<official-title>To amend the Foreign Intelligence Surveillance Act of 1978 to provide for the designation of Foreign Intelligence Surveillance Court judges by the President, majority of the Supreme Court, Speaker and minority leader of the House of Representatives, and majority leader and minority leader of the Senate.</official-title>

<section id="HBD30AE09D79E48CA90B786960CAE178B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>FISA Court Oversight Underscoring Responsibility and Transparency Act</short-title></quote> or the <quote><short-title>FISA COURT Act</short-title></quote>.</text></section> <section id="H21A287E41518446FACF88D59945DC6A2"><enum>2.</enum><header>Designation of Foreign Intelligence Surveillance Court judges</header><text display-inline="no-display-inline">Section 103 of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1803">50 U.S.C. 1803(a)</external-xref>) is amended—</text> 
<paragraph id="H7EFAD0E4252B43FEA75128A6D19A82F4"><enum>(1)</enum><text>in subsection (a), by striking paragraph (1) and inserting the following new paragraph:</text> <quoted-block display-inline="no-display-inline" id="H7835CCB6A70648A2B5DD1EB5F22F0E7A" style="traditional"> <paragraph id="HBC8D95612CD34C6785303E562ECF0163" indent="up1"><enum>(1)</enum> <subparagraph commented="no" display-inline="yes-display-inline" id="HD57621E69C3D42AD8C36EA993EE4086A"><enum>(A)</enum><text>There is established a court which shall have jurisdiction to hear applications for and grant orders approving electronic surveillance anywhere within the United States under the procedures set forth in this Act.</text></subparagraph> 
<subparagraph id="HC434506F0A1B45FC82E6CBB2FC6177AD" indent="up1"><enum>(B)</enum><text>The court established under paragraph (1) shall consist of 11 publicly designated district court judges, of whom—</text> <clause id="H92C941CD17694F64ADC6C5667683946F"><enum>(i)</enum><text>2 judges shall be designated by the President;</text></clause> 
<clause id="HAC3CCABC7CD146D39D178037E1E79574"><enum>(ii)</enum><text>1 judge shall be designated by a majority of the Supreme Court;</text></clause> <clause id="H10A6AE8706234975B9971FD3521E75FE"><enum>(iii)</enum><text>2 judges shall be designated by the Speaker of the House of Representatives;</text></clause> 
<clause id="H2E4A2BBB5EB44721ABE7DC74AD13D44B"><enum>(iv)</enum><text>2 judges shall be designated by the minority leader of the House of Representatives;</text></clause> <clause id="HC44A65F0F3AE47578D8626574F9F4F8C"><enum>(v)</enum><text>2 judges shall be designated by the majority leader of the Senate; and</text></clause> 
<clause id="H817BC9C20FCB4D3DA5108FECAFE8170C"><enum>(vi)</enum><text>2 judges shall be designated by the minority leader of the Senate.</text></clause></subparagraph> <subparagraph id="H166E37157389402CB61F1F427115E336" indent="up1"><enum>(C)</enum><text>No judge designated under this subsection (except when sitting en banc under paragraph (2)) shall hear the same application for electronic surveillance under this Act which has been denied previously by another judge designated under this subsection. If any judge so designated denies an application for an order authorizing electronic surveillance under this Act, such judge shall provide immediately for the record a written statement of each reason for his decision and, on motion of the United States, the record shall be transmitted, under seal, to the court of review established in subsection (b).</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H9E3688CBA2DC48B59FFA36DD1EFBFFBA"><enum>(2)</enum><text>in subsection (b), by striking <quote>The Chief Justice</quote> and inserting <quote>A majority of the Supreme Court</quote>.</text></paragraph></section> </legis-body> </bill>
