 <subsection commented="no" id="id6444E67D63DC4080B29502057AD32949"><enum>(a)</enum><header>Voting members</header><text display-inline="yes-display-inline">Section 302(b)(2)(D) (<external-xref legal-doc="usc" parsable-cite="usc/16/1852">16 U.S.C. 1852(b)(2)(D)</external-xref>) is amended—</text> <paragraph commented="no" id="id218ED8F56987402B83A6AE3417DCC44F"><enum>(1)</enum><text>in clause (i)—</text>
 <subparagraph commented="no" id="id16AA07E712A049B6888D31548A7A161F"><enum>(A)</enum><text>by striking <quote>Fisheries</quote> and inserting <quote>Fishery</quote>; and</text> </subparagraph><subparagraph commented="no" id="idBE6326822758493A80B16E9143A75D24"><enum>(B)</enum><text>by inserting <quote>or the South Atlantic Fishery Management Council</quote> after <quote>Management Council</quote>; and</text>
 </subparagraph></paragraph><paragraph commented="no" id="id18A7E21346F5484BB219388F20188595"><enum>(2)</enum><text display-inline="yes-display-inline">by striking clause (iv).</text> </paragraph></subsection><subsection commented="no" id="id22D7759C05734684BE73DF755FE67116"><enum>(b)</enum><header>Committees and advisory panels</header><text>Section 302(g)(1)(B) (<external-xref legal-doc="usc" parsable-cite="usc/16/1852">16 U.S.C. 1852(g)(1)(B)</external-xref>) is amended to read as follows:</text>
					<quoted-block changed="deleted" committee-id="SSCM00" display-inline="no-display-inline" id="id58E3666428534C658E399E37BED06BCC" reported-display-style="strikethrough" style="OLC">
 <subparagraph commented="no" id="id930704349D6E4D54B2DC8B2F80F137DC" indent="up1"><enum>(B)</enum><text>Each scientific and statistical committee shall—</text> <clause commented="no" id="id7C92F66EFE344CBC861BA33EBF176D40"><enum>(i)</enum><text>provide its Council ongoing scientific advice for fishery management decisions, including recommendations for acceptable biological catch, preventing overfishing, maximum sustainable yield, achieving rebuilding targets, and reports on stock status and health, bycatch, habitat status, social and economic impacts of management measures, and sustainability of fishing practices; and</text>
 </clause><clause commented="no" id="idA357E5021B3E4057890DC9EE40CB7C97"><enum>(ii)</enum><text>carry out the requirements of this subparagraph in a transparent manner, allowing for public involvement in the process.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection commented="no" id="idD7D9F3098BC64F2EBB991738421F8848"><enum>(c)</enum><header>Functions</header><text>Section 302(h) (<external-xref legal-doc="usc" parsable-cite="usc/16/1852">16 U.S.C. 1852(h)</external-xref>) is amended—</text> <paragraph commented="no" id="idCFD424C363DF462F89754BA2E983EC80"><enum>(1)</enum><text>in paragraph (7)(C), by striking <quote>and</quote> at the end;</text>
 </paragraph><paragraph commented="no" id="idDE36BDA370AB4B738AC919E440FA0681"><enum>(2)</enum><text>by redesignating paragraph (8) as paragraph (9); and</text> </paragraph><paragraph commented="no" id="id4F3B60E824FE44DB81EA40CF169A66EB"><enum>(3)</enum><text>by inserting after paragraph (7) the following:</text>
						<quoted-block changed="deleted" committee-id="SSCM00" display-inline="no-display-inline" id="idB75CD707840F4EBE86CD8A1A8C0D421C" reported-display-style="strikethrough" style="OLC">
 <paragraph commented="no" id="id6E5B0AF7019648BEAA7E0844F9EB03C6"><enum>(8)</enum><text>have the authority to use alternative fishery management measures in a recreational fishery (or the recreational component of a mixed-use fishery), including extraction rates, fishing mortality, and harvest control rules, to the extent they are in accordance with the requirements of this Act; and</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection commented="no" id="idDE1CC49947814CA5A30CFDF5AF0E8C12"><enum>(d)</enum><header>Webcasts of council meetings</header><text display-inline="yes-display-inline">Section 302(i)(2) (<external-xref legal-doc="usc" parsable-cite="usc/16/1852">16 U.S.C. 1852(i)(2)</external-xref>) is amended by adding at the end the following:</text> <quoted-block changed="deleted" committee-id="SSCM00" display-inline="no-display-inline" id="id73C5724CE1E74B21A0B866B86BF64DFA" reported-display-style="strikethrough" style="OLC"> <subparagraph commented="no" id="id68E2D5F4DDC74BB79C21C909B3733DD6" indent="up1"><enum>(G)</enum><text>Unless closed in accordance with paragraph (3), each Council shall, where practicable, make available on the Internet website of the Council a video or audio webcast of each meeting of the Council and each meeting of the scientific and statistical committee of the Council not later than 30 days after the date of the conclusion of such meeting.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection></section><section commented="no" id="idE7B00931B5E040E3AB7335F352DB892E"><enum>102.</enum><header>Contents of fishery management plans</header><text display-inline="no-display-inline">Section 303 (<external-xref legal-doc="usc" parsable-cite="usc/16/1853">16 U.S.C. 1853</external-xref>) is amended by adding at the end the following:</text> <quoted-block changed="deleted" committee-id="SSCM00" display-inline="no-display-inline" id="idFCDECAAFA8314CCD853AE80F179148E2" reported-display-style="strikethrough" style="OLC"> <subsection commented="no" id="id83926280E5974D10BB2E0E0C34A065AA"><enum>(d)</enum><header>Limitations</header> <paragraph commented="no" id="id099E31C0E65544C197C088B78FFB30E1"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The requirements under subsection (a)(15) shall not—</text>
