 <section changed="deleted" committee-id="SSGA00" id="S1" reported-display-style="strikethrough" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Smarter Regulations Through Advance Planning and Review Act of 2015</short-title></quote> or the <quote><short-title>Smarter Regs Act of 2015</short-title></quote>.</text>
		</section><section changed="deleted" committee-id="SSGA00" id="id9C507CDD2DD744AE93559D7A7F1A9CCC" reported-display-style="strikethrough"><enum>2.</enum><header>Incorporating retrospective review into new major rules</header>
 <subsection id="idB96A45790CD046B1994EFEDFF6B77C6F"><enum>(a)</enum><header>In general</header><text>Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/5">chapter 5</external-xref> of title 5, United States Code, is amended—</text> <paragraph id="idC45711A3C131492DA896751F5B25B9B6"><enum>(1)</enum><text display-inline="yes-display-inline">in section 551—</text>
 <subparagraph id="id380AD8EC86324B45B104122BC7E96738"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (13), by striking <quote>; and</quote> and inserting a semicolon;</text> </subparagraph><subparagraph id="id2CEDAFBE5475403A88BAD9EBECABB284"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (14), by striking the period at the end and inserting a semicolon; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idAD655AD9109C41AD99B5672080A8EB34"><enum>(C)</enum><text>by adding at the end the following:</text> <quoted-block changed="deleted" committee-id="SSGA00" display-inline="no-display-inline" id="id5F1FCEFB8B234F2B9510EE7CBDCD6DAA" reported-display-style="strikethrough" style="OLC"> <paragraph id="id9ac39d9dc82e441f992268944ce2ab47"><enum>(15)</enum><text><term>Administrator</term> means the Administrator of the Office of Information and Regulatory Affairs of the Office of Management and Budget; and</text>
 </paragraph><paragraph id="id1739C0B71C094B10A01B6FBC1F7DBDD7"><enum>(16)</enum><text><term>major rule</term> means any rule that the Administrator finds has resulted in or is likely to result in—</text>
 <subparagraph id="id1834ad018c204021b01691ebc8e05c4e"><enum>(A)</enum><text>an annual effect on the economy of $100,000,000 or more;</text> </subparagraph><subparagraph id="id30677dd1108144f6aa4870ce7da48a09"><enum>(B)</enum><text>a major increase in costs or prices for consumers, individual industries, Federal, State, or local government agencies, or geographic regions; or</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id27F3FAB1A8E8404C9693E49BF6CD246B"><enum>(C)</enum><text>significant adverse effects on competition, employment, investment, productivity, innovation, or on the ability of United States-based enterprises to compete with foreign-based enterprises in domestic and export markets.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id89B880CAF5374C4E91D0A0BB14258732"><enum>(2)</enum><text>in section 553, by adding at the end the following:</text> <quoted-block changed="deleted" committee-id="SSGA00" display-inline="no-display-inline" id="id48C04413071E418880EF4C441617F5B2" reported-display-style="strikethrough" style="OLC"> <subsection id="idDE4F109338C447BC87235BDC1BD6DCC0"><enum>(f)</enum><header>Regulation-Specific Frameworks</header> <paragraph id="idD8ED675F25904899BA6C05E18F6BD436"><enum>(1)</enum><header>In general</header><text>Beginning 180 days after the date of enactment of this subsection, when an agency publishes a proposed or final major rule in the Federal Register, the agency shall include a framework for reassessing the major rule under paragraph (2), which shall include—</text>
 <subparagraph id="idF6602E9F790A43E5813C4742ED2221B9"><enum>(A)</enum><text>a clear statement of the regulatory objectives of the major rule, including the societal benefit and cost of the major rule;</text>
