 <paragraph id="id840870ce58ff4174b6f33fc183928ea4"><enum>(1)</enum><text>the Tribal Law and Order Act of 2010 (<external-xref legal-doc="public-law" parsable-cite="pl/111/211">Public Law 111–211</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/25/2801">25 U.S.C. 2801</external-xref> note) was enacted to enhance law enforcement services, encourage interagency cooperation, and improve Federal accountability for public safety in Indian communities;</text>
 </paragraph><paragraph id="id5af1098e64b84f9a9af0649c542747bd"><enum>(2)</enum><text>in 2013, the Bureau of Indian Affairs reported increases in property crimes and violent crimes in Indian country;</text>
 </paragraph><paragraph id="id7d476c39dc054e43909d5ab21bc7217b"><enum>(3)</enum><text>according to the Department of Justice, 34 percent of total Indian country criminal matters are eligible for prosecution, a percentage that has not decreased significantly and has remained fairly steady;</text>
 </paragraph><paragraph id="id9396afe30ab74df19cfd8f158a1addfe"><enum>(4)</enum><text>during the period beginning in 2010 and ending on the date of enactment of this Act, the number of law enforcement officers working on public safety in Indian country has slightly increased, but according to the Bureau of Indian Affairs, only approximately 43 percent of the total need for those officers is currently being met;</text>
 </paragraph><paragraph id="id175f7ff38dc748a2a4a963ba164c6811"><enum>(5)</enum><text>for a period of more than 40 years prior to the date of enactment of this Act, the Shadow Wolves, a special unit of tactical officers of the U.S. Immigration and Customs Enforcement, have been deployed throughout the Tohono O'odham Nation reservation in Arizona and have been operating in an area—</text>
 <subparagraph id="idF7B0A367B74A4A43B14AC9B9D79019F5"><enum>(A)</enum><text>of more than 5,000 square miles of vast, desert, tribal land in the Southwest, 75 square miles of which is an area located along the United States border with Mexico;</text>
 </subparagraph><subparagraph id="ida528593d225c4de7ae36376fc5dc229e"><enum>(B)</enum><text>in which approximately 28,000 Indians reside; and</text> </subparagraph><subparagraph id="ide066b13bb5af4f10891ae5a10fc3808e"><enum>(C)</enum><text>that has been targeted by criminal organizations for use as a major corridor to deliver contraband from Mexico to locations throughout the United States, including other Indian reservations;</text>
 </subparagraph></paragraph><paragraph id="id0d1acb52f1654e0fb81c6629a85d2cbd"><enum>(6)</enum><text>many Bureau of Indian Affairs and tribal detention facilities continue to operate in overcrowded conditions;</text>
 </paragraph><paragraph id="idd7429f384ed94190a1a080c2df6282e7"><enum>(7)</enum><text>tribal justice systems have encountered barriers to accessing criminal data and improvements to the ability to access that data are needed to facilitate information sharing by Federal agencies;</text>
 </paragraph><paragraph id="idf60fe7590b6a4f9ca61f179c179a4679"><enum>(8)</enum><text>American Indian and Alaska Native juveniles are overrepresented in Federal and State juvenile justice systems;</text>
 </paragraph><paragraph id="idaeb7f5afee284062b83888ae7b61fb17"><enum>(9)</enum><text>there is a lack of training, collaboration, communication, and cooperation among government agencies regarding juvenile justice for Indian youth;</text>
 </paragraph><paragraph id="idb4ff3c8410094fa3856ff22ad9060cd1"><enum>(10)</enum><text>tribal youth in the Federal justice system—</text> <subparagraph id="id5738F2C6792748FDBF6E792DF8E2FE2B"><enum>(A)</enum><text>may spend more time in secure confinement than youth in State justice systems, sometimes by several years; and</text>
 </subparagraph><subparagraph id="id16151dd73683459caae8f316f2b74fb0"><enum>(B)</enum><text>are placed in facilities that may be located far away from the communities and families of the tribal youth; and</text>
 </subparagraph></paragraph><paragraph id="idbc8b6a1f5a1d4aaa9ff025a122a21722"><enum>(11)</enum><text>appropriate services for tribal youth in the Federal justice system are unavailable.</text> </paragraph></section><title id="id11A53B626B754994B3A33373BCBC7DCB" style="OLC"><enum>I</enum><header>Tribal law and order</header> <section id="id95F27140C6A0429B931531F28E7FE1C4"><enum>101.</enum><header>Bureau of Indian Affairs law enforcement</header> <subsection id="id36b8a6978984432db9e556c32f4ce06b"><enum>(a)</enum><header>Enforcement of reporting requirements</header><text>Section 3 of the Indian Law Enforcement Reform Act (<external-xref legal-doc="usc" parsable-cite="usc/25/2802">25 U.S.C. 2802</external-xref>) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id05B7559C6DF6427585AEBBEF828637C2" style="OLC">
						<subsection id="id91eece42cbba48b8b4fbd34d7481c5fd"><enum>(g)</enum><header>Enforcement of reporting requirements</header>
 <paragraph id="idABBBEB1C650847B3BE866957C7A4FC07"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), on the failure of the Director of the Office of Justice Services to submit a report in accordance with paragraph (16) or (17) of subsection (c), the Secretary shall withhold funding for the Office of the Assistant Secretary for Indian Affairs used for the administration of services, including functional expenses such as overtime, personnel salaries, and associated benefits or related tasks that directly affect those functions, to the extent that the withholding does not adversely impact the capacity of the Secretary to provide law enforcement services in Indian communities in accordance with this Act.</text>