 <subparagraph commented="no" id="idB49F99EC793A4FB2BCBCF2D5F0CA6D36"><enum>(A)</enum><text display-inline="yes-display-inline">apply to a species in a fishery that has a mean life cycle of 18 months or less, or to a species in a fishery with respect to which all spawning and recruitment occurs beyond State waters and the exclusive economic zone, unless the Secretary has determined the fishery is subject to overfishing of that species; and</text>
 </subparagraph><subparagraph commented="no" id="idD5D6B79FA1E345CDB4A17E40E5F5CCA1"><enum>(B)</enum><text display-inline="yes-display-inline">limit or otherwise affect the requirements of section 301(a)(1) or 304(e) of this Act.</text> </subparagraph></paragraph><paragraph commented="no" id="id44443C64A3824B81B94A644A34A83FD5"><enum>(2)</enum><header>Construction</header><text display-inline="yes-display-inline">Nothing in this subsection shall be construed to affect any effective date regarding the requirements under subsection (a)(15) otherwise provided for under an international agreement in which the United States participates.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section commented="no" id="id8236197C1C634EBBA36FA6D2B4568D73"><enum>103.</enum><header>Rebuilding overfished and depleted fisheries</header><text display-inline="no-display-inline">Section 304(e)(4)(A) (<external-xref legal-doc="usc" parsable-cite="usc/16/1854">16 U.S.C. 1854(e)(4)(A)</external-xref>) is amended to read as follows:</text> <quoted-block changed="deleted" committee-id="SSCM00" display-inline="no-display-inline" id="id4220CD0A0DE4442899160E604A9BDD45" reported-display-style="strikethrough" style="OLC"> <subparagraph commented="no" id="idBEE2510224924146953C909F2D731551"><enum>(A)</enum><text>specify a time period for rebuilding the fishery that—</text>
 <clause commented="no" id="id6CC0F2D4B6DE41F6874627313EB16808"><enum>(i)</enum><text>shall be as short as possible, taking into account the status and biology of any overfished stocks of fish, the needs of fishing communities, recommendations by international organizations in which the United States participates, and the interaction of the overfished stock of fish within the marine ecosystem; and</text>
 </clause><clause commented="no" id="id1BA0851F45464E03A23D98CF8F55B10D"><enum>(ii)</enum><text>except where management measures under an international agreement with the United States participates dictate otherwise, shall not exceed—</text>
 <subclause commented="no" id="id2CA8C15420C74ADBB75792E8D382CA88"><enum>(I)</enum><text>10 years, except in cases where the biology of the stock of fish or other environmental conditions dictate otherwise; or</text>
 </subclause><subclause commented="no" id="id43AD8F90916244DBA65C38F580D49BAE"><enum>(II)</enum><text>the sum of the time in which the affected stock of fish is expected to rebuild to its maximum sustainable yield biomass level in the absence of any fishing mortality, and the mean generation of time of the affected stock of fish, if those time values are the best scientific information available;</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section commented="no" id="id79FD143C989E42BC8AA3F6561BF1B8B6"><enum>104.</enum><header>Funding for stock assessments, surveys, and data collection</header><text display-inline="no-display-inline">Section 311(e)(1) (<external-xref legal-doc="usc" parsable-cite="usc/16/1861">16 U.S.C. 1861(e)(1)</external-xref>) is amended—</text>
 <paragraph commented="no" id="idD39BAA2577594092A16E41558A1CFA99"><enum>(1)</enum><text>in subparagraph (E), by striking <quote>; and</quote> and inserting a semicolon;</text> </paragraph><paragraph commented="no" id="idB4E4ED7083324D52B79FE66D6ED8AB0D"><enum>(2)</enum><text>in subparagraph (F), by striking the period at the end and inserting <quote>; and</quote>; and</text>
 </paragraph><paragraph commented="no" id="id34DF93A60FBB42599CBF072E9A4D1C5B"><enum>(3)</enum><text>by inserting after subparagraph (F) the following:</text> <quoted-block changed="deleted" committee-id="SSCM00" display-inline="no-display-inline" id="id296E143B996A46AF87A5B1A5A85A79A2" reported-display-style="strikethrough" style="OLC"> <subparagraph commented="no" id="id47268ACD20FA4F2AA3838B1E82211FE6" indent="up1"><enum>(G)</enum><text>the costs of stock assessments, surveys, and data collection in fisheries managed under this Act.</text></subparagraph><after-quoted-block>. </after-quoted-block></quoted-block>
				</paragraph></section><section commented="no" id="idD61F13E200464C27BA374D7BA7795453"><enum>105.</enum><header>Capital construction</header>
 <subsection commented="no" id="id6FC397B0F9E2495A9892D07741E540B1"><enum>(a)</enum><header>Definitions; eligible and qualified fishery facilities</header><text display-inline="yes-display-inline">Section 53501 of title 46, United States Code, is amended—</text> <paragraph commented="no" id="id1257D32C28044F66AC12812133FC0A72"><enum>(1)</enum><text>by striking <quote>(7) <header-in-text level="paragraph" style="OLC">United states foreign trade</header-in-text>.—</quote> and inserting <quote>(11) <header-in-text level="paragraph" style="OLC">United States foreign trade</header-in-text>.—</quote>;</text>
 </paragraph><paragraph commented="no" id="id6BCA59ADDEC9424D8042FEF508A32142"><enum>(2)</enum><text>by striking <quote>(8) <header-in-text level="paragraph" style="OLC">Vessel</header-in-text>.—</quote> and inserting <quote>(12) <header-in-text level="paragraph" style="OLC">Vessel</header-in-text>.—</quote>;</text> </paragraph><paragraph commented="no" id="id83BEDB683FDC48FB983961C18EBAD951"><enum>(3)</enum><text>by redesignating paragraphs (5), (6), and (7) as paragraphs (8), (9), and (10), respectively;</text>

