 <section id="HA8BAF7CB7F95417FB9F471D9601F1FA5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Senior$afe Act of 2016</short-title></quote>.</text> </section><section id="H8AD759CCD68143CDAAABF8270DC5C649"><enum>2.</enum><header>Immunity</header> <subsection id="H5A7972D563AF47BE853FDA1403A49CE7"><enum>(a)</enum><header>Definitions</header><text>In this Act—</text>
 <paragraph id="H70F485DEB1974CA48FDD25D0F1A831D1"><enum>(1)</enum><text>the term <quote>Bank Secrecy Act Officer</quote> means an individual responsible for ensuring compliance with the requirements mandated by subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/53">chapter 53</external-xref> of title 31, United States Code;</text>
 </paragraph><paragraph id="H190B0C76E6F84D0C91AD1711BA227CBB"><enum>(2)</enum><text>the term <quote>broker-dealer</quote> means a broker or dealer, as those terms are defined, respectively, in section 3(a) of the Securities Exchange Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/15/78c">15 U.S.C. 78c(a)</external-xref>);</text>
 </paragraph><paragraph id="H72127EE1E18846B08FDE3A31A9321181"><enum>(3)</enum><text>the term <quote>covered agency</quote> means—</text> <subparagraph id="H4929FA2A8D3C427699328F19965F18A4"><enum>(A)</enum><text>a State financial regulatory agency, including a State securities or law enforcement authority;</text>
 </subparagraph><subparagraph id="H7E850A99C3CB462D9FF5A3E4518390B1"><enum>(B)</enum><text>each of the Federal financial institutions regulatory agencies;</text> </subparagraph><subparagraph id="H9937A599D0354AB3AA558ACB0D26B4F8"><enum>(C)</enum><text>the Securities and Exchange Commission;</text>
 </subparagraph><subparagraph id="HB89AB44E120C49D3B19E7CE5660C7EAA"><enum>(D)</enum><text>a law enforcement agency; and</text> </subparagraph><subparagraph id="H987493C2FB8248AABBFB14920EEF25F9"><enum>(E)</enum><text>and State or local agency responsible for administering adult protective service laws;</text>
 </subparagraph></paragraph><paragraph id="HC812F3328B9E49A5850251C8EA8BC3F6"><enum>(4)</enum><text>the term <quote>covered financial institution</quote> means—</text> <subparagraph id="H216BA917E9744E4787F87EB8417D7CC2"><enum>(A)</enum><text>a credit union;</text>
 </subparagraph><subparagraph id="H9144BDC856E14E62B9445C9E53DD6C9A"><enum>(B)</enum><text>a depository institution;</text> </subparagraph><subparagraph id="HD99D7157971D4E7BBD60A682CABEE09E"><enum>(C)</enum><text>an investment advisor;</text>
 </subparagraph><subparagraph id="HED284CF1A2634359B105D85E34F40507"><enum>(D)</enum><text>a broker-dealer; and</text> </subparagraph><subparagraph id="H93FF68C87F0143BAAF8E93B9B8F98C92"><enum>(E)</enum><text>an insurance company;</text>
 </subparagraph></paragraph><paragraph id="H862ED962439E4199BBA5D914BE931B6E"><enum>(5)</enum><text>the term <quote>credit union</quote> has the meaning given that term in section 2 of the Dodd-Frank Wall Street Reform and Consumer Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/12/5301">12 U.S.C. 5301</external-xref>);</text>
 </paragraph><paragraph id="HA69DB500CAF146E1968E4FFA4095DBD2"><enum>(6)</enum><text>the term <quote>depository institution</quote> has the meaning given the term in section 3(a) of the Federal Deposit Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1813">12 U.S.C. 1813(a)</external-xref>);</text>
 </paragraph><paragraph id="HC5B291F1765A4E03AA52EEA39D001BB5"><enum>(7)</enum><text>the term <quote>exploitation</quote> means the fraudulent or otherwise illegal, unauthorized, or improper act or process of an individual, including a caregiver or fiduciary, that—</text>
 <subparagraph id="H41AA6A8235B04202AB498EFB457E091B"><enum>(A)</enum><text>uses the resources of a senior citizen for monetary personal benefit, profit, or gain; or</text> </subparagraph><subparagraph id="H211D22901D4341AC8CD40321AE364F67"><enum>(B)</enum><text>results in depriving a senior citizen of rightful access to or use of benefits, resources, belongings or assets;</text>
 </subparagraph></paragraph><paragraph id="HE2475407DC94418996E825EADBF962AD"><enum>(8)</enum><text>the term <quote>Federal financial institutions regulatory agencies</quote> has the meaning given the term in section 1003 of the Federal Financial Institutions Examination Council Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/12/3302">12 U.S.C. 3302</external-xref>);</text>
 </paragraph><paragraph id="H819A748F109A40E595FAD167A7F39B65"><enum>(9)</enum><text>the term <quote>investment adviser</quote> has the meaning given the term in section 202 of the Investment Advisers Act of 1940 (<external-xref legal-doc="usc" parsable-cite="usc/15/80b-2">15 U.S.C. 80b-2</external-xref>);</text>
 </paragraph><paragraph id="HC30DDC90697743DDAE7E602E8724BCEB"><enum>(10)</enum><text display-inline="yes-display-inline">the term <quote>insurance company</quote> has the meaning given the term in section 2(a) of the Investment Company Act of 1940 (<external-xref legal-doc="usc" parsable-cite="usc/15/80a-2">15 U.S.C. 80a–2(a)</external-xref>);</text>
 </paragraph><paragraph id="H28E991A3B49946079044BAFE2D174E2C"><enum>(11)</enum><text>the term <quote>registered representative</quote> means an individual who represents a broker-dealer in effecting or attempting to affect a purchase or sale of securities;</text>
