		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Gun Rights and Due Process Act</short-title></quote>.</text>
		</section><section id="id03529c388a114802b36978f33af4cb3d"><enum>2.</enum><header>Definitions relating to mental health</header>
 <subsection id="id1fc4dd9fea3840f2965911e05be4f034"><enum>(a)</enum><header>Title 18 definitions</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/44">Chapter 44</external-xref> of title 18, United States Code, is amended—</text> <paragraph id="id0b4b2fcf16de4154ab1a8479dbc8a54b"><enum>(1)</enum><text>in section 921(a), by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="iddb9b1df181654f97aa43d936a4115dfc" style="OLC">
 <paragraph id="idf129ccec39b747029c32bd8880814890"><enum>(36)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id497D54ABD1D04D609A8677C7BB1F3B57"><enum>(A)</enum><text>Subject to subparagraph (B), the term <term>has been adjudicated mentally incompetent or has been committed to a psychiatric hospital</term>, with respect to a person—</text> <clause id="idBD5E619ACE8544619D0CC03B32F2EBFB" indent="up1"><enum>(i)</enum><text>means the person is the subject of an order or finding by a judicial officer or court—</text>
 <subclause id="id1DA0032F32D646F7B2DB191E6E4256CD"><enum>(I)</enum><text>that was issued after a hearing—</text> <item id="idB8FA67FA6D8A4CEA9F0D31BBA47C2C29"><enum>(aa)</enum><text>of which the person received actual notice; and</text>
 </item><item id="id5FF1C8639C4D406899FA49BBA9F6B702"><enum>(bb)</enum><text>at which the person had an opportunity to participate with counsel; and</text> </item></subclause><subclause id="idB32AD9A80EAA48A59297FE7A49CEADAE"><enum>(II)</enum><text>that found that the person, as a result of marked subnormal intelligence, mental impairment, mental illness, incompetency, condition, or disease—</text>
 <item id="idC3BF2F67B4D44BAAAD24CA3D543F7F48"><enum>(aa)</enum><text>was guilty but mentally ill in a criminal case, in a jurisdiction that provides for such a verdict;</text> </item><item id="idF723A1D390254305A6F99433AB51DFD7"><enum>(bb)</enum><text>was not guilty in a criminal case by reason of insanity or mental disease or defect;</text>
 </item><item id="id4A33A95DF7504F24A537A6145B2046A5"><enum>(cc)</enum><text>was incompetent to stand trial in a criminal case; or</text> </item><item id="idA5814164B8724E2C93A0F513B805C62C"><enum>(dd)</enum><text>was not guilty by reason of lack of mental responsibility under section 850a of title 10 (article 50a of the Uniform Code of Military Justice); and</text>
 </item></subclause></clause><clause id="id625AFD92EB4444E1BBE4AD5D702674FB" indent="up1"><enum>(ii)</enum><text>does not include—</text> <subclause id="id8C52C4F3DEE74680A3631228877E49EE"><enum>(I)</enum><text>an admission to a psychiatric hospital for observation; or</text>
 </subclause><subclause id="id212804B137B645F9AAFF3F72ABD5C1D5"><enum>(II)</enum><text>a voluntary admission to a psychiatric hospital.</text> </subclause></clause></subparagraph><subparagraph id="idCA614BBA46F74926BD8C53A8682093BE" indent="up1"><enum>(B)</enum><text>In this paragraph, the term <term>order or finding</term> does not include—</text>
 <clause id="idC225501B49004E5F942258880328DE84"><enum>(i)</enum><text>an order or finding that has expired or has been set aside or expunged;</text> </clause><clause id="idC1C67EAC710B4B8DB4A0CB8A16D0F8E9"><enum>(ii)</enum><text>an order or finding that is no longer applicable because a judicial officer or court has found that the person who is the subject of the order or finding—</text>
 <subclause id="idCDD898F1D8074FDAABA0873E71DFA486"><enum>(I)</enum><text>does not present a danger to himself or herself or to others;</text> </subclause><subclause id="id20D1CDF3D3A147EE84B0CB0640C3E20E"><enum>(II)</enum><text>has been restored to sanity or cured of mental disease or defect;</text>
 </subclause><subclause id="idDABE98F6AF304596960F43339A504790"><enum>(III)</enum><text>has been restored to competency; or</text> </subclause><subclause id="id74A53EDA48E7459CBD99CE3298243B52"><enum>(IV)</enum><text>no longer requires involuntary inpatient or outpatient treatment by a psychiatric hospital; or</text>
