 <section commented="no" id="HB17085CFB054494CB5135FC152C77317" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Information Systems Safeguards Act of 2016</short-title></quote>.</text> </section><section id="H02E1050E7C7240298B74A81CD0AD6E19" section-type="subsequent-section"><enum>2.</enum><header>Agency discretion to secure information technology and information systems</header> <subsection id="id3D8DE5289473420F9933E3F360D95311"><enum>(a)</enum><header>In general</header><text>In carrying out section 3554 of title 44, United States Code, any action taken by the head of an agency that is necessary to limit, restrict, or prohibit access to any website the head of the agency determines to present a current or future security weakness or risk to the information technology or information system under the control of the agency<deleted-phrase reported-display-style="strikethrough">, and any impact or implementation of such action,</deleted-phrase> shall not be subject to <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/71">chapter 71</external-xref> of title 5, United States Code.</text>
			</subsection><subsection changed="added" id="id70047e3067474b0c878fc666939cb4ac" reported-display-style="italic"><enum>(b)</enum><header>Consideration of communication needs</header>
 <paragraph id="id52afd1d536f6452d96b0b88cde14373e"><enum>(1)</enum><header>In general</header><text>After taking an action under subsection (a), the head of an agency shall, upon the request of employees of the agency, take into consideration and seek guidance on the personal communication needs of the employees of the agency.</text>
 </paragraph><paragraph id="id5e2b507cc425471f9d2f6548b55424fe"><enum>(2)</enum><header>Rule of construction</header><text>Nothing in this subsection shall be construed to establish a right to collective bargaining.</text> </paragraph></subsection><subsection id="idFAD601848DEE415094DDC5A2134322B1"><enum><deleted-phrase reported-display-style="strikethrough">(b)</deleted-phrase> <added-phrase reported-display-style="italic">(c)</added-phrase></enum><header>Definitions</header><text>In this section—</text>
 <paragraph id="idC6AF0505535A4C718DCBB9623A673190"><enum>(1)</enum><text>the terms <term>agency</term> and <term>information system</term> have the meanings given the terms in section 3502 of title 44, United States Code; and</text> </paragraph><paragraph id="id300D56B7691B403696F1621A6DC2FFF3"><enum>(2)</enum><text>the term <term>information technology</term> has the meaning given the term in section 3552 of title 44, United States Code.</text></paragraph></subsection></section></legis-body><endorsement><action-date>September 27, 2016</action-date><action-desc>Reported with amendments</action-desc></endorsement></bill>