 </paragraph><paragraph id="HCD757E9EE64743798BAC19D35C2352F5"><enum>(12)</enum><text>the term <quote>senior citizen</quote> means an individual who is not less than 65 years of age; and</text> </paragraph><paragraph id="H2D7A9B488E5946C6A284CC68A0DCA9C9"><enum>(13)</enum><text>the term <quote>State securities or law enforcement authority</quote> has the meaning given the term in section 24(f)(4) of the Securities Exchange Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/15/78x">15 U.S.C. 78x(f)(4)</external-xref>).</text>
				</paragraph></subsection><subsection id="H375D4E13E63C4AF3A70C00D69D6520E9"><enum>(b)</enum><header>Immunity from suit</header>
 <paragraph id="HF109C02FF6D84A1BB05B1CD0AEA3ADF2"><enum>(1)</enum><header>Immunity for individuals</header><text>An individual who has received the training described in section 3 shall not be liable, including in any civil or administrative proceeding, for disclosing the possible exploitation of a senior citizen to a covered agency if the individual, at the time of the disclosure—</text>
 <subparagraph id="H684C2EAD0DEB4FFE83FB32CAE6E37119"><enum>(A)</enum><text>served as a supervisor, compliance officer (including a Bank Secrecy Act Officer), or registered representative for a covered financial institution; and</text>
 </subparagraph><subparagraph id="HF288986C50C2412FACAC62173BF01294"><enum>(B)</enum><text>made the disclosure with reasonable care including reasonable efforts to avoid disclosure other than to a covered agency.</text>
 </subparagraph></paragraph><paragraph id="H44CFB1B4125B4457BF794A8E75473A32"><enum>(2)</enum><header>Immunity for covered financial institutions</header><text>A covered financial institution shall not be liable, including in any civil or administrative proceeding, for a disclosure made by an individual described in paragraph (1) if—</text>
 <subparagraph id="H01860C46A8854060A1B45C4F82D44CD7"><enum>(A)</enum><text>the individual was employed by, or, in the case of a registered representative, affiliated or associated with, the covered financial institution at the time of the disclosure; and</text>
 </subparagraph><subparagraph id="HA9A83D350C6746AFA647EEC1832939B9"><enum>(B)</enum><text>before the time of the disclosure, the covered financial institution provided the training described in section 3 to each individual described in section 3(a).</text>
					</subparagraph></paragraph></subsection></section><section id="H7607D62F3FBD43E6864FE9EA5F1852F0"><enum>3.</enum><header>Training required</header>
 <subsection id="HF7C6E679607D43619DE66D2807C0B86A"><enum>(a)</enum><header>In general</header><text>A covered financial institution may provide training described in subsection (b)(1) to each officer or employee of, or registered representative affiliated or associated with, the covered financial institution who—</text>
 <paragraph id="H4E5A933EA45F4187BF8121ECC3DDFAFB"><enum>(1)</enum><text>is described in section 2(b)(1)(A);</text> </paragraph><paragraph id="HBFB8FBAD6E594A70BB5DE709CD6DB0F9"><enum>(2)</enum><text>may come into contact with a senior citizen as a regular part of the duties of the officer, employee, or registered representative; or</text>
 </paragraph><paragraph id="HBDD1394509E74C098C95C3949C0822C7"><enum>(3)</enum><text>may review or approve the financial documents, records, or transactions of a senior citizen in connection with providing financial services to a senior citizen.</text>
				</paragraph></subsection><subsection id="H6D4926419E504A49AA76529F9112249F"><enum>(b)</enum><header>Training</header>
 <paragraph id="H64048B1A83F6463F8B90479AC9D78806"><enum>(1)</enum><header>In general</header><text>The training described in this paragraph shall—</text> <subparagraph id="H6A55B79C5F6E47158E2A536816D2C363"><enum>(A)</enum><text>instruct any individual attending the training on how to identify and report the suspected exploitation of a senior citizen;</text>
 </subparagraph><subparagraph id="HEF2A676D408E4CE593FC06C3BC169B2C"><enum>(B)</enum><text>discuss the need to protect the privacy and respect the integrity of each individual customer of a covered financial institution; and</text>
 </subparagraph><subparagraph id="H6618584C7B794B35AD2DE89B0B7847A7"><enum>(C)</enum><text>be appropriate to the job responsibilities of the individual attending the training.</text> </subparagraph></paragraph><paragraph id="HE6F0E9F24DF143E39DF8BB4E477B55A3"><enum>(2)</enum><header>Timing</header><text>The training required under subsection (a) shall be provided as soon as reasonably practicable but not later than 1 year after the date on which an officer, employee, or registered representative begins employment with or becomes affiliated or associated with the covered financial institution.</text>
 </paragraph><paragraph id="H8142729C00DF4E2A8EB490B25C1EF5E4"><enum>(3)</enum><header>Bank Secrecy Act Officer</header><text display-inline="yes-display-inline">An individual who is designated as a compliance officer under an anti-money laundering program established pursuant to section 5318(h) of title 31, United States Code, shall be deemed to have received the training described under this subsection.</text>
 </paragraph></subsection></section><section id="HEA6507E3940049E1BB913AD9ADC39A16"><enum>4.</enum><header>Relationship to State law</header><text display-inline="no-display-inline">Nothing in this Act shall be construed to preempt or limit any provision of State law, except only to the extent that section 2 provides a greater level of protection against liability to an individual described in section 2(b)(1) or to a covered financial institution described in section 2(b)(2) than is provided under State law.</text>