 </subclause></clause><clause id="id5A32CAD1AF0B419292D3134C37B79294"><enum>(iii)</enum><text>an order or finding with respect to which the person who is subject to the order or finding has been granted relief from disabilities under section 925(c), under a program described in section 101(c)(2)(A) or 105 of the NICS Improvement Amendments Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/18/922">18 U.S.C. 922</external-xref> note), or under any other State-authorized relief from disabilities program of the State in which the original commitment or adjudication occurred.</text>
 </clause></subparagraph></paragraph><paragraph id="idf361d43ea3e94267a58af77d4e3493c8"><enum>(37)</enum><text>The term <term>psychiatric hospital</term> includes a mental health facility, a mental hospital, a sanitarium, or a psychiatric facility, including a psychiatric ward in a general hospital.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="ided255d1e874f44c5b4a2883c905aac75"><enum>(2)</enum><text>in section 922—</text> <subparagraph id="id327b1ee55359432fa127cb9c14ca9661"><enum>(A)</enum><text>in subsection (d)(4)—</text>
 <clause id="idf171106815e041859db98b13b3118bec"><enum>(i)</enum><text>by striking <quote>as a mental defective</quote> and inserting <quote>mentally incompetent</quote>; and</text> </clause><clause id="idfc46e402dd1c4edea90285b62afb61fd"><enum>(ii)</enum><text>by striking <quote>any mental institution</quote> and inserting <quote>a psychiatric hospital</quote>; and</text>
 </clause></subparagraph><subparagraph id="idd5d0923e5bb84db2b6e8d02bb92ca8ad"><enum>(B)</enum><text>in subsection (g)(4)—</text> <clause id="id0845770350374f7c8387ce47bfcd9318"><enum>(i)</enum><text>by striking <quote>as a mental defective or who has</quote> and inserting <quote>mentally incompetent or has</quote>; and</text>
 </clause><clause id="id0cb448a1ef304fe6960c6f41ab7be795"><enum>(ii)</enum><text>by striking <quote>mental institution</quote> and inserting <quote>psychiatric hospital</quote>.</text> </clause></subparagraph></paragraph></subsection><subsection id="ide95b7e0d9c8a4bf699ef13d2104ca4a7"><enum>(b)</enum><header>Technical and conforming amendments</header><text>The NICS Improvement Amendments Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/18/922">18 U.S.C. 922</external-xref> note) is amended—</text>
 <paragraph id="id1cf4d0b891f54b42b4e5802943c5df31"><enum>(1)</enum><text>by striking <quote>as a mental defective</quote> each place that term appears and inserting <quote>mentally incompetent</quote>;</text> </paragraph><paragraph id="id9c7a07da4d6e4479b19a2ee42c5cf986"><enum>(2)</enum><text>by striking <quote>mental institution</quote> each place that term appears and inserting <quote>psychiatric hospital</quote>;</text>
 </paragraph><paragraph id="idb3c8bbfcd76b449ca4a244fbcbf73fb2"><enum>(3)</enum><text>in section 101(c)—</text> <subparagraph id="idc2ba8087aa4745379afc0b9a8c3677f2"><enum>(A)</enum><text>in paragraph (1), in the matter preceding subparagraph (A), by striking <quote>to the mental health of a person</quote> and inserting <quote>to whether a person is mentally incompetent</quote>; and</text>
 </subparagraph><subparagraph id="idfbe64e50e0fb4c8a94ae751500f28b91"><enum>(B)</enum><text>in paragraph (2)—</text> <clause id="idf9e5bfcc81df4f9bbee8747447cfdf57"><enum>(i)</enum><text>in subparagraph (A)(i), by striking <quote>to the mental health of a person</quote> and inserting <quote>to whether a person is mentally incompetent</quote>; and</text>
 </clause><clause id="idd3cbf13065ca420093baccafae12cc5e"><enum>(ii)</enum><text>in subparagraph (B), by striking <quote>to the mental health of a person</quote> and inserting <quote>to whether a person is mentally incompetent</quote>; and</text> </clause></subparagraph></paragraph><paragraph id="id34681837b6284127aad4081e21ae021e"><enum>(4)</enum><text>in section 102(c)(3)—</text>
 <subparagraph id="id56e86b61a7854f3b8930a3e6168f188d"><enum>(A)</enum><text>in the paragraph heading, by striking <quote><header-in-text level="paragraph" style="USC">as a mental defective or committed to a mental institution</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="USC">as mentally incompetent or committed to a mental institution</header-in-text></quote>; and</text> </subparagraph><subparagraph id="id5fddf68287284142887cb44870cf2f77"><enum>(B)</enum><text>by striking <quote>mental institutions</quote> and inserting <quote>psychiatric hospitals</quote>.</text>
