 <section changed="deleted" committee-id="SSJU00" id="S1" reported-display-style="strikethrough" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Bureau of Investigation Whistleblower Protection Enhancement Act of 2015</short-title></quote>.</text>

 <subsection id="id2FEF37E0EA914BDDA2FFAF20097D7489"><enum>(a)</enum><header>In general</header><text>Section 2303 of title 5, United States Code, is amended to read as follows:</text> <quoted-block changed="deleted" committee-id="SSJU00" display-inline="no-display-inline" id="idDE651F947037414691D7E97B8FC5D190" reported-display-style="strikethrough" style="USC"> <section id="idE6FD4AF875234060BCF4B69227F18F81"><enum>2303.</enum><header>Prohibited personnel practices in the Federal Bureau of Investigation</header> <subsection id="idBF2B6449E3E0423EAB46523D2DD79FF1"><enum>(a)</enum><header>Definitions</header><text>In this section—</text>
 <paragraph id="idb51d1b2778454e78a9ab830f3d7dd13d"><enum>(1)</enum><text>the term <term>administrative law judge</term> means an administrative law judge appointed by the Attorney General under section 3105 or used by the Attorney General under section 3344;</text>
 </paragraph><paragraph id="idBA9A20265A1D4B3FB858CE36A33BAB62"><enum>(2)</enum><text>the term <term>Inspector General</term> means the Inspector General of the Department of Justice;</text> </paragraph><paragraph id="id17B0AF58058D4A9BBC5C287BD2476402"><enum>(3)</enum><text>the term <term>personnel action</term> means any action described in section 2302(a)(2)(A) with respect to an employee in, or applicant for, a position in the Federal Bureau of Investigation (other than a position of a confidential, policy-determining, policymaking, or policy-advocating character);</text>
 </paragraph><paragraph id="id0F018CD1231341559289E49F4CE211A2"><enum>(4)</enum><text>the term <term>prohibited personnel practice</term> means a prohibited personnel practice described in subsection (b); and</text> </paragraph><paragraph id="id9f438f0fa7af482b87778b70a676c421"><enum>(5)</enum><text>the term <term>protected disclosure</term> means any disclosure of information by an employee in, or applicant for, a position in the Federal Bureau of Investigation—</text>
 <subparagraph id="id620CDA682714476496DC9AA4BE4835BC"><enum>(A)</enum><text>made—</text> <clause id="id2F4D092C619F4553BBF08BFE709C16BC"><enum>(i)</enum><text>for an employee, to a supervisor in the direct chain of command of the employee, up to and including the head of the employing agency;</text>
 </clause><clause id="idB7DE2BE91B0B4219A89BC170AA523DD7"><enum>(ii)</enum><text>to the Inspector General;</text> </clause><clause id="id5ED9898295A140689AB430A1CDE09A45"><enum>(iii)</enum><text>to the Office of Professional Responsibility of the Department of Justice;</text>
 </clause><clause id="idF2041079950C4D5CB8A7918A32536C0C"><enum>(iv)</enum><text>to the Office of Professional Responsibility of the Federal Bureau of Investigation;</text> </clause><clause id="id4F5EF1D81BA94C4F98A438842AAA3EFD"><enum>(v)</enum><text>to the Inspection Division of the Federal Bureau of Investigation;</text>
 </clause><clause id="id8185FA7E65A74CA493E8597A0E8C2BCB"><enum>(vi)</enum><text>to a Member of Congress;</text> </clause><clause id="id6CABAA9599CA41278AFE9FE6311B684D"><enum>(vii)</enum><text>to the Office of Special Counsel; or</text>
 </clause><clause id="id97CF46538B0246D59F171CC37627EE27"><enum>(viii)</enum><text>to an employee designated by any officer, employee, office, or division described in clauses (i) through (vii) for the purpose of receiving such disclosures; and</text>
 </clause></subparagraph><subparagraph id="idFDF626BD911F463F95E3E0867641CA45"><enum>(B)</enum><text>which the employee or applicant reasonably believes evidences—</text> <clause id="id04ecd28db96b4ca2ac931df51ce6b5bf"><enum>(i)</enum><text>any violation of any law, rule, or regulation; or</text>
 </clause><clause id="idb2d330d2c8f14e85b110d709da975b49"><enum>(ii)</enum><text>gross mismanagement, a gross waste of funds, an abuse of authority, or a substantial and specific danger to public health or safety.</text>
 </clause></subparagraph></paragraph></subsection><subsection id="id5e0e59d0fa554d269b3539fe60d66be9"><enum>(b)</enum><header>Prohibited practices</header><text>Any employee of the Federal Bureau of Investigation or another component of the Department of Justice who has authority to take, direct others to take, recommend, or approve any personnel action, shall not, with respect to such authority—</text>
 <paragraph id="id0028a9c2c702448fa1a8a57eef4e440a"><enum>(1)</enum><text>take or fail to take, or threaten to take or fail to take, a personnel action with respect to an employee in, or applicant for, a position in the Federal Bureau of Investigation because of a protected disclosure;</text>
 </paragraph><paragraph id="id27c2b0af103c4c5b815dac1232846552"><enum>(2)</enum><text>take or fail to take, or threaten to take or fail to take, any personnel action against an employee in, or applicant for, a position in the Federal Bureau of Investigation because of—</text>
 <subparagraph id="id0c2f80fca8724b73a315fd25e48432b8"><enum>(A)</enum><text>the exercise of any appeal, complaint, or grievance right granted by any law, rule, or regulation—</text> <clause id="id8f821f75fcc04b49a582cdbcface602a"><enum>(i)</enum><text>with regard to remedying a violation of paragraph (1); or</text>
 </clause><clause id="id44290b53e5064c40999a1e9819a7e86d"><enum>(ii)</enum><text>other than with regard to remedying a violation of paragraph (1);</text> </clause></subparagraph><subparagraph id="id3122f8f3ff954a8785128e339771d443"><enum>(B)</enum><text>testifying for or otherwise lawfully assisting any individual in the exercise of any right referred to in clause (i) or (ii) of subparagraph (A);</text>
