><text display-inline="yes-display-inline">the term <term>times of emergency</term> means—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id4252ad2b-37a0-4187-bfc5-c5c93cc7d197"><enum>(A)</enum><text display-inline="yes-display-inline">an emergency or major disaster, as those terms are defined in section 102 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5122">42 U.S.C. 5122</external-xref>); or</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id61a6c75c-deb3-4be8-87f8-b43b0845de28"><enum>(B)</enum><text display-inline="yes-display-inline">an emergency as declared by the Governor of a State or territory of the United States; and</text> </subparagraph></paragraph><paragraph id="ide609f973-c50d-4973-aed0-fa2aa580dd86"><enum>(4)</enum><text>the term <term>WiFi access points</term> means wireless Internet access using the standard designated as 802.11 or any variant thereof.</text>
				</paragraph></subsection><subsection id="idd7c3062b-8e3e-4913-9454-614b54cd7a74"><enum>(b)</enum><header>FCC study on alternative access to 9-1-1 services during times of emergency</header>
 <paragraph id="id3a4b672f-bb28-493d-8c5d-7a9651cbbe93"><enum>(1)</enum><header>Study</header><text display-inline="yes-display-inline">Not later than 36 months after the date of enactment of this Act, the Commission shall submit to Congress, and make publicly available on the website of the Commission, a study on the public safety benefits and technical feasibility and cost of—</text>
 <subparagraph id="idf9ee27a0-e595-463d-9f33-5f04d4c287e0"><enum>(A)</enum><text display-inline="yes-display-inline">making telecommunications service provider-owned WiFi access points, and other telecommunications service provider-owned communications technologies operating on unlicensed spectrum, available to the general public for access to 9–1–1 services, without requiring any login credentials, during times of emergency when mobile service is unavailable;</text>
 </subparagraph><subparagraph id="id04cf5b27-7048-464d-967c-f66620df975c"><enum>(B)</enum><text display-inline="yes-display-inline">the provision by non-telecommunications service provider-owned WiFi access points of public access to 9–1–1 services during times of emergency when mobile service is unavailable; and</text>
 </subparagraph><subparagraph id="iddfa49a23-86bb-4f4d-85b1-9a296b083c72"><enum>(C)</enum><text display-inline="yes-display-inline">other alternative means of providing the public with access to 9–1–1 services during times of emergency when mobile service is unavailable.</text>
 </subparagraph></paragraph><paragraph id="id440E96DCCB844BFC9AADB8901FC227A3"><enum>(2)</enum><header>Considerations</header><text>In conducting the study required under paragraph (1), the Commission shall consider issues related to making WiFi access points available to the general public for access to 9-1-1 services, including communications network provider liability, the operational security of communications networks, and any existing actions or authorities in and among the States.</text>
				</paragraph></subsection><subsection id="idec6e9e36-eb45-487c-9ceb-2ed3cd5ef02c"><enum>(c)</enum><header>GAO study and report</header>
 <paragraph id="id1FA8123E8B904A06BE63959336341AB8"><enum>(1)</enum><header>Definitions</header><text>In this subsection—</text> <subparagraph id="id0AF15E904A9045ACBCFE127D0E80A10C"><enum>(A)</enum><text>the term <term>essential communications services</term> means wireline and mobile telephone service, Internet access service, radio and television broadcasting, cable service, and direct broadcast satellite service; and</text>
 </subparagraph><subparagraph id="id1F3CB2A6EAA5441C948D3AECDFF0BB9D"><enum>(B)</enum><text>the term <term>Executive departments</term> has the meaning given the term in section 101 of title 5, United States Code.</text> </subparagraph></paragraph><paragraph id="id94ca5db5-fa64-4753-9dfd-21edecb5a8c9"><enum>(2)</enum><header>Study</header><text>The Comptroller General of the United States shall conduct a study on—</text>
 <subparagraph id="ide1a3e874-9d27-41bf-942d-d3c323a8bed6"><enum>(A)</enum><text>how Executive departments can better ensure essential communications services remain operational during times of emergency;</text>
 </subparagraph><subparagraph id="id55ba237c594b4101942c44da4d5ec9e0"><enum>(B)</enum><text>any legislative matters, if appropriate, Congress could consider to help promote the resiliency of essential communications services; and</text>
