 <section changed="deleted" committee-id="SSCM00" id="H004B5DCA553647FD9A1811285C31CE00" reported-display-style="strikethrough" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>ROV In-Depth Examination Act of 2015</short-title></quote>.</text> </section><section changed="deleted" committee-id="SSCM00" id="H7E148FCA8E224984A5B84CDF2B59978C" reported-display-style="strikethrough"><enum>2.</enum><header>Recreational off-highway vehicle standards study</header> <subsection id="H56D5EED59D20479EAF951225B61163B7"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text>
 <paragraph id="H5CB2336ADE044614B9C1AEF2E28D1780"><enum>(1)</enum><header>Commission</header><text display-inline="yes-display-inline">The term <term>Commission</term> means the Consumer Product Safety Commission.</text> </paragraph><paragraph id="H13D088933DF542A4A5F0F48BCA59285F"><enum>(2)</enum><header>Recreational off-highway vehicle and ROV</header> <subparagraph id="id55ED419CDF5345AB9F7B060F98104C68"><enum>(A)</enum><header>In general</header><text>The term <term>recreational off-highway vehicle</term> or <term>ROV</term> means a motorized off-highway vehicle designed to travel on four or more tires, intended by the manufacturer for recreational use by one or more persons and having the following characteristics:</text>
 <clause id="H675EE9BF5A9445838DDC7EF7600CA15E"><enum>(i)</enum><text>A steering wheel for steering control.</text> </clause><clause id="H772E5A39814F420E884148D42F0B971B"><enum>(ii)</enum><text>Foot controls for throttle and service brake.</text>
 </clause><clause id="H514A615F549943CAA6847A2293E9ED8F"><enum>(iii)</enum><text>Non-straddle seating.</text> </clause><clause id="H177D226F78404AAA9675D9AF99C3BA0B"><enum>(iv)</enum><text>Maximum speed capability greater than 30 miles per hour.</text>
 </clause><clause id="HFF880019999748B2B9802D59219FE84E"><enum>(v)</enum><text>Gross vehicle weight rating no greater than 3,750 pounds.</text> </clause><clause id="H31D0575EC4C74D4593493034C584C45A"><enum>(vi)</enum><text>Less than 80 inches in overall width, exclusive of accessories.</text>
 </clause><clause id="HF75AE5F41CB84A24989C9696A66465C5"><enum>(vii)</enum><text>Engine displacement equal to or less than 61 cubic inches for gasoline fueled engines.</text> </clause><clause id="HC755765AA091489089467ACAFE708344"><enum>(viii)</enum><text>Identification by means of a 17-character personal or vehicle information number.</text>
 </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2936AF6D5F8240BAA9C72B2C2A90F690"><enum>(B)</enum><header>Exclusion</header><text>Such term does not include a prototype of a motorized, off-highway, all-terrain vehicle or other motorized, off-highway, all-terrain vehicle that is intended exclusively for research and development purposes unless the vehicle is offered for sale.</text>
					</subparagraph></paragraph></subsection><subsection id="HA69C5D8BA6E74A84AA8E3FC13029C76B"><enum>(b)</enum><header>No mandatory standards regarding performance or configuration of ROVs</header>
 <paragraph id="HF7980C94E27D49AD90DED0E15307009B"><enum>(1)</enum><header>In general</header><text>The Consumer Product Safety Commission shall have no authority to establish any standards concerning the performance or configuration of recreational off-highway vehicles until after the completion of the study required by subsection (c). This prohibition includes a prohibition on the exercise of any authority pursuant to section 27(e) of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2076">15 U.S.C. 2076(e)</external-xref>) to require ROV manufacturers to provide performance and technical data to prospective purchasers and to the first purchaser of an ROV for purposes other than resale.</text>
 </paragraph><paragraph id="HCEF19FD4EA704210B184D03863435ADF"><enum>(2)</enum><header>Voluntary standards</header><text>Nothing in this section shall be construed as suggesting that ROVs shall not be manufactured in compliance with applicable voluntary standards.</text>
				</paragraph></subsection><subsection id="HC90B4C54AB4F4E0E8B15232DE04B7F2C"><enum>(c)</enum><header>Study on proposed lateral stability and vehicle handling requirements</header>
				<paragraph id="id6735E7A7E60D47B4BDDC9C8F1F510C49"><enum>(1)</enum><header>Agreement</header>
 <subparagraph id="idEA6763ED8A33428D8A34F5DC723E2E12"><enum>(A)</enum><header>In general</header><text>The Commission shall seek to enter into an agreement with the National Academy of Sciences to perform the services covered by this subsection.</text>
 </subparagraph><subparagraph id="id64966348236B4EFFA40147F4F9B36726"><enum>(B)</enum><header>Timing</header><text>The Commission shall seek to enter into the agreement described in subparagraph (A) not later than the latest date by which the Commission considers reasonable for the National Academy of Sciences to begin performing the services covered by this subsection and complete them before the date described in paragraph (2)(D).</text>