 </subparagraph><subparagraph id="id5A60F3BC44334C148CC8912B361143DD"><enum>(B)</enum><text>the methodology by which the agency plans to analyze the major rule, including metrics by which the agency can measure—</text>
 <clause id="idB060786DACC3423D927E0EB577309E29"><enum>(i)</enum><text>the effectiveness and benefits of the major rule in producing the regulatory objectives of the major rule; and</text>
 </clause><clause id="idB61FB6F3459C4CC88178B20FABCA9441"><enum>(ii)</enum><text>the impacts, including any costs, of the major rule on regulated entities;</text> </clause></subparagraph><subparagraph id="idD1DE12503E9C4E5BA2E324E39BA633A7"><enum>(C)</enum><text>a plan for gathering data regarding the metrics described in subparagraph (B) on an ongoing basis, or at periodic times, during the implementation of the major rule, including the method by which the agency will invite the public to participate in the review process and seek input from other agencies, taking into account any burden to the public in supplying relevant data to agencies; and</text>
 </subparagraph><subparagraph id="id45CDDBF3116C457291F37344668B5CDC"><enum>(D)</enum><text>a specific time frame, as appropriate to the major rule and not more than 10 years, under which the agency shall conduct the reassessment of the major rule in accordance with paragraph (2)(A).</text>
								</subparagraph></paragraph><paragraph id="idC9DD67C97551496E995E6FC5B16708FD"><enum>(2)</enum><header>Reassessment</header>
 <subparagraph id="idAD8D8257C234485A8E6999EDAF0D7BC4"><enum>(A)</enum><header>In general</header><text>Each agency shall assess the data collected under paragraph (1)(C), using the methodology set forth in paragraph (1)(B), with respect to a major rule—</text>
 <clause id="id534ECFC50AE2469A9F44A09C96004599"><enum>(i)</enum><text>to analyze how the actual benefits and costs of the major rule may have varied from those anticipated at the time the major rule was issued; and</text>
 </clause><clause id="id3E2454087ADD4A31ADEDDAB7A4B5C02F"><enum>(ii)</enum><text>to determine whether—</text> <subclause id="id5592D15054784F9583CFFAB5E55AC389"><enum>(I)</enum><text>the major rule is accomplishing its regulatory objective;</text>
 </subclause><subclause id="idE8673DFBBD8D4E92A1AA4ED9AB65409F"><enum>(II)</enum><text>the major rule has been rendered unnecessary, taking into consideration—</text> <item id="idF53DE9F8889A4EA190C11E0D6F2BD9FB"><enum>(aa)</enum><text>changes in the subject area affected by the major rule; and</text>
 </item><item id="id89A9E50A086D41F6941252BFB51924A3"><enum>(bb)</enum><text>whether the major rule overlaps, duplicates, or conflicts with other rules or, to the extent feasible, State and local government regulations; and</text>
 </item></subclause><subclause id="id43E2911D6EC34CDBB366586219456495"><enum>(III)</enum><text>other alternatives to the major rule or modification of the major rule could achieve better results while imposing a smaller burden on society or at a lower cost, taking into consideration any cost already incurred.</text>
 </subclause></clause></subparagraph><subparagraph id="id6418016577B14AE2A7169B833EAB0F8C"><enum>(B)</enum><header>Subsequent assessments</header><text>If, after a reassessment of a major rule under subparagraph (A), an agency determines that the major rule will remain in effect with or without modification, the agency shall—</text>
 <clause id="idEFC4958B21034FEA9E0B5D3E31BE2DD5"><enum>(i)</enum><text>determine a specific time, as appropriate to the major rule and not more than 10 years, under which the agency shall conduct another assessment of the major rule in accordance with subparagraph (A); and</text>
 </clause><clause id="id36E3D67788A3429C9C8F6C165AEE42A9"><enum>(ii)</enum><text>if the assessment conducted under clause (i) does not result in a repeal of the major rule, periodically reassess the major rule in accordance with subparagraph (A) to ensure the major rule continues to meet the regulatory objective.</text>