 </subparagraph><subparagraph id="id7b503cdde3404571a2ebc7dff2b4c63b"><enum>(C)</enum><text>cooperating with or disclosing information to the Inspector General of an agency, or the Special Counsel, in accordance with applicable provisions of law; or</text>
 </subparagraph><subparagraph id="id4741a47c71a241f9b05cb9875f1d1bb4"><enum>(D)</enum><text>refusing to obey an order that would require the individual to violate a law; or</text> </subparagraph></paragraph><paragraph id="id10f9cdebdf2148ffa232c4e15a366b59"><enum>(3)</enum><text>implement or enforce any nondisclosure policy, form, or agreement, if such policy, form, or agreement does not contain the statement described in section 2302(b)(13).</text>
							</paragraph></subsection><subsection id="id465e66dfe69c46d0a0acf2f8bfd5ffd0"><enum>(c)</enum><header>Procedures</header>
 <paragraph id="id1bd9b05ed7b04d7bb0702460df5b48b4"><enum>(1)</enum><header>Filing of a complaint</header><text>An employee in, or applicant for, a position in the Federal Bureau of Investigation may seek review of a personnel action alleged to be in violation of subsection (b) by filing a complaint with the Office of the Inspector General.</text>
							</paragraph><paragraph id="ideb440ca524c040748cb52d4e81bbc77a"><enum>(2)</enum><header>Investigation</header>
 <subparagraph id="id084C1E4A4DB14848B12CCE5C77D7FC8E"><enum>(A)</enum><header>In general</header><text>The Inspector General shall investigate any complaint alleging a personnel action in violation of subsection (b), consistent with the procedures and requirements described in section 1214.</text>
 </subparagraph><subparagraph id="id12ec4ce5034549b7873abeb6faafceeb"><enum>(B)</enum><header>Determination</header><text>The Inspector General—</text> <clause id="idDBDDCB9BDDCA4B99BA752A7864A31D68"><enum>(i)</enum><text>shall issue a decision containing the findings of the Inspector General supporting the determination of the Inspector General; and</text>
 </clause><clause id="id20B8C935A44B4D82AA638271663701F9"><enum>(ii)</enum><text>if the Inspector General determines that reasonable grounds exist to believe that a personnel action occurred, exists, or is to be taken, in violation of subsection (b), the Inspector General shall request from an administrative law judge, and the administrative law judge, without further proceedings, shall issue, a preliminary order staying the personnel action.</text>
									</clause></subparagraph></paragraph><paragraph id="id180b631709084e4e91f2cce7e31ba67e"><enum>(3)</enum><header>Filing of objections</header>
 <subparagraph id="id189597552C59467399679CAE358556E6"><enum>(A)</enum><header>In general</header><text>Not later than 60 days after the Inspector General issues a decision under paragraph (2)(B)(i), either party may file objections to the decision and request a hearing on the record.</text>
 </subparagraph><subparagraph id="id05BD3682A1B2400CA815FA662210FBB6"><enum>(B)</enum><header>No effect on stay</header><text>The filing of objections under subparagraph (A) shall not affect the stay of a personnel action under a preliminary order issued under paragraph (2)(B)(ii).</text>
 </subparagraph><subparagraph id="idA538FB9461E247E5AEAF1D571A6B4209"><enum>(C)</enum><header>No objections filed</header><text>If no party has filed objections as of the date that is 61 days after the date the Inspector General issues a decision—</text>
 <clause id="idE01F4AB782944391B4C5C89D6444478A"><enum>(i)</enum><text>the decision is final and not subject to further review; and</text>
 </clause><clause id="id53E40BCEF90F49278B244D9D53A9BF1D"><enum>(ii)</enum><text>if the Inspector General had determined that reasonable grounds exist to believe that a personnel action occurred, exists, or is to be taken, in violation of subsection (b)—</text>
 <subclause id="id6BD0FEF482C04BD2B97841D245A4E207"><enum>(I)</enum><text>an administrative law judge, without further proceedings, shall issue an order permanently staying the personnel action; and</text>
 </subclause><subclause id="idF39B364C0EFE4010B07F0B454C6B3F58"><enum>(II)</enum><text>upon motion by the employee, and after an opportunity for a hearing, an administrative law judge may issue an order that provides for corrective action as described under section 1221(g).</text>
										</subclause></clause></subparagraph></paragraph><paragraph id="idE74B94E31FE24C39B64E29AC8AEE56DC"><enum>(4)</enum><header>Review by administrative law judge</header>
 <subparagraph id="id20b73b37f7124b268bdc7f6324839561"><enum>(A)</enum><header>In general</header><text>If objections are filed under paragraph (3)(A), an administrative law judge shall review the decision by the Inspector General on the record after opportunity for agency hearing.</text>
 </subparagraph><subparagraph id="idDF11AB5523E24F82A4D3A0CF3DB43543"><enum>(B)</enum><header>Corrective action</header><text>An administrative law judge may issue an order providing for corrective action as described under section 1221(g).</text>
 </subparagraph><subparagraph id="id451309C03BE047B7A30053178D9F306A"><enum>(C)</enum><header>Determination</header><text>An administrative law judge shall issue a written decision explaining the grounds for the determination by the administrative law judge under this paragraph.</text>
 </subparagraph><subparagraph id="idFD6D6515DEBE4816B9BC85C52EDDADCD"><enum>(D)</enum><header>Effect of determination</header><text>The determination by an administrative law judge under this paragraph shall become the decision of the Department of Justice without further proceedings, unless there is an appeal to, or review on motion of, the Attorney General within such time as the Attorney General shall by rule establish.</text>
