 <section display-inline="no-display-inline" id="H7556B6CF4D9241AABE418463B3306D8C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Law Enforcement Officers Equity Act</short-title></quote>.</text> </section><section id="H81169FC9BA8F4233B2422286F7C84D89"><enum>2.</enum><header>Including certain positions within the definition of law enforcement officer for purposes of retirement</header> <subsection id="H49C1E9628B094B068FB95827C70D43D5"><enum>(a)</enum><header>Federal Employees Retirement System</header><text>Section 8401(17) of title 5, United States Code, is amended—</text>
 <paragraph id="id846E87F933134244A4F682F45BF9BA3F"><enum>(1)</enum><text>in subparagraph (C)—</text> <subparagraph id="id20032873A196424FB11D5722E04CE597"><enum>(A)</enum><text>by striking <quote>subparagraph (A) and (B)</quote> and inserting <quote>subparagraphs (A), (B), (E), (F), (G), (H), and (I)</quote>; and</text>
 </subparagraph><subparagraph id="id72D7ECCD13764217B77BD81601536DCC"><enum>(B)</enum><text>by striking <quote>and</quote> at the end; and</text> </subparagraph></paragraph><paragraph id="id87655BCF9CAD423DB6B9E9E240FA3509"><enum>(2)</enum><text>by adding at the end the following:</text>
					<quoted-block id="HADF98498D3654EC98870B6825F45638B">
 <subparagraph id="HDFDD0E3EC569414E802B9F668CBC8A1E"><enum>(E)</enum><text>an employee not otherwise covered by this paragraph—</text> <clause id="HB67120987A0247FC8937309E6F9C1157"><enum>(i)</enum><text>the duties of whose position include the investigation or apprehension of individuals suspected or convicted of offenses against the criminal laws of the United States; and</text>
 </clause><clause id="HA2F9D0851CDA42A38AFDF42F69D3CA0A"><enum>(ii)</enum><text>who is authorized to carry a firearm;</text> </clause></subparagraph><subparagraph id="H4F72EC7FEF0B4833B7A250FE787D7D27"><enum>(F)</enum><text>an employee of the Internal Revenue Service, the duties of whose position are primarily the—</text>
 <clause id="idD44F5CB97B4F46C289477ECAE2CB7B6C"><enum>(i)</enum><text>collection of delinquent taxes; and</text> </clause><clause id="id3BE97A0183C64202A48D7FAA8B3AE59A"><enum>(ii)</enum><text>securing of delinquent returns;</text>
 </clause></subparagraph><subparagraph commented="no" id="HEC00F7ED2E3F4E3880876351AEBC2C32"><enum>(G)</enum><text>an employee of the United States Postal Inspection Service;</text> </subparagraph><subparagraph id="H0949FB75066140EE82649200144AB066"><enum>(H)</enum><text>an employee of the Department of Veterans Affairs who is a Department police officer under section 902 of title 38; and</text>
 </subparagraph><subparagraph id="id2D1F32AA99284D3981E0CD85E8C57778"><enum>(I)</enum><text>an employee of U.S. Customs and Border Protection—</text> <clause id="id77643BEAB2E948B899F9365BAA37E0D4"><enum>(i)</enum><text>who is a seized property specialist in the GS–1801 job series; and</text>
 </clause><clause id="id0AF46A3CA96442559D691D4968359E6E"><enum>(ii)</enum><text>the duties of whose position include activities relating to the efficient and effective custody, management, and disposition of seized and forfeited property;</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="HE6383C023B6C482F8141094159147806"><enum>(b)</enum><header>Civil Service Retirement System</header><text>Section 8331(20) of title 5, United States Code, is amended, in the matter preceding subparagraph (A)—</text>
 <paragraph id="id814E63FE72A747CB8C511F7165B9F394"><enum>(1)</enum><text>by inserting <quote>and an individual described in any of subparagraphs (E) through (I) of section 8401(17)</quote> after <quote>United States</quote>; and</text> </paragraph><paragraph id="id1F12A232CDE5448DA1DC45BB00E59BF4"><enum>(2)</enum><text>by striking <quote>this activity</quote> and inserting <quote>such activity or described in any such subparagraph</quote>.</text>
 </paragraph></subsection><subsection id="H89497AAEBEDA42D292BED8265E3F6E89"><enum>(c)</enum><header>Application</header><text display-inline="yes-display-inline">The amendments made by this section shall apply to any—</text> <paragraph commented="no" id="H6C15D8BF25F949DFA69D9CA8CA8E4A20"><enum>(1)</enum><text>individual who is appointed as a law enforcement officer—</text>
 <subparagraph commented="no" id="id1279C288D5164983B16B1D53BACD559A"><enum>(A)</enum><text>as defined in section 8331(20) or 8401(17) of title 5, United States Code (as amended by this section); and</text>
 </subparagraph><subparagraph commented="no" id="id00601CDD7BCF48CDAB682BE25E762008"><enum>(B)</enum><text>on or after the date of enactment of this Act; and</text> </subparagraph></paragraph><paragraph id="HFE5A8F23FBC94787B152716B3E0AE70F"><enum>(2)</enum><text>incumbent (as defined in section 3(a)(3)), consistent with the requirements of section 3.</text>