 </paragraph><paragraph commented="no" id="id65D96DEA0B4F4365BF966BA82BCA5D82"><enum>(7)</enum><text display-inline="yes-display-inline">by inserting after paragraph (2), as redesignated, the following:</text> <quoted-block changed="deleted" committee-id="SSCM00" display-inline="no-display-inline" id="idABD20433BD14458FAE1E670625057580" reported-display-style="strikethrough" style="OLC"> <paragraph commented="no" id="idA903B0A4A8464183A01EC18A0B6DFA64"><enum>(3)</enum><header>Eligible fishery facility</header> <subparagraph commented="no" id="idFCB978C99F79444DB183F6A058799177"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to subparagraph (B), the term “eligible fishery facility” means—</text>
 <clause commented="no" id="id14B7C30061FD4D57997E9B7F768B09A8"><enum>(i)</enum><text display-inline="yes-display-inline">for operations on land—</text> <subclause commented="no" id="id7A763EB5C150451E86071D9B37DAEAB8"><enum>(I)</enum><text display-inline="yes-display-inline">a structure or an appurtenance thereto designed for unloading and receiving from a vessel, processing, holding pending processing, distribution after processing, or holding pending distribution, of fish from a fishery;</text>
 </subclause><subclause commented="no" id="id67A1A84E0FAC4C719FBF9335DE74C1AF"><enum>(II)</enum><text display-inline="yes-display-inline">the land necessary for the structure or appurtenance described in subclause (I); and</text> </subclause><subclause commented="no" id="idC7505A905FBD4343A90C9FE44F18F33A"><enum>(III)</enum><text display-inline="yes-display-inline">equipment that is for use with the structure or appurtenance that is necessary to perform a function described in subclause (I);</text>
 </subclause></clause><clause commented="no" id="id39EF0036DCCB49D8BD70BBAA37439B2F"><enum>(ii)</enum><text display-inline="yes-display-inline">for operations not on land, a vessel built in the United States and used for, equipped to be used for, or of a type normally used for, processing fish; or</text>
 </clause><clause commented="no" id="id1754E27334EF49DCBE88D03984F4C0FD"><enum>(iii)</enum><text display-inline="yes-display-inline">for aquaculture, including operations on land or elsewhere—</text> <subclause commented="no" id="id223C221896294788B76C1F09D18BAFB0"><enum>(I)</enum><text display-inline="yes-display-inline">a structure or an appurtenance thereto designed for aquaculture;</text>
 </subclause><subclause commented="no" id="idAE4130A5A6EF4526A01855293CF61DB5"><enum>(II)</enum><text display-inline="yes-display-inline">the land necessary for the structure or appurtenance;</text> </subclause><subclause commented="no" id="idB24EC568C9194ADBAB8BEBA29C5226EC"><enum>(III)</enum><text display-inline="yes-display-inline">equipment that is for use with the structure or appurtenance and that is necessary to perform a function described in subclause (I); and</text>
 </subclause><subclause commented="no" id="idACAC480F1633446194E531EBFAEC88D9"><enum>(IV)</enum><text display-inline="yes-display-inline">a vessel built in the United States and used for, equipped to be used for, or of a type normally used for, aquaculture.</text>
 </subclause></clause></subparagraph><subparagraph commented="no" id="idBFB4C22DD9AA44719418B332163678BC"><enum>(B)</enum><header>Ownership requirement</header><text display-inline="yes-display-inline">Under subparagraph (A), the structure, appurtenance, land, equipment, or vessel shall be owned by—</text> <clause commented="no" id="idAE0BA7B0ED604A5EA3DD7DE428E2DBC3"><enum>(i)</enum><text display-inline="yes-display-inline">an individual who is a citizen of the United States; or</text>
 </clause><clause commented="no" id="id248C3A9AA0B24E9F843942588B7E1DA8"><enum>(ii)</enum><text display-inline="yes-display-inline">an entity that is—</text> <subclause commented="no" id="idB943EBD9CFF44FCFBAF4B457F30A8836"><enum>(I)</enum><text display-inline="yes-display-inline">a citizen of the United States under section 50501 of this title; and</text>
 </subclause><subclause commented="no" id="idB7A41B666F6E42C6AB3177F572253207"><enum>(II)</enum><text display-inline="yes-display-inline">at least 75 percent owned by citizens of the United States, as determined under section 50501 of this title.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph commented="no" id="idFC8508EF893E4F64A417DC6BFF1F97EC"><enum>(8)</enum><text display-inline="yes-display-inline">by inserting after paragraph (6), as redesignated, the following:</text> <quoted-block changed="deleted" committee-id="SSCM00" display-inline="no-display-inline" id="id77B478D4B4584BA38D557120A8BDD214" reported-display-style="strikethrough" style="OLC"> <paragraph commented="no" id="id0D64CB94A80D4080B918574B64863B42"><enum>(7)</enum><header>Qualified fishery facility</header> <subparagraph commented="no" id="idC5536CFE5B52413CAD44967FF5CC2776"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to subparagraph (B), the term <term>qualified fishery facility</term> means—</text>
 <clause commented="no" id="id52804E2E898D4860B78C83DD02B024F2"><enum>(i)</enum><text display-inline="yes-display-inline">for operations on land—</text> <subclause commented="no" id="id85447A9904BD46DF88C23D02F921A7FF"><enum>(I)</enum><text display-inline="yes-display-inline">a structure or an appurtenance thereto designed for unloading and receiving from a vessel, processing, holding pending processing, distribution after processing, or holding pending distribution, of fish from a fishery;</text>
 </subclause><subclause commented="no" id="idF62871CBCA1F442087F92713150657A1"><enum>(II)</enum><text display-inline="yes-display-inline">the land necessary for the structure or appurtenance; and</text> </subclause><subclause commented="no" id="id907F9D6EEE6341EBABC6052A77B0FF1A"><enum>(III)</enum><text display-inline="yes-display-inline">equipment that is for use with the structure or appurtenance and necessary to perform a function described in subclause (I);</text>
 </subclause></clause><clause commented="no" id="id33C974E053BA446FA5FFDA28A8AA167E"><enum>(ii)</enum><text display-inline="yes-display-inline">for operations not on land, a vessel built in the United States and used for, equipped to be used for, or of a type normally used for, processing fish; or</text>
 </clause><clause commented="no" id="idD7EC48F522094D6F8C4430548B6789A3"><enum>(iii)</enum><text display-inline="yes-display-inline">for aquaculture, including operations on land or elsewhere—</text> <subclause commented="no" id="idCADB6E8EE44D4AE5A3D93662B9AE840B"><enum>(I)</enum><text display-inline="yes-display-inline">a structure or an appurtenance thereto designed for aquaculture;</text>
 </subclause><subclause commented="no" id="id1DB49839CC564C36ACE1439CB3D4D43F"><enum>(II)</enum><text display-inline="yes-display-inline">the land necessary for the structure or appurtenance;</text> </subclause><subclause commented="no" id="id97E19C4A3BC2489C8A739C97DE1B9D6B"><enum>(III)</enum><text display-inline="yes-display-inline">equipment that is for use with the structure or appurtenance and necessary for performing a function described in subclause (I); and</text>
 </subclause><subclause commented="no" id="id142FBB886B1C44A7994C2850CEFD8771"><enum>(IV)</enum><text display-inline="yes-display-inline">a vessel built in the United States.</text> </subclause></clause></subparagraph><subparagraph commented="no" id="id3E0A13C718C14E67A8E781796468A1FF"><enum>(B)</enum><header>Ownership requirement</header><text display-inline="yes-display-inline">Under subparagraph (A), the structure, appurtenance, land, equipment, or vessel shall be owned by—</text>
 <clause commented="no" id="id0B2203054A1744EE9FF157BC7DC0C73C"><enum>(i)</enum><text display-inline="yes-display-inline">an individual who is a citizen of the United States; or</text> </clause><clause commented="no" id="idEC92863B93AC4F17AC31C9AA0CB48472"><enum>(ii)</enum><text display-inline="yes-display-inline">an entity that is—</text>
 <subclause commented="no" id="id41D2447B6DCC4752A5E9BF3DF287AA19"><enum>(I)</enum><text display-inline="yes-display-inline">a citizen of the United States under section 50501 of this title; and</text> </subclause><subclause commented="no" id="id651F5F71554944DB87F91FFFE940EC2E"><enum>(II)</enum><text display-inline="yes-display-inline">at least 75 percent owned by citizens of the United States, as determined under section 50501 of this title.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection commented="no" id="idBFB0954B57634F898714CA5DD2A2C435"><enum>(b)</enum><header>Eligible fishery facilities</header>
 <paragraph commented="no" id="id51EE68523ECE4CD3A958E0F92F219B99"><enum>(1)</enum><header>Definition of Secretary</header><text display-inline="yes-display-inline">Paragraph (9)(A) of section 53501 of title 46, United States Code, as redesignated by subsection (a) of this section, is amended to read as follows:</text>