								</subparagraph></paragraph><paragraph id="idFC4C58EA24B0459B9EA551A93729E860"><enum>(5)</enum><header>Review by Attorney General</header>
								<subparagraph id="id98470F86BF0144FCADAAF57AF52272B3"><enum>(A)</enum><header>Timeframe</header>
 <clause id="id253545278D0F445D94E0A0EABFC269CD"><enum>(i)</enum><header>In general</header><text>Upon an appeal to, or review on motion of, the Attorney General under paragraph (4)(D), the Attorney General, through reference to such categories of cases, or other means, as the Attorney General determines appropriate, shall establish and announce publicly the date by which the Attorney General intends to complete action on the matter, which shall ensure expeditious consideration of the appeal or review, consistent with the interests of fairness and other priorities of the Attorney General.</text>
 </clause><clause id="idA475672C5EE64AB49908EE6D370F1343"><enum>(ii)</enum><header>Failure to meet deadline</header><text>If the Attorney General fails to complete action on an appeal or review by the announced date, and the expected delay will exceed 30 days, the Attorney General shall publicly announce the new date by which the Attorney General intends to complete action on the appeal or review.</text>
 </clause></subparagraph><subparagraph id="id5AB37E7857D94F18ADD5B678759155B4"><enum>(B)</enum><header>Determination</header><text>The Attorney General shall issue a written decision explaining the grounds for the determination by the Attorney General in an appeal or review under paragraph (4)(D).</text>
								</subparagraph></paragraph><paragraph id="id23624AC4032D490EAF0BEF41DAB1928F"><enum>(6)</enum><header>Publication of determinations</header>
 <subparagraph id="idE9E2C983A3084D1286A57C65302CC3C8"><enum>(A)</enum><header>Public availability</header><text>Except as provided in subparagraph (B), the Attorney General shall make written decisions issued by administrative law judges under paragraph (4)(C) and written decisions issued by the Attorney General under paragraph (5)(B) publicly available.</text>
 </subparagraph><subparagraph id="id44E8004CDD554CE2B5E97E52DCD9D28B"><enum>(B)</enum><header>Rule of construction</header><text>Nothing in subparagraph (A) shall be construed to limit the authority of an administrative law judge or the Attorney General to limit the public disclosure of information under law or regulations.</text>
 </subparagraph></paragraph><paragraph id="idAFCD19E4A84442528340FD7845774F5C"><enum>(7)</enum><header>Judicial review</header><text>Any determination by an administrative law judge or the Attorney General under this subsection shall be subject to judicial review under chapter 7. A petition for judicial review of such a determination shall be filed in the United States Court of Appeals for the Federal Circuit or any court of appeals of competent jurisdiction.</text>
 </paragraph></subsection><subsection id="id3a8d2bd0b47c49c1ae195227dca32365"><enum>(d)</enum><header>Regulations</header><text>The Attorney General shall prescribe regulations to carry out subsection (c) that—</text> <paragraph id="id20B3B76779504A5EAB9BF935CA6C1BCE"><enum>(1)</enum><text>ensure that prohibited personnel practices shall not be taken against an employee in, or applicant for, a position in the Federal Bureau of Investigation; and</text>
 </paragraph><paragraph id="id760839A614D54F96BBA26EAC23070AA4"><enum>(2)</enum><text>provide for the administration and enforcement of subsection (c) in a manner consistent with applicable provisions of sections 1214 and 1221 and in accordance with the procedures under subchapter II of chapter 5 and chapter 7.</text>
 </paragraph></subsection><subsection id="id6DD2DDE4DAFA4473B794917CEF1586D6"><enum>(e)</enum><header>Reporting</header><text>Not later than March 1 of each year, the Attorney General shall make publically available a report containing—</text>
 <paragraph id="id4200C8D43CDD41DE8D5E5F8F41C45FB0"><enum>(1)</enum><text>the number and nature of allegations of a prohibited personnel practice received during the previous year;</text>
 </paragraph><paragraph id="id3A257C2DED07482DA5AFFE97577CCB47"><enum>(2)</enum><text>the disposition of each allegation of a prohibited personnel practice resolved during the previous year;</text>
 </paragraph><paragraph id="idD36B8C2FB5B64443BBFC2BA7F8C6A3B7"><enum>(3)</enum><text>the number of unresolved allegations of a prohibited personnel practice pending as of the end of the previous year and, for each such unresolved allegation, how long the allegation had been pending as of the end of the previous year;</text>
 </paragraph><paragraph id="id63C7FD3C0F2E451AA4AEBB67412D2017"><enum>(4)</enum><text>the number of disciplinary investigations and actions taken with respect to each allegation of a prohibited personnel practice during the previous year;</text>
 </paragraph><paragraph id="id67915B8278DB4F85BF2596873008C70E"><enum>(5)</enum><text>the number of instances during the previous year in which the Inspector General found a reasonable basis that a prohibited personnel practice had occurred that were appealed by the Federal Bureau of Investigation; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id904584C2A194424CBEEAE53FF21435E1"><enum>(6)</enum><text>the number of allegations of a prohibited personnel practice resolved through settlement, including the number that were resolved as a result of mediation.</text>