 </clause></subparagraph><subparagraph id="id8F970B1289ED41C48B7AB2D150CAFFB5"><enum>(C)</enum><header>Publication</header><text>Not later than 180 days after the date on which an agency completes a reassessment of a major rule under subparagraph (A), the agency shall publish a notice of availability of the results of the reassessment in the Federal Register, including the specific time for any subsequent assessment of the major rule under subparagraph (B)(i), if applicable.</text>
 </subparagraph></paragraph><paragraph id="idB7643DB768D844B7855BFBC5492C2A6C"><enum>(3)</enum><header>OMB oversight</header><text>The Administrator shall—</text> <subparagraph id="idc1d5963b160f4815acc85d03ab24d7c1"><enum>(A)</enum><text>issue guidance for agencies regarding the development of the framework under paragraph (1) and the conduct of the reassessments under paragraph (2)(A);</text>
 </subparagraph><subparagraph id="id841707a08451437eaf2c201ef7fd775b"><enum>(B)</enum><text>oversee the timely compliance of agencies with this subsection; and</text> </subparagraph><subparagraph id="idfd45359f9cd6437b96ee9e1eb1880781"><enum>(C)</enum><text>ensure that the results of each reassessment conducted under paragraph (2)(A) are—</text>
 <clause id="id4B182D75B85E4DAF9A98050E4FA44E4E"><enum>(i)</enum><text>published promptly on a centralized Federal website; and</text> </clause><clause id="idB66641051B4643F3BAFDDE662607945A"><enum>(ii)</enum><text>noticed in the Federal Register in accordance with paragraph (2)(C).</text>
 </clause></subparagraph></paragraph><paragraph id="id8FBAEF9E558A4229AE46151EBB231DA0"><enum>(4)</enum><header>Rule of construction</header><text>Nothing in this subsection shall be construed to affect—</text> <subparagraph id="id1A73DF5B48734B2DB73B9CDEE7D1E157"><enum>(A)</enum><text>the authority of an agency to reassess or modify a major rule of the agency earlier than the end of the time frame specified for the major rule under paragraph (1)(D); or</text>
 </subparagraph><subparagraph id="id0DBC0B50A5D24A0EB1BC03A5DB4F2141"><enum>(B)</enum><text>any other provision of law that requires an agency to conduct retrospective reviews of rules issued by the agency.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idA4A6C510E9174AE4A31A1ECD7ECD45E8"><enum>(b)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated such sums as may be necessary to carry out the amendments made by subsection (a).</text></subsection></section></legis-body>
	<legis-body display-enacting-clause="no-display-enacting-clause">
 <section changed="added" committee-id="SSGA00" id="id560e6f51-2293-43da-84ad-ee4aec907ab7" reported-display-style="italic" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Smarter Regulations Through Advance Planning and Review Act of 2015</short-title></quote> or the <quote><short-title>Smarter Regs Act of 2015</short-title></quote>.</text>
		</section><section changed="added" committee-id="SSGA00" id="id499de27e-3217-4eb8-a675-27708658e962" reported-display-style="italic"><enum>2.</enum><header>Incorporating retrospective review into new major rules</header>
 <subsection id="id8f7542a7-37a7-4d17-b9ab-908aea4bc1e0"><enum>(a)</enum><header>In general</header><text>Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/5">chapter 5</external-xref> of title 5, United States Code, is amended—</text> <paragraph id="iddb560aab-abf8-4b36-854d-35baab3079f5"><enum>(1)</enum><text display-inline="yes-display-inline">in section 551—</text>