 <clause commented="no" id="idCE39519CF1D94334AEEC38B5D52FA1D5"><enum>(i)</enum><text display-inline="yes-display-inline">by inserting <quote>or eligible fishery facility</quote> after <quote>eligible vessel</quote>; and</text> </clause><clause commented="no" id="id11720EC09B11482ABAB2642A2B2E2C94"><enum>(ii)</enum><text display-inline="yes-display-inline">by striking the period at the end and inserting <quote>or fishery facility.</quote>; and</text>

 </subparagraph><subparagraph commented="no" id="id748B6949EE714CF1B384DC73ADD26118"><enum>(B)</enum><text display-inline="yes-display-inline">an entity that is—</text> <clause commented="no" id="idF7F6288F1AAB411B95C7379AE131B117"><enum>(i)</enum><text display-inline="yes-display-inline">a citizen of the United States under section 50501; and</text>

 </subparagraph></paragraph><paragraph commented="no" id="idE77525A8D3E941559C8E17CA011A80A3"><enum>(2)</enum><header>Tax treatment of qualified withdrawals and basis of property</header><text display-inline="yes-display-inline">Section 53510 of title 46, United States Code, is amended—</text> <subparagraph commented="no" id="idA339B4FB46DE44E3BAF86241BCA4EF24"><enum>(A)</enum><text display-inline="yes-display-inline">in subsections (b) and (c), by striking <quote>or container</quote> each place that term appears and inserting <quote>container, or fishery facility</quote>; and</text>

 </paragraph></subsection><subsection commented="no" id="idA84919D60D2D4211908D3FFE69A32B44"><enum>(e)</enum><header>Technical amendment</header><text>Paragraph (8)(A)(iii) of section 53501 of title 46, United States Code, as redesignated by subsection (a) of this section, is amended by striking <quote>trade trade</quote> and inserting <quote>trade</quote>.</text>
 </subsection></section><section commented="no" id="id35DA704119624DE3B19F694E300F9989"><enum>106.</enum><header>Fisheries disaster relief</header><text display-inline="no-display-inline">Section 312(a) (<external-xref legal-doc="usc" parsable-cite="usc/16/1861a">16 U.S.C. 1861a(a)</external-xref>) is amended—</text> <paragraph commented="no" id="idFF76155C375B4263BA89D005E50B12DF"><enum>(1)</enum><text>by redesignating paragraphs (2) through (4) as paragraphs (3) through (5), respectively; and</text>

 <subsection commented="no" id="id0E8BF8E8FB764EE1961F5E1A34A667F3"><enum>(a)</enum><header>Study requirements</header><text display-inline="yes-display-inline">Not later than 60 days after the date of the enactment of this Act, the Secretary of Commerce shall enter into an arrangement with the National Academy of Sciences to conduct a study—</text>
 <paragraph commented="no" id="id1EBF31B21CD044398D63F900DE5A25B4"><enum>(1)</enum><text display-inline="yes-display-inline">to provide guidance on criteria that could be used for allocating fishing privileges, including consideration of the conservation and socioeconomic benefits of the commercial, recreational, and charter components of a fishery, to a Regional Fishery Management Council established under section 302 of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1852">16 U.S.C. 1852</external-xref>) in the preparation of a fishery management plan under that Act; and</text>
 </paragraph><paragraph commented="no" id="id609D8C20E1A94BB3ABEB4C58D5FB71C6"><enum>(2)</enum><text display-inline="yes-display-inline">to identify sources of information that could reasonably support the use of such criteria in allocation decisions.</text>
 </paragraph></subsection><subsection commented="no" id="id8BEEEF0489964BEC997AC94487302F46"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date a contract is awarded under subsection (a), the National Academy of Sciences shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Natural Resources of the House of Representatives a report on the study conducted under subsection (a).</text>

 <subsection id="H24D6721679CB4AF78CAD06CBCEED74A6"><enum>(a)</enum><header>Stock assessment plan</header><text>Section 404 (<external-xref legal-doc="usc" parsable-cite="usc/16/1881c">16 U.S.C. 1881c</external-xref>) is amended by adding at the end the following:</text>

							<paragraph id="H8767DE61FF464A64AA154F0B9702F3ED"><enum>(1)</enum><header>In
 general</header><text display-inline="yes-display-inline">The Secretary, in consultation with the Councils, shall develop and publish in the Federal Register, on the same schedule as required for the strategic plan required under subsection (b), a plan to conduct stock assessments for all stocks of fish for which a fishery management plan is in effect under this Act.</text>
 </paragraph><paragraph id="HFCFBA0870A01412E8EED125398CCA65D"><enum>(2)</enum><header>Contents</header><text>The plan shall—</text>
 <subparagraph id="HD7788E4F208C40EAB64169DB89A7AE85"><enum>(A)</enum><text display-inline="yes-display-inline">for each stock of fish for which a stock assessment has previously been conducted—</text>
 <clause id="HC257274A6D1F46C3B0FCD9559BD2C88F"><enum>(i)</enum><text>establish a schedule for updating the stock assessment that is reasonable given the biology and characteristics of the stock; and</text>
 </clause><clause id="H7C99553148C84CAAAD993CC88F70399A"><enum>(ii)</enum><text display-inline="yes-display-inline">subject to the availability of appropriations, require completion of a new stock assessment, or an update of the most recent stock assessment—</text>
 <subclause id="HF2FB9DF66A5B4FF3BBF1672A4F4A338B"><enum>(I)</enum><text>at least once every 5 years, except a Council may delay action for not more than 3 additional 1-year periods; or</text>
 </subclause><subclause id="H239D76DBF8E646249E563A79A2E4B84C"><enum>(II)</enum><text>within such other time period specified and justified by the Secretary in the plan;</text>
 </subclause></clause></subparagraph><subparagraph id="HB78CCD0C0FCD4942BE6FC7F3011C8E05"><enum>(B)</enum><text>for each economically important stock of fish for which a stock assessment has not previously been conducted—</text>
 <clause id="H3C771C84948543AC99A5AD838AC143D7"><enum>(i)</enum><text>establish a schedule for conducting an initial stock assessment that is reasonable given the biology and characteristics of the stock; and</text>
 </clause><clause commented="no" id="HEF5D2344936A4739BAEE3200051CDFDF"><enum>(ii)</enum><text display-inline="yes-display-inline">subject to the availability of appropriations, require completion of the initial stock assessment not later than 3 years after the date that the plan is published in the Federal Register unless another time period is specified and justified by the Secretary in the plan; and</text>
 </clause></subparagraph><subparagraph id="H930C0D131EA34E2FA13319E7C855323C"><enum>(C)</enum><text display-inline="yes-display-inline">identify data and analysis, especially concerning recreational fishing, that, if available, would reduce uncertainty in and improve the accuracy of future stock assessments, including whether that data and analysis could be provided by nongovernmental sources, including fishermen, fishing communities, universities, and research institutions.</text>
								</subparagraph></paragraph><paragraph id="HC13AB7CBF91E4E45A00A3C8A98594E8E"><enum>(3)</enum><header>Waiver of stock
 assessment requirement</header><text>Notwithstanding subparagraphs (A)(ii) and (B)(ii) of paragraph (2), a stock assessment shall not be required for a stock of fish in the plan if the Secretary determines that such a stock assessment is not necessary and justifies the determination in the Federal Register notice required by this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H471916658F674116B945C78115B4544C"><enum>(b)</enum><header>Deadline</header><text>Notwithstanding paragraph (1) of section 404(e) of the Magnuson-Stevens Fishery Conservation and Management Act, as added by this section, the Secretary of Commerce shall issue the first stock assessment plan under that section by not later than 1 year after the date of the enactment of this Act.</text>