 </paragraph></subsection><subsection id="idab9a50936158460b93022d4da28f45d0"><enum>(f)</enum><header>Rule of construction</header><text>Nothing in this section shall be construed to limit the jurisdiction of any office under any other provision of law to conduct an investigation to determine whether a prohibited personnel practice has been or will be taken.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id2D7C5D4388974520B79294171F8070CF"><enum>(b)</enum><header>GAO report</header>
 <paragraph id="id3494a67e234d489abdf00afd659e4765"><enum>(1)</enum><header>Definition</header><text>In this subsection, the term <term>prohibited personnel practice</term> means a prohibited personnel practice described in section 2303(b) of title 5, United States Code, as added by subsection (a).</text>
 </paragraph><paragraph id="ida08f988a2bce4871850681d91be1545c"><enum>(2)</enum><header>Report</header><text>Not later than 4 years after the date of enactment of this Act, the Comptroller General of the United States shall submit to Congress a report on the effects of the amendment made by subsection (a), which shall include—</text>
 <subparagraph id="id035E748D359345C2B16BA502EF1092B7"><enum>(A)</enum><text>an evaluation of the timeliness of resolution of allegations of a prohibited personnel practice;</text> </subparagraph><subparagraph id="idAC72B236F211435095A75A12AAD14B65"><enum>(B)</enum><text>an analysis of the corrective action provided in instances of a prohibited personnel practice;</text>
 </subparagraph><subparagraph id="idB44E9D09C41D451390888B05E3AC6E23"><enum>(C)</enum><text>the number and type of disciplinary actions taken in instances of a prohibited personnel practice;</text>
 </subparagraph><subparagraph id="idF28881C6CE1C45F1A792B91DED0492FA"><enum>(D)</enum><text>an evaluation of the communication by the Inspector General of the Department of Justice with an individual alleging a prohibited personnel practice regarding the investigation and resolution of the allegation;</text>
 </subparagraph><subparagraph id="idDDF684D8794048C39910385FD84C2E37"><enum>(E)</enum><text>an assessment of the mediation process of the Department of Justice; and</text> </subparagraph><subparagraph id="idF8D6B3A9CBDA4A919D035BA538E06BC2"><enum>(F)</enum><text>a discussion of how the use of administrative law judges and review under chapters 5 and 7 of title 5, United States Code, affected the process of investigating and resolving allegations of a prohibited personnel practice.</text></subparagraph></paragraph></subsection></section></legis-body>

 <paragraph id="idd9ba875f-a8cd-4cff-9d5b-cdcb2853065c"><enum>(1)</enum><text>the term <term>administrative law judge</term> means an administrative law judge appointed by the Attorney General under section 3105 or used by the Attorney General under section 3344;</text>
 </paragraph><paragraph id="id2ad2b831-5c55-40fd-8c9c-e41199cb3a45"><enum>(2)</enum><text>the term <term>Inspector General</term> means the Inspector General of the Department of Justice;</text> </paragraph><paragraph id="id2355575e-b444-4bf5-89ad-24d3019d9a67"><enum>(3)</enum><text>the term <term>personnel action</term> means any action described in section 2302(a)(2)(A) with respect to an employee in, or applicant for, a position in the Federal Bureau of Investigation (other than a position of a confidential, policy-determining, policymaking, or policy-advocating character);</text>
 </paragraph><paragraph id="id4393f8cc-c885-48d7-89c6-a8515661c0e1"><enum>(4)</enum><text>the term <term>prohibited personnel practice</term> means a prohibited personnel practice described in subsection (b); and</text> </paragraph><paragraph id="id06b917a2-d2d0-4a52-8208-d90a670e7c0e"><enum>(5)</enum><text>the term <term>protected disclosure</term> means any disclosure of information by an employee in, or applicant for, a position in the Federal Bureau of Investigation—</text>
 <subparagraph id="ida2a583c9-5dda-4c18-858b-769e435e928b"><enum>(A)</enum><text>made—</text> <clause id="id6056c4f6-cdef-46dd-a7a6-7cfd8e1cd3df"><enum>(i)</enum><text>in the case of an employee, to a supervisor in the direct chain of command of the employee, up to and including the head of the employing agency;</text>
 </clause><clause id="id8d299f09-28c1-47c6-a1a5-34a54f44e6c1"><enum>(ii)</enum><text>to the Inspector General;</text> </clause><clause id="idf1b00ef0-02df-45a0-a1b2-70140c5e045d"><enum>(iii)</enum><text>to the Office of Professional Responsibility of the Department of Justice;</text>
 </clause><clause id="id235eea19-f658-4c02-9b47-138c97200e68"><enum>(iv)</enum><text>to the Office of Professional Responsibility of the Federal Bureau of Investigation;</text> </clause><clause id="id5c3ec3ed-033f-489c-83a7-9861fc64dce6"><enum>(v)</enum><text>to the Inspection Division of the Federal Bureau of Investigation;</text>
 </clause><clause id="id133f14e0-77fb-4aba-ba4d-5f873566d664"><enum>(vi)</enum><text>as described in section 7211;</text> </clause><clause id="ide3923b72-4715-442e-afa5-1316be9e9df9"><enum>(vii)</enum><text>to the Office of Special Counsel; or</text>
 </clause><clause id="id1c39ec33-6c0f-44aa-bb66-df820bf3d751"><enum>(viii)</enum><text>to an employee designated by any officer, employee, office, or division described in clauses (i) through (vii) for the purpose of receiving such disclosures; and</text>
 </clause></subparagraph><subparagraph id="id0ee113a9-cf88-4ed3-9642-ec85ecf053d0"><enum>(B)</enum><text>which the employee or applicant reasonably believes evidences—</text> <clause id="idde8436ae-515e-4334-a2c9-619175db668b"><enum>(i)</enum><text>any violation of any law, rule, or regulation; or</text>
 </clause><clause id="ide6c0b9ad-786c-436a-a292-37a2776a77f9"><enum>(ii)</enum><text>gross mismanagement, a gross waste of funds, an abuse of authority, or a substantial and specific danger to public health or safety.</text>