 </paragraph><paragraph id="id6F62C40B01AF47BE9FEEDCE01D195DDF"><enum>(2)</enum><header>Restoration</header><text>The Secretary shall restore funding withheld in accordance with paragraph (1) on submission of the applicable report in accordance with paragraph (16) or (17) of subsection (c).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="id616f7af5d4324a7891faab956fcd570c"><enum>(b)</enum><header>Allowance for rentals of quarters and facilities</header><text>Section 8 of the Indian Law Enforcement Reform Act (<external-xref legal-doc="usc" parsable-cite="usc/25/2807">25 U.S.C. 2807</external-xref>) is amended—</text> <paragraph id="id417f6efc32484f0f99fb194d485308f0"><enum>(1)</enum><text>by striking the section heading and designation and all that follows through <quote>Notwithstanding the limitation</quote> and inserting the following:</text>
						<quoted-block display-inline="no-display-inline" id="id7CEC89300F744B598F6BC521FAC2AF82" style="OLC">
							<section id="id72C58C7239A14D3BAD62490CD320BC73"><enum>8.</enum><header>Allowances</header>
 <subsection id="id2B560978A22143578AF1D181DB629425"><enum>(a)</enum><header>Uniforms</header><text>Notwithstanding the limitation</text> </subsection></section><after-quoted-block>; and</after-quoted-block></quoted-block> </paragraph><paragraph id="idD8C7487B8854473FBA3ABCC7CAB752BB"><enum>(2)</enum><text>by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="idA844E32B6BBB42D395E55EFF656EF1C3" style="OLC">
 <subsection id="id40356AB5A63D4E1896A837711E6BA943"><enum>(b)</enum><header>Rentals for quarters and facilities</header><text>Notwithstanding section 5911 of title 5, United States Code, the Secretary, on recommendation of the Director of the Office of Justice Services, shall establish applicable rental rates for quarters and facilities for employees of the Office of Justice Services.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="idec134842c6ea4edd89ef8a83a58b7fda"><enum>(c)</enum><header>Law enforcement and judicial training</header><text>Section 4218(b) of the Indian Alcohol and Substance Abuse Prevention and Treatment Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/25/2451">25 U.S.C. 2451(b)</external-xref>) is amended by striking <quote>2011 through 2015</quote> and inserting <quote>2017 through 2021</quote>.</text>
 </subsection><subsection id="id8cc31e91c0104f5db0ebbddce8a7fa84"><enum>(d)</enum><header>Public safety and community policing grants</header><text>Section 1701(j) of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3796dd">42 U.S.C. 3796dd(j)</external-xref>) is amended—</text>
 <paragraph id="id9B6C0A9C3D2A4EBBBC4EDB44429ED85D"><enum>(1)</enum><text>in paragraph (1), by striking <quote>any fiscal year</quote> and inserting <quote>each fiscal year</quote>; and</text> </paragraph><paragraph id="id30010FC52EFD4A639195915A497C585B"><enum>(2)</enum><text>in paragraph (4), by striking <quote>2011 through 2015</quote> and inserting <quote>2017 through 2021</quote>.</text>
					</paragraph></subsection></section><section id="idcef3f89fa05047feab7a741226d5f593"><enum>102.</enum><header>Integration and coordination of programs</header>
 <subsection id="id5e3bdf18f57e4c39bea7c98ac8c86d1e"><enum>(a)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary of the Interior, the Secretary of Health and Human Services, and the Attorney General shall consult with Indian tribes regarding—</text>
 <paragraph id="id5b079883c60c4058a7d5857d937a4fc2"><enum>(1)</enum><text>the feasibility and effectiveness of the establishment of base funding for, and the integration and consolidation of, Federal law enforcement, public safety, and substance abuse and mental health programs for which Indian tribes are eligible, for the purposes of coordinating the programs, reducing administrative costs, and improving services for Indian tribes, individual Indians, and Indian communities;</text>
 </paragraph><paragraph id="id37c96e5069d444dead3ad080603c091d"><enum>(2)</enum><text>the use of a single application and reporting system for the consolidated approach described in paragraph (1);</text>
 </paragraph><paragraph id="id71b9f8ea53384d30a31e935ef0bb7e18"><enum>(3)</enum><text>the application of the Single Audit Act of 1984 (<external-xref legal-doc="usc" parsable-cite="usc/31/7501">31 U.S.C. 7501 et seq.</external-xref>) to the consolidated approach described in paragraph (1);</text>
 </paragraph><paragraph id="id985634fb57d34e9cae17eb9e8a622392"><enum>(4)</enum><text>the methodology for interagency transfer of funds for the consolidated approach described in paragraph (1);</text>
 </paragraph><paragraph id="id4dce50c6d9ba4a3abecd14ae28a89c4f"><enum>(5)</enum><text>the method for Federal oversight for the consolidated approach described in paragraph (1); and</text>
 </paragraph><paragraph id="id1ae3fafffed443b98dd52a56aca51f76"><enum>(6)</enum><text>any legal or administrative barriers to the implementation of the consolidated approach described in paragraph (1).</text>
 </paragraph></subsection><subsection id="id8a9fcc8a80d74865a5b4826ff436fd1d"><enum>(b)</enum><header>Responsibilities</header><text>As part of the consultation described in subsection (a), each applicable unit of the Department of the Interior, the Department of Health and Human Services, and the Department of Justice shall identify—</text>
 <paragraph id="id1C605AAA04A7450EA78EAA3A6F931881"><enum>(1)</enum><text>each program under the jurisdiction of that unit for which an Indian tribe may be eligible; and</text>
 </paragraph><paragraph id="id5396EAEE91E4485BA0D4631F65E44604"><enum>(2)</enum><text>the regulations governing each program described in paragraph (1).</text>
