 <section changed="deleted" committee-id="SSCM00" id="S1" reported-display-style="strikethrough" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Small Business Broadband Deployment Act of 2015</short-title></quote>.</text>
		</section><section changed="deleted" committee-id="SSCM00" id="id4DD74D1C61194A378E5579FC938EE243" reported-display-style="strikethrough"><enum>2.</enum><header>Exception to enhancement to transparency requirements for small businesses</header>
 <subsection id="id3EB95DAB324047E5B76C608103DF6E5B"><enum>(a)</enum><header>Definitions</header><text>In this Act—</text> <paragraph id="id36D3DFB2FC89453282610D43D178B783"><enum>(1)</enum><text>the term <term>broadband Internet access service</term>—</text>
 <subparagraph id="id21BD2739EDFB4EEC96E40804C31CF230"><enum>(A)</enum><text>means a mass-market retail service by wire or radio that provides the capability to transmit data to and receive data from all or substantially all Internet endpoints, including any capability that is incidental to and enables the operation of the communications service; and</text>
 </subparagraph><subparagraph id="id5BB543734E414CB8A18E5BB5AE99864A"><enum>(B)</enum><text>does not include dial-up Internet access service; and</text> </subparagraph></paragraph><paragraph id="id7ECDC03F69064E38AD875A469AD2F30E"><enum>(2)</enum><text>the term <term>small business</term> means any provider of broadband Internet access service that has not more than—</text>
 <subparagraph id="idDC7FDEE0E8C243B1A00150D179803E05"><enum>(A)</enum><text>1,500 employees; or</text> </subparagraph><subparagraph id="idF6188DAAA28545CEA7D756AA102A82E7"><enum>(B)</enum><text>500,000 subscribers.</text>
 </subparagraph></paragraph></subsection><subsection id="id6B76CDAB27974A51AC8AD56B8215B385"><enum>(b)</enum><header>Exception for small businesses</header><text>The enhancements to the transparency rule of the Federal Communications Commission under section 8.3 of title 47, Code of Federal Regulations, as described in paragraphs 162 through 184 of the Report and Order on Remand, Declaratory Ruling, and Order of the Federal Communications Commission with regard to protecting and promoting the open Internet (adopted February 26, 2015) (FCC 15–24), shall not apply to any small business.</text></subsection></section></legis-body>
	<legis-body display-enacting-clause="no-display-enacting-clause" style="OLC">
 <section changed="added" commented="no" committee-id="SSCM00" display-inline="no-display-inline" id="HA588693EBFD34AE0B3011E098A2E244D" reported-display-style="italic" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Small Business Broadband Deployment Act of 2016</short-title></quote>.</text> </section><section changed="added" committee-id="SSCM00" id="id7385bac8-782e-47a6-9168-539e894ee275" reported-display-style="italic"><enum>2.</enum><header>Small business exemption</header> <subsection id="id6abe370b-af7a-47c2-b4d5-46183f01c759"><enum>(a)</enum><header>Definitions</header><text>In this section—</text>
 <paragraph id="id20DB48DCCB3A4890A60ACEAF0827755B"><enum>(1)</enum><text>the term <term>appropriate congressional committees</term> means—</text> <subparagraph id="id8450F4C3E7364E279C7F2B2EA2B3DECB"><enum>(A)</enum><text>the Committee on Commerce, Science, and Transportation of the Senate; and</text>
 </subparagraph><subparagraph id="id848F276059C04AA0AD3BBF0831E61B36"><enum>(B)</enum><text>the Committee on Energy and Commerce of the House of Representatives;</text> </subparagraph></paragraph><paragraph id="idb721ff05-33d8-4121-85ed-02bd39f2f7fb"><enum>(2)</enum><text>the term <term>broadband Internet access service</term> has the meaning given the term in section 8.2 of title 47, Code of Federal Regulations;</text>
 </paragraph><paragraph id="id297FFA07E0904C59AA9A0DF477AEC416"><enum>(3)</enum><text>the term <term>Commission</term> means the Federal Communications Commission; and</text> </paragraph><paragraph id="id8af637fb-e081-49f5-9216-81c4b87961a1"><enum>(4)</enum><text>the term <term>small business</term> means any provider of broadband Internet access service that has not more than 250,000 subscribers.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id011c13ac-e0c4-4cd8-bfb3-02f096be428c"><enum>(b)</enum><header>Exception for small businesses</header><text>The enhancements to the transparency rule of the Commission under section 8.3 of title 47, Code of Federal Regulations, as described in paragraphs 162 through 184 of the Report and Order on Remand, Declaratory Ruling, and Order of the Commission with regard to protecting and promoting the open Internet (adopted by the Commission on February 26, 2015) (FCC 15–24), shall not apply to any small business.</text>
 </subsection><subsection id="HC50296E656A54C1FBF12E1E5B3A39EF2"><enum><added-phrase committee-id="SSCM00" reported-display-style="italic">(c)</added-phrase></enum><header>Report by FCC</header><text>Not later than 180 days after the date of enactment of this Act, the Commission shall submit to the appropriate congressional committees a report that contains the recommendations of the Commission, and data supporting those recommendations, regarding—</text>
 <paragraph id="HB89FA5F8B86F4BF8B791E6CA365ED97E"><enum>(1)</enum><text>whether the exception provided by subsection (b) should be made permanent; and</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCAE5DC8B67B14BEABFF66175B3B2B5BA"><enum>(2)</enum><text>whether the definition of the term <quote>small business</quote> for the purposes of that exception should be modified from the definition in subsection (a)(4).</text>
 </paragraph></subsection><subsection id="idB29A7AC546A24DC98A78FA71EC45696B"><enum>(d)</enum><header>Rulemaking</header><text>Not later than 180 days after the date on which Commission submits the report under subsection (c), the Commission shall commence a rulemaking proceeding to implement the recommendations in that report.</text>
 </subsection><subsection id="idF012479E0210498FBE85AC18B55FEA78"><enum>(e)</enum><header>Sunset</header><text>Subsection (b) shall have no force or effect after the later of the date—</text> <paragraph id="id4DEBDC1F9942446687A46D1B3D4A8944"><enum>(1)</enum><text>that is 3 years after the date of enactment of this Act; or</text>
 </paragraph><paragraph id="idA9D3758FCF944590A5F7C24C61795749"><enum>(2)</enum><text>on which the Commission adopts rules in the proceeding required under subsection (d).</text></paragraph></subsection></section></legis-body><endorsement><action-date>December 6, 2016</action-date><action-desc>Reported with an amendment</action-desc></endorsement></bill>
