			 mitigate fraud risks, and to improve Federal agencies' development and use
			 of data analytics for the purpose of identifying, preventing, and
			 responding to fraud, including improper payments.</official-title></form>
	<legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC">
 <section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fraud Reduction and Data Analytics Act of 2015</short-title></quote>.</text>
 </section><section commented="no" display-inline="no-display-inline" id="idF40FEF9DC43D4A1693123B8E1F184DD9" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act—</text> <paragraph commented="no" display-inline="no-display-inline" id="id199AEA963C2A41FBB6544A55F970833B"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>agency</term> has the meaning given the term in section 551 of title 5, United States Code; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id58505CA246E64A7680FBA8ADD198F0EF"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>improper payment</term> has the meaning given the term in section 2(g) of the Improper Payments Information Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/31/3321">31 U.S.C. 3321</external-xref> note).</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="idC6D24B2ABAEE4A3F85D347154C1093DC" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Establishment of financial and administrative controls relating to fraud and improper payments</header>
			<subsection commented="no" display-inline="no-display-inline" id="id4371EE872DC6456A907E7AFF29630424"><enum>(a)</enum><header display-inline="yes-display-inline">Guidelines</header>
 <paragraph commented="no" display-inline="no-display-inline" id="idAED2F8FB084E43BE8F4E8D2CFAFD9025"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of this Act, the Director of the Office of Management and Budget, in consultation with the Comptroller General of the United States, shall establish guidelines for agencies to establish financial and administrative controls to identify and assess fraud risks and design and implement control activities in order to prevent, detect, and respond to fraud, including improper payments.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id84E727A9FCBF4ECD8C43380AF9F81D6A"><enum>(2)</enum><header display-inline="yes-display-inline">Contents</header><text display-inline="yes-display-inline">The guidelines described in paragraph (1) shall incorporate the leading practices identified in the report published by the Government Accountability Office on July 28, 2015, entitled <quote>Framework for Managing Fraud Risks in Federal Programs</quote>.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF1BE927DEC8946E3B8EEE11DAFBBDA3D"><enum>(3)</enum><header display-inline="yes-display-inline">Modification</header><text display-inline="yes-display-inline">The Director of the Office of Management and Budget, in consultation with the Comptroller General of the United States, may periodically modify the guidelines described in paragraph (1) as the Director and Comptroller General may determine necessary.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id30394164547C4832911FB0CC0FD3E1A2"><enum>(b)</enum><header display-inline="yes-display-inline">Requirements for controls</header><text display-inline="yes-display-inline">The financial and administrative controls required to be established by agencies under subsection (a) shall include—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="id666b4bd75afc4fe888e3ead75a04aed4"><enum>(1)</enum><text display-inline="yes-display-inline">conducting an evaluation of fraud risks and using a risk-based approach to design and implement financial and administrative control activities to mitigate identified fraud risks;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd78a9a047efc4a87a9a261f0dbc8e2a7"><enum>(2)</enum><text display-inline="yes-display-inline">collecting and analyzing data from reporting mechanisms on detected fraud to monitor fraud trends and using that data and information to continuously improve fraud prevention controls; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf92f6b2772684c96a4ee6a9ce2c781e0"><enum>(3)</enum><text display-inline="yes-display-inline">using the results of monitoring, evaluation, audits, and investigations to improve fraud prevention, detection, and response.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id08AA0C21FD3C4E73958F96BBB1AAF4DC"><enum>(c)</enum><header display-inline="yes-display-inline">Reports</header>
 <paragraph commented="no" display-inline="no-display-inline" id="idEBDA588B4ACB438EA966744015FE791A"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), for each of the first 3 fiscal years beginning after the date of enactment of this Act, each agency shall submit to Congress, as part of the annual financial report of the agency, a report on the progress of the agency in—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id625DBFACB3C6433EB13B900E42B980C0"><enum>(A)</enum><text display-inline="yes-display-inline">implementing—</text> <clause commented="no" display-inline="no-display-inline" id="id88AB65C3E9624F609BC6C5AA941B6FD0"><enum>(i)</enum><text display-inline="yes-display-inline">the financial and administrative controls required to be established under subsection (a);</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id792D1BEEDB8741E085865D1A28458D5B"><enum>(ii)</enum><text display-inline="yes-display-inline">the fraud risk principle in the Standards for Internal Control in the Federal Government; and</text> </clause><clause commented="no" display-inline="no-display-inline" id="id6948FEBC72CE499DB5DDECCEC6C2B7ED"><enum>(iii)</enum><text display-inline="yes-display-inline">Office of Management and Budget Circular A–123 with respect to the leading practices for managing fraud risk;</text>
 </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idADE45733EFC549AC93F23EE1118BA443"><enum>(B)</enum><text display-inline="yes-display-inline">identifying risks and vulnerabilities to fraud, including with respect to payroll, beneficiary payments, grants, large contracts, and purchase and travel cards; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD36CC34DD54C46C196660B47AB929D85"><enum>(C)</enum><text display-inline="yes-display-inline">establishing strategies, procedures, and other steps to curb fraud.</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB401C3E58FC84F628E830960A81DF977"><enum>(2)</enum><header display-inline="yes-display-inline">First report</header><text display-inline="yes-display-inline">If the date of enactment of this Act is less than 180 days before the date on which an agency is required to submit the annual financial report of the agency, the agency may submit the report required under paragraph (1) as part of the following annual financial report of the agency.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id48C959CB47EF42679CF3F721812127A2" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Working group</header>
 <subsection commented="no" display-inline="no-display-inline" id="id457ADA172AAB4EB4BD6FD2D89676598A"><enum>(a)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Office of Management and Budget shall establish a working group to improve—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="id3BD06EAEB6D34E3BBECFB931955508A5"><enum>(1)</enum><text display-inline="yes-display-inline">the sharing of financial and administrative controls established under section 3(a) and other best practices and techniques for detecting, preventing, and responding to fraud, including improper payments; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idBAF1221767654F52B29EB577A6E3DAD2"><enum>(2)</enum><text display-inline="yes-display-inline">the sharing and development of data analytics techniques.</text> </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idE6B8A46DC47441CB8489FAC6CF6A894D"><enum>(b)</enum><header display-inline="yes-display-inline">Composition</header><text display-inline="yes-display-inline">The working group established under subsection (a) shall be composed of—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="id6BFF8A80AD0E47E496526A9239D4C60D"><enum>(1)</enum><text display-inline="yes-display-inline">the Controller of the Office of Management and Budget, who shall serve as Chairperson;</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0053FCEF1C614DD688CC6BD01D046BBE"><enum>(2)</enum><text display-inline="yes-display-inline">the Chief Financial Officer of each agency; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id55A580062B454E33858F5F7EC701F236"><enum>(3)</enum><text>any other party determined to be appropriate by the Director of the Office of Management and Budget, which may include the Chief Information Officer, the Chief Procurement Officer, or the Chief Operating Officer of each agency.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id3744BBBB11564A4A8F6DAA7EAD79BC08"><enum>(c)</enum><header display-inline="yes-display-inline">Consultation</header><text display-inline="yes-display-inline">The working group established under subsection (a) shall consult with Offices of Inspectors General and Federal and non-Federal experts on fraud risk assessments, financial controls, and other relevant matters.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="id3472C25D28D643139C54222E557A226D"><enum>(d)</enum><header display-inline="yes-display-inline">Meetings</header><text display-inline="yes-display-inline">The working group established under subsection (a) shall hold not fewer than 4 meetings per year.</text> </subsection><subsection commented="no" display-inline="no-display-inline" id="idCC613B6269844835BB8D8165A094EBC7"><enum>(e)</enum><header display-inline="yes-display-inline">Plan</header><text display-inline="yes-display-inline">Not later than 270 days after the date of enactment of this Act, the working group established under subsection (a) shall submit to Congress a plan for the establishment and use of a Federal interagency library of data analytics and data sets, which can incorporate or improve upon existing Federal resources and capacities, for use by agencies and Offices of Inspectors General to facilitate the detection, prevention, and recovery of fraud, including improper payments.</text></subsection></section></legis-body><attestation><attestation-group><attestation-date chamber="Senate" date="20160412">Passed the Senate April 12, 2016.</attestation-date><attestor display="no"></attestor><role>Secretary</role></attestation-group></attestation><endorsement display="yes"></endorsement></bill>
