			 evidence samples to improve and expand the forensic science testing
			 capacity of Federal, State, and local crime laboratories, to increase
			 research and development of new testing technologies, to develop new
			 training programs regarding the collection and use of forensic evidence,
			 to provide post-conviction testing of DNA evidence to exonerate the
			 innocent, to support accreditation efforts of forensic science
			 laboratories and medical examiner offices, to address training and
			 equipment needs, to improve the performance of counsel in State capital
			 cases, and for other purposes. </official-title></form>

 <section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Justice for All Reauthorization Act of 2016</short-title></quote>.</text>
		</section><section id="idE74DD2A56B3A414E8E2C31DAFD3BCE16"><enum>2.</enum><header>Crime victims' rights</header>
 <subsection id="idca2de9ca4b04495ca2b0b6d91eb1d390"><enum>(a)</enum><header>Restitution during supervised release</header><text>Section 3583(d) of title 18, United States Code, is amended in the first sentence by inserting <quote>, that the defendant make restitution in accordance with sections 3663 and 3663A, or any other statute authorizing a sentence of restitution,</quote> after <quote>supervision</quote>.</text>
 </subsection><subsection id="id11e937076c274b3ab2f5b0a99edf13c0"><enum>(b)</enum><header>Collection of restitution from defendant’s estate</header><text>Section 3613(b) of title 18, United States Code, is amended by adding at the end the following: <quote>The liability to pay restitution shall terminate on the date that is the later of 20 years from the entry of judgment or 20 years after the release from imprisonment of the person ordered to pay restitution. In the event of the death of the person ordered to pay restitution, the individual’s estate will be held responsible for any unpaid balance of the restitution amount, and the lien provided in subsection (c) of this section shall continue until the estate receives a written release of that liability.</quote>.</text>
 </subsection><subsection id="idc229e6cc9c554cb4aee1db7430411f84"><enum>(c)</enum><header>Victim interpreters</header><text>Rule 28 of the Federal Rules of Criminal Procedure is amended in the first sentence by inserting before the period at the end the following: <quote>, including an interpreter for the victim</quote>.</text>
			</subsection></section><section id="id724c80bac1b04c38b41a44e67c65ef86"><enum>3.</enum><header>Authorization of appropriations for grants for crime victims</header>
 <subsection id="id2985e8474fb14dedb18b086b06dcdffc"><enum>(a)</enum><header>Crime victims legal assistance grants</header><text>Section 103(b) of the Justice for All Act of 2004 (<external-xref legal-doc="public-law" parsable-cite="pl/108/405">Public Law 108–405</external-xref>; 118 Stat. 2264) is amended—</text> <paragraph id="id3de4ab6e058e4524a30f5bae45cb2c55"><enum>(1)</enum><text>in paragraph (1), by striking <quote>2006, 2007, 2008, and 2009</quote> and inserting <quote>2017 through 2021</quote>;</text>
 </paragraph><paragraph id="id506db6b7a0224231b49a06245b3637d2"><enum>(2)</enum><text>in paragraph (2), by striking <quote>2006, 2007, 2008, and 2009</quote> and inserting <quote>2017 through 2021</quote>;</text> </paragraph><paragraph id="id53dac8711daf414893ec15f7841be15e"><enum>(3)</enum><text>in paragraph (3), by striking <quote>2006, 2007, 2008, and 2009</quote> and inserting <quote>2017 through 2021</quote>;</text>
 </paragraph><paragraph id="id1bfff06ef7df4fc4ad39d939ebe55ca3"><enum>(4)</enum><text>in paragraph (4), by striking <quote>2006, 2007, 2008, and 2009</quote> and inserting <quote>2017 through 2021</quote>; and</text> </paragraph><paragraph id="ide6f89cbe4d8f4afd9a46a597304a8294"><enum>(5)</enum><text>in paragraph (5), by striking <quote>2006, 2007, 2008, and 2009</quote> and inserting <quote>2017 through 2021</quote>.</text>
 </paragraph></subsection><subsection id="id1c83ffda93e249f4b3d6cb04576b32e4"><enum>(b)</enum><header>Crime victims notification grants</header><text>Section 1404E(c) of the Victims of Crime Act of 1984 (<external-xref legal-doc="usc" parsable-cite="usc/42/10603e">42 U.S.C. 10603e(c)</external-xref>) is amended by striking <quote>2006, 2007, 2008, and 2009</quote> and inserting <quote>2017 through 2021</quote>.</text> </subsection></section><section commented="no" id="id0095a8e6babc4f408996426d7339ca31"><enum>4.</enum><header>Reducing the rape kit backlog</header><text display-inline="no-display-inline">Of the amounts made available to the Attorney General for a DNA Analysis and capacity enhancement program and for other local, State, and Federal forensic activities under the heading <quote><header-in-text level="appropriations-small" style="appropriations">State and local law enforcement</header-in-text></quote> under the heading <quote><header-in-text level="appropriations-intermediate" style="appropriations">Office of Justice Programs</header-in-text></quote> under the heading <quote><header-in-text level="appropriations-major" style="OLC">Department of Justice</header-in-text></quote> in a fiscal year—</text>
 <paragraph commented="no" id="id47a470bb24444a198581d5d26b6fcbeb"><enum>(1)</enum><text>not less than 75 percent of such amounts shall be provided for grants for direct testing activities described under paragraphs (1), (2), and (3) of section 2(a) of the DNA Analysis Backlog Elimination Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/42/14135">42 U.S.C. 14135(a)</external-xref>); and</text>
 </paragraph><paragraph commented="no" id="id9750b00d3a7d403396d73a6b938725ba"><enum>(2)</enum><text>not less than 5 percent of such amounts shall be provided for grants for law enforcement agencies to conduct audits of their backlogged rape kits, including through the creation of a tracking system, under section 2(a)(7) of the DNA Analysis Backlog Elimination Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/42/14135">42 U.S.C. 14135(a)(7)</external-xref>), and to prioritize testing in those cases in which the statute of limitation will soon expire.</text>