 general</header><text>The Secretary, in consultation with the scientific and statistical committees of the Councils established under section 302(g), shall develop and submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Natural Resources of the House of Representatives a report on facilitating greater incorporation of data, analysis, stock assessments, and surveys from nongovernmental sources, including fishermen, fishing communities, universities, and research institutions, into fisheries management decisions.</text>
 </paragraph><paragraph id="HC143EA7C67E141EDA4D365AACE768F00"><enum>(2)</enum><header>Content</header><text>The report under paragraph (1) shall—</text>
 <subparagraph id="H4E281FEC62A74C4C92AAE173FA1C1B43"><enum>(A)</enum><text display-inline="yes-display-inline">identify types of data and analysis, especially concerning recreational fishing, that can be reliably used for purposes of this Act and the basis for establishing conservation and management measures as required by section 303(a)(1), including setting standards for the collection and use of that data and analysis in stock assessments and surveys and for other purposes;</text>
 </subparagraph><subparagraph id="HAE07E4DCC1934A36939F2797474E7324"><enum>(B)</enum><text>provide specific recommendations for collecting data and performing analyses identified as necessary to reduce the uncertainty referred to in section 404(e)(2)(C);</text>
 </subparagraph><subparagraph id="H5E287C3A18424D4EAF7DEC78A8213EE1"><enum>(C)</enum><text>consider the extent to which it is possible to establish a registry of persons providing such information; and</text>
 </subparagraph><subparagraph id="id71C615ACE58E439A8738C37456C8107E"><enum>(D)</enum><text>consider the extent to which the acceptance and use of data and analysis identified in the report in fishery management decisions is practicable.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="HA53024A10EE84C35A4E9EA4F5D589CDB"><enum>(b)</enum><header>Deadline</header><text>The Secretary of Commerce shall submit the report required under the amendment made by subsection (a) not later than 1 year after the date of the enactment of this Act.</text>
				</subsection></section><section id="id60FA468357B8424ABDCE5680767EF611"><enum>203.</enum><header>Focusing assets for improved fisheries outcomes</header>
 <subsection id="idA3AD3AB7009A4044A4B0521CC1855C72"><enum>(a)</enum><header>In general</header><text>Section 2(b) of the Act of August 11, 1939 (<external-xref legal-doc="usc" parsable-cite="usc/15/713c-3">15 U.S.C. 713c–3(b)</external-xref>), is amended—</text> <paragraph id="id27DC7FD6606745929670F57F4CFC44A4"><enum>(1)</enum><text>in paragraph (1)—</text>
 <subparagraph id="id5A079B8459AB4CB48B830A730BF321BF"><enum>(A)</enum><text>by striking <quote>beginning with the fiscal year commencing July 1, 1954, and ending on June 30, 1957,</quote>;</text> </subparagraph><subparagraph id="id4A182AA834E44C62B42318EB35678D3A"><enum>(B)</enum><text>by striking <quote>moneys</quote> the first place that term appears and inserting <quote>monies</quote>; and</text>
 </subparagraph><subparagraph id="id2EAE1B0E234B4FD1A6E6621184F7E304"><enum>(C)</enum><text>by striking <quote>shall be maintained in a separate fund only for</quote> and all that follows through the end and inserting <quote>shall only be used for the purposes described under subsection (c).</quote>; and</text> </subparagraph></paragraph><paragraph id="id5E5D08BFE15549EEB79500DF7A39C492"><enum>(2)</enum><text>by striking paragraph (2).</text>

 </subparagraph><subparagraph id="id3CABF4E2910A4619A67C079CC7045B7F"><enum>(C)</enum><header>Waiver</header><text>A provision of this paragraph may be waived or suspended in the Senate only by the affirmative vote of three-fifths of the Members, duly chosen and sworn.</text>
 </subparagraph><subparagraph id="id4DE50F8922F14281AEC5881193819ADB"><enum>(D)</enum><header>Appeals</header><text>An affirmative vote of three-fifths of the Members of the Senate, duly chosen and sworn, shall be required to sustain an appeal of the ruling of the Chair on the point of order raised under this paragraph.</text>
 </subparagraph><subparagraph id="idD26F3A90A3CE48ADAF594B04CFCB689C"><enum>(E)</enum><header>Rules of the Senate and the House of Representatives</header><text>This paragraph is enacted by Congress—</text> <clause id="id4B69972C602E4505B38F8CBCB1FBB342"><enum>(i)</enum><text>as an exercise of the rulemaking power of the Senate and the House of Representatives, respectively, and is deemed to be part of the rules of each house, respectively, but applicable only with respect to the procedure to be followed in the House in the case of a bill, resolution, amendment, or conference report under this paragraph, and it supersedes other rules only to the extent that it is inconsistent with such rules; and</text>

 <subparagraph commented="no" id="id4213b8a2-c2a3-443e-8956-445ab953d953"><enum>(A)</enum><text display-inline="yes-display-inline">apply to a species in a fishery that has a mean life cycle of 12 months or less, or to a species in a fishery with respect to which all spawning and recruitment occurs beyond State waters and the exclusive economic zone, unless the Secretary has determined the fishery is subject to overfishing of that species; and</text>
 </subparagraph><subparagraph commented="no" id="id3b375bf2-009d-428c-a478-9ed21cdbe320"><enum>(B)</enum><text display-inline="yes-display-inline">limit or otherwise affect the requirements of section 301(a)(1) or 304(e) of this Act.</text> </subparagraph></paragraph><paragraph commented="no" id="id4487a1e1-363d-4719-b668-2b8f8ef1932b"><enum>(2)</enum><header>Construction</header><text display-inline="yes-display-inline">Nothing in this subsection shall be construed to affect any effective date regarding the requirements under subsection (a)(15) otherwise provided for under an international agreement in which the United States participates.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

