		<official-title>To amend section 2302 of title 5, United States Code, to include the suspension or revocation of
			 access to classified information as a personnel action, and for other
			 purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>National Security Whistleblower Protection Act of 2016</short-title></quote>.</text>
		</section><section id="id66BAFC6FAEF34F9D8A2EFEDC3CB85B54"><enum>2.</enum><header>Suspension or revocation of access to classified information</header>
 <subsection id="id96C73586106142828D28CB11E08392A4"><enum>(a)</enum><header>In general</header><text>Section 2302(a)(2)(A) of title 5, United States Code, is amended—</text> <paragraph id="idD4F8615630044FD289C9436D7EEC15B5"><enum>(1)</enum><text>in clause (xi), by striking <quote>and</quote> at the end;</text>
 </paragraph><paragraph id="id95FBAE2A1D9347518BA0D9A3B68706DF"><enum>(2)</enum><text>by redesignating clause (xii) as clause (xiii); and</text> </paragraph><paragraph id="id9569A293D5BE4708919E3F3592D16CD4"><enum>(3)</enum><text>by inserting after clause (xi) the following:</text>
					<quoted-block display-inline="no-display-inline" id="idFF65C42C4618491694CDD85AAF914D43" style="OLC">
 <clause id="idC6B8A67180D743278E6A98D114EB589D" indent="up1"><enum>(xii)</enum><text>the suspension or revocation of access to classified information; and</text></clause><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection><subsection id="id2E712773B1404A23981DE979CC1E94C0"><enum>(b)</enum><header>Application to FBI</header><text>Section 2303(a) of title 5, United States Code, is amended in the matter following paragraph (2), by inserting <quote>or clause (xii)</quote> after <quote>clauses (i) through (x)</quote>.</text>
			</subsection><subsection id="id4B88499F4F034C4B93AB3947D5DF3763"><enum>(c)</enum><header>Report by Inspector General of the Department of Defense</header>
 <paragraph id="id03F83A2751C645718CDDA2C2035D2C22"><enum>(1)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subsection—</text> <subparagraph id="id04B67496225B4AD49A9A61D400704721"><enum>(A)</enum><text display-inline="yes-display-inline">the term <term>employee</term> includes an employee of a contractor of the Department of Defense;</text>
 </subparagraph><subparagraph id="idAAA7BC5CAB0B45E19B20202F4CBA36CC"><enum>(B)</enum><text display-inline="yes-display-inline">the term <term>Inspector General</term> means the Inspector General of the Department of Defense; and</text> </subparagraph><subparagraph id="idBBDF1C6956534E949D00B00D282EBF4C"><enum>(C)</enum><text display-inline="yes-display-inline">the term <term>whistleblowing</term> means—</text>
 <clause id="idF09BF92D2BDA47B6801732448EC5288E"><enum>(i)</enum><text display-inline="yes-display-inline">making a disclosure described in section 2302(b)(8) of title 5, United States Code; or</text> </clause><clause id="id8CCE74F0DE6A4B4BA3B199CA9DBA0031"><enum>(ii)</enum><text display-inline="yes-display-inline">taking an action described in subparagraph (A)(i), (B), (C), or (D) of section 2302(b)(9) of title 5, United States Code.</text>
						</clause></subparagraph></paragraph><paragraph id="id723CE867B82E481BAFCE42CCD6370176"><enum>(2)</enum><header>Report</header>
 <subparagraph id="idA87F8D7C5E6D41F79298F0011D91DC3C"><enum>(A)</enum><header>Initial report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Inspector General shall submit to Congress a report that provides the information described in subparagraph (C) for the 5-year period ending on the date of enactment of this Act.</text>
 </subparagraph><subparagraph id="id1865C9F06144467AABD4862755A08D72"><enum>(B)</enum><header>Inclusion in semiannual report</header><text>In each semiannual report submitted to Congress by the Inspector General under <external-xref legal-doc="usc-act" parsable-cite="usc-act/Inspector General Act of 1978 /5">section 5(a)</external-xref> of the Inspector General Act of 1978 (5 U.S.C. App.) after the date on which the report under subparagraph (A) is submitted, the Inspector General shall include the information described in subparagraph (C) for the period covered by the report.</text>
