		<official-title>To amend the Controlled Substances Act to permit certain partial fillings of prescriptions.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Reducing Unused Medications Act of 2016</short-title></quote>.</text>
 </section><section id="id6EBA6EF7F3974B478772F722F5733551"><enum>2.</enum><header>Prescriptions</header><text display-inline="no-display-inline">Section 309(a) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/829">21 U.S.C. 829(a)</external-xref>) is amended—</text> <paragraph id="idFB412B1FD659429D85EE04D5D3D357C7"><enum>(1)</enum><text>by inserting <quote>(1) <header-in-text level="paragraph" style="OLC">In general</header-in-text>.—</quote> before <quote>Except</quote>; and</text>
 </paragraph><paragraph id="idFE2735D82A3D4A54969032F350CD8A02"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="id42916BD9F8CB43E8A4A7257012DB74F6" style="OLC"> <paragraph id="iddf4e448656ce46709b0bb316ebea817e"><enum>(2)</enum><header>Partial filling of prescriptions</header> <subparagraph id="id90295DD5785E4E3CA715A876E45EE076"><enum>(A)</enum><header>In general</header><text>A prescription for a controlled substance in schedule II may be partially filled if—</text>
 <clause id="id9b78ca1fbafe455b896f92383dad4e34"><enum>(i)</enum><text>it is requested by—</text> <subclause id="id7B648627A29F445EB9EA57E05406E54F"><enum>(I)</enum><text>the practitioner that wrote the prescription by making a notation on the face of the written prescription, written record of the emergency oral prescription, or in the electronic prescription record; or</text>
 </subclause><subclause id="id3A7C473B3E424427971A36EB76B200EF"><enum>(II)</enum><text>the patient;</text> </subclause></clause><clause id="ided32e805275448b1a33ff0397f3b375a"><enum>(ii)</enum><text>the pharmacist partially filling the prescription records the partial filling in the same manner as a filling of the prescription;</text>
 </clause><clause id="idadcbff918d8b4dec9908472c8d4bfeb3"><enum>(iii)</enum><text>the pharmacist partially filling the prescription updates the record each time the prescription is partially filled;</text>
 </clause><clause id="id9ea5090b5c504e1dafb0424082cfb4a1"><enum>(iv)</enum><text>the total quantity dispensed in all partial fillings does not exceed the total quantity prescribed; and</text>
 </clause><clause id="idc207e5bbb1b749a1b2d5bc799475e325"><enum>(v)</enum><text>the pharmacist notifies the practitioner that wrote the prescription of each partial fill.</text> </clause></subparagraph><subparagraph id="idFAD3B86D0FA04510B61153625D0F3E5B"><enum>(B)</enum><header>Remaining portions</header><text>Remaining portions of a partially filled prescription—</text>
 <clause id="id08BB22D24B954878953411019DD9B604"><enum>(i)</enum><text>may be filled; and</text> </clause><clause id="idB811BFACF2D144599418D6E8530B2734"><enum>(ii)</enum><text>must be exhausted prior to, or on the same date that such prescription, if fully filled, would have been exhausted.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