 <subparagraph id="id7169eb14-86a6-4d89-bb24-95ecb4cbbc91"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (13), by striking <quote>; and</quote> and inserting a semicolon;</text> </subparagraph><subparagraph id="idafd1fac7-63fb-4953-bd0e-87ddb27631ef"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (14), by striking the period at the end and inserting a semicolon; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4ce0451f-c685-4802-928c-7bfe3d875937"><enum>(C)</enum><text>by adding at the end the following:</text> <quoted-block changed="added" committee-id="SSGA00" display-inline="no-display-inline" id="id6a840ffe-930b-4b73-8493-da4354c67cb3" reported-display-style="italic" style="OLC"> <paragraph id="idcfc9085f-0665-4b34-81e2-165b7aafbbeb"><enum>(15)</enum><text><term>Administrator</term> means the Administrator of the Office of Information and Regulatory Affairs of the Office of Management and Budget; and</text>
 </paragraph><paragraph id="id51f55d2d-f1aa-4ea4-bf0f-6a1c643f0821"><enum>(16)</enum><text><term>major rule</term> means any rule that the Administrator finds has resulted in or is likely to result in—</text>
 <subparagraph id="id3f9ceaa4-e7f2-4195-898e-448d8de383ea"><enum>(A)</enum><text>an annual effect on the economy of $100,000,000 or more;</text> </subparagraph><subparagraph id="ide9cc91f6-7855-41fd-b23c-6ff935447907"><enum>(B)</enum><text>a major increase in costs or prices for consumers, individual industries, Federal, State, or local government agencies, or geographic regions; or</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4e5806e2-3b85-4a79-b42f-69d1c5ca4912"><enum>(C)</enum><text>significant adverse effects on competition, employment, investment, productivity, innovation, or on the ability of United States-based enterprises to compete with foreign-based enterprises in domestic and export markets.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id17ff5774-805d-42c1-ab1a-80c82c75a5bb"><enum>(2)</enum><text>in section 553, by adding at the end the following:</text> <quoted-block changed="added" committee-id="SSGA00" display-inline="no-display-inline" id="ide57e2e42-d9eb-4e63-ba63-3df34cdc3a66" reported-display-style="italic" style="OLC"> <subsection id="id069413a8-b014-4697-a707-c8167884bf18"><enum>(f)</enum><header>Major rule frameworks</header> <paragraph id="id6e1189ee-f3ec-4426-abf7-9136bc10f4d4"><enum>(1)</enum><header>In general</header><text>Beginning 180 days after the date of enactment of this subsection, when an agency publishes in the Federal Register—</text>
 <subparagraph id="idCE6B3710AB674711BE63CB2D5AC5E6B3"><enum>(A)</enum><text>a proposed major rule, the agency shall include a potential framework for assessing the major rule, which shall include a general statement of how the agency intends to measure the effectiveness of the major rule; or</text>
 </subparagraph><subparagraph id="id0FEE486ED3BF4FBBB4648E11D006B6E0"><enum>(B)</enum><text>a final major rule, the agency shall include a framework for assessing the major rule under paragraph (2), which shall include—</text>
 <clause id="id5a6f8f0c-22d2-4244-ab87-7f069865b1df"><enum>(i)</enum><text>a clear statement of the regulatory objectives of the major rule, including a summary of the societal benefit and cost of the major rule;</text>
 </clause><clause id="idcc032d55-8d69-41ea-87aa-fdd2c04f9de1"><enum>(ii)</enum><text>the methodology by which the agency plans to analyze the major rule, including metrics by which the agency can measure—</text>
 <subclause id="id2ca287e3-0c31-4217-980f-0074a1ed49f3"><enum>(I)</enum><text>the effectiveness and benefits of the major rule in producing the regulatory objectives of the major rule; and</text>
 </subclause><subclause id="idb9aa742b-637f-490e-80dc-4000c664ae17"><enum>(II)</enum><text>the impacts, including any costs, of the major rule on regulated and other impacted entities;</text> </subclause></clause><clause id="id3961c791-23d8-4c97-82ad-14e3ba4de11f"><enum>(iii)</enum><text>a plan for gathering data regarding the metrics described in clause (ii) on an ongoing basis, or at periodic times, including a method by which the agency will invite the public to participate in the review process and seek input from other agencies; and</text>
