		<official-title>To ensure that venue in patents cases is fair and proper, and for other purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Venue Equity and Non-Uniformity Elimination Act of 2016</short-title></quote>.</text>
		</section><section id="idBB17F09F8D8F42AD96EAFE27B677DD7D"><enum>2.</enum><header>Venue</header>
 <subsection id="idED7C1BD306B848E5944D59C86C1CECAF"><enum>(a)</enum><header>Amendment</header><text display-inline="yes-display-inline">Section 1400 of title 28, United States Code, is amended by striking subsection (b) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="ide471b768755e41d5ba5c7a58dd77e9f8" style="OLC">
 <subsection id="id74c28566ae16450492f8ee580098a2c9"><enum>(b)</enum><text>Notwithstanding subsections (b) and (c) of section 1391, any civil action for patent infringement or any action for a declaratory judgment that a patent is invalid or not infringed may be brought only in a judicial district—</text>
 <paragraph id="id535e76d5fe8c4fa582d78f92acbaf46d"><enum>(1)</enum><text>where the defendant has its principal place of business or is incorporated;</text>
 </paragraph><paragraph id="id445206d76ea14565a6babed60a591f42"><enum>(2)</enum><text>where the defendant has committed an act of infringement of a patent in suit and has a regular and established physical facility that gives rise to the act of infringement;</text>
 </paragraph><paragraph id="id3db5a1d42a554a2094e611b34d2ad0d8"><enum>(3)</enum><text>where the defendant has agreed or consented to be sued in the instant action;</text> </paragraph><paragraph id="id7a5ef822db7b42d290dfac7aabc97e5b"><enum>(4)</enum><text>where an inventor named on the patent in suit conducted research or development that led to the application for the patent in suit;</text>
 </paragraph><paragraph id="idef5a34752083416ea6accb5b3df1451e"><enum>(5)</enum><text>where a party has a regular and established physical facility that such party controls and operates, not primarily for the purpose of creating venue, and has—</text>
 <subparagraph id="idff078b521d97423aad6b10c850de7868"><enum>(A)</enum><text>engaged in management of significant research and development of an invention claimed in a patent in suit prior to the effective filing date of the patent;</text>
 </subparagraph><subparagraph id="id28739c5265cc45fe99a9ad215b2adcfa"><enum>(B)</enum><text>manufactured a tangible product that is alleged to embody an invention claimed in a patent in suit; or</text>
 </subparagraph><subparagraph id="ide1969fbc4971459cb3b56fa20ab5cc5a"><enum>(C)</enum><text>implemented a manufacturing process for a tangible good in which the process is alleged to embody an invention claimed in a patent in suit; or</text>
 </subparagraph></paragraph><paragraph id="id111be7b72c3040b4b54f0e9ea7c65cd9"><enum>(6)</enum><text>in the case of a foreign defendant that does not meet the requirements of paragraph (1) or (2), in accordance with section 1391(c)(3).</text></paragraph></subsection><after-quoted-block>. </after-quoted-block></quoted-block>
 </subsection><subsection id="id6f48f1408ef94a15a4e2b9a686dc3cd8"><enum>(b)</enum><header>Mandamus relief</header><text>For the purpose of determining whether relief may issue under section 1651 of title 28, United States Code, a clearly and indisputably erroneous denial of a motion under section 1406(a) of such title to dismiss or transfer a case on the basis of section 1400(b) of such title shall be deemed to cause irremediable interim harm.</text>
 </subsection><subsection id="id21a5b804675b40d89395da31f7e9ef25"><enum>(c)</enum><header>Teleworkers</header><text>The dwelling or residence of an employee or contractor of a defendant who works at such dwelling or residence shall not constitute a regular and established physical facility of the defendant for purposes of section 1400(b)(2) of title 28, United States Code, as added by subsection(a).</text>