 </paragraph></subsection><subsection id="id8af1bad256234be3b5d593eafd63ee6c"><enum>(c)</enum><header>Submission of plan</header><text>Not later than 18 months after the date of enactment of this Act, the Secretary of the Interior, the Secretary of Health and Human Services, and the Attorney General shall jointly submit to the Committee on Indian Affairs of the Senate, the Committee on Natural Resources of the House of Representatives, and the Committee on the Judiciary of the House of Representatives a plan that includes—</text>
 <paragraph id="id49167CF8200C4DCCA146EA2433CC0672"><enum>(1)</enum><text>the findings of the consultation described in subsection (a);</text> </paragraph><paragraph id="id177065B91B11459E86EC3F114D5C0140"><enum>(2)</enum><text>the programs identified in accordance with subsection (b); and</text>
 </paragraph><paragraph id="id1E3BC186D1BB4282A4C9888DA7912F88"><enum>(3)</enum><text>any legal or administrative barriers to the implementation of the consolidated approach described in subsection (a)(1).</text>
					</paragraph></subsection></section><section id="id55101b7b93d24f9cb277254897f4b5d0"><enum>103.</enum><header>Data sharing with Indian tribes</header>
 <subsection id="id11fb3a2f64e6475d86856bd3bb29d0cb"><enum>(a)</enum><header>Information sharing with Indian tribes</header><text>Section 534(d) of title 28, United States Code, is amended—</text> <paragraph id="ide9a895cc537a441c820d5eb5455312cb"><enum>(1)</enum><text>by redesignating paragraphs (1) and (2) as subparagraphs (A) and (B), respectively, and indenting appropriately;</text>
 </paragraph><paragraph id="idc5ff680b1fcb4efb8aeb00208a90c6ec"><enum>(2)</enum><text>in the matter preceding subparagraph (A) (as so redesignated), by striking <quote>The Attorney General</quote> and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="idb7a7fbf04fc143ea8cb801291712f8f2" style="OLC"> <paragraph id="id0d6be3aaa97045e2a755f8592af66eeb"><enum>(1)</enum><header>In general</header><text>The Attorney General</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="ida554f00eb04d455a94a282936bc35bc4"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="ide3c1000382854f5f8e1b23afdaa11b45" style="OLC"> <paragraph id="idb7168a615f9745678c996a4157a474aa"><enum>(2)</enum><header>Information sharing</header><text>Any report issued as a result of the analysis of information entered into Federal criminal information databases or obtained from Federal criminal databases, including for the purpose of conducting background checks, shall be shared with Indian tribes of jurisdiction.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="id2dd2db13995847fbbd34b4fde767d9e1"><enum>(b)</enum><header>Bureau of Justice statistics</header><text>Section 302(d) of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3732">42 U.S.C. 3732(d)</external-xref>) is amended—</text>
 <paragraph id="id9216f840c7014e5d8bef148afe8bfaac"><enum>(1)</enum><text>by striking the subsection designation and all that follows through <quote>To ensure</quote> in paragraph (1) and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="id181b72a0e1e848018b0fa6866db5db8f" style="OLC"> <subsection id="ide139ad510fbc4bdeb76771c114637e57"><enum>(d)</enum><header>Justice statistical collection, analysis, and dissemination</header> <paragraph id="id29db26c87db5494e81868ba13fe240ef"><enum>(1)</enum><header>In general</header><text>To ensure</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block>

 <subparagraph id="idb9ae70902885454b8e258a82b82793f5"><enum>(B)</enum><header>Information sharing requirement</header><text>Analysis of the information collected under subparagraph (A) shall be shared with the Indian tribe that provided the information that was collected.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subparagraph></paragraph></subsection><subsection id="idc3ed723d15c54e969c77412be5ded84c"><enum>(c)</enum><header>Reports to tribes</header><text>Section 10(b) of the Indian Law Enforcement Reform Act (<external-xref legal-doc="usc" parsable-cite="usc/25/2809">25 U.S.C. 2809(b)</external-xref>) is amended—</text> <paragraph id="id40422E44FD7C4AAAA69A46CD0E3E6A8B"><enum>(1)</enum><text>in paragraph (1)—</text>
 <subparagraph id="id799FE01084E549B58DCDAF94B14CE6E2"><enum>(A)</enum><text>in subparagraph (B), by redesignating clauses (i) and (ii) as subclauses (I) and (II), respectively, and indenting appropriately; and</text>
 </subparagraph><subparagraph id="id60D1CAB9A2EB46EF84794BF6AEA6144B"><enum>(B)</enum><text>by redesignating subparagraphs (A) and (B) as clauses (i) and (ii), respectively, and indenting appropriately;</text>
 </subparagraph></paragraph><paragraph id="idA547D15FEA5D42DF9DEE694029DEDB50"><enum>(2)</enum><text>by redesignating paragraphs (1) and (2) as subparagraphs (A) and (B), respectively, and indenting appropriately;</text>

 </paragraph><paragraph id="idC5C1BAC0E20449C3BE719C94DC186AE0"><enum>(4)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="id43b52b78203847cfb5be5ed6b37c543b" style="OLC"> <paragraph id="id14b25130d9714a13bcdc67937f362885"><enum>(2)</enum><header>Consultation</header><text>Not later than 1 year after the date of enactment of the <short-title>Tribal Law and Order Reauthorization and Amendments Act of 2016</short-title>, the Attorney General shall consult with Indian tribes, including appropriate tribal justice officials, regarding—</text>
 <subparagraph id="idEEBFB355FE554221911D5D04D4D932F5"><enum>(A)</enum><text>the annual reports described in paragraph (1) to improve the data collected, the information reported, and the reporting system; and</text>