 </clause></subparagraph></paragraph></subsection><subsection id="id2c18e9e3-a460-4ab0-9a8e-9177f63e0d66"><enum>(b)</enum><header>Prohibited practices</header><text>Any employee of the Federal Bureau of Investigation or another component of the Department of Justice who has authority to take, direct others to take, recommend, or approve any personnel action, shall not, with respect to such authority—</text>
 <paragraph id="idd6f3e817-5289-4e32-a2aa-f65fca68cc1b"><enum>(1)</enum><text>take or fail to take, or threaten to take or fail to take, a personnel action with respect to an employee in, or applicant for, a position in the Federal Bureau of Investigation because of a protected disclosure;</text>
 </paragraph><paragraph id="idd0dea770-33cc-4d12-bd77-7fc57469e5a3"><enum>(2)</enum><text>take or fail to take, or threaten to take or fail to take, any personnel action against an employee in, or applicant for, a position in the Federal Bureau of Investigation because of—</text>
 <subparagraph id="idb47021e7-dc2d-4f8d-a00f-fbcc9d94ba60"><enum>(A)</enum><text>the exercise of any appeal, complaint, or grievance right granted by any law, rule, or regulation—</text> <clause id="id44d93a82-f83f-485a-9048-1fc350290f9a"><enum>(i)</enum><text>with regard to remedying a violation of paragraph (1); or</text>
 </clause><clause id="idd3909b81-eb7d-4d98-9838-239222dfc7fb"><enum>(ii)</enum><text>other than with regard to remedying a violation of paragraph (1);</text> </clause></subparagraph><subparagraph id="id9acf9370-2349-4308-8040-d8bc3ba7e14b"><enum>(B)</enum><text>testifying for or otherwise lawfully assisting any individual in the exercise of any right referred to in clause (i) or (ii) of subparagraph (A);</text>
 </subparagraph><subparagraph id="id79b4905c-2900-4124-9d63-fa71eeb57c72"><enum>(C)</enum><text>cooperating with or disclosing information to the Inspector General of an agency, or the Special Counsel, in accordance with applicable provisions of law; or</text>
 </subparagraph><subparagraph id="id136a93fb-c3f7-4ef0-8952-d09fe91643f6"><enum>(D)</enum><text>refusing to obey an order that would require the individual to violate a law; or</text> </subparagraph></paragraph><paragraph id="idb9521093-0db4-41da-a741-cf49548ca042"><enum>(3)</enum><text>implement or enforce any nondisclosure policy, form, or agreement, if such policy, form, or agreement does not contain the statement described in section 2302(b)(13).</text>
							</paragraph></subsection><subsection id="id292ededf-3157-44d0-b05d-375d8f05ac64"><enum>(c)</enum><header>Procedures</header>
 <paragraph id="id2e785097-141d-405a-b702-5efa04b46f39"><enum>(1)</enum><header>Filing of a complaint</header><text>An employee in, or applicant for, a position in the Federal Bureau of Investigation may seek review of a personnel action alleged to be in violation of subsection (b) by filing a complaint with the Office of the Inspector General.</text>
							</paragraph><paragraph id="idbd78f63e-0138-48cf-9dd7-ba8023db436c"><enum>(2)</enum><header>Investigation</header>
 <subparagraph id="idc6e736d9-1a8c-4a6b-89f0-ea190947169f"><enum>(A)</enum><header>In general</header><text>The Inspector General shall investigate any complaint alleging a personnel action in violation of subsection (b), consistent with the procedures and requirements described in section 1214.</text>
 </subparagraph><subparagraph id="idc8d12647-becc-49c6-9324-8de903befc43"><enum>(B)</enum><header>Determination</header><text>The Inspector General shall issue a decision containing the findings of the Inspector General supporting the determination of the Inspector General.</text>
								</subparagraph><subparagraph id="id5292f6cf-9f6c-4a54-91e7-7b6a40907931"><enum>(C)</enum><header>Preliminary relief</header>
 <clause id="idEF78058004FF496A8B9B42EBC891710D"><enum>(i)</enum><header>In general</header><text>If the Inspector General determines under subparagraph (B) that reasonable grounds exist to believe that a personnel action occurred, exists, or is to be taken, in violation of subsection (b)—</text>
 <subclause id="id53389D9CD9EE465FAE2E7DB841C54D70"><enum>(I)</enum><text>the Inspector General shall request from an administrative law judge a preliminary order providing relief from the personnel action; and</text>
 </subclause><subclause id="id3080FC59C58146B1A219F1720754C734"><enum>(II)</enum><text>except as provided in clause (ii), the administrative law judge, without further proceedings, shall issue such an order.</text>
 </subclause></clause><clause id="id8649AB325B1041BBABA59504A218995E"><enum>(ii)</enum><header>Good cause</header><text>Upon motion by the Government, after notice and an opportunity to be heard, and if the administrative law judge determines that there is a particularized showing of good cause that an order should not be issued returning an employee to the position the employee would have held had the personnel action not been taken, the administrative law judge shall issue an order directing that the employee be returned, as nearly as practicable and reasonable, to such position.</text>
									</clause></subparagraph></paragraph><paragraph id="idc3c4b86d-3cd5-478d-b651-1e89b6759684"><enum>(3)</enum><header>Filing of objections</header>
 <subparagraph id="id56bb0c8e-89bd-4a6c-b5c3-74ef510f0033"><enum>(A)</enum><header>In general</header><text>Not later than 60 days after the Inspector General issues a decision under paragraph (2)(B), either party may file objections to the decision and request a hearing on the record.</text>
 </subparagraph><subparagraph id="idce13477d-8e7d-4f25-990c-666348c467fb"><enum>(B)</enum><header>No effect on preliminary relief</header><text>The filing of objections under subparagraph (A) shall not affect an order issued under clause (i) or (ii) of paragraph (2)(C).</text>
