		<official-title>To amend the Act of June 18, 1934, to require mandatory approval of applications for land to be
			 taken into trust if the land is wholly within a reservation, and for other
			 purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Reservation Land Consolidation Act of 2016</short-title></quote>.</text>
 </section><section id="idC5C6EA3472A1492A91E0F1317F349CD0"><enum>2.</enum><header>On-reservation land acquisitions</header><text display-inline="no-display-inline">The Act of June 18, 1934 (commonly known as the <quote>Indian Reorganization Act</quote>), is amended by inserting after section 5 (<external-xref legal-doc="usc" parsable-cite="usc/25/465">25 U.S.C. 465</external-xref>) the following:</text> <quoted-block display-inline="no-display-inline" id="idE92FB54E82E74ABC8ABB39E55F22E0A4" style="OLC"> <section id="id20B58B71867343FA8F9AE5BA6DC674BF"><enum>5A.</enum><header>On-reservation land acquisitions</header> <subsection id="id4588403FA7A04E19A6AC45629D9864E5"><enum>(a)</enum><header>Definitions</header><text>In this section:</text>
 <paragraph id="idC663FE13A0004F2B8A93EAC79EBFCEDB"><enum>(1)</enum><header>Indian tribe</header><text>The term <term>Indian tribe</term> means an Indian tribe included in the list published by the Secretary in the Federal Register pursuant to section 104 of the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/479a-1">25 U.S.C. 479a–1</external-xref>).</text>
						</paragraph><paragraph id="id8027C28080764ABCBA34FEF7E68A553B"><enum>(2)</enum><header>Reservation</header>
 <subparagraph id="idF2AE101199AC415AACD6B629216CBCFF"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraphs (B) and (C), the term <term>reservation</term> means the area of land over which an Indian tribe is recognized by the United States as having governmental jurisdiction.</text>
 </subparagraph><subparagraph id="idD31037516C994993B321F18363F534BA"><enum>(B)</enum><header>Application to certain land</header><text>Notwithstanding subparagraph (A), with respect to the State of Oklahoma or where there has been a final judicial determination that a reservation has been disestablished or diminished, the term <term>reservation</term> means the area of land constituting the former reservation of an Indian tribe, as defined by the Secretary.</text>
 </subparagraph><subparagraph id="id9A2772F5CF6C4F59930141C7BA117186"><enum>(C)</enum><header>Effect</header><text>If the meaning given the term <term>reservation</term> in subparagraphs (A) and (B) conflicts with any law enacted by Congress to acquire, or to authorize the acquisition of, title to particular land to be held in trust by the United States for the benefit of an Indian tribe, that law shall control with respect to that land.</text>
 </subparagraph></paragraph></subsection><subsection id="idC9E4FCCE327E42B0B534D07020A56AC8"><enum>(b)</enum><header>Acquisition of land in trust</header><text>An Indian tribe seeking to have land wholly within or contiguous to the reservation of the Indian tribe taken into trust for the benefit of that Indian tribe shall submit to the Secretary an application containing such title evidence necessary for the United States to accept title to the land.</text>
 </subsection><subsection id="id0fc2f7a7802b445f946899b3ff59a291"><enum>(c)</enum><header>Requirements</header><text>Immediately on application under subsection (b), and subject only to Federal land acquisition title requirements applicable to an acquisition of land by the Secretary to be held in trust for the benefit of an Indian tribe, the Secretary shall take into trust the land covered by the application.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