 </subparagraph><subparagraph id="idBA91D75C2EE9457DAA6C83EEC8EBEC29"><enum>(B)</enum><text>improvements to the processes for the satisfaction of the requirements for coordination described in paragraphs (1) and (3) of subsection (a).</text>
								</subparagraph></paragraph><paragraph id="idc37ca0f2317f45f8924478016cafb989"><enum>(3)</enum><header>Enforcement of reporting requirements</header>
 <subparagraph id="id2DF7E08958664253B6686678DEA5F11F"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), on the failure of the Attorney General to submit a report in accordance with paragraph (1), the Attorney General shall withhold funding for the Director of the Federal Bureau of Investigation and the Director of the Executive Office for United States Attorneys used for the administration of services, including functional expenses such as overtime, personnel salaries, and associated benefits or related tasks that directly affect those functions, to the extent that the withholding does not adversely impact the capacity of the Attorney General to provide law enforcement, investigation, or prosecution services.</text>
 </subparagraph><subparagraph id="id278D51058A2644FDAE5A606A08AB9029"><enum>(B)</enum><header>Restoration</header><text>The Attorney General shall restore funding withheld in accordance with subparagraph (A) on submission of the applicable report in accordance with paragraph (1).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection></section><section id="id82e0bdb2506e44ff808998a570977666"><enum>104.</enum><header>Judicial administration in Indian country</header>
 <subsection id="id35C97F48E6CB4FF1B84AE2B0BC2F84F6"><enum>(a)</enum><header>Bureau of prisons tribal prisoner program</header><text display-inline="yes-display-inline">Section 234(c) of the Tribal Law and Order Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/25/1302">25 U.S.C. 1302</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/111/211">Public Law 111–211</external-xref>) is amended—</text>
 <paragraph id="id4E1337036F3F4914AB75FFCA090A7F8D"><enum>(1)</enum><text>in paragraph (5), by striking <quote>3 years after the date of establishment of the pilot program</quote> and inserting <quote>5 years after the date of enactment of the <short-title>Tribal Law and Order Reauthorization and Amendments Act of 2016</short-title></quote>; and</text> </paragraph><paragraph id="idF2628FB33E6B41F7B30DBD0DAFD6E9F3"><enum>(2)</enum><text>in paragraph (6), by striking <quote>paragraph shall expire on the date that is 4 years after the date on which the program is established</quote> and inserting <quote>subsection shall expire on the date that is 7 years after the date of enactment of the <short-title>Tribal Law and Order Reauthorization and Amendments Act of 2016</short-title></quote>.</text>
 </paragraph></subsection><subsection id="id24DC94F183F345B4B8527CC6BFAA948C"><enum>(b)</enum><header>Consultation for juvenile justice reform</header><text display-inline="yes-display-inline">Section 3 of the Indian Law Enforcement Reform Act (<external-xref legal-doc="usc" parsable-cite="usc/25/2802">25 U.S.C. 2802</external-xref>) (as amended by section 101(a)) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id0e4884ffc05841e39ae0f18e97f395bb" style="OLC">
 <subsection id="idec5c407cc800451089a048e0b492c3d9"><enum>(h)</enum><header>Consultation for juvenile justice reform</header><text>Not later than 1 year after date of enactment of this subsection, the Director of the Bureau of Indian Affairs, the Director of the Bureau of Prisons, the Director of the Indian Health Service, and the Administrator of the Substance Abuse and Mental Health Services Administration shall consult with Indian tribes regarding Indian juvenile justice and incarceration, including—</text>
 <paragraph id="id6F0C6CF14F974A9BB84524D52F359E58"><enum>(1)</enum><text>the potential for using Bureau of Indian Affairs or tribal juvenile facilities for the incarceration of Indian youth in the Federal system as alternative locations closer to the communities of the Indian youth;</text>
 </paragraph><paragraph id="id693F333C988C4B649DACC6D3035C309E"><enum>(2)</enum><text>improving community-based options for the services needed and available for Indian youth in Federal incarceration;</text>
 </paragraph><paragraph id="id3067BC544EA340F08D34C04764823657"><enum>(3)</enum><text>barriers to the use of—</text> <subparagraph id="idED365CC416A24235A032F747AF84441E"><enum>(A)</enum><text>alternatives to incarceration; or</text>
 </subparagraph><subparagraph id="id6A533D094BCE4C3F968D0D19520FAB1A"><enum>(B)</enum><text>cross-agency services for Indian youth in incarceration; and</text> </subparagraph></paragraph><paragraph id="idFB6002479EF349E7A418C7DD9B7C1CF3"><enum>(4)</enum><text>the application of the Federal sentencing guidelines to Indian youth.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection></section><section id="id53c28bd24c114940848a1163862a89e6"><enum>105.</enum><header>Federal notice</header><text display-inline="no-display-inline">Section 10 of the Indian Law Enforcement Reform Act (<external-xref legal-doc="usc" parsable-cite="usc/25/2809">25 U.S.C. 2809</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idC20F03E8D0BE4E739F4E8964D0205583" style="OLC">
 <subsection id="id7a50bc3a2fee42b7bb8cd1530dc5dcdb"><enum>(d)</enum><header>Federal notice</header><text>On conviction in any district court of the United States of an enrolled member of a federally recognized Indian tribe, the Office of the United States Attorney for the district in which the member was convicted shall provide to the appropriate tribal justice official notice of the conviction and any other pertinent information.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="id5851a09836cb4ea59f93862dbc9d1843"><enum>106.</enum><header>Detention facilities</header>