 </paragraph></section><section id="id7647bdd04e5e495faaa7d7101c5b019d"><enum>5.</enum><header>Sexual assault nurse examiners</header><text display-inline="no-display-inline">Section 304 of the DNA Sexual Assault Justice Act of 2004 (<external-xref legal-doc="usc" parsable-cite="usc/42/14136a">42 U.S.C. 14136a</external-xref>) is amended—</text> <paragraph id="id2b8e3dee9e67464e8ad894dd832f9882"><enum>(1)</enum><text>by redesignating subsection (c) as subsection (d); and</text>
 </paragraph><paragraph id="id520fe7dd48664ea089c1fa2c6da8c26c"><enum>(2)</enum><text>by inserting after subsection (b) the following:</text> <quoted-block display-inline="no-display-inline" id="id27551bd9adfb4b54873c5bfa80bce2dd" style="OLC"> <subsection id="id6c4141c2971944a5bf20a20f0fc4718c"><enum>(c)</enum><header>Preference</header> <paragraph id="ida235e9cf3a4145349e43ee63d7edc9ea"><enum>(1)</enum><header>In general</header><text>In reviewing applications submitted in accordance with a program authorized, in whole or in part, by this section, the Attorney General shall give preference to any eligible entity that certifies that the entity will use the grant funds to—</text>
 <subparagraph id="idf772c0418adc4e8ea5b051e03f4731e7"><enum>(A)</enum><text>operate or expand forensic nurse examiner programs in a rural area or for an underserved population, as those terms are defined in section 4002 of the Violence Against Women Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/42/13925">42 U.S.C. 13925</external-xref>);</text>
 </subparagraph><subparagraph id="id5fbed9a8bd904c1dbe2da4cd8795cdc6"><enum>(B)</enum><text>hire full-time forensic nurse examiners to conduct activities under subsection (a); or</text> </subparagraph><subparagraph id="id34fa74b973864fd2a0c56c16b4859e84"><enum>(C)</enum><text>sustain or establish a training program for forensic nurse examiners.</text>
 </subparagraph></paragraph><paragraph id="id47808a6e8fbf4218af69a0df31b16571"><enum>(2)</enum><header>Directive to the Attorney General</header><text>Not later than 120 days after the date of enactment of the <short-title>Justice for All Reauthorization Act of 2016</short-title>, the Attorney General shall coordinate with the Secretary of Health and Human Services to inform Federally Qualified Health Centers, Community Health Centers, hospitals, colleges and universities, and other appropriate health-related entities about the role of forensic nurses and existing resources available within the Department of Justice and the Department of Health and Human Services to train or employ forensic nurses to address the needs of communities dealing with sexual assault, domestic violence, and elder abuse. The Attorney General shall collaborate on this effort with nongovernmental organizations representing forensic nurses.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></section><section id="id1bda5f5a682f441c8fc623745abc7d8d"><enum>6.</enum><header>Protecting the Violence Against Women Act</header><text display-inline="no-display-inline">Section 8(e)(1)(A) of the Prison Rape Elimination Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/42/15607">42 U.S.C. 15607(e)(1)(A)</external-xref>) is amended—</text>
 <paragraph id="id5e35e4a87cc946bda21ac6dbc58d171a"><enum>(1)</enum><text>in clause (i), by striking <quote>and</quote> at the end;</text> </paragraph><paragraph id="ide45c3601078c4bfa927ae144058d7d0d"><enum>(2)</enum><text>in clause (ii), by striking the period and inserting <quote>; and</quote>; and</text>
 </paragraph><paragraph id="id886e9366117c48bfb66a80feac573820"><enum>(3)</enum><text>by inserting at the end the following:</text> <quoted-block display-inline="no-display-inline" id="id44db8bae6a754e758c9bcc93f8c1e9b7" style="OLC"> <clause id="id86bda0c3d3c8406fb0c425f0fcbb690d"><enum>(iii)</enum><text>the program is not administered by the Office on Violence Against Women of the Department of Justice.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></section><section id="id215f212d5dd64bfc921a0ee839316ac5"><enum>7.</enum><header>Clarification of violence against women act housing protections</header><text display-inline="no-display-inline">Section 41411(b)(3)(B)(ii) of the Violence Against Women Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/42/14043e-11">42 U.S.C. 14043e–11(b)(3)(B)(ii)</external-xref>) is amended—</text>
 <paragraph id="id7fdfccd31b644ee0ae6ef6d48e8fec83"><enum>(1)</enum><text>in the first sentence, by inserting <quote>or resident</quote> after <quote>any remaining tenant</quote>; and</text> </paragraph><paragraph id="id5f15790c855348d1b15fda1192934c58"><enum>(2)</enum><text>in the second sentence, by inserting <quote>or resident</quote> after <quote>tenant</quote> each place it appears.</text>
 </paragraph></section><section commented="no" id="id9b7277a8b9c54de2acd4c411640f29d3"><enum>8.</enum><header>Strengthening the Prison Rape Elimination Act</header><text display-inline="no-display-inline">The Prison Rape Elimination Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/42/15601">42 U.S.C. 15601 et seq.</external-xref>) is amended—</text> <paragraph commented="no" id="id76df241be479488b82b19a771de9073a"><enum>(1)</enum><text>in section 6(d)(2) (<external-xref legal-doc="usc" parsable-cite="usc/42/15605">42 U.S.C. 15605(d)(2)</external-xref>), by striking subparagraph (A) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="id61d3bb31cb824106a9214a8309ada6a4" style="OLC">
 <subparagraph commented="no" id="id25f7c4ba76de46f88987bb8eb8069407"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="id6EFCAF1DC88D48409D12B4FC132CF567"><enum>(i)</enum><text>include the certification of the chief executive that the State receiving such grant has adopted all national prison rape standards that, as of the date on which the application was submitted, have been promulgated under this Act; or</text>
