		  STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To amend title 31, United States Code, to establish entities tasked with improving program
			 and project management in certain Federal agencies, and for other
 purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC"><section commented="no" display-inline="no-display-inline" id="H9D765BB9305342AF85F52B780613F5B4" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Program Management Improvement Accountability Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="H271DE56165E3412B9D3A4132380250DD" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Project Management</header><subsection commented="no" display-inline="no-display-inline" id="H50393562A5AD4A828E7BE01FDE038E58"><enum>(a)</enum><header display-inline="yes-display-inline">Deputy director for management</header><paragraph commented="no" display-inline="no-display-inline" id="H19CA6DE7504F4636B41E28DB3F1301CB"><enum>(1)</enum><header display-inline="yes-display-inline">Additional functions</header><text display-inline="yes-display-inline">Section 503 of title 31, United States Code, is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H11DF1A539A2B4125A24FE1A544E3879C" style="USC"><subsection commented="no" display-inline="no-display-inline" id="H4097D630E359473EA05BC2C2D30EBD4E"><enum>(c)</enum><header display-inline="yes-display-inline">Program and project management</header><paragraph commented="no" display-inline="no-display-inline" id="H3ADD8738D2A442B9ABCE3FFC0092FC40"><enum>(1)</enum><header display-inline="yes-display-inline">Requirement</header><text display-inline="yes-display-inline">Subject to the direction and approval of the Director, the Deputy Director for Management or a designee shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="H572965A4F7CB4C4BB78953129C5D91BA"><enum>(A)</enum><text display-inline="yes-display-inline">adopt governmentwide standards, policies, and guidelines for program and project management for executive agencies;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H50118485BDD44D23B037889008F20C32"><enum>(B)</enum><text display-inline="yes-display-inline">oversee implementation of program and project management for the standards, policies, and guidelines established under subparagraph (A);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HFE9685572D6F4865BC4728621B8D6318"><enum>(C)</enum><text display-inline="yes-display-inline">chair the Program Management Policy Council established under section 1126(b);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HBED117D825294533840C7C994B623DEE"><enum>(D)</enum><text display-inline="yes-display-inline">establish standards and policies for executive agencies, consistent with widely accepted standards for program and project management planning and delivery;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H00A6C3C9BC734CC4856EBA7CB54E3F70"><enum>(E)</enum><text display-inline="yes-display-inline">engage with the private sector to identify best practices in program and project management that would improve Federal program and project management;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE2AEC47F926942088E3BA6B958F3E644"><enum>(F)</enum><text display-inline="yes-display-inline">conduct portfolio reviews to address programs identified as high risk by the Government Accountability Office;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H86539F8D9A0A4DBC81FEB8E7BE657689"><enum>(G)</enum><text display-inline="yes-display-inline">not less than annually, conduct portfolio reviews of agency programs in coordination with Project Management Improvement Officers designated under section 1126(a)(1) to assess the quality and effectiveness of program management; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9BD66175A3634E6E861E166549AD8B82"><enum>(H)</enum><text display-inline="yes-display-inline">establish a 5-year strategic plan for program and project management.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0FC34D0DB00448EEB48467DF11804785"><enum>(2)</enum><header display-inline="yes-display-inline">Application to department of defense</header><text display-inline="yes-display-inline">Paragraph (1) shall not apply to the Department of Defense to the extent that the provisions of that paragraph are substantially similar to or duplicative of—</text><subparagraph commented="no" display-inline="no-display-inline" id="HB3E71E7B3B9749B28411006B1DCBFC69"><enum>(A)</enum><text display-inline="yes-display-inline">the provisions of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/87">chapter 87</external-xref> of title 10; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HCD0A2094B281478D9A29EB5363A95228"><enum>(B)</enum><text display-inline="yes-display-inline">policy, guidance, or instruction of the Department related to program management.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB6E5F2307497430EBA82AD35F8CA42B6"><enum>(2)</enum><header display-inline="yes-display-inline">Deadline for standards, policies, and guidelines</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Deputy Director for Management of the Office of Management and Budget shall issue the standards, policies, and guidelines required under section 503(c) of title 31, United States Code, as added by paragraph (1).