 </subparagraph><subparagraph id="id605ad48c-69c5-4d6c-8e42-fb77e2cbb7e2"><enum>(C)</enum><header>No objections filed</header><text>If no party has filed objections as of the date that is 61 days after the date the Inspector General issues a decision—</text>
 <clause id="id004be931-4e42-4224-8164-16fb74235e20"><enum>(i)</enum><text>the decision is final and not subject to further review; and</text>
 </clause><clause id="id2d4f6f97-4725-46ea-81db-292fee660b8e"><enum>(ii)</enum><text>if the Inspector General had determined that reasonable grounds exist to believe that a personnel action occurred, exists, or is to be taken, in violation of subsection (b)—</text>
 <subclause id="id929face9-3b93-47f4-9e03-ea94ca43280d"><enum>(I)</enum><text>an administrative law judge, without further proceedings, shall issue an order providing permanent relief from the personnel action; and</text>
 </subclause><subclause id="id14ad224c-cbba-4eaf-a654-889ec489179e"><enum>(II)</enum><text>upon motion by the employee or applicant, and after an opportunity for a hearing, an administrative law judge may issue an order that provides for corrective action as described under section 1221(g), which shall be accompanied by a written decision explaining the grounds for the order.</text>
										</subclause></clause></subparagraph></paragraph><paragraph id="id2d33af5c-7b73-4459-bd5d-a12954412079"><enum>(4)</enum><header>Review by administrative law judge</header>
 <subparagraph id="id61742834-a8a5-4510-b3eb-e5539fbf2036"><enum>(A)</enum><header>In general</header><text>If objections are filed under paragraph (3)(A), an administrative law judge shall review the decision by the Inspector General on the record after opportunity for agency hearing.</text>
 </subparagraph><subparagraph id="idd806c05a-8069-46ce-b16c-ffdd08bbb160"><enum>(B)</enum><header>Corrective action</header><text>An administrative law judge may issue an order providing for corrective action as described under section 1221(g).</text>
 </subparagraph><subparagraph id="ideaf56e33-7c92-4080-9447-91e253d67827"><enum>(C)</enum><header>Determination</header><text>An administrative law judge shall issue a written decision explaining the grounds for the determination by the administrative law judge under this paragraph.</text>
 </subparagraph><subparagraph id="id6d860cfb-ad6e-4390-b2c9-3202a0adc842"><enum>(D)</enum><header>Effect of determination</header><text>The determination by an administrative law judge under this paragraph shall become the decision of the Department of Justice without further proceedings, unless there is an appeal to, or review on motion of, the Attorney General within such time as the Attorney General shall by rule establish.</text>
								</subparagraph></paragraph><paragraph id="ided376b16-2206-46c1-bcae-8fffb3f114b6"><enum>(5)</enum><header>Review by Attorney General</header>
								<subparagraph id="iddc9aca6c-8ee0-4c8c-9225-2817c91925f6"><enum>(A)</enum><header>Timeframe</header>
 <clause id="id2d023c64-4468-4a87-b807-4de6132720fa"><enum>(i)</enum><header>In general</header><text>Upon an appeal to, or review on motion of, the Attorney General under paragraph (4)(D), the Attorney General, through reference to such categories of cases, or other means, as the Attorney General determines appropriate, shall establish and announce publicly the date by which the Attorney General intends to complete action on the matter, which shall ensure expeditious consideration of the appeal or review, consistent with the interests of fairness and other priorities of the Attorney General.</text>
 </clause><clause id="idbe9772e0-6c67-4271-813c-5108336d5697"><enum>(ii)</enum><header>Failure to meet deadline</header><text>If the Attorney General fails to complete action on an appeal or review by the announced date, and the expected delay will exceed 30 days, the Attorney General shall publicly announce the new date by which the Attorney General intends to complete action on the appeal or review.</text>
 </clause></subparagraph><subparagraph id="id3be0c68c-2fec-4b9f-9124-57828d3d4648"><enum>(B)</enum><header>Determination</header><text>The Attorney General shall issue a written decision explaining the grounds for the determination by the Attorney General in an appeal or review under paragraph (4)(D).</text>
								</subparagraph></paragraph><paragraph id="idadd26ef7-fa26-458f-bdb3-c1dd16fcda33"><enum>(6)</enum><header>Publication of determinations</header>
 <subparagraph id="id5c1e0a22-4544-4e55-acfe-294bb3f0627c"><enum>(A)</enum><header>Public availability</header><text>Except as provided in subparagraph (B), the Attorney General shall make written decisions issued by administrative law judges under paragraph (3)(C) or (4)(C) and written decisions issued by the Attorney General under paragraph (5)(B) publicly available in a manner that is—</text>
 <clause id="id13f1e2045e7b474d9e62e4ada5a9c5f8"><enum>(i)</enum><text>to the maximum extent practicable, consistent with the manner in which the Merit Systems Protection Board makes decisions of the Board available to the public; and</text>
 </clause><clause id="idd186bdf7032143699e205423b3548d9c"><enum>(ii)</enum><text>in accordance with section 552.</text> </clause></subparagraph><subparagraph id="idcd7eb209-5c86-48e4-bead-4653ece533b8"><enum>(B)</enum><header>Rule of construction</header><text>Nothing in subparagraph (A) shall be construed to limit the authority of an administrative law judge or the Attorney General to limit the public disclosure of information under law or regulations.</text>
