		<official-title>To amend the Small Business Act to expand intellectual property education and training for small
			 businesses, and for other purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Small Business Innovation Protection Act of 2016</short-title></quote>.</text>
		</section><section display-inline="no-display-inline" id="id48CACA8A405C407B8F527B307DE0988D" section-type="subsequent-section"><enum>2.</enum><header>Definitions</header>
 <text display-inline="no-display-inline">In this Act—</text> <paragraph id="id258486FFC0C842BE9A75AA37540AB2C0"><enum>(1)</enum><text>the term <term>Administrator</term> means the Administrator of the SBA;</text>
 </paragraph><paragraph id="idC7D8D9209E98465F8B0787916A1E398A"><enum>(2)</enum><text>the term <term>Director</term> means the Under Secretary of Commerce for Intellectual Property and Director of the USPTO;</text> </paragraph><paragraph id="id07AC9A82C12C4382BDE35B145C531238"><enum>(3)</enum><text>the term <term>SBA</term> means the Small Business Administration;</text>
 </paragraph><paragraph id="id49E2D333958C404C8185914A4B650DCC"><enum>(4)</enum><text>the term <term>small business concern</term> has the meaning given the term in section 3(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632(a)</external-xref>);</text> </paragraph><paragraph id="id66D72D2857B64292BB18AADF88BB317D"><enum>(5)</enum><text>the term <term>small business development center</term> means a center described in section 21 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/648">15 U.S.C. 648</external-xref>); and</text>
 </paragraph><paragraph id="id71AC51059FB34DE49D96E9D371C8DBA1"><enum>(6)</enum><text>the term <term>USPTO</term> means the United States Patent and Trademark Office.</text> </paragraph></section><section id="id15F37BC099D64DF9BB07AFAAE42DEC56"><enum>3.</enum><header>Findings</header> <text display-inline="no-display-inline">Congress finds that—</text>
 <paragraph id="idAC4E7AE4D4D74A48B2234C0DC3FF9359"><enum>(1)</enum><text>the USPTO and the SBA are positioned to—</text> <subparagraph id="id0F37A43B1C1946E084B94F1C57CF8FF2"><enum>(A)</enum><text>build upon several successful intellectual property and training programs aimed at small business concerns; and</text>
 </subparagraph><subparagraph id="idF226249FE1FF4D7C84BB2C7C3DA47009"><enum>(B)</enum><text>increase the availability of and the participation in those programs across the United States; and</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id28A4F938DF94404CB0287B131C75C471"><enum>(2)</enum><text>any education and training program administered by the USPTO and the SBA should be scalable so that the program is able to reach more small business concerns.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="idF1BA8365F5164130A7737D8134574994"><enum>4.</enum><header>SBA and USPTO partnerships</header>
 <subsection id="id059A80918BC14F2BACBDAB45F982F4CD"><enum>(a)</enum><header>In general</header><text>Beginning not later than 180 days after the date of enactment of this Act, the Administrator, in consultation with the Director, shall develop partnership agreements that—</text>
 <paragraph id="idD293E236F3004276B97BCA0AF00EF775"><enum>(1)</enum><text>provide for the—</text> <subparagraph id="id7FFBCE222E8D447D8A365FBFDEF44553"><enum>(A)</enum><text>development of high-quality training, including in-person or modular training sessions, for small business concerns relating to domestic and international protection of intellectual property;</text>
 </subparagraph><subparagraph id="idAFB6BC2C26214BA695D46DCFCCFBF5F5"><enum>(B)</enum><text>leveraging of training materials already developed for the education of inventors and small business concerns; and</text>
 </subparagraph><subparagraph id="id26439F3EC4DD4293956E983DC0A58CB0"><enum>(C)</enum><text>participation of a nongovernmental organization; and</text> </subparagraph></paragraph><paragraph id="idCF0552CCD6B64DA688F8317682403886"><enum>(2)</enum><text>provide training—</text>
 <subparagraph id="id362D971926644C3E88AD1F6351AA76A7"><enum>(A)</enum><text>through electronic resources, including Internet-based webinars; and</text> </subparagraph><subparagraph id="id4BC9E0BFF9E04910BDD618DCBA30B623"><enum>(B)</enum><text>at physical locations, including—</text>
 <clause id="id7D99AD074C4E4290B7CC8522D594568B"><enum>(i)</enum><text>a small business development center; and</text> </clause><clause id="id4D729811A03A4069BA577069EEA1C851"><enum>(ii)</enum><text>the headquarters or a regional office of the USPTO.</text>
						</clause></subparagraph></paragraph></subsection></section><section id="idC44BCEC0515240AF869D595601E3BC0B"><enum>5.</enum><header>Small Business Development Centers</header>
 <text display-inline="no-display-inline">Section 21(c)(3) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/648">15 U.S.C. 648(c)(3)</external-xref>) is amended—</text> <paragraph id="id6E90D9BC6154462EBA4D10D6B06C86E5"><enum>(1)</enum><text>in subparagraph (S), by striking <quote>and</quote> at the end;</text>
 </paragraph><paragraph id="idA93C5DC3882A474ABE41E3A35F43D32F"><enum>(2)</enum><text>in subparagraph (T), by striking the period at the end and inserting <quote>; and</quote>; and</text> </paragraph><paragraph id="id7E48A598A6B1478AA874496BDD1B06F2"><enum>(3)</enum><text>by adding at the end the following:</text>
				<quoted-block act-name="" id="idA14DF7FC5DF94E8293E5BFE9863E96D6" style="OLC">
 <subparagraph id="idD391814610F446FF8C537FDB1CDF83B5"><enum>(U)</enum><text>in conjunction with the United States Patent and Trademark Office, providing training—</text> <clause id="id55125387BA804E72983722F5C169B80F"><enum>(i)</enum><text>to small business concerns relating to—</text>
 <subclause id="idBD373D17796244D8A7A410E23E7ADCF1"><enum>(I)</enum><text>domestic and international intellectual property protections; and</text> </subclause><subclause id="id22FCC48845D4487CA42CD659DE28A793"><enum>(II)</enum><text>how those protections should be considered in the business plans and growth strategies of the small business concerns; and</text>
 </subclause></clause><clause id="id4C1CF95597C84464A7C33F6DD2EAEFC8"><enum>(ii)</enum><text>which may be delivered—</text> <subclause id="id81A2917493424EAFA3C54F375BCE8C6C"><enum>(I)</enum><text>in person; or</text>
 </subclause><subclause id="idF256D5B90A13492488C71D084230536D"><enum>(II)</enum><text>through a website.</text> </subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></section></legis-body> </bill>