				</paragraph></subsection></section><section id="HC1E443A39B054F8F912758B95AE93DA7"><enum>3.</enum><header>Incumbent law enforcement officers</header>
 <subsection id="H9487EC3B296B4957B1A89F407C1C1ABC"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section—</text> <paragraph id="idF718C781764E428FB2093429641B2A37"><enum>(1)</enum><text>the term <term>Director</term> means the Director of the Office of Personnel Management;</text>
 </paragraph><paragraph id="H26CE8C4A4D6843B89E5460ED784905D5"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>Fund</term> means the Civil Service Retirement and Disability Fund;</text> </paragraph><paragraph id="H5CFC9260D7DA47FA8BC750D058D6BC22"><enum>(3)</enum><text>the term <term>incumbent</term> means an individual who—</text>
 <subparagraph id="H68BCFE0D5FC9460B9DE8B5B40FC89213"><enum>(A)</enum><text>was appointed as a law enforcement officer before the date of enactment of this Act; and</text> </subparagraph><subparagraph id="H5EFA85774BDC4C7DA57DE4236B1EC98F"><enum>(B)</enum><text>is serving as a law enforcement officer on the date of enactment of this Act;</text>
 </subparagraph></paragraph><paragraph id="H6FE01DF8709A4B1C941E755B146C3CF9"><enum>(4)</enum><text>the term <term>law enforcement officer</term> means an individual who satisfies the requirements of section 8331(20) or 8401(17) of title 5, United States Code, by virtue of the amendments made by section 2;</text>
 </paragraph><paragraph id="HEB826C6F953048CDB712A42A9EFE6E6F"><enum>(5)</enum><text display-inline="yes-display-inline">the term <term>prior service</term> means, with respect to an incumbent who makes an election under subsection (b)(2), service performed by the incumbent before the date on which appropriate retirement deductions begin to be made under the election; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H82EA4FD81E0A4A2283493D265E047EB3"><enum>(6)</enum><text>the term <term>service</term> means service performed by an individual as a law enforcement officer.</text> </paragraph></subsection><subsection id="HCCC82AEF6B3B4236ACDBF23703451296"><enum>(b)</enum><header>Treatment of service performed by incumbents</header> <paragraph id="HB49FFB136E3348339876EC8A5EF16F2D"><enum>(1)</enum><header>Service on or after date of enactment</header><text>Service performed by an incumbent on or after the date of enactment of this Act shall be treated as service performed as a law enforcement officer.</text>
 </paragraph><paragraph id="H735A79CABACA4821B948C6162552DC74"><enum>(2)</enum><header>Service before date of enactment</header><text display-inline="yes-display-inline">Service performed by an incumbent before the date of enactment of this Act shall, for purposes of subchapter III of chapter 83 and <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/84">chapter 84</external-xref> of title 5, United States Code, be treated as service performed as a law enforcement officer only if the incumbent submits a written election to the Director by the earlier of—</text>
 <subparagraph id="id15B9E5C3A14A48ECAEBF5806C575E3A8"><enum>(A)</enum><text display-inline="yes-display-inline">the date that is 5 years after the date of enactment of this Act; or</text> </subparagraph><subparagraph id="idD1002502A5E64CADB4B6592D67859DE0"><enum>(B)</enum><text display-inline="yes-display-inline">the day before the date on which the incumbent separates from the service.</text>
					</subparagraph></paragraph></subsection><subsection id="H2608341039304C60B753842A5A0AABAE"><enum>(c)</enum><header>Individual contributions for prior service</header>
 <paragraph id="HB98EC2C26C5C478D862ED5926FBD2301"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">An incumbent who makes an election under subsection (b)(2) may, with respect to prior service performed by the incumbent, pay a deposit into the Fund equal to the sum of—</text>
 <subparagraph id="HCE8F20F6F84E440CBCE9910E38C562C2"><enum>(A)</enum><text>the difference between—</text> <clause id="H51CD34226B7443A1BD042B477286D444"><enum>(i)</enum><text display-inline="yes-display-inline">the amount that would have been deducted during the period of prior service under section 8334 or 8422 of title 5, United States Code, from the pay of the incumbent if the amendments made by section 2 had been in effect during the prior service; and</text>
 </clause><clause id="H512577B739C54B7B86B357E805A3743E"><enum>(ii)</enum><text display-inline="yes-display-inline">the amount that was deducted during the period of prior service under section 8334 or 8422 of title 5, United States Code; and</text>
