		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Micro Drone Safety and Innovation Act of 2016</short-title></quote>.</text>
		</section><section id="id1add0acf9ad649cb8ab34a00497b365f"><enum>2.</enum><header>Operation of micro unmanned aircraft systems</header>
 <subsection id="ida2622c95c4964100956349532159b840"><enum>(a)</enum><header>In general</header><text>Subtitle B of title III of the FAA Modernization and Reform Act of 2012 (<external-xref legal-doc="public-law" parsable-cite="pl/112/95">Public Law 112–95</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/49/40101">49 U.S.C. 40101</external-xref> note) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id0C4F7F1C0B874AF3B8D85D1A791D8B5E" style="OLC">
					<section id="ide3964305a92e4877890d9ea9398b9234"><enum>337.</enum><header>Special rule for micro unmanned aircraft systems</header>
						<subsection id="id6dab7689e41444bbb1f4b6b5804081a7"><enum>(a)</enum><header>Requirements for operation of micro unmanned aircraft systems</header>
 <paragraph id="idA12D3CBFA9FF4B7CBD39DA08CFFCED41"><enum>(1)</enum><header>In general</header><text>A micro unmanned aircraft system and the operator of that system shall qualify for the exemptions described under subsections (b), (c), and (d) if the system is operated—</text>
 <subparagraph id="id98d05c6820ab438b97fa0a298d625b42"><enum>(A)</enum><text>at an altitude of less than 400 feet above ground level;</text> </subparagraph><subparagraph id="id2932c3a1651a40f893316b4f077a8cd0"><enum>(B)</enum><text>at an airspeed not greater than 40 knots;</text>
 </subparagraph><subparagraph id="id1c9a3b5662c540d7a8aef6fa9535525d"><enum>(C)</enum><text>within the visual line of sight of the operator;</text> </subparagraph><subparagraph id="idb00a01a754ca4411958d85b7501b6cd4"><enum>(D)</enum><text>during the hours between sunrise and sunset; and</text>
 </subparagraph><subparagraph id="id3eddcc2cb30243a89f83977d45a1faa2"><enum>(E)</enum><text>except as provided in paragraph (2), not less than 5 statute miles from the geographic center of an airport with an operational air traffic control tower or an airport denoted on a current aeronautical chart published by the Federal Aviation Administration.</text>
 </subparagraph></paragraph><paragraph id="id00755F91148F45538212E5FD3B8102C8"><enum>(2)</enum><header>Operation within 5 statute miles of an airport</header><text>A micro unmanned aircraft system may be operated within 5 statute miles of an airport described in paragraph (1)(E) if, before the micro unmanned aircraft system is operated within 5 statute miles of the airport, the operator of the micro unmanned aircraft system—</text>
 <subparagraph id="id0722B5B5D86F45CCAC42DCF11563B4AD"><enum>(A)</enum><text>provides notice to the airport operator; and</text> </subparagraph><subparagraph id="id06F9FFFE88014952B37161A089E5BDEC"><enum>(B)</enum><text>in the case of an airport with an operational air traffic control tower, receives approval from the air traffic control tower.</text>
 </subparagraph></paragraph></subsection><subsection id="id0f52c8ad2b17452c819c679dba17aa1f"><enum>(b)</enum><header>Exemptions for operators of micro unmanned aircraft systems</header><text>Notwithstanding sections 44703 and 44711 of title 49, United States Code, part 61 of title 14, Code of Federal Regulations, or any other provision of a statute, rule, or regulation relating to airman certification, any person may operate a micro unmanned aircraft system in accordance with subsection (a) without being required—</text>
 <paragraph id="idD7ACB00E286D476BB929DD6C1E994CEC"><enum>(1)</enum><text>to pass any aeronautical knowledge test;</text> </paragraph><paragraph id="idBE6034A8AA024B20A77B5C6CB58C73C0"><enum>(2)</enum><text>to meet any age or experience requirement; or</text>
 </paragraph><paragraph id="idD9DC30444242409AB6FB0F23090A48BD"><enum>(3)</enum><text>to obtain an airman certificate or medical certificate.</text> </paragraph></subsection><subsection id="id848dbdae6e344ec381db3139eac8efdf"><enum>(c)</enum><header>Exemption from airworthiness standards</header><text>Notwithstanding any provision of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/447">chapter 447</external-xref> of title 49, United States Code, or any other provision of a statute, rule, or regulation relating to certification of aircraft or aircraft parts or equipment, a micro unmanned aircraft system operated in accordance with subsection (a) and component parts and equipment for that system shall not be required to meet airworthiness certification standards or to obtain an airworthiness certificate.</text>
						</subsection><subsection id="id40784d6fbf494716ac48059bac62681c"><enum>(d)</enum><header>Exemptions from operational regulations</header>
 <paragraph id="id9CD657FD2FCF4D10844BC1C07C5B8376"><enum>(1)</enum><header>Part 91 regulations</header><text>Sections 91.7(a), 91.119(c), 91.121, 91.151(a)(1), 91.405(a), and 91.407(a)(1), paragraphs (1) and (2) of section 91.409(a), and subsections (a) and (b) of section 91.417 of title 14, Code of Federal Regulations, shall not apply with respect to the operation of a micro unmanned aircraft system in accordance with subsection (a).</text>
 </paragraph><paragraph id="id232AE7FA616D448EBA1911380D6A513C"><enum>(2)</enum><header>Certificate of waiver or authorization</header><text>A micro unmanned aircraft system operated in accordance with subsection (a) may be operated by any person without a certificate of authorization or waiver from the Federal Aviation Administration.</text>
 </paragraph><paragraph id="id358B766AA1D74CA8BFFDE4C10C0919EC"><enum>(3)</enum><header>Future regulations</header><text>A micro unmanned aircraft system operated in accordance with subsection (a), and the operator of such a system, shall be exempt from any additional requirements that may be prescribed pursuant to this subtitle after the date of the enactment of the <short-title>Micro Drone Safety and Innovation Act of 2016</short-title>.</text>
 </paragraph></subsection><subsection id="id6EEE8A86B4F044E082A9FE6E4823A519"><enum>(e)</enum><header>Alternative regulations</header><text>Instead of being operated in accordance with subsection (a), a micro unmanned aircraft may be operated pursuant to any form of authorization, operational rules, or exemptions pertaining to unmanned aircraft systems prescribed by the Administrator, except that a micro unmanned aircraft and its operator shall be exempt from any requirement for an airman certificate or medical certificate.</text>
 </subsection><subsection id="id6d9c36f3b058431db4f1373d391e17ce"><enum>(f)</enum><header>Micro unmanned aircraft system defined</header><text>In this section, the term <term>micro unmanned aircraft system</term> means an unmanned aircraft system the aircraft component of which weighs not more than 4.4 pounds, including payload.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="idbaa68382a497469f97ad5559142044e0"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents for the FAA Modernization and Reform Act of 2012 is amended by inserting after the item relating to section 336 the following:</text>