 </subclause><subclause commented="no" id="id26984ef2-d1e3-4aa4-a495-269ef13b01dd"><enum>(II)</enum><text display-inline="yes-display-inline">the land necessary for the structure or appurtenance described in subclause (I); and</text> </subclause><subclause commented="no" id="id6c17c366-9c22-4efc-8208-bdcadbb34550"><enum>(III)</enum><text display-inline="yes-display-inline">equipment that is for use with the structure or appurtenance that is necessary to perform a function described in subclause (I);</text>
 </subclause></clause><clause commented="no" id="ide5d14866-4c4d-4e75-807d-dc804ea8b7ef"><enum>(ii)</enum><text display-inline="yes-display-inline">for operations not on land, a vessel built in the United States and used for, equipped to be used for, or of a type normally used for, processing fish; or</text>
 </clause><clause commented="no" id="ide9bc5144-0114-4d4c-96b9-039916eff4c5"><enum>(iii)</enum><text display-inline="yes-display-inline">for aquaculture, including operations on land or elsewhere—</text> <subclause commented="no" id="id72ec1109-c0f1-46b6-8536-7607644ad233"><enum>(I)</enum><text display-inline="yes-display-inline">a structure or an appurtenance thereto designed for aquaculture;</text>
 </subclause><subclause commented="no" id="id0fb028aa-9c8b-4e4c-9cf3-6a03d0faa4fa"><enum>(II)</enum><text display-inline="yes-display-inline">the land necessary for the structure or appurtenance;</text> </subclause><subclause commented="no" id="id2c167578-1264-45bf-b1ae-ce2c4d3b6d91"><enum>(III)</enum><text display-inline="yes-display-inline">equipment that is for use with the structure or appurtenance and that is necessary to perform a function described in subclause (I); and</text>
 </subclause><subclause commented="no" id="id042a9ed6-a530-4d97-9f77-c4d67c6fd533"><enum>(IV)</enum><text display-inline="yes-display-inline">a vessel built in the United States and used for, equipped to be used for, or of a type normally used for, aquaculture.</text>
 </subclause></clause></subparagraph><subparagraph commented="no" id="idd242f534-7969-4bc5-9c66-e37cfe892975"><enum>(B)</enum><header>Ownership requirement</header><text display-inline="yes-display-inline">Under subparagraph (A), the structure, appurtenance, land, equipment, or vessel shall be owned by—</text> <clause commented="no" id="idc51a34f3-ddda-437c-8245-47fbd70c2f70"><enum>(i)</enum><text display-inline="yes-display-inline">an individual who is a citizen of the United States; or</text>
 </clause><clause commented="no" id="ide8af4f8f-48a5-4576-9fe1-ca88bd6bbc01"><enum>(ii)</enum><text display-inline="yes-display-inline">an entity that is—</text> <subclause commented="no" id="idd3160441-ca20-49d2-b9c2-3e90716e28e7"><enum>(I)</enum><text display-inline="yes-display-inline">a citizen of the United States under section 50501 of this title; and</text>
 </subclause><subclause commented="no" id="idc0612a21-f52e-4f9c-8a5b-fb6a8e0c8c4f"><enum>(II)</enum><text display-inline="yes-display-inline">at least 75 percent owned by citizens of the United States, as determined under section 50501 of this title.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>

 </subclause><subclause commented="no" id="idd3e16918-35a6-4ee8-91c6-5e2513312238"><enum>(II)</enum><text display-inline="yes-display-inline">the land necessary for the structure or appurtenance; and</text> </subclause><subclause commented="no" id="id9f9c231a-cdef-48c8-b79d-734a2ebca6aa"><enum>(III)</enum><text display-inline="yes-display-inline">equipment that is for use with the structure or appurtenance and necessary to perform a function described in subclause (I);</text>
 </subclause></clause><clause commented="no" id="idde149279-d609-45d8-b8e9-4bf4df9a1ee0"><enum>(ii)</enum><text display-inline="yes-display-inline">for operations not on land, a vessel built in the United States and used for, equipped to be used for, or of a type normally used for, processing fish; or</text>
 </clause><clause commented="no" id="id1925af64-8b3f-49dd-89d8-7cbbdf50f770"><enum>(iii)</enum><text display-inline="yes-display-inline">for aquaculture, including operations on land or elsewhere—</text> <subclause commented="no" id="id76a90476-d99f-4a76-bb3e-fb3a4216b73b"><enum>(I)</enum><text display-inline="yes-display-inline">a structure or an appurtenance thereto designed for aquaculture;</text>
 </subclause><subclause commented="no" id="id3453b8d4-52f3-4b24-b6c0-d49848ed343e"><enum>(II)</enum><text display-inline="yes-display-inline">the land necessary for the structure or appurtenance;</text> </subclause><subclause commented="no" id="idbef0931e-6cb6-459c-8daa-5426b48acaf1"><enum>(III)</enum><text display-inline="yes-display-inline">equipment that is for use with the structure or appurtenance and necessary for performing a function described in subclause (I); and</text>
 </subclause><subclause commented="no" id="id63941e0e-d7fc-46f7-805c-9d5db5b33095"><enum>(IV)</enum><text display-inline="yes-display-inline">a vessel built in the United States.</text> </subclause></clause></subparagraph><subparagraph commented="no" id="idbdaf17e2-4a92-4aae-aac1-38ccaeb7673d"><enum>(B)</enum><header>Ownership requirement</header><text display-inline="yes-display-inline">Under subparagraph (A), the structure, appurtenance, land, equipment, or vessel shall be owned by—</text>

 <paragraph commented="no" id="id5c3d32f8-6547-46ec-8b29-fe720a95eb68"><enum>(1)</enum><header>Definition of Secretary</header><text display-inline="yes-display-inline">Paragraph (9)(A) of section 53501 of title 46, United States Code, as redesignated by subsection (a) of this section, is amended to read as follows:</text>

 </paragraph><paragraph commented="no" id="idefcc20dc-12c7-4112-943d-2950b20da2ed"><enum>(2)</enum><text display-inline="yes-display-inline">to provide for the acquisition, construction, or reconstruction of a fishery facility owned by—</text> <subparagraph commented="no" id="id02072de2-2a64-40d6-9165-de8390005b34"><enum>(A)</enum><text display-inline="yes-display-inline">an individual who is a citizen of the United States; or</text>
 </subparagraph><subparagraph commented="no" id="idcbfc56b9-898b-43cb-bfcc-5d1c13ee8b93"><enum>(B)</enum><text display-inline="yes-display-inline">an entity that is—</text> <clause commented="no" id="id54253e02-ee97-4adc-bec8-14cd47cb967d"><enum>(i)</enum><text display-inline="yes-display-inline">a citizen of the United States under section 50501; and</text>