 </subparagraph></paragraph><paragraph id="id240cf3de-8c4a-4f15-9547-8e3dd90610d3"><enum>(7)</enum><header>Judicial review</header><text>Any determination by an administrative law judge or the Attorney General under this subsection shall be subject to judicial review under chapter 7. A petition for judicial review of such a determination shall be filed in the United States Court of Appeals for the Federal Circuit or any court of appeals of competent jurisdiction.</text>
 </paragraph></subsection><subsection id="id41121da0-c271-4e4c-96ec-9e25426cada5"><enum>(d)</enum><header>Regulations</header><text>Not later than 18 months after the date of enactment of the <short-title>Federal Bureau of Investigation Whistleblower Protection Enhancement Act of 2016</short-title>, the Attorney General shall prescribe regulations to carry out subsection (c) that—</text> <paragraph id="idacfb0bff-ec6c-40a5-ada8-8adcc5210d5f"><enum>(1)</enum><text>ensure that prohibited personnel practices shall not be taken against an employee in, or applicant for, a position in the Federal Bureau of Investigation;</text>
 </paragraph><paragraph id="idea87d0d7-7960-480e-99f1-c45d42b8dba9"><enum>(2)</enum><text>provide for the administration and enforcement of subsection (c) in a manner consistent with applicable provisions of sections 1214 and 1221 and in accordance with the procedures under subchapter II of chapter 5 and chapter 7;</text>
 </paragraph><paragraph id="idebace074f29c403695ae68938f549b3b"><enum>(3)</enum><text>ensure that employees of the Federal Bureau of Investigation are informed of the rights and remedies available to the employees under this section, including how to make a lawful disclosure of information that is specifically required by law or Executive Order to be kept classified in the interest of national defense or the conduct of foreign affairs; and</text>
 </paragraph><paragraph id="id9c6dbc4722374127904dc1356e71b094"><enum>(4)</enum><text>provide for the protection of classified information and intelligence sources and methods.</text>
 </paragraph></subsection><subsection id="id3832449d-f576-4519-8683-750944a9fab4"><enum>(e)</enum><header>Reporting</header><text>Not later than March 1 of each year, the Attorney General shall make publicly available a report containing—</text>
 <paragraph id="id2474bbe3-1696-4c66-931e-f2f1872ed284"><enum>(1)</enum><text>the number and nature of allegations of a prohibited personnel practice received during the previous year;</text>
 </paragraph><paragraph id="id9cbc24d9-99d6-41e8-a872-58a0692f059e"><enum>(2)</enum><text>the disposition of each allegation of a prohibited personnel practice resolved during the previous year;</text>
 </paragraph><paragraph id="idf9025e0b-5208-4c15-8d30-b1a5a6c4946c"><enum>(3)</enum><text>the number of unresolved allegations of a prohibited personnel practice pending as of the end of the previous year and, for each such unresolved allegation, how long the allegation had been pending as of the end of the previous year;</text>
 </paragraph><paragraph id="id405b17ed-00fc-4e3c-8bc7-eb2795ff5400"><enum>(4)</enum><text>the number of disciplinary investigations and actions taken with respect to each allegation of a prohibited personnel practice during the previous year;</text>
 </paragraph><paragraph id="id4f07a8e3-1ed9-4ee3-b27d-3f8d5b934fdb"><enum>(5)</enum><text>the number of instances during the previous year in which the Inspector General found reasonable grounds existed to believe that a prohibited personnel practice had occurred that were appealed by the Federal Bureau of Investigation; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id19d8c9aa-d9ca-40d7-885e-ee84babeb651"><enum>(6)</enum><text>the number of allegations of a prohibited personnel practice resolved through settlement, including the number that were resolved as a result of mediation.</text>
 </paragraph></subsection><subsection id="idb8bdd9b0-c876-4d37-8dd6-69a26f39a19e"><enum>(f)</enum><header>Rules of construction</header><text>Nothing in this section shall be construed to—</text> <paragraph id="idA7F2C5094CD24EE391A32FCC9E914E29"><enum>(1)</enum><text>limit the jurisdiction of any office under any other provision of law to conduct an investigation to determine whether a prohibited personnel practice has been or will be taken; or</text>
 </paragraph><paragraph id="id796B0BD6704D49CE8BD02E347B602175"><enum>(2)</enum><text>alter or amend any law, regulation, or Executive Order regarding the handling or disclosure of information, including classified information.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id804b1ccb-7d96-45c8-80d6-1f55d3ecc1ab"><enum>(b)</enum><header>GAO report</header>
 <paragraph id="id7f33aebb-f31a-481d-a9c3-072576bb3d77"><enum>(1)</enum><header>Definition</header><text>In this subsection, the term <term>prohibited personnel practice</term> means a prohibited personnel practice described in section 2303(b) of title 5, United States Code, as amended by subsection (a).</text>
 </paragraph><paragraph id="id72c13e5a-1170-4ec5-b608-4ac381f16ba3"><enum>(2)</enum><header>Report</header><text>Not later than 4 years after the date of enactment of this Act, the Comptroller General of the United States shall submit to Congress a report on the protections for whistleblowers at the Federal Bureau of Investigation and the process of investigating and adjudicating complaints of reprisal by whistleblowers under the amendments made by this Act, which shall include—</text>
 <subparagraph id="idc611099e7634493791ebb718b058d885"><enum>(A)</enum><text>the number and nature of complaints—</text> <clause id="id6D26D6E1D253496980B76B1A1972610D"><enum>(i)</enum><text>that were filed;</text>