					</subparagraph></paragraph></subsection></section><section id="id64ef6c8887fa445182a5832511bb7c67"><enum>3.</enum><header>Protecting the second amendment rights of veterans</header>
 <subsection id="id6e9bc06f8c7a4e83a83c8dcc398b6560"><enum>(a)</enum><header>Definition</header><text>In this section, the term <term>covered veteran</term> means a person who, on the day before the date of enactment of this Act, is considered to have been adjudicated as a mental defective or committed to a mental institution under subsection (d)(4) or (g)(4) of section 922 of title 18, United States Code, as a result of having been found by the Department of Veterans Affairs to be mentally incompetent.</text>
 </subsection><subsection id="idB42562459ADD4017B67BE304E9FDA678"><enum>(b)</enum><header>Review</header><text>The Secretary of Veterans Affairs shall—</text> <paragraph id="idA30910FF149F4338867DE770AFCB5FE7"><enum>(1)</enum><text>not later than 90 days after the date of enactment of this Act, conduct a review relating to each covered veteran to determine whether the proceedings for the adjudication or commitment of the covered veteran were conducted in accordance with, and resulted in an order or finding described in, section 921(a)(36) of title 18, United States Code, as added by this Act; and</text>
 </paragraph><paragraph id="id9F27A6A6D79E44D4BFE61C549C099F2B"><enum>(2)</enum><text>unless the Secretary certifies that the proceedings were conducted in accordance with, and resulted in an order or finding described in, section 921(a)(36) of title 18, United States Code, as added by this Act, ensure that the records of the covered veteran used for purposes of any determination of whether the covered veteran is disqualified from possessing or receiving a firearm under subsection (g) or (n) of section 922 of title 18, United States Code, are modified to indicate that the covered veteran has not been adjudicated mentally incompetent or committed to a psychiatric hospital.</text>
				</paragraph></subsection><subsection id="id2703C69F8CC64771A1C9017972428D8C"><enum>(c)</enum><header>Enforcement</header>
 <paragraph id="idB039C706897347E19DD1E5D9ABF13765"><enum>(1)</enum><header>Identification of inaccurate records</header><text>Not later than January 1 of each year, the Attorney General shall—</text> <subparagraph id="id268FFEA4396B481E8E969B1A943BA382"><enum>(A)</enum><text>review the record of each person who is considered to have been adjudicated mentally incompetent or committed to a psychiatric hospital under subsection (d)(4) or (g)(4) of section 922 of title 18, United States Code, as a result of having been found by the Department of Veterans Affairs to be mentally incompetent;</text>
 </subparagraph><subparagraph id="id14B8E4690C204DBCA15B473238D0D7ED"><enum>(B)</enum><text>identify each such record that does not include documentation indicating that the proceedings for the adjudication or commitment were conducted in accordance with, and resulted in an order or finding described in, section 921(a)(36) of title 18, United States Code, as added by this Act; and</text>
 </subparagraph><subparagraph id="idF53A44DFAA8A4F3B91036FFEE73FA943"><enum>(C)</enum><text>submit to the Secretary of the Treasury and Congress a report providing the number of records identified under subparagraph (B).</text>
 </subparagraph></paragraph><paragraph id="id269D282A302E41B39BBBB9EB73668CB4"><enum>(2)</enum><header>Rescission</header><text>Effective on the date on which the Attorney General submits a report under paragraph (1)(C), there is rescinded from the unobligated balances in the appropriations account appropriated under the heading <quote><header-in-text level="appropriations-small" style="OLC">general administration</header-in-text></quote> under the heading <quote><header-in-text level="appropriations-intermediate" style="OLC">Departmental Administration</header-in-text></quote> under the heading <quote><header-in-text level="appropriations-major" style="OLC">Department of Veterans Affairs</header-in-text></quote> the amount equal to the product of—</text>
 <subparagraph id="id05BEF882B8B8423792E2AE3B7EEDBC95"><enum>(A)</enum><text>the number of records that the report states were identified by the Attorney General under paragraph (1)(B); and</text>