 </paragraph><paragraph commented="no" id="id13d41f0c-7129-4d70-a11f-798ff0f9a5e7"><enum>(2)</enum><header>Ceiling on deposits</header><text display-inline="yes-display-inline">Section 53505 of title 46, United States Code, is amended—</text> <subparagraph commented="no" id="id3ea02d90-38c7-4fb3-aa61-a6e47be848dc"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (a)—</text>

 </subsection></section><section commented="no" id="idf27d8404-6113-463c-a567-9434d92f55f2"><enum><added-phrase committee-id="SSCM00" reported-display-style="italic">105.</added-phrase></enum><header>Fisheries disaster relief</header><text display-inline="no-display-inline">Section 312(a) (<external-xref legal-doc="usc" parsable-cite="usc/16/1861a">16 U.S.C. 1861a(a)</external-xref>) is amended—</text> <paragraph commented="no" id="id2cbbb9a4-684b-49c5-ac08-cbaab9087b75"><enum>(1)</enum><text>by redesignating paragraphs (2) through (4) as paragraphs (3) through (5), respectively; and</text>

 <subsection commented="no" id="id6bf6d0ca-a0fb-4030-9e6b-bffe81887966"><enum>(a)</enum><header>Study requirements</header><text display-inline="yes-display-inline">Not later than 60 days after the date of the enactment of this Act, the Secretary of Commerce shall enter into an arrangement with the National Academy of Sciences to conduct a study—</text>
 <paragraph commented="no" id="id5083fd71-c31a-4ef1-bda6-f1b19efa81cd"><enum>(1)</enum><text display-inline="yes-display-inline">to provide guidance on criteria that could be used for allocating fishing privileges, including consideration of the conservation and socioeconomic benefits of the commercial, recreational, and charter components of a fishery, to a Regional Fishery Management Council established under section 302 of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1852">16 U.S.C. 1852</external-xref>) in the preparation of a fishery management plan under that Act; and</text>
 </paragraph><paragraph commented="no" id="id61c5c87e-679e-46af-85ed-a16ee7668aad"><enum>(2)</enum><text display-inline="yes-display-inline">to identify sources of information that could reasonably support the use of such criteria in allocation decisions.</text>
 </paragraph></subsection><subsection commented="no" id="id98a322f8-b9af-4306-b274-9150e42440be"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date a contract is awarded under subsection (a), the National Academy of Sciences shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Natural Resources of the House of Representatives a report on the study conducted under subsection (a).</text>

						<subsection id="idd44539b4-2709-4e34-9a4b-bf83798bab7d"><enum>(e)</enum><header>Stock assessment
				plan</header>
							<paragraph id="id67e205e3-960b-44f2-9ff5-17f640fe3f72"><enum>(1)</enum><header>In
 general</header><text display-inline="yes-display-inline">The Secretary, in consultation with the Councils, shall develop and publish in the Federal Register, on the same schedule as required for the strategic plan required under subsection (b), a plan to conduct stock assessments for all stocks of fish for which a fishery management plan is in effect under this Act.</text>
 </paragraph><paragraph id="id67ff3b19-2adc-4ba9-9693-90003049671c"><enum>(2)</enum><header>Contents</header><text>The plan shall—</text>
 <subparagraph id="id34431e6d-a6cd-4c97-8b55-14c690daf556"><enum>(A)</enum><text display-inline="yes-display-inline">for each stock of fish for which a stock assessment has previously been conducted—</text>
 <clause id="ide6d33a66-0472-4479-ad3f-105812c0b504"><enum>(i)</enum><text>establish a schedule for updating the stock assessment that is reasonable given the biology and characteristics of the stock; and</text>
 </clause><clause id="id53a53113-0770-492f-b1f4-42c1efe073b5"><enum>(ii)</enum><text display-inline="yes-display-inline">subject to the availability of appropriations, require completion of a new stock assessment, or an update of the most recent stock assessment—</text>
 <subclause id="id76207a90-84ec-456d-860f-15fb454db091"><enum>(I)</enum><text>at least once every 5 years, except a Council may delay action for not more than 3 additional 1-year periods; or</text>
 </subclause><subclause id="id7851f93f-0139-4d40-9786-9cb99fa085d7"><enum>(II)</enum><text>within such other time period specified and justified by the Secretary in the plan;</text>
 </subclause></clause></subparagraph><subparagraph id="id22f5ceb2-92d8-4135-a860-9f13602be14d"><enum>(B)</enum><text>for each economically important stock of fish for which a stock assessment has not previously been conducted—</text>
 <clause id="id7a525f3c-5285-4aa3-a840-518662cde5dd"><enum>(i)</enum><text>establish a schedule for conducting an initial stock assessment that is reasonable given the biology and characteristics of the stock; and</text>
 </clause><clause commented="no" id="id376ed922-0c33-4adf-84f8-c3991aceebfd"><enum>(ii)</enum><text display-inline="yes-display-inline">subject to the availability of appropriations, require completion of the initial stock assessment not later than 3 years after the date that the plan is published in the Federal Register unless another time period is specified and justified by the Secretary in the plan; and</text>
 </clause></subparagraph><subparagraph id="id097134a3-c256-45d2-9d5e-83e0075c6fbf"><enum>(C)</enum><text display-inline="yes-display-inline">identify data and analysis, especially concerning recreational fishing, that, if available, would reduce uncertainty in and improve the accuracy of future stock assessments, including whether that data and analysis could be provided by nongovernmental sources, including fishermen, fishing communities, universities, and research institutions.</text>
								</subparagraph></paragraph><paragraph id="ide23a3d85-0220-4989-b967-83e95a1c317d"><enum>(3)</enum><header>Waiver of stock
 assessment requirement</header><text>Notwithstanding subparagraphs (A)(ii) and (B)(ii) of paragraph (2), a stock assessment shall not be required for a stock of fish in the plan if the Secretary determines that such a stock assessment is not necessary and justifies the determination in the Federal Register notice required by this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="idad774702-0cd3-44ff-b805-51611ebdc441"><enum>(b)</enum><header>Deadline</header><text>Notwithstanding paragraph (1) of section 404(e) of the Magnuson-Stevens Fishery Conservation and Management Act, as added by this section, the Secretary of Commerce shall issue the first stock assessment plan under that section by not later than 1 year after the date of the enactment of this Act.</text>
				</subsection></section><section id="idde613786-8259-4eb5-a5db-f453d3631a9e"><enum>202.</enum><header>Improving
			 science</header>
				<subsection id="ide6caf1c0-2e0b-4e06-b9fb-c678eb5c2281"><enum>(a)</enum><header>Improving data
			 collection and analysis</header>
					<paragraph id="id22e11068-856a-4567-9045-25ed25f8aea0"><enum>(1)</enum><header>In
 general</header><text>Section 404 (<external-xref legal-doc="usc" parsable-cite="usc/16/1881c">16 U.S.C. 1881c</external-xref>), as amended by section 201 of this Act, is further amended by adding at the end the following:</text>

