<section id="HBD1879F6048948F5881D59B772967320" section-type="section-one"><enum>1.</enum><header>Short Title</header><text display-inline="no-display-inline">This concurrent resolution may be cited as the <quote><short-title>Protection of the Right of Tribes to stop the Export of Cultural and Traditional Patrimony Resolution</short-title></quote> or the <quote><short-title>PROTECT Patrimony Resolution</short-title></quote>.</text></section> <section id="H360BC169EDD248F5A48110D8C2A590E2"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this resolution:</text> 
<paragraph id="HBE06078D7E764847AAA26AC547BEA343"><enum>(1)</enum><header>Native American</header><text>The term <term>Native American</term> means—</text> <subparagraph id="H87F57B80E040489B84BE46F3FEF621D3"><enum>(A)</enum><text>with respect to an individual, an individual who is a member of an Indian tribe (as defined in section 2 of the Native American Graves Protection and Repatriation Act (<external-xref legal-doc="usc" parsable-cite="usc/25/3001">25 U.S.C. 3001</external-xref>)); and</text></subparagraph> 
<subparagraph id="HB14EEB66BE914093860B4021429D6194"><enum>(B)</enum><text>with respect to the cultural nature or significance of an item, right, or other object or concept, being of or significant to—</text> <clause id="H1FFB894BE6124F6AA6B1057B06874862"><enum>(i)</enum><text>an Indian tribe (as defined in section 2 of the Native American Graves Protection and Repatriation Act (<external-xref legal-doc="usc" parsable-cite="usc/25/3001">25 U.S.C. 3001</external-xref>)); or</text></clause> 
<clause id="H3C0BE3BDFEC34931ACE6A3DC0BD9252F"><enum>(ii)</enum><text>a Native Hawaiian organization (as defined in that section (<external-xref legal-doc="usc" parsable-cite="usc/25/3001">25 U.S.C. 3001</external-xref>)).</text></clause></subparagraph></paragraph> <paragraph id="H56EFFF35DBA744D881B8A6D74BEB95AB"><enum>(2)</enum><header>Tribal cultural item</header><text>The term <quote>tribal cultural item</quote> has the meaning given the term <quote>cultural item</quote> in section 2 of the Native American Graves Protection and Repatriation Act (<external-xref legal-doc="usc" parsable-cite="usc/25/3001">25 U.S.C. 3001</external-xref>).</text></paragraph></section> 
<section id="H5A60C7C95B654F90B72F815221FAE2C8"><enum>3.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text> <paragraph id="HB024A390A08F427BB2A6C8D55361824A"><enum>(1)</enum><text>Tribal cultural items—</text> 
<subparagraph id="HF1CAB8AA5D944896A00DFFD514CFE472"><enum>(A)</enum><text>have ongoing historical, traditional, or cultural importance central to a Native American group or culture;</text></subparagraph> <subparagraph id="H0CD7F59B55C2418BB07F94111F7C668C"><enum>(B)</enum><text>cannot be alienated, appropriated, or conveyed by any individual; and</text></subparagraph> 
<subparagraph id="HE3C3BB3F3AB6401FA4365A7DCF80037F"><enum>(C)</enum><text>are vital to Native American cultural survival and the maintenance of Native American ways of life.</text></subparagraph></paragraph> <paragraph id="HB6A0E2C86517420BBCD43419960EA42E"><enum>(2)</enum><text>The nature and description of tribal cultural items are sensitive and to be treated with respect and confidentiality, as appropriate.</text></paragraph> 
<paragraph id="H1181EB0F07CD4EE198EF801F1BE25EB9"><enum>(3)</enum><text>Violators often export tribal cultural items internationally with the intent of evading Federal and tribal laws.</text></paragraph> <paragraph id="HF22B38FB600D44309A313CE68B03784E"><enum>(4)</enum><text>Tribal cultural items continue to be removed from the possession of Native Americans and sold in black or public markets in violation of Federal and tribal laws, including laws designed to protect Native American cultural property rights.</text></paragraph> 
<paragraph id="HA425029758184A398151DFEA829BAA9B"><enum>(5)</enum><text>The illegal trade of tribal cultural items involves a sophisticated and lucrative black market, where the items are traded through domestic markets and then are often exported internationally.</text></paragraph> <paragraph id="HC7679C59F16F486DA7976DBEB3C4F7A1"><enum>(6)</enum><text>Auction houses in foreign countries have held sales of tribal cultural items from the Pueblo of Acoma, the Pueblo of Laguna, the Pueblo of San Felipe, the Hopi Tribe, and other Indian tribes.</text></paragraph> 
<paragraph id="HDBD63A571D124DE58E5432936C452BC3"><enum>(7)</enum><text>After tribal cultural items are exported internationally, Native Americans have difficulty stopping the sale of the items and securing their repatriation to their home communities, where the items belong.</text></paragraph> <paragraph id="HDF1DB3846D414B24BF09B54B774D4A90"><enum>(8)</enum><text>Federal agencies have a responsibility to consult with Native Americans to stop the theft, illegal possession or sale, transfer, and export of tribal cultural items.</text></paragraph> 
<paragraph id="H19DF08F2A23243379AC2EF69A672642F"><enum>(9)</enum><text>An increase in the investigation and successful prosecution of violations of the Native American Graves Protection and Repatriation Act (<external-xref legal-doc="usc" parsable-cite="usc/25/3001">25 U.S.C. 3001 et seq.</external-xref>) and the Archaeological Resources Protection Act of 1979 (<external-xref legal-doc="usc" parsable-cite="usc/16/470aa">16 U.S.C. 470aa et seq.</external-xref>) is necessary to deter illegal trading in tribal cultural items.</text></paragraph> <paragraph id="H513BD24FA74C47C8BE650E68B7B09FF9"><enum>(10)</enum><text>Many Indian tribes and tribal organizations have passed resolutions condemning the theft and sale of tribal cultural items, including the following:</text> 
<subparagraph id="HAF5CF4BF716045DA8D8C4C37B8256D5E"><enum>(A)</enum><text display-inline="yes-display-inline">The National Congress of American Indians passed Resolutions SAC–12–008 and SD–15–075 to call on the United States, in consultation with Native Americans—</text> <clause id="H3D99BE0EB4E94B068D087EAF8DF78FE3"><enum>(i)</enum><text display-inline="yes-display-inline">to address international repatriation; and</text></clause> 
<clause id="H5DCC683E11B349CBA8D7B8C6E2450773"><enum>(ii)</enum><text display-inline="yes-display-inline">to take affirmative actions to stop the theft and illegal sale of tribal cultural items both domestically and internationally.</text></clause></subparagraph> <subparagraph id="H02C7B4CEAB8D4E6A80BAC597F0D5E710"><enum>(B)</enum><text display-inline="yes-display-inline">The All Pueblo Council of Governors, representative of 20 Pueblo Indian tribes—</text> 
<clause id="H293A631BA7964B9B911ABA802F4D3733"><enum>(i)</enum><text display-inline="yes-display-inline">noted that the Pueblo Indian tribes of the Southwestern United States have been disproportionately affected by the sale of tribal cultural items both domestically and internationally in violation of Federal and tribal laws; and</text></clause> <clause id="H4F71AB9C21D94B31B61E5A48151B6583"><enum>(ii)</enum><text display-inline="yes-display-inline">passed Resolutions 2015–12 and 2015–13 to call on the United States, in consultation with Native Americans—</text> 
<subclause id="HCED99CA7FA664263AAB2E63737CE5A4A"><enum>(I)</enum><text display-inline="yes-display-inline">to address international repatriation; and</text></subclause> <subclause id="H29FB927C688C429BA78DEC66A2799D98"><enum>(II)</enum><text display-inline="yes-display-inline">to take affirmative actions to stop the theft and illegal sale of tribal cultural items both domestically and internationally.</text></subclause></clause></subparagraph> 
<subparagraph id="H2BD3E1AE96DD494A80EC12EF52F584EE"><enum>(C)</enum><text display-inline="yes-display-inline">The United South and Eastern Tribes, an intertribal organization comprised of 26 federally recognized Indian tribes, passed Resolution 2015:007, which calls on the United States to address all means to support the repatriation of tribal cultural items from beyond United States borders.</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HB58D2BE7E2504413AC067802C8C8B6F2"><enum>(D)</enum><text display-inline="yes-display-inline">The Inter-Tribal Council of the Five Civilized Tribes, uniting the Chickasaw, Choctaw, Cherokee, Muscogee (Creek), and Seminole Nations, passed Resolution 12–07, which requests that the United States, after consultation with Native Americans, assist in international repatriation and take immediate action to address repatriation.</text></subparagraph></paragraph></section> 
<section commented="no" display-inline="no-display-inline" id="H8A62BD9E56E44A7082C23BE578D58243"><enum>4.</enum><header>Declaration of Congress</header><text display-inline="no-display-inline">Congress—</text> <paragraph id="H5633B24DB5354FAAA5CE4666157A499B"><enum>(1)</enum><text>condemns the theft, illegal possession or sale, transfer, and export of tribal cultural items;</text></paragraph> 
<paragraph id="H9E6EBA7CFADE4FCDB279748EB026651F"><enum>(2)</enum><text display-inline="yes-display-inline">calls on the Secretary of the Interior, the Secretary of State, the Secretary of Commerce, the Secretary of Homeland Security, and the Attorney General to consult with Native Americans, including traditional Native American religious leaders, in addressing the practices described in paragraph (1)—</text> <subparagraph id="HF6421EE2F8234184B5574EEC900E8CCD"><enum>(A)</enum><text display-inline="yes-display-inline">to take affirmative action to stop the practices; and</text></subparagraph> 
<subparagraph id="HABB4EF05DD4E4E12A6E38CB5D4B4BC0A"><enum>(B)</enum><text display-inline="yes-display-inline">to secure repatriation of tribal cultural items to Native Americans;</text></subparagraph></paragraph> <paragraph id="H55B4EAD8C5BC43B9BF0A7B34C53B7F6C"><enum>(3)</enum><text>supports the efforts of the Comptroller General of the United States—</text> 
<subparagraph id="H40F621A3B490434BAC7F2749D033B57C"><enum>(A)</enum><text>to determine the scope of illegal trafficking in tribal cultural items domestically and internationally; and</text></subparagraph> <subparagraph id="HA5B739ACBD8F4532A00F746A1777AB8E"><enum>(B)</enum><text>to discuss with Native Americans, including traditional Native American religious leaders, relevant Federal officials, and other individuals and entities, as appropriate, the steps required—</text> 
<clause id="H7E507CFF176B4D3CAA5EAA065622A6E6"><enum>(i)</enum><text display-inline="yes-display-inline">to end illegal trafficking in, and the export of, tribal cultural items; and</text></clause> <clause id="HD9DAF0097F324BE19C08242168A45237"><enum>(ii)</enum><text display-inline="yes-display-inline">to secure repatriation of tribal cultural items to the appropriate Native Americans;</text></clause></subparagraph></paragraph> 
<paragraph id="H4D1DC4A05F9B48608B227B7C6DEFEEAB"><enum>(4)</enum><text>supports the development of explicit restrictions on the export of tribal cultural items; and</text></paragraph> <paragraph id="HFC8BF47647C54AD398B17ED3B4F993F7"><enum>(5)</enum><text>encourages State and local governments and interested groups and organizations to work cooperatively in—</text> 
<subparagraph id="HB2AD09EE858D49C8902C67C676AA6D7B"><enum>(A)</enum><text>deterring the theft, illegal possession or sale, transfer, and export of tribal cultural items; and</text></subparagraph> <subparagraph id="H9ACB0663DC8342E8B4155A3E3C3661B9"><enum>(B)</enum><text>securing the repatriation of tribal cultural items to the appropriate Native Americans.</text></subparagraph></paragraph></section>