 </clause><clause commented="no" id="idB678E8E2989C4B03AEA4F4A7DAB56034" indent="up1"><enum>(ii)</enum><text>demonstrate to the Attorney General, in such manner as the Attorney General shall require, that the State receiving such grant is actively working to adopt and achieve full compliance with the national prison rape standards described in clause (i);</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph commented="no" id="idA99DFA7C1BA5407D83B633773D182CF3"><enum>(2)</enum><text display-inline="yes-display-inline">in section 8(e) (<external-xref legal-doc="usc" parsable-cite="usc/42/15607">42 U.S.C. 15607(e)</external-xref>)—</text> <subparagraph commented="no" id="id20B95A0C67524BECB3AEF85AEDFFD2B0"><enum>(A)</enum><text display-inline="yes-display-inline">by striking paragraph (2) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="id89381abf00f84ecc9e77516c77e93602" style="OLC">
						<paragraph commented="no" id="id2720ab98ce79450d8d150aa6dbf2e09f"><enum>(2)</enum><header>Adoption of national standards</header>
 <subparagraph commented="no" id="id2140efa58b894f0e8af3a13fd8521552"><enum>(A)</enum><header>In general</header><text>For each fiscal year, any amount that a State would otherwise receive for prison purposes for that fiscal year under a grant program covered by this subsection shall be reduced by 5 percent, unless the chief executive officer of the State submits to the Attorney General proof of compliance with this Act through—</text>
 <clause commented="no" id="id7957500033124a6da3f8112569cf4bba"><enum>(i)</enum><text>a certification that the State has adopted, and is in full compliance with, the national standards described in subsection (a); or</text>
 </clause><clause commented="no" id="id09f2a18175ba43f896cf1bd508e4d280"><enum>(ii)</enum><text>an assurance that the State intends to adopt and achieve full compliance with those national standards so as to ensure that a certification under clause (i) may be submitted in future years, which includes—</text>
 <subclause commented="no" id="id6964ed2a08354bf59e1ef4cc48b7cd68"><enum>(I)</enum><text>a commitment that not less than 5 percent of such amount shall be used for this purpose; or</text> </subclause><subclause commented="no" id="id6607c24481f34ce6bffa305421237917"><enum>(II)</enum><text>a request that the Attorney General hold 5 percent of such amount in abeyance pursuant to the requirements of subparagraph (E).</text>
									</subclause></clause></subparagraph><subparagraph commented="no" id="idf59814ae6e234f328f6e5dcbd8d8dcfb"><enum>(B)</enum><header>Rules for certification</header>
 <clause commented="no" id="id63847b4c6c834bff85a0e55ff33b38d1"><enum>(i)</enum><header>In general</header><text>A chief executive officer of a State who submits a certification under this paragraph shall also provide the Attorney General with—</text>
 <subclause commented="no" id="id9a7092e664d64e3598fca4d5cac048a7"><enum>(I)</enum><text>a list of the prisons under the operational control of the executive branch of the State;</text> </subclause><subclause commented="no" id="id8c42729a7a24454a8760726c94e6e5e7"><enum>(II)</enum><text>a list of the prisons listed under subclause (I) that were audited during the most recently concluded audit year;</text>
 </subclause><subclause commented="no" id="iddbddcd144adb48e49ae12db42a73b208"><enum>(III)</enum><text>all final audit reports for prisons listed under subclause (I) that were completed during the most recently concluded audit year; and</text>
 </subclause><subclause commented="no" id="iddf3aab8c754c473ebef84806524b40c6"><enum>(IV)</enum><text>a proposed schedule for completing an audit of all the prisons listed under subclause (I) during the following 3 audit years.</text>
 </subclause></clause><clause commented="no" id="idedb965c35f9e4f01a742c8bacf302b1b"><enum>(ii)</enum><header>Audit appeal exception</header><text>Beginning on the date that is 3 years after the date of enactment of the <short-title>Justice for All Reauthorization Act of 2016</short-title>, a chief executive officer of a State may submit a certification that the State is in full compliance pursuant to subparagraph (A)(i) even if a prison under the operational control of the executive branch of the State has an audit appeal pending.</text>
								</clause></subparagraph><subparagraph commented="no" id="id3bbfbb4d04bb416aa071f0c63e58fa2c"><enum>(C)</enum><header>Rules for assurances</header>
 <clause commented="no" id="id8cfdbf3ea8174fdb85810dcc45d3a18e"><enum>(i)</enum><header>In general</header><text>A chief executive officer of a State who submits an assurance under subparagraph (A)(ii) shall also provide the Attorney General with—</text>
 <subclause commented="no" id="idc4a3a127c07748789e0dd2cf4407dcc5"><enum>(I)</enum><text>a list of the prisons under the operational control of the executive branch of the State;</text> </subclause><subclause commented="no" id="id83eaea9e4b914a32a052a9cff0d23dd2"><enum>(II)</enum><text>a list of the prisons listed under subclause (I) that were audited during the most recently concluded audit year;</text>
 </subclause><subclause commented="no" id="id5512e58ec77644e8b2a8341c0a55b86b"><enum>(III)</enum><text>an explanation of any barriers the State faces to completing required audits;</text> </subclause><subclause commented="no" id="id0c0fda27d66e46c38accc06111a86b86"><enum>(IV)</enum><text>all final audit reports for prisons listed under subclause (I) that were completed during the most recently concluded audit year;</text>
 </subclause><subclause commented="no" id="ida8db5f3c0f5d440599d4532d6fd847fe"><enum>(V)</enum><text>a proposed schedule for completing an audit of all prisons under the operational control of the executive branch of the State during the following 3 audit years; and</text>
