 <section id="id0083168CE0E14C238C9762EE1634E8FE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Public Safety Officers’ Benefits Improvement Act of 2016</short-title></quote>.</text> </section><section id="idA4045F7C17394ACD995E2CFA8C663912" section-type="subsequent-section"><enum>2.</enum><header>Reports</header><text display-inline="no-display-inline">Section 1205 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3796c">42 U.S.C. 3796c</external-xref>) is amended—</text>
 <paragraph id="idC55BE05BDC8E437DA804968C30F97A74"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), by inserting <quote>Rules, regulations, and procedures issued under this part may include regulations based on standards developed by another Federal agency for programs related to public safety officer death or disability claims.</quote> <deleted-phrase committee-id="SSSB00" reported-display-style="strikethrough">after <quote>before the Bureau.</quote>;</deleted-phrase> <added-phrase committee-id="SSSB00" reported-display-style="italic">before the last sentence;</added-phrase></text>
 </paragraph><paragraph id="id90B77D4AFC614084B74EC3853DBB05CA"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (b)—</text> <subparagraph id="id241982339B19421EB4A91F4B44327490"><enum>(A)</enum><text>by inserting <quote>(1)</quote> before <quote>In making</quote>; and</text>
 </subparagraph><subparagraph id="id49DDF60ABAF847CF98D87C14DBA2D5BE"><enum>(B)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="id75AB6DC82D1F4ADCBD60E521CBA5EEF3" style="OLC"> <paragraph id="id085DE57263F24C27A7983D68D5D1969B" indent="up1"><enum>(2)</enum><text>In making a determination under section 1201, the Bureau shall give substantial weight to the evidence and all findings of fact presented by a State, local, or Federal administrative or investigative agency regarding eligibility for death or disability benefits.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="idFDEBAF727A1A4BE9BA39A9C1A1371438"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="idF32B74B7E7D24A9AB529BA802410B848" style="OLC"> <subsection id="id5206B3AEA2524E6DBB4485DD1D399ACE"><enum>(e)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id7B1968D8EBB7459CA5A5EB4A7A921BE1"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id64CE2140284D4D158F3F9631B1958FAA"><enum>(A)</enum><text>Not later than 30 days after the date of enactment of this subsection, the Bureau shall make available on the public website of the Bureau information on all death, disability, and educational assistance claims submitted under this part that are pending as of the date on which the information is made available.</text>
 </subparagraph><subparagraph id="idc715d0724bbd48f2b4eb5d69067d8d90" indent="up2"><enum>(B)</enum><text>Not less frequently than once per week, the Bureau shall make available on the public website of the Bureau updated information with respect to all death, disability, and educational assistance claims submitted under this part that are pending as of the date on which the information is made available.</text>
 </subparagraph><subparagraph id="id31fae903f8bf4f0790221da5be4c3af5" indent="up2"><enum>(C)</enum><text>The information made available under this paragraph shall include—</text> <clause id="id59f22c31626a46f0a2276da9755317f4"><enum>(i)</enum><text>for each pending claim—</text>
 <subclause id="id0C4FB82AD6DD4EA791E4F7CBF53CD60F"><enum>(I)</enum><text>the date on which the claim was submitted to the Bureau;</text> </subclause><subclause id="id801d44624d1a471c91b501b5822cbd33"><enum>(II)</enum><text>the State of residence of the claimant;</text>
 </subclause><subclause id="idc42665e02d2b41c8a3be7887f80b9f42"><enum>(III)</enum><text>an anonymized, identifying claim number; and</text> </subclause><subclause id="id31ab7a78a92c4192acb542b8d1c7b679"><enum>(IV)</enum><text>the nature of the claim; and</text>
 </subclause></clause><clause id="iddc773440204a438d90820880c205f0d6"><enum>(ii)</enum><text>the total number of pending claims that were submitted to the Bureau more than 1 year before the date on which the information is made available.</text>
 </clause></subparagraph></paragraph><paragraph id="id31E99EFE7F734BB49EEC87C0D94D06FE" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idD4A477256197442182632BE21A8B8451"><enum>(A)</enum><text>Not later than 180 days after the date of enactment of this subsection, and every 180 days thereafter, the Bureau shall submit to Congress a report on the death, disability, and educational assistance claims submitted under this part during the 180-day period preceding the report.</text>
