			 issues from calculations under the Medicare hospital value-based
			 purchasing program, and for other purposes.</official-title></form>

 <section id="HCC3F8A4AACAA44648DE415E0093C1FA5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Promoting Responsible Opioid Prescribing Act of 2016</short-title></quote> and as the <quote><short-title>PROP Act of 2016</short-title></quote>.</text> </section><section id="H1C2AA7D16557473C9D6197A52D7B033A"><enum>2.</enum><header>Removing consideration of certain pain-related issues from calculations under the Medicare hospital value-based purchasing program</header><text display-inline="no-display-inline">Section 1886(o)(2)(B) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ww">42 U.S.C. 1395ww(o)(2)(B)</external-xref>) is amended—</text>
 <paragraph id="H3A6786864D2344E9911654712D573DD7"><enum>(1)</enum><text>in clause (i)(II), by inserting <quote>, subject to clause (iii),</quote> after <quote>shall</quote>; and</text> </paragraph><paragraph id="HEE77928BC9A94CF4B1D3E61EB981590D"><enum>(2)</enum><text>by adding at the end the following new clause:</text>

 <clause id="HDEDBA1ABF8744172A683AE51365F31FE"><enum>(iii)</enum><header>Exclusion of certain pain-related measures</header><text display-inline="yes-display-inline">For value-based incentive payments made with respect to discharges occurring during fiscal year 2017 or a subsequent fiscal year, the Secretary shall ensure that measures selected under subparagraph (A) do not include measures based on any assessments by patients, with respect to hospital stays of such patients, of—</text>
 <subclause id="H7C23BC5845D24AE8AE5F462468539E1E"><enum>(I)</enum><text display-inline="yes-display-inline">the need of such patients, during such stay, for medicine for pain;</text> </subclause><subclause id="HBCEA58ABD38F4CE6942FD1636067A552"><enum>(II)</enum><text display-inline="yes-display-inline">how often, during such stay, the pain of such patients was well controlled; or</text>
 </subclause><subclause id="H117845F19C564CDE8B1E8D47D460ACB8"><enum>(III)</enum><text display-inline="yes-display-inline">how often, during such stay, the staff of the hospital in which such stay occurred did everything they could to help the patient with the pain experienced by the patient.</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