 <subsection id="id908D2F83323E4EF48D877C65D7EEB776"><enum>(a)</enum><header>Indian Law Enforcement Reform Act</header><text display-inline="yes-display-inline">Section 3 of the Indian Law Enforcement Reform Act (<external-xref legal-doc="usc" parsable-cite="usc/25/2802">25 U.S.C. 2802</external-xref>) (as amended by section 104(b)) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id699903332E5041E89590689475C2759D" style="OLC">
 <subsection id="id5C7DC8D07E4B4BCCA63FCCB3A9733F39"><enum>(i)</enum><header>Alternatives to detention</header><text>In carrying out the responsibilities of the Secretary under this Act or title II of <external-xref legal-doc="public-law" parsable-cite="pl/90/284">Public Law 90–284</external-xref> (commonly known as the <quote>Indian Civil Rights Act of 1968</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/25/1301">25 U.S.C. 1301 et seq.</external-xref>), the Secretary shall authorize an Indian tribe carrying out a contract or compact pursuant to the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/450">25 U.S.C. 450 et seq.</external-xref>), on request of the Indian tribe, to use any available detention funding from the contract or compact for such appropriate alternatives to detention to which the Indian tribe and Secretary, acting through the Director of the Office of Justice Services, mutually agree.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="idac75147edd6443c9a86658c99cc276b7"><enum>(b)</enum><header>Indian Tribal Justice Act</header><text>Section 103 of the Indian Tribal Justice Act (<external-xref legal-doc="usc" parsable-cite="usc/25/3613">25 U.S.C. 3613</external-xref>) is amended—</text> <paragraph id="id1A84F140628146A3A02E60AAFC6E68FD"><enum>(1)</enum><text>by redesignating subsection (c) as subsection (d); and</text>

 </paragraph></subsection><subsection id="id849d46d4a2c9439a9215b60e9d3daadb"><enum>(c)</enum><header>Juvenile detention centers</header><text>Section 4220(b) of the Indian Alcohol and Substance Abuse Prevention and Treatment Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/25/2453">25 U.S.C. 2453(b)</external-xref>) is amended by striking <quote>2011 through 2015</quote> each place it appears and inserting <quote>2017 through 2021</quote>.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="id36ccb48ee63c44399732ea035bfdbfcd"><enum>(d)</enum><header>Payments for incarceration on tribal land</header><text>Section 20109(a) of the Violent Crime Control and Law Enforcement Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/42/13709">42 U.S.C. 13709(a)</external-xref>) is amended by striking <quote>2011 through 2015</quote> and inserting <quote>2017 through 2021</quote>.</text>
				</subsection></section><section id="ide03eb366a1684b2bac7995dedd287c9b"><enum>107.</enum><header>Reauthorization for tribal courts training</header>
 <subsection id="idAFB9AB2B7DA0445FAC70A18822332CD5"><enum>(a)</enum><header>Tribal justice systems</header><text display-inline="yes-display-inline">Section 201 of the Indian Tribal Justice Act (<external-xref legal-doc="usc" parsable-cite="usc/25/3621">25 U.S.C. 3621</external-xref>) is amended by striking <quote>2011 through 2015</quote> each place it appears and inserting <quote>2017 through 2021</quote>.</text> </subsection><subsection id="id49525ADE614B4386A5E14BC412EDF8B6"><enum>(b)</enum><header>Technical and legal assistance</header> <paragraph id="id062ADBE8D82B4DC99884D577B5FE071A"><enum>(1)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">Section 107 of the Indian Tribal Justice Technical and Legal Assistance Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/25/3666">25 U.S.C. 3666</external-xref>) is amended by striking <quote>2011 through 2015</quote> and inserting <quote>2017 through 2021</quote>.</text>
 </paragraph><paragraph id="idDB3DA725FE5E4CECB1F334712167A19D"><enum>(2)</enum><header>Grants</header><text display-inline="yes-display-inline">Section 201(d) of the Indian Tribal Justice Technical and Legal Assistance Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/25/3681">25 U.S.C. 3681(d)</external-xref>) is amended by striking <quote>2011 through 2015</quote> and inserting <quote>2017 through 2021</quote>.</text>
					</paragraph></subsection></section><section id="id8cf6547e69744596a414d94df3dd121d"><enum>108.</enum><header>Amendments to the Indian Civil Rights Act</header>
 <subsection id="idCB9E1F01A08D40EE8C9EFA24D95925FB"><enum>(a)</enum><header>Constitutional rights</header><text>Section 202(a)(10) of <external-xref legal-doc="public-law" parsable-cite="pl/90/284">Public Law 90–284</external-xref> (commonly known as the <quote>Indian Civil Rights Act of 1968</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/25/1302">25 U.S.C. 1302(a)(10)</external-xref>) is amended by inserting <quote>for 180 days or more</quote> after <quote>punishable by imprisonment</quote>.</text> </subsection><subsection id="id497945aec4d7424ea6cdb6ab52017125"><enum>(b)</enum><header>Rights of defendants</header><text>Section 204(d)(3) of <external-xref legal-doc="public-law" parsable-cite="pl/90/284">Public Law 90–284</external-xref> (commonly known as the <quote>Indian Civil Rights Act of 1968</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/25/1304">25 U.S.C. 1304(d)(3)</external-xref>) is amended in the matter preceding subparagraph (A), by striking <quote>the right</quote> and inserting <quote>if a term of imprisonment of 180 days or more may be imposed, the right</quote>.</text>