 </subparagraph><subparagraph id="idB796E69B12574C858382D6EDAF106EC0"><enum>(B)</enum><text>$10,000.</text> </subparagraph></paragraph></subsection><subsection id="idAECCDB06FF62412DA5024CCD3A9ABB3E"><enum>(d)</enum><header>Appointment of fiduciaries</header> <paragraph id="id9ECEB39F83664025A453E4EB2E99B10E"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/55">Chapter 55</external-xref> of title 38, United States Code, is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id461EA9D9938147D692334991C6837695" style="USC">
 <section id="id0b059c233f7242a881dfaf625691edc7"><enum>5511.</enum><header>Use of determinations to appoint fiduciaries</header><text display-inline="no-display-inline">No determination by the Secretary that benefits under this title to which an individual is entitled shall be paid to a fiduciary shall be considered to be a determination that the individual has been adjudicated mentally incompetent for purposes of subsections (d)(4) and (g)(4) of section 922 of title 18.</text>
						</section><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph><paragraph id="id9a9a5b4a0dd2487baa395df8db6ff943"><enum>(2)</enum><header>Clerical amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/55">chapter 55</external-xref> of title 38, United States Code, is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id6204029CE6F54A5788C4F7CCFD4694EC" style="OLC"><toc><toc-entry bold="off" level="section">5511. Use of determinations to appoint fiduciaries.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="id2d7dbb8207c04000b0dec824eacb3fa8"><enum>4.</enum><header>Use of determinations made by the Commissioner of Social Security</header>
 <subsection id="id196aeb2279ce47c79cdec2b7812c24c6"><enum>(a)</enum><header>Title II</header><text>Section 205(j) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/405">42 U.S.C. 405(j)</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id57712E556E35456EBF58A21CC5D68510" style="OLC">
 <paragraph id="id003312cf9aca4937922565493de7c93a" indent="up1"><enum>(11)</enum><text>No determination by the Commissioner of Social Security with respect to an individual, including a determination that benefits under this title to which such individual is entitled shall be paid to a representative payee, shall be considered to be a determination that the individual has been adjudicated mentally incompetent for purposes of subsections (d)(4) and (g)(4) of section 922 of title 18, United States Code.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="ide6569ad3d3254dc3a6c9df463f9e02c5"><enum>(b)</enum><header>Title XVI</header><text>Section 1631(a)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1383">42 U.S.C. 1383(a)(2)</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idADC204F536FD499EA8C21A0B6B743244" style="OLC">
 <subparagraph id="idab267b58493541c69e3dee85cf7aefc7" indent="up2"><enum>(J)</enum><text>No determination by the Commissioner of Social Security with respect to an individual, including a determination that benefits under this title to which such individual is entitled shall be paid to a representative payee, shall be considered to be a determination that the individual has been adjudicated mentally incompetent for purposes of subsections (d)(4) and (g)(4) of section 922 of title 18, United States Code.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id41E4710C781D4F22891EED71EBC3821B"><enum>(c)</enum><header>Enforcement</header>
 <paragraph id="idD153892746054CF4A9897BDA9ACBCC02"><enum>(1)</enum><header>Identification of inaccurate records</header><text>Not later than January 1 of each year, the Attorney General shall—</text> <subparagraph id="id9BA3A9F0D3F14C6A943B9A2AC279264B"><enum>(A)</enum><text>review the record of each person who is considered to have been adjudicated mentally incompetent or committed to a psychiatric hospital under subsection (d)(4) or (g)(4) of section 922 of title 18, United States Code, as a result of a determination by the Commissioner of Social Security;</text>
 </subparagraph><subparagraph id="id6FE0476A6078436495E252B026B845B3"><enum>(B)</enum><text>identify each such record that does not include documentation indicating that the proceedings for the adjudication or commitment were conducted in accordance with, and resulted in an order or finding described in, section 921(a)(36) of title 18, United States Code, as added by this Act; and</text>