					</subparagraph><subparagraph id="id3499C961B72B4DD7A2605D419FC9C45B"><enum>(C)</enum><header>Information</header>
 <clause id="id2B278C5763FB4055A01DCF971F039CE2"><enum>(i)</enum><header>In general</header><text>The information described in this subparagraph is, for each category of employee described in clause (ii)—</text>
 <subclause id="id77e26677cbc246e6a9540c3ae5759b6c"><enum>(I)</enum><text>the number of allegations received by the Inspector General (which shall include separately the number of contacts to the hotline of the Inspector General) in which an employee asserts that the access to classified information of the employee was suspended or revoked in retaliation for whistleblowing;</text>
 </subclause><subclause id="id37ab1b96e896410fa32732b90533c739"><enum>(II)</enum><text>the number of allegations described in subclause (I) that were closed by the Inspector General before a full investigation was conducted;</text>
 </subclause><subclause id="id930B22221DEC4DCEBF37FB362C8E8B8F"><enum>(III)</enum><text>the number of allegations described in subclause (I) for which a full investigation was conducted by the Inspector General;</text>
 </subclause><subclause id="id65dddc07b8524fcab9b367dd6b60d64f"><enum>(IV)</enum><text>the number of allegations described in subclause (I) in which the Inspector General determined that the access to classified information of the employee was suspended or revoked in retaliation for whistleblowing;</text>
 </subclause><subclause id="id964fbf104418499796a1e45ec42ef0be"><enum>(V)</enum><text>the number of investigations of allegations described in subclause (I) that were conducted by a component of the Department of Defense other than the Office of the Inspector General and a description of the oversight of the investigation by the Inspector General;</text>
 </subclause><subclause id="id735d021330c642f591c266973b108a03"><enum>(VI)</enum><text>the number of investigations of allegations described in subclause (I) that, upon appeal, were returned by the Inspector General of the Intelligence Community as defective;</text>
 </subclause><subclause id="id946d7bfeea5d48d0a2ab917497c15c5c"><enum>(VII)</enum><text>a description of the remedial measures taken relating to allegations described in subclause (I); and</text>
 </subclause><subclause id="id4cf5e6087f934be9b637b5f4a287c6d5"><enum>(VIII)</enum><text>a description of the disciplinary actions taken against individuals who suspended or revoked the access to classified information of an employee in retaliation for whistleblowing.</text>
 </subclause></clause><clause id="id834748FA5D5A41FF922690BFDA20606B"><enum>(ii)</enum><header>Categories of employees</header><text>The categories of employees described in this clause are the following:</text> <subclause id="id8D07B5ADFD464EA78C01A6A7D04B4207"><enum>(I)</enum><text>Employees of the Department of Defense in the civil service, as defined in section 2101(1) of title 5, United States Code.</text>
 </subclause><subclause id="idBCF1867CCEC94F39BAD936EFC007DC2F"><enum>(II)</enum><text>Employees of non­ap­pro­pri­ated fund instrumentalities of the Department.</text> </subclause><subclause id="idA2CBB05F630A44F096025DB5502B35C7"><enum>(III)</enum><text>Members of the regular components of the Armed Forces.</text>
 </subclause><subclause id="idCB7C9AFF82B3401F95E0755BEAF4476C"><enum>(IV)</enum><text>Members of the Army National Guard of the United States and Air National Guard of the United States on active duty.</text>
 </subclause><subclause id="id8EC2B2C0424449FEA3A9CCCD12ADD378"><enum>(V)</enum><text>Employees of contractors of the Department.</text> </subclause><subclause id="id16D663ACE711442AA357CBC87E94630D"><enum>(VI)</enum><text>Any other category of employees not included under clauses (I) through (V), which shall be described by the Inspector General in the applicable report.</text>