 </clause><clause id="idb97f380f-4447-41d3-9c63-265f446dc67e"><enum>(iv)</enum><text>a specific time frame, as appropriate to the major rule and not more than 10 years after the effective date of the major rule, under which the agency shall conduct the assessment of the major rule in accordance with paragraph (2)(A).</text>
									</clause></subparagraph></paragraph><paragraph id="iddb2050a5-df87-479c-9017-8e2ad292f228"><enum>(2)</enum><header>Assessment</header>
 <subparagraph id="ide623c47b-effe-4cf6-8088-b40521ab374c"><enum>(A)</enum><header>In general</header><text>Each agency shall assess the data collected under paragraph (1)(B)(iii), using the methodology set forth in paragraph (1)(B)(ii) or any other appropriate methodology developed after the issuance of a final major rule to better determine whether the regulatory objective was achieved, with respect to a major rule—</text>
 <clause id="id3f773cff-4775-4362-a5b4-5b6ac41556dd"><enum>(i)</enum><text>to analyze how the actual benefits and costs of the major rule may have varied from those anticipated at the time the major rule was issued; and</text>
 </clause><clause id="ide0ca7387-7f1f-456a-ba72-54dad5d5547a"><enum>(ii)</enum><text>to determine whether—</text> <subclause id="id48deaeef-e026-4647-b300-d74d7e4362ae"><enum>(I)</enum><text>the major rule is accomplishing its regulatory objective;</text>
 </subclause><subclause id="id3ea7e16a-20ce-4901-8312-47f401fbced2"><enum>(II)</enum><text>the major rule has been rendered unnecessary, taking into consideration—</text> <item id="id23bca33a-ecb6-4f51-8a32-d60cbc7ea3f5"><enum>(aa)</enum><text>changes in the subject area affected by the major rule; and</text>
 </item><item id="id782a54a1-0cd3-4656-a972-734d1c391f7f"><enum>(bb)</enum><text>whether the major rule overlaps, duplicates, or conflicts with other rules or, to the extent feasible, State and local government regulations;</text>
 </item></subclause><subclause id="ide03c695d-23c4-4523-868a-44c49d79a1a6"><enum>(III)</enum><text>the major rule needs to be strengthened in order to accomplish the regulatory objective; and</text> </subclause><subclause id="id92368B9B002C4F1CA303E146EB89BB69"><enum>(IV)</enum><text>other alternatives to the major rule or modification of the major rule could better achieve the regulatory objective while imposing a smaller burden on society or increase net benefits, taking into consideration any cost already incurred.</text>
 </subclause></clause></subparagraph><subparagraph id="idB0DE8E6F47D44D8DB713A47237DD4809"><enum>(B)</enum><header>Different methodology</header><text>If an agency uses a methodology other than the methodology set forth in paragraph (1)(B)(ii) to assess data under subparagraph (A), the agency shall include as part of the notice required under subparagraph (D) an explanation of the changes in circumstances that necessitated the use of that other methodology.</text>
								</subparagraph><subparagraph id="idacba51f1-31cc-4760-9b01-1c6460045e83"><enum>(C)</enum><header>Subsequent assessments</header>
 <clause id="id0B8B765654FE47BFBFAFD03A91C0EC4B"><enum>(i)</enum><header>In general</header><text>Except as provided in clause (ii), if, after an assessment of a major rule under subparagraph (A), an agency determines that the major rule will remain in effect with or without modification, the agency shall—</text>
 <subclause id="ida6c3197d-d222-4c34-bac7-13859c2454e7"><enum>(I)</enum><text>determine a specific time frame, as appropriate to the major rule and not more than 10 years after the effective date of the major rule, under which the agency shall conduct another assessment of the major rule in accordance with subparagraph (A); and</text>