 </subclause><subclause commented="no" id="id6e75d67bc45f475584b9803c83300804"><enum>(VI)</enum><text>an explanation of the State’s current degree of implementation of the national standards.</text> </subclause></clause><clause commented="no" id="idc24ac39e60e74c708f9ad00ccb3ed7fd"><enum>(ii)</enum><header>Additional requirement</header><text>A chief executive officer of a State who submits an assurance under subparagraph (A)(ii)(I) shall, before receiving the applicable funds described in subparagraph (A)(ii)(I), also provide the Attorney General with a proposed plan for the expenditure of the funds during the applicable grant period.</text>
 </clause><clause commented="no" id="ide23cde151f7c48f89d0a08690ed459a7"><enum>(iii)</enum><header>Accounting of funds</header><text>A chief executive officer of a State who submits an assurance under subparagraph (A)(ii)(I) shall, in a manner consistent with the applicable grant reporting requirements, submit to the Attorney General a detailed accounting of how the funds described in subparagraph (A) were used.</text>
								</clause></subparagraph><subparagraph commented="no" id="id39e6457c19c440d6865d1f9b6419654a"><enum>(D)</enum><header>Sunset of assurance option</header>
 <clause commented="no" id="id50708228a9534bc0bd07675bb94e2aa9"><enum>(i)</enum><header>In general</header><text>On the date that is 3 years after the date of enactment of the <short-title>Justice for All Reauthorization Act of 2016</short-title>, subclause (II) of subparagraph (A)(ii) shall cease to have effect.</text>
 </clause><clause commented="no" id="id15263488f889474597cfe01edf192380"><enum>(ii)</enum><header>Additional sunset</header><text>On the date that is 6 years after the date of enactment of the <short-title>Justice for All Reauthorization Act of 2016</short-title>, clause (ii) of subparagraph (A) shall cease to have effect.</text> </clause><clause commented="no" id="id0c75c2baa8c84828b0400f59c26d5aa4"><enum>(iii)</enum><header>Emergency assurances</header> <subclause commented="no" id="idf29023e573324ac4a585785708b80d79"><enum>(I)</enum><header>Request</header><text>Notwithstanding clause (ii), during the 2-year period beginning 6 years after the date of enactment of the <short-title>Justice for All Reauthorization Act of 2016</short-title>, a chief executive officer of a State who certifies that the State has audited not less than 90 percent of prisons under the operational control of the executive branch of the State may request that the Attorney General allow the chief executive officer to submit an emergency assurance in accordance with subparagraph (A)(ii) as in effect on the day before the date on which that subparagraph ceased to have effect under clause (ii) of this subparagraph.</text>
 </subclause><subclause commented="no" id="idb36e36b9a8474a5991b246255d345dc0"><enum>(II)</enum><header>Grant of request</header><text>The Attorney General shall grant a request submitted under subclause (I) within 60 days upon a showing of good cause.</text>
									</subclause></clause></subparagraph><subparagraph commented="no" id="id2e7002e4fbf54852a8864aeb4849ed5d"><enum>(E)</enum><header>Disposition of funds held in abeyance</header>
 <clause commented="no" id="id1e8dc1db245040568805d9c6709ef7c5"><enum>(i)</enum><header>In general</header><text>If the chief executive officer of a State who has submitted an assurance under subparagraph (A)(ii)(II) subsequently submits a certification under subparagraph (A)(i) during the 3-year period beginning on the date of enactment of the <short-title>Justice for All Reauthorization Act of 2016</short-title>, the Attorney General will release all funds held in abeyance under subparagraph (A)(ii)(II) to be used by the State in accordance with the conditions of the grant program for which the funds were provided.</text>
 </clause><clause commented="no" id="idbc7396a5c8ee4c7389e2e9de8c741219"><enum>(ii)</enum><header>Release of funds</header><text>If the chief executive officer of a State who has submitted an assurance under subparagraph (A)(ii)(II) is unable to submit a certification during the 3-year period beginning on the date of enactment of the <short-title>Justice for All Reauthorization Act of 2016</short-title>, but does assure the Attorney General that <fraction>2/3</fraction> of prisons under the operational control of the executive branch of the State have been audited at least once, the Attorney General shall release all of the funds of the State held in abeyance to be used in adopting and achieving full compliance with the national standards, if the State agrees to comply with the applicable requirements in clauses (ii) and (iii) of subparagraph (C).</text>
 </clause><clause commented="no" id="id7f1b50c60d4a4ebf8a7e6cda48045509"><enum>(iii)</enum><header>Redistribution of funds</header><text>If the chief executive officer of a State who has submitted an assurance under subparagraph (A)(ii)(II) is unable to submit a certification during the 3-year period beginning on the date of enactment of the <short-title>Justice for All Reauthorization Act of 2016</short-title> and does not assure the Attorney General that <fraction>2/3</fraction> of prisons under the operational control of the executive branch of the State have been audited at least once, the Attorney General shall redistribute the funds of the State held in abeyance to other States to be used in accordance with the conditions of the grant program for which the funds were provided.</text>
 </clause></subparagraph><subparagraph commented="no" id="id36cfd4be056f42d09f4cb33a1e59a1a4"><enum>(F)</enum><header>Publication of audit results</header><text>Not later than 1 year after the date of enactment of the <short-title>Justice for All Reauthorization Act of 2016</short-title>, the Attorney General shall request from each State, and make available on an appropriate Internet website, all final audit reports completed to date for prisons under the operational control of the executive branch of each State. The Attorney General shall update such website annually with reports received from States under subparagraphs (B)(i) and (C)(i).</text>