 </subparagraph><subparagraph id="id7E85F423D2D74782B3D2086451CCA5ED"><enum>(C)</enum><text>submit to the Secretary of the Treasury and Congress a report providing the number of records identified under subparagraph (B).</text>
					</subparagraph></paragraph><paragraph id="id8B94260E62604A599A621E74E3A8365F"><enum>(2)</enum><header>Rescission</header>
 <subparagraph id="id24CAFE1E6CF34D2FA8D2DD0E9EDECC28"><enum>(A)</enum><header>In general</header><text>Effective on the date on which the Attorney General submits a report under paragraph (1)(C), there is rescinded from the unobligated balances in the Federal Old-Age and Survivors Insurance Trust Fund, the Federal Disability Insurance Trust Fund, the Federal Hospital Insurance Trust Fund, and the Federal Supplementary Medical Insurance Trust Fund, on a pro rata basis, the amount equal to the product of—</text>
 <clause id="id2536970F984C4588B71C5BAA2F5F688C"><enum>(i)</enum><text>the number of records that the report states were identified by the Attorney General under paragraph (1)(B); and</text>
 </clause><clause id="idCDBBA0B37F714544A0F85369D167C751"><enum>(ii)</enum><text>$10,000.</text> </clause></subparagraph><subparagraph id="id815C2A083551404E9BB068D6781E036F"><enum>(B)</enum><header>Treatment of amounts</header><text>Amounts rescinded under subparagraph (A) shall be deemed to have been expended for costs described in section 201(g)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/401">42 U.S.C. 401(g)(1)</external-xref>).</text>
 </subparagraph></paragraph></subsection></section><section id="id35eeec1ed0674e33bb174f1a5156e555"><enum>5.</enum><header>State health reports</header><text display-inline="no-display-inline">Section 102(c)(3) of the NICS Improvement Amendments Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/18/922">18 U.S.C. 922</external-xref> note) is amended by adding at the end the following: <quote>A report made available by a State indicating that a person has been adjudicated as mentally incompetent or committed to a mental institution shall not be used for purposes of any determination of whether a person is disqualified from possessing or receiving a firearm under subsection (g) or (n) of section 922 of title 18, United States Code, unless the Attorney General determines that the proceedings for the adjudication or commitment were conducted in accordance with, and resulted in an order or finding described in, section 921(a)(36) of title 18, United States Code, and that the State has provided clear and convincing evidence that the person poses a significant danger.</quote>.</text>
 </section><section id="id6c63888a5ec543f1bc9261c8a9adf048"><enum>6.</enum><header>Applicability of amendments</header><text display-inline="no-display-inline">With respect to any record of a person prohibited from possessing or receiving a firearm under subsection (d)(4) or (g)(4) of section 922 of title 18, United States Code, before the date of enactment of this Act, the Attorney General shall remove such a record from the National Instant Criminal Background Check System—</text>
 <paragraph id="id4e0a97a2103d4de18889d09230a4d205"><enum>(1)</enum><text>upon being made aware that the person is no longer considered as adjudicated mentally incompetent or committed to a psychiatric hospital according to the criteria under paragraph (36)(A)(i)(II) of section 921(a) of title 18, United States Code (as added by this Act), and is therefore no longer prohibited from possessing or receiving a firearm;</text>
 </paragraph><paragraph id="idbdf45696aff448e0acae21a7b04cb338"><enum>(2)</enum><text>upon being made aware that any order or finding that the record is based on is an order or finding described in paragraph (36)(B) of section 921(a) of title 18, United States Code (as added by this Act); or</text>
 </paragraph><paragraph id="idcf7a57053c004b28b2cbe2deeedbfdde"><enum>(3)</enum><text>upon being made aware that the person has been found competent to possess a firearm after an administrative or judicial review under subsection (c) or (d) of section 5511 of title 38, United States Code (as added by this Act).</text>