 </clause><clause id="id10266F87C804452DA3ECE56A9A0D3881"><enum>(ii)</enum><text>that were investigated;</text> </clause><clause id="id01B2693CDA854E36A6F7294C55A9550E"><enum>(iii)</enum><text>that were adjudicated; and</text>
 </clause><clause id="id8FD3C2661BC14025A5117B6161560608"><enum>(iv)</enum><text>that were appealed to a court of appeals of the United States;</text> </clause></subparagraph><subparagraph id="idf589cf8b8f0e47939d5a841d376f50c7"><enum>(B)</enum><text>the number of decisions made publicly available under 2303(c)(6) of title 5, United States Code, as amended by this Act, and the nature of any limitations on public disclosure of the decisions;</text>
 </subparagraph><subparagraph id="id789ff36a053548a5bda31036f5f47d33"><enum>(C)</enum><text>the nature of corrective action provided in instances of a prohibited personnel practice;</text> </subparagraph><subparagraph id="id0ac07d115a8c41cea661201f40677732"><enum>(D)</enum><text>the number and type of disciplinary actions taken in instances of a prohibited personnel practice;</text>
 </subparagraph><subparagraph id="idfb0e9d3f-5701-446b-81b5-edba29d6d99f"><enum>(E)</enum><text>an evaluation of the timeliness of resolution of allegations of a prohibited personnel practice;</text> </subparagraph><subparagraph id="id5516b33d-84bf-491e-9e64-3b59eda10658"><enum>(F)</enum><text>an assessment of the mediation process of the Department of Justice;</text>
 </subparagraph><subparagraph id="iddd781540-7c96-424e-bb9d-553aa23e0d37"><enum>(G)</enum><text>a discussion of how the use of administrative law judges and review under chapters 5 and 7 of title 5, United States Code, affected the process of investigating and resolving allegations of a prohibited personnel practice; and</text>
 </subparagraph><subparagraph id="idBC71D372B4E040E0A1D5AD8EA1A82423"><enum>(H)</enum><text>a discussion of the perspectives of key stakeholders on the effects of the amendments made by this Act on the Federal Bureau of Investigation.</text>
					</subparagraph></paragraph></subsection><subsection id="id22E88E432ADF4C26A34E2231A085CE34"><enum>(c)</enum><header>Effective date; implementation</header>
 <paragraph id="idEF0946221BEE42019F1EF6C64BCFCD93"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), this Act and the amendments made by this Act shall—</text> <subparagraph id="idE1E33DBC5ACA44E1802DD7E15717170A"><enum>(A)</enum><text>take effect on the date of enactment of this Act; and</text>
 </subparagraph><subparagraph id="idAF3D8FCA9461488B9E2B2CAA9C8E5598"><enum>(B)</enum><text>apply to any matter pending on, or commenced on or after, the date of enactment of this Act.</text> </subparagraph></paragraph><paragraph id="id65476D1ADF044120936DC1B6DE9839C4"><enum>(2)</enum><header>Implementation of investigation and review procedures for pending complaints and complaints made during transition period</header> <subparagraph id="id204963895AFA4F73AFDA9093C3DEB3B5"><enum>(A)</enum><header>Definition</header><text>In this paragraph, the term <term>covered complaint</term> means a complaint alleging a personnel action in violation of section 2303 of title 5, United States Code—</text>
 <clause id="idBF6302A7478C4AD7A3E53C6CD006A82A"><enum>(i)</enum><text>made—</text> <subclause id="idB72CF88A38774A5291CC610C10347CA9"><enum>(I)</enum><text>before, on, or after the date of enactment of this Act; and</text>
 </subclause><subclause id="idF8BF5BC865D249B3BDE733A43C75EBE3"><enum>(II)</enum><text>before the effective date of the regulations prescribed by the Attorney General under section 2303(d) of title 5, United States Code, as amended by this Act; and</text>
 </subclause></clause><clause id="idBD82B706D6F142FA8F53EFBA0A4A4BC5"><enum>(ii)</enum><text>for which an investigation or review is pending on or after the date of enactment of this Act.</text> </clause></subparagraph><subparagraph id="idA5CA1E9CF1044DAB88BA201CE81AB2F8"><enum>(B)</enum><header>Application of existing procedures until rules issued</header><text>Subject to subparagraph (C), for any covered complaint—</text>
 <clause id="id8E8620D21A404A6EBC6A122EC614E664"><enum>(i)</enum><text>the procedures under section 2303(c) of title 5, United States Code, as amended by this Act, shall not apply; and</text>
 </clause><clause id="id017053CDEA2447F08358A712F15B1211"><enum>(ii)</enum><text>the covered complaint shall be investigated and reviewed in accordance with the regulations and procedures prescribed under section 2303 of title 5, United States Code, as in effect on the day before the date of enactment of this Act.</text>
 </clause></subparagraph><subparagraph id="id475453AC4D604486961BE6CF6D61FF14"><enum>(C)</enum><header>Application of new review procedures to pending investigations</header><text>For any covered complaint for which the investigation is pending on the effective date of the regulations prescribed by the Attorney General under section 2303(d) of title 5, United States Code, as amended by this Act—</text>
 <clause id="idC6E334AAE729455097286BA86975A5B7"><enum>(i)</enum><text>the procedures under paragraphs (1), (2), and (3) of section 2303(c) of title 5, United States Code, as amended by this Act, shall not apply; and</text>
 </clause><clause id="id20602BF01EBE4EE58F8148B828A48713"><enum>(ii)</enum><text>if either party files objections and requests a hearing on the record not later than 60 days after the date on which the investigation is completed, the covered complaint shall be subject to review in accordance with paragraphs (4), (5), (6), and (7) of section 2303(c) of title 5, United States Code, as amended by this Act.</text></clause></subparagraph></paragraph></subsection></section></legis-body><endorsement><action-date>April 14, 2016</action-date><action-desc>Reported with an amendment</action-desc></endorsement></bill>