 </subparagraph><subparagraph commented="no" id="idbe55164ccc344c768dc744b8f53ccccd"><enum>(G)</enum><header>Report on implementation of national standards</header><text>Not later than 2 years after the date of enactment of the <short-title>Justice for All Reauthorization Act of 2016</short-title>, the Attorney General shall issue a report to the Committee on the Judiciary of the Senate and the Committee on the Judiciary of the House of Representatives on the status of implementation of the national standards and the steps the Department, in conjunction with the States and other key stakeholders, is taking to address any unresolved implementation issues.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </subparagraph><subparagraph commented="no" id="idCE1A965938994782962386989CBDEA27"><enum>(B)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="id7FE06E00F5384A25AE4DA7D27149D4C9" style="OLC"> <paragraph commented="no" id="id8c6a520f443346639ad9793057d216b4"><enum>(8)</enum><header>Background checks for auditors</header><text>An individual seeking certification by the Department of Justice to serve as an auditor of prison compliance with the national standards described in subsection (a) shall, upon request, submit fingerprints in the manner determined by the Attorney General for criminal history record checks of the applicable State and Federal Bureau of Investigation repositories.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

 </subparagraph></paragraph><paragraph id="ida889a9b30d214833a495e8f65fbf3675"><enum>(4)</enum><text>in subsection (e)—</text> <subparagraph id="idf18e3bc36ae5466ca7f1b1aca58a6d5d"><enum>(A)</enum><text>by amending paragraph (1) to read as follows:</text>

 <clause id="id9bd882d53fda45279c719e09117deb8e"><enum>(i)</enum><header>In general</header><text>If a DNA profile is obtained through testing that excludes the applicant as the source and the DNA complies with the Federal Bureau of Investigation’s requirements for the uploading of crime scene profiles to the National DNA Index System (referred to in this subsection as <quote>NDIS</quote>), the court shall order that the law enforcement entity with direct or conveyed statutory jurisdiction that has access to the NDIS submit the DNA profile obtained from probative biological material from crime scene evidence to determine whether the DNA profile matches a profile of a known individual or a profile from an unsolved crime.</text>
 </clause><clause id="idcbff6e97b749437c861fb88ce9fc7089"><enum>(ii)</enum><header>NDIS search</header><text>The results of a search under clause (i) shall be simultaneously disclosed to the court, the applicant, and the Government.</text></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </subparagraph><subparagraph id="id67b16ed087904047a122e1d89bfae3f8"><enum>(B)</enum><text>in paragraph (2), by striking <quote>the National DNA Index System (referred to in this subsection as <quote>NDIS</quote>)</quote> and inserting <quote>NDIS</quote>; and</text> </subparagraph></paragraph><paragraph id="id9f956c69141c4c17a3611a0effed8d25"><enum>(5)</enum><text>in subsection (g)(2)(B), by striking <quote>death</quote>.</text>

 <paragraph id="id3736354cf4cb4a56aeff09c31d20e0d5"><enum>(1)</enum><text>in the matter preceding paragraph (1), by striking <quote>fiscal years 2005 through 2009</quote> and inserting <quote>fiscal years 2017 through 2021</quote>; and</text> </paragraph><paragraph id="idb034017aa10c4acabc9cca1c5a41807e"><enum>(2)</enum><text>by striking paragraph (2) and inserting the following:</text>

 <paragraph id="idfb2ece35bd16491db39c5c1df9374ebb"><enum>(2)</enum><text>for eligible entities that are a State or unit of local government, provide a certification by the chief legal officer of the State in which the eligible entity operates or the chief legal officer of the jurisdiction in which the funds will be used for the purposes of the grants, that the State or jurisdiction—</text>
 <subparagraph id="id263efcf63c0249489237c3dc1ccf55b2"><enum>(A)</enum><text>provides DNA testing of specified evidence under a State statute or a State or local rule or regulation to persons sentenced to imprisonment or death for a State felony offense, in a manner intended to ensure a reasonable process for resolving claims of actual innocence that ensures post-conviction DNA testing in at least those cases that would be covered by section 3600(a) of title 18, United States Code, had they been Federal cases and, if the results of the testing exclude the applicant as the source of the DNA, permits the applicant to apply for post-conviction relief, notwithstanding any provision of law that would otherwise bar the application as untimely; and</text>
 </subparagraph><subparagraph id="id4e06291e9d714a90bf0373c26ec3f424"><enum>(B)</enum><text>preserves biological evidence, as defined in section 3600A of title 18, United States Code, under a State statute or a State or local rule, regulation, or practice in a manner intended to ensure that reasonable measures are taken by the State or jurisdiction to preserve biological evidence secured in relation to the investigation or prosecution of, at a minimum, murder, nonnegligent manslaughter and sexual offenses.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="id81075a4da0d24b6f987afd8c49ea003b"><enum>(b)</enum><header>Authorization of appropriations</header><text>Section 412(b) of the Justice for All Act of 2004 (<external-xref legal-doc="usc" parsable-cite="usc/42/14136e">42 U.S.C. 14136e(b)</external-xref>) is amended by striking <quote>$5,000,000 for each of fiscal years 2005 through 2009</quote> and inserting <quote>$10,000,000 for each of fiscal years 2017 through 2021</quote>.</text> </subsection></section><section id="idf650ed156a7144fe9d5208ad11b6bfe8"><enum>14.</enum><header>Establishment of best practices for evidence retention</header> <subsection id="id5318dbaeed584c6697fcff830cebd9da"><enum>(a)</enum><header>In general</header><text>Subtitle A of title IV of the Justice for All Act of 2004 (<external-xref legal-doc="public-law" parsable-cite="pl/108/405">Public Law 108–405</external-xref>; 118 Stat. 2278) is amended by adding at the end the following:</text>