 </subsection></section><section id="idb7efc67e6df64073a2934151052b72d5"><enum>109.</enum><header>Special assistant public defender liaisons</header><text display-inline="no-display-inline">The Indian Law Enforcement Reform Act is amended by inserting after section 13 (<external-xref legal-doc="usc" parsable-cite="usc/25/2810">25 U.S.C. 2810</external-xref>) the following:</text>
				<quoted-block display-inline="no-display-inline" id="id81912DD682814E1F99CF260C675D5D6D" style="OLC">
					<section id="idc4a417c1f9c34f1d97768d51e6334b61"><enum>13A.</enum><header>Assistant Federal Public Defender tribal liaisons</header>
						<subsection id="idea5c0c93d46440a9985c2c86df365e35"><enum>(a)</enum><header>Appointment</header>
 <paragraph id="id2E16AF05CF6F44D1B5F9F842235414C8"><enum>(1)</enum><header>In general</header><text>The Federal Public Defender for each district that includes Indian country shall appoint not less than 1 assistant Federal Public Defender to serve as a tribal liaison for the district.</text>
 </paragraph><paragraph id="idbb7a6fa8653e4782a09e54043552c2c8"><enum>(2)</enum><header>Sense of Congress</header><text>It is the sense of Congress that in appointing assistant Federal Public Defenders under paragraph (1), the Federal Public Defender should consult with tribal justice officials from each Indian tribe that would be affected by the appointment.</text>
							</paragraph></subsection><subsection id="id8512c58af0254b129558d58273949102"><enum>(b)</enum><header>Duties</header>
 <paragraph id="idB4B9282CF75948E88849A506687C9156"><enum>(1)</enum><header>In general</header><text>The duties of a tribal liaison shall include the following:</text> <subparagraph id="idd549e33211b44ff4a573b96befc99919"><enum>(A)</enum><text>Coordinating the defense of Federal crimes that occur in Indian country.</text>
 </subparagraph><subparagraph id="id1ea941ca3c8f44b3bc96b942696a441e"><enum>(B)</enum><text>Consulting and coordinating with tribal public defenders to address any backlog in providing criminal defense of major crimes in Indian country in the relevant district.</text>
 </subparagraph><subparagraph id="idda4062893c1142378b2bd45a34cff899"><enum>(C)</enum><text>Developing working relationships and maintaining communication with tribal leaders and tribal community, including the interchange and understanding of cultural issues that may impact the effective assistance of counsel.</text>
 </subparagraph><subparagraph id="id4eca3d72ae614c20a26e2702a5eae12c"><enum>(D)</enum><text>Coordinating with tribal public defenders in cases in which a tribal government has concurrent jurisdiction over an alleged defendant in advance of the expiration of any applicable statute of limitation.</text>
 </subparagraph><subparagraph id="id6d809e03947944babcd3daa1b2dd1749"><enum>(E)</enum><text>Providing technical assistance and training regarding criminal defense techniques and strategies, forensics, and reentry programs and strategies for responding to crimes occurring in Indian country.</text>
 </subparagraph><subparagraph id="id296c8e55328f42f4be20414fa9e6c653"><enum>(F)</enum><text>Coordinating with the Administrative Office of the United States Courts.</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idad539437af4e46d4bda01fcb334c86d3"><enum>(2)</enum><header>Sense of Congress</header><text>It is the sense of Congress that—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id57A8DDCE8C1D487380997B172FB29CE0"><enum>(A)</enum><text>in evaluating the performance of tribal liaisons, and as part of the work performance study of the Federal public defenders, the Administrative Office of the United States Courts should take into consideration the multiple duties of tribal liaisons described in paragraph (1); and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idCE86E86D39A2457C9379BB5577BD617A"><enum>(B)</enum><text>the Federal Public Defender Service and the Attorney General should work together to ensure that each district that includes Indian country has sufficient resources to provide adequate representation.</text>
 </subparagraph></paragraph></subsection><subsection id="id2b3ccefbc5e34d7c93eaf732131add71"><enum>(c)</enum><header>Enhanced criminal defense of major crimes</header><text>Each Federal Public Defender serving a district pursuant to section 3006A of title 18, United States Code, that includes Indian country is authorized and encouraged—</text>
 <paragraph id="id99d082581ad0496687d912af645ded80"><enum>(1)</enum><text>to appoint Special Assistant Public Defenders to defend Indian defendants charged with a Federal crime occurring in Indian country as necessary to improve the administration of justice if—</text>
 <subparagraph id="id2A76F4669CDA497190E9FFC0224C7777"><enum>(A)</enum><text>the crime rate in the district exceeds the national average crime rate; or</text>
 </subparagraph><subparagraph id="idFEDA00A03AEF4F89B040A6D35A6D4776"><enum>(B)</enum><text>the rate at which Indian criminal defendants are being prosecuted in the district exceeds the national average of prosecution rates;</text>
 </subparagraph></paragraph><paragraph id="ide173b82cd29644bebc1d2fe1ceb04ec3"><enum>(2)</enum><text>to coordinate with applicable United States district courts and United States Attorneys’ Offices regarding—</text>
 <subparagraph id="id3869FA71ABC245E1B7ED280B19EF4E1E"><enum>(A)</enum><text>scheduling of Indian country matters; and</text> </subparagraph><subparagraph id="idF7BACE2148AB4E679FC559270311CF11"><enum>(B)</enum><text>holding trials or other proceedings in Indian country, as appropriate;</text>
 </subparagraph></paragraph><paragraph id="idefa7cb6d092f41379662822ce063f642"><enum>(3)</enum><text>to provide to appointed Special Assistant Federal Public Defenders appropriate training, supervision, and staff support; and</text>