 </subparagraph><subparagraph id="id455E87F19C5C41238107C467E4186005" indent="up1"><enum>(B)</enum><text>Each report submitted under subparagraph (A) shall include information on—</text> <clause id="id163d90bf1aad4fc7b273097cd818b096"><enum>(i)</enum><text>the total number of claims, and the nature of each claim, submitted to the Bureau;</text>
 </clause><clause id="id747F0834D84645D0AD06611B553A4CE5"><enum>(ii)</enum><text>the number of claims for which a final determination has been made;</text> </clause><clause id="id0f2ebe159178422f9671c2dcd418eb6c"><enum>(iii)</enum><text>the number of claims for which a final determination has not been reached and the basis for the delay;</text>
 </clause><clause id="id605f03864efd4448b92b0200c5d7e40b"><enum>(iv)</enum><text>the amount of time required to process each claim for which a final determination has been made<deleted-phrase committee-id="SSSB00" reported-display-style="strikethrough"> and, for any claim which could not be processed within 1 year of being submitted to the Bureau, the basis for any delay</deleted-phrase>;</text>
 </clause><clause id="id90088878bdbd44f19d5a494ba8bd3562"><enum>(v)</enum><text>the number of claims submitted that are related to exposure due to the September 11th, 2001, terrorism attacks and the average award amount for any such claims for which a final determination has been made;</text>
 </clause><clause id="id45bd86dd7a4c494a8d3e0d80f662500b"><enum>(vi)</enum><text>the result of each claim <added-phrase committee-id="SSSB00" reported-display-style="italic">for which a final determination was made during the 180-day period</added-phrase>, including the number of claims rejected and the basis for any denial of benefits;</text>
 </clause><clause id="id3C196FA41B144BB88869BB8D7DB8ADA2"><enum>(vii)</enum><text>the number of claims <deleted-phrase committee-id="SSSB00" reported-display-style="strikethrough">that were appealed</deleted-phrase><added-phrase committee-id="SSSB00" reported-display-style="italic">for which a final determination was made and appealed during the 180-day period</added-phrase>;</text> </clause><clause id="idEAF9D5391F4D4E8F81FC30F05E2A34DA"><enum>(viii)</enum><text>the <added-phrase committee-id="SSSB00" reported-display-style="italic">average </added-phrase>number of claims processed per reviewer of the Bureau; and</text>
 </clause><clause changed="deleted" committee-id="SSSB00" id="id7932C02CB35D4FD0A11182B0C1F3606F" reported-display-style="strikethrough"><enum>(ix)</enum><text>the average amount of time each agency takes to submit all required information and documents to the Bureau.</text>
 </clause><clause changed="added" committee-id="SSSB00" id="idf4ee14f6fac349e4bd3e262596e66495" reported-display-style="italic"><enum>(ix)</enum><text>information on the compliance of the Bureau with the obligation to offset award amounts under section 1201(f)(3), including—</text>
 <subclause id="idA44FDA61838A4B258F5346A7CB6BC6B8"><enum>(I)</enum><text>the number of claims that are eligible for compensation under both this part and the September 11th Victim Compensation Fund of 2001 (<external-xref legal-doc="usc" parsable-cite="usc/49/40101">49 U.S.C. 40101</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/107/42">Public Law 107–42</external-xref>) (commonly referred to as the <quote>VCF</quote>);</text>
 </subclause><subclause id="id61A1532F75044AF88B46E206DF018878"><enum>(II)</enum><text>for each claim described in subclause (I) for which compensation has been paid under the VCF, the amount of compensation paid under the VCF;</text>
 </subclause><subclause id="id2C724CC97A3243CAA12ABB485AF9C86D"><enum>(III)</enum><text>the number of claims described in subclause (I) for which the Bureau has made a final determination; and</text>
 </subclause><subclause id="idFF76BBBDD43F4458A7061E00DD1C91E1"><enum>(IV)</enum><text>the number of claims described in subclause (I) for which the Bureau has not made a final determination.</text>
 </subclause></clause></subparagraph></paragraph><paragraph changed="added" committee-id="SSSB00" id="id665A8383C04F457494CFA8CCDF742865" indent="up1" reported-display-style="italic"><enum>(3)</enum><text>Not later than 5 years after the date of enactment of the <short-title>Public Safety Officers' Benefits Improvement Act of 2016</short-title>, and every 5 years thereafter, the Comptroller General of the United States shall—</text> <subparagraph id="id69B0B6831E5B4A7FA06702280E6B308F"><enum>(A)</enum><text>conduct a study on the compliance of the Bureau with the obligation to offset award amounts under section 1201(f)(3); and</text>