 <paragraph id="ida620a06d45474c10a9a11c56f0133d3f"><enum>(1)</enum><text>establish best practices for evidence retention to focus on the preservation of forensic evidence; and</text>
 </paragraph><paragraph id="id8b4d854e3de44290a1b3915aea77736e"><enum>(2)</enum><text>assist State, local, and tribal governments in adopting and implementing the best practices established under paragraph (1).</text>
 </paragraph></subsection><subsection id="id026563d2ac3742d28b7d30d75f594396"><enum>(b)</enum><header>Deadline</header><text>Not later than 1 year after the date of enactment of this section, the Director of the National Institute of Justice shall publish the best practices established under subsection (a)(1).</text>
 </subsection><subsection id="idb179c08e7dd94a0298fb4ece7fad1bd1"><enum>(c)</enum><header>Limitation</header><text>Nothing in this section shall be construed to require or obligate compliance with the best practices established under subsection (a)(1).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

					<quoted-block display-inline="no-display-inline" id="id94e7c8e0962545bb86aeb9627bec7716" style="OLC">
 <paragraph id="id431d0af488ad447ca7460ba42bf504de"><enum>(6)</enum><text>A comprehensive Statewide plan detailing how grants received under this section will be used to improve the administration of the criminal justice system, which shall—</text>
 <subparagraph id="idedb8f1c2c1214bc291b623d60ecd6b05"><enum>(A)</enum><text>be designed in consultation with local governments, and representatives of all segments of the criminal justice system, including judges, prosecutors, law enforcement personnel, corrections personnel, and providers of indigent defense services, victim services, juvenile justice delinquency prevention programs, community corrections, and reentry services;</text>
 </subparagraph><subparagraph id="id52bc368fb94b4ceb9629b8482e04b877"><enum>(B)</enum><text>include a description of how the State will allocate funding within and among each of the uses described in subparagraphs (A) through (G) of section 501(a)(1);</text>
 </subparagraph><subparagraph id="idc442de50e28d4a1ba58a066efb32c9c2"><enum>(C)</enum><text>describe the process used by the State for gathering evidence-based data and developing and using evidence-based and evidence-gathering approaches in support of funding decisions;</text>
 </subparagraph><subparagraph id="id7C07E6CD03FB4019835B4BE0ECAA1600"><enum>(D)</enum><text>describe the barriers at the State and local level for accessing data and implementing evidence-based approaches to preventing and reducing crime and recidivism; and</text>
 </subparagraph><subparagraph id="id6958a4873a2a42e18131ec4f5db422ab"><enum>(E)</enum><text>be updated every 5 years, with annual progress reports that—</text> <clause id="id0f74b9df7ecf4b00a5240ce752f15a0e"><enum>(i)</enum><text>address changing circumstances in the State, if any;</text>
 </clause><clause id="idfd7da1af93694eb0bf0560727af38a28"><enum>(ii)</enum><text>describe how the State plans to adjust funding within and among each of the uses described in subparagraphs (A) through (G) of section 501(a)(1);</text>
 </clause><clause id="id6edf13c2533b4f03b9f70a06efdf0479"><enum>(iii)</enum><text>provide an ongoing assessment of need;</text> </clause><clause id="id0821d31bdeb74918b6ce06d741ce0171"><enum>(iv)</enum><text>discuss the accomplishment of goals identified in any plan previously prepared under this paragraph; and</text>
 </clause><clause id="idffabb8ba86764cde9fb27085c87895b3"><enum>(v)</enum><text>reflect how the plan influenced funding decisions in the previous year.</text> </clause></subparagraph></paragraph><subsection id="id4572722c9b2f4001922483fe7e132318"><enum>(b)</enum><header>Technical assistance</header> <paragraph id="id7e2ad04e6fe146358877ab4bbd0e3ed0"><enum>(1)</enum><header>Strategic planning</header><text>Not later than 90 days after the date of enactment of this subsection, the Attorney General shall begin to provide technical assistance to States and local governments requesting support to develop and implement the strategic plan required under subsection (a)(6).</text>
 </paragraph><paragraph id="idba3aaca2f81743888a73cca731a24a18"><enum>(2)</enum><header>Protection of constitutional rights</header><text>Not later than 90 days after the date of enactment of this subsection, the Attorney General shall begin to provide technical assistance to States and local governments, including any agent thereof with responsibility for administration of justice, requesting support to meet the obligations established by the Sixth Amendment to the Constitution of the United States, which shall include—</text>
 <subparagraph id="ide04f99cf2a6e4c6cbefb7800f4bbb7a8"><enum>(A)</enum><text>public dissemination of practices, structures, or models for the administration of justice consistent with the requirements of the Sixth Amendment; and</text>
 </subparagraph><subparagraph id="id1670227ef83449d59f55e6bcec1844f1"><enum>(B)</enum><text>assistance with adopting and implementing a system for the administration of justice consistent with the requirements of the Sixth Amendment.</text>
 </subparagraph></paragraph><paragraph id="idffdd1e5afff34c7aafef44041371b1c5"><enum>(3)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated $5,000,000 for each of fiscal years 2017 through 2021 to carry out this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="idad8f4ab85af942b889bd8a6e061adc38"><enum>(c)</enum><header>Applicability</header><text>The requirement to submit a strategic plan under section 501(a)(6) of title I of the Omnibus Crime Control and Safe Streets Act of 1968, as added by subsection (b), shall apply to any application submitted under such section 501 for a grant for any fiscal year beginning after the date that is 1 year after the date of enactment of this Act.</text>