					</subparagraph></paragraph><paragraph id="H1A867B2F627B4C4AAB859F87A8CFDE00"><enum>(2)</enum><header>Study</header>
 <subparagraph id="id6954D653A3434D62AFCC88CC1DDD9729"><enum>(A)</enum><header>In general</header><text>Under an agreement between the Commission and the National Academy of Sciences under this subsection, the National Academy of Sciences shall conduct a study on matters concerning the lateral stability and vehicle handling requirements proposed by the Commission in a notice of proposed rulemaking published in the Federal Register November 19, 2014 (79 Fed. Reg. 68964).</text>
 </subparagraph><subparagraph id="id585C460B65C84B309867367F44A4EA70"><enum>(B)</enum><header>Elements</header><text>The study carried under subparagraph (A) shall determine—</text> <clause id="H7EF4A1153F7246F3B4A3F2314D96A6F7"><enum>(i)</enum><text>the technical validity of the lateral stability and vehicle handling requirements described in subparagraph (A), for purposes of reducing the risk of ROV rollovers in the off-road environment, including the repeatability and reproducibility of testing for compliance with such requirements;</text>
 </clause><clause id="H8735E769CB1E4723BB03FE3CBE5AB7AF"><enum>(ii)</enum><text>the number of ROV rollovers that would be prevented if the proposed requirements were adopted;</text> </clause><clause id="H5C1223422B7446B1AB8F048D7A47000A"><enum>(iii)</enum><text>whether there is a technical basis for the proposal to provide information on a point-of-sale hangtag about a vehicle’s rollover resistance on a progressive scale; and</text>
 </clause><clause id="HC47D8A504B244468B3E518A4D4D576F6"><enum>(iv)</enum><text>the effect on the utility of ROVs used by the Armed Forces if the proposed requirements were adopted.</text>
 </clause></subparagraph><subparagraph id="H64F514D65DDB4793982129430C3FA832"><enum>(C)</enum><header>Consultation</header><text>In carrying out the study pursuant to subparagraph (A), the National Academy of Sciences shall consult with the Administrator of the National Highway Traffic Safety Administration and the Secretary of Defense.</text>
 </subparagraph><subparagraph id="id28CBC1FAEA8D43CC8545981723C93C0E"><enum>(D)</enum><header>Deadline and report</header><text>In carrying out the study pursuant to subparagraph (A), the National Academy of Sciences shall complete and transmit to the Commission a report containing the findings of the study not later than 2 years after the date of the enactment of this Act.</text>
 </subparagraph></paragraph><paragraph commented="no" id="HF6C4AEBED2D14F8393832E9630A539E3"><enum>(3)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">Not later than 5 days after receiving the report described in paragraph (2)(D) from the National Academy of Sciences, the Commission shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Energy and Commerce of the House of Representatives such report, along with such comments as the Commission may have concerning the report.</text>
 </paragraph><paragraph id="H3D665D9F05F34B7DB007451751081071"><enum>(4)</enum><header>Consideration</header><text>The Commission shall consider the results of the study conducted under this subsection in any subsequent rulemaking regarding the performance or configuration of ROVs, or the provision of point-of-sale information regarding ROV performance.</text>
				</paragraph><paragraph id="id50a513d6a3f14279876caabc03503737"><enum>(5)</enum><header>Alternate contract organization</header>
 <subparagraph id="id9ecc0d8b09964606a5e3785b6ff85c37"><enum>(A)</enum><header>In general</header><text>If the Commission is unable within the period prescribed in paragraph (1)(B) to enter into an agreement described in paragraph (1)(A) with the National Academy of Sciences on terms acceptable to the Commission, the Commission shall seek to enter into such an agreement with another appropriate organization that—</text>
 <clause id="idbee0962559b04b248d56a0655694b18f"><enum>(i)</enum><text>is not part of the Government;</text> </clause><clause id="id3464d1e97c1f42cfb87ea987f8a15ad4"><enum>(ii)</enum><text>operates as a not-for-profit entity; and</text>
 </clause><clause id="id7d354b55d2ae48a48d41aa59beac1686"><enum>(iii)</enum><text>has expertise and objectivity comparable to that of the National Academy of Sciences.</text> </clause></subparagraph><subparagraph id="ide72049ee47e648a2bbd8682eeb536888"><enum>(B)</enum><header>Treatment</header><text>If the Commission enters into an agreement with another organization as described in subparagraph (A), any reference in this section to the National Academy of Sciences shall be treated as a reference to the other organization.</text></subparagraph></paragraph></subsection></section></legis-body>