 </subparagraph><subparagraph id="id51912C94FAC64634AA2F918C9201B6FA"><enum>(B)</enum><text>submit to Congress a report on the study conducted under subparagraph (A) that includes an assessment of whether the Bureau has provided the information required under subparagraph (B)(ix) of paragraph (2) of this subsection in each report required under that paragraph.</text>
							</subparagraph></paragraph><paragraph id="id284ED278CF064C499E5CA761ED9B2F5A" indent="up1"><enum><deleted-phrase committee-id="SSSB00" reported-display-style="strikethrough">(3)</deleted-phrase>
 <added-phrase committee-id="SSSB00" reported-display-style="italic">(4)</added-phrase></enum><text>In this subsection, the term <term>nature of the claim</term> means whether the claim is a claim for—</text> <subparagraph id="id245D48C61EEC4479A26D13977EB9CB46"><enum>(A)</enum><text>benefits under this subpart with respect to the death of a public safety officer;</text>
 </subparagraph><subparagraph id="id4ABCB31C0F6B4D5690F167A9E987C47D"><enum>(B)</enum><text>benefits under this subpart with respect to the disability of a public safety officer; or</text> </subparagraph><subparagraph id="id365971E034624EE79C56B7367FBD1F17"><enum>(C)</enum><text>education assistance under subpart 2.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></section><section changed="added" committee-id="SSSB00" id="idD0287F61597D479FAA3C4C5FA0B764A9" reported-display-style="italic"><enum>3.</enum><header>Age limitation for children</header><text display-inline="no-display-inline">Section 1212(c) of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3796d-1">42 U.S.C. 3796d–1(c)</external-xref>) is amended—</text>
 <paragraph id="id75D92004F14F424AABDDD984F934CFCF"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>No child</quote> and inserting the following:</text> <quoted-block changed="added" committee-id="SSSB00" display-inline="no-display-inline" id="id286B5DC8101B4BA5A72FB8F2BC89F537" reported-display-style="italic" style="OLC"> <paragraph id="id518B4732FED44BD483936BA228ABD2D4"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to paragraph (2), no child</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="id892FBBE67F794E4FA4581D334F7FC46B"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text> <quoted-block changed="added" committee-id="SSSB00" display-inline="no-display-inline" id="id8BEEAE09D5544739A46B9E2EC10C2928" reported-display-style="italic" style="OLC"> <paragraph id="idA93E6B33A49E4888901BB3811B47431A"><enum>(2)</enum><header>Delayed approvals</header> <subparagraph id="idC890D6DC4EA444B79416AE685FEDEBDA"><enum>(A)</enum><header>Educational assistance application</header><text display-inline="yes-display-inline">If a claim for assistance under this subpart is approved more than 1 year after the date on which the application for such assistance is filed with the Attorney General, the age limitation under this subsection shall be extended by the length of the period—</text>
 <clause id="id8E64B0666CEB42569938D2A5A632E9A0"><enum>(i)</enum><text display-inline="yes-display-inline">beginning on the day after the date that is 1 year after the date on which the application is filed; and</text>
 </clause><clause id="id27CC55A4D3C94666BB87E1D9A8078A55"><enum>(ii)</enum><text display-inline="yes-display-inline">ending on the date on which the application is approved.</text> </clause></subparagraph><subparagraph id="id3D58CFD735CF46C28D5C67D962A2691A"><enum>(B)</enum><header>Claim for benefits for death or permanent and total disability</header><text display-inline="yes-display-inline">In addition to an extension under subparagraph (A), if any, for an application for assistance under this subpart that relates to a claim for benefits under subpart 1 that was approved more than 1 year after the date on which the claim was filed with the Attorney General, the age limitation under this subsection shall be extended by the length of the period—</text>
 <clause id="id892877b0461640eb83db89614a35fdb4"><enum>(i)</enum><text>beginning on the day after the date that is 1 year after the date on which the claim for benefits is submitted; and</text>
 </clause><clause id="ided89d9ae92184757b2cd4c2c9ed1eab6"><enum>(ii)</enum><text>ending on the date on which the claim for benefits is approved.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></section><section changed="added" committee-id="SSSB00" id="idA617C46BEC734767B783B0FB839381BC" reported-display-style="italic"><enum>4.</enum><header>Due diligence in paying benefit claims</header><text display-inline="no-display-inline">Subpart 1 of part L of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3796">42 U.S.C. 3796 et seq.</external-xref>) is amended by adding at the end the following:</text>