 </subsection></section><section id="id95ef569659cf4fd7b2716dbc29f6d2c9"><enum>16.</enum><header>Oversight and accountability</header><text display-inline="no-display-inline">All grants awarded by the Department of Justice that are authorized under this Act shall be subject to the following:</text>
 <paragraph id="id5a534d0dd80a443cac7859287f1b06b4"><enum>(1)</enum><header>Audit requirement</header><text>Beginning in fiscal year 2016, and each fiscal year thereafter, the Inspector General of the Department of Justice shall conduct audits of recipients of grants under this Act to prevent waste, fraud, and abuse of funds by grantees. The Inspector General shall determine the appropriate number of grantees to be audited each year.</text>
 </paragraph><paragraph id="id2c234f59e3d04abd828040368eaf7434"><enum>(2)</enum><header>Mandatory exclusion</header><text>A recipient of grant funds under this Act that is found to have an unresolved audit finding shall not be eligible to receive grant funds under this Act during the 2 fiscal years beginning after the 12-month period described in paragraph (5).</text>
 </paragraph><paragraph id="id8a4e8eee3a4643258e25db89542028b0"><enum>(3)</enum><header>Priority</header><text>In awarding grants under this Act, the Attorney General shall give priority to eligible entities that, during the 3 fiscal years before submitting an application for a grant under this Act, did not have an unresolved audit finding showing a violation in the terms or conditions of a Department of Justice grant program.</text>
 </paragraph><paragraph id="iddd3527b2968c42d684c30adfc06034c0"><enum>(4)</enum><header>Reimbursement</header><text>If an entity is awarded grant funds under this Act during the 2-fiscal-year period in which the entity is barred from receiving grants under paragraph (2), the Attorney General shall—</text>
 <subparagraph id="id29cfea787f1f4da2bd068c996c7b61cf"><enum>(A)</enum><text>deposit an amount equal to the grant funds that were improperly awarded to the grantee into the General Fund of the Treasury; and</text>
 </subparagraph><subparagraph id="idecab419d938541dab288ad85a4a1a9f0"><enum>(B)</enum><text>seek to recoup the costs of the repayment to the fund from the grant recipient that was erroneously awarded grant funds.</text>
 </subparagraph></paragraph><paragraph id="id2a2301264e404461aa55b99b3bac07e9"><enum>(5)</enum><header>Defined term</header><text>In this section, the term <term>unresolved audit finding</term> means an audit report finding in the final audit report of the Inspector General of the Department of Justice that the grantee has utilized grant funds for an unauthorized expenditure or otherwise unallowable cost that is not closed or resolved within a 12-month period beginning on the date when the final audit report is issued.</text>
			</paragraph><paragraph id="id17726d7482294066aa240c66a861d6ce"><enum>(6)</enum><header>Nonprofit organization requirements</header>
 <subparagraph id="id06665abc9df34ec5b03baf4b6227cd3f"><enum>(A)</enum><header>Definition</header><text>For purposes of this section and the grant programs described in this Act, the term <term>nonprofit organization</term> means an organization that is described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 and is exempt from taxation under section 501(a) of such Code.</text>
 </subparagraph><subparagraph id="idaeac573ab2564d5abe582939e5b67e3b"><enum>(B)</enum><header>Prohibition</header><text>The Attorney General shall not award a grant under any grant program described in this Act to a nonprofit organization that holds money in offshore accounts for the purpose of avoiding paying the tax described in <external-xref legal-doc="usc" parsable-cite="usc/26/511">section 511(a)</external-xref> of the Internal Revenue Code of 1986.</text>
 </subparagraph><subparagraph id="id1abdc9de650840bc88c92af48c2c9914"><enum>(C)</enum><header>Disclosure</header><text>Each nonprofit organization that is awarded a grant under a grant program described in this Act and uses the procedures prescribed in regulations to create a rebuttable presumption of reasonableness for the compensation of its officers, directors, trustees and key employees, shall disclose to the Attorney General, in the application for the grant, the process for determining such compensation, including the independent persons involved in reviewing and approving such compensation, the comparability data used, and contemporaneous substantiation of the deliberation and decision. Upon request, the Attorney General shall make the information disclosed under this subsection available for public inspection.</text>
 </subparagraph></paragraph><paragraph id="id0ffd255bde4d48fead943b9112570154"><enum>(7)</enum><header>Administrative expenses</header><text>Unless otherwise explicitly provided in authorizing legislation, not more than 7.5 percent of the amounts authorized to be appropriated under this Act may be used by the Attorney General for salaries and administrative expenses of the Department of Justice.</text>
			</paragraph><paragraph id="idb7621c9448da49798d5c1e7f4d04a3af"><enum>(8)</enum><header>Conference expenditures</header>
 <subparagraph id="id25092049c66f46b0a6f429e1bf5383c7"><enum>(A)</enum><header>Limitation</header><text>No amounts authorized to be appropriated to the Department of Justice under this Act may be used by the Attorney General or by any individual or organization awarded discretionary funds through a cooperative agreement under this Act, to host or support any expenditure for conferences that uses more than $20,000 in Department funds, unless the Deputy Attorney General or the appropriate Assistant Attorney General, Director, or principal deputy as the Deputy Attorney General may designate, provides prior written authorization that the funds may be expended to host a conference.</text>
 </subparagraph><subparagraph id="id9a1a27eee5d94027b1b9beab87f3f30b"><enum>(B)</enum><header>Written approval</header><text>Written approval under subparagraph (A) shall include a written estimate of all costs associated with the conference, including the cost of all food and beverages, audio/visual equipment, honoraria for speakers, and any entertainment.</text>
 </subparagraph><subparagraph id="ida509f0cdb702494989a963d8bd92a4b5"><enum>(C)</enum><header>Report</header><text>The Deputy Attorney General shall submit an annual report to the Committee on the Judiciary of the Senate and the Committee on the Judiciary of the House of Representatives on all conference expenditures approved by operation of this paragraph.</text>
				</subparagraph></paragraph><paragraph id="id465ac1ff3feb4d8688e8c7de4cdae03d"><enum>(9)</enum><header>Prohibition on lobbying activity</header>
 <subparagraph id="idbdbebbde129c4023890be6d592f9fac7"><enum>(A)</enum><header>In general</header><text>Amounts authorized to be appropriated under this Act may not be utilized by any grant recipient to—</text> <clause id="id20bc7b23e17c4add8d030379eee805f8"><enum>(i)</enum><text>lobby any representative of the Department of Justice regarding the award of grant funding; or</text>
 </clause><clause id="id1176962158fd4472af15103a92ebfb44"><enum>(ii)</enum><text>lobby any representative of a Federal, State, local, or tribal government regarding the award of grant funding.</text>
 </clause></subparagraph><subparagraph id="idd35f7d99ca584a4ea84471b811527575"><enum>(B)</enum><header>Penalty</header><text>If the Attorney General determines that any recipient of a grant under this Act has violated subparagraph (A), the Attorney General shall—</text>
 <clause id="id14d4f119decf435aa309766b988ab7e1"><enum>(i)</enum><text>require the grant recipient to repay the grant in full; and</text> </clause><clause id="id267afb2c249441aa82b8f21c9b7d1956"><enum>(ii)</enum><text>prohibit the grant recipient from receiving another grant under this Act for not less than 5 years.</text>
					</clause></subparagraph></paragraph></section><section id="id36FD181B0BED4B23B53D40E0C84616BC"><enum>17.</enum><header>Needs assessment of forensic laboratories</header>
 <subsection id="id446EE8377DC849E6AE3F7813137E0377"><enum>(a)</enum><header>Study and report</header><text display-inline="yes-display-inline">Not later than October 1, 2018, the Attorney General shall conduct a study and submit a report to the Committee on the Judiciary of the Senate and the Committee on the Judiciary of the House of Representatives on the status and needs of the forensic science community.</text>
 </subsection><subsection id="id0847CD13BADD4955807DE0F91F167F41"><enum>(b)</enum><header>Requirements</header><text display-inline="yes-display-inline">The report required under subsection (a) shall—</text> <paragraph id="id9E4EE81A778A4206A826AEE0AD6D4780"><enum>(1)</enum><text display-inline="yes-display-inline">examine the status of current workload, backlog, personnel, equipment, and equipment needs of public crime laboratories and medical examiner and coroner offices;</text>
 </paragraph><paragraph id="id24D69A29B6FB4F2DB44E0883D7C71698"><enum>(2)</enum><text display-inline="yes-display-inline">include an overview of academic forensic science resources and needs, from a broad forensic science perspective, including nontraditional crime laboratory disciplines such as forensic anthropology, forensic entomology, and others as determined appropriate by the Attorney General;</text>
 </paragraph><paragraph id="id53E7A667C1E043369C1021B7BB70D243"><enum>(3)</enum><text display-inline="yes-display-inline">consider—</text> <subparagraph id="idA5D57F5831024312B8867B19A6E74C79"><enum>(A)</enum><text display-inline="yes-display-inline">the National Institute of Justice study, Forensic Sciences: Review of Status and Needs, published in 1999;</text>
 </subparagraph><subparagraph id="id2A7BE62B118541A7988F3CDA6D7E6A4B"><enum>(B)</enum><text display-inline="yes-display-inline">the Bureau of Justice Statistics census reports on Publicly Funded Forensic Crime Laboratories, published in 2002, 2005, 2009, and 2014;</text>
 </subparagraph><subparagraph id="id3D77BE67761847AAB5E15D52F7822E5D"><enum>(C)</enum><text display-inline="yes-display-inline">the National Academy of Sciences report, Strengthening Forensic Science: A Path Forward, published in 2009; and</text>
 </subparagraph><subparagraph id="idE50DA745C2184383A6A0C42185C6A3AB"><enum>(D)</enum><text display-inline="yes-display-inline">the Bureau of Justice Statistics survey of forensic providers recommended by the National Commission of Forensic Science and approved by the Attorney General on September 8, 2014;</text>
 </subparagraph></paragraph><paragraph id="id8453AE034AF94440848E81DEA4DB17C7"><enum>(4)</enum><text display-inline="yes-display-inline">provide Congress with a comprehensive view of the infrastructure, equipment, and personnel needs of the broad forensic science community; and</text>
 </paragraph><paragraph id="idB71139B245E84B3DA47C41C328E2AC3C"><enum>(5)</enum><text>be made available to the public.</text> </paragraph></subsection></section><section id="id3F3855422E604F1AA7E5795166282EDB"><enum>18.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text>
 <paragraph id="ida71b47e0437b4e7e996514f69983be54"><enum>(1)</enum><text>the authority of the Director of the Office of Victims of Crime under section 1404 of the Victims of Crime Act of 1984 (<external-xref legal-doc="usc" parsable-cite="usc/42/10603">42 U.S.C. 10603</external-xref>) includes funding ongoing projects that provide services to victims of crime on a nationwide basis or Americans abroad who are victims of crimes committed outside of the United States; and</text>
 </paragraph><paragraph id="id2ba5a3a593e84f558869a7b86fd7ac41"><enum>(2)</enum><text>the proposed rule entitled <quote>VOCA Victim Assistance Program</quote> published by the Office of Victims of Crime of the Department of Justice in the Federal Register on August 27, 2013 (78 Fed. Reg. 52877), is consistent with section 1404 of the Victims of Crime Act of 1984 (<external-xref legal-doc="usc" parsable-cite="usc/42/10603">42 U.S.C. 10603</external-xref>).</text></paragraph></section></legis-body></bill>
