		<official-title>To require the Missile Defense Agency to conduct annual tests of the ground-based midcourse defense
			 element of the ballistic missile defense system, and for other purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Missile Defense Defend and Deter Act of 2016</short-title></quote>.</text>
 </section><section id="id23ded0b0f59a4a4689a2e75fd33784a6"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following findings:</text> <paragraph id="id404c46919409423b94f011ba956d03d5"><enum>(1)</enum><text>It is in the highest strategic interest of the United States to field a fully operational missile defense system to defend against threats from intercontinental ballistic missiles (ICBMs) of rogue nations, including North Korea and Iran.</text>
 </paragraph><paragraph id="idff62048c16864aa4b9f2f93a9fae445d"><enum>(2)</enum><text>In the past year, the Democratic People's Republic of Korea tested a nuclear weapon and an intercontinental ballistic missile and has made claims that it now possesses the ability to miniaturize a nuclear warhead.</text>
 </paragraph><paragraph id="idd3a2ba44eef24d89805e1e54e262ab63"><enum>(3)</enum><text>The ground-based midcourse defense (GMD) element of the ballistic missile defense system (BMDS) is one of the most critical capabilities needed to defend the United States against threats from intercontinental ballistic missiles, conventional and nuclear.</text>
 </paragraph><paragraph id="id9319c40f8b154fc09fdc8591d1852590"><enum>(4)</enum><text>The test program of the Missile Defense Agency provides vital data to demonstrate the operational effectiveness, suitability, and survivability of the ballistic missile defense system, and it contributes to United States nonproliferation goals by sending a very credible message to the international community on the ability of the United States to defeat ballistic missiles in flight, thus reducing their value to potential adversaries.</text>
			</paragraph></section><section id="idaec55356190b4b919a9d73dfbd24bf1b"><enum>3.</enum><header>Required testing by Missile Defense Agency of ground-based midcourse defense element of ballistic
			 missile defense system</header>
 <subsection id="id1BAF7013A7B045E082807C54F89928B1"><enum>(a)</enum><header>Testing required</header><text display-inline="yes-display-inline">Except as provided in subsection (c), not less frequently than once each fiscal year, the Director of the Missile Defense Agency shall administer an intercept flight test of the ground-based midcourse defense element of the ballistic missile defense system.</text>
 </subsection><subsection id="id5E0D01665E314175BD0E394F5DBAC61B"><enum>(b)</enum><header>Requirements</header><text>The Director shall ensure that each test carried out under subsection (a) provides, when possible, for one or more of the following:</text>
 <paragraph id="idAF3B70B3F6804F44B4979FDCCE6415A3"><enum>(1)</enum><text>Validation of the operational effectiveness of the ground-based midcourse defense element of the ballistic missile defense system.</text>
 </paragraph><paragraph id="id0EED85EB915F4E68AC88750DB91F8B49"><enum>(2)</enum><text>Use of assets in their operational configuration against an inventory of targets to assess all aspects of ground-based midcourse defense elements of the ballistic missile defense system performance in a variety of flight test regimes.</text>
 </paragraph><paragraph id="idF4386B1A20A341AD93CFC72E7CCE5511"><enum>(3)</enum><text>Use of operational doctrine and real-world constraints.</text> </paragraph><paragraph id="idC234EE75D356411F9A0462C23C8BAC41"><enum>(4)</enum><text>Evaluation of new concepts of operations and exercising tactics, techniques, and procedures.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9B50FFAEE7824E0EB5F34DF75CA3F34C"><enum>(5)</enum><text>Mechanisms to assure the confidence of members of the Armed Forces in the basic design of the ground-based midcourse defense element of the ballistic missile defense system, its hit-to-kill effectiveness, and its inherent operational capability.</text>
				</paragraph></subsection><subsection id="iddc0db95a78e34150a3bb0873e7a5e693"><enum>(c)</enum><header>Exceptions</header>
 <paragraph id="id2d9e6857e5364c6981faa3d180a9818f"><enum>(1)</enum><header>Nonintercept test</header><text>The Director may forgo a test under subsection (a) in a fiscal year if the Secretary of Defense, in consultation with the Director, determines that conducting the test would—</text>
 <subparagraph id="idb3c84a07e0d743229f6bd0ec0937454a"><enum>(A)</enum><text>jeopardize national security;</text> </subparagraph><subparagraph id="id4991b45fc5354e24b6d8dd303d47ea76"><enum>(B)</enum><text>not be successful due to specific ground-based midcourse defense components needing a nonintercept test; and</text>
 </subparagraph><subparagraph id="id5ff783a5c1fa4c30aa9daf0b38b85729"><enum>(C)</enum><text>likely lead to failure due to impractical time considerations.</text> </subparagraph></paragraph><paragraph id="id538ec9deab9c4435a04418bab25b255b"><enum>(2)</enum><header>Funding</header><text>The Director may forgo a test under subsection (a) in a fiscal year if the Secretary of Defense, in consultation with the Director, determines that the test is not sufficiently funded.</text>
				</paragraph><paragraph id="idbcbeacd9e378417a93673739887c1b7e"><enum>(3)</enum><header>National security waiver</header>
 <subparagraph id="id81e18467ff93416eabd935235c7e06fe"><enum>(A)</enum><header>In general</header><text>The Director may forgo a test under subsection (a) in a fiscal year if the Secretary of Defense, in consultation with the Director of the Missile Defense Agency, Director of National Intelligence, and the Commander of United States Northern Command (NORTHCOM), determines that the provision of testing as described in that subsection is detrimental to the national security interests of the United States.</text>
					</subparagraph><subparagraph id="idb6895e88e5884049ac9212dd6d740d02"><enum>(B)</enum><header>Notice required</header>
 <clause id="id661E0D0ACEB64F6A8A8DDE2AD1FC4EE8"><enum>(i)</enum><header>In general</header><text>Not later than 30 days after forgoing a test pursuant to subparagraph (A), the Secretary shall submit to the congressional defense committees notice regarding the foregone test.</text>
 </clause><clause id="idCD0B30C981344ACE898AC6C2635175F4"><enum>(ii)</enum><header>Elements</header><text>Notice submitted under clause (i) shall include the following:</text>
 <subclause id="id56dd87f843ca42d0ad3e44ca6545bc0a"><enum>(I)</enum><text>The rationale for forgoing the test.</text> </subclause><subclause id="id2e2d195c67364ab58e576ce5305ad4be"><enum>(II)</enum><text>The national security interests of the United States preventing the test.</text>
 </subclause><subclause id="id45d5cc086fad4a4a9c33620268da8e21"><enum>(III)</enum><text>A plan to complete the intercept test in the following fiscal year, which does not affect testing in following fiscal years.</text>
 </subclause></clause><clause id="id45039804b59f479595095eac50c3f853"><enum>(iii)</enum><header>Form</header><text>Each notice under clause (ii) shall be submitted in an unclassified form, but may include a classified annex.</text>
 </clause></subparagraph></paragraph></subsection><subsection id="idFFA523E84F9B4E3D9BB47544C18FFD47"><enum>(d)</enum><header>Congressional defense committees defined</header><text>In this section, the term <term>congressional defense committees</term> has the meaning given that term in section 101(a)(16) of title 10, United States Code.</text></subsection></section></legis-body> </bill>
