		<official-title>To amend title 10, United States Code, to ensure criminal background checks of employees of the
			 military child care system and providers
			 of child
			 care services and youth program services for military dependents. </official-title>

 <section id="idB1F229A1BFA64637A0F96C1E33498377" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Military Child Care Protection Act of 2016</short-title></quote>.</text> </section><section id="idE362C51E74B6420CADCB3C908FB8E90E" section-type="subsequent-section"><enum>2.</enum><header>Criminal background checks of employees of the military child care system and providers of child care services and youth program services for military dependents</header> <subsection id="id02AF948F40184D31858A9112D8D698D4"><enum>(a)</enum><header>Employees of military child care system</header><text>Section 1792 of title 10, United States Code, is amended—</text>
 <paragraph id="id8400893AC7A9420BB2FF6FC121C74074"><enum>(1)</enum><text>by redesignating subsection (d) as subsection (e); and</text> </paragraph><paragraph id="id04FFDF5B7E694CFDB920F3B10DAA9033"><enum>(2)</enum><text>by inserting after subsection (c) the following new subsection (d):</text>
					<quoted-block display-inline="no-display-inline" id="idFF7C0AA7FDA342038A0A8A959B74E1E0" style="OLC">
 <subsection id="id872254B6F4844B709A2357EA0EDF957E"><enum>(d)</enum><header>Criminal background check</header><text>The criminal background check of child care employees under this section that is required pursuant to section 231 of the Crime Control Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/13041">42 U.S.C. 13041</external-xref>) shall be conducted pursuant to regulations prescribed by the Secretary of Defense in accordance with the provisions of section 658H of the Child Care and Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9858f">42 U.S.C. 9858f</external-xref>).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="id8B285066D37F4C28B3323B35FD3C4FDC"><enum>(b)</enum><header>Providers of child care services and youth program services</header><text>Section 1798 of such title is amended—</text> <paragraph id="idFD3749693489446B9AB03A6CEBADC9AA"><enum>(1)</enum><text>by redesignating subsection (c) as subsection (d); and</text>
 </paragraph><paragraph id="id8358AA6DDAB3410C8B5BC89B12DD8EE3"><enum>(2)</enum><text>by inserting after subsection (b) the following new subsection (c):</text> <quoted-block display-inline="no-display-inline" id="idD5086E2E4F9C4B8C9992AF51D89DDCBE" style="OLC"> <subsection id="id447157A5F6F640A58E1E2618161A67B4"><enum>(c)</enum><header>Criminal background check</header><text>A provider of child care services or youth program services may not provide such services under this section unless such provider complies with the requirements for criminal background checks under section 658H of the Child Care and Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9858f">42 U.S.C. 9858f</external-xref>) for the State in which such services are provided.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