 </clause></subparagraph><subparagraph id="HE254F7B2705B47A2961AB0982DA70780"><enum>(B)</enum><text display-inline="yes-display-inline">interest on the amount described in subparagraph (A)(i), as computed under—</text> <clause id="idC2FDED4ABA3B4BC29E72CDE61B0340AD"><enum>(i)</enum><text display-inline="yes-display-inline">paragraphs (2) and (3) of section 8334(e) of title 5, United States Code; and</text>
 </clause><clause id="idE3E3B6B434DA4CD6A6452611CFB3F525"><enum>(ii)</enum><text display-inline="yes-display-inline">regulations promulgated by the Director.</text>
 </clause></subparagraph></paragraph><paragraph id="HA980EB1BBD7A4ECE998B31E2CECAB1E5"><enum>(2)</enum><header>Effect of not contributing</header><text>If an incumbent does not pay the full amount of the deposit described in paragraph (1), all prior service of the incumbent—</text>
 <subparagraph id="id14D000D232514CFFA7E4EED7013A64C4"><enum>(A)</enum><text>shall remain fully creditable as a law enforcement officer; and</text>
 </subparagraph><subparagraph id="idE74C0D62B3384F42A3B9707B56390CE9"><enum>(B)</enum><text>the resulting annuity shall be reduced—</text>
 <clause id="idDC23BB45BF3F4A7FB7AEF8B2ABDAE067"><enum>(i)</enum><text>in a manner similar to that described in section 8334(d)(2) of title 5, United States Code; and</text>
 </clause><clause id="id26BE1CC71F564FB8909D1FF750F019E5"><enum>(ii)</enum><text>to the extent necessary to make up the amount unpaid.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="H1C907AE4D31944F3A42D08F4FDE26B46"><enum>(d)</enum><header>Government contributions for prior service</header>
 <paragraph id="H8001B6DA07C34676B045F855E22E6A76"><enum>(1)</enum><header>In general</header><text>If an incumbent makes an election under subsection (b)(2), an agency that employed the incumbent during any prior service of the incumbent shall remit to the Director, for deposit in the Fund, an amount equal to the sum of—</text>
 <subparagraph id="HBD378A9127EE417680988C68C085BFB3"><enum>(A)</enum><text>the difference between—</text> <clause id="H58861E7394EC45A98EBC1AB3A1178936"><enum>(i)</enum><text>the total amount of Government contributions that would have been paid under section 8334 or 8423 of title 5, United States Code, if the amendments made by section 2 had been in effect during the prior service; and</text>
 </clause><clause id="HBEA641FCDABB47258C302F2DF368187E"><enum>(ii)</enum><text>the total amount of Government contributions paid under section 8334 or 8423 of title 5, United States Code; and</text>
 </clause></subparagraph><subparagraph id="HA1FB94487904457B83F30954D11559E2"><enum>(B)</enum><text display-inline="yes-display-inline">interest on the amount described in subparagraph (A)(i), as computed in accordance with—</text> <clause id="idA0225B17ADDE42C38A4CE73820F8721E"><enum>(i)</enum><text display-inline="yes-display-inline">paragraphs (2) and (3) of section 8334(e) of title 5, United States Code; and</text>
 </clause><clause id="id07AC52FB534447B5BF9C3BEFAD57AB44"><enum>(ii)</enum><text display-inline="yes-display-inline">regulations promulgated by the Director.</text>
 </clause></subparagraph></paragraph><paragraph id="H05FC16EEE6584A8E815ED463685DA85F"><enum>(2)</enum><header>Contributions to be made ratably</header><text>Government contributions under this subsection on behalf of an incumbent shall be made by the agency ratably (not less frequently than annually) over the 10-year period beginning on the date described in subsection (a)(5).</text>
 </paragraph></subsection><subsection id="H76F28E6E34C247A5932B4FE9DCFA8215"><enum>(e)</enum><header>Exemption from mandatory separation</header><text>Notwithstanding section 8335(b) or 8425(b) of title 5, United States Code, a law enforcement officer shall not be subject to mandatory separation during the 3-year period beginning on the date of enactment of this Act.</text>
 </subsection><subsection commented="no" id="H1F68A99C4AC347958AE6BC57A5E013C2"><enum>(f)</enum><header>Regulations</header><text>The Director shall prescribe regulations to carry out this Act, including regulations for the application of this section in the case of any individual entitled to a survivor annuity (based on the service of an incumbent who dies before making an election under subsection (b)(2)), to the extent of any rights that would have been available to the decedent if still living.</text>
 </subsection><subsection id="H2673AB79A7C449B789E9AA7F0D4A1E0C"><enum>(g)</enum><header>Rule of construction</header><text>Nothing in this section shall be considered to apply in the case of a reemployed annuitant.</text></subsection></section></legis-body></bill>