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB5A3D372C098479C8C962712074CEEF1"><enum>(3)</enum><header display-inline="yes-display-inline">Regulations</header><text display-inline="yes-display-inline">Not later than 90 days after the date on which the standards, policies, and guidelines are issued under paragraph (2), the Deputy Director for Management of the Office of Management and Budget, in consultation with the Program Management Policy Council established under section 1126(b) of title 31, United States Code, as added by subsection (b)(1), and the Director of the Office of Management and Budget, shall issue any regulations as are necessary to implement the requirements of section 503(c) of title 31, United States Code, as added by paragraph (1).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H1AC8B02E4FEE4394AF4FC72A74927A8A"><enum>(b)</enum><header display-inline="yes-display-inline">Program management improvement officers and program management policy council</header><paragraph commented="no" display-inline="no-display-inline" id="HAF8703DE854449DEB287B629FF46F48C"><enum>(1)</enum><header display-inline="yes-display-inline">Amendment</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/11">Chapter 11</external-xref> of title 31, United States Code, is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H1743724A1E944D8389AFE45A0B416C75" style="USC"><section commented="no" display-inline="no-display-inline" id="H5A123EC19F964CC396736D68BC6A0B09" section-type="subsequent-section"><enum>1126.</enum><header display-inline="yes-display-inline">Program management improvement officers and program management policy council</header><subsection commented="no" display-inline="no-display-inline" id="H5006C5C7D899492FA44B15EF65725837"><enum>(a)</enum><header display-inline="yes-display-inline">Program management improvement officers</header><paragraph commented="no" display-inline="no-display-inline" id="H7B186DA7AEC94B6B898BE4FC99FCEE5C"><enum>(1)</enum><header display-inline="yes-display-inline">Designation</header><text display-inline="yes-display-inline">The head of each agency described in section 901(b) shall designate a senior executive of the agency as the Program Management Improvement Officer of the agency.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3014922E55484DEBA2AC6C5AD9189D7C"><enum>(2)</enum><header display-inline="yes-display-inline">Functions</header><text display-inline="yes-display-inline">The Program Management Improvement Officer of an agency designated under paragraph (1) shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="H3A9A13ADF88E4A03BB93AA31866E07AC"><enum>(A)</enum><text display-inline="yes-display-inline">implement program management policies established by the agency under section 503(c); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H81DC6D90164C4D858B2E92EA079FD208"><enum>(B)</enum><text display-inline="yes-display-inline">develop a strategy for enhancing the role of program managers within the agency that includes the following:</text><clause commented="no" display-inline="no-display-inline" id="HF376B4886D7B4BF4BE909F08D15779B0"><enum>(i)</enum><text display-inline="yes-display-inline">Enhanced training and educational opportunities for program managers that shall include—</text><subclause commented="no" display-inline="no-display-inline" id="H2FC38ABA169044D68D2F87AD796B1E18"><enum>(I)</enum><text display-inline="yes-display-inline">training in the relevant competencies encompassed with program and project manager within the private sector for program managers; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H5E85C427B4B247B6AB94992792832D45"><enum>(II)</enum><text display-inline="yes-display-inline">training that emphasizes cost containment for large projects and programs.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="H3E2798C0E35F42DBB1850D0B8FA93401"><enum>(ii)</enum><text display-inline="yes-display-inline">Mentoring of current and future program managers by experienced senior executives and program managers within the agency.</text></clause><clause commented="no" display-inline="no-display-inline" id="H0DDEBB4DF70B400E897903AAE6FD7A5B"><enum>(iii)</enum><text display-inline="yes-display-inline">Improved career paths and career opportunities for program managers.</text></clause><clause commented="no" display-inline="no-display-inline" id="HABE4672A3E7D412C9A636FAFE56A9873"><enum>(iv)</enum><text display-inline="yes-display-inline">A plan to encourage the recruitment and retention of highly qualified individuals to serve as program managers.</text></clause><clause commented="no" display-inline="no-display-inline" id="H78AFC5DA0683424F986CF13C620F6930"><enum>(v)</enum><text display-inline="yes-display-inline">Improved means of collecting and disseminating best practices and lessons learned to enhance program management across the agency.</text></clause><clause commented="no" display-inline="no-display-inline" id="HAC995BB35C774AAAAE1C3BCFD8184276"><enum>(vi)</enum><text display-inline="yes-display-inline">Common templates and tools to support improved data gathering and analysis for program management and oversight purposes.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFE3251DA79FA451EBACFADF3CD01C29E"><enum>(3)</enum><header display-inline="yes-display-inline">Application to department of defense</header><text display-inline="yes-display-inline">This subsection shall not apply to the Department of Defense to the extent that the provisions of this subsection are substantially similar to or duplicative of the provisions of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/87">chapter 87</external-xref> of title 10. For purposes of paragraph (1), the Under Secretary of Defense for Acquisition, Technology, and Logistics (or a designee of the Under Secretary) shall be considered the Program Management Improvement Officer.