 </paragraph><paragraph id="id5a1357b98780429f8067be1156636ac7"><enum>(4)</enum><text>to provide technical and other assistance to tribal governments and tribal court systems to ensure that the goals of this subsection are achieved.</text>
 </paragraph></subsection><subsection id="idc9290becb3614cf78981b62908d42026"><enum>(d)</enum><header>Effect</header><text>Nothing in this section limits the authority of any Federal Public Defender to determine the duties of a tribal liaison officer to meet the needs of the Indian tribes located within the relevant Federal district.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section id="iddb72ca8be81a466d9f528884f2814443"><enum>110.</enum><header>Offenses in Indian country: trespass on Indian land</header><text display-inline="no-display-inline">Section 1165 of title 18, United States Code, is amended—</text> <paragraph id="id90D4C718B9084D2E9B5699E61C3C989D"><enum>(1)</enum><text display-inline="yes-display-inline">in the section heading, by striking <quote><header-in-text level="section" style="USC">Hunting, trapping, or fishing</header-in-text></quote> and inserting <quote><header-in-text level="section" style="USC">Criminal trespass</header-in-text></quote>;</text>
 </paragraph><paragraph id="id569452782FDA488B9B15FC5D1E43E87E"><enum>(2)</enum><text>by inserting <quote>(referred to in this section as <quote>tribal land</quote>)</quote> after <quote>for Indian use</quote>;</text> </paragraph><paragraph id="id448128E1365D4D4EAF0465EC6969480E"><enum>(3)</enum><text display-inline="yes-display-inline">by striking <quote>Whoever, without lawful authority</quote> and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="idE008B9B07AFB4DF3A098598DC03628B8" style="OLC">
 <subsection id="idEC5B738D735D49118120EF3EE009CF9A"><enum>(a)</enum><header>Hunting, trapping, or fishing on Indian land</header><text>Whoever, without lawful authority</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block> </paragraph><paragraph id="idAE57DED8E4A942E399B954A9B1E18D0D"><enum>(4)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id03542A1428FC4E83BD709EF2A9B4ED62" style="OLC">
						<subsection id="idE6A200753BD7476F9917E7F4D6738A26"><enum>(b)</enum><header>Violation of tribal exclusion order</header>
 <paragraph id="id38efcf9b687d48cfb2d308384641da2e"><enum>(1)</enum><header>Definition of exclusion order</header><text>In this subsection, the term <term>exclusion order</term> means an order issued in a proceeding by a court of an Indian tribe that temporarily or permanently excludes a person from tribal land because of a conviction under the criminal laws of the tribal government—</text>
 <subparagraph id="id28796CD88A4D4F5D9BBBF07BBD705732"><enum>(A)</enum><text>for a violent crime (as defined under applicable tribal law); or</text>
 </subparagraph><subparagraph id="id35606AF4CFBC4F93865DCA86EC25C418"><enum>(B)</enum><text>for the sale or distribution of controlled substances.</text> </subparagraph></paragraph><paragraph id="ida30698c18c8146f0b0ffb349ec8aa997"><enum>(2)</enum><header>Violation described</header><text>It shall be unlawful for any person to knowingly violate the terms of an exclusion order that was issued by a court of an Indian tribe in accordance with paragraph (4).</text>
 </paragraph><paragraph id="id9bf86cde7037481e902d399dfeafa12d"><enum>(3)</enum><header>Penalty</header><text>Any person who violates paragraph (2) shall be fined up to $5,000 or imprisoned for up to 1 year, or both.</text>
 </paragraph><paragraph id="idff4887d0d53d4becbc300588c8a00a6e"><enum>(4)</enum><header>Requirements</header><text>The violation described in paragraph (2) applies only to an exclusion order—</text> <subparagraph id="id15df4c8b9b634bd685f98e688450f303"><enum>(A)</enum><text>for which—</text>
 <clause id="idEB6521A41D094D39A2E2228BC52B073D"><enum>(i)</enum><text>the respondent was served with, or had actual notice of, the underlying complaint; and</text> </clause><clause id="id469a24bda18a4c709328908f4e044c14"><enum>(ii)</enum><text>the underlying complaint included—</text>
 <subclause id="id0968FA5162D94262916E68E2FF348D08"><enum>(I)</enum><text>a plain statement of facts that, if true, would provide the basis for the issuance of an exclusion order against the respondent;</text>
 </subclause><subclause id="idbcae844c2b1f4367a6f42d1f72b24961"><enum>(II)</enum><text>the date, time, and place for a hearing on the complaint; and</text> </subclause><subclause id="idfff3b53048a5499e98a969257928ed69"><enum>(III)</enum><text>a statement informing the respondent that if the respondent fails to appear at the hearing on the complaint, an order may issue, the violation of which may result in—</text>

 </paragraph></subsection><subsection id="idd4d28808-1770-4df9-a474-d090c468e0e9"><enum>(b)</enum><header>Concentration of Federal efforts</header><text display-inline="yes-display-inline">Section 204(b) of the Juvenile Justice and Delinquency Prevention Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5614">42 U.S.C. 5614(b)</external-xref>) is amended—</text>
 <paragraph id="idd1b6722b38174e6fafc55a0ec36472f1"><enum>(1)</enum><text>in paragraph (6), by striking <quote>section 223(a)(15)</quote> and inserting <quote>section 223(a)(14)</quote>; and</text>

 </clause><clause id="id1F361CD2620A460FAA981EB28EEA6374" indent="up1"><enum>(iii)</enum><text>improving juvenile delinquency programs, services, and activities affecting Indian youth and Indian tribes;</text>
 </clause><clause id="id156124FA0F3D40F9AF701899D7A3E236" indent="up1"><enum>(iv)</enum><text>improving coordination among Federal departments and agencies to reduce juvenile offenses, delinquency, and recidivism;</text>
 </clause><clause id="id2300B179BA6E4482A67C6752D8E862E0" indent="up1"><enum>(v)</enum><text>the means by which traditional or cultural tribal programs may serve or be developed as promising or evidence-based programs; and</text>
 </clause><clause id="id73FD4C74BA3141A0A5A189D20DCDB404" indent="up1"><enum>(vi)</enum><text>any other matters relating to improving juvenile justice for Indian youth; and</text>
 </clause></subparagraph><subparagraph id="id2f96e145f79a412aa999511ff69717cb" indent="up1"><enum>(B)</enum><text>not later than 1 year after the date of enactment of this subparagraph, issue a tribal consultation policy for the Office of Juvenile Justice and Delinquency Prevention to govern the consultation to be conducted under subparagraph (A).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="idc3e39082-e5ba-4aa9-8082-27575c6b168d"><enum>(c)</enum><header>Coordinating Council on Juvenile Justice and Delinquency Prevention</header><text display-inline="yes-display-inline">Section 206 of the Juvenile Justice and Delinquency Prevention Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5616">42 U.S.C. 5616</external-xref>) is amended—</text>

 </subparagraph><subparagraph id="id04E4C030678847F99EF54B21722873CD"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="idA6A97DE9C54A4BAB9D3E8C1AF64DC784"><enum>(i)</enum><text>notice to an Indian tribe in any case in which a juvenile member of that Indian tribe comes in contact with the juvenile justice system of the State or other unit of local government; and</text>
 </clause><clause id="id2CDF1A72D955443AAC289D713540E4D1" indent="up1"><enum>(ii)</enum><text>intervention by, the provision of services by, or coordination with, such an Indian tribe for any Indian juvenile member of that Indian tribe in the juvenile justice system of the State or other unit of local government;</text></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>

					</paragraph></subsection></section><section id="iddb8429c9de324c28bdfe802addb8cd4d"><enum>204.</enum><header>GAO report on justice for Indian juveniles</header>
 <subsection id="id295e4807437741d59cbb730311ae09fb"><enum>(a)</enum><header>In general</header><text>The Comptroller General of the United States shall conduct a study and make findings and recommendations with respect to—</text>
 <paragraph id="idedd304f7e5734a60b5a6cc7d295a2755"><enum>(1)</enum><text>the extent of Indian youth involvement in juvenile justice systems, including—</text> <subparagraph id="idE421D3CFCD06431FBC2EA7BBD90F391A"><enum>(A)</enum><text>the number of Indian youth in Federal, State, or tribal custody;</text>
 </subparagraph><subparagraph id="id79AFEE723D1549C885EAB748B25495C8"><enum>(B)</enum><text>the nature of supervision or detention for offenses committed by Indian youth under the age of 18; and</text>
 </subparagraph><subparagraph id="idAD4295C1529D48EABBC16C093A5EF669"><enum>(C)</enum><clause commented="no" display-inline="yes-display-inline" id="id8DA3BCDE2EC24FB780DF8E8DFB264FDD"><enum>(i)</enum><text>an assessment of the type of offenses with which Indian youth are charged; and</text>
 </clause><clause id="idC2654FEF76D04C7D97B0A251DA98507C" indent="up1"><enum>(ii)</enum><text>the number of those charges that are substance abuse-related;</text> </clause></subparagraph></paragraph><paragraph id="id87f1b704bc5f4fb5a8a4eb343349afac"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id814AB0B1931B4BA5B72A7A90C4B444C0"><enum>(A)</enum><text>the facilities in which Indian youth offenders are confined; and</text>
 </subparagraph><subparagraph id="idF5FD940B357E4B34AE23A400FAC3EA4D" indent="up1"><enum>(B)</enum><text>a description of the oversight or supervision provided by the applicable governmental authority;</text>
 </subparagraph></paragraph><paragraph id="id7f74ec6728974ef1890e36bd16d3190c"><enum>(3)</enum><text>the effectiveness of Federal, State, tribal, and local efforts to prevent and treat juvenile delinquency among Indian youth, including—</text>
 <subparagraph id="id5DFA1F21F9844AE2879EDF16696E7438"><enum>(A)</enum><text>the extent of intergovernmental cooperation; and</text>
 </subparagraph><subparagraph id="id4214BC832B3E4F3D9CD8BA598EE68ED4"><enum>(B)</enum><text>available mental health and substance abuse assessments and services;</text>
 </subparagraph></paragraph><paragraph id="id059f5530435d4e5aaf85d545de225d76"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idC8EC188507B8423CA1BF3E17AE0C1E57"><enum>(A)</enum><text>existing programs, including traditional or cultural youth programs, administered by Indian tribes; and</text>
 </subparagraph><subparagraph id="idA820258DE6A44438BA38F3B86D08A3AF" indent="up1"><enum>(B)</enum><text>recommendations for how those programs may qualify, or be developed to qualify, as promising or evidence-based programs;</text>
 </subparagraph></paragraph><paragraph id="id09eeb4786c404c7495636a055c717f84"><enum>(5)</enum><text>the barriers faced by Indian tribes in providing adequate services to delinquent youth or youth at risk of becoming delinquent; and</text>
 </paragraph><paragraph id="ide13b814ca11145eea41a76ebade50ca1"><enum>(6)</enum><text>improving the effectiveness of prevention and treatment services for Indian youth.</text> </paragraph></subsection><subsection id="idf7a1fd5b3ee74d1a85a60da88bae7ecf"><enum>(b)</enum><header>Report</header><text>Not later than 18 months after the date of enactment of this Act, the Comptroller General shall submit to Congress a report describing the results of the study, findings, and recommendations under subsection (a).</text>