			<quoted-block changed="added" committee-id="SSSB00" display-inline="no-display-inline" id="id7E91FA63CD2E49869E17BF83A4DC2C73" reported-display-style="italic" style="OLC">
				<section id="idFABA6F3B58F146ACA4A5ED1F06CE2DD2"><enum>1206.</enum><header>Due diligence in paying benefit claims</header>
 <subsection id="idA4BF5926D36A4D0CAB4F6C6E9B6A3008"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Bureau, with all due diligence, shall expeditiously attempt to obtain the information and documentation necessary to adjudicate a benefit claim filed under this part, including a claim for financial assistance under subpart 2.</text>
 </subsection><subsection id="id27F8573C97E94F638A75147F641565DF"><enum>(b)</enum><header>Sufficient information unavailable</header><text display-inline="yes-display-inline">If a benefit claim filed under this part, including a claim for financial assistance under subpart 2, is unable to be adjudicated by the Bureau because of a lack of information or documentation from a third party, such as a public agency, the Bureau may not abandon the benefit claim unless the Bureau has utilized the investigative tools available to the Bureau to obtain the necessary information or documentation, including subpoenas.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section changed="added" committee-id="SSSB00" id="id1c64b572a4464f85819c9397097b9885" reported-display-style="italic"><enum>5.</enum><header>Presumption that officer acted properly</header><text display-inline="no-display-inline">Section 1202 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3796a">42 U.S.C. 3796a</external-xref>) is amended—</text>
 <paragraph id="id67582493d571422ca7b3b91932178e4c"><enum>(1)</enum><text>by striking <quote>No benefit</quote> and inserting the following:</text> <quoted-block changed="added" committee-id="SSSB00" display-inline="no-display-inline" id="idc9bd60be0b67485bae2691b4a7cfdb0f" reported-display-style="italic" style="OLC"> <subsection id="id926F2C976AED446A80C0FA30467D5784"><enum>(a)</enum><header>In general</header><text>No benefit</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="id89c047cf2c1540728a349db82c4cd06e"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block changed="added" committee-id="SSSB00" display-inline="no-display-inline" id="id6af6e40434e7472eab3e7bfe0608f338" reported-display-style="italic" style="OLC"> <subsection id="id3183459dccbd4155b720791e074faeee"><enum>(b)</enum><header>Presumption</header><text>In determining whether a benefit is payable under this part, the Bureau shall—</text>
 <paragraph id="id9AF346F1F2514EB19D0917A2E7AE340F"><enum>(1)</enum><text>presume that none of the limitations described in subsection (a) apply; and</text> </paragraph><paragraph id="id0b57413afd7642a58a9bd0c8762e5a0a"><enum>(2)</enum><text>have the burden of establishing by clear and convincing evidence that a limitation described in subsection (a) applies.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></section><section changed="added" committee-id="SSSB00" id="idB45807BDCD0B4D8AA3775D739CFE12AB" reported-display-style="italic"><enum>6.</enum><header>Effective date; applicability</header><text display-inline="no-display-inline">The amendments made by this Act shall—</text> <paragraph id="id1BFEB14FBF744FD4858C314580755B32"><enum>(1)</enum><text display-inline="yes-display-inline">take effect on the date of enactment of this Act; and</text>
 </paragraph><paragraph id="idDB11576C7B3B463D8494A7F37E167B3C"><enum>(2)</enum><text display-inline="yes-display-inline">apply to any benefit claim or application under part L of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3796">42 U.S.C. 3796 et seq.</external-xref>) that is—</text>
 <subparagraph id="id895692E26A9B44BAB5163AC8744FFCD5"><enum>(A)</enum><text display-inline="yes-display-inline">pending before the Bureau of Justice Assistance on the date of enactment; or</text> </subparagraph><subparagraph id="id74C8E703F51B4D4FAFE2A863E8878A3C"><enum>(B)</enum><text display-inline="yes-display-inline">received by the Bureau on or after the date of enactment of this Act.</text>
				</subparagraph></paragraph></section></legis-body><endorsement><action-date>June 9, 2016</action-date><action-desc>Reported with amendments</action-desc></endorsement></bill>