 </subparagraph><subparagraph id="id89393b6d7bbe41b6b38a45c688580f19"><enum>(C)</enum><text>whether a nationwide directory of points of contact among providers of essential communications services is needed to facilitate the rapid restoration of such services damaged during times of emergency.</text>
 </subparagraph></paragraph><paragraph id="idC31BFA313E9C4ED7962E6A7A7B86FF46"><enum>(3)</enum><header>Considerations</header><text>In making the determination described in paragraph (2)(C), the Comptroller General shall consider—</text> <subparagraph id="id1c95317aff8d4d00893d7e5c53351528"><enum>(A)</enum><text>any similar directories that exist at the Federal, State, or local level, including the effectiveness of such directories;</text>
 </subparagraph><subparagraph id="idf3e35f0819354e1ca82b8a6c064932b2"><enum>(B)</enum><text>how such a directory could be established and updated, including what types of information would be most useful;</text>
 </subparagraph><subparagraph id="id24cb6e932495450888803f50de31cbd1"><enum>(C)</enum><text>how access to such a directory could be managed to adequately ensure the confidentiality of any sensitive information and operational security of essential communications services; and</text>
 </subparagraph><subparagraph id="id32d5469ebb2e4ff8a253be31f52b9ab3"><enum>(D)</enum><text>the resources necessary to establish and maintain such a directory.</text> </subparagraph></paragraph><paragraph id="id58824057-4a9a-461e-9d7d-ea0be680853b"><enum>(4)</enum><header>Report</header><text>Not later than 18 months after the date of enactment of this Act, the Comptroller General shall transmit a report to Congress containing the findings and recommendations of the study required under paragraph (2).</text>
				</paragraph></subsection><subsection id="idadc599c1-5795-4f7a-8fdc-5bf831619e3a"><enum>(d)</enum><header>Expanding list of essential service providers during federally declared emergencies To include all
 communications providers; providing access to essential service providers</header><text display-inline="yes-display-inline">Section 427 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5189e">42 U.S.C. 5189e</external-xref>) is amended—</text>
 <paragraph id="idec94843b-08ac-414f-8f7c-1a7b91d24c5a"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(1)(A), by striking <quote>telecommunications service</quote> and inserting <quote>wireline or mobile telephone service, Internet access service, radio or television broadcasting, cable service, or direct broadcast satellite service</quote>; and</text>
 </paragraph><paragraph id="id7b17c618-6e96-449c-ad07-bfebd6621029"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block changed="added" committee-id="SSCM00" display-inline="no-display-inline" id="idd1283afd-c251-4e35-9861-99bf75b39dd7" reported-display-style="italic" style="OLC"> <subsection id="id46f25976-5ab1-454e-b2f5-898cc455ed71"><enum>(d)</enum><header>Mutual aid agreements</header><text>The President, acting through the Administrator of the Federal Emergency Management Agency, shall encourage the adoption of mutual aid agreements that recognize the credentials of essential service providers issued by all parties to the mutual aid agreement.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="id964bf7f2-85c0-4991-b426-a9a0f227d04e"><enum>(e)</enum><header>Communications networks are designated essential assistance during federally declared emergencies</header><text>Section 403(a)(3) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170b">42 U.S.C. 5170b(a)(3)</external-xref>) is amended—</text>
 <paragraph id="id69bf0ada-3feb-4add-ab96-850db650545e"><enum>(1)</enum><text>in subparagraph (I), by striking <quote>and</quote> at the end;</text> </paragraph><paragraph id="id923e9c90-3628-48f9-9d86-fc1ff036c2b1"><enum>(2)</enum><text>in subparagraph (J), by striking the period at the end and inserting <quote>; and</quote>; and</text>
 </paragraph><paragraph id="id336749CB37A44683A710D285A4CECBCA"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block changed="added" committee-id="SSCM00" display-inline="no-display-inline" id="idcc963281-81a2-4cb3-a2ae-010b8434c1d2" reported-display-style="italic" style="OLC"> <subparagraph id="id90b757c0-7091-4152-9c88-a763020e9124"><enum>(K)</enum><text>allowing for access to essential service providers necessary for establishing temporary or restoring wireline or mobile telephone service, Internet access service, radio or television broadcasting, cable service, or direct broadcast satellite service.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body><endorsement><action-date>December 6, 2016</action-date><action-desc>Reported with an amendment</action-desc></endorsement></bill>