	<legis-body display-enacting-clause="no-display-enacting-clause" style="OLC">

 <paragraph id="id46cc6981-88ab-4c23-9809-3781cb71d4dd"><enum>(1)</enum><header>Commission</header><text display-inline="yes-display-inline">The term <term>Commission</term> means the Consumer Product Safety Commission.</text> </paragraph><paragraph id="id4cae514a-77a6-49b9-9af5-0421750692a0"><enum>(2)</enum><header>Recreational off-highway vehicle and ROV</header> <subparagraph id="id63c30cc1-b662-4451-8282-482ceb1b42f0"><enum>(A)</enum><header>In general</header><text>The term <term>recreational off-highway vehicle</term> or <term>ROV</term> means a motorized off-highway vehicle designed to travel on four or more tires, intended by the manufacturer for recreational use by one or more persons and having the following characteristics:</text>

 </clause><clause id="idcf5c9772-173e-40ff-af66-27707bc2cd79"><enum>(v)</enum><text>Gross vehicle weight rating no greater than 3,750 pounds.</text> </clause><clause id="idd194cffe-49f9-4000-8e7b-951ad18ee968"><enum>(vi)</enum><text>Less than 80 inches in overall width, exclusive of accessories.</text>
 </clause><clause id="id1dcf3cbb-ea3c-4979-ba52-85782351e8e0"><enum>(vii)</enum><text>Engine displacement equal to or less than 61 cubic inches for gasoline fueled engines.</text> </clause><clause id="idd94ab626-2a53-4c10-b02f-1537fcf7c3f5"><enum>(viii)</enum><text>Identification by means of a 17-character personal or vehicle information number.</text>

 </subparagraph><subparagraph id="id0c3c26d5-e597-431e-884a-a788e68a7b46"><enum>(B)</enum><header>Timing</header><text>The Commission shall seek to enter into the agreement described in subparagraph (A) not later than the latest date by which the Commission considers reasonable for the National Academy of Sciences to begin performing the services covered by this subsection and complete them before the date described in paragraph (2)(D).</text>
					</subparagraph></paragraph><paragraph id="idd8c877d4-2b4b-4b41-b2fa-11697af6416d"><enum>(2)</enum><header>Study</header>
 <subparagraph id="id68a8a8de-07ed-4f6b-b656-c55d7185d1c9"><enum>(A)</enum><header>In general</header><text>Under an agreement between the Commission and the National Academy of Sciences under this subsection, the National Academy of Sciences shall conduct a study on matters concerning the lateral stability and vehicle handling requirements proposed by the Commission in a notice of proposed rulemaking published in the Federal Register November 19, 2014 (79 Fed.  </subparagraph><subparagraph id="id6ca1fbb6-58a8-4730-97f3-072af7955186"><enum>(B)</enum><header>Elements</header><text>The study carried under subparagraph (A) shall determine—</text> <clause id="id221a7a79-ee45-4ef4-9676-7cf4582c414a"><enum>(i)</enum><text>the technical validity of the lateral stability and vehicle handling requirements described in subparagraph (A), for purposes of reducing the risk of ROV rollovers in the off-road environment, including the repeatability and reproducibility of testing for compliance with such requirements; and</text>
 </clause><clause id="id7c8e302d-beca-4cc0-8728-6ff47452dea9"><enum>(ii)</enum><text>whether there is a technical basis for the proposal to provide information on a point-of-sale hangtag about a vehicle’s rollover resistance on a progressive scale.</text>
 </clause></subparagraph><subparagraph id="id6274ccda-8f18-4eef-8f9f-84ae2fc4efe9"><enum>(C)</enum><header>Consultation</header><text>In carrying out the study pursuant to subparagraph (A), the National Academy of Sciences shall consult with the Administrator of the National Highway Traffic Safety Administration and the Secretary of Defense.</text>
 </subparagraph><subparagraph id="idd493a01d-6667-41b1-82b7-de1bb8c3bdd9"><enum>(D)</enum><header>Deadline and report</header><text>In carrying out the study pursuant to subparagraph (A), the National Academy of Sciences shall complete and transmit to the Commission, the Committee on Commerce, Science, and Transportation of the Senate, and the Committee on Energy and Commerce of the House of Representatives a report containing the findings of the study not later than 480 days after the date of the enactment of this Act.</text>
 </subparagraph></paragraph><paragraph id="id00beae93-498e-4a7b-9a8a-b7cb89e2738e"><enum>(3)</enum><header>Consideration</header><text>The Commission shall consider the results of the study conducted under this subsection in any subsequent rulemaking regarding the performance or configuration of ROVs, or the provision of point-of-sale information regarding ROV performance.</text>
				</paragraph><paragraph id="id2211f82e-757f-45c1-8046-47cf16ab5bc8"><enum>(4)</enum><header>Alternate contract organization</header>