							<subsection id="idb7b95dd8-b25d-4192-a199-5cc1a26f4b92"><enum>(f)</enum><header>Improving data
				collection and analysis</header>
								<paragraph id="id902156b7-624b-41e2-bced-42bd3d46bf24"><enum>(1)</enum><header>In
 general</header><text>The Secretary, in consultation with the scientific and statistical committees of the Councils established under section 302(g), shall develop and submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Natural Resources of the House of Representatives a report on facilitating greater incorporation of data, analysis, stock assessments, and surveys from nongovernmental sources, including fishermen, fishing communities, universities, and research institutions, into fisheries management decisions.</text>
 </paragraph><paragraph id="id1b3e2d31-2739-4ed1-9750-520b016a9e53"><enum>(2)</enum><header>Content</header><text>The report under paragraph (1) shall—</text>
 <subparagraph id="id542e3759-bd6f-4867-b444-3ad3aefddea0"><enum>(A)</enum><text display-inline="yes-display-inline">identify types of data and analysis, especially concerning recreational fishing, that can be reliably used for purposes of this Act and the basis for establishing conservation and management measures as required by section 303(a)(1), including setting standards for the collection and use of that data and analysis in stock assessments and surveys and for other purposes;</text>
 </subparagraph><subparagraph id="id80f37292-689f-4774-bcd9-5c4821806f43"><enum>(B)</enum><text>provide specific recommendations for collecting data and performing analyses identified as necessary to reduce the uncertainty referred to in section 404(e)(2)(C);</text>
 </subparagraph><subparagraph id="id7a1b6292-6513-4021-8ab9-c4ad9fdfa420"><enum>(C)</enum><text>consider the extent to which it is possible to establish a registry of persons providing such information; and</text>
 </subparagraph><subparagraph id="id1ec8c4df-1881-4a30-be1a-8d882cf89453"><enum>(D)</enum><text>consider the extent to which the acceptance and use of data and analysis identified in the report in fishery management decisions is practicable.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="idc1b8f9fe-5062-464c-a2f5-77e0eea57de3"><enum>(b)</enum><header>Deadline</header><text>The Secretary of Commerce shall submit the report required under the amendment made by subsection (a) not later than 1 year after the date of the enactment of this Act.</text>
				</subsection></section><section id="id76934cad-8762-4b5b-b7fc-03a9ee4043ae"><enum>203.</enum><header>Focusing assets for improved fisheries outcomes</header>
 <subsection id="idc1d76671-aeae-433c-b06f-677c655a17d2"><enum>(a)</enum><header>In general</header><text>Section 2(b) of the Act of August 11, 1939 (<external-xref legal-doc="usc" parsable-cite="usc/15/713c-3">15 U.S.C. 713c–3(b)</external-xref>), is amended—</text> <paragraph id="id911d9731-3799-48e3-b257-41bbb055e448"><enum>(1)</enum><text>in paragraph (1)—</text>
 <subparagraph id="idb64e4aa6-874f-4347-9a0d-40fbf40b7f92"><enum>(A)</enum><text>by striking <quote>beginning with the fiscal year commencing July 1, 1954, and ending on June 30, 1957,</quote>;</text> </subparagraph><subparagraph id="id75bb17de-5085-4b9c-b972-3ea709032bd0"><enum>(B)</enum><text>by striking <quote>moneys</quote> the first place that term appears and inserting <quote>monies</quote>; and</text>
 </subparagraph><subparagraph id="id4a900085-69f3-4d18-ad96-c8df3caf6ad3"><enum>(C)</enum><text>by striking <quote>shall be maintained in a separate fund only for</quote> and all that follows through the end and inserting <quote>shall only be used for the purposes described under subsection (c).</quote>; and</text> </subparagraph></paragraph><paragraph id="ide3e95208-92b7-4006-9560-de87f4956a2c"><enum>(2)</enum><text>by striking paragraph (2).</text>
 </paragraph></subsection><subsection id="idbe9fe62f-f826-4458-b566-f930a5048432"><enum>(b)</enum><header>Limitations on bills transferring funds</header><text>Section 2(b) of the Act of August 11, 1939 (<external-xref legal-doc="usc" parsable-cite="usc/15/713c-3">15 U.S.C. 713c–3(b)</external-xref>), as amended by subsection (a) of this section, is further amended by adding at the end the following:</text>

 <subparagraph id="id5adc0c96-105e-4b0c-9ce9-11cbc0b0c736"><enum>(A)</enum><header>In general</header><text>It shall not be in order in the Senate or the House of Representatives to consider any bill, resolution, amendment, or conference report that reduces any amount in the fund referred to in paragraph (1) in a manner that is inconsistent with such paragraph.</text>
 </subparagraph><subparagraph id="id01bdb39a-250d-4a79-bd9f-744f34135a02"><enum>(B)</enum><header>Limitation on changes to this paragraph</header><text>It shall not be in order in the Senate or the House of Representatives to consider any bill, resolution, amendment, or conference report that would repeal or otherwise amend this paragraph.</text>
 </subparagraph><subparagraph id="id30efb28f-6ac4-4c55-9400-cda76a730c3e"><enum>(C)</enum><header>Waiver</header><text>A provision of this paragraph may be waived or suspended in the Senate only by the affirmative vote of three-fifths of the Members, duly chosen and sworn.</text>
 </subparagraph><subparagraph id="idf152ca71-4911-4ab1-86eb-6f8f74217a53"><enum>(D)</enum><header>Appeals</header><text>An affirmative vote of three-fifths of the Members of the Senate, duly chosen and sworn, shall be required to sustain an appeal of the ruling of the Chair on the point of order raised under this paragraph.</text>
 </subparagraph><subparagraph id="id436868fe-2ac8-495c-aab4-b2a65d640567"><enum>(E)</enum><header>Rules of the Senate and the House of Representatives</header><text>This paragraph is enacted by Congress—</text> <clause id="idd4079130-d03b-436a-bd11-49dc5371c1b0"><enum>(i)</enum><text>as an exercise of the rulemaking power of the Senate and the House of Representatives, respectively, and is deemed to be part of the rules of each house, respectively, but applicable only with respect to the procedure to be followed in the House in the case of a bill, resolution, amendment, or conference report under this paragraph, and it supersedes other rules only to the extent that it is inconsistent with such rules; and</text>
 </clause><clause id="id82122306-bcba-4ccd-b9a7-1203d6632429"><enum>(ii)</enum><text>with full recognition of the constitutional right of either House to change the rules (so far as they relate to the procedure of that House) at any time, in the same manner, and to the same extent as in the case of any other rule of that House.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