 </subclause><subclause id="id7f645f96-183d-425b-a9b3-bed6228cc4af"><enum>(II)</enum><text>if the assessment conducted under subclause (I) does not result in a repeal of the major rule, periodically assess the major rule in accordance with subparagraph (A) to ensure the major rule continues to meet the regulatory objective.</text>
 </subclause></clause><clause id="id48EB9241BA604858B09DC304DF8B0514"><enum>(ii)</enum><header>Exemption</header><text>The Administrator may exempt an agency from conducting a subsequent assessment of a major rule under clause (i) if the Administrator determines that there is a foreseeable and apparent need for the major rule beyond the time frame required under clause (i)(I).</text>
 </clause></subparagraph><subparagraph id="id95b1fde3-6665-4e44-b7b2-517df35e8818"><enum>(D)</enum><header>Publication</header><text>Not later than 180 days after the date on which an agency completes an assessment of a major rule under subparagraph (A), the agency shall publish a notice of availability of the results of the assessment in the Federal Register, including the specific time frame for any subsequent assessment of the major rule under subparagraph (C)(i), if applicable.</text>
 </subparagraph></paragraph><paragraph id="iddcc8d48b-6ee8-4cb9-b867-d8861a0a3e86"><enum>(3)</enum><header>OMB oversight</header><text>The Administrator shall—</text> <subparagraph id="ida0fc1a92-86a4-4eee-a111-ae515a0451f6"><enum>(A)</enum><text>issue guidance for agencies regarding the development of the framework under paragraph (1) and the conduct of the assessments under paragraph (2)(A);</text>
 </subparagraph><subparagraph id="id30e41570-2f72-47c3-a6dc-f48e7fb51bef"><enum>(B)</enum><text>oversee the timely compliance of agencies with this subsection;</text> </subparagraph><subparagraph id="id688eb6e8-4495-470a-8c5a-468e9e66b801"><enum>(C)</enum><text>ensure that the results of each assessment conducted under paragraph (2)(A) are—</text>
 <clause id="id12fb05c9-0dc2-499c-81fe-f94accb0b223"><enum>(i)</enum><text>published promptly on a centralized Federal website; and</text> </clause><clause id="id1f0d0360-b4fd-4cd0-b0fb-21021df32de6"><enum>(ii)</enum><text>noticed in the Federal Register in accordance with paragraph (2)(D);</text>
 </clause></subparagraph><subparagraph id="idE7E62FD5618143DEAA33E9560CCD5D6C"><enum>(D)</enum><text>encourage and assist agencies to streamline and coordinate the assessment of major rules with similar or related regulatory objectives;</text>
 </subparagraph><subparagraph id="id053BC526AAC64EEAB2E3667A4AD219D7"><enum>(E)</enum><text>exempt an agency from including the framework required under paragraph (1)(B) when publishing a final major rule, if the agency did not issue a notice of proposed rule making for the major rule in order to provide a timely response to an emergency or comply with a statutorily imposed deadline, in accordance with paragraph (5)(B); and</text>
 </subparagraph><subparagraph id="idD391BF0E16114EA6A6A86C803A9095B4"><enum>(F)</enum><text>extend the deadline specified by an agency for an assessment of a major rule under paragraph (1)(B)(iv) or paragraph (2)(C)(i)(I) for a period of not more than 90 days if the agency justifies why the agency is unable to complete the assessment by that deadline.</text>
 </subparagraph></paragraph><paragraph id="id070547a0-82e5-44ab-bc94-e9b0647465e3"><enum>(4)</enum><header>Rule of construction</header><text>Nothing in this subsection shall be construed to affect—</text> <subparagraph id="idcdf43521-a3a1-4d7b-9683-139308c54308"><enum>(A)</enum><text>the authority of an agency to assess or modify a major rule of the agency earlier than the end of the time frame specified for the major rule under paragraph (1)(B)(iv); or</text>
 </subparagraph><subparagraph id="id227e479b-7678-41a7-8bca-d995d7f0b2b7"><enum>(B)</enum><text>any other provision of law that requires an agency to conduct retrospective reviews of rules issued by the agency.</text>