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HC4EDC3A530C842218D868291E32245CE"><enum>(b)</enum><header display-inline="yes-display-inline">Program management policy council</header><paragraph commented="no" display-inline="no-display-inline" id="HCBD8D59C8535446A9D911138BD03DE1D"><enum>(1)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">There is established in the Office of Management and Budget a council to be known as the <quote>Program Management Policy Council</quote> (in this subsection referred to as the <quote>Council</quote>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC1F3760FE6F04D99AA8CBA1AD4983989"><enum>(2)</enum><header display-inline="yes-display-inline">Purpose and functions</header><text display-inline="yes-display-inline">The Council shall act as the principal interagency forum for improving agency practices related to program and project management. The Council shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="HA05F0E6C3504419D9F9985D206BEFFD0"><enum>(A)</enum><text display-inline="yes-display-inline">advise and assist the Deputy Director for Management of the Office of Management and Budget;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB9E7076C4D3C466AB44F93A7D7D6B084"><enum>(B)</enum><text display-inline="yes-display-inline">review programs identified as high risk by the General Accountability Office and make recommendations for actions to be taken by the Deputy Director for Management of the Office of Management and Budget or a designee;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HDAF87E75D4464CC8A6D43000C928DA45"><enum>(C)</enum><text display-inline="yes-display-inline">discuss topics of importance to the workforce, including—</text><clause commented="no" display-inline="no-display-inline" id="H6111328952B44D64A36A81B9433A9D72"><enum>(i)</enum><text display-inline="yes-display-inline">career development and workforce development needs;</text></clause><clause commented="no" display-inline="no-display-inline" id="HACD04427D6114958A1572FD858C4B88C"><enum>(ii)</enum><text display-inline="yes-display-inline">policy to support continuous improvement in program and project management; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H9D48352CC89D4055A7EF4D611B52463E"><enum>(iii)</enum><text display-inline="yes-display-inline">major challenges across agencies in managing programs;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF604D9022AD44669BFBE396C74E5906F"><enum>(D)</enum><text display-inline="yes-display-inline">advise on the development and applicability of standards governmentwide for program management transparency; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC66426C7DF624001986F507B20941810"><enum>(E)</enum><text display-inline="yes-display-inline">review the information published on the website of the Office of Management and Budget pursuant to section 1122.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H32EE767F23E04E4D895A6E070C44AC6B"><enum>(3)</enum><header display-inline="yes-display-inline">Membership</header><subparagraph commented="no" display-inline="no-display-inline" id="H293E65657B3B4B38A082749356F7DAC3"><enum>(A)</enum><header display-inline="yes-display-inline">Composition</header><text display-inline="yes-display-inline">The Council shall be composed of the following members:</text><clause commented="no" display-inline="no-display-inline" id="H0CEB6206344C4EDA82C792A6BD468378"><enum>(i)</enum><text display-inline="yes-display-inline">Five members from the Office of Management and Budget as follows:</text><subclause commented="no" display-inline="no-display-inline" id="HC9FD2920B7194743931D84B5F8BE434A"><enum>(I)</enum><text display-inline="yes-display-inline">The Deputy Director for Management.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H8F4062EC538D4F04AF4753D3EC170759"><enum>(II)</enum><text display-inline="yes-display-inline">The Administrator of the Office of Electronic Government.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HE0B5AFD3D5BE4B30A7CF545CA67B0755"><enum>(III)</enum><text display-inline="yes-display-inline">The Administrator of Federal Procurement Policy.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HBFDB2547AF4C4B1AA2AAB0FBEB94CC37"><enum>(IV)</enum><text display-inline="yes-display-inline">The Controller of the Office of Federal Financial Management.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H89C954E6015C435D9ECA430369F27556"><enum>(V)</enum><text display-inline="yes-display-inline">The Director of the Office of Performance and Personnel Management.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="HACAA731334514196B90C10D5A65384DE"><enum>(ii)</enum><text display-inline="yes-display-inline">The Program Management Improvement Officer from each agency described in section 901(b).</text></clause><clause commented="no" display-inline="no-display-inline" id="H5E26457082034B378B806B5647632E5A"><enum>(iii)</enum><text display-inline="yes-display-inline">Any other full-time or permanent part-time officer or employee of the Federal Government or member of the Armed Forces designated by the Chairperson.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HFE1647CB83D642F284D8D8D8DFF31D42"><enum>(B)</enum><header display-inline="yes-display-inline">Chairperson and vice chairperson</header><clause commented="no" display-inline="no-display-inline" id="H4048C23FCBE44ACBA8FC3C50AFB18713"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Deputy Director for Management of the Office of Management and Budget shall be the Chairperson of the Council. A Vice Chairperson shall be elected by the members and shall serve a term of not more than 1 year.</text></clause><clause commented="no" display-inline="no-display-inline" id="HBEC3599410A54861AA51F8811B87E3EC"><enum>(ii)</enum><header display-inline="yes-display-inline">Duties</header><text display-inline="yes-display-inline">The Chairperson shall preside at the meetings of the Council, determine the agenda of the Council, direct the work of the Council, and establish and direct subgroups of the Council as appropriate.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H47F530AC2C164376900EA1FD1A21B694"><enum>(4)</enum><header display-inline="yes-display-inline">Meetings</header><text display-inline="yes-display-inline">The Council shall meet not less than twice per fiscal year and may meet at the call of the Chairperson or a majority of the members of the Council.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB05695C43AA04A6AB032EDE9E49CB8A1"><enum>(5)</enum><header display-inline="yes-display-inline">Support</header><text display-inline="yes-display-inline">The head of each agency with a Project Management Improvement Officer serving on the Council shall provide administrative support to the Council, as appropriate, at the request of the Chairperson.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HAF8C921C83814CBF99162259A56135B1"><enum>(2)</enum><header display-inline="yes-display-inline">Report required</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Director of the Office of Management and Budget, in consultation with each Program Management Improvement Officer designated under section 1126(a)(1) of title 31, United States Code, shall submit to Congress a report containing the strategy developed under section 1126(a)(2)(B) of such title, as added by paragraph (1).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H451D68D812604B03B33B70FC6D5AF80F"><enum>(c)</enum><header display-inline="yes-display-inline">Program and project management personnel standards</header><paragraph commented="no" display-inline="no-display-inline" id="HD0DDC90D7BC742E8B92262FA60CBCAA7"><enum>(1)</enum><header display-inline="yes-display-inline">Definition</header><text display-inline="yes-display-inline">In this subsection, the term <quote>agency</quote> means each agency described in section 901(b) of title 31, United States Code, other than the Department of Defense.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0BA7126D72B54889BBABA1EFB798FD9F"><enum>(2)</enum><header display-inline="yes-display-inline">Regulations required</header><text display-inline="yes-display-inline">Not later than 180 days after the date on which the standards, policies, and guidelines are issued under section 503(c) of title 31, United States Code, as added by subsection (a)(1), the Director of the Office of Personnel Management, in consultation with the Director of the Office of Management and Budget, shall issue regulations that—</text><subparagraph commented="no" display-inline="no-display-inline" id="HB672DEDD40B1428C95170B6892E74752"><enum>(A)</enum><text display-inline="yes-display-inline">identify key skills and competencies needed for a program and project manager in an agency;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H6DC0973D8E5B44D5872B224BBF19CF42"><enum>(B)</enum><text display-inline="yes-display-inline">establish a new job series, or update and improve an existing job series, for program and project management within an agency; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H408035FFE42D4302834494555AC686C5"><enum>(C)</enum><text display-inline="yes-display-inline">establish a new career path for program and project managers within an agency.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H5977026DE32A463F869EA7E55197BA6E"><enum>(d)</enum><header display-inline="yes-display-inline">Gao report on effectiveness of policies on program and project management</header><text display-inline="yes-display-inline">Not later than 3 years after the date of enactment of this Act, the Government Accountability Office shall issue, in conjunction with the High Risk list of the Government Accountability Office, a report examining the effectiveness of the following on improving Federal program and project management:</text><paragraph commented="no" display-inline="no-display-inline" id="HE6EEAA7E85FE4DDC84DEC721A1C5BFA6"><enum>(1)</enum><text display-inline="yes-display-inline">The standards, policies, and guidelines for program and project management issued under section 503(c) of title 31, United States Code, as added by subsection (a)(1).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1FCDDF00EF3C400EB915F152DA7B7CFD"><enum>(2)</enum><text display-inline="yes-display-inline">The 5-year strategic plan established under section 503(c)(1)(H) of title 31, United States Code, as added by subsection (a)(1).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H550B9CD413834D10BC1D1A14AF218133"><enum>(3)</enum><text display-inline="yes-display-inline">Program Management Improvement Officers designated under section 1126(a)(1) of title 31, United States Code, as added by subsection (b)(1).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H84955FC04BC94DDDBE9F791480C5234D"><enum>(4)</enum><text display-inline="yes-display-inline">The Program Management Policy Council established under section 1126(b)(1) of title 31, United States Code, as added by subsection (b)(1).</text></paragraph></subsection></section></legis-body><attestation><attestation-group><attestor display="no"></attestor><role>Speaker of the House of Representatives</role></attestation-group><attestation-group><attestor display="no"></attestor><role>Vice President of the United States and President of the Senate</role></attestation-group></attestation></bill>