								</subparagraph></paragraph><paragraph id="idF9683D756C9143D5AACB97CDEBA342B6"><enum>(5)</enum><header>Applicability</header>
 <subparagraph id="idE195E9E4A06D4D97838DAC245887CC86"><enum>(A)</enum><header>In general</header><text>This subsection shall not apply to—</text> <clause id="id78CFA800E1914AE884D3CA56EB2DA4C7"><enum>(i)</enum><text>a major rule of an agency—</text>
 <subclause id="id747C6083882B4E7A8F611A8DF29C62C4"><enum>(I)</enum><text>that the Administrator reviewed before the date of enactment of this subsection; or</text> </subclause><subclause id="idBEDB785096214091A2E81E62C6DFED78"><enum>(II)</enum><text>for which the agency is required to conduct a retrospective review under any other provision of law that meets or exceeds the requirements of this subsection, as determined by the Administrator;</text>
 </subclause></clause><clause id="id3D47BE3C19624A9D963CCBF3C1D9F8B2"><enum>(ii)</enum><text>interpretative rules, general statements of policy, or rules of agency organization, procedure, or practice; or</text>
 </clause><clause id="id457C297EE3BC4C0E822F10CE9888C828"><enum>(iii)</enum><text>routine and administrative rules.</text> </clause></subparagraph><subparagraph id="id3CEFF4EBA88C47A2A84154D7BEB2198E"><enum>(B)</enum><header>Direct and interim final major rule</header><text>In the case of a major rule of an agency for which the agency is not required to issue a notice of proposed rule making in response to an emergency or a statutorily imposed deadline, the agency shall publish the framework required under paragraph (1)(B) in the Federal Register not later than 6 months after the date on which the agency publishes the final major rule.</text>
								</subparagraph></paragraph><paragraph id="id5276AD859C374C0FAF28C24599F91F52"><enum>(6)</enum><header>Judicial review</header>
 <subparagraph id="id3D3EB80139084007B9351D2AF58B57AD"><enum>(A)</enum><header>In general</header><text>Judicial review of agency compliance with this subsection is limited to—</text> <clause id="idE8704059B69A4415AEDCB4BA28FDD647"><enum>(i)</enum><text>whether an agency published the framework for assessment of a major rule in accordance with paragraph (1); or</text>
 </clause><clause id="id627F98E4A9EC4C748880D45483BE2151"><enum>(ii)</enum><text>whether an agency completed and published the required assessment of a major rule in accordance with subparagraphs (A) and (D) of paragraph (2).</text>
 </clause></subparagraph><subparagraph id="id874C1AAD572D41CE9FF850EEA27A2435"><enum>(B)</enum><header>Remedy available</header><text>In granting relief in an action brought under subparagraph (A), the court may only issue an order remanding the major rule to the agency to comply with paragraph (1) or subparagraph (A) or (D) of paragraph (2), as applicable.</text>
 </subparagraph><subparagraph id="id725F0F7597214AE9BB8A55A42CE5B10D"><enum>(C)</enum><header>Effective date of major rule</header><text>If, in an action brought under subparagraph (A)(i), a court determines that the agency did not comply, the major rule shall take effect notwithstanding any order issued by the court.</text>
 </subparagraph><subparagraph id="id9240309CA1124DDA8D1E99D9F7BA5165"><enum>(D)</enum><header>Administrator</header><text>Any determination, action, or inaction of the Administrator shall not be subject to judicial review.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id65ee9e0a-f506-4b33-b6b4-db0d05d252e2"><enum>(b)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated such sums as may be necessary to carry out the amendments made by subsection (a).</text></subsection></section></legis-body><endorsement><action-date>June 20, 2016</action-date><action-desc>Reported with an amendment</action-desc></endorsement></bill